A Tour of the Public Safety Facility is scheduled for 5:30 P.M. Food will be available prior to the Council meeting. An EDA Meeting will immediately follow the Regular City Council meeting. Agenda Item #3A: Enclosed is the Verified Claims List for Council approval. Agenda Item #3B: This item has been postponed. '. Agenda Item #3C: The new Cub Foods store at 23800 State Highway 7 has applied for a 3.2 percent "off-sale" malt liquor license. The applicant has met all of the application requirements and the background checks were clear. The City's ordinance does state that no sales of 3.2 percent malt liquor shall be made on any Sunday between the hours of 1:00 AM and 12:00 Noon, and no sales shall be made between the hours of 1:00 AM and 8:00 AM on any other day. Cub Foods has received a copy of the City's ordinance outlining these hours. Council should approve a Resolution granting Cub Foods a 3.2 Percent "off-sale" Malt Liquor License. Agenda Item #3D: The new Cub Foods Store at 23800 State Highway 7 has applied for a License to Sell Tobacco Products. The applicant has met all of the application requirements and the background check was clear. The applicant has paid the ,necessary fees for the license period from the opening of the store (anticipated mid-October) through October 31,2004. Council should approve a Resolution granting Cub Foods a License to Sell Tobacco Products. Agenda Item #3E: The public works director will present a memorandum regarding the purchase of a lawn mower with cab. This purchase is included in the 2003 capital equipment replacement program; the approximately $23,000 price in the State contract is within amount budgeted in the CIP. Agenda Item #3F: The City typically repairs concrete curbs and gutters in targeted neighborhoods as part of its annual maintenance program. This work is contracted out. The work for 2003 will be $7,200 and done in the Boulder Bridge area. ft ~J PRINTED ON RECYCLED PAPER .. Executive Summary - City Council Meeting of 25 August, 2003 Page 2 of3 I Agenda Item #30: Bids were received for the purchase and installation of a beverage cooler for the Shorewood Plaza Liquor Store on Wednesday, August 20th, 2003. The low bidder is Minnetonka Refrigeration in the amount of $49,640. Staff recommends approval of the resolution that accepts the bids and awards the contract to Minnetonka Refrigeration. Agenda Item #3H: Quotes were obtained for emergency removal and replacement of the furnace and air conditioner that provides ventilation to the finance and engineering areas of the city hall building. Merit Heating and Cooling, Inc. provided the quote with the best combination of price and warranty in the amount of $7,353, before rebates of $950. Staff recommends approval of the emergency purchase of this HV AC equipment from the Public Facilities Fund. Agenda Item #5A: This item is the Lake Minnetonka Communications Commission and the Community Television Studio recognition of the Shorewood City Council for the . production of programming or volunteer service to Community Television. Agenda Item #5B: Hennepin County Transportation Department Director Jim Grube will present a status report on the County Road 19 Intersection project. Staff suggests moving Mr. Grube's report to later in the agenda, in conjunction with the Preliminary (re)Design of the CR 19 intersection project, Item #1OA. This would provide for greater continuity of discussion. Agenda Item #8A: Fred and Ellen Johnson propose to remodel their home at 5695 Christmas Lake Point, including adding another story of living space above certain portions of the home. Since the existing building is nonconforming relative to front and lakeshore setback requirements, they have requested a variance. Based upon staff input, the Johnsons have drastically revised their original plans to minimize the amount of variance necessary. They also propose to correct a number of deficiencies (e.g. reducing hardcover on the site, removing two nonconforming accessory buildings and removing . patio area that is too close to the lake). The Planning Commission agreed unanimously with the Planning Director's recommendation to approve the variance. A draft resolution has been prepared for the Council's consideration. Agenda Item #8B: The Planning Commission has recommended approval of a special home occupation permit for Eileen Hickey. Ms. Hickey proposes to teach group music lessons in her home at 5320 Shady Hills Circle. A draft resolution has been prepared for the Council's approval. Agenda Item #8C: M.J. McGregor has asked the City to amend the R-C zoning district to include "custom woodworking shop" as a conditional use. She then requests approval of a conditional use permit, pursuant to the amended Code. The Planning Commission agreed that the proposed change was not unlike a home occupation in a residential zoning district. A draft ordinance and draft resolution have been prepared for the Council's consideration. .. . . Executive Summary - City Council Meeting of 25 August, 2003 Page 3 of 3 Agenda Item #8D: Rich Anderson and Ted Hanna have purchased the property at 20995 Forest Drive. They propose to demolish the existing home and subdivide the property into two building sites. Since the proposed lots comply with the requirements of the R- ID Zoning District, the Planning Commission voted unanimously to recommend approval of the minor division. A draft resolution has been prepared for the Council's consideration. Agenda Item #8E: The owners of Dimensions in Floors propose to add on to the rear of their building at 5660 County Road 19. The Planning Commission recommended approval of their site plan, subject to a number of conditions, including approval of grading, drainage and erosion control by the City Engineer and a revised landscape plan. A draft resolution has been prepared for the Council's consideration. Agenda Item #9A: Waste Management has requested that it be allowed to pick up refuse from its customers on Christmas Lake Point on a day other than Wednesday, as it does not have a small collection truck in the area on that day. Staff will present its recommendation on this request during the Council meeting. Agenda Item #9B: Staff is recommending approval of the 2004 Excelsior Fire District Budget as presented by Chief DuCharme at the August 11 budget work session. Agenda Item #9C: Staff is recommending approval of the 2004 South Lake Minnetonka Police Department Budget, and the City's contribution, as presented by Chief Litsey at the August 11 budget work session. Agenda Item #9D: Stan Taube has requested that the City contribute to the costs of the drainage elements of the Lake Linden Trail project. Agenda Item #lOA: The County Road 19 intersection improvement project has been redesigned to address several issues that have arisen since Shorewood and Tonka Bay approved a preliminary layout in 2001. Essentially, the approval process is starting over for the cities. Don Sterna, principal with WSB & Associates, will present the new design. PLANNING . Commissioner White reported on matters considered and actions taken at the August 5, 2003, Planning Commission Meeting (as detailed in the minutes of that meeting). 9. GENERALINEW BUSINESS A. Selection of Firm for Space Needs Study Administrator Dawson explained the 2003 City budget allocated approximately $15,000 to conduct an analysis of space needs for City Hall operations. Staff had sent out Request for Proposals, had received responses from eight firms, and had interviewed four firms for further discussion. Of these four firms, the Staff interview team had unanimously recommended Boarman Kroos Vogel (BKV) Group to provide the City with the most responsive and cost-effective analysis of needs and feasible alternatives for Council to consider for future plans. Councilmember Turgeon stated she was pleased with the recommendation by Staff as she had seen other projects by the BKV Group, and thought the work presented was innovative and very creative. .. CITY COUNCIL REGULAR MEETING MINUTES AUGUST 11, 2003 Page 3 of 5 Councilmember Zerby stated he was concerned with the potential for a "conflict of interest" situation where the City would be asking an architect to make recommendations on a subject that could potentially bring that firm additional business in the future. He was also concerned that the City would be paying a firm to provide a sales presentation for future business, rather than actually providing solutions to a problematic situation. Councilmember Lizee reminded Council that this firm would be conducting a space needs study, whose purpose was to identify current logistics and needs to update the building, and reorganize workspace for City Staff, not to provide plans for reconstruction of the current building. Administrator Dawson stated the firm's analysis would need to be part of a collaborative effort of many people, and it should be anticipated that this firm would want to make sure the City was pleased for any future work. . Councilmember Zerby stated he thought a consultant should be hired that dealt with space needs issues only, rather than an architect. Administrator Dawson stated he did not fmd any consultants that dealt specifically with this issue. He noted a firm was needed that could provide a multidisciplinary approach that would include interior design as well as structural analysis capabilities. Turgeon moved, Lizee seconded, Engaging the Services of Boarman Kroos Vogel (BKV) Group to perform an Analysis of City Hall Space Needs per its Proposal dated July 28, 2003. Motion passed 3/1, with Zerby dissenting. B. Authorize Advertisement of Bids for Liquor Store II Remodel Finance Director Burton explained the City had engaged Seaborne Architects to begin redesign of the Shorewood Liquor Store located in the Shore wood Village Shopping Center in April of this year. Since lease negotiations had concluded two weeks ago, the plans were now ready for the bid process as they had exceeded the $50,000, and would necessitate the formal bid process set forth by the City. . Acting Mayor Garfunkel stated the Liquor Committee had struggled a bit with the potential cost of the project, but believed strongly that the cost of the remodeling would be mitigated by the increased sales in that store. Councilmember Lizee stated she thought the plans provided a beautiful design, and believed it was important to include the right features and fixtures for this store at the beginning. Councilmember Zerby stated he thought it would be a worthy investment for the City Turgeon moved, Zerby seconded, Adopting RESOLUTION NO. 03-067, "A Resolution Approving Plans and Specifications and Authorizing Advertisement of Bids for Construction Remodeling of Shorewood Liquor Store #2, Shorewood Village Shopping Center." Motion passed 4/0. C. Authorize Purchase of Shelving for Liquor Store No.2 - Shore wood Village Center Administrator Dawson explained one of the key components for Liquor Store No.2, located in the Shore wood Village Shopping Center, included the use of shelving to emphasize wine products. Most notable would be the introduction of new "lay down" wine wood shelving. The perimeter of the store would have black metal shelving to match the framing of the beverage cooler. The Lozier brand CITY COUNCIL REGULAR MEETING MINUTES AUGUST 11, 2003 Page 4 of 5 ." provided the most desirable combination of quality and cost for the metal shelving. Existing shelving would be made available for purchase through advertising. Administrator Dawson noted the Liquor Enterprise Fund would be utilized for these purchases. Lizee moved, Turgeon seconded, Authorizing the purchase of shelving from Dave Grotta Custom Wood Design for $12,028.75, as specified in its quote of July 15, 2003; and AA Equipment Company for $4,426.85 as specified in its quote of July 25, 2003. Motion passed 4/0. D. Schedule date for joint meeting with Park and Planning Commissions Council agreed a Joint Meeting with Council, Park and Planning Commissioners would take place on October 6, 2003. More information would be made available later regarding the time and location of this meeting. E. A Resolution Stating the Position of the City Council Regarding Law Enforcement Responsibilities on Lake Minnetonka . Councilmember Turgeon stated she was responsible for introducing this resolution to Council this evening, as she was concerned for potential lack of funding by Hennepin County for additional Water Patrol deputies for Lake Minnetonka. She requested this resolution be drafted to send a message of support for the Sheriff's Department position that funding for full-time Water Patrol deputies should be borne by Hennepin County, rather than local municipalities. Councilmember Liue stated she thought an additional level of law enforcement had been requested, and this resolution would clarify the City's position on its stance for this issue. Acting Mayor Garfunkel commented he had always been of the position that the funding for these positions should come from Hennepin County, as it was clearly the responsibility of the County to provide law enforcement on Lake Minnetonka. Turgeon moved, Zerby seconded, Adopted RESOLUTION NO. 03-068, "A Resolution Stating the . Position of the City Council Regarding Law Enforcement Responsibilities on Lake Minnetonka." Motion passed 4/0. 10. ENGINEERINGIPUBLIC WORKS None. 11. STAFF AND COUNCIL REPORTS A. Administrator & Staff 1. County Road 19 Intersection Administrator Dawson stated the Tonka Bay City Council was meeting with representatives of Hennepin County to discuss issues related to the cost of acquiring the Tonka Bay Liquor Store to make way for the improved County Road 19 intersection. Public Safety Facilities Administrator Dawson noted the construction of the West Side Public Safety Facility was progressing, and offered Council the opportunity to view the Facility prior to an upcoming Council meeting. He also noted the East Side Facility bids should be awarded early October of this year. 3. Smithtown Road Administrator Dawson reported paving on Smithtown Road had begun from the Victoria municipal border to Cathcart. He also anticipated the second phase of the project from Cathcart to Grant Lorenz had been moved up in the schedule to take place prior to September 1, 2003. The contractor on the project was working Saturdays to complete the project in a timely manner, so as not to impact the school buses that would be traversing the roadway in September. B. Mayor & City Council Council requested updates on the Lake Linden project, Minnetonka Watermain project, and Our Savior's Lutheran Church issues related to noise and light. Staff responded verbally to each of these items. Councilmember Lizee noted the Excelsior Sesquicentennial Celebration was taking place August 16, and 17, 2003. She would be playing the part of the White Queen in the Living Chess Game, and Mayor Love would be the White King, as part of the celebration. 12. PROPOSED 2004 GENERAL FUND OPERATING BUDGET A. Overview Finance Director Burton explained the 2004 General Fund Operating Budget was being presented for review by Council. She noted the budget requests were the result of careful consideration by Staff, guided by direction of Council at its budget work session in June. She noted Shorewood continued to provide essential services at a very reasonable cost, with a very lean budget and small staff. Staff members continue to perform at a high level with economy and efficiency; professional staff consistently spent countless extra hours to meet and exceed the high expectations of performance. She next reviewed the budget preparation calendar, including the Truth-in- Taxation process to be completed by year-end. Next, Finance Director Burton explained the anticipated highlights of budget revenues and expenditures for the Year 2004. She noted the City was subject to levy limits, and noted the City was allowed to raise the levy by an amount equivalent to 60% of lost State Aids. This amounted to an increase of about $56,000 or 2.19% from the Pay 2003 levy. She also stated the City was permitted to add a "special levy" to accommodate the debt service payment that would be made annually to fund the new public safety buildings. For 2004, Shorewood's share of this special levy amount was estimated to be $510, 480. Finance Director Burton also explained potential fund transfers and other funding sources for the Pay 2004 Operating Budgets. -#~B CITY COUNCIL WORK SESSION MEETING MINUTES August 11, 2003 Page 2 of 3 J With regard to Budget Expenditures, Finance Director Burton explained most of the changes to the 2004 budget would be incremental for the continuing cost of doing business. Significant changes included expenditures associated with police and fire services, as well as changes to the Park and Recreation, Employee Pay Plan and Benefits, Information Technology, and Land and Open Space Acquisition Fund portions of the 2004 General Fund Operating Budget. Because the Chiefs of the SLMPD and EFD had not yet arrived, Finance Director Burton reviewed the Budget found in Item 2D. B. South Lake Minnetonka Police Department This item followed 2C on this evening's Agenda. SLMPD Chief Litsey complimented City Staff for support of the Public Safety Facility Project. He then explained the history of the preparation of the Operating Budget for the Year 2004. He noted failure by all cities to approve the budget would result in the cities' contributions being the same as in . 2003. He stated he was quite concerned for this potential action as the budget was already quite lean. At the direction of the Coordinating Committee, he had revised his budget to include a $20,000 contingency that would increase the operating expenses to 1.9% over 2003. This contingency would be utilized in operating costs for the new Public Safety Facility and overtime-related costs for the department. The overall operating budget increase would be from 4.8% to 6.3%. Similarly, according to the Joint Powers Agreement, the cities had agreed to pay their obligation for the SLMPD's lease obligation for the new police station. The amount each city paid toward that figure was based on property values. As a result, Shorewood's portion would $258,200. This payment was considered a special levy and would not be subject to levy limits. C. Excelsior Fire District -- --- - This item followed 2D on this evening's Agenda. EFD Chief DuCharme explained the proposed draft Operating and Capital Equipment Plan Budget for . the EFD for the Year 2004. He detailed the revenues and expenditures and noted the Operating Budget for the EFD would increase by $5,850, approximately 2.92% in 2004. Also, he stated the lease payments to the Shorewood EDA would increase to $585,000 should the funding formulas remain as they had been for the past year. He also explained the anticipated revenues and expenditures for providing fire services to the City of Orono beginning January, 2004. Councilmember Zerby thanked him for his efforts in preparation of this budget. Councilmember Turgeon requested clarification about the necessity of certain vehicles as part of the budget. She noted certain expenditures associated with larger vehicles were difficult to justify for local residents. D. City Budget Review This item was discussed following Item 2A. Finance Director Burton reviewed the City Budget in detail, specifically noting the highlighted changes referenced in Item 2A. Councilmember Zerby commented he appreciated the efforts made by Staff to show where choices had been made to reduce the cost of equipment by sharing with other municipalities. Additionally, he thought it important to show where the budget had been scrutinized for economy as part of the budget preparation. Councilmember Turgeon questioned the $5,000 allocation toward the Land and Open Space Acquisition Fund referenced in the budget. She stated she would like to see monies set aside for Right-of-Way Acquisition in addition to the Open Space designation. She encouraged Staff to be proactive in acquiring right-of-way as properties were sold so that future Councils did not have to deal with associated costs of acquiring right-of-way whenever projects were taking place i~ the City. . Councilmember Lizee agreed, noting consideration also should be given to providing incentive programs to residents for dedicating right-of-way to the City. 3. OTHER Finance Director Burton then reviewed the process that the budget would be subjected to as a result of changes and clarifications made this evening. Council thanked Finance Director Burton and City Staff for its hard work and dedication in preparing the budget for review, and thanked them for their continued efforts toward economy in City operations. No further work sessions on the 2004 budget were deemed necessary prior to setting the 2004 proposed tax levy on September 8. 4. This past spring, the furnace that provides heat for the finance and engineering areas of the City Hall building was determined to have faulty heat exchangers. Faulty heat exchangers could result in carbon monoxide poisoning, so staff was aware that the furnace would have to be replaced this fall before the heating season. The City Council was advised of this in an agenda memo this past spring. Then, the air conditioning unit unexpectedly stopped working this past month. Due to the 90 degree heat, quotes were obtained for emergency removal and replacement of this furnace and air conditioning unit. Merit Heating and Cooling, Inc. provided the quote with the best combination of price and warranty in the amount of $7,353, before rebates of about $950. While some would prefer that we install a fourth stop sign at the intersection, we are not inclined to do so. We take this position because stopping the through move will back up traffic well up County Road 19. We do believe that a concentration of access points along the Tonka Bay side of County Road 19 could improve traffic movement in the area. In fact, we have shared this opinion with Dave Kirkland, our contact with the group developing the adjacent shopping center. During a visit to the shopping center site Mr. Kirkland, the Hennepin County Traffic Operations Engineer and I discussed the possible introduction of an interim access management plan wherein access to the area would be limited to the area immediately south of the shopping center (the extension ofthe access drive adjacent to the building to County Road 19) and the area immediately south of the shopping center sign/planter. Continuing further along County Road 19, the main shopping access could be reduced from approximately 75 feet to approximately 50 feet. If these access reductions are enacted, direct access to the Tonka Bay Liquor Store would be eliminated, necessitating shopping center access sharing. When asked if the shopping center owners would agree to shared access use by liquor store patrons, Mr. Kirkland said he would consider such a request. Mr. Kirkland's response was based on the assumption we were discussing potential options, not certain action. J\.l..I.1 u sf As you recall, during our ~ 15 meeting with the Tonka Bay City Administrator, I expressed a desire to successfully conclude negotiations for the county's purchase of the Tonka Bay Liquor Store. Accordingly, I indicated a reluctance to actively pursue an access/traffic management plan based upon a concern such action may be viewed as a threat if the negotiations stall. I feel compelled to reiterate this position and advise that I have had no further conversations with Tonka Bay staff in this matter. Chair Bailey opened the Public Hearing at 7:06 P.M., noting the procedures utilized in a Public Hearing, as well as the criteria for granting a variance. He also noted cases recommended for approval would be placed on the August 25,2003, Regular City Council Meeting Agenda for further consideration. Director Nielsen explained the applicant had proposed a significant remodeling project for their property at 5695 Christmas Lake Point that included the addition of another story of living space over portions of the existing structure. He went onto explain the house was nonconforming with respect to the standards of the R-1C/S zoning district where it was currently located. The lot was very shallow and tapered from 160 feet on the north end of the lot to 64 feet on the south end of the lot, resulting in an extremely limited buildable area. The lot also dropped 30 feet from the northwest corner to the shoreline of Christmas Lake. The existing house contained approximately 1840 square feet on the main floor, with another 1536 square feet in the basement level. The applicants were attempting to achieve additional living space within the confines of the existing footprint ofthe house. To do so, they proposed a significantly steeper pitched roof capturing most of the expansion area of the second story with the new roof structure. They also hoped to correct drainage problems associated with the nearly flat pitch of the existing roof. In order to improve vehicular access to the site, the applicants also proposed reorienting the garage doors to the south end of the building. At present, there was barely enough room to park a car in the driveway without having some portion of the car extending into the roadway of Christmas Lake Point. Hardcover reductions had already begun to take place, Director Nielsen.noted, with the impervious surface totaling 22.3 percent once the project was completed. PLANNING COMMISSION MEETING MINUTES August 5, 2003,' Page 2 of 9 With regard to issues of concern, Director Nielsen noted the applicant's had originally submitted plans much different from those presented to the Commission this evening. He stated the architect had worked to redesign the project based on the advice of Staff to focus the expansion on the end of the lot with the most buildable area, correct existing nonconformity to the extent possible, and minimize expansion toward the lakeside ofthe property. He noted a recent variance, similar in regard, had been granted recently to the property directly across the street. He noted the applicant's property differed in that some buildable area was on the north end of the lot, where unfortunately topography on the site was most severe. He noted the applicant's would be reducing the impervious surface on the site by removing two accessory structures and approximately 420 square feet of concrete patio area near the lake. Setbacks from the lake were also improved through the removal of these items. Reorientation of the garage doors was viewed as improvements to the safety and operation of Christmas Lake Point. The driveway would be relocated further south on the street allowing the garage to be accessed from its south end. Director Nielsen recommended the landscaping on this end include at least one evergreen tree that would break up the increased mass of the south end of the building. He also recommend the driveway configuration be modified to include a small pullout on the street side of the driveway to facilitate backing out of the new garage, and the driveway in front of the garage should be at least 20 feet in depth in front of the garage to allow for parking in front ofthe garage door. Additionally, should the variance be recommended for . approval, he stated it was extremely critical the large trees between the house and the lake be well protected and maintained. Also, he suggested the City obtain a conservation easement over the north 25 feet of the site to ensure the future owners of the property do not propose to extend the building into the steep slope. Director Nielsen then stated the City Attorney had recommended a stipulation regarding the future potential for building into the steep slope be restricted as part of the resolution associated with this matter, as it would need to be recorded in Hennepin County. Fred and Ellen Johnson were present this evening, and Mr. Johnson stated he was in agreement with Director Nielsen's recommendation regarding this case. Timothy Rainey, 5660 Christmas Lake Point, stated he was the adjacent neighbor and commended the Johnson's on submitting excellent plans for the project. He stated he was in favor of the project. Chair Bailey closed the Public Testimony portion of the Public Hearing at 7:20 P.M. Various members of the Commission requested clarification of certain parts of the applicant's plans. . Commissioner Gagne stated he thought the proposal made good use of the property and the land. Commissioner Borkon stated she also liked the plans and appreciated the conservation efforts associated with the proposed plans. Borkon moved, Gagne seconded, Recommending Approval of a Setback Variance and a Variance to Expand a Nonconforming Structure, subject to Staff Recommendations, and Recording the Stipulation of the Conservation Easement on the Resolution, for Fred and Ellen Johnson, 5695 Christmas Lake Point. With the approval of seconder of the motion, the maker of the motion amended the motion to include tree protection measures as part of the project. Chair Bailey stated he supported the variance because the site clearly had a limited buildable area that would serve to generate the hardship and uniqueness required in the criteria for consideration of this case. He also stated the other conditions for granting a variance were met in this case, and he liked the idea of reducing hardcover especially near the lake. Commissioner Gagne called the question. FOR SPECIAL HOME OCCUPATION Applicant: Eileen Illckey Location: 5320 Shady Hills Circle Chair Bailey opened the Public Hearing at 7:30 P.M. . Director Nielsen explained the history of the case, noting the applicant requested a conditional use permit to teach group music lessons in her home at 5320 Shady Hills Circle. Her property was zoned R-1C, Single-Family Residential. As stated in her request letter she currently taught music lessons for one student at a time. Her group lessons would include 3-8 students, taught between the hours of 9:00 A.M. and 1:30 P.M. The lessons would be conducted in the basement of her home. He noted the primary consideration in this type of request was parking. The Code required all parking associated with the home occupation must be accommodated within an existing driveway, with no cars parked within 25 feet ofthe street. The applicant's property had a circular driveway that appeared capable of holding six cars. He also stated he believed the limited hours proposed by the applicant should pose no problem for the neighborhood with respect to clientele coming to or going from the site. He stated it was imperative the applicant limit her clients' parking to the driveway. Subject to this condition, it was recommended the request be approved. Eileen Hickey, applicant, stated she planned to teach 1-2 classes one morning per week. She explained each session would last approximately 45 minutes lasting 1.5 hours total. She stated approving the request would allow her to teach group lessons as part of her business. These group lessons would include ideally 6-8 students with students over the age of 3 being dropped off and picked up as part of the schedule for her program. . Steve Hickey, 5320 Shady Hills Circle, stated his wife had already tried to organize classes for future planning, and was having difficulty recruiting a class of more than three students. He noted the driveway could easily hold 6-8 cars. In response to Commissioner Borkon's question, Mrs. Hickey stated she would not be having recitals for her program. Chair Bailey closed the Public Testimony of the Public Hearing. Commissioner White questioned the days of the week Mrs. Hickey hoped to be teaching classes. Mrs. Hickey stated she hoped to teach on Mondays, Tuesdays, and Fridays with two sessions at the most on any given day. Commissioner Woodruff stated she was quite concerned about approving this request, as the Commission had reviewed similar request in past history and she remained concerned for the potential parking problem this situation could create for the streets in the neighborhood. Mrs. Hickey stated her driveway would hold a single lane of parked cars within the driveway. She stated the parents of her students could be informed of a parking configuration that would not allow them to park on the street and would establish an order of departure. In response to Commissioner Packard's question, Mrs. Hickey responded, there would not be an overlap of class times as part of her program. PLANNING COMMISSION MEETING MINUTES August 5, 2003, Page 4 of9 Commissioner Borkon questioned the options for providing the applicant with a probationary period associated with the Conditional Use Permit (CUP) in this case. Director Nielsen explained the laws had changed and no longer allowed for a probationary period. He also reminded the Commission the CUP would remain with the land should the property be sold in the future. He stated the CUUP could be revisited or revoked with complaint. He stated guidelines could be established through the CUP to regulate the parking and hours associated with the business. Borkon moved, Gagne seconded, Recommending Approval of the Conditional Use Permit, subject to the following stipulations: 1. Hours of business would be from 9:30 A.M. to 3:00 P.M. 2. There would be no overlap of class times. 3. The CUP would not be transferred to the new owner of the property should the property be sold. 4. Class size would be limited to six students to allow a maximum of six cars in the driveway at one time in the driveway during business hours. With approval of the seconder, the maker of the motion amended the motion to read as followed: . 1. Hours of business would be from 9:30 A.M. to 3:00 P.M. Monday to Friday only. 2. Half-hour intervals of time would need to take place between classes. 3. Should the property be sold, the same business would need to operate under the time stipulations as specified in approval of the CUP. 4. The number of cars should be limited to six in the driveway at one time during the days classes would be held. Director Nielsen then reviewed the actions taken should complaints arise as a result of granting the CUP. Mrs. Hickey questioned how the complaints were verified to ensure fairness and accuracy as part ofthe due process associated with such a complaint. Motion passed 5/2, with Gagne and Woodruff dissenting. Commissioner Gagne stated he was concerned for setting a precedent in this case that had the potential to expose the situation to additional problems associated with parking. Commissioner Woodruff stated she agreed, noting she thought this situation could represent a potential problem for the future. . Chair Bailey closed the Public Hearing at 8:02 P.M. 3. 7:30 P.M. PUBLIC HEARING - R-C DISTRICT ZONING TEXT AMENDMENT AND CONDITIONAL USE PERMIT AMENDMENT Applicant: M.J. McGregor Location: 21195 Minnetonka Boulevard Chair Bailey opened the Public Hearing at 8:03 P.M. Director Nielsen explained the applicant was one of the owners of the former Kuempel Chime Clock Studio building located at 21195 Minnetonka Boulevard. A prospective tenant currently doing custom woodworking out of his home wished to locate his business in her building. Since this was not a permitted or conditional use in the R-C, Residential/Commercial zoning district, the applicant had requested a Zoning Code text amendment to include it into the Code. PLANNING COMMISSION MEETING MINUTES August 5, 2003, Page 5of9 As explained in Ms. McGregor's letter, dated June 30, 2003, Mr. Rick Johnson made one-of-a-kind furniture and woodwork, and would occupy the northerly wing of the building. The property contained approximately 28,455 square feet of area. The building contained 11,112 square feet and was currently occupied by a manufacturer's video recording studio and office. The south wing of the building was used for storage. Upon meeting with Mr. Johnson and Ms. McGregor, it was found that the nature of Mr. Johnson's business was not unlike a home occupation that might ordinarily be allowed in a residential district. Nor was it inconsistent with the former use of the property, the Kuempel Chime Clock shop. It may in fact be somewhat lower in intensity of use than the previous tenant (i.e. no mass production, fewer employees, etc.). Director Nielsen stated Mr. Johnson and Ms. McGregor had studied the special provisions in the R-C district and indicated they would have no problem complying with the requirements. . If the City were to consider a change in the Code, Director Nielsen recommended the proposed activity be narrowly defined and regulated based upon Mr. Johnson's proposed use of the property. In addition to the special provisions already listed in the Code, an amendment to in Section 1201.19 of the City Code might look like the following: "f. Custom woodworking shop, provided that: (1) The total number of employees working in the shop shall not exceed three (3). (2) The use shall not have a predominant retail character. Any retail sales conducted on the premises shall be limited to products produced on the premises. (3) Products made on the premises shall be limited to custom, one-of-a-kind woodwork items. . (4) Noise, dust and odor shall comply with the standards of the Minnesota Pollution Control Agency and shall not constitute a nuisance to adjacent residential uses. (5) Adequate off-street parking shall be provided in compliance with Section 1201.03 Subd. 5. of this Code. (6) All work shall be performed entirely within the building. There shall be no outdoor display or storage on the property." The provisions suggested above would apply to any property zoned R-C and would be listed under conditional uses. In addition, Director Nielsen stated, a C.U.P. for the subject site should include a provision that any loading or unloading of materials or products must occur between the north and south wings of the building. Finally, Ms. McGregor and Mr. Johnson were reminded that the hours of business in the R-C district are 8:00 A.M. to 9:00 P.M. Ms. McGregor stated she thought this business would provide great use of the building, and would serve the historic use of the site. She stated Mr. Johnson did fine work and was an artisan with exceptional work. Chair Bailey closed the Public Testimony portion of the Public Hearing at 8:08 P.M. Ms. McGregor responded the equipment utilized by other tenants was typical of that found in someone's home that would serve precise woodworking skills. Ms. McGregor also commented it was not easy to find occupants for her building as not many business owners were able to wait for the planning process needed for approval. She stated this requirement had become a hardship for her, and she requested the Commission consider remedy for this hardship in the future. Commissioner Woodruff expressed concern for delivery times taking place in the evening hours. She suggested any approval include a stipulation that deliveries only be allowed between 8:00 A.M. and 5:00 P.M. MINOR SUBDIVISION Applicant: Rich Anderson and Ted Hanna Location: 20995 Forest Drive Director Nielsen stated the applicants had arranged to purchase the property located at 20995 Forest Drive. They proposed removing the existing house on the property and subdividing the lot into two building sites. He noted the property was zoned R-lD/S, Single-Family Residential/Shore1and and contained 22,649 square feet in area. The proposed lots would be 11,928 square feet and 10,721 square feet in area. Director Nielsen went on to state both of the proposed lots complied with the requirements of the R -lD/S zoning district. The building pads also complied with setback requirements. Director . Nielsen noted two issues were worth raising relative to the proposed building pads: 1) the lots were to be limited to a maximum of 25 percent hardcover; and 2) driveway grades should not exceed eight percent. The hardcover limitation included driveways, decks, sidewalks and patios. Further, he recommended applicants be advised that the size of homes on these lots would need to be modest. According to the applicants' survey, sanitary sewer services were available to each lot. It was thus recommended that the minor division be approved subject to the following: 1. The applicants must provide legal descriptions for the proposed lots. 2. The applicants must provide legal descriptions and deeds for drainage and utility easements, 10 feet on each side of each lot line. 3. The applicants must provide an up-to-date (within 30 days) title opinion for review by the City Attorney. 4. COMMERCIAL SITE PLAN REVIEW Applicant: John Sulcinar and John Deters (Dimensions in Floors) Location: 5660 County Road 19 Director Nielsen explained the history of the case, noting John Sulcinar and John Deters owned the carpet store at 5660 County Road 19, and had requested site plan approval for a proposed warehouse addition to the rear of their building. The property was located in the C-3, General Commercial zoning district and contained approximately 38,329 square feet of area. Land use and zoning surrounding the site included Gideon Glen conservation open space; zoned C-3 and R-IC to the north; Tonka Bay Shopping Center, zoned commercial, to the east; a motor fuel station/convenience store, zoned C-3, to the south; and the American Legion club; zoned C-3, to the west. . The existing building was one story in height (12') and contained approximately 2769 square feet in area. The proposed structure was also one story, although taller in feet (18'), and would contain 2004 square feet of area. The new addition would be used for warehousing of flooring products. According to the applicant, Director Nielsen explained, the new structure would be either concrete or masonry construction with a stucco fmish that would extend onto the sides of the existing building. The proposed new addition would extend 16 feet further to the north than the existing building in order to make room for an overhead loading door for the addition. Director Nielsen went on to explain the parking lot would be extended back along the north side of the building, with eighteen spaces proposed. He stated it was worth noting that the entry to the site would change at such time as the County Road 19/Country Club Road intersection was done. Access to this site would then come in through the southeast corner of the Gideon Glen site and would not adversely affect the site plan. In evaluating the applicants' plans, Director Nielsen explained the proposed use was consistent with the C-3, General Commercial zoning district, and building and parking setbacks complied with the Zoning Code. The required parking for the proposed use was 13.8 spaces for the retail portion of the store and four for the warehouse area for which the applicant had provided 18 spaces. Director Nielsen noted these parking spaces must be at least nine feet wide and 20 feet deep and the parking lot and driveway must have perimeter poured concrete curbing and striping. PLANNING COMMISSION MEETING MINUTES August 5, 2003, Page 8of9 He also noted grading, drainage and erosion control were subject to approval by the City Engineer and the Minnehaha Creek Watershed District. He recommended the connection of this property to the drainage system in Gideon Glen should be explored. Hardcover calculations had not yet been provided, however the applicants' had stated they would be able to stay within the allotted 66% allowed by the commercial zoning district. Director Nielsen went on to explain the applicant had stated the dumpster area would be enclosed with a masonry enclosure and some sort of gate system across the front. With regard to lighting, it was assumed what existed currently would remain, however, Director Nielsen noted the continued use oflow wattage lighting should be utilized in the front of the building. Director Nielsen stated some trees would be lost to accommodate the addition and new parking. However, the larger trees on the north side of the property would remain intact, providing a buffer between the parking lot and the Gideon Glen site. He also suggested that some additional evergreen trees be spread across the rear of the lot in lieu of, or in addition to, the deciduous trees that had been proposed, as this was consistent with the recommendations of the Co. Rd. 19 corridor study being prepared by the Planning Commission. It was also suggested that the turf area between the road and the parking lot be built up into a berm, upon which salt-tolerant landscaping should be placed. The applicants should address how the landscaping will be maintained (i.e. irrigation). He went on to state the proposed concrete or masonry construction was consistent with the requirements of the Zoning Code. Finally, the applicants had not indicated any change in signage. Director Nielsen recommended the applicants' plan be approved, subject to these recommendations. . Commissioner Woodruff stated she would like to encourage the applicants to utilize as many landscape elements as possible as this store would be part of the new "entrance" to Shorewood. She stated she would prefer to review the proposed landscape plan for the site prior to Council approval, as part of the planning process. Fred and Ellen Johnson propose a significant remodeling project for their property at 5695 Christmas Lake Point (see Site Location map - Exhibit A, attached). Included in the project is the addition of another story of living space over portions of the existing structure. The home is currently nonconforming with respect to the standards of the R- 1 CIS zoning district in which it is currently located. The lot is very shallow and tapers from 160 feet on the north end of the lot to 64 feet on the south end of the lot. The result is an extremely limited buildable area (shown in heavy dashed lines on Exhibit B). Consequently, they have requested a setback variance and variance to expand a nonconforming structure (see Request Letter - Exhibit C). The subject property contains approximately 21,000 square feet of area and is characterized by a dramatic change in topography. The lot drops 30 feet from its northwest comer down to the shoreline of Christmas Lake, most of which occurs in the northerly 40 feet oflot (see Exhibit D). The lot is also heavily vegetated with mature deciduous trees, particularly on the north and lake sides of the property. Elevations of the existing home are shown on Exhibit E. In this regard they propose a significantly steeper roof. Mostofthe expansion area for the second story is captured within the new roof structure. They also propose to reorient the garage doors to the south end of the building in order to improve vehicular access to the site. At present there is barely enough room to park a car in the driveway without it extending into the roadway of Christmas Lake Point. The Johnsons have already begun to correct the amount of hardcover on the property, reducing it from approximately 33 percent to 26 percent. Once their project is completed, the amount of impervious surface on the site will be reduced to 22.3 percent. . Plans for the existing home are shown on Exhibits E through G. Plans for the remodeling/expansion are shown on Exhibits H through M. ISSUES AND ANALYSIS It is worth noting that the Johnsons initially came in with drastically different plans than what are presented here. After several discussions with staff, they had their architect redesign the project based upon the following advice: 1) focus the expansion on the end of the lot with the most buildable area; 2) correct existing nonconformity to the extent possible; and 3) minimize any expansion toward the lake side of the property. For the most part, the plans presented have followed that direction. . While variances are inherently unique to the property, this request compares favorably with the variances that were granted directly across the street (the Hawk residence). That home was expanded by adding a steep roof that, together with some dormer treatments, allowed an upper level to be added to the home. . Considerable hardcover was removed in that case, although the owners were not able to completely comply with the 25 percent maxImum. The Johnsons property differs somewhat in that it has at least some buildable area on the north end of the lot. Unfortunately, this is the portion of the lot where the topography is most severe. In this case the Johnsons will bring the property into compliance with the hardcover requirement, ultimately achieving less than 23 percent of impervious surface. This will be accomplished by removing two accessory structures and approximately 420 square feet of concrete patio area near the lake. Setbacks from the lake are also improved through the removal of these items. The reorientation of the garage doors and driveway are also viewed as improvements to safety and operation of Christmas Lake Point. The street is very narrow private road, with a steep grade adjacent to the Johnson property. The Johnsons' driveway is located near the bottom of the steepest portion of the street. The proximity of the existing garage results in a very shallow driveway with barely enough depth to park a car without it -2- Memorandum Re: Johnson Variance 31 July 2003 extending into the street. The driveway will be relocated further south on the street allowing the garage to be accessed from its south end. The area where the existing driveway is located will be landscaped. It is recommended that the landscaping in this spot include least one evergreen tree that will eventually break up the increased mass of the south end of the building. It is also recommended that the driveway configuration be modified to include a small pullout on the street side of the driveway to facilitate backing out of the new garage. The driveway in front of the garage should be at least 20 feet in depth in front of the garage to allow for parking in front of the garage door. . One of the mitigating factors in this request is the tree cover on the lake side of the home (see Exhibit M). Ifthe.variance is to be granted it is extremely critical that the large trees between the house and the lake be well protected and maintained. Also, since the expansion can not take advantage of the technically buildable area on the north end of the site, it is recommended that the City obtain a conservation easement over the north 25 feet of the site to ensure that future owners of the property do not propose to extend the building into the steep slope. RECOMMENDATION . The applicant's proposal is considered to have merit. With respect to the criteria for variances, the project is consistent with the character of the area and the homes on Christmas Lake Point. The configuration of the site, combined with topography, prevent the applicants from using the buildable area of the property. The architecture of the project has been designed to minimize the extent and the visual impact of the expansion, and to avoid the significant site alteration that would result from carving into the steep slope on the north end of the site. Finally, the variances would be further mitigated by the requirement of the conservation easement and some additional landscaping as suggested earlier in this report. We are requesting a variance for our property located at 5695 Christmas Lake Point. Our goal is to do a complete repair and remodel of the house, garage and deck and add a second level while keeping within the spirit and intent of the City of Shorewood's Ordinance. Our plans will result in better conformity with zoning and building code standards than what it currently is. Our property is substantially nonconforming for the zoning district in which we live. Furthermore, a variance would be required for adding a second level to our home. We feel that it is a privilege to be living on Christmas Lake so we are very much aware in our home repair and remodeling plans to take into consideration not only our family needs but our neighborhood and community goals also. Special conditions and circumstances do exist which are peculiar to our land and home because of the narrowness, shallowness, and shape of our property. Our lot is a triangular lot at the end of a private road. Repair and Remodeline: Plans Our plan is to repair and remodel the existing house and to add a second level, which will make the structure a two and a half-story home. The second level will fit into the roof structure. This additional space would be for bedrooms, baths, office space and very needed storage space, which the house is clearly lacking, since the other small buildings located on our property which were used for storage will be removed and the existing garage is fairly small with very limited storage room. Besides the space issue, a significant reason for the remodeling is that there are continuing moisture and mold problems due to the poor design and structure of the roof. These issues need to be addressed as soon as possible to avoid any potential health issues. The existing roof is virtually flat and has a teflon coating on the roof which most roofers do not use today because of the many problems associated with it. Exhibit C-l APPLICANT'S REOUEST LETTER In our plan we have minimized the impact of any additional space. Weare staying within the existing footprint of the home, except for expanding the front step. The expansion of the entry step is necessary to prevent water and mold problems, which continues to be a significant problem in the well room. The existing front step is ineffective roof for the well room. The proposed overlap of the front step over the well room will function as a roof does for a house. A screen porch was added (76 sq. feet) within the existing structure of the house. The porch is set below the existing roof and above the existing deck. This was added to allow better use of the property at night. After 6.30 pm it becomes difficult to sit outside the house because of the mosquito population. The screen porch is on the east side of the house. From the lake view it will not be imposing for a number of reasons; the wall will be a see through screen, the porch does not expand the structure and the foliage covers a significant portion of that section of the house. . Due to safety concerns, we are changing the location of driveway and removing the old driveway and replacing it with trees and ground cover. See Exhibit 4 for proposed location. Because of the uniqueness and beauty of our property we would like to propose a cottage type setting. This will keep in line with the Christmas Lake beauty. We will continue with our landscaping to blend the area into the landscape. In addition, more trees will be added to our property. The completion of this project will bring our home up to current building and safety codes since the home has not been updated much since it was built in 1958. Our plans will show that we are making reasonable use of our land and that we are requesting the minimum variance necessary. As you will see from our plans we have been quite conservative in our rights commonly enjoyed by properties in our same neighborhood and district. We feel our proposed renovation significantly improves the value of our house and that of the neighbors yet keeping the pristine beauty of the lake. We are confident that our plans will demonstrate our desire to conform and live within the city of Shorewood Ordinances. Also, we are in a similar situation to our neighbors who live directly across the street from us. Their lot shares the same characteristics, i.e. narrow, and triangular. They were recently granted a variance to put a second level on their house and expand their footprint of their house. C-2 What we have already done to improve the conformity of the lot to Shorewood's zonim! requirements. Over the past couple of years, as part of our overall construction and renovation plan, we have taken significant steps to improve the overall conformity of our property to Shorewood's zoning requirements, i.e. removal of hardcover. In addition, we have planted a number of trees, which will significantly improve the view of the new addition from not only the lake but from the road. The planting of the trees is consistent and harmonious with the tree preservation initiative that Shorewood has adopted. . When we purchased our property a significant portion ofthe lot was covered by river rock and below the river rock was a thick black plastic which was impervious to water. The plastic was the equivalent to cement since it did not allow water to penetrate the surface, effectively creating a dead zone for plant life and causing significant water runoff, which ultimately ended up in the lake. The river rock was located on the entire west side and north side of the house and 50% of the lake side or east side located below the decking. See attached exhibit 1 for locations of river rock and plastic removed. Prior to removing the rock, the hardcover percentage was approximately 33%. This work resulted in a decrease in the hardcover percentage of approximately 8% to 25.6%. This is a significant decrease in the impervious hardcover. We have added approximately 30 trees, which include maple, white pine, balsam fir and birch in order to restore the property to a more natural setting. We have also created a buffer between the current lawn and the lake. Prior to this the lawn was manicured up to the lake, which created more erosion issues and did not allow runoff to be filtered before entering the lake. . What we intend to do as part of our remodeling project to improve the conformity of the property to Shorewood's requirements. As part of our plan, we will be removing approximately 420 square feet of cement stone and replacing the stone with grass. See attached exhibit 2. Some of the cement will be pushed back and put under the deck and up against the house. This will allow better drainage and the runoffwill be bettered filtered before it hits the lake and thus be more in conformity with Shorewood' s requirements. We would also as part of the project remove two buildings on our property. One of the buildings is 12 feet from the high water mark and the other building is 28 from the high water mark. See exhibit 3. In addition, we would also be planting additional trees and shrubbery along the lake to better improve the buffer between the house and the lake and additional trees on the roadside so to improve the view from the road and blend the house into the natural setting. This will enable us to continue to have the low profile look that we currently have C-3 .. . and allow the property to blend in even more to the surrounding landscape. In conclusion, we feel that the narrowness of the lot from the lake to the road constitutes significant factors, which would make the property not buildable under the existing Shorewood zoning ordinances. In addition, the removable of nonconforming structures on the property together with the significant reduction in hard cover actually make the property significantly more conforming than it was before. In addition, the proposed plan is reasonable and is consistent with the community and in fact would better blend into the surrounding environment then other similar homes in the neighborhood. Furthermore, the circumstances of this property are similar to the property located at 5680 Christmas Lake Point, which received a variance to build a second addition. This letter is in regard to the Conditional Use Permit Application by Ms. Hickey, at 5320 Shady Hills Circle. I will be on vacation at the time of the public hearing, but I wanted my objections to go on public record. Neighborhoods are zoned residential for a reason - to keep them from becoming commercial, to protect the peace and quiet of a family-oriented neighborhood of private residences. What if we wanted to run a yoga studio from our home, serving 3-8 students per session? What if Ms. Bloom (across the street) wanted to teach painting to 3-8 students per session? What if Mr. Fredeen (next door) wanted to run a weekly investment group for 3-8 students per session? What if the Manns (on the corner) wanted to teach personal safety classes to 3-8 students per session? With the number of homes on Shady Hills Circle, if even a few of us started home-based businesses that served 3-8 students per session (or employed 3-8 workers per day/session) our street would be lined with cars and the traffic in and out of our neighborhood would increase dramatically! If only five homes out of the 18 on Shady Hills Circle ran home businesses that served 8 students at a time, this translates into 40 cars - per session!!! . Is this likely? Probably not. Is this possible? Certainly. With the poor economy, many people are turning to alter- native methods of earning a living, and home-based businesses are increasingly popular. If one request is granted, then a potentially harmful precedent is set. In fact, we knuw of a nearby neighbor on Shady Hills Circle (well known to city of Shorewood staff), who years ago operated a home-based business with employees. Shorewood did not allow this business to continue due to the number of cars in and around that address. In that particular case, we believe it was employee cars rather than students' cars, but that is irrelevant to us. The effect is the same; increased traffic and parked cars, and an unfair burden on the rest of the neighbors. Up until we received the letter from Shorewood, we were unaware of the nature of Ms. Hickey's business, but we certainly were already aware that there was a lot of traffic/parking gener- ated by the Hickey house (we live across the street). We would have no objections if a home-based business served 1 student at a time. More than that, it becomes an unfair burden on the rest of the neighborhood, and an open door for others to do the same, potentially destroying the whole notion of a "neighborhood. She has a prospective tenant who currently does custom woodworking out of his home and wishes to locate his business in her building. Since this is not a permitted or conditional use in the R -C, Residential/Commercial zoning district, she has. requested a Zoning Code text amendment to include it into the Code. As explained in Ms. McGregor's letter, dated 30 June 2003 (Exhibit B), Mr. Rick Johnson makes one-of-a-kind furniture and woodwork, and would occupy the northerly wing of the building (see Exhibit ~). A public hearing has been scheduled for 5 August to consider this request. The property contains approximately 28,455 square feet of area (see Exhibit D). The building contains 11,112 square feet and is currently occupied by a manufacturer's video recording studio and office. The south wing of the building is used for storage. ANALYSIS/RECOMMENDATION The R-C, Residential/Commercial zoning district is provided for in Section 1201.19 of the City Code. This district is very specialized and was intended to establish land use transitions between residential areas and higher uses or busy roadways. Two issues are worth raising relative to the proposed building pads: 1) the lots are limited to a maximum of 25 percent hardcover; and 2) driveway grades should not exceed eight percent. Access to this site will then come in through the southeast comer of the Gideon Glen site. This does not adversely affect the site plan. ANAL YSIS/RECOMMENDATION In evaluating the applicants' plans, the following should be taken into consideration: 1. The proposed use is consistent with the C-3, General Commercial zoning district. . 2. Hardcover calCulations have not been provided. The maximum amount of impervious surface is 66 percent on commercial property. This will be addressed at the meeting on Tuesday night. 8. Although the plan does not indicate, the applicant has stated that the dumpster area will be enclosed with a masonry enclosure and some sort of gate system across the front. 9. Since the plan does not indicate any change in lighting, it is assumed that what exists today will remain. 10. Some trees will be lost to accommodate the addition and new parking. However, the larger trees on the north side of the property will remain intact, providing a buffer between the parking lot and the Gideon Glen site. . 11. It is suggested that some additional evergreen trees be spread across the rear of the lot in lieu of, or in addition to, the deciduous trees that have been proposed. This is consistent with the recommendations of the Co. Rd. 19 corridor study being prepared by the Planning Commission. The concept is to eventually provide an evergreen backdrop for businesses along County Road 19. In that regard, it is also suggested that the turf area between the road and the parking lot be built up into a berm, upon which salt-tolerant landscaping should be placed. The applicants should address how the landscaping will be maintained (Le. irrigation). 12. The proposed concrete or masonry construction is consistent with the requirements of the Zoning Code. . 13. Prior to issuance of a building permit, the Applicants shall provide hardcover calculations, prepared by a registered land surveyor, civil engineer, landscape architect, or architect, demonstrating that impervious surfaces on the lot do not exceed 66 percent of the lot area. DATE: Larry Brown, Director of Public Works ~ August 24, 2003 FROM: RE: Request from Waste Management for Change of Schedule for Refuse Pickup Christmas Lake Point Attachment 1 is a request from Waste Management to deviate from the City of Shorewood's Ordinance setting Wednesday as pickup day for refuse on Christmas Lake Point. This request stems from the fact that changes have been made to private property at the south end of Christmas Lake Point, that blocks the use of a driveway that has traditionally been utilized by larger vehicles for a turn around. Christmas Lake Point is a private road that is very substandard and narrow in width. Attachment 2 is a site location map for the roadway. If it were not for the fact that the City has a lift station at the end of this road with an asphalt pad, there would be little room to turn around at all. Again, Christmas Lake Point is a private roadway. . Due to the recent changes in configuration of driveways at the south end of the road, Waste Management states that it is impossible to turn a large refuse truck around at the south end of Christmas Lake Point. Therefore, they are forced to service this area with a smaller truck. The request received is to change the pickup day form Wednesdays to Fridays. Apparently this due to limited availability of the smaller trucks. On August 12th, 2002, the Shorewood City Council passed an ordinance amending Section 507.06 of the City Code, relating to refuse collection. The following is an excerpt of the amendment passed. "507.06: REFUSE COLLECTION SCHEDULE: Each licensee shall collect refuse from premises for which he has a collection contract according to the following minimum schedule: daily from hotels, restaurants, and other premises which, in the judgment of the City, require such collection; and weekly from residences and other premises. No refuse shall be collected before six o'clock (6:00) A.M. or after eight o'clock (8:00) P.M. of any day. With the exception of Shady Island or Enchanted Island, collection from residential properties shall take place only on Wednesdays, unless otherwise authorized by the City Council. While we can sympathize with the difficulty in scheduling alternative equipment or lack of equipment to meet the requirements of the ordinance, granting a variance from the ordinance is setting a difficult precedence. In an effort to treat all neighborhoods equally, the pickup day should remain constant. Granting a variance from the ordinance for Christmas Lake Point, opens the door to further amendments for other neighborhoods. Staff does acknowledge that Ordinance does have Thursdays designated for refuse pickup for Shady and Enchanted Islands. However, this was approved due the geographical proximity to the Cities of . Mound and Minnetrista, whose pickup days are set for Thursdays. Recommendation Staff is recommending that the request for a schedule change for refuse pickup be denied. That concerns 11 of our customers in Shorewood on Christmas Lake Point Road. The safety concern is that our customer at 5790 Christmas Lake Point did some chi.veway improvements. With new blacktop and a big tree in the middle of the circle drive, we turned arowld in. Now we have to drive in and back all the way out onto Radisson Inn Road. There is a blind curve on each side of Christmas Lake Point and on several occasions, there has almost been an accident there. What I need to know is if it would be O.K. to change the pick up day of these 11 customers fi.'om Wednesday to F1i.day to be serviced with one of our small trucks. That would have room to turn around at the end of the road. This would also save on any damage that may accrue to the road in the future. Thank you for taking time to discuss this matter. As of the date of this memo, staff learned that the City of Excelsior, at their most recent meeting, approved a 0% increase in the 2004 SLMPD budget. If this event should come to pass, the additional City of Shorewood allocation which has been budgeted for the 6.3% increase, would revert to the Council Contingency line item, and eventually back to General Fund reserves. Council is aware that the developer for the Smithtown Crossings Shopping Center has approached representatives for Hennepin County soliciting revisions to the final design that had been completed by the City of Shorewood for the project. At the time of the request, WSB and Associates had completed 98 percent of the final design for the roadway portions of the project. The streetscape design had received preliminary approval. . Council may recall that Mr. Jim Grube, Transportation Director for Hennepin County, accepted the request and agreed to revise the final design to meet the developer's petition for the shopping center. This change was to be completed by WSB and Associates, in cooperation with Hennepin County. Therefore, the preliminary geometric layout has been revised, and is ready for consideration by the City Councils of the City of Shorewood and Tonka Bay. The following is a description of the revisions performed to the layout. Access to the Smithtown Crossings Shopping Center The developer for the shopping center requested the addition of a left turn access and median cut on the south end of the shopping center property. Due to the proximity of the shopping center with the proposed intersection, this request was originally denied. In response, the developer has drafted an agreement with the owner of the Chocolate Shop to construct a frontage road through the chocolate shop property, to access the south end of the shopping center. n ~.1 PRINTED ON RECYCLED PAPER '# JD A Mayor and City Council County Road 19 August 24, 2003 Page 2 of 2 Impacts due to these revisions include larger portions of the existing shopping center having to be demolished, grading impacts to the chocolate shop property and additional tree loss for the property to the east of the chocolate shop. The roadway was widened to the inside of the curve to develop a left turn lane for this frontage road. Access for the Carpet/Tile Store The driveway for the carpet/tile store on the west side of County Road 19 has been revised through the Gideon Glen property. This revision aligns the driveway of the carpet store directly in line with the proposed entrance/exit of the shopping center. From a traffic and safety viewpoint, this is desirable. . Impacts of grading will have to be weighed by the City Council. If approved, an easement agreement will have to be granted.by the City to permit a cross easement for owners of the carpet store. Access for Wash and Roll Car Wash After considerable discussion regarding the access to the car wash, it was determined that the best scenario would be to align the car wash entrance directly opposing the driveway for the public works facility. This will require a small retaining wall along the outside of the proposed driveway; Grades between this drive~ay and the retaining wall for the Senior Community Center are significant, and will take closer review in the final design. If approved an access easement will be required between all fi ve joint owners of the Senior Community Center and the owners of the Wash and Roll Car Wash. If the revised preliminary geometric layout is found acceptable by the City Council, a resolution has been drafted for the City Council's consideration. Mr. Jim Grube, of Hennepin County, and Mr. Don Sterna, of WSB and Associates, will be present at Monday's City Council meeting to present the revised layout and answer any questions. . CITY OF SHOREWOOD RESOLUTION NO. 03- A RESOLUTION APPROVING THE REVISED PRELIMINARY GEOMETRIC LAYOUT FOR THE COUNTY STATE AID HIGHWAY 19/5MITHTOWN ROAD INTERSECTION REALIGNMENT PROJECT CITY PROJECT 97-08 . WHEREAS, the City Council of the City of Shorewood approved a preliminary geometric layout on November 5th, 2001, as prepared by WSB and Associates for the realignment of County State Aid Highway 19 as it intersects with Smithtown Road; and WHEREAS, revisions to said geometric layout have been requested and performed by Hennepin County on behalf of the developer of the Smithtown Crossings Shopping Center to improve access to said property; and WHEREAS, the City Council has reviewed said layout and found it to be in order.
