I have tried to summarize these options for ease of understanding. I would refer you to the Secretary of State's Website (www.sos.state.mn.us) for updated and complete information: . If you have an absentee ballot in hand and intend to vote for someone other than Paul Wellstone, then you can go ahead and send in that ballot and it will work for you. . If you have an absentee ballot in hand and want to vote for the person that the DFL Party chooses to fill the vacancy, then you may a. use that absentee ballot and write-in the name of the candidate of your choice~ or b. go to the polls on Election Day to cast a New RegularBallot~ or c. go in person to Shorewood City Hall or to Hennepin County in downtown Minneapolis prior to Election Day, bringing your original absentee ballot with you to swap for a New Regular Ballot, when they become available. . If you have sent in an absentee ballot with a vote for Paul Wellstone on it, and want to cast a new vote in the US Senate race, you may go to the polls on Election Day to cast a New Regular Ballot that will replace your original absentee ballot. Note: If you have already returned your absentee ballot, Minnesota state law does not allow us to void that ballot and mail you a new supplemental ballot (MS 204B.41). The only way to change your vote is to go to the polls on Election Day. n ~J PRINTED ON RECYCLED PAPER October 28, 2002 Page Two The Secretary of State's office is reviewing the laws on Absentee voting to determine if there are any options for voters who already submitted an absentee ballot, and would like to change their vote, but are unable to go to the polls on Election Day. We are continuing to process absentee ballots until further notice from the Secretary of State. City Hall will be open for absentee voting on Saturday, November 2 from 10:00 a.m. to 3:00 p.m. and Monday, November 4 from 8:00 a.m. to 5:00 p.m. As of this time, we do not have information as to when the New Regular Ballot and Supplemental Ballots will be printed and delivered to City Hall. Agenda Item #3B: This resolution approves issuing licenses to retailers to sell tobacco products. Eight applicants have met the license requirements; therefore, approval is recommended. The license period runs from November 1,2002 to October 31,2003. Agenda Item #3C: This resolution sets delinquent utility charges and other charges and fees to be certified to the County as.a levy on the property taxes. This resolution is passed annually. If anyone in the audience is present to question or contest the delinquent charges, this item should be removed from the consent agenda and placed under Section 8 - General, later on the agenda. '. . .' Agenda Item #3D: This resolution establishes an Absentee Ballot Board for the 2002 General Election. State Statute 203B.13, Subd. 1 provides that an Absentee Ballot Board . consisting of at least 2 election judges of different political parties may be appointed to perform a number of duties prior to Election Day. It is anticipated there will be over 350 absentee ballots to process. In order to facilitate the absentee ballot process, it would be beneficial tohave an Absentee BallotBoard perform the duty of "accepting" or "rejecting" absentee ballots. The Accepted ballots would be delivered to the polls on Elections Day, at which time they would be opened, recorded and counted Agenda Item #3E: The Liquor Committee is recommending approval of Full-Time Liquor Clerk II position and appointment of Ms. Dale Field to this position. This position would provide a promotional opportunity to liquor operations staff. Agenda Item #3F: The South Shore Senior Center has requested approval of a temporary sign permit announcing its holiday boutique and chicken. dinner. Agenda Item #8A: BFI has requested approval to pick up refuse from Shady and Enchanted Islands on Monday instead of Thursdays when the recycling is picked up. Although a number of Island residents appear to like the Monday pick up, the rationale for such a departure from the new ordinance seems inadequate. Whatever the outcome of this request, staff will send out letters to Island residents advising them of the City's decision. . Agenda Item #8B: Staff recommends adoption of an order to secure the hazardous building at 5655 Eureka Road within 10 c;1ays. PARKS A. Report on Park Commission Meeting Held October 8, 2002 Commissioner Davis reported on matters considered and actions taken at the October 8, 2002, Park Commission Meeting (as detailed in the minutes of that meeting). B. Set the Park Master Plan Open House Meeting Date for October 22, 2002 Turgeon moved, Zerby seconded, Setting the Master Plan Open House Meeting Date as October 22, 2002, from 5:30 -7:00 P.M. at City Hall. Motion passed 5/0. 7. PLANNING . Commissioner Packard reported on matter considered and actions taken at the September 24, 2002, and October 1, 2002, Planning Commission meetings (as detailed in the minutes of those meetings). She noted the Commission would be reviewing issues related to senior housing regulations and density requirements. She requested input and direction on these issues from Council. Councilmember Turgeon stated she believed the purpose in reviewing these issues should include consideration of all options to move past parameters set in the current regulations. She asked that the Commission seek out innovative ways to bring affordable senior housing to the City and suggested Staff speak to representatives of the City of Minnetonka for suggestions on innovative measures taken regarding the need and building possibilities for affordable senior housing in that city. Council agreed with this suggestion, and Mayor Love also requested these issues be examined to avoid benefits of affordable senior housing being lost to market-driven land economics. Commissioner Packard thanked the Council for its direction on these issues. . . . CITY COUNCIL REGULAR MEETING MINUTES October 14, 2002 Page 3 of 6 8. GENERAL A. Reschedule the First Council Meeting of November and Schedule a Work Session Administrator Dawson explained the first Council meeting date was Veteran's Day, which was a holiday, and suggested the Council hold the first Regular Council Meeting and Work Session on November 12, 2002. Council agreed. B. Schedule Canvassing Board Meeting Administrator Dawson stated the Canvassing Board must meet soon after the General Election on November 5, 2002, to approve the local election results of the Election. It. was suggested this meeting takeplace on Wednesday, November 6,2002, at 6:00P.M.. Council agreed. C. Opt-Out Transit Proposal Administrator Dawson explained the City had been included in special legislation in 2000 to allow the City of Minnetonka to "opt out" of the delivery of transit services by Metropolitan Council Transit Operations (MCTO). He went on to explain that in the 1980's, several cities were unhappy with the amount of transit service for the amount of money the Metropolitan Transit Commission (MTC) was levying against property taxpayers. Legislation was enacted at that time permitting municipalities to provide their own services, thus "opting out" of service provided by MTC. Any funds available after providing replacement services could be used for other transit purposes, such as additional buses during rush hours, local dial-a-ride or circulator services. The legislation did not allow opt-out cities to lower the transit tax rate; rather, it gave them the opportunity to provide more and/or better-tailored service for about the same amount of taxes paid. The Legislature established a deadline for "opt out" services in the early 1990' s. Special legislation was enacted in 2000 to except Minnetonka and Shorewood from the state law regarding the establishment of opt-out transit services. In order for the City to avail itself of this legislation, action needed to be taken by June 30,2003. Administrator Dawson then explained transit was a specialty area, and was even more specialized given the context of transit jurisdiction and funding within the metropolitan area. As a result, a proposal had been submitted for a Needs Assessment and Feasibility study. He also explained the firm was highly recommended by a number of metropolitan cities and would allow the Council to make a well-informed decision regarding opt-out transit services. Mayor Love stated this proposal would afford the City an opportunity to examine needs of the local area, and how well those needs were being met. In response to Mayor Love's question, Administrator Dawson stated the amount of funding would not necessarily change for transit service; however, the purpose of the study was to find ways to provide improved transit services with similar amounts of funding. Lizee moved, Zerby seconded, Authorizing the Services of LJR, Inc., for opt-out transit planning services per its proposal of September 27, 2002, on an hourly-fee basis, not to exceed $15,000. Motion passed 5/0. 9. ENGlNEERINGIPUBLIC WORKS A. Petition to Tonka Bay to provide water service to the South Lake Minnetonka Public Safety Facility Engineer Brown explained that as the plans for the South Lake Minnetonka Public Safety Facility site had progressed through the review process, it had been determined that the most economical method of CITY COUNCIL REGULAR MEETING MINUTES October 14, 2002 Page 4 of6 . . providing adequate fire suppression flows and domestic water supply to the Public Safety Facility site was via the City of Tonka Bay water system. Engineer Brown also reviewed background information regarding fire flow regulations and the current water main extending from the City of Tonka Bay water system to the Public Works facility. He noted the proposed action was the most economical and feasible solution to the issues related to bringing appropdate water supply to the Public Safety Facility. Zerby moved, Lizee seconded, Adopting RESOLUTION NO. 02-082, "A Resolution Authorizing the Mayor and City Administrator to Enter into a Cooperative Agreement with the City of Tonka Bay for Utility Services." Motion passed 5/0. B. Authorize Feasibility Report for Watermain Extension from Minnetonka Drive to Hwy.7 . . . Engineer Brown stated that as part of the review process for the Cub Foods proposal, the Fire Marshal had supplied information regarding an increased need for fire flow to the site. This need for increased fire flow would require further action by the Commission and Council as part of an amendment to an existing Conditional Use Permit. As a separate matter, the City had received and approved a preliminary plat for a 14-10t subdivision, known as Linden Hills, which surrounded Lake Linden. He went on to explain municipal water service was not available to either one of these sites. Since the recent addition of the Linden Hills plat, he noted it would seem practical to consider extending water service to the Cub Foods site. Staff requested the authorization to have a feasibility report prepared to further examine the practicality, costs, and opportunities that existed to service the subject areas. He stated preliminary discussions with each developer had been initiated regarding the possibility of making municipal water service available in these areas. Both applicants were concerned about the timing of the project. . Engineer Brown also stated if a feasibility report indicated a practical application; this water main would serve as a trunk watermain with the cost to be borne by the developers. He stated the residents would not be assessed as part of this project as the project would only make available an opportunity for residents from the Clover Lane/Gillette Curve area along Minnetonka Drive southward to Yellowstone Trail and into the Linden Hills development. Existing property owners could begin municipal water service as a result of any installation without assessment cost; however, should residents wish to connect to the municipal water supply a connection fee would be expected at the time of connection. Mayor Love stated he saw this as an opportunity to gain valuable infrastructure at no cost to the City. Engineer Brown agreed, noting the action before Council this evening only directed a feasibility study and did not necessarily presuppose results. . Councilmember Garfunkel asked if the developers had requested municipal water. Engineer Brown responded that was not the case. Councilmember Garfunkel stated he was also concerned the cost of the feasibility report would not be able to be recovered should the report indicate it would not be a practical application. Councilmember Turgeon agreed. Mayor Love also stated he thought the developers should demonstrate some interest prior to moving forward with the report. Councilmember Zerby stated this was an opportunity to gather citizen input as to whether there was interest in municipal water along the potential route from residents. Council reviewed various options for proceeding with this issue. Mayor Love suggested this matter be reconsidered in two weeks, thus, giving Staff the opportunity to meet with the developers to determine whether there was interest in this project. . ."., CITY COUNCIL REGULAR MEETING MINUTES ~ October 14,2002 Page 5 of6 . . Councilmember Zerby also commented the potential water main would be a long dead end main. Councilmember Turgeon suggested the possibility of linking this main with a water main in Chanhassan beneath Highway 7. Engineer Brown stated this issue could also be explored as part any future project for the area. 10. REPORTS A. Administrator & Staff 1. Gideon Glen Administrator Dawson stated there was nothing further to report on this matter at this time. 2. County Road. 19 Intersection Engineer Brown stated a meeting had taken place in the past week with representatives of Hennepin County, Tonka Bay and the Smithtown Crossing Shopping Center. Plans for the intersection project were nearly complete and ready for bids; however, there had not been any change to the status of the value of the Liquor Store. He stated representatives of Hennepin County expressed concern regarding the project cost. Councilmember Turgeon stated she was concerned for exceeding project costs as well, noting it seemed as if liquor sales were more important than public safety in this matter. She stated making the intersection safer for all residents of area cities was worth more than revenue. Mayor Love agreed. Councilmember Garfunkel also agreed, noting he did not fault the City of Tonka Bay for requesting reasonable compensation; however, the issue became what was reasonable compensation. Councilmember Garfunkel also explained the Liquor Committee had met earlier this evening, and continued planning the process to vacate the store by the end of November. If the County and City of Tonka Bay reached settlement and the City approved the project, business could continue until the construction of the project necessitated relocation or dissolution of the business. He stated all options had been offered to no avail. Mayor Love stated he believed municipa1liquor sales needed to benefit residents of the City where it was being sold in some way. Shorewood had given up all revenue in this matter in effort to provide enhanced safety measures to its residents, and was requesting Tonka Bay consider giving up only a portion of its revenue. 3. Public Safety Facilities Administrator Dawson stated a groundbreaking ceremony for the Public Safety Facility-West Side Station had been scheduled for Saturday, November 9, at 10:00 A.M. Refreshments would be served at the Southshore Senior/Community Center following the ceremony. B. Mayor & City Council Councilmember Garfunkel stated the Liquor Committee had also discussed the status of the Shorewood Plaza store and potential relocation to a different store in the Center as a result of the CUB Foods redevelopment project. CITY COUNCIL REGULAR MEETING MINUTES October 14, 2002 Page 6 of 6 Mayor Love stated he had attended a Leadership forum sponsored by the South Lake Minnetonka Chamber of Commerce including a panel discussion between the mayoral candidates of the five member South Lake Minnetonka communities and the Superintendent of the Minnetonka School District. TO: FROM: RE: In past elections, the City has experienced a high voter turnout rate at the General Election; therefore, the polling places are very busy during the Election Day. This leaves little time for election judges to process absentee ballots during the normal election hours. To date, we have received approximately 200 requests for Absentee ballots and anticipate an additional 150 between now and November 4. An absentee ballot board may perform a number of duties prior to Election Day, including "accepting" and "rejecting" absentee ballot envelopes. . During the process of "accepting" and "rejecting" absentee ballots, election judges or absentee ballot board members examine the absentee return envelope. The envelope would be marked "Accepted" if the following requirements are met: 1. the voter's name and address on the return envelope are the same as the information provided on the absentee ballot application; 2. the voter's signature on the return envelope is the genuine signature of the individual who made the application for ballots and the witness certificate has been completed as prescribed in the directions; 3. the voter is registered and eligible to vote in the precinct or has included a properly completed registration card in the return envelope; and 4. the voter has not already voted at that election either in person or by absentee ballot. State Statutes have given municipalities the authority to establish an absentee ballot board by resolution for this purpose. Attached is a draft resolution establishing an absentee ballot board to "accept" and "reject" absentee ballot envelopes during the 30 days prior to the General Election. By following this procedure, the ballot envelopes are not opened, and the polling place rosters are not marked indicating that the voter has voted by absentee, until election day when the absentee ballots in sealed envelopes are delivered to the polling place after the last mail delivery. According to the joint powers agreement, a majority of the councils of the 16 cities of the LMCC must review and approve the budget before it is authorized. The revenues for the LMCC come from franchise and access fees paid by subscribers to cable services in the 16-city area. There is no tax support or other payments from the member cities for LMCC operations. At the Council's meeting on 14 October, a sign permit request for Snyder Drugs was continued to 28 October, pending clarification of design issues (see staff report, dated 4 October 2002). As stated in the 4 October memo, one of the proposed signs was inconsistent with the conditional use permit under which the shopping center regulated. As it turns out, the plan for the sign in question was drawn in error. The signcompaily has submitted a revised plan (see Exhibit A) showing the new wall sign installed within the established signage band on the building. As you may recall, the anchor tenants for the center get three signs. Approval of the sign permitis recommended subject to removal of either the large, west-~acing pharmacy sign or the smaller one-hour photo sign. The changeover to same day refuse and recycling has gone relatively smoothly, with one exception. For whatever reason, BFI did not receive notice of the 1 October deadline for Wednesday pickup (Thursdays for Shady and Enchanted Islands). In mid-September they came to us and requested an extension. Staff allowed them to start on 1 November, provided they sent letters to their Shorewood customers explaining the situation. They recently purchased Blackowiak & Son, Inc., giving them all accounts on Shady and Enchanted islands. Since then they apparently discovered that the islands were part of Shorewood. Unfortunately, they recently announced to their island customers that they would be switching to Mondays for refuse collection. Dan Jurik, BFI Operations Manager, has now requested that Shorewoodallow refuse to be picked up on the islands on a different day than recycling, which is still picked up on Thursdays. The new ordinance specifically states the refuse will be picked up on Shady and Enchanted Islands "unless otherwise authorized by the City Council". In support of their request, BFI conducted a telephone survey of their island customers. Thirty-six oftheir customers responded, six of which clearly do not want separate days for refuse and recycling. Thirty seem to like the new Monday pick-up and do not care if recycling is on a separate day. These responses are copied and attached for your review. The City Council for Shorewood recently passed a new ordinance that changes all garbage collection to Thursday in your area, which is the day your recycling is currently collected. Because the area South of Wills hire Blvd. is so condensed, we are able to collect the trash in that area on one day, currently Monday. The City of Shore wood agreed to let us continue servicing this area on Monday's if we got the approval from our customers. Would you like to keep your trash collection day on Monday? e NO The one issue in keeping trash day to Monday is recycling collection is being switched by the City to Thursday. Our office has received a resident complaint alleging that the above-referenced building has been abandoned and fallen into disrepair. Upon inspection of the premises the building was found to have been vacated and left in a hazardous condition. Attached for your consideration is 1) an order to secure the building within 10 days; and 2) an order to repair of remove the building within 20 days. Realistically, the building appears to be beyond repair and should be demolished. The owner of the property is advised by copy of this memorandum that this matter will be discussed by the Council at its 28 October 2002 meeting. To: Craig and Karen Buechler 1) Pursuant to Minnesota Statutes Sections 463.15 to 463.261, the Council of the City of Shorewood, having duly considered the matter, finds the above-described building to be a hazardous building for the following reasons: (a) Rotting wood and structural deficiencies, including rafters, headers, studs, siding, sheathing and joists (b) Building is dilapidated, windows broken, windows boarded over, building has decay and is a hazard. (c) House and garage have. rodent harborage. (d) Garage is not secure from entry and is an attractive nuisance. ( e) Electrical service is disconnected; well cap is missing. (f) Trash and similar items in and around house. 2) Pursuant to the foregoing findings and in accordance with Minnesota Statutes Sections 463.15 to 463.261, the Council hereby orders the record owners ofthe above-hazardous building to repair and make such building safe and not detrimental to the public health, welfare and safety by making the following necessary repairs: (a) Secure the building. (b) Make those repairs required to bring the building into conformance with all applicable building codes. Either such repairs shall be completed within twenty (20) days of the date ofthe service of this Order or the building shall be razed or removed before that date. Att~z., . 3) The Council further orders that unless such corrective action is taken or an answer is served upon the City of Shorewood and filed in the office of the Clerk of District Court of Hennepin County, Minnesota within twenty (20) days from the date ofthe service of this order, a motion for summary enforcement of this order will be made to the District Court of Hennepin County. 4) The Council further orders that if the City is compelled to take any corrective action herein, all necessary costs expended by the City will be assessed against the real estate concerned and collected in accordance with Minnesota Statutes Section 463.22. .5). The Mayor, Clerk, City Attorney and other officers and employees of the City are authorized and directed to take such action, prepare, sign and serve such papers as are necessary to comply with the Order and to assess the costs thereof against the real estate described above for collection along with taxes. .
