Agenda Item #3B: Staff requested bids for Fall Clean-up Service from three vendors. Staffis
recommending the contract for 2002 Fall Clean-up Service be awarded to Waste
Technology. Approval requires a simple majority vote by Council
Agenda Item #3C: This motion sets the date of the Annual Appreciation Party for Friday,
December 6. The Minnetonka Country Club has been reserved for this event.
Agenda Item #30: This Resolution approves a simple subdivision of property at 24340
Yellowstone Trail, as approved at the September 23 Council meeting. A simple majority
vote by Council is required.

Agenda Item #3E: This request for sign permits for the Snyder Drug store at the Shorewood
Village Shopping Center actually includes applications two separate signs. Since one of
the proposed signs complies with the City Code while the other does not, it is
recommended that this item be continued to the October 28 City Council meeting.
Agenda Item #3F: Staff is recommending adoption of a resolution to approve a Temporary
Gambling License for Friends of the Southshore Center. The date of the raffle is Tuesday,
January 7,2003, at the Southshore Center, 5735 Country Club Road in Shorewood.
Agenda Item #3G: Minnetonka Public Schools has requested the City participate in the "Kids
Voting Minnesota" program - a program which allows children in K-12 to go to the polls
on Election Day and actually cast their vote at a polling table just for the children.
Arrangements have been made to provide space at each of the four mainland polling
locations in the City of Shorewood for "Kids Voting". Minnetonka Public Schools is
arranging for volunteer staff at each polling location. A motion adopting the Kids Voting
Proclamation is recommended.

, Executive Summary - City Council Meeting of 14 October, 2002

Agenda Item #6A: A Park Commission representative will report on the October 8 Park
Commission meeting.
Agenda Item #6B: The Park Commission is inviting Shorewood residents to review the Park
Master Plan at an Open House on Tuesday, October 22,2002 from 5:30 -7:00 p.m. at
City Hall. The public is invited to review the plans and provide comments.
Agenda Item #8A: The second Monday in November falls on the Veteran's Day holiday-
November 11. Council should determine if it wishes to hold its first meeting of
November on Tuesday, November 12, or an alternate date, which may be more suitable
to Council's schedule. The Park Commission is schedule to meet on Wednesday,
November 13. Council should also schedule a Work Session meeting on this same date,
following the Regular Council meeting, to discuss enterprise budget funds.
A motion scheduling the date of the first Council meeting in November and the Work
Session meeting is in order.

Agenda Item #8B: The Canvassing Board must meet soon after the Election to approve the
local election results of the Tuesday, November 5 General Election. It is recommended
this meeting take place on Wednesday, November 6 at 6:00 p.m. A motion scheduling
the date of the Canvassing Board meeting is in order.

Agenda Item #8C: Staffhas received a proposal from LJR, Inc., to provide opt-out transit
planning services. The City has until June 30, 2003, to decide whether it wants to avail
itself of this opportunity created by special legislation in 2000. In his discussions with
members of other city staffs and transit organizations, the city administrator consistently
received unsolicited recommendations to use this firm. Consequently, only this proposal
has been solicited at this time. Staff believes that the proposal meets the City's
objectives, and the study contemplated would be thorough, concise, and within the
amount in the 2002 budget. Accordingly, staff is recommending that the Council
authorize the services described in the proposal on an hourly-basis, not-to-exceed
$15,000 fee.
Agenda Item #9A: The Director of Public Works has determined that the most cost effective
method of providing fire protection to the South Lake Minnetonka Public Safety site is
via the City of Tonka Bays water system. Pursuant to the cooperative agreement with the
City of Tonka Bay, the City of Shorewood must provide a formal request to Tonka Bay
for these services. Staff has prepared a resolution requesting Tonka Bay water service for
this facility.
Agenda Item #9B: Staff is requesting authorization to prepare a feasibility report to extend
municipal water service to the Cub Foods and Linden Hills plat. WSB and Associates
has prepared a proposal for these services. Staff will be presenting this item in greater
detail at Monday night's meeting.

5. PARKS
A. Report on Park Commission Meeting Held September 17, 2002
Commissioner Callies reported on matters considered and actions taken at the Park Commission Meeting
of September 17,2002 (as detailed in the minutes of that meeting).
Councilmember Zerby commented how wonderful it was to see fundraising for the year by the Park
Foundation approach its annual goal.
Councilmember Turgeon thanked the Public Works Department for its efforts and dedication in making
Freeman Park so clean for the Girls Fastball Tournament held there this past weekend,
Commissioner Callies reported after consideratIon by the Park Commission and Staff there would be no
winter ice-skating at Freeman Park this year.
6. PLANNING

Commissioner Borkon reported on matters considered and actions taken at the Planning Commission
Meeting of September 17,2002 (as detailed in the minutes of that meeting).
A Linden Hills Preliminary Plat
Applicant: Mike Seifert
Location: 23665, 23775 and 23785 Yellowstone Trail
Director Nielsen explained the applicant had assembled three parcels of land located at 23665,23675, and
23685 Yellowstone Trail. Mr. Seifert proposed combining the parcels and then platting them into 14
single-family residential lots. The property currently contained 12 acres, with approximately 2.5 acres
being Lake Linden. The property was zoned Single-Family Residential, with three houses currently
existing on the three parcels. The easterly two houses and their associated accessory buildings would be
removed, and the developer intended to keep the westernmost house and its detached garage as his
residence.
All proposed lots were over the minimum lot area for the zoning district. A cul-de-sac shown on the
preliminary plat as Minnetonka Court, since named Lake Linden Court, served all lots. With regard to
issues and analysis of the case, Director Nielsen stated the zoning for the project allowed for single-
family homes on 20,000 square-foot lots. The proposed lots would meet or exceed the minimum
requirements for area width and depth, and the use an proposed lot size were within the land use
designation recommended for the area in the Comprehensive Plan. The wetland had been set aside as an
outlot to be deeded to the City, pursuant to wetland regulations. All buffers related to wetlands could
easily be accommodated as part of the plan.

Regarding grading, drainage and utilities, Engineer Brown had prepared a report for the Commission for
this case. The development ofthe property would involve cutting into the site near Yellowstone Trail and
filling one of the existing low areas to create the road. A storm water detention pond would be excavated
on the west side of the new street, between Lots 11 and 12. With regard to right-of-way, easements, and
roadways, he noted the maximum street grade needed to be revised from the shown 8% grade to the
required 6% grade, and vertical sight distance requirements for most recent MSA standards should be met
in design. He also recommended additional catch basins installed on Lake Linden Court prior to the
entrance onto Yellowstone Trail to avoid additional water entering onto Yellowstone Trail. While this

effort would require additional grading and tree impact to the site along the roadway, this requirement
was critical from a traffic safety perspective. Engineer Brown went to explain in his report that there was
an existing depression with significant tributary area centered on the common lot boundary of Lots 4 and
5. It was recommended that the applicant's engineer provide a design for an emergency overflow for this
area, similar to the proposed NURP pond, to insure the integrity of the houses from flooding. Sanitary
sewer was available to the site by an existing main located on Yellowstone Drive, and while municipal
water service was available 1500 feet away, it appeared the site would be served by existing wells. Staff
was recommending approval, subject to the referenced conditions.
Councilmember Zerby questioned whether an easement existed along Yellowstone Trail. Engineer
Brown responded affirmatively noting there was the standard fifty-foot right-of-way, and the final plat
would be exa.mined for future trail possibilities.

Councilmember Lizee expressed concern for the steep grades on the site. James Parker, of Adva.nced
Surveying and Engineering and representing the applicant, stated the grades would be reduced to the
required six percent; however, it would require a delicate balance of grade work and trees. He noted
many other cities had grading standards of ten percent, and requested Council consider this same standard
for this proposal.
Councilmember Lizee also questioned where the low ponding area drained. Mr. Parker stated the water
in the ponds seeped into the ground, as there was not an outlet for the water to a larger water source. He
noted water rarely stood in these ponding areas for any length of time despite the wet weather this season.
The soil boring showed the soil at the bottom of these ponds were mostly gravel, thus, making the ponds
act as an infiltration system of sorts. Engineer Brown further commented there was no outlet for Lake
Linden, but there was a vast amount of storage available in the outlot area. He stated the applicant's
engineer was also being required to verify calculations for. stormwater management purposes to remove
liability in this case.

With regard to municipal water being available to this development, Mayor Love commented he hoped
there would not be any assessments to the residents of Minnetonka Drive in securing municipal water to
the site. Engineer Brown stated there would be anticipated connection costs for residents in that area, but
not an assessment for the project, as it would be the developer's responsibility, as well as the CUB Foods
Store developer, to provide funding for a watermain from Minnetonka Drive at Gillette Curve to the
proposed plat area, if completed under this proposal. Engineer Brown stated the Planning Commission
and Staff had recommended approval of the preliminary plat with the proposal including individual wells
for this project, but he would also continue to seek additional alternatives for providing water to the
development.
Garfunkel moved, Turgeon seconded, Approving the Preliminary Plat, subject to Staff
Recommendations, for Mike Seifert, 23665, 23775 and 23785 Yellowstone Trail. Motion passed 5/0.
B.
Setback Variance
Applicant:

5380 Howard's Point Road
Director Nielsen reviewed the history of this request, noting the applicant had owned the property at 5380
Howard's Point Road. The applicant had proposed to tear down the existing home on the property and
build a new home on the portion of the lot to the east of Howard's Point Road, and was requesting an 18-
foot variance for the side yard abutting Edgewood Road. Director Nielsen also explained the property
was zoned Single Family ResidentiallShoreland and contained approximately 1.8 acres, the rear third of

which was occupied by designated wetland. The property was cut in two by Howard's Point Road, with
the existing house and deck located on the westerly portion of the lot, very near the shoreline of Lake
Minnetonka. A detached garage was located on the east side of the lot, abutting the right-of-way. The
new house would be 50 feet from the right-of-way from Howard's Point Road. A proposed setback from
Edgewood Road was 47 feet, measured from the paved surface of the roadway, as there was discrepancy
as to whether Edgewood Road had any right-of-way. Director Nielsen also explained the applicant's
survey did not show an easement that would make the buildable area of the lot even narrower.
In analysis, Director Nielsen explained this proposal was quite interesting, as the irregular shape of the lot
and road dividing the parcel in two would satisfy the criteria of physical uniqueness for granting a
variance. He noted the property to be long and narrow, extending to a wetland basin in the rear of the lot
Further, the required .. setbacks imposed by the zoning district would render the property nearly
unbuildable.The proximity of the. current structures to the lake and road would result in an. increase of
nonconformity precluding expansion of the home or garage. Director Nielsen stated if the variance would
be granted, many nonconformities would be resolved with regard to zoning requirements for the City.
Director Nielsen stated Staff believed this request had considerable merit, however; the Planning
Commission debated issues of hardship. The applicant stated a two-car garage exists across the street
from the home currently, making its use difficult in winter months. Also, the property was extremely
nonconforming in its current state, and a variance would be needed to make any changes to the site. The
applicant had stated the property was for sale, and as yet had no specific designs for a new house.

Director Nielsen introduced Paul Larsen, realtor for the applicant. Mr. Larsen stated he believed the
request for variance had considerable merit as well and he believed all elements were present to satisfy
the criteria for variance in this case. He went on to explain the applicant had chosen a house plan that
would be appropriate to the size ofthe site. Also, he had studied several precedents for granting variances
in cases such as this one, and he believed this case also met the criteria established through past
experience. He stated the house was built in 1900, and was approaching the end of its use. He also, cited
variance profiles and home prices in the neighborhood, noting the anticipated cost for the new home to be
approximately $1.5 million. With this new house, he noted the driveway would egress to Edgewood
Road, making the lot safer and having less hardcover than current conditions. He stated the property
would be sold, as an offer was pending, upon Council approval of this matter.
Mayor Love reminded Mr. Larsen that economics of a situation could not be considered as a reason for
granting a variance.

Director Nielsen stated the neighbors to the northeast had stated concerns for additional drainage in the
area as a result of the new construction of a home on this site. The applicant had agreed to grant an
easement along the property to install a culvert to alleviate additional drainage in the northeast corner of
the site.
Mayor Love stated he had great respect for the recommendations of the Planning Commission, but
questioned the issues of concern, as it seemed this case presented an opportunity to move more concerns
away from the lakeshore.
Commissioner Borkon stated variances were always controversial for the Commission as there was room
for interpretation in the criteria for granting variances. She stated the Commission questioned the
hardship in this case as well as whether reasonable use could be made of the property without the
variance. Councilmember Turgeon stated the Commission had concerns as to what the minimum amount
of variance could be in this case since specific design plans for the site were not presented.

Councilmember Garfunkel stated he also believed the Commission had reservations regarding granting a
variance without knowing the accurate amount of variance necessary. He stated the request seemed
reasonable without setting a precedent, and he liked the proposal. Councilmember Turgeon agreed, but
stated she would like to see accurate design plans for the site to be able to understand the extent the
variance request could be minimized.
Mr. Larsen also commented the sight lines to the lake for the neighbors would be greatly improved with
this proposal, and improvement to the site would be better for the City as well.
Mayor Love explained it seemed Council was willing to work with the site, but would like additional
information to avoid misunderstanding. Director Nielsen stated the buyer for the property had indicated a
willingness to choose plans for the site, and he anticipated this could be accomplished within 30-60 days.
The applicant would then need to waive the statutory.60-day rule. for Council review of this case.

Mr. Larsen stated the applicant would resubmit the plans and would be willing to waive the 60 days for
review by Council.
Lizee moved, Garfunkel seconded, Continuing this case to November 25, 2002, subject to receipt of
a letter from the applicant waiving the 60-day rule by September 26, 2002, and submission of
design plans for the site submitted to the Planning Commission no later than October 30, 2002.

C.
Simple Subdivision

Director Nielsen explained in November 2000, the applicant had requested approval of a simple
subdivision to divide his property at 24340 Yellowstone Trail into two lots. The applicant then withdrew
his request before the Planning Commission could hear it. He had now submitted a new application
addressing areas of concerns found within the original application. The application had been revised to
include a survey that included a 17-foot right-of-way for Country Club Road as recommended. The
applicant had submitted all of the legal descriptions for the conservation easement, road right-of-way, and
the drainage and utility easements. The existing barn must be removed or moved onto the southerly lot.
Deeds must be provided for the various easements. Park dedication fees and sanitary sewer charges were
established. The applicant also must provide a title opinion prior to release of a resolution. The
subdivision had been redrawn as previously recommended. Any new building for the site would need to
be built to storm water management plan guidelines.
Carl Zinn, representing the Bootes, was in attendance, and offered to answer any questions Council may
have had of him.
Turgeon moved, Zerby seconded, Approving the Simple Subdivision, subject to Staff
Recommendations and Directing Staff to Prepare a Resolution for Marvin and Hazel Boote, 24340
Yellowstone Trail. Motion passed 5/0.
D. Multiple Dock Facility License Application
Applicant: Shorewood Yacht Club
Location: 600 West Lake Street

Director Nielsen explained the Shorewood Yacht Club was in violation of its current Conditional Use
Permit by leasing space for powerboats and for operating without a license. The owners had responded
with a letter, and subsequently an incomplete license application. Given the current zoning violation and
no attempt by the owners to comply, Staff recommended denial of the 2002 Operating license for the'
Shorewood Yacht Club. The City Attorney had begun formal legal action regarding this matter.
Attorney Keane reviewed the history of the violations and current legal action being pursued through the
justice system.
Judy Cross, along with husband, John Cross, owners of the Shorewood Yacht Club located at 600 West
Lake Street, stated she appreciated the opportunity to address Council regarding this matter. She stated
she did receive the letter regarding operation without a license. She stated she had inadvertently
overlooked this matter, and reacted irrlI11ediately to the letter by pursuing an application at . City Hall.
After a brief misunderstanding with City Staff regarding the fee for the license, she received accurate
information and submitted a letter of application to Director Nielsen without the check. Since that time,
she had delivered the check and license on Friday, September 20,2002, with receipt of the letter received
today. Mrs. Cross went on to explain the Yacht Club had hoped to make use of all sailboat slips on Pier
4, but current economics of the sailboat industry had not allowed this to happen. With numerous requests
from powerboat owners for leasing of the slips, she read the Conditional Use Permit and zoning
requirements, noting historical use of the site included a few powerboats. Because of this history of use
by powerboats at the Yacht Club, she believed she could rent slip space to the powerboat owners. She
had not heard any previous complaints this year, and noted without the leasing of the slips to powerboat
owners, the Yacht Club would have incurred severe financial hardship.

Councilmember Turgeon stated she had spoken with Mr. Cross regarding this matter, noting the historical
use stated in the Conditional Use Permit applied to the marina, not the location of the piers. She greatly
appreciated Mr. Cross's work with establishing the Lakeshore-Residential zoning requirements; however,
these requirements clearly stated the Yacht Club was for sailboat use only.
Councilmember Zerby stated he agreed a violation had been made in this case, but had heard merit in
possible future changes for the L-R district as sailboats used motors to get under sail.
Councilmember Turgeon stated she had explained to Mr. Cross that application could be made for an .
ordinance amendment in this case. Regardless of those possibilities, she stated the license still remained
in question. She also questioned the legal process for this matter.
Attorney Keane explained the options for granting a license and legal implications for the owners of the
Shorewood Yacht Club as a result of the violations.
Mrs. Cross stated she viewed this matter as an opportunity to work with the City as times changed
economically for their business. Mayor Love stated making application for a license or following the
process for obtaining an ordinance amendment would more clearly have showed this sincere opportunity.
Councilmernber Lizee stated she did not think it was the job of City Staff to obtain and enforce licensing
requirements, as it was the responsibility of business owners to secure a license in the appropriate
timeframe.
John Cross stated a license had not been needed for many years. Councilmember Turgeon reminded him
licensing requirements were enacted with the designation of the L-R district. Mayor Love also

commented power boats were not being discriminated against in this case, as the marina was allowed to
have four of them.
Lizee moved, Turgeon seconded, denial of the 2002 license for the Shorewood Yacht Club. Motion
passed 5/0.
7. GENERAL
A. City of Excelsior Sesquicentennial- Request for Support
.
Linda Murrell, Executive Director for the Excelsior Chamber of Commerce, stated the Excelsior
Sesquicentinnial committee was requesting financial support and/or volunteer time for Excelsior's l50tb
Anniversary Celebration being planned for 2003. The Committee planned to host a series of events
throughout the year, culminating on August 16 and 17,2003. She stated the Celebration Committee was
requesting support from all South Lake Minnetonka communities as Excelsior provided a sense of place,
shared community heritage, and celebrated the present. She encouraged participation of all South Lake
Minnetonka residents, and asked for Shorewood's help in making the celebration memorable for all
community residents.
Mayor Love thanked her for her efforts to represent all communities in this celebration and questioned
what Shorewood's role would be in the celebration other than financial support. Councilmember
Garfunkel questioned the amount of monies contributed by other South Lake Minnetonka communities.
Ms. Murrell explained that information was uncertain at this point in time as all communities and
businesses had not yet been contacted.
Mayor Love stated he. was concerned that without substantive involvement of all communities, the
celebration could not be labeled a community event. He stated he was greatly aware of the history of the
founding of the communities, and would be more receptive to hearing how Shorewood could be more
involved. Also, Council invited Ms. Murrell to return at a later date to revisit this matter once additional
funding resources were established.

8. ENGINEERINGIPUBLIC WORKS
A. Accepting a petition for Harding Lane and Ordering Preparation of Feasibility
Report
Engineer Brown explained residents from the Harding Lane and Glen Road area were requesting a
drainage improvement be performed to address the runoff entering the rear yards and homes from the
upland area of the Country Club Meadows development. He went on to explain the Harding Lane area
had been an area of issue for many years. In review of the plat for Harding Acres Second Addition, it was
discovered there was a drainage easement ranging 40 to 50 feet wide platted across the rear of the
property to provide for drainage of the upland areas recently developed. From a technical standpoint, this
approach would be acceptable. From a homeowner's perspective, the drainage was a nuisance.
Petitioners had stated the new Country Club Meadows subdivision had aggravated this situation. While
dramatic steps were taken to force as much of the drainage from Country Club Meadows to Fairway
Drive, ultimately drainage flowed to Smithtown Road in order to minimize impacts to the Harding Lane
and Glen Road areas.

After meeting with the neighborhood on September 3rd, 2002, to discuss issues of concern, several steps
had been taken to try to address the situation. Staff had discussed issues with the current developer of
Country Club Meadows, to insure houses that had not changed ownership had gutters installed to direct
the drainage back to Fairway Drive. Secondly, Staffhad met with other property owners toward the north
end of the cul-de-sac to advise them of issues and to redirect sump pump discharge to Fairway Drive.
Third, Staff continued to work with the property owners along Fairway Drive and Harding Lane to obtain
rights of entry to allow the developer of Country Club Meadows to install a drain tile along the rear yards
of certain properties on Fairway Drive. During the neighborhood meeting, it was recommended a
feasibility report be completed to investigate alternatives and scenarios to address these issues. Residents
were informed an ultimate solution would likely involve assessments to the benefiting property owners.
Staff also discussed the subject areas with the City's consultant, and was once again reminded that minor
improvements could be, .made to address specificdrainageconcems; however, the subwatershed
performed to. outlet conditions, and the subwatershed needed a trunk. system capable of taking . drainage all
the way to Lake Minnetonka. ' .. .
Engineer Brown then shared the associated costs for proposed services from the City's consultant. He
noted the cost could change depending on the scope of services chosen to address the situation.

Engineer Brown also noted the presence of a number of residents affected by this drainage issue.
Councilmember Zerby questioned whether residents were aware of the potential assessments attributed to
finding solutions to this issue.
Carrie Nicklow, 5585 Harding Lane, stated she was not aware ofthe larger trunk project being discussed
as part of a long-term solution. However, she was interested in pursuing the installation of drain tile by
the developer of Country Club Meadows.
Councilmember Turgeon stated she believed there were two issues being discussed this evening. One
issue involved the actions of the developer for the Country Club Meadows development, and the other
issue involved fmding a broader solution through examination of overall water storage/drainage issues for
the City.
Mayor Love agreed, noting this matter would require a short-term shift of water drainage and examination .
of the overall drainage areas for the long-term.
Mike Delbusso, 25165 Glen Road, stated he had never had water in his backyard until this development
had been under construction. He stated he did not believe he should have to pay for long-term solutions
for this issue, as his problems were attributable to the grading of the development site.
Mayor Love stated all parties in the affected area needed relief, and he wanted to explore alternatives to
examine long-term needs and solutions for the area.
Engineer Brown stated he believed it was the consensus of the Council to continue pursuit of the
installation of drain tile as a short-term solution, and also contact the City's consulting firm to begin a
broader long-term examination to begin to layout alternatives.
Ms. Nicklow commented the water problems in the area had not been experienced prior. to this year.
Engineer Brown stated the drainage easement in Harding Acres was there for a reason. He also asked
residents for their cooperation in allowing tile line to be placed on their property later this week to begin
to remedy the situation.

Administrator Dawson stated the project remained in the budget for 2003 for the Minnehaha Creek
Watershed District, thus allowing the project to continue to move forward.
2. County Road 19 Intersection
Engineer Brown stated there was nothing further to report as the project had been halted for this year until
such time as right-of-way issues regarding Tonka Bay Liquors could be resolved with Hennepin County.
B. Mayor & City Council
There were no additional reports presented this evening by the Mayor and Council.
C. Public Safety Facilities
Administrator Dawson reviewed the time line of events anticipated in the upcoming month with regard to
financing, and project scheduling. He stated groundbreaking for the project was tentatively scheduled to
take place on November 11, 2002.

2. TRAIL PROCESS
Engineer Brown explained an agenda item regarding the Approval of Plans and Specifications and
Estimate was placed on the September 9, 2002, Council Agenda for review and consideration. During
that meeting, it was determined a Work Session would be needed to find answers and clarity
surrounding this topic.
Engineer Brown provided background regarding the chronology of events related to the Smithtown
Road offstreet trail issue and the Comprehensive Trail Planning process. He presented a summary of
events regarding the history of the trail planning process and a document designed to assist the City
with that process. Next, he reviewed Steps 1 through lOin the Trail Planning Process, noting there
was intepretation regarding the exact location in the process for the Smithtown Road project.
On January 28,2002, the City Council directed Staff to proceed with the design of widened shoulders
along the entire length of the project, and an offstreet trail west of the LRT. The type of trail in the
west portion was to be decided after a neighborhood meeting. The City's consultant proceeded on
that direction with preliminary plans based on direction given. On April 22, 2002, a work session was
conducted to provide direction into the design process. Since the time of the last authorization many
petitions and comments had been received regarding an offstreet trail along Smithtown Road. Staff
was directed to proceed with the design based upon a trail west of the LRT. The exact dimension and
type of trail would be determined as part of a neighborhood meeting.
Engineer Brown also noted the right-of-way process for Smithtown Road was not ordinary. An
Owners and Encumbrances Report, documenting control or interest in what appeared to be the right-
of-way and adjacent parcels along the entire length of Smithtown Road, was prepared by the City
Attorney.

The agenda item placed on the September 9, 2002, seemingly indicated consideration of final
construction plans for the project. Engineer Brown apologized for the misunderstanding indicated in
the wording for that Agenda item. He stated Staff never intended to circumvent the Trail Planning
process; rather, what was being sought was the authority, by Council action, to go door-to-door to
answer any right-of-way questions residents may have had regarding the off street trail project.
Much discussion ensued regarding the current actions of the project related to the trail planning
process.
Councilmembers Turgeon and Lizee expressed concern for presenting all possible options for the trail
to residents.. . Mayor Love stated it was important to give accurate information to residents. Funding
only allowed for either an 8-foot-wide bituminous trail or a 5-foot-wide concrete trail according to
Minnesota State Aid standards. He thought it important to share construction impacts regarding these
two options as demand for safety along Smithtown Road had been heard from residents, and these
were the only options available with current funding.
Engineer Brown stated both these options were presented at neighborhood meetings earlier in the .
year. Discussion ensued regarding a potential course of action for the remainder of the proj ect.
Engineer Brown noted Council consensus that the Park Commission should host a public
informational meeting regarding potential impacts to residents for this trail. Also, this offstreet trail
project would needed to be funded by Minnesota State Aid (MSA) dollars, which allowed for an
8-foot or a 5-foot offstreet trail on the west end of Smithtown Road along the northern side of the road
from the LRT to the Victoria municipal border. Other options for MSA funding would also be
explored.
Mayor Love commented he was anxious for this project to receive resident support, and the roadway
to be completed next year. Also, he suggested the alternatives defme maximum and minimum
impacts for residents. These impacts should be presented clearly to the Park Commission, it should
determine the next step in the process and report back to Council at a later date.
Councilmember Zerby questioned whether a trail for the eastern end of Smithtown Road should be .
investigated for feasibility as part of this project. Council agreed a decision had been made
previously that until such time as the City was petitioned for an offstreet trail in that area, there was
not a need to investigate the east end of Smithtown Road for off street trail purposes.
3. OTHER
Jeff Foust, Shorewood resident and representative to the Lake Minnetonka Cable Commission
(LMCC), requested attention from Engineer Brown regarding pending matters of concern with the
LMCC. Engineer Brown agreed to meet with Mr. Foust after this meeting to further discuss these
issues.

Fall Clean-up Day is Saturday, October 26. Staff requested bids from three vendors for Fall
Clean-up services. We received one bid from Waste Technology, but did not get a response
from the other two vendors. A copy of the bid from Waste Technology attached.
Waste Technology has performed Fall Clean-up service for the City for the past several years
and has always provided excellent service.

Staff Recommendation
Staff recommends Council approve a motion authorizing the Contract for Fall Clean-up Services
be granted to Waste Technology.

Chair Bailey commented the Open House held from 5:30 P.M. to 7:00 P.M. this evening at City Hall in
Council Chambers to review Planning District Area Plans seemed to gamer support from the six residents
that attended the event. He noted the rest of this evening's meeting would take place in Study Session
format.
STUDY SESSION
1. DISCUSS AREA PLANS
Woodruff moved, Packard seconded, Discussing the Complete Set of Area Plans at the October 1,
2002, Planning Commission Meeting. Motion passed 6/0.

2. DISCUSS SENIOR HOUSING
After brief discussion by the Commission, it was determined Commissioner Packard, as October Planning
Commission Liaison, should hold a dialogue with Council regarding recommendations on density
requirements for the City.
3. DISCUSS COUNTY ROAD 19 CORRIDOR
Director Nielsen explained the County Road 19 project had been delayed due to a dispute over
land/structure values for the Tonka Bay Liquor Store. The project 'was being slated for the Spring 2003
construction season.
He went on to explain George Watson, of Brauer and Associates, continued to work on the streetscape
plans for the project, largely in effort to coordinate the streetscape aesthetically with the Public Safety
Facility slated for ground breaking this fall. Director Nielsen then shared various options for the building
material of the retaining walls along the County Road 19 corridor. Consensus of the Commission
indicated a preference for the wall material to include the New England Drystack design. Director
Nielsen went on to discuss the use of entry monuments at entrance points to the City as well as a potential
firefighter's memorial near the intersection of County Road 19 and Smithtown Road as a vertical element
to the streetscape.
Director Nielsen stated the next step in the planning process for the project would be to address concept
plans in text form and compare the planned design to the elements of the Comprehensive Plan. He
anticipated making a recommendation to Council about the County Road 19 Corridor Study by year-end.

5. DRAFT NEXT MEETING AGENDA
Director Nielsen stated a final plat review of Oakview Estates and consideration of final draft text for the
Planning District Area Plans were slated for the October 1, 2002, Planning Commission Agenda.
Commissioner White questioned whether the concepts involved in commercial redevelopment could be
examined as part of the 2003 Planning Commission Work Program. Director Nielsen stated this issue
would be placed on theW ork Program.
6. REPORTS
Liaison to Council
Commissioner Borkon reported on matters considered and actions taken at the September 23, 2002, .
Regular City Council Meeting (as detailed in the minutes of that meeting).
Liaison to LCEC
The next Land Conservation and Environment Committee meeting was scheduled for October 3, 2002.
There had not been a meeting of the LCEC since the most recent Planning Commission meeting.
SLUC
A Conservative's View of Smart Growth was the topic being presented at the Sensible Land Use
Coalition Meeting on September 25, 2002. Director Nielsen, Chair Bailey, and Commissioner Pisula
were expected to attend.

STUDY SESSION

1. OAKVIEW ESTATES - TREE PRESERV ATIONIREFORESTATION PLAN
Director Nielsen explained he had recently received the tree preservation and reforestation plan for
Oakview Estates. Upon closer inspection, he noticed it still was lacking a number of requested elements
of design. He suggested the plan be rejected, and an adequate tree preservation and reforestation plan
submitted by the October 15,2002, Planning Commission Meeting for review.
Woodruff moved, White seconded, Rejecting the Tree Preservation and Reforestation Plan for
Oakview Estates.. Motion passed 7/0.
2. SENIOR HOUSING REGULATIONS
Director Nielsen explained recommendations made previously regarding ordinance requirements for
density in Senior Housing sites remained valid. He stated the recommendation of 8 units per acre in the
RI-C zoning district were excessive for actual construction limits of preferred "cottage style" housing.
Based on previous construction experience throughout the City, he thought reducing that recommendation
to 6 units per acre made the ordinance more accurate for building limits.
Commissioner Woodruff stated she was in favor of making the ordinance fit the real experience of
construction. Commissioner Gagne commented he liked the idea of smaller clusters of housing per unit;
however, he knew it became cost prohibitive in construction.
Director Nielsen also noted in a study of potential Senior Housing sites within the City, three sites had
been recommended. All three of these sites had been utilized since the time of that study. With current
conditions of zoning and land use, he anticipated it would be very difficult to try to speculate which

parcels of land could potentially be assembled over time to provide a site large enough to accommodate
senior housing.
There was consensus among the Commission to recommend to Council to reduce the density
requirements to 6 units per acre as per the previous recommendation.
3. REVIEW AREA PLANS
Director Nielsen reviewed the text for the twelve zoning district area plans for the City with the
Commission. Typographical and contextual errors were reviewed for accuracy.
Woodruff moved, Gagne seconded, Adopting Zoning District Area Plans for Districts 1-12, as
amended this evening. Motion passed 7/0.

SignArt Inc. has requested permits for two new signs for the Snyders Drug Store located
in the Shorewood Village Shopping Center. The signs are part of a significant
remodeling of the store that has recently been undertaken. Exhibit A is a replacement of
the sign that currently exists over one of the main entries to the center, near the drug
store. This sign is consistent with the previously approved conditional use permit forthe
shopping center. Approval of this sign is recommended.
. The second sign is a wall sign to be located near the recently remodeled doorway into the
drug store. This sign does not comply with the existing conditional use permit. . The
C.D.P. stipulates that the wall signs shall be located within the designated sign band. The
proposed sign (see Exhibit B) appears to be higher than the sign band and affixed to the
metal trim feature. Approval of this sign is not recommended.
This item has been placed on the consent agenda for the 14 October City Council
meeting. Since I will not be in attendance at that meeting, it is requested that the matter
be continued to the 28 October meeting.

A RESOLUTION APPROVING
A TEMPORARY GAMBLING LICENSE
WHEREAS, the Shorewood City Code, Chapter 301, provides for the
licensing of certain gambling activities in the City; and
WHEREAS, the City prescribes certain restrictions concerning eligibility for
such licensing and application, whereby the licensee will hold the City harmless for all
claims arising out of the granting of such license; and
WHEREAS, the following applicant has met the eligibility requirements for
such a license and has agreed to all terms and conditions of the agreement contained in the
license.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City
of Shorewood as follows:
That a single temporary license for the conduct of gambling as specified in the terms
and conditions of the license be issued to Friends of the Southshore Center. Said
raflle to be held on Tuesday, January 7, 2003 at the Southshore Center 5735
Country Club Road, Shorewood, Minnesota.

KIDS VOTING Proclamation

The attached correspondence from the Minnetonka Public Schools is a request for the City's
participation in the Kids Voting Minnesota program. This is a voter education program for
children in K-12, and is encouraged by the Secretary of State. The program allows children to
go to the adult polling locations on Election Day to learn about the importance of voting, and to
actually cast their vote at the polls.

The City needs to provide space at its polling locations to set up a separate voting area for
children. The program will be organized and staffed by Minnetonka Public School volunteers.
Staffhas met with the Jeanne Straus, the School District Volunteer Coordinator, and has made
arrangements for Kids Voting Minnesota to be set up at its four mainland polling locations.
It is recommended that the attached Kids Voting Proclamation be approved, encouraging
children to vote on November 5.
Recominended Action:
A motion approving the Kids Voting Proclamation.

A new voter education program for K-12 students is being introduced. It is called KIDS
VOTING. It is a one-of-a-kind program supported by government officials, civic groups,
Chambers of Commerce, and public and private schools.
KIDS VOTING is the country's only program in which children actually go to adult polls on
Election Day. Many of them will be accompanied by an adult family member or other adult. One
of the goals is to have voting become a family affair.
Mary Kiffmeyer, Secretary of State, has encouraged communities to participate. In the attached
letter. she shares; "As the state's chief election official, it is one of my goals to have every
Minnesotan involved in elections in some way or another. Our nation is made stronger by
increased citizen participation at every level, and 1 believe there are roles to play for absolutely
everyone, regardless of age."

We ask you to join with us in this partnership providing both a classroom and community site
based educational opportunity for all K-12 students. What is needed from each of our local
municipalities is "space". We will need space at each precinct site for a table. Registration and
voting can take place at one table.
If you are able to participate with us, we invite you to formally proclaim your support of this
program at your next City Council Meeting. Upon formal approval, please return a signed copy
to our office. We will make a formal presentation to the School Board prior to November 5.
A KIDS VOTING brochure is enclosed for your review.
Please join us for a Kids Voting post election party being organized by Minnetonka High School

Dear Community Leaders:
As the state's chief election official, it is one of my goals to have every Minnesotan involved in
elections in some way or another. Our nation is made. stronger by increased citizen participation
at every level, and I believe there are roles to play for absolutely everyone, regardless of age.
.
People who vote on a regular basis often tell me that they were instilled with a good citizenship
ethic at a young age, as their parents, teachers, neighbors, and others served as role models for
them. Therefore, I believe it is especially important to get kids involved in good citizenship
activities. I am always eager to find ways to achieve this goal.
Consequently, it is with enthusiasm that I have become affiliated with "Kids Voting Minnesota,"
as an honorary member of the board of directors.
Kids Voting offers students an opportunity to become personally involved with our state's
elections, well before they turn 18 years old and become eligible to vote. Kids Voting also
provides an opportunity for intergenerational involvement, with parents joining their kids in the
voting process.
.
I think Kids Voting Minnesota is probably the most effective voter education program for young
people that I've seen, and it has statistics to prove it. Compared with other places, Kids Voting
communities have students who are more aware of current events and parents who have a higher
rate of participation in voting.
There are a couple of keys to the success of Kids Voting where it exists, and these include
involvement of parents, backing by community leaders, and enthusiasm of school district
officials.
I encourage you to learn more about Kids Voting and to help establish and maintain a program. in
your community. Together, we can realize the goal of -having absolutely everyone actively
involved in our state's elections for today and especially for the future.

The 2nd Monday in November falls on the Veteran's Day Holiday - November 11. Council
should determine if it wishes to reschedule the first meeting in November to Tuesday, November
12, or an alternate date, which may be more suitable to Council's schedule. The Park
Commission is scheduled to meet on Wednesday, November 13.

Along with rescheduling this Regular Council meeting, Council should also schedule a Work
Session on this same evening following the Regular Council meeting for discussion on the
Enterprise Budget Funds.

Professional Services for "Opt-Out" Transit Planning
The City of Shorewood was included in special legislation in 2000 to allow the City of Mhmetonka to
"opt out" of the delivery of transit services by Metropolitan Council Transit Operations (MCTO).
Action needs to be taken by June 30, 2003, in order for Shorewood to avail itself of this permissive
legislation.
What is "Opt-Out Transit"?: In the early/mid-1980s, several cities complained to all that would
hear that they were getting very little transit service for the amount that the then-Metropolitan Transit
Commission (MTC) was levying against their property taxpayers. Legislation was enacted that
permitted municipalities to provide their own services, thus "opting out" of service provided by
MTC. Opt-out communities had to:
. Be at the end of an MTC route
. Continue to provide service along existing MTC routes
. Use no more than 85 percent of the transit tax to provide service
Any funds available after providing replacement MTC service could be used for other transit
purposes: e.g., additional buses during rush hours~ local dial-a..ride or circulator services. The
legislation did not allow opt-out cities to lower the iransittax rate; rather, it gave them the
opportunity to provide more andlor better-tailored service for about the same amount of taxes paid.
Several opt-out systems were created, including Shakopee, Plymouth, Maple Grove, Southwest
Metro Transit (Eden Prairie, Chanhassen, and Chaska), and Minnesota Valley Transit (about six
communities in Scott and Dakota counties). The MTC, in order to restore certainty in its transit and
financial planning, requested that the opt-out option be terminated, and the Legislature established a
deadline to establish new systems in the early 19908.
In the latter 1990s, the cities of Minnetonka, Hopkins, and St. Louis Park were studying ways to
provide better transit services among their communities. Without going into specifics, the result
pointed to potential benefits that would result if Minnetonka could become an opt-out city. Hence the
special legislation in 2000 to except Minnetonka-and Shorewood-from the state law regarding
establishment of opt-out transit services.

metropolita.r.tservices were made by the 2001 Legislature. Transit was one: instead of funding
through Pl'9Perty t~es levied by the Metropolitan Council ot opt-out jurisdictions, funding would be
made by the Legishiture through appropriations to the Minnesota Department of Transportation
(MnDOT).
This shift has made it very difficult to ascertain how much money would be available for new opt-out
cities (or, for that matter, existing opt-out systems). Partly as a result of this uncertainty, the City of
Minnetonka has become a "partial opt-out" by entering into a six-year agreement with MCTO in
which the MCTO will continue as a transit service contractor (subject to substantial notice of
termination of the agreement). Minnetonka keeps its options open underthis arrangement.
This lack of certainty is an important issue for Shorewood.
.
Proposal for Professional Services: Transit is a specialty area, and it is even more specialized given
the context of transit jurisdiction and funding within the metropolitan area. For Shorewood to
consider the opt-out option, among the many important questions to explore are:
. What are the transit needs and opportunities in Shorewood?
. How are existing transit services (MCTO, dial-a-ride through the Senior Community
Services) meeting the needs?
. Does a South Lake Minnetonka system make more sense?
. What capabilities will Shorewood need to arrange, manage and monitor a transit service
system?
. Are there sensible and feasible connections to be made with Southwest Metro Transit and
what may evolve in Minnetonka?
. What is doable given the new funding mechanism for transit service? .
. Is opt-out transit a viable option for Shorewood? Or is it smart to replicate Minnetonka's
solution?
As I spoke with city and opt-out transit system staffs, there was a consistent, unsolicited
recommendation about who should be engaged to do a needs assessment and feasibility study. Lisa
Raduenz, principal of LJR, Inc., has extensive experience in transit system planning in the
metropolitan area, and is very familiar with the legal, intergovernmental, and funding matters relating
to transit. Given the relatively small scope of Shore wood's project, the need to perform a study
within six months, and the preference to engage a firm with great familiarity with transit in the metro
area, I decided to request a proposal from LJR, Inc., before considering whether to solicit proposals
from such large firms with transit expertise as URS (formerly BRW) or Parsons Transportation
Group (formerly Barton-Aschman).
The proposal from LJR..lnc.. is responsive. sufficiently thorough. and sensible in terms of the work
that needs to be done so that the City Council can make a well-informed decision regarding opt-out
transit. It does not contemplate a long, drawn-out study, but rather an efficient and thorough review
of current needs and viable alternatives. It includes community involvement with various user groups
(see pp. 5-6 of proposal) and the Planning Commission, among others.

Shorewood's request for a proposal to conduct a scoping study determining the feasibility of "Opting
Out" of the regional transit system. As you are well aware, there have been recent dramatic changes in
the way in which the regional transit system is funded that will affect Shorewood's future decision on
whether or not to "Opt Out". In a technical sense, the ability to "Opt-Out" no longer exists, although
there are various opportunities that we believe may be available to the City to address its community
transportation needs. Under the work plan proposed within the following proposal, UR will explore
and answer the wide array of issues surrounding the opportunity that Shorewood has to "Opt Out" . We
believe the attached proposal will provide direction and "next steps" for City leaders and staff to digest
before the 2003 decision deadline date draws near.
LJR has worked with many other local and regional cities on issues of importance to regional transit
systems since 1984. We understand the specific needs of communities and those organizations and
individuals within communities that require transit services on an ongoing basis. UR is especially
knowledgeable about statewide and local transportation and transit policy issues, and is intimately
familiar with public organizations like the Metropolitan Council and Metro Transit that are important
players in the discussion of future transit options for Shorewood. We welcome the opportunity to work
with you and your staff to provide a top-quality process and product that provides the Shorewood City
Council with answers to the questions they will ask about whether or not to Opt-Out. We are sensitive
to this issue, and understand the potential issues for the City no matter what the answer might be to the
Opt-Out question.

The recommendations that result from the proposed work plan offered by LJR, Inc. will
provide alternatives to the City of Shorewood that are able to be easily and seamlessly
implemented, that are realistic and not conceptual in nature, and achievable. In short,
through the work plan deliverables proposed, we will offer a staged implementation plan
to Shorewood that addresses the City's needs prior to "Opt-Out" deadline date of the
2003 Minnesota Legislative session. The Shorewood Scoping Study for Opt-Out Transit
Services will include a rationale that provides for the following:
>> A thorough analysis of the problem, outlining issues and needs particular to
the City of Shorewood while defining current challenges and costs to
administer and provide the existing transportation alternatives within the
regional system.
>> Recommendations for suitable alternatives and options that effectively
address the City's issues, identify stakeholders, and detail potential impacts
of any alternative implementation in the short and long-term.
>> An analysis of the implementation and ongoing costs of all identified
alternatives for the City of Shorewood.
>> A specific process that defines feasible strategies and options quickly, and
narrows the City's range of options in making a decision of whether or not
to "opt-out". The product of the study will provide a roadmap to the City of
Shorewood for the implementation of any recommendations selected by the
City Council and staff.

Proposed Work Plan
There are six (6) primary work plan elements proposed in the development of a scoping
study to determine the feasibility of electing the public transit opt-out option provided by
the 2000 Minnesota Legislature.
1. Identify the background of opt-out authority
. Legal and policy implications of opt-out transit
. Legal and administrative steps necessary for Shorewood to opt-out
. Legal and policy implications of "partial" opt-out
The first step in this process is to identify the legal basis for opt-out transit and for the
inclusion of Shorewood as an opt-out transit city. LJR will research the opt-out statute.
(Minnesota Statutes ~ 473.388) and identify background information for the City Counci
and staff that includes the basis of legal authority and what the intent of the law was
meant to signify for Shorewood. We will provide the history, the intent of legislative
changes in the statute, and changes in the method of funding services and capital projects
in the implementation of the statute. Regional policies are also critical in determining the
feasibility of implementing opt-out transit in Shorewood, and LJR is broadly versed in all
such regional policies and can speak authoritatively on their implications. This work plan
element will identify what will be required of Shorewood to meet the legal and
administrative steps necessary to become an opt-out city. Finally, we will provide legal
and policy analysis on the concept of "partial" opt-out, a concept that has been discussed
within the region and recently selected by the City of Minnetonka as its response to the
State Legislature in 2003.

2. Qualitative Needs Assessment of community transit needs.
In discussions with Shorewood city staffs it has become apparent that a professional
assessment of the community's transit needs and level of services desired by the general
public has not recently been undertaken. This type of assessment could be conducted
through basic research and several segmented focus groups to a representative sampling
ofvarlous Shorewood user groups (i.e., seniors, families with school-aged children, etc.)
We strongly recommend this step as a means of identifying the true needs of residents
and employees, and also to distinguish between the types of services (Le., fixed route,
dial-a-ride, circulator, etc.) that may be desired by residents. Further, should the City

Council or staff wish to query the public about the level of community investment in
public transit service, a quantitative study of the issue through the use of focus groups
and phone surveys could assist in guiding the City to a fmal decision with regard to the
Opt-Out provision. This step, however, would have to be done in conjunction with a
qualified market research firm, and would require six to ten weeks of time to administer
and complete for results. LJR is not proposing to conduct a quantitative study as part of
this work task at this time.

3. Develop "Best Practices" of existing opt-out transit systems
. Describe what local opt-out systems are doing to provide quality
community-based service
. Discuss opportunities/barriers for Shorewood to provide improved
community-based transit services through opt-out
. Identify issues associated with local control and decision-making,
including impacts on local transit management and administration
. Address coordination of opt-out services with Metro Transit and other
local opt-out systems or service providers
. Identify other opportunities and barriers relative to a possible election of
opt-out status for Shorewood

Under this element LJR will research and compile an extensive list of past and present
"best practices" from opt-out systems and other regional and local transit system
operations. LJR will address the issues of local control and decision-making requirements
from both a legal and practical standpoint, and describe what has worked well and what
the difficulties have been. As part of this process we will "personalize" these matters to
identify what opportunities and barriers exist for Shorewood to provide its own
community-based transit services. Coordination of transit service with other regional
providers, including Metro Transit, Minnetonka and the other opt-out systems, is critical
to operational success, and this element will address this coordination factor, providing
practical recommendations. We will also study the varying methods used to provide
community transit facilities and needed vehicle capacity, and how different opt-out
systems manage these critical items.

agreement. Among the major considerations for organization and management of a
transit system is the procurement and maintenance of transit vehicles and facilities, and
we will address these matters in this study.

When considering whether to become an opt-out transit city or not, it is very important to
understand what will be gained and what will be given up in exchange. The project team
will analyze the advantages and disadvantages to Shorewood of continuing with Metro
Transit-provide service or to opt-out, including what service modifications could be
expected from Metro Transit in the future compared to the level of service modification
Shorewood.could realize if it chose to opt-out of the Metro Transit system. We will also
discuss the long-term implications of a decision to opt-out, a decision to pursue a
"partial" opt-out, or a decision to maintain the status quo.

6. Preferred Alternative(s) and Recommendations
Through this study LJR staff will prepare several alternatives related to the election by
the Shorewood City Council of proceeding with or rejecting opt-out status. Each option
will provide a matrix of opportunities and barriers, requirements for implementation,
financial considerations, organizational considerations, legal implications and other
factors necessary for an informed decision about possible opt-out status by the City of
Shorewood. These matrices will be fashioned in a manner that will provide "blueprints"
for implementation.
As a final step, LJR will recommend one of the options, along with all of the information
necessary for the City to make an informed decision about its future status as an opt-out

community. LJR recommendations will result from the tenor and tone of previous
discussions with City staff and Council members.
LJR is confident that the information gathered and presented during the course of this
study will provide the City of Shorewood with the most comprehensive information
possible, and will properly guide the City toward a sound decision.
Project Deliverables
LJR will provide the following deliverablesas part of this project:

Technical Memoranda
It is recommended that two midterm reports be made to the City Council at Council study
sessions; one between November 1,2002 and December,31, 2002, and the other between
January 31, 2003 and March 15, 2003. At the fIrst meeting LJR staff will present
Technical Memorandum #1, which will focus on the data compiled for Tasks #1, #3
and #4. At the second meeting LJR will present Technical Memorandum #2, which
will focus on data and fmdings compiled for Tasks #2 and #5. These Technical
Memoranda will provide the City Council and staff with detailed information to assist
them in providing direction toLJR for the completion of the recommendations and final
report (Task #6).
Proiect Cost Estimate
The project cost estimate for Work Plan Tasks # 1 - 6 is based on an inclusive hourly fee
of $90 for Lisa Raduenz ofLJR, Inc. plus any reasonable expenses as noted.

LJR proposes to bill the City of Shorewood for professional services based on task hours
per month. LJR standard practice is to prepare and send a bill to its clients on the fIrst
day of the month following the month in which hours are worked. Payment in full is

Proiect Team Experience and Qualifications
Lisa Jane Raduenz, President and Principal of LJR, Inc., has twenty-two years of
experience in the planning and implementation of many types of transportation and
transit service. Lisa has a wide array of experience in working with public and private
sector organizations and fIrms, including not-for-profit and for-profit organizations. She
directs and oversees all areas of LJR, Inc., including personnel management, client
development and relations;. overall project management and..the..finn'stechnicalplanning
services. Lisa served on the Minnesota Guidestar Board of Directors from 1992 through
1999, the University of Minnesota Center for Transportation Studies Executive
Committee from 1991 through 2000, the Minnesota Transportation Alliance Board of
Directors from 1989 to 2002, and was elected President of the Minnesota Chapter of
Women's Transportation Seminar in 1992, holding various other positions on WTS' local
and National chapter boards through 2002. In 2002 she served as the 2002 WTS National
Conference Fundraising Chair.
Raduenz is also a member of the American Public Transit Association (APTA),
Minnesota Public Transit Association (MPTA), Minnesota Surveyors and Engineers
Association, the Minnesota Chapter of Women's . Transportation Seminar (WTS) and the
National Association for Commuter Transportation (ACT).

As the plans for the South Lake Minnetonka Public Safety (SLMPS) site have progressed
through the review process, it has been determined that the most economical method of
providing adequate fire suppression flows and domestic water supply to the SLMPS site
is via the City of Tonka Bay water system.
On February 11th, 2002, the City of Shorewood entered into a revised cooperative
agreement for providing municipal utility services between the Cities of Tonka Bay and
Shorewood. Attachment 1 is the resolution and agreement that has been adopted. Since
the subject site is located within the City of Shorewood, the service agreement that is in
place shall govern.
Background
The Fire Marshall has provided the most recent fire flow numbers required to adequately
protect the SLMPS facility. Due to the high flows that are required, it will be necessary
to replace an existing 6-inch diameter watermain that was installed from the City of
Tonka Bay system to serve the Shorewood Public Works facility (Refer to Attachment 2).
This main was also extended to the easterly property boundary of the public works site in
anticipation of the site immediately east of public works expanding. Attachment 2 is a
map that indicates the location of the watermain.
Fire flows required dictate that the existing 6-inch diameter line be replaced with a 12-
inch diameter main. It is anticipated that this will create a three-day disruption in the

water service to the public works facility and construction disturbance in the area east of
the southerly end of the Smithtown Crossing Shopping Center. Currently, these utilities
are within a 40-foot wide drainage and utility easement.
Construction Costs
The cost for design, constructign, survey and inspection shall be paid for by the public
safety proj ect.
Cooperative Agreement

In accordance with the agreement, the City of Shorewood shall request service by way of
resolution. From that point in time, the Tonka Bay City Council will consider the request
for the extension of services.
Staff has prepared a resolution requesting the City of Tonka Bay permit the extension of
municipal water service to the South Lake Minnetonka Public Safety site. The resolution
is attached for the City Council's consideration.

2002 by and between the City of Tonka Bay, a municipal corporation, hereinafter
referred to as Tonka Bay, and the City of Shorewood, a municipal corporation,
hereinafter referred to as Shorewood. .
WHEREAS, Tonka Bay did in the year 1965 construct an interior sewer system
to serve land located within the confines of its city; and
WHEREAS, Tonka Bay did during the year 1972 construct an interior water
system to serve the land located within the confines of its city; and
WHEREAS, the Metropolitan Sewer Board did during the year 1971 construct a
Metropolitan sewer line to serve, among other municipalities, in such a manner as to
collect the sewage from Tonka Bay at one point at or near Manitou, Hennepin County
Road No. 19 intersection; and
WHEREAS, the City of Shorewood did during the year 1972 construct a .
municipal sewer system to serve properties located within the confines of its city; and
WHEREAS, the metropolitan interceptor serves Shorewood so that the trunks
constructed by the City of Shorewood can, in most cases, connect with the metropolitan
interceptor at points within the confines of Shorewood; and
WHEREAS. Shorewood is adjacent to Tonka Bay so that the two have a
common border; and
WHEREAS, there is a section of Shorewood the geography of which makes it
. impractical to connect to the metropolitan sewer interceptor without constructing
expensive pumping stations and force mains, unless the area in question is, in fact,
connected to the interceptor by use of the interior lateral sewer system of Tonka Bay;
and .
.
WHEREAS, Tonka Bay and Shorewood agree that it is to the best interest of
both cities to use the Ton.ka Bay interior sewer lines to serve the Shorewood area . .
provided Tonka Bay is appropriately compensated f()r such use; and .
WHEREAS, Shorewood is desirous of being served by water from the Tonka Bay
municipal water system, and Tonka Bay is desirous of providing such service; and
WHEREAS, Tonka Bay and Shorewood are desirous of setting forth in this
agreement provisions under which Shorewood may make use of Tonka Bais interior
sewer system to reach the metro interceptor, and also provisions whereby Shorewood
may receive water service from the Tonka Bay water system. .

.' NOW, THEREFORE, inconsideration of the premises and mutual covenants, it is
hereby agreed as follows:
I.
USE OF TONKA SAY INTERIOR SEWER SYSTEM
.
1. ' Shorewood may connect a portion of its lateral sewer system to the Tonka Bay
mterior sewer system for the purpose of using the Tonka Bay lines to reach the
metropolitan sewer interceptor upon the adoption of a resolution by the City of
Tonka Bay authorizing said connection. Hookup to such connection may be
made in the City of Shorewood only upon: '
a. Obtaining a permit from the City of Shorewood to do so, all in accordance
with the ordinances of Shorewood.
b. Copy of the application of such permit shall be furnished forthwith to
Tonka Bay. Shorewood shall issue no permit for such connection until
approval or disapproval thereof has been given by Tonka Bay.
c. A copy of the as-built plans (mylars and electronic CAD files) of that
portion of the line along with the necessary measurement to all manholes
and service connections.
d. A plat showing the area including the platted lots of that portion of the
system so connected.
e. A statement setting forth the maximum number of connections to be
connected to the Tonka Bay system, which number shall not exceed
twenty-five (25). '
f. A cash payment to Tonka Bay for each residential hookup in an amount
established annually by the Tonka Bay City Council. Said rate shall reflect
initial construction costs for the sewer system along with annual
adjustments based on the construction price index. '
(i). Said residential hookup charges shall be paid either in full at the
time of connection or 50% at the time of connection and the
remaining 50% prorated over a period of five (5) years, Tonka Bay
shall refund the prorated portion, whether paid in full at the time of
connection or paid on an install basis, as described herein. Half of
the cost of said hookup charge shall be nonrefundable.
(ii). Each unit in a multi-family dwelling shall pay to Tonka Bay a user
fee at the same rate as residential users in Tonka Bay.
(iii). User fees.for Shorewood residents hooked up to the Tanka Bay'
sewer system ~m be at the same rate as Tanka ,Bay residents.' , .,
(iv).lf a commercial connection is made to the sanitary system that is
using a private well for potable water, a meter shall be installed on
the private well in prder to determine usage.
g. Users connected to the Tanka Bay sewer system shall comply with the
T.onka Bay ordinances governing the use of the Tonka Bay sewer system.
In the event Shorewood desires to bill and collect said userfees, it shall
be Shorewood's obligation to remit to Tonka Bay that amount which would
be due Tonka Bay if Tonka Bay billed directly.
h. Shorewood shall be responsible for all delinquent sewer accounts. The
accounts of all sewer users in Shorewood which are delinquent for more

than ninety (90) days shall be turned over to Shorewood, and Shorewood
shall within thirty (30) days thereafter make payment to Tonka Bay and
become absolute owner of the account.
Shorewood shall bf3 obligated to inspect and repair all sewer lines located
in the City of Shorewood and in the event there is a defect or break
.allowing breakage or excessive infiltration of ground water into said lines,
Shorewood shall immediately take steps to correct the same. If the break
is not corrected, Tonka Bay reserves the right to discontinue service at the
Tonka Bay city limits or raise said rates to compensate for additional
sewer flows generated by ground water infiltration.
2. Tonka Bay will be responsible for maintaining its own interior system. In the
event there is a breakdown in that system so as to preclude receiving sewage
from the Shorewood connections, Tonka Bay will immediately notify Shorewood
of the problem and it shall thereupon be Shorewood's responsibility to provide
emergency service to the Shorewood users. Tonka Bay shall not be responsible
to Shorewoodforany breakdown in the Tonka Bay lines.

Either party may terminate use the portion of this agreement providing for future
sewer connections by mailing a written notice to the other at least six (6) months
prior to the intended date of termination. If any sewer connections have been
made and are currently in use, neither party may terminate the agreement to
provide service to those connections unless a reasonable alternative service is
available. Termination in that case must also be made by mailing a written notice
at least six (6) months prior to the intended date of termination.

II.
WATER SYSTEM
1. In the event Shorewood determines that it desires to construct and install water
lines within the City of Shorewood, it may connect said lines to the Tonka Bay
municipal water system upon the adoption of Tonka Bay of a resolution
authorizing said connection.

Hook up to such connection may be made in the City of Shorewood only upon:

d. Users connected to Tonka Bay water system shall comply with the Tonka
Bay ordinances governing the use of the Tonka Bay water system
including the use of meters. Tonka Bay shall' charge the residents of
Shorewood connected to the Tonka Bay water system user fees at the
same rate charged to Tonka Bay residents. In the event Shorewood
desires to bill and collect said user fees, it shall be Shorewood's obligation
to inspect and read the meters quarterly and remit to Tonka Bay that
amount which would be due Tonka Bay if Tonka Bay billed directly.
e. Shorewood shall be responsible for all delinquent water accounts'. The
accounts of all water users in Shorewood which are delinquent for more

Emergency Interconnection. It is understood that there presently exists a facility
to provide direct interconnection between the Tonka Bay municipal water system
and theShorewood Badger Well municipal water system at County Road 19. In
the event that an emergency arises whereby either City's water system becomes
impaired, such City may make use of the interconnect facility to obtain water
temporarily from the other city's water system, subject to the following conditions:
a. Notification - Should it become necessary for either Tanka Bay or
Shorewood to open the valve to utilize water from the othef system, the
public works supervisor shall notify the public works supervisor or some
other city official (administrator or Councilmembers) from the city prior to
the time that the valve is opened.
b. Payment for Water Use -In lieu of metering, payment by one city. to the
'other for the water u~ed shall be basec;i on't~e previous year's weekly or,' ,
monthly average for that same comparable time period.
Example: If Shorewood opens valve on March 10, 1991, and uses water
for one day, Tonka Bay will review records for water consumption on
March 10tn of 1990. If March 10,1990 records show that 200,000 gallons
of water were consumed in Tonka Bay that day and 220,000 gallons are
consumed with the valve open on March 10,1991, Shorewood shall pay
Tonka Bay for the use of 20,000 gallons of water at the water rate in effect
at that time. If Tanka Bay uses water from Badger Well, a similar process

would be followed to determine what amo'unt Tonka Bay owes
Shorewood.

c. Maintenance of Valves - Each city shall be responsible for the
maintenance of its own valve.
d. Mutual Benefit -It is understood that the connection between the two
cities is mutually beneficial and, in an emergency situation such as a firel
the mixing of the water from each system would not be harmful or pose
any health-related problems.
IN WITNESS WHEREOF, the undersigned governmental units have caused this
agreement to be execu~ed in their behalf pursuant to the authority of their respective city

A RESOLUTION REQUESTING MUNICPAL WATER SERVICE
FOR THE SOUTH LAKE MINNETONKA PUBLIC SAFETY FACILITY

WHEREAS, the City of Shorewood and the City of Tonka Bay have entered into
a Cooperative Agreement dated February 11, 2002 for providing municipal water and sanitary
sewer services outside the corporate boundary of each municipality; and
WHEREAS, the South Lake Minnetonka Public Safety facility located at 24140
Smithtown Road, within the City of Shorewood, requires municipal water service; and
WHEREAS, the Director of Public Works has determined that the most economical method of
providing municipal water service to said facility is via the City of Tonka Bay's municipal water
system
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood as follows:

1. The City of Shorewood, on behalf of the South Lake Minnetonka Police and
Excelsior Fire District, hereby request municipal water services from the City of Tonka Bay, for
the property located at 24140 Smithtown Road, Shorewood, Minnesota.
2. The City of Shorewood, on behalf of the South Lake Minnetonka Police and
Excelsior Fire District, hereby request permission from the City of Tonka Bay to remove the
existing 6 inch diameter watermain connected to the Tonka Bay water system, shown in Exhibit
A, and replacing said utility with a 12 inch diameter watermain.
ADOPTED BY THE CITY COUNCIL OF THE CITY OF SHOREWOOD this 14th day of
October 2002.

Authorization to Prepare Feasibility Report for Watermain Extension on
Minnetonka Drive to State Highway 7
As part of the review process for the Cub Foods proposal, the Fire Marshall has supplied
the applicant with the latest fire flow requirements to adequately protect the facility and
meet fire, life, and safety requirements. As part of the Cub Foods proposal, the site is to
have a water ground storage tank to provide a sufficient supply of water to meet the
requirements of the Fire Marshall.
Based upon the flows needed, the applicant has indicated that a larger ground storage
tank will be required than initially proposed. In response, Staffhas indicated that an
amendment to the Conditional Use Permit will be required.

As a separate matter, the City has received and approved a preliminary plat for a 14-10t
subdivision, known as Linden Hills, that surrounds Lake Linden. This property abuts the
Cub Foods site.
The Council is aware through the Cub Foods proposal, that municipal water service is not
available to either one of these sites. Since the preliminary plat of Linden Hills was not
present during the Cub Foods review, it appeared impractical to extend water service to
the Cub Foods site. However, the recent addition of the Linden Hills plat sheds a
different light on the matter.
Staff is requesting authorization to have a feasibility report prepared to further examine
the practicality, costs, and opportunities that exist to service the subject areas. While a
feasibility report does not commit the City to an improvement project, it will provide the
City a better view of the options available.

Preliminary discussions with each developer have been initiated. Both applicants are
very concerned about the timing of the project. However, the City does have a
responsibility to examine the feasibility of serving both of these developments with
municipal services.
Staff has requested that WSB. and Associates prepare. a proposal. for the water modeling
and feasibility for such an improvement project. Attachment 2 is the proposal supplied
by WSB and Associates. At first blush, the costs may appear high. However, this
proposal requires extensive water modeling for the City's water system to insure that fire
flows can be met for the subject sites.
Staffwill present this in greater detail at Monday night's City Council meeting. In turn a
resolution will also be provided at Monday night's meeting.

Watermain Extension Proposal

A. SCOPE OF SERVICES
Task I: Data Collection
Items to be collected include:

· Water demand/usage calculations
· Topography maps

Task II: Demand Analysis
This task will use the existing City water model to calculate the system demand and
pressures for three alternatives consisting of an 8-inch, lO-inch, or 12-inch watermain.
Any looping options will be explored due to the potentially long dead end main.
Task III: Preliminary DesignlLayout
Once the system modeling has been completed, a preliminary design of the watermain
will be completed and estimated quantities will be developed. The location of any
hydrants or valves will be established.
Task IV: Financial Analysis
This task consists of preparing an opinion of probable cost along with developing a
funding plan for the project.
Task V: Feasibility Report
We will prepare a draft and final report for the City. Ten (10) copies of the final report
will be submitted.
Task VI: Meetings
Our scope includes regular meetings with City staff, one public informational meeting,
and two City Council meetings. We will present the feasibility report at a regular
Council meeting and a work session (if requested).

Attached is our breakdown of hours per employee per task. Weare estimating the
engineering fees for this scope to be $10,400.
C. SCHEDULE
Upon receiving a notice to proceed, we can have the feasibility report completed in 45-60
days. Assuming an October 15, 2002 notice to proceed, the feasibility report will be
completed by December 15,2002.
