Shorewood City Council Regular Meeting
Monday, 12 March 2001
A 5:30 p.m. Liquor Committee meeting is scheduled for this evening.
A 6:45 Special Meeting is scheduled this evening for interviewing a Park Commission candidate.
Agenda Item #3A: This motion adopts a resolution to approve one additional Tree Trimmer
license for the year 2001.
Agenda Item #3B: This motion authorizes the expenditure of funds for replacement ofl a light
equipment trailer. The low quote was provided by Lano Equipment, Inc. in the amount
of $4,039.55. This is within the budgeted amount in the Equipment Replacement
Schedule. Staff is recommending approval of the expenditure.

Agenda Item #3C: This motion adopts a resolution setting a license fee of $30 for a
Commercial Lawn Fertilizer Applicator License.
Agenda Item #3D: Nordquist Sign Company has requested a sign permit on behalf of
HealthSystem for their Park Nicollet office building at 19685 State Highway 7. The
signage, a wall sign and a refacing of the existing pylon sign are very consistent with the
requirements for the Waterford commercial area. In fact the new wall sign will be
smaller than the previous. Approval is recommended and requires a simple majority vote
by the City Council.
Agenda Item #5A: This agreement provides for the installation of an irrigation system
planned to be installed by South Tonka Little League be donated to the City of
Shorewood once completed. Staff is recommending approval of the agreement by simple
motion. .

Agenda Item #7 A: The Planning Commission has requested a joint meeting with the City
Council on Tuesday, March 20, 2001, at 7 :00 p.m. The kick-off meeting for the City
Council on the community visioning is being scheduled as a work session immediately
following the regular City Council meeting on March 26, 2001. The Council!
commissions/staff orientation on Shorewood city governance is being scheduled for
Tuesday, April 17, 2001, at 7:00 p.m. The City Council will need to set these meeting
dates and times.
Agenda Item #7B: A cooperative agreement between the City and the Minnehaha Creek
Watershed District is necessary to get the gears in motion for the MCWD to release
$200,000 for the acquisition of Gideon Glen.

A. Report on Park Commission Meeting Held February 13, 2001
Commissioner Bix reported on matters considered and actions taken at the February 13, 2001, Park
Commission Meeting (as detailed in the Minutes ofthat meeting). She also noted there would be a Joint
Park Commission and City Council Meeting on February 27, 2001, beginning at 7:30 P.M. regarding the
Master Plan for the parks in the City.
6. PLANNING
Commissioner Bailey reported on issues discussed at the February 13, 2001, Planning Commission
Meeting. He noted there was a not a quorum of members available for this Study Session to formally
take action on any items, but enough members were present to discuss various issues presented by
Commissioners that evening. He also noted the Planning Commission had unanimously supported the .
following Conditional Use Permit on this evening's Agenda.
Administrator Dawson also reported there would be a training session for Planning Commissioners on
April 21, 2001. More information would be shared on this topic at a later date with the Planning
Commissioners.
A Motion to Adopt a Resolution Approving a Conditional Use Permit for Accessory Space
over 1200 sq. ft.
Applicant: Travis and Laurel Murphy
Location: 28110 Boulder Bridge Drive
Director Nielsen provided background on this matter, noting the applicants were adding a new attached
garage to the rear of their home, as well as, an addition above that and the existing garage area. These
additions, combined with existing accessory space, exceeded 1200 square feet; thus, a request for a
Conditional Use Permit became necessary. He also reviewed the four criteria to be met in order to grant

this type of permit. He commended the applicants for meeting these criteria as well as a revision that
reflected a jog in the garage addition allowing for setback compliance in that area.
Mr. Travis Murphy was in attendance this evening and offered to answer questions from Council.
Council member Zerby questioned a cedar rail fence he believed to lie in the right-of-way. Director
Nielsen noted the fence was there and probably should be removed.
Zerby moved, Turgeon seconded, Adopting RESOLUTION NO. 01-017, "A Resolution Approving
a Conditional Use Permit for Accessory Space over 1200 Square Feet for Travis and Laurel
Murphy, 28110 Boulder Bridge Drive, with the condition that the cedar rail fence in the right-of-
way be removed. Motion passed 5/0.
7. GENERAL
A. Review Fee Schedule and Consideration of a Motion to Adopt an Ordinance
Amendment Setting Fees by Resolution
Director Burton reviewed the 2001 Fee Schedule noting changes could be made through use of
resolutions.
Garfunkel moved, Turgeon seconded, Adopting Ordinance No. 370, "An Ordinance Amending
Section 1301.02 of the Shorewood City Code Relating to Establishment of Fees and Charges."
Motion passed 5/0.
Garfunkel moved, Zerby seconded, Adopting RESOLUTION NO. 01-018. "A Resolution Setting
License, Permit, Service Charges, and Miscellaneous Fees." Motion passed 5/0.
B. A Motion to Set a Special Meeting to Interview Commissioners for the Park

Mter some consultation of calendars, Mayor Love stated he would direct staff to set a Special Meeting to
interview potential Commissioners for the Park Commission on March 12,2001, at 6:30 P.M.

Director Nielsen reported Mr. Dan Dickel, the City's environmental consultant, had been elaborating on
a concept plan for Gideon Glen, and a meeting would be scheduled to discuss planning and
implementation of the concepts for the area.

2. Skate Park
Engineer Brown reported he had decided to delay award of equipment for further review of quotes and
proposed equipment. Since the equipment could be supplied in a timely manner, he did not anticipate
this added review would delay the opening of the Skate Park in the spring.

3. Eddy Station
Engineer Brown stated there was nothing new to report on this matter.
4. County Road 19 Intersection
Engineer Brown stated he had contacted Hennepin County regarding sending preliminary plans to the
City for review.
B. Mayor & City Council
Mayor Love reported there seemed to be a ground swell of support from colleagues in other cities .
regarding fertilizer legislation, and efforts were being made by various agencies to lobby on the cities'
behalf for legislation reflecting this support. He also reported Representative Sykora and Senator Oliver
were interested in seeing a draft of the legislation, and seemed to favor legislation on this topic.
Council member Lizee reported a large pothole on Highway 7 beneath the Mill Street bridge into
Excelsior. Engineer Brown stated MnDOT had been called, but it was having trouble finding time to
address it. The City of Excelsior had tried to fill it as well with little success. He cautioned drivers in the
area to be alert for it.
Mayor Love reminded Council there would be a five-minute recess before convening the Work Session.

2. REPORT FROM THE LAKE MINNETONKA CONSERVATION DISTRICT
(LMCD) ON WATER PATROL FUNDING
.
Mr. Tom Skramstad, City Representative to the LMCD, stated he had attended a Council meeting
in December 2000, regarding issues of Water Patrol funding. At that time, Council had
requested information about the necessity of this funding. Mr. Skramstad introduced Mr. Bert
Foster, Chair of the LMCD Board; Mr. Greg Nybeck, Executive Director of the LMCD; and
Lieutenant Ken Schilling of the Hennepin County Sheriff s Department to Council, noting any of
these people were able to answer questions regarding this issue.
Lt. Schilling reported he had no numerical data for presentation this evening, but would be happy
to answer questions and provide as much information as possible about the need for additional
Water Patrol deputies on Lake Minnetonka.
Mayor Love asked Lt. Schilling how additional patrols would enhance the current situation on
Lake Minnetonka. Lt. Schilling explained more patrols would be more visible to people using
the lake, and it had been his experience that presence was a deterrent to problems. He also
explained the Sheriff s Department was responsible for servicing the entire county which
included 104 lakes, 3 rivers, and virtually any other body of water. He further explained that if
the City contributed the funding amount of $3285 for two full-time water patrol deputies, one
hundred percent of their time would be dedicated to Lake Minnetonka versus the eighty percent
currently being dedicated by the Water Patrol. In addition, he stated he believed two additional
full-time deputies would provide a bit quicker response as their time would be spent solely on the
lake instead of having to travel from some other body of water to address a problem on Lake
Minnetonka. He stated overall there would be a bit quicker response, a more focused response,

and a more constant presence felt on Lake Minnetonka with the addition of these two full-time
deputies.
Councilmember Garfunkel stated this was the third time he had requested a demonstration of
additional need. He stated he could only hear a perceived need, but had no actual statistical data
to support this request.
Lt. Schilling stated the level of service currently being provided to the community would not
change whether the full-time officers were funded or not. However, it seemed that people
wanted a level of service above and beyond what was currently being demonstrated. He reported
there were seven full-time Water Patrol deputies with approximately forty Special Deputies.
Thus, approximately fifty deputies patrolled the entire county with eighty percent of their focus
being given to Lake Minnetonka. He reiterated that there would be more constant coverage,
visibility, and focus given to Lake Minnetonka. Raw statistics would not necessarily show that
there was a need. If there were low incidence statistics, it could mean either a better job had
been done patrolling the lake, or fewer problems had occurred on the lake in past years. There
seemed to be different variables that could be applied to give different statistics. He noted the
2000 Annual Report was not yet available, but he would be happy to share it with Council once
available.

Councilmember Zerby asked about the origin of requests for additional patrols. Mr. Foster
explained some Lake Minnetonka community mayors, as well as comments shared with the
LMCD from people using the lake, prompted this request. Mr. Nybeck stated the Water Patrol
and DNR had been involved with this issue when problems occurred around Big Island. Several
people at that time testified about the need for additional patrols on Lake Minnetonka.
Mayor Love commented there seemed to be a lack or loss of boating culture on the Lake. Lt.
Schilling stated presence on the Lake would act as a deterrent, but could not cure these cultural
problems.
Lt. Schilling stated, in response to Councilmember Garfunkel's question about funding, Water
Patrol funding was mandated by the State but only to a level the County could sustain. Lt.
Schilling stated it was his belief the commitment of $50,000 was all that the County budget could
sustain at this time. He noted it was also a challenge to keep, maintain, and recruit Special
Deputies who would receive little compensation for their time.

Councilmember Turgeon asked for the status of the fourteen cities surrounding Lake Minnetonka
as it related to this issue. Mr. Skramstad reported nine cities favored the funding, two cities did
not favor the funding, and three cities were undecided at this point.
Councilmember Garfunkel stated it did not seem as though much had changed from past reports.
He stated he would like to see a demonstration of need, and if need could be demonstrated to the
City, then it should be demonstrated to the County. It was his belief that once cities agreed to
fund these deputies, that funding would never be budgeted by the County. He stated the money
was not the issue for him, but rather he did not believe the responsibility for funding these
officers to be with the individual Lake Minnetonka cities. By statute, it seemed it was the
County's responsibility for funding of these positions.

Mayor Love stated he would like to see a permanent funding mechanism for these positions, not
a short-term approach. Mr. Foster responded the County had agreed to fund $50,000 toward
these positions, with the remaining $50,000 made up of $20,000 from private donations, and
$30,000 from the Lake Minnetonka cities. The cities were being asked to contribute toward
these positions for two years only, and he believed need could then be demonstrated to the
County as a perception heard through feedback, rather than data of different variables put
together under various circumstances
Councilmember Lizee commented she could understand how this project could be beneficial to
residents without a large financial commitment over the next two years when it would then
become a budget item for the County, so she did not have a problem supporting this funding
request.

Councilmember Zerby questioned the amount the County was willing to contribute toward these
positions. Mr. Foster explained the current County budget included start-up costs related to the
new County Jail. As a result, there would be a large increase in the budget during the next two
years, making it very difficult to obtain additional funding for these positions. Councilmember
Zerby stated he could understand those issues, but he still believed he needed statistical results in
hand before supporting this request.
Lt. Schilling stated he could provide different measuring tools which could provide different
results, as statistics related to patrolling were somewhat environmentally dependent. However,
he could provide statistics regarding the implementation of two full-time positions and then that
information could be compared to the Annual Report.
Mayor Love noted a concern about how the two-year period would be measured. While he heard
people desired more presence and a better experience on the lake, he still thought it important to
know why statistically this funding request had come forward and what would change over the
two-year period.

Councilmember Zerby stated he believed more scientific data should be applied if the positions
were to be perceived as a two-year test for need.
Councilmember Turgeon stated she did not have a problem with the amount of money being
requested; however, she would like to have baseline data so that a comparison could be made in
two year's time. Mayor Love agreed.
Councilmember Garfunkel stated he thought the same as he had in earlier discussions.
Regardless of the data presented, this issue was really about enhancing the experience of using
the lake from a safety standpoint, and the responsibility for funding additional patrols belonged
with the County. Also, it was not too early to begin lobbying the County for these funds in the
future.
Administrator Dawson stated future discussions would need to take place regarding this issue
once baseline data had been supplied along with the budget and a two-year measurement tool for
comparison. He thanked Mr. Foster, Mr. Nybeck, and Lieutenant Schilling for their time and
efforts regarding this discussion.

3. REVIEW WATER UTILITY ORDINANCE
Administrator Dawson provided a brief historical background on efforts related to working on
this ordinance. Engineer Brown then summarized three scenarios for Council regarding the
initiation of a watermain improvement project in the City.
After much discussion, Council supported the idea of a fixed minimum charge for this type of
project. Council also agreed, regarding the City's assessment policy, it was important to make
costs reasonable for water connections and still allow the Water Fund to remain solvent.
Engineer Brown explained there would need to be a Public Hearing to provide clarification about
the ordinance after a draft ordinance was shared with Council.

application and provide proof of insurance coverage. We are in receipt of one additional
application for a Tree Trimmers license for the year 2001. The applicant has completed the
requirements to provide tree trimming service in the City.

A RESOLUTION APPROVING LICENSES FOR TREE TRIMMERS
WHEREAS, the Shorewood City Code Section 305 provides for the annual
licensing of tree trimmers in the City; and
WHEREAS, said Section provides that an applicant submit a letter of intent and
fulfill certain requirements concerning insurance coverage and pay licensing fee; and
WHEREAS, the following applicants have satisfactorily completed this process
and have submitted the requirements for the issuance of a License for Tree Trimmers.

RE: A Motion Authorizing Expenditure of Funds for Public Works Equipment
Trailer
The Department of Public Works is recommending replacement of the 1975 flatbed trailer.
This unit is utilized for light equipment moves. In addition to the everyday use, this trailer plays a
key role for seasonal summer help. The lighter trailer, versus the larger capacity trailers, allows
seasonal help to move mowers and equipment without a commercial vehicle license. .
The existing 1975 flatbed trailer has had two major overhauls, and requires ongoing maintenance.
Therefore, Staff is recommending that this trailer be replaced in accordance with the Equipment.
Replacement Schedule of the 2001 Capital Improvement Program. This schedule allots $4,077 for
this expenditure. It is planned that the old trailer will be retained for very limited use.
Quotes for replacement of the trailer have been received, and are indicated below.

The Lawn Fertilizer Application Control section ofthe Shorewood city code provides for a
license fee to be charged for.a Commercial Lawn Fertilizer Applicator License. Accordingly,
staff reviewed the administrative requirements of processing such a license and recommends the
fee be set at $30 per year.

WHEREAS, the fees that shall be paid to the city for licenses, permits, service
charges, and miscellaneous fees are determined from time to time by the Shorewood City
Council; and
WHEREAS, Section 310.03, Subd. 2d of the Shorewood City Code (Regulations
For Commercial Lawn Fertilizer Applicators), provides that a license fee shall be
established,

Nordquist Sign Co. has submitted a signage plan for the office building located at 19685
State Highway 7. They propose to reface the existing freestanding pylon sign (see
Exhibit A) in front of the building near the driveway and replace the previous wall sign
(see Exhibit B) on the north side of the building.

The pylon sign contains 73 square feet of area (on one side), and the wall sign contains 19
square feet of area, for a total of 92 square feet. It is worth noting that the new wall sign
is approximately one half the size of the previous. The Zoning Code allows a total sign
area up to 10 percent ofthe building silhouette as viewed from the street. Since the
building silhouette co~tains 3305 square feet of area, the applicant is well under the
maximum allowable sign area. .
It should be noted that the height of the sign is 20 feet, measured from the grade of the
parking lot. Approval of the sign permit is recommended.

Agreement with South Tonka Little League for Irrigation System

South Tonka Little League has offered to install an irrigation system at Freeman Park. The Park
Commission heard this proposal at its February 13,2001, meeting, and recommended that the City
accept this gift subject to an agreement between South Tonka Little League and the City, The
Commission was pleased with the generosity of South Tonka Little League,
The City Attorney has prepared an agreement to this effect. In essence, South Tonka Little League
~id develop plans and specifications for the irrigation system, which would need to be approved
by t111l Director of Public Works, South Tonka Little League would contract for the installation of the
s.yst1em, The system would be a donation to the City, subject to acceptance of the improvement by the
City Council (after inspection of the installation),
South Tonka Little League plans to have the irrigation system operational as soon as possible this
year.

RECOMMENDATION
It is recommended that the City Council approve and authorize execution of the agreement
with South Tonka Little League for an irrigation system at Freeman Park.

THE SOUTH TONKA LITTLE LEAGUE ASSOCIATION
RELATING TO THE CONSTRUCTION AND INSTALLATION OF IMPROVEMENTS TO
PUBLIC PARKS
RECITALS: .
WHEREAS, the City of Shorewood (City) is a municipal corporation organized under the
laws of the State of Minnesota; and
WHEREAS, the South Tonka Little League Association, Inc. (South Tonka), is a
non-profit corporation organized under the laws of the State of Minnesota; and
WHEREAS, the City owns and operates park facilities throughout the City to the benefit .
and betterment of residents of the City and surrounding communities; and
WHEREAS, South Tonka has made and desires to make further improvements to park
facilities within the City.
NOW, THEREFORE, BE IT RESOLVED that the parties to this Agreement agrees as
follows:
1. South Tonka will undertake the construction of irrigation improvements to Freeman Park
within the City (the Improvements).
2. Prior to construction of the Improvements, South Tonka agrees to provide plans and
specifications for the Improvements to the Director of Public Works of the City for
approval.
3.
South Tonka agrees to pay all obligations and costs relating to the Improvements and
further agrees to ensure the City suffers no liens or claims arising out of the
Improvements.

4. South Tonka agrees to ensure the Improvements are installed in a workmanlike manner to
contemporary construction standards.
5. The City agrees to accept the Improvements as a donation to the City at no expense to the
City.
6. Upon acceptance of the Improvements by the City Council, the City will operate and
maintain the Improvements at no expense to Soutl~ Tonka.

Gideon Glen Cooperative Agreement with Minnehaha Creek Watershed District
.
The City has purchased the Gideon Glen property for $400,000. The MCWD made a commitment to
fund 50 percent of the acquisition costs up to $200,000, as public ownership of this property would
fulfill several of its goals and objectives regarding water quality (among other things). MCWD
funding was also contingent upon execution of a cooperative agreement between it and the City of
Shorewood. It had been expected that the City would receive funds somewhat prior to mid-year
2001.
Technically, the MCWD needs to make a "plan amendment" to include this property in its water
management plan. Its staff believes that this action can be accomplished as a minor or simple plan
amendment, a process that takes 60 to 90 days to complete.
The MCWD Board of Managers is scheduled to act on the proposed Cooperative Agreement
(attached) at its March 8 meeting. The key components of the Agreement are:

· The MCWD would coritribute to the acquisition costs (up to $200,000) after making or
gaining the necessary plan amendment approvals.
· The MCWD would own any wetland credits generated by improvements.
· The parties would determine later the appropriate relationships on subsequent use or
improvement of the property.
The City Attorney has reviewed the proposed cooperative agreement and worked with MCWD
counsel in revising drafts of it.
RECOMMENDATION:
Staff recommends that the City Council approve and authorize execution of the Cooperative
Agreement with the Minnehaha Creek Watershed District for the acquisition of the Gideon
Glen property.

District (f'MCWD"), a watershed district created pursuant to Minnesota Statutes Chapter 1 03D,
and the City of Shorewood ("Shorewood"). I\. statutory city pursuant to Minnesota Statutes
Chapter 412.

WHEREAS. the MCWD has all approved Water Resources Management Plan (WRMP)
tha.t identities the preservation of wetlands and surface water resources as MCWD goals and
wetlBLld restoration, regional stormwater detention and related improvements as priorities for
protection and management of water reSources within the watershed;

WHEREAS, the Gideon Glen area i1t Shorewood, north of Smithtown Road, contains
substantial arellS of degraded and filled wetland, as well WI remnant maple-basswood forest,
through which an 8S-acre S\.Ibwatershed drains to Gideon Bay in Lako Minnetonka;
WHBRBAS, Shorewood has identified the Gideon Glen area nsa site that it desires to
preserve and restore, and has obtained ownership of the site by purchase; and
WHEREAS, the MCWD finds that preservation of the Gideon Glel1 area for water
resmltce protection may oi'fer a substantial opportunity for beneficial wetland restoration,
stormwater management. public education and other related purposes in accordance with WRMP
priorities and the existing capital improvement progra.m oflhe WRMP; and
WHEREAS, the parties aoknowledge the likelihood of mutual benefit in a. partnership to
further ex-plore the opportunities available for water resource improvenlent at the Gideon Glen
site;
Tl.-lEREFORE. IT IS AGRBED by and between the parties to enter into this Cooperative
Agreement to formalize their understanding as to the scope of their cooperation in acquiring the
Gideon Glen site.

1.1 Shorewood has been and shall remahl responsible for acquiring all fee and other
property rights necessary for the preservation and water resource hnprovel11ent of the Gideon

1.2 The MCWD shall initiate those procedures re'luired by law and the MCWD's
discretion that are prerequisite to its ordering the acquisition of rights in the Gideon Glen area, its
use for watershed purposes and its potential improvement, and to its expending funds thereon.
1.2.1 At such time as the project ma.y be ordered or established by the MCWD
Board of Managel's, the MCWD shall contribute to the property acquisition by
reimbursing ShorewQod in an amount equal to the amount paid by Shorewood toward the
purchase price, as determined after the MCWDls contributkm. Notwithstanding, the
maximum contribution of the MCWD shall be $200,000. The MCWD may review
documentation from Shorewood for the purpose of deternlining the amount of its
contribution.

1.2.2 The MCWD's obligatk~n to provide up to $200,000 for pl'Operty
acquisition is contingent on such an'angements and conveyances as the MCWD finds
adequate to ensUI'e that the acquired lands will be preserved for water resource purposes;
that altY improvements would be accoml)lished altd maintained; aI1d that the MCWD will
own any wetland credits generared by improvoments.
1.3 The parties, at their discretion, shall examine the opportunities for lIse or
improvement of the Qideon Glen area in furtherance of' water resource management and
protection. Thereafter, the parties shall ~lndertake project planning and development for any
identified improvement on the Gideon Glen site as may be mutually agreeable.
2. Am~ndments.
This Agreement may be amended only by a writiltg signed by both parties.

The Planning Commission has requested a joint meeting with the City Council at 7:00 p.m. Tuesday,
March 20. The purpose of the meeting would be similar to the recent joint CouncillPark Commission
meeting - to understand each other's work programs and expectations for 2001.
The City Council also has identified (a) community visioning, and (b) an orientation session on city

meeting. Our consultant, Hoisington Koegler Group, Inc., (HKGi), will conduct the kick-off
session for the Council.

(b) Shorewood city governance orientation - Tuesday. April 17. 2001. 7:00 p.m. The session,
tentatively titled "The 3 Rs of Local Governance - Roles, Responsibilities, and Relationships",
will be designed to give Council, commission members, and staff an overview of the form of
government in Shorewood, and a framework to work appropriately and effectively together.
I have tried to accommodate the schedules of as many people as possible in planning these meeting
dates.
RECOMMENDATION
It is recommended that the City Council set the following special meetings:
(1) March 20, 2001, at 7:00 p.m. in the City Council Chamber;
(2) March 26, 2001, immediately following the regular City Council meeting; and
(3, April 11, 2001, at 7:00 p.m. in the City Council Chamber.
