hereby states and alleges as follows:
SUMMARY OF ACTtON
Plaintiff is a property owner in the City of Shorewood, Minnesota who is seeking
to build a new home. That home would enhance the property, conform with all
applicable laws of the City and the state. add to the property taxes received by the City,
Hennepin County and the local scnools and generally be a beneficial addition to
Shorewood. Plaintiff brings this action to enjoin the City from acting through certain of
its employees from continuing a pattern of activity designed solely to frustrate Plaintiff's
efforts and to arbitrarily and capriciously force Plaintiff to expend time and money and to
endure delays that are not commensurate with any legitimate exercise of municipal
authority.

FACTUAL ALLEGATIONS APPLICABLE TO ALL COUNTS
1. Plaintiff is the owner of the real property located at 27820 Island View
Road. City of Shorewood. County of Hennepin, State of Minnesota ("Property"). The
Property was purchased by Plaintiff in April of 2000 for the purpose of removing the
eXisting structure and replacing it with a new and far better single family home. That
home when completed will be a structural, architectural and economic benefit to the
neighborhDod. the City and the County.
2. Defendant City of Shorewood is a Minnesota municipal corporation ("City~)
and as such has certain oversight and approval rights over the design and construction
of the new home contemplated by Plaintiff granted by City ordinances and state law.
3. After acquiring the Property and its prior structure. Plaintiff believed that it
would be helpful to his new community and its residents if he would permit the Excelsior
Fire Department to conduct a training exercise involving a controlled bum of the house
on the Property.
4. Plaintiff and the Excelsior Fire Department gave the required notice to the
neighbors and received a permit from the City authorizing the fire training burn. In
addition, on May 1. 2000, Plaintiff. the Excelsior Fire Department and the City entered
into an Excelsior Fire Department Agreement to Burn Structures ("Agreement"),
attacned as Exhibit 1.
5. That Agreement imposed certain requirements upon Plaintiff including the
reasonable safety measure that within 120 hours after completion of the bum. Plaintiff
must fill any excavation to grade.

City permits.
14. On information and belief, other property owners routinely bring in fill in
comparable amounts without permit or objection from the City, or jf a fill permit is
sought, such permits are routinely granted as a ministerial function, No other property
owner is known to have faced such a draconian punishment for such a simple act as
putting in sufficient fill to account for settling and grading,
15, The City has continued to impose unwarranted and unnecessary delays
upon the fair and timely handling of the building permit application process.
COUNT I
16. Plaintiff realleges the allegations of paragraphs 1 through 15.
17. The past and present actions of the Defendant are arbitrary and capricious
and constitute an unlawful and unconstitutional exercise of governmental control over
Plaintiffs property rights and his construction of a residential building on the Property.
18. Plaintiff has and continues to suffer damages. some of which are ~ubject
to monetary recovery in an amount yet to be determined,
19. Plaintiff has and continues to suffer additional and irreparable harm which
is not subject to compensation by monetary damages and for which a temporary and
permanent injunction is warranted,

violate the lawful enforcement of city and state laws and ordinances governing Plaintiff's
construction of a residential building on the Property.
22. Plaintiff has and continues to suffer damages, some of which are subject
to monetary recovery in an amount yet to be determined.
23. Plaintiff has and continues to suffer additional and irreparable harm which
is not subject to compensation by monetary damages and for which a temporary and
permanent injunction IS warranted.

enforcement of ordinances and undisclosed policies by Defendant in violation of the
Ecual Protection clause of the United States Constitution.
26. Plaintiff has and continues to suffer damages, some of which are subject
to monetary recovery in an amount yet to be determined.
27. Plaintiff has and continues to suffer additionaj and irreparable harm which
is not subject to compensation by monetary damages and for which a temporary and
permanent injunction is warranted.
