Use of TIF for Eureka Road Watermain Improvements
Background
As you know, with the upcoming development of Shorewood Ponds, it has been
recommended that the watermain be looped in that area of the City. A single feeder line
currently serves the neighborhoods in this area of the City. The purpose of looping the
water would be to ensure an alternate source of water, to maintain water pressure and to
enhance fire flow in the area.

A feasibility study prepared for this matter included four options for looping the water,
three of which would extend water down Eureka Road and one which would extend a
line through Freeman Park. Extending the water through the park could be financed
within the amount of the water connection charges the developer of Shorewood Ponds
will pay to the City. The cost of extending water down Eureka Road would be more
expensive as it would necessitate tearing up and repairing or replacing the road surface.
The additional cost would need to be financed through another source. Tax Increment
Financing (TIF) from a district covering the Shorewood Ponds development was
suggested as a possible financing tool.
Anal vsis
At your request, staff, in conjunction with Springsted, Inc., has explored the use of Tax
Increment Financing (TIF) for the extension of watermain on Eureka Road. Council
received materials on TIF financing at their May 10 meeting. Meetings were held with
the developer, Springsted, Bonel Counsel and city staff to discuss issues and possibilities
with regard to using TIF. . Among these were:
1. The type of TIF district which would be applicable. Two types were explored ~ a
Redevelopment district and a Housing district. A Redevelopment district would only
be applicable if the parcels were previously developed. A certain percentage of the

area of the parcels had to have been developed (30%) and 50% of the buildings on the
parcels must be substandard. It was determined that this area would not meet the
criteria for a Redevelopment district. This left a Housing district. This development
does qualify under the criteria for a Housing district.
2. Income Restrictions. There would be income restrictions for the potential purchasers
of the units within the district. Since this is a senior housing development, it is
anticipated that most or all units would be occupied by one or two persons. For a
one- or two-person household, the income limit would be $63,060 per year. It has
been the Council's position to not have income limits on senior housing.
3. Use ofTIF money. The increments generated by the district would largely need to be
used inside the district. Only 20% of the increments could be used on improvements
outside of the district boundaries, including up to 10% for administrative costs.
Administrative costs include legal, fiscal and other administrative costs. In addition,
increments could be used for site acquisition, demolition, grading, utilities and roads. .
Increments could not be used for the actual construction of the units themselves.
Because of this restriction, the use of TIF for watermain extension outside the district,
either down Eureka Road or across Freeman Park, is extremely limited.
4. How will the financing be structured? Three possibilities exist. First, the City could
bond for and construct the improvements, paying off the bonds with future
increments; however, the City is at risk of default or supplemental tax levy if the
development does not go as planned and increments are lower than expected.
Second, the City could sell revenue bonds to the developer and could construct the
improvements. This is the same method used for the Waterford TIF district. The
developer would be repaid solely through future increments. This places the risk
back on the developer. However, the City would still be in a default position if the
development didn't develop as quickly as anticipated. Finally, the developer could
finance and construct the improvements. Under a TIP Pay-as-you-go agreement, the
developer would be reimbursed for the improvement and financing costs solely from .
future increments. This places all of the risk on the developer.
5. Timing. It would take from two to three months to go through the process of
establishing a TIP district. The process includes notification of affected jurisdictions,
preparation of the necessary documents, and holding a public hearing. This would
place us in August/September before the district is established. Unitt the district is
established no work could be performed within the district. It is my understanding
that the final plans for the development has been submitted for approval in late June
and that the developer wants to begin construction in early July. This timeline makes
the establishment of a TIP district impossible unless the developer agrees to hold of
on construction.
6. Public Perception. There will undoubtedly be the perception that the City is
subsidizing the developer through the use of TIP. The extension of watermain would
be a benefit for many parties: the Shorewood Oaks area, those properties lying

adjacent to the extended main, and other areas adjacent to the extension that would
have the possibilities of extending water from this main. However, it could still be
perceived that the watermain is being extended for this development through the use
of future tax revenues, thereby subsidizing the developer. It may also be perceived
that by extending the watermain down Eureka, properties which may not want water
may be indirectly forced to connect sometime in the future.
ConclusionlRecommendation
While it is clear that the City can use TIF financing for the purpose of extending
watermain to this area, it is also clear that there are many issues that would need to be
addressed. The biggest issue at this point is timing - whether the developer will put off
his planned start of the development until a TIF district can be established. The public's
perception must be carefully considered. And, the imposition of income limits, whether
limited to part of the development or imposed on all of it, also seems questionable on the
part of some councilmembers.

Without making a recommendation, it seems that, at this point, there are more factors
weighing against the use ofTIF than are in favor. Ultimately, the City Council will have
to make that determination. The issues can be discussed in greater detail at the work

Of the 21 residents who are currently without municipal water service, 2 have responded that they desire
water service, 5 have responded they may consider hookup dependant upon cost, with 2 responding they
are not interested in municipal water service. Of these 21 people, only 7 provided written responses to
the survey.
In summary, this certainly constitutes less than an "overwhelming majority"

Eureka Road Watermain Project
Attachment 1 is a summary tabulation of the comments received regarding the different alternatives for
consideration of the Eureka Road project.
Of the 24 affected property owners, 13 responded to the surveys provided. In summary, of those
responding, the majority vote was to leave the road in the same condition as it is presently, and not to
extend watermain down Eureka Road. ..

The feasibility report for this project described different variations of two alternatives for the looping of
the Shorewood Oaks / Shorewood Ponds watermain system. The first alternative was to extend
watermain down Eureka Road. The second concept was to extend water through Freeman Park to
Eureka Way.
From a purely technical standpoint, I must state that it appears to have the most cost benefit to extend the
watermain down Eureka Road, and utilize MSA funds to rebuild the road. This would serve the 24
parcels along Eureka, versus the two homes which would be able to connect to the watermain by going
through Freeman Park.

Recently there has been discussion that homes which back up to Freeman Park would have the
opportunity to connect to the watermain in the park, if that is the alternative chosen. Their service would
be installed off the back of their lot. While this scenario is not impossible, it is less than ideal for several
reasons.
Service lengths extending off the rear of the property leads to water quality problems, pressure problems,
and more importantly, problems in locating the shut off valve in the event of emergency or required water
shut off. It has been the City's policy to only connect from the front of the house to insure ease in
locating the shut of valve. These valves become very difficult to locate after they have been landscaped

over, or buried by deep snow. Having established the standard of having the valve located off the front
of the house has eased water operations dramatically.
Reconstruction of the Roadway using State dollars provides an opportunity to address several drainage
concerns along Eureka Road. In addition, this would maximize the potential for maintaining a healthy
balance in the City's roadway fund.
Having stated all of this, these decisions certainly are not to be made in a vacuum. From the "technical
side" it makes good sense to proceed with extending water down Eureka Road. However, the City
Council must weigh out the best alternative for the public. .

I appreciate your informal meeting and discussion of the potential changes to Eureka Road that
you held last night.
As I did verbally last night, I want to make my opinion clear for the record. I oppose any changes
to Eureka Road either to add city water. or to widen the road in any manner.
For several years the residents of this area have opposed senior housing density in our area.
Unfortunately the developers attorneys are much smarter than the nearby residents and now we
are stuck with this development. Most disappointiJ:lg however, is that before the first shovel of dirt
has been turned, the issues raised in opposition to this development are coming forward.
These issues are density related issues that were raised repeatedly during our discourse on this
development.
It has been explained to me that the developer is not driving this process and he does not care
where he gets his water. While that may be true, the development of Shorewood Ponds is MOST
DEFINITELY driving the consideration of these improvements and the developer is, and has
been, driving the development! The developer and the development cannot be separated from
these issues.
As I see it, this city is under no legal obligation to supply this development with water. I again
oppose any consideration made by the city to accommodate the developments needs at the
expense of right of way or financial burden of the folks living on Eureka Road.

Re: Eureka Road Issues
After attending the informal meeting tonight at City Hall, I am deeply concerned about the
issues and options that are being considered. I am at 5760 Eureka on the West side
which would have the most direct impact from water being brought through.

Maybe I'm being a little selfish in not wanting this to happen. I know it would benefit the
new development, Shorewood Ponds, as well as Shorewood Oaks. At the same time, I
am not really concerned about them. Shorewood Ponds should never have happened in
the first place, but since it did - I see no valid reason whymy property should be disrupted
for water to supply Shorewood Ponds. My street would be tom up indefinitely, it would
take a considerable amount of my front yard, to include the beautiful maples that I would
certainly prefer looking at rather than curbs and gutters on my front step. I don't mind the
utility poles and it would certainly be preferable to have them remain as well as my front
yard and the trees. Even with the least drastic option which would leave the trees, the
street would be so close and the roots of the trees damaged so much that chances are they
wouldn't live. In that case of course we would have extra expense to have the trees taken
down when they die. You say that by having the water line go through the park it would
only benefit a couple of people. I disagree. It would benefit all the people on Eureka Rd
and especially those on the west side of Eureka because we wouldn't have half our front
yards taken away, the street tom up for who knows how long, the expense of a new road
(we're dreaming if we think that the "current" policy of no assessment for the street would
last), our entire property decreased in value, the traffic and speeds along Eureka increased,
not to mention the assessment of the water itself

I think the option of bringing the water in from the existing Shorewood Oaks development
would be the best option, or doing nothing at all. The statement was made tonight that as
a city we have no responsibility to provide them with city water. I know the City Council
does not want them to go with wells, but why not? Maybe if there' s eneugh
discouragement, the development won't happen?
The proof of the issues involved with increased development is in my back yard. Take a
walk through my back yard in the next few days, but be sure to bring your waders. Yes-
we ~ave a drainage problem on our property that needs to be addressed, but it
... didn't exist until the city allowed the development directly behind us. You have
done nothing to date to correct this problem, and this as well will decrease our
property value.
We have lived here for 23 years and one of the primary reasons we bought here was for
the rural atmosphere. I'm sure this is true for many residents. I hope that the Council
will listen to these concerns with an open mind, and not with a mind that has already been
made up. Weare almost ready for retirement and the equity that we have built up in our
house will be a good portion of our retirement income. With the cost of putting in city
water, the street itself, the decreased value of our home because of the closeness to the
street and any other additional assessments that could possibly go along with it - our
retirement income will be decreased considerably. Quite possibly if we had just recently
built a new home here on Eureka and intended to live here for many more years, we might
feel differently. That is not the case, and I feel that I am entitled to be just a little selfish
about these issues.

outside the pavement or shoulder area to bury these lines? The homeowner would
contract to have service lines buried It is estimated that the cost would be $200.00-
$500.00 to the homeowner. Is this still desirable?
Yes - with two sump omnps in our basement. one of my conQet11s is that should
we have a ~wer outage due to downed power lines. we'll have a floo<Ied basement -
and all that goes with it. This occurred last summer. Burving these lines will.
