Staff now suggests an alternative (i.e. "friendly condemnation ") which would expedite the process, save the Hermans some application fees, and not require changing the ordinance for one, somewhat unique, situation. The Hermans are agreeable to signing a consent to the condemnation. If you have any questions relative to this matter, please call the Planning Director prior to Monday night's meeting. Approval of the condemnation orders requires a simple majority vote by the Council. n � PRINTED ON RECYCLED PAPER Executive Summary Shorewood City Council Meeting 1Vlonday, August 10, 1998 The City Council will meet in Executive Session in the conference room at 6:30 p.m. Agenda Item #3A: In preparation for the elections, the City Council appoints election judges for the year by resolution. That resolution is in the packet. i; . Agenda Item #3B: This is a motion to adopt a resolution awarding the 1998 Bituminous y' Overlay Project to DMJ Corporation. The low bid provided is $84,625.00. This exceeds the $80,000 programmed through the Capital Improvement Program. However, Staff is recommending approval of the Contract. The remaining dollars will be transferred from the Local Roadway Fund under a separate resolution at a later date. Agenda Item #5: Requirements of insurance for tournaments at City parks had been covered by written policy. They are now incorporated into this tournament application form. The sentence now reads, "other items required at time of application are evidence of comprehensive liabilitv insurance in the amount of $500.000 per occurrence workers compensation coverage if applicable and a schedule of events." Agenda Item #7: In the packet is a copy of the mailing labels that we used for the first and second notices. All Shorewood Oaks residents were included. Also included in the packet are communications regarding the petition for the stop sign on Shorewood Oaks Drive at Maple Leaf Circle. Traffic count results on Shorewood Oaks Circle are also enclosed. One indicated he would not be able to meet our timeframes. Garrett Lysiak from Owl Engineering Inc. is recommended. A proposed letter of agreement and some background material is enclosed in the packet. Because a public hearing on an ordinance regarding cellular towers should be held in early October, timing is important. The Council is asked to authorize execution of the agreement for professional services which is to be done only after the Council has had an opportunity to meet Mr. Lysiak and discuss with him communications issues as a work session scheduled for Monday, August 17. Agenda Item #10: The Coordinating Committee has recommended a budget for the South Lake Minnetonka Public Safety Department. That budget is enclosed in the packet for your review. Chief Rick Young will be present at the meeting should there be any questions. Please feel free to call me with any questions in advance of the meeting. • Agenda Item #11: As you may know, the Finance Department has been utilizing its present hardware and software since 1990. The computer applications are not and will not be made to be year 2000 compliant, making it necessary to upgrade both hardware and software in this area. Staff has obtained quotes for the upgrade of the finance software from the city's present vendor, CMS, and for the acquisition of a new Windows/NT file server, workstation and Hewlett - Packard high -speed laser printer from Dell Computers. Staff has utilized and integrated current equipment along with the new equipment to move toward the goal of establishing a Windows/NT network in the City offices. The acquisition of this hardware and software will satisfy the immediate need to upgrade the financial computer capabilities while also moving the city offices toward it's goal of networking staff in the various applications among its departments. The 1998 Capital Improvement Plan contains a budget of $40,000 to make these improvements. The proposed acquisitions, along with implementation and a small contingency, fall within this budget. Approval of the proposed hardware and software is recommended by staff. • CITY OF SHOREWOOD REGULAR CITY COUNCIL MEETING MONDAY, JULY 27, 1998 MINUTES 1. CONVENE CITY COUNCIL MEETING Mayor Dahlberg called the meeting to order at 7:00 p.m. A. Review Agenda Mayor Dahlberg read the Agenda for July 27, 1998. Councilmember O'Neill requested adding Agenda Item No. 11, Discussion Relative to An Accessory Building, Location: 5650 Eureka Road. The agenda was approved as amended. C . Presentation of Appreciation Mayor Dahlberg presented Mr. Dan Randall with a gift certificate in honor of his 25 years of service with the Public Works Department. Dan's wife, Chris, was also in attendance along with their daughters Abbey, Ashley, Allie and Anna. 2. APPROVAL OF MINUTES City Council Regular Meeting Minutes - July 13, 1998 O'Neill moved, Stover seconded approving the City Council Regular Meeting Minutes for July 13, 1998, as amended on Page 3, Item 8, Paragraph 3, change to reflect "artificially slow the traffic" and add "The City will need to obtain unaffected results first." Page 5, Item D, Sentence 2, change to read "The stop signs were removed from Shorewood Oaks Drive and Maple Leaf Circle." Sentence 3, change "Oak Leaf Trail" to "Maple Leaf Circle." Page 6, Item E, Paragraph 8, Sentence 1, change "unwritten" to "written." Sentence 2, change to read, "the Planning Commission rules state no further public comment will be allowed, although this is not strongly enforced." PARKS - Report by Representative A . Report on July 14, 1998 Park Commission Meeting Park Chair Dan Puzak reported on the matters considered and actions taken at the July 14, 1998 meeting of the Park Commission (as detailed in the minutes of that meeting). B . A Motion Accepting the 1997 -98 Snowmobile Season Report - Presentation by Jeff Keller Officer Keller was in attendance and reported on the 1997 -98 snowmobile season. He stated the focus was on training. An additional officer was certified as snowmobile safety instructor. Forty - five student were certified through the safety classes which were conducted by the police department. Officer Keller expressed appreciation to the Council for allowing the use of the Freeman Park parking lot for the practical portion of the classes. During 1995 -96, there were 99 snowmobile related complaints. In the 1996 -97 season, there were 57 complaints, and in the last season, the complaints dropped to 35. Officer Keller felt there are a number of factors associated with the decrease in complaints which are received. Officer Keller reported in the last year the City applied for and received a grant of $1,000 from the Department of Natural Resources to be used for snowmobile enforcement. The grant funds were used to cover a 30 -hour block of overtime patrolling of the trail. At the end of the season, 50 citations and 12 warnings had been issued. This is a decrease from approximately 100 citations • which were issued in the previous season. Officer Keller relayed there are now four officers patrolling the trail at various times who spent a total of 187 hours on the trail. Officer Keller noted Chief Young has submitted a memorandum with respect to equipment needs and he asked that the Council give that matter some consideration. Officer Keller stated he feels the officers are having a positive impact. Councilmember Champa inquired whether Officer Keller has felt in danger while out on patrol. Officer Keller related a situation in which he was alone and stopped a couple who were on the trail. This situation ended up in a wrestling match. When attempting to utilize his radio to call for assistance, there were difficulties with the radio in that it was attached to his helmet which had fallen in the snow during the struggle. Officer Keller expressed concern relative to the potential for problems to arise when a single officer is stopping two or more persons on the trail at one time. CITY COUNCIL REGULAR MEETING MINUTES JULY 27, 1998 - PAGE 3 O'Neill moved, Champa seconded accepting the 1997 -98 Snowmobile Season Report. Motion passed 510. Councilmember Stover noted the Park Commission asked that the Council identify if there is an easier graph system to be used in the future. Park Commission Chair Puzak explained the historical data is available. If presenting a graph, it must be realized the numbers will change with the days of snowmobiling and the snow. He did not feel a simplistic graph would tell the full story and stated the Council should be aware of this. Officer Keller informed the Council that Polaris Industries sells snowmobiles, jet skis and other apparatus to governmental agencies at approximately 50 percent reduced price. In addition, he pointed out other cities are benefiting from Officer Keller's patrolling activities, although the majority of his time is spent patrolling in Shorewood. Officer Keller stated this may be something the Coordinating Committee may want to discuss. Officer Keller noted the Shorewood snowmobile is very well maintained. Councilmember O'Neill inquired how the additional snowmobile officers are being outfitted at this time. Officer Keller stated he and the other officers have contributed some of their personal equipment. . • Councilmember O'Neill noted if a second machine is purchased, there would be an expense relative to installation of lights as well as the additional expense of outfitting the officer. Officer Keller will obtain information relative to cost from Polaris Industries. C . A Motion Accepting the Proposed Tournament Policy Councilmember Stover inquired whether there is a provision in the policy which states the amount and type of insurance which is required as well as a provision which addresses holding the City harmless. Engineer Brown stated it has been a manner of practice that the City has previously required evidence of insurance for an association to be recognized as an organized sport. Mayor Dahlberg directed staff to investigate this matter and stated out of fairness and equity, everyone should be supplying the same level of coverage. Councilmember O'Neill suggested tabling this matter until the details can be worked out. Chair Puzak noted this policy will not become effective until next year so the policy will not be affected if it is tabled. Councilmember Stover requested the inclusion of a hold harmless clause on behalf of the City. O'Neill moved, Stover seconded tabling the acceptance of the proposed tournament policy to the August 10, 1998 meeting of the City Council. Motion passed 510. 6. PLANNING - Report by Representative Planning Commissioner Collins reported on the matters considered and actions taken at the July 21, 1998 meeting of the Planning Commission (as detailed in the minutes of that meeting). Commissioner Collins also brought to the attention of the Council there is a problem with bicycles on the trail. He related an incident in which the bicyclers demonstrated poor and dangerous behavior on the trail. He suggested to the Council the same program which is utilized with respect to snowmobiles on the trail, including enforcement, be carried over and applied to bicycles on the trail. CITY COUNCIL REGULAR MEETING MINUTES JULY 27, 1998 - PAGE 4 A. A Motion Directing Staff to Prepare a Resolution Approving a Preliminary Plat - Christmas Shores Applicant: Keith Waters Location: 5715 Christmas Lake Road Planning Director Nielsen reviewed this matter and noted although there was substantial neighborhood support of Mr. Waters' request, concerns were raised by Mr. Peter Lehman relative to the proximity to the road and the traffic which would be generated by this subdivision in front of his rental properties which currently exist on the east side of Mary Lane. Mr. Waters was in attendance to address this matter. Mayor Dahlberg noted his understanding this request complies with existing zoning and would not require any variances. He also noted there is substantial neighborhood support. Mayor Dahlberg noted there was concern raised by Mr. Jabs relative to drainage of watershed into Christmas Lake. Engineer Brown explained outlot "A" is sized to accommodate an adequate stormwater facility which is truly designed to NURP standards. He further explained Mr. Jabs • appears to be satisfied relative to this issue. Councilmember O'Neill inquired relative to the road design which will be used. Brown stated while there are several options, he considered a straight cul -de -sac design which would minimiz the pavement area and would keep maintenance costs to a minimum. It does not, however, create a separation from the boat access to the residential access. It was therefore ultimately decided the plat, as proposed with some minor modifications to address the more technical traffic issues, would be appropriate. Don Peterson, Civil Engineer and Project Manager, was also in attendance. Mr. Waters described the type of road he proposes for the development. Mayor Dahlberg noted this would be essentially leaving the road the same as it exists today which would not necessarily improve the situation, but would not make it worse. Mr. Waters noted this to be the case. Mayor Dahlberg questioned what type of impact 50 additional car trips per day would have on the neighborhood. Brown stated each roadway varies based on its function. He felt considering Mary Lane has been accustomed to solely boat traffic during the evening hours and the traffic of two parcels, this will be a significant increase for them. Brown noted, however, the traffic will come in at varying times. Councilmember Garfunkel pointed out this traffic would also be somewhat seasonal. Councilmember Stover noted on a per hour basis, this would amount to approximately five vehicles per hour. Mr. Peterson explained he had the traffic monitored between the hours of 7:00 and 8 :20 a.m. which he would consider to be the morning rush hour. During this time 104 cars entered the intersection from south to north. He felt an additional 50 cars per day would create a minimal impact. Maximum stacking at this intersection consisted of approximately seven cars lasting approximately 14 seconds. Mayor Dahlberg voiced his appreciation to Mr. Waters, Mr. Peterson and City Staff for being sensitive to the impact on this area. CITY COUNCIL REGULAR MEETING MINUTES JULY 27, 1998 - PAGE 5 Garfunkel moved, O'Neill seconded directing staff to prepare a resolution approving a preliminary plat - Christmas Shores for Keith Waters, 5715 Christmas Lake Road. Motion passed 510. B . A Motion to Adopt a Resolution Approving a Conditional Use Permit for Special Home Occupation Applicant: Doug Kurkowski Location: 27200 West 62nd Street Mr. and Mrs. Kurkowski were in attendance requesting a Special Home Occupation Permit which will permit Mr. Kurkowski to operate an audio headset business from their home. Councilmember O'Neill noted the neighbors have expressed concern relative to increased traffic as a result of this business. He commented although the applicants stated there is only one UPS delivery per day, there are a number of FedEx deliveries. Mr. Kurkowski noted he has a contract with UPS for delivery once per day and, although he does • not have a contract with FedEx, he receives deliveries once or twice per week. Mr. Kurkowski stated he has contacted a number of his clients and encouraged them to utilize the U.S. Mail rather than FedEx. Mr. Kurkowski reported a "dead -end" sign has been posted in the area and this has significantly reduce the traffic in the area. In addition, he noted there are three garbage companies servicing this particular roadway. Councilmember Stover noted a number of home occupations have visitors frequently during the day on an appointment type basis. She pointed out Mr. Kurkowski does not have the type of business where there will be visitors on a regular basis. Councilmember Garfunkel did not feel there were any concerns relative to traffic. Court Queen, 27180 West 22nd Street, stated he is the next door neighbor and he supports the application of Mr. Kurkowski. He felt there would be minimal impact relative to traffic. He noted the dead -end sign has significantly reduced traffic in the area and he is not opposed to the weekly • visits of the UPS truck. Stover moved, Garfunkel seconded adopting RESOLUTION NO. 98 -074 "A Resolution Approving a Conditional Use Permit for Special Home Occupation for Doug Kurkowski, 27200 West 62nd Street." Councilmember O'Neill noted a number of residents were in attendance at the Planning Commission and he assumed their concerns had been addressed given the lack of public input at this particular meeting. Planning Director Nielsen explained if there is a concern relative to the intensity of the business, a provision could be included if the applicants were to sell their home, the Conditional Use Permit would be terminated. Nielsen explained that ordinarily a Conditional Use Permit would go with the land unless specified otherwise. Mayor Dahlberg suggested a friendly amendment to the motion reflecting the Conditional Use Permit will terminate upon a sale of the property. CITY COUNCIL REGULAR MEETING MINUTES JULY 27, 1998 - PAGE 6 Stover moved, Garfunkel seconded adopting RESOLUTION NO. 98 -074 "A Resolution Approving a Conditional Use Permit for Special Home Occupation for Doug Kurkowski, 27200 West 62nd Street," subject to termination of the Conditional Use Permit upon the sale of the home. Motion passed 510. 7. CONSIDERATION OF A MOTION REGARDING REQUEST FOR STOP SIGN AT INTERSECTION OF MAPLE LEAF CIRCLE AND SHOREWOOD OAKS DRIVE Mayor Dahlberg acknowledged a memo by Administrator Hurm requesting this matter be tabled to the August 10, 1998 meeting of the City Council. Brown explained notices will be re -sent to the entire neighborhood. Theresa Brown, 6050 Burlwood Court, noted significant traffic in the area given the close proximity of Freeman Park. She stated there are close to 200 children playing in the streets in the vicinity of Maple Leaf Circle. Ms. Brown suggested a stop sign would hopefully slow down traffic in the area. She has noticed the majority of people driving in the area do not acknowledge the stop signs. Heather Garibaldi, 6080 Burlwood Court, stated she has contacted the post office, the garbage companies and UPS to notify them their drivers are not obeying the stop signs in the area. Councilmember O'Neill suggested contacting the police department and assured this matter will be passed along to them. Ms. Garibaldi stated the placement of the two signs now is good, but she felt an additional sign would be more effective. Mayor Dahlberg stated he would like to consider all possibilities and noted the Council is willing to work with the neighborhood in this regard. Councilmember Stover asked if there a better way to sign the Freeman Park access. Engineer Brown stated he will work with the State to address this issue. Councilmember O'Neill noted the sign simply needs to be moved to the east, closer to the park. John Haesler, 26225 Oak Leaf Trail, stated he is in support of an additional stop sign at Maple Leaf Court and Shorewood Oaks Drive, however, as a resident of Oak Leaf Trail, he feels this will generate additional traffic onto Oak Leaf Trail when motorists notice the additional stop signs. Pat Hadapp, 26195 Shorewood Oaks Drive, felt the neighborhood is in support of an additional • stop sign. The other concern would be to ensure there is some equity between Oak Leaf Trail and Shorewood Oaks Drive. He felt the addition of two stops signs would be the ideal situation. Mr. Haesler suggested a stop sign in the middle of Oak Leaf Trail in the area of the fire hydrant. Councilmember Garfunkel commented when placing a stop sign where a motorist will not expect it, this can create a false sense of security as well as a more dangerous situation than if the roadway were without a stop sign. Commissioner Champa inquired whether a one -way access has been considered. This would result in the burden being shared. Councilmember O'Neill noted this would have a definite impact on the residents. Commissioner Champa stated he would like to hear suggestions back from the neighborhood. He suggested one option would be to make Oak Leaf Trail a dead end street. Mr. Haesler felt the neighborhood would support this. CITY COUNCIL REGULAR MEETING MINUTES JULY 27, 1998 - PAGE 7 Councilmember Stover pointed out dead ending this street will result in high volumes of traffic on the other streets. Mayor Dahlberg stated the Council is willing to work with the neighborhood to reach an acceptable resolution to this situation. Engineer Brown stated from a technical standpoint, stop signs need to be warranted otherwise they will lose their effectiveness. He noted stop signs can provide a false sense of security. He expressed concern if cars are not stopping for the signs now, they may not stop at the additional sign either. Brown explained warrants are mandated by the Institute of Traffic Engineers relative to the placement of stop signs. Brown also stated in a litigious society, the City could become involved in a lawsuit in the event of an accident and it were felt the signs were not warranted. Mayor Dahlberg felt the City could just as well become involved in a lawsuit by not placing a sign. He felt even though it may be ineffective to place an additional stop sign in this area, it would be better than doing nothing. Mayor Dahlberg suggested to the residents in attendance that a neighborhood committee be establish to work with the City on this issue. Planning Director Nielsen felt the most effective manner in which to deal with a situation of this type is through enforcement. Ms. Garibaldi did not feel there has been any enforcement in the two years she has lived in this neighborhood. Mr. Haesler stated the neighborhood will return with suggestions. Attorney Dean commented if the City Council, in the exercise of reasonable judgment, determines an additional stop sign would serve a significant public safety purpose, the City would succeed against any lawsuit which might be filed against it. He pointed out a sign had been placed in this area by a previous City Council based upon a review of the facts and a determination that placement of a sign in this area would be reasonable. Planning Commissioner Pat Collins, noted in his experience as a police officer, residents in the neighborhood are generally the people who are violating the area speed limits and stop signs. Mr. Haesler inquired whether the speed limit in the neighborhood could be reduced. Brown explained in seeking to establish a speed limit which is less than 30 mph, a petition would have to be received by the Council. The Council would then make a petition to the Commissioner of Transportation. The Commissioner of Transportation would then conduct a speed study and the speed is then set at 85 percent of the actual rate of speed in the area. There is, therefore, a potential for the speed limit to actually be increased rather than decreased. Mayor Dahlberg suggested the residents of the neighborhood attend the August 10, 1998 meeting of the City Council to voice their concerns. If a neighborhood committee has been established, their suggestions and recommendations should be submitted to City Staff. 8. CONSIDERATION OF A MOTION TO APPROVE A LEASE AGREEMENT FOR AN OUTLOT FOR WATERFORD HOMEOWNERS ASSOCIATION FOR AN ENTRY MONUMENT Planning Director Nielsen explained this agreement has been provided to the Waterford Homeowners Association for their review, however, they have had short notice to review the lease and present it to their Board of Directors. CONSIDERATION OF A MOTION TO ADOPT A RESOLUTION ACCEPTING FEASIBILITY REPORT FOR WILTSEY LANE IMPROVEMENTS AND ESTABLISHING A PUBLIC IMPROVEMENT HEARING Engineer's Report on Informational Meeting held July 23, 1998 Mayor Dahlberg noted there were two residents from one property in attendance at the informational meeting on July 23, 1998. He felt until the City receives more reaction from the neighborhood, this matter should be tabled indefinitely. Councilmember Champa commented the City Assessor has determined a benefit of approximately $8,500 per property and the report of the City Engineer reflects each property would be assessed $8,419. Mayor Dahlberg directed staff to share this information with the Wiltsey Lane residents. O'Neill moved, Garfunkel seconded indefinitely tabling consideration of a resolution accepting the feasibility report for Wiltsey Lane improvements and establishing a Public Improvement Hearing. In addition, the information from the City Assessor and City Engineer will be shared with the residents of Wiltsey Lane. Motion passed 510. Mr. Francis McMahon, 6165 Pleasant Avenue, was in attendance. Mayor Dahlberg explained according to the existing policy, Mr. McMahon's property would not have been assessed for improvements on Wiltsey Lane. City Engineer Brown stated it is his recommendation that Mr. McMahon's property not be assessed for the improvements since he does not believe he would benefit from them. 10. CONSIDERATION OF A MOTION AUTHORIZING EXECUTION OF A LEASE AGREEMENT WITH SHOREWOOD VILLAGE SHOPPING CENTER INC. Finance Director Rolek reported in the event the City were to discontinue its liquor operations, the lease could be canceled with a four month notice. Rolek further explained the management of the shopping center is anticipating some improvements to the center and would like to have all of the lease agreement updated prior to seeking financing. Councilmember Stover noted the percentage of property taxes as well as cost of maintenance of the common areas has been an issue in the past. Rolek explained these items are estimated and charged on a monthly basis. The City receives an itemization of the actual charges on a yearly basis and any necessary adjustments are made at that time. Nielsen reported as far as renovation of the center, there have not been any applications for permits, however, there has been reference to reroofing the center and/or possibly performing some face lifting across the front of the center. CITY COUNCIL REGULAR MEETING MINUTES JULY 27, 1998 - PAGE 9 Councilmember Stover noted the renovation cost would probably be passed along to the tenants. Rolek explained all tenants would pay a pro rata share of their cost of the improvement. This amount would be amortized over the remaining portion of the lease. If this amount is in excess of $665 per month, the tenant could give a one year notice they wish to cancel their lease. The management could then renegotiate that pro rata share. Rolek explained the lease with the City has been changed to reflect the City's share will not exceed $665 per month. Garfunkel moved, Champa seconded authorizing the execution of a lease agreement with Shorewood Village Shopping Center, Inc. Motion passed 510. 11. DISCUSSION RELATIVE TO AN ACCESSORY BUILDING Property Owners: Mike and Laurie Herman Location: 5650 Eureka Road Mike and Laurie Herman were in attendance to address this issue. Mayor Dahlberg explained the Hermans have acquired and improved the property next door to them. The house on this piece of property is in poor repair and the Hermans would like to have it removed. There is an accessory • building on the property which is in good shape. In addition, the Hermans have made improvements to this building. Mayor Dahlberg explained if the Hermans remove the house, by ordinance, the accessory building would not be permitted. Mayor Dahlberg felt this may be an unintended consequence of the ordinance. Ms. Herman explained that due to restrictions of the mortgage company, they were unable to combine the third parcel with the first two which have previously been consolidated. Ms. Herman stated they do not intend to build on the property or sell it. Councilmember O'Neill felt everyone would lose if the Hermans are not permitted to keep the accessory building once the existing home is destroyed. Nielsen felt a Conditional Use Permit may be a logical way to handle the situation, however, this will require an amendment to the ordinance. Attorney Dean did not feel it would be difficult to formulate conditions which would resolve this problem. He noted there are other options which can be considered such as a use variance although he felt a Conditional Use Permit would be the appropriate way to proceed. Mayor Dahlberg referred this matter back to the Planning Commission to process and return a draft ordinance amendment to the Council for their consideration. In addition, Attorney Dean stated the Hermans will need to make application for a text amendment as well as a Conditional Use Permit. Ms. Herman inquired how long this process will take. Nielsen explained it could take 60 to 90 days to complete given the notice requirements. CITY COUNCIL REGULAR MEETING MINUTES JULY 27, 1998 - PAGE 10 12. ADMINISTRATOR AND STAFF REPORTS Staff Report on Development Monitoring Nielsen reported relative to the Gideons Woods Development. There are two lots vacant on which four units could be built. This has been delayed given the fact the required drainage facilities were not installed. Staff are in contact with the Gaines Trust to address this situation. Staff has reviewed the area and determined there will be less tree removal than originally anticipated and that the most this would cost would be $10,000 to $11,000. If the developer's contractors are careful, they will not approach that number in terms of tree replacement. At this point, the developer must escrow $10,000 for that purpose. Once the escrow is in place, the City will process building permits for the final four units. Nielsen reported the City has collected on Abingdon Development's $43,000 Letter of Credit given the punch list of items which remain to be completed. Amounts will be refunded for any items which the developer completes prior to the City addressing them. Councilmember Garfunkel noted the billboard has not been removed and the development . agreement calls for the removal of that sign. Mayor Dahlberg was unsure the Council had made a definitive decision and requested staff check into this. Nielsen commented if the decision was made to remove the billboard, this will be acted upon. Mayor Dahlberg inquired relative to the status of the fencing at Watten Ponds. Nielsen stated he will address that issue this week. 13. MAYOR & CITY COUNCIL REPORTS Councilmember O'Neill requested Public Works place the speed cart in Shorewood Oaks to complete speed monitoring as soon as possible. Brown noted there is a high demand for the speed cart. In addition, it must be kept charged. He also explained it has been the City's practice to take the cart in on weekends given excessive damage to the radar unit in the past when it was left out. With respect to speed monitoring on St. Albans Bay Road, the 85 percentile was at 25 miles per hour. The speed was monitored, but not displayed. Brown stated he has not determined whether the speed on this road was set through a petition to • the State. Councilmember Stover commented this road may be a good candidate for a 25 mile per hour roadway. Mayor's Report on Meeting held July 27 to Discuss the Excelsior Fire Contract Mayor Dahlberg reported he attended a meeting along with Councilmember O'Neill in which they met with the cities of Deephaven, Excelsior, Tonka Bay and Greenwood to discuss the future of the Excelsior Fire Department contract. Mayor Dahlberg explained the discussion surrounded concerns raised by Deephaven which are of a financial nature in addition to how the department is run. They would like to obtain an analysis of comparables from other departments to be sure this is an efficient operation. A decision was made to proceed with an analysis and investigation. Deephaven will bring the results back to the Council. Mayor Dahlberg stated while Excelsior would like a five year contract at this time, consideration will be given to changes which are necessary to ensure this is an efficient operation. CITY COUNCIL REGULAR MEETING MINUTES JULY 27, 1998 - PAGE 11 Councilmember O'Neill noted wood chips are still available at Freeman Park, free of charge. Engineer Brown commented a weekend time may be established in which volunteers from Public Works will assist with loading of the chips. Brown noted the remaining wood chips will be delivered to the Renaissance Festival within the next couple of days. There will be no cost to the City with the exception of the trucks which are used to deliver the wood chips. He pointed out there are generally costs which the City would incur to dispose of the wood chips. Brown also reported the City has received notice that FEMA will fund approximately $85,000 of the storm damage clean up expense. 14. Review Agenda Mayor Dahlberg reviewed the Agenda for July 27, 1998. Councilmember O'Neill requested the opportunity to raise an issue relative to the code book. The agenda was approved as amended. C . Discussion Relative to Code Book Councilmember O'Neill suggested directing staff to index the subsections as well as the major sections. He stated he would like the subsections included in the index pages of the code. Mayor Dahlberg noted his agreement and there was no objection. 2. DISCUSSION ON NATURAL RESOURCES PORTION OF COMPREHENSIVE PLAN Planning Director Nielsen stated there may be additional items to be included in the Natural Resources section of the Comprehensive Plan once the Land Conservation Committee has completed their report which he anticipates will be completed in November. • Nielsen stated he will be discussing with the Committee the need to place a stronger emphasis on the environmental aspects of the land to be put aside. The concern of the City would be to preserve land which is most sensitive. This would result in limiting density. The Council reviewed the additions and deletions indicated on pages NR1, NR3, NR7, NR8, NR10, NR11, NR12, NR15, and NR17. With respect to Page NR 11, Councilmember Stover noted her objection to the provision relative to trees. She explained this was initially to avoid clear cutting. Councilmember Stover noted if a property owner has a heavily wooded lot surrounded by trees, every time there is a storm, there are trees down. She questioned why someone would be required to pay into a fund to make up trees which are removed. Nielsen stated this is not a penalty, however, any developer who removes a tree is going to replace it. If it is not practical to put it on that site, a payment is made into a fund. This will reduce the number of trees which are taken down indiscriminately. 16 M I ly CITY COUNCIL WORK SESSION MEETING MINUTES JULY 27, 1998 - PAGE 2 Councilmember Champa felt a good point was made by Councilmember Stover in that he questioned the policy of requiring payment into a fund for the replacement of eight trees if there is not an appropriate place on the property in which to plant replacement trees. Nielsen noted this issue was discussed with a local developer who was in favor of a contribution into a fund rather than placing trees on a property where they do not belong. Councilmember Garfunkel noted this creates a built -in mechanism to deal with a situation such as clear cutting. It was the consensus of the Council to leave this provision as written. On Page NR17, Councilmember Stover pointed out a discrepancy between the meeting minutes and the paragraph relative to the Wetland Conservation Act having been incorporated into the Shorewood Wetland Code. Nielsen will make the appropriate change. Councilmember O'Neill pointed out the DNR has suggested a 50 -foot setback to avoid situations in which people begin to encroach into this area. Nielsen noted the City currently utilizes a total of 50 feet. Councilmember O'Neill noted the DNR has noted problems relative to people encroaching into this area with grass clippings, swing sets, etcetera. Nielsen noted the DNR does not have regulations on the buffers, however, they do have regulations relative to the wetland itself. Mayor Dahlberg stated he is in agreement with the proposed changes to the Natural Resources section of the Comprehensive Plan. Councilmembers Champa, Stover and O'Neill noted their agreement. Councilmember Champa commented the City authorized funds in the amounts of $3,000 and $1,000 to the playground project at Minnewashta Elementary School. He reported the School Board has loaned the PTO the funds to purchase the equipment to be installed this weekend. They will then attempt to raise additional funds. Councilmember Champa noted they are asking for volunteers to help in setting up this new equipment. Councilmember Champa inquired how the City's $1,000 contribution is made. He inquired whether the City would offer a crew to assist in this set up. Nielsen stated he will discuss this with Engineer Brown. 3. Attachment 1 is the speed and volume study obtained from the "speed buggy." The speed buggy was placed on Shorewood Oaks Drive approximately mid way between Maple Leaf Circle and Burlwood Court. The display was not showing to the drivers. The radar unit recorded traffic in both directions on Shorewood Oaks Drive. The time period that the radar unit monitored traffic was from 8:30 AM Monday August 3 to 8:03 AM Friday August 7. This monitoring was completed to aid the City Council in making the decision as to whether a stop sign • should be installed "to control speed" on Shorewood Oaks Drive. Please take the time to review this article, as it relates some very important concepts. For brevity they will not be repeated here. :` PRINTED ON RECYCLED PAPER �"� J Attachment 3 is an excerpt from the Minnesota Manual on Uniform Traffic Control Devices (MMUTCD). This manual is the governing standard by which signs are placed. The warrants for placement of stop signs have been highlighted in the margin of this attachment. For reference, the signs under consideration do not meet the warrants for placement according to the MMUTCD. Certainly, the City Council has the authority to place the signs as they desire. Lastly, I must state that I have serious concerns regarding the placement of additional stop signs in an area where the residents have already stated that there is a problem of drivers not stopping at the signs that are already present. The drivers who are violating the existing signs are the very drivers likely to fail to even slow down for additional stop signs that are not warranted. This can lead to tragedy for a pedestrian stepping into traffic, assuming that that vehicle is going to stop at the sign. One common misuse of stop signs is to arbitrarily interrupt • through traffic, either by causing it to stop, or by causing such an inconve- nience as to force the traffic to use other routes. Where stop signs are installed as "nuisances" or "speed breakers," there is a high incidence of intentional violation. In those locations where vehicles do stop, the speed reduction is effective only in the immediate J vicinity of the stop sign, and fre- quently speeds are actually higher between intersections. For these reasons, stop signs should not be used as a speed control device. A school crossing may look dangerous for children causing parents to demand a stop sign to halt traffic. A vehicle which previously had a problem for the three seconds or so approaching and passing that intersection now has a problem for a much longer period of time. Both the vehicle and the pedestrian have a problem deciding when to cross or start up. There are no longer normal gaps in traffic through which pedestrians can safely cross. An intersection that previously was not busy now looks like a major intersection, even though it isn't. It doesn't even look safer, and it usually isn't. Most drivers are reasonable and prudent, with no intention of violating traffic regulations. However when an unreasonable restriction is imposed. violations are more likely to occur. An unreasonable stop siorn can create a false sense of security in a pedes- trian and an attitude of contempt in a motorist. This can lead to tra,ic results. Well- developed. nationally recognized guidelines help to indicate when such controls become necessary. These guide- lines include: • probability of vehicles arriving at an intersection at the same time; • length of time traffic must wait to enter; and • availability of safe crossing opportunities. This article was written by George Calebaugh, Brooklyn Park Traffic Engineer Attachment 2 TO P 4 -WAY R1 -1 RI-3 R1-4 30" x 30" 12" x 6" 18" x 6" 2B -4 Stop Sign (R1 -1) STOP signs are intended for use where traffic is required to stop. The STOP sign shall be an octagon with white message and border on a red background. The standard size shall be 30 x 30 inches. Where greater emphasis or visibility is required, a larger size is recommended. On low - volume local streets and secondary roads with low approach speeds, a 24 X 24 inch size may be used. At a multiway stop intersection (sec. 2B -6), a supplementary plate (Rl -3) should be mounted just below each STOP sign. If the number of approach legs to the intersection is three or more, the numeral on the supplementary plate shall correspond to the actual number of legs, or the legend ALL -WAY (R1 -4) may be used. The supplementary plate shall have white letters on a red background and shall have a standard size of 12 X 6 inches (R1 -3) or 18 x 6 inches (R1 -4). A STOP sign beacon or beacons may be used in conjunction with a STOP sign as described in section 4E -4. Secondary messages shall not be used on STOP sign faces. Ix 2B -5 Warrants for Stop Sign Because the STOP sign causes a substantial inconvenience to motorists, it should be used only where warranted. A STOP sign may be warranted at an intersection where one or more of the following conditions exist: 1. Intersection of a less important road with a main road where application of the normal right -of -way rule is unduly hazardous. 2. Street entering a through highway or street. 3. Unsignalized intersection in a signalized area. 4. Other intersections where a combination of high speed, restricted view, and serious accident record indicates a need for control by the STOP sign. Prior to the application of these warrants, consideration should be given to less restrictive measures, such as the YIELD sign (2B -7) where a full 11 -4. -) Rev. 3 Rev. 9184 2B -2 Attachment 3 stop is not necessary at all times. Periodic reviews of existing installations 11 -48 (c) may be desirable to determine whether, because of changed conditions, Rev. 3 the use of less restrictive control or no control could accommodate traffic demands safely and more effectively. STOP signs should never be used on the through roadways of expressways. Properly designed expressway interchanges provide for the continuous flow of traffic, making STOP signs unnessary even on the entering roadways. Where at -grade intersections are temporarily justified for local traffic in sparsely populated areas, STOP signs should be used on the entering roadways to protect the through traffic. STOP signs may also be required at the end of diverging roadways at the intersection with other highways not designed as expressways. In most of these cases. the speeds will not warrant any great increase in the sign sizes. STOP signs shall not be erected at intersections where traffic control signals are operating. The conflicting commands of two types of control devices are confusing. If traffic is required to stop when the operation of the stop- and -go signals is not warranted, the signals should be put on flashing operation with the red flashing light facing the traffic that must stop. Where two main highways intersect, the STOP sign or signs should normally be posted on the minor street to stop the lesser flow of traffic. Traffic engineering studies, however, may justify a decision to install a STOP sign or signs on the major street, as at a three -way intersection where safety considerations may justify stopping the greater flow of traffic to permit a left- turning movement. STOP signs may be used at selected railroad- highway grade crossings only after their need has been determined by a detailed traffic engineering R�ev.2 study. Use of the STOP sign at railroad- highway grade crossings is described in Section 8B -9. Portable or part-time STOP signs shall not be used except for emergency purposes. Also, STOP signs should not be used for speed control. ; 2B -6 Muldway Stop Signs The " Multiway Stop" installation is useful as a safety measure at some locations. It should ordinarily be used only where the volume of traffic on the intersecting roads is approximately equal. A traffic control signal is more satisfactory for an intersection with a heavy volume of traffic. Any of the following conditions may warrant a multiway STOP sign installation (sec. 2B-4): 1. Where traffic signals are warranted and urgently needed, the multiway stop is an interim measure that can be installed quickly to control traffic while arrangements are being made for the signal installation. 25 -3 Rev. 9184 2. An accident problem, as indicated by five or more reported accidents of a type susceptible of correction by a multiway stop installation in a 12 -month period. Such accidents include right- and left -turn collisions as well as right -angle collisions. 3. Minimum traffic volumes: (a) The total vehicular volume entering the intersection from all approaches must average at least 500 vehicles per hour for any 8 hours of an average day, and (b) The combined vehicular and pedestrian volume from the minor street or highway must average at least 200 units per hour for the same 8 hours, with an average delay to minor street vehicular traffic of at least 30 seconds per vehicle during the maximum hour, but (c) When the 85- percentile approach speed of the major street traffic exceeds 40 miles per hour, the minimum vehicular volume warrant is 70 percent of the above requirements. 2B -7 Yield Sig n (R1-2) The YIELD sign assigns right -of -way to traffic on certain approaches to an intersection. Vehicles controlled by a YIELD sign need stop only when necessary to avoid interference with other traffic that is given the right -of- way. The YIELD sign shall be a downward pointing, equilateral triangle having a red border band and a white interior and the word YIELD in red inside the border band. The standard size shall be 36 x 36 x 36 inches. 2B -8 Warrants for Yield Signs The YIELD sign may be warranted: 1. At the entrance to an intersection where it is necessary to assign 1 11_37 (c) right -of -way and where the safe approach speed on the entrance exceeds Rev. 5 10 miles per hour. 2. I recently purchased a home on Oak Leaf Trail in the Shorewood Oaks development and have found cut- through traffic on Oak Leaf Trail a serious health risk to my family. I believe many individuals use Oak Leaf Trail to access Strawberry Lane and Smithtown Road from Hwy. 7. Without sidewalks my children often. use the street to ride their bicycles, rollerblade and traverse to friends households. An additional stop sign on Shorewood Oaks will deter traffic from Shorewood Oaks and most likely divert the cut -cut through traffic onto Oak Leaf Trail where there is no impediment to through traffic. I have no objection to an additional stop sign on Shorewood Oaks provided significant measures are taken to slow traffic on Oak Leaf Trail as well. Ideally, I would like to see Oak Leaf Trail closed entirely to through traffic. Short of that I believe speed bumps could be placed strategically to reduce the speed of traffic. My understanding is that there are certain neighborhoods in Minneapolis where this is being used effectively. My family owns property in Iowa were speed bumps are extremely useful in keeping traffic slow enough to allow my children to pursue an occasional errant basketball rebound or foul baseball. I noticed you have placed the strip to count traffic on Shorewood Oaks. I would suggest you place a strip to see exactly how much cut - through traffic there is on Oak Leaf Trail. Measure Oak Leaf Trail when Strawberry Lane is closed for resurfacing and then again once school is open and you should have the accurate information you need to make an informed decision. Lastly I would suggest policing the speed limit during high traffic times. We are excited to be residents of Shorewood and especially looking forward to raising our children in the Shorewood Oaks. The access to parks and trails is fantastic! Please help us to keep our children safe on the neighborhood streets by providing us with the tools to eliminate unnecessary traffic. Stop signs have been placed at intersections with dead -end streets that have 5 or 6 houses on them. It seems incredible that traffic from a dead -end street is high enough to warrant stopping the through traffic. Mention was made of a vehicle speed problem on Shorewood Oaks Drive. This issue was raised a few years ago and traffic studies of Shorewood Oaks Dr. showed there was not a speed problem. Stop signs are not speed control devices and MNDOT, I'm told, does not recommend them for speed control. A previous Council stated that the stop signs were placed for "safety ". If that is truly the case why don't we have stop signs at every intersection throughout Shorewood? Please consider the facts traffic studies, engineers, and Police present and make decisions that are realistic -- not emotional. These facts were rebuffed by the previous council which placed some of the stop signs that presently are on Shorewood Oaks Dr. a few weeks before an election (effectively making them "campaign signs ") I encourage you to base your decisions on all the traffic flow design conditions related to the overall needs of all of Shorewood -- not just an isolated vocal few residents. I'm calling about the meeting that is going to be held tonight and I'm not sure if I'm going to be able to make it regarding the stop signs in our neighbor. I feel very strong about this, I totally oppose to making any changes to where the stop signs are placed. I feel its only going to increase traffic on our street. We have a lot of children on our street, small children. I believe one solution to consider for the problem we have in the neighborhood with traffic is to just lower the speed limit to 20 -25 miles instead of 30. I cannot attend the July 27th council meeting but wanted to make my opinion known. I very much oppose putting a stop sign at Maple Leaf intersection. Here are my reasons, in order of importance: 1) As a resident of Oak Leaf Trail (which intersects with Shorewood Oaks Drive), I believe leaving the stop sign at the Oak Leaf Trail intersection divides the traffic more evenly between Shorewood Oaks Drive and Oak Leaf Circle. As I recall, the previous council had traffic wunis which validated this. When the stop sign was positioned at the Maple Leaf Circle intersection, there were two stop signs on Shorewood Oaks drive uAd Only One stop sign on Oak Leaf Trail. This caused the majority of travelers to choose the road with the least amount of stop signs, Oak Leaf Trail. Once the sign was moved to the Oak Leaf Trail intersection, traffic was much more evenly divided between the two roads. If you move the current Oak Leaf Trail stop sign down to Maple Leaf or if you add another stop sign to Maple Leaf, this will put more signs on Shorewood Oaks Drive and once again drive an uneven amount of traffic down Oak Leaf Trail, 2) In my opinion, it makes sense to leave the stop sign at the Oak Leaf Trail intersection. This intersects with a major road rather than a cuddle -sac. I believe a major road requires more control than a cuddle -sac intersection. 3) The distance from the current stop sign on Oak Leaf Trail to Maple Leaf Circle is very short ... only a half block. I do not think traffic gains significant speed in half a block to justify negating the two issues above. I'd be happy to discuss this in person, if necessary. I am calling in response to the City Council meeting notice regarding the Shorewood Oaks area where we would like to replace the stop sign at Shorewood Oaks Drive and Maple Leaf Circle. I am definitely for that. We have I believe on that cul -de -sac alone, probably over 15 children. People race through here rather quickly and I know there was a stop sign there before that was placed through all the normal legal channels and it was removed very quietly, which wasn't a very good way to do it. I don't know exactly the details on how that happened. I do know that people that live along there and inside that cul -de -sac would appreciate having that put back. I live in the next cul -de -sac over where there is a stop sign and I know it does make a difference — having that area broken up so people don't speed. So I guess that's it. I appreciate your letting me voice my opinion. Hi, my name is Delores Mullenbach, and I live at 5840 Strawberry Lane in Shorewood and I have several comments in regards to the stop signs that Shorewood Oaks wants again. I have lived in Shorewood for 31 years, all on Strawberry Lane, and most of the time on the corner of Smithtown and Strawberry. All of us with young children at that time taught our children not to go out into the street — streets are for cars. Many, many times I have noticed children playing on the streets in Shorewood Oaks, driving plastic bikes, very small children, playing hockey, children playing baseball in the middle of the street. Many times with parents watching and glaring at passing motorists. Instead of stop signs, please educate those people about the dangers of cars and children. I can't understand why they don't feel their children are important. They do have a park adjacent to many of those houses — why not use it? I am very grateful for you listening to me. First off I am all for the stop sign, it needs one this is a street where kids play on way too much for people to be cross - commuting on. Secondly, I know the stop sign is "unenforceable" which is a joke really, if I found all the "unenforceable" stop signs around could I really go run them all and maybe hit someone and not be at fault ? ? ?? I should hope not. Anyway if you do put this stop sign in you had better put one where we actually really need one, and the intersection of Strawberry lane and Shorewood oaks drive (obviously the stop sign would go on Strawberry lane) . Comming from shorewood Oaks drive it is hard to see the traffic from the right due to some trees etc ... and the cars come way too fast down Strawberry to see them. I would like to know how many people I need to rally behind me to get one here, if a stop sign goes up on Maple leaf you had better seriously consider one on Strawberry because it is the same argument for both signs. At that time he stated that the moving of the stop signs to the westerly intersection of Shorewood Oaks Drive and Oak Leaf Trail is recommended even though neither location meets warrants. His only concern was that at some point in time there would be a request for a stop sign at both intersections. I checked with Jim Schmidt, Transportation Coordinator with the Minnetonka School District, about the statement in the petition that "because of the removal of a stop sign, the middle school bus will not stop at Maple Leaf Circle to pickup or discharge students." He says the location of the stop signs in no way affect the location of bus stops. The school buses are in fact their own traffic control device. Their written criteria is based upon distances. If Maple Leaf Circle parents are concerned about a change in school bus pickup location, they should in fact talk with Jim Schmidt. Hurm, City Administrator Date: July 8, 1998 Re: Maple Leaf Circle Stop Sign Request I talked with John Swanson to explain that I was bringing the petition before the City Council to discuss the request about not notifying neighbors about the meeting. He stated he doesn't really have a problem with notifying neighbors, it is just that there was no notification some years ago when the stop sign was removed. He further indicated that he would not be here on July 27 and would prefer that the item be placed on the August 10 City Council meeting for action. Background In 1995 Councilmember McCarty indicated to the City Council that she had been approached by a number of Shorewood Oaks residents about moving the stop signs on Shorewood Oaks Drive at Maple Leaf Circle to Shorewood Oaks Drive intersection with Oak Leaf Trail. Staff stated at that time that stop signs are not warranted at either intersection, but if a stop sign were to be placed, a Shorewood Oaks /Oak Leaf Trail intersection is more appropriate because Maple Leaf Circle is a short cul -de -sac. The Council authorized the move. The Council then received a petition requesting that the stop sign be replaced at Maple Leaf Circle. Residents were notified and the Council debated the issue with some residents present. The stop sign was not reinstated. Recommendation: The item should be placed on the August 10 City Council agenda so that the petitioner John Swanson can be present and that a notice go out to those residences that had been notified in 1995, which includes an area beyond the Shorewood Oaks subdivision. REGULAR CITY COUNCIL MINUTES July 24, 199 - PAGE 6 ® Mr. Carlson stated he felt there should be one fee for one type of use. The fee should be the same for everyone whether they have been in the City or not. He indicated other cities charge so much per linear foot. He felt the Council should investigate what other cities do. Mayor Bean explained the City created a water assessment task force which consisted of the five Councilmembers, Staff and four citizens who were approached and requested to participate. He indicated the formula was derived after hours of debate. He indicated the developers may have to pay initially but ultimately the homeowners pav the assessments. The new homeowners will be able to spread this fee into a 30 year mortgage but the existing homeowners cannot. He explained the concern with the front footage formula is that it would lead to development. He indicated the Council is trying to stay as development neutral as possible. Councilmember Benson excused himself from the meeting at 9:28 p.m. Mayor Bean recessed the meeting at 9:28 p.m. and reconvened the meeting at 9:35 p.m. Mr. Bill Diem, 5755 Smithtown Circle, commended the City Council for their diligence. He indicated he thought the progress was necessary. He noted the sewer Going to commercial property was six inches in comparison to the line of one inch going to r properties. He stated he works for a design builder and S5,000 was not an unreasonable assessment. He stated he felt it would be ludicrous to postpone the project. He also indicated there was a law soon to be placed before the City Council which would require mandatory fire protection. If the City was forced to put the water in then, it could result in the loss of competitive bidding. Mr. Diem indicated there were many residents who wished to prepay the assessment but it may be more fair to allow them more than thirty days to do so. • Keane indicated the State Statute does not allow the City much flexibility with regard to the payment of the assessments. McCarty moved, Malam seconded to continue the public hearing for public improvements and assessments for the water improvements to Tuesday, July 25, 1995 at 7:30 p.m. The motion passed 4/0. 7. Councilperson McCarty has been approached by some Shorewood Oaks residents suggesting that the Maple Leaf Circle stop signs be moved westerly to the west intersection of Oak Leaf Trail and Shorewood Oaks Drive. The feeling is that this intersection would serve a greater purpose for stop signs than Maple Leaf Circle because Maple Leaf Circle is a short cul -de -sac where Oak Leaf Trail is a thru street. The original location of the stop sign was on Shorewood Oaks Drive at the intersection of Maple Leaf Circle, where it has been for approximately three years. It has been moved to a new location on Shorewood Oaks Drive at the intersection of Oak Leaf Trail. Actually, most residents in the neighborhood were not even aware that this proposal was before the City Council. Originally the Shorewood Oaks neighborhood began the long process of procuring stop signs at its two cul -de -sacs back in 1991. After several City Council meetings and a petition of signatures from virtually the entire neighborhood, the Council agreed to place stop signs as proposed at the two cul -de -sac locations. This decision was well received by the neighborhood and has not been a point of contention since their placement three years ago. Needless to say, the neighborhood was perplexed to discover this unexpected and unwarranted change in the location of the stop signs. We regret that the city Council would have to be involved in this dispute. But it is important to note that we, the majority of the Shorewood Oaks neighborhood, as well as the City Council were victims of misrepresentation regarding the removal of the stop signs that have served our neighborhood effectively for three years. Therefore, we respectfully ask that the Council return the stop signs to the original location on Shorewood Oaks Drive and Maple Leaf Circle, which were previously established by the Shorewood City Council and supported by the vast majority of Shorewood Oaks residents. I came home one day and the stop sign was gone. I said to my wife (Kathie), "someone stole the stop signs." Kathie then told me that the city had removed the signs. I had never heard that the stop signs were on the agenda to be removed or I would have come to you sooner. There are 20 children directly affected by the safety of these signs, not to mention many other children who play on Maple Leaf Circle, but don't live there. Hurm explained in 1991 the issue was raised regarding traffic control, speed and safety of cars driving through this neighborhood on Shorewood Oaks Drive. He explained there was a series of meetings, a number of reports, a speed study was requested and several options were considered. Initially staff did not recommend a stop sign but City Council installed stop signs at the intersection of Burlwood Court and Shorewood Oaks Drive and the intersection of Maple Leaf Circle and Shorewood Oaks Drive. Hurm stated during the interim a number of new homes have been built on Oak Leaf Trail. Staff has now recommended the stop signs on Shorewood Oaks Drive be moved west to Oak Leaf Trail. This was recommended due to the increased number of homes on Oak Leaf Trail, the short distance between stop signs and the Chief of Police and City Engineers opinion that the change will bring the stop signs closer to meeting the traffic control warrants. Hurm reported there is now a petition before the City Council to replace the stop signs to their original location. He indicated the City had not fulfilled their responsibility to notify the residents in the area of the change. He reported Catherine Dales, 26085 Oak Leaf Trail, had called the City today to ask that her name be removed from the petition. • Councilmember McCarty noted she had talked with residents on Oak Leaf Trail and two of the six who had signed the petition had asked to have their names removed, Catherine Dale and Gela Kantro, 26205 Oak Leaf Trail. She indicated she should have notified more of the neighborhood of the change. She stated she had been asked by residents to address this issue and had taken into account the safety of the entire neighborhood. She questioned if the suggestion for curve signs on Shorewood Oaks Drive and Oak Leaf Trail, with recommended reduced speeds, was a valid option. Councilmember Stover reported in 1991 there was discussion regarding the curve and reduced speed signs but they were discouraged because the suggested speed was not enforceable but only recommended. It was also suggested the signs may only detract the driver's vision. She indicated in 1991 there was a lot of discussion and much written information provided that is not included in the Council meeting minutes. She stated the Council was strongly encouraged by the professional staff involved, to choose only two spots for the stop signs to be placed. Guadalupe Pfaff, 6075 Maple Leaf Circle, stated that three weeks ago, stop signs were moved in . the Shorewood Oaks neighborhood without any notification to the residents. She asked who had made the recommendation to remove stop signs after three years. She stated the number of children in the neighborhood has grown from 78 to 130. She believed the neighborhood needed more safety measures rather than less. Councilmember McCarty stated she had been asked by residents to investigate if the stop signs were in the most appropriate location. Hurm explained that the Police Chief states in his memo that the new location of the stop signs comes much closer to meeting the uniform traffic control warrants. Ms. Pfaff stated it appeared the Police Chief was against the stop signs originally. She stated Shorewood Oaks Drive is used as a cut through and there are many small children in the area. She asked if the speed limit could be reduced. She stated the neighborhood needs more safety measures installed rather than removed. Hurm explained stop signs are not recommended as speed control devices. He stated the best speed control device was to have a police officer in the area more often. REGULAR CITY COUNCIL MINUTES August 14, 1995 - PAGE 7 Ms. Pfaff disagreed. She stated with the stop signs moved, traffic is flying by her home at high speeds. Councilmember Malam indicated when the speed study was performed in 1991, the recorded average speed was 30 miles per hour. Ms. Pfaff asked why the City took away what stop signs the neighborhood had. She indicated with the new developments in the area there was much more traffic. She indicated 50% of the residents in the neighborhood signed the petition. Councilmember McCarty stated the stop signs had not been taken away but rather had only been moved down two houses. She stated it was equitable to have two stop signs on Shorewood Oaks Drive and two stop signs on Oak Leaf Trail. Ms. Pfaff again indicated there had been increased speeding since the stop signs were moved. She indicated it was not good government the way the stop signs were removed and she felt there was no actual basis for their removal. She stated that first and foremost the speed limit in the area needs to be reduced. • Mayor Bean stated the Council is very concerned with the safety of the children in the streets of Shorewood but Minnesota Statute states that 30 miles per hour is the lowest enforceable speed limit. Councilmember Stover noted the City cannot lower the speed limit without State authority. If the City did, the speed limit would not be enforceable. She explained the State determines the speed limit based upon the construction of the street, the side vision, etc. Mayor Bean stated the speed limit on this street was not the issue before the Council tonight. The issue was would moving the signs bring a balance in traffic control. Ms. Pfaff asked if the City had completed a study that showed the new location of the stop signs would be more effective than the previous location and why an additional stop sign could not be added. Mayor Bean stated the decision was based on the feelings and experience of the South Lake Police • Department and a significant volume of information from MNDOT. He indicated there should not be two stop signs in such close proximity of one another. Mayor Bean explained the City had to work within constraints of the State Legislature. He urged Ms. Pfaff to contact her State Legislators and urge them to give the authority to set speed limits to the local government. Councilmember McCarty suggested the stop signs be left where they presently are and the issue tabled for three months. Councilmember Stover agreed, indicating during that period of time, a police officer could be requested to be in the area more often and record data to be compared with data acquired when the stop signs were in their previous location. A decision would then be made if the stop signs would stay where they are currently located or moved back to their previous location. Mayor Bean suggested a traffic counter also be placed at each of the intersections. Mayor Bean suggested the State could also be asked to come and evaluate the speed study again. Tom Rendos, 6040 Maple Leaf Circle, suggested this study be performed but then the stop sign be replaced to its previous location and another study be performed. He felt this would show if the stop sign actually did split the traffic. Councilmember Stover indicated the City already had data from the previous location of the stop signs. He added residents in favor of moving the stop signs should be in attendance at the meeting. Mayor Bean recessed the meeting at 9:36 p.m. and reconvened at 9:38 p.m. Mr. Swanson indicated he did not want to see the neighbors at odds with each other. He stated Oak Leaf Trail was a winding road and there was not as much likelihood of speeding on that road. He asked that the stop sign be replaced to its previous location and the study performed at that time. Bean moved, Benson seconded to table the issue of replacing the stop sign at Maple Leaf Drive until November 13, 1995. Motion passed 510. McCarty moved, Benson seconded to request the State of Minnesota perform a speed evaluation throughout the Shorewood Oaks neighborhood, specifically Shorewood Oaks Drive and Oak Leaf Trail. Motion passed 510. The Council directed staff to request the Shorewood Lakes Police Department to establish a monitor in the Shorewood Oaks neighborhood with a mechanic traffic counter. Mr. Kurt Pfaff, 6075 Maple Leaf Circle, expressed his concern that the study be based on objective data rather than subjective data. He suggested if the monitors were visible, it may affect the results. Mayor Bean recessed the meeting at 9:52 p.m. and reconvened at 10:00 p.m. 8. As you may be aware, in 1991 a petition was received by the City Council which requested additional stop si-r* in the area, a reduction of the speed limit to 15 mph, and installation of "Slow Children at Play" signs. In response to this petition and following a speed study in the area, MNDot reported "we recommend continued reliance on Minnesota's statutory 30 mph urban district speed limit ". They also recommended the Slow Children signs not be posted. City staff recommended against placement of stop signs as requested because they did not meet stop sign criteria. Following review of the data collected at that time, the City Council directed installation of stop signs at the intersection of Maple Leaf Circle and Burlwood Court with Shorewood Oaks Drive. In June of this year, City staff was directed by the Council to determine if the stop sign at the Maple Leaf Circle intersection could more closely meet warrants by moving it westerly to the intersection of Oak Leaf Trail, which is now fully developed with new homes. It was determined that while neither location meets warrants for a stop sign, the Oak Leaf Trail intersection more closely meets those warrants. The Council's goal is to reduce speed by more visibility and traffic enforcement by police, and to have Shorewood Oaks Drive and Oak Leaf Trail share as equally as possible in traffic volume. The City also acknowledges poor communication on our part before action affecting the entire neighborhood was taken. Following the moving of the signs, several area residents contacted City Hall to inquire about the change in location, and a petition was presented to the City Council requesting that the stop sign removed from the corner Maple Leaf Circle and Shorewood Oaks Drive be reinstated. In response, City Council has directed the following actions: • Table the issue of replacing the stop sign at Maple Leaf Circle until November 13, 1995; • Request a speed evaluation from the State of Minnesota; • Request additional monitoring from the Police Department; and • Use mechanical traffic counters in the area for the collection of data. We discussed a possible provision that would allow, perhaps by conditional use permit, an accessory building to remain on a vacant lot as long as the owner owned the lot immediately adjacent to it, and the adjacent lot had a principal structure on it. • The City Attorney and I met later to discuss this matter and have an alternative to suggest. We propose that the Building Official simply condemn the building, allowing the Fire Department to burn it down, leaving the accessory building in place. Ordinarily condemnation is approached very cautiously, but the Hermans are willing to sign a consent to the condemnation, stating that they will not object to the order. Not only will this expedite the process and eliminate the need to amend the Code, but it will save the Hermans the application fees related to a text amendment and conditional use permit. The documents necessary for this "friendly condemnation" are attached for your review and approval. Staff recommends this approach over amending the Code for this somewhat unique situation. Pursuant to the foregoing findings and in accordance with Minnesota Statutes Sections 463.15 tot 463.261, the Council hereby orders the record owners of the above - hazardous building to repair and make such building safe and not detrimental to the public health, welfare and safety by bringing the building into conformance with all applicable building codes. Either such repairs shall be completed within twenty (20) days of the date of the service of this Order or the building shall be razed or removed after that date. 3.) The Council further orders that unless such corrective action is taken or an answer is served upon the City of Shorewood and filed in the office of the Clerk of District Court of Hennepin County, Minnesota within twenty (20) days from the date of the service of this order, a motion for summary enforcement of this order will be made to the District court of Hennepin County. 4.) The Council further orders that if the City is compelled to take any corrective action herein, all necessary costs expended by the City will be assessed against the real estate concerned and collected in accordance with Minnesota Statutes Section 463.22. 5.) Montgomery has managed his own consulting practice since 1971. Previous to that time he held positions of increasing responsibility with Motorola, Inc. and Motorola Communications-and Electronics, Inc. in home office and field locations. Montgomery is a member of the Institute of Electrical and Electronic Engineers (IEEE) and the Professional Group on Vehicular Technology of the IEEE. He is a member of the Associated Public Safety Communications Officers (APCO) organization. Montgomery's activities are centered on large and complex radio and microwave communication systems for departments and agencies at the municipal, county, and state level, plus electric utility load control, SCADA, emergency medical communications, and public safety systems. These projects have variously used 9 -1 -1 and enhanced 9 -1 -1 telephone systems, 800 MHz conventional and tnmked radio, receiver voting, automatic selection of the most favorably situated transmitter for radio communications in rural areas, telemetry, mobile data terminals, and voice scrambling. Montgomery has planned, specified, and implemented both multi- department and multi jurisdictional dispatch centers for public safety providers. He has developed and implemented plans for inter- agency communications, statewide frequency coordination, master planning, and project manage- ment. ,s JEFFREY NELSON Jeff Nelson is a graduate of the University of Illinois holding a B.A. in Administration. He is also a graduate of the Minnesota Management Academy (a residency program of the graduate school of management) of the University of Minnesota. He is engaged in continuous technical training through course work via manufacturer's seminars, independent engineering training forums, and at the College of Engineering, University of Wisconsin. He has a continuing educational interest in radio frequency (RF) propagation and radio system design. He previously worked in the two -way radio repair service business while pursuing his undergraduate degreee and subsequently worked in municipal law enforcement in Illinois. Nelson returned to communications and held positions of increasing management responsibility over two decades. Nelson served for four years on the board of officers of the 300 + member Minnesota chapter of IV APCO and was appointed to the NPSPAC Region 22 Planning Committee created by the FCC_ APCO is a national professional organization which routinely lobbies the FCC and Congress on radio communications issues. The Region 22 NPSPAC Committee developed a Minnesota frequency utilization plan for public sector radio frequencies in the 806 -821 mHz spectrum. Nelson served for twelve (12) years in the appointed service of Minneapolis city government as a senior executive in the Department of Emergency Communications. While at Minneapolis he received the police department chiefs award of merit, the Excelebrate award from the mayor's office, and a city council resolution honoring his excellence in service, planning, and operations. Nelson has performed a variety of project oversight roles in both his government and consulting career. Nelson has provided consulting services since 1985 to government clients in Illinois, Iowa, Minnesota, Michigan, North & South Dakota, and Wisconsin. With increased mandatory state requirements, an amazing increase in walk in and telephone requests and the increase in police calls, much additional work is required in the office. The part time positions are essential to accomplish the necessary and required job tasks. There are two of these positions. This category also includes the Excelsior Park Patrol. A revenue is shown under anticipated income for the Park Patrol. 13- Professional Services $6,000 • This account covers the audit required by state statutes, physical and psychological exams and all legal services that are required by the department. New hires payroll service is being anticipated for 1999 to ease office workload. 20- Communications $6,000 This account covers all costs associated with necessary radio communications equipment required by the department. This line item has decreased in the recent past due to the amortization of the portables, mobiles and MDT's over this time period. 21- Printing & Publishing $4,500 This section covers all correspondence and necessary report keeping functions. Expected expenses in this category include stationery, envelopes, report forms, warning citations, legal and professional publications. New or changed state and federal reporting requirements always necessitate new forms. 22- Utilities $15,655 This account covers all utilities. Rate increases are expected. 23- Travel, Conferences & Schools $9,000 This account covers all departmental training programs. The cost of training is expensive; however, litigation is much more so. It is imperative that we continue to provide the best possible training for our personnel. Recent State and federal mandated training require additional expenditures. This line item also covers local meeting costs and parking fees for court, etc. The costs of training are rising along with mandates for more training. 24- Maintenance $17,000 Funds disbursed from this category provide for the maintenance of departmental equipment. All automotive repairs, along with office equipment and departmental radio service, are covered in this • classification. Radar units require scheduled calibration and are paid for from this account. Maintenance contracts on the typewriters and computers are in this category. Copy machine maintenance is now covered as part of rent and is in that line item. 27 -Care of Persons $100 This account covers care of prisoners. 28- Cleaning and Waste Removal $6,400 This category covers all janitorial services and waste removal. 30- Office Supplies $3,750 This section covers all necessary office supplies for maintaining the operation. It also includes all postage expenses. 33 -Motor Fuels $17,000 This portion of the budget covers all fuels and lubricants for the department's vehicles. Gasoline prices are currently increasing, and past experience shows an increase is warranted. 37- Uniforms $6,400 This line item covers replacement of the required uniform for all department personnel. The costs of uniform equipment have been escalating each year. A new hire will cause an increase. 39- General Supplies $12,400 This category includes all items of a general nature required by the department. It includes ammunition, tires, first aid supplies, small tools, vehicle supplies and any and all items required for the general operation of the department. State mandates on firearms training are driving this increase along with the increased cost of ammunition. 40 -Rent $44,500 This item covers the rent of the building. Also in this category are rents for the state CRT, Postage Meter, etc. The copy machine is now in this category causing the increase. 41- Insurance $43,000 Covered in this section is the insurance protection for: worker's compensation, general liability, automobile and professional liability. This amount will be transferred to the Insurance Fund. The worker's compensation has again been reduced significantly from last year. 43- Subscriptions & Memberships $850 This area includes subscriptions to professional and legal journals. Memberships in area and national professional organizations are also taken from this category. 45- Pensions & Benefits $152,000.00 • This line item is for hospital and life insurance, PERA and Social Security. The expected State Aid funding is shown as a revenue. 48- Special Projects $9,600 This section covers the required cash match for the federal drug enforcement grant administered through the state. This is the Southwest Metro Task Force made up of eight police agencies in this area. It also covers the departments fee to use ComerHouse, a child sexual abuse center. 51- Building Expense $2,000 This category covers any and all necessary expenditures for building repair. As the building ages, we have found the costs going up. 52- Furniture & Equipment Repair $5,000 This line item of the budget is to replace items that become inoperable. Replacement computer equipment that breaks down is always a large expense. 53- Vehicles $57,500 This includes the expenses involved in preparing the new cars for police service. This budget item reflects the current costs for 2 1/2 vehicles. In each budget year 2 1/2 cars are budgeted. Every other year we need to replace three vehicles, instead of two, in order to maintain the fleet and avoid costly repairs and reduced resale values. Vehicles have risen in price dramatically. The dealers have stated that next years police vehicles will cost in excess of $21,500. We have started keeping the vehicles in service longer, when possible. We shall continue that practice next year. 54- Furniture and Equipment Fund $7,000 This will be used for the purchase or new or replacement equipment. INCOME State Aid $78,000 This is a slight increase from last year. Transfer to Contingency $20,000 In past years, $15,000 to $20,000 was not an unusual amount to be taken from the contingency fund to offset the budget. However, this fund has been reduced and $10,000 is a more appropriate amount. The transfer budgeted, when combined with the $10,000 should cover the cost of wage increases in 1999. ,0 Shorewood $69,301.98 This is the funds necessary to cover the costs for the Shorewood Community Policing Officer. Interest $11,000 This years amount is based upon performance during the 1997 and 1998 budget years. Minnetonka School District $6,800 The Minnetonka School District provides these funds for police liaison and education services in the schools. • Park Patrol $8,000 This is a reimbursement from the City of Excelsior for costs of the Park Patrol. Expenditures of a like amount are budgeted under Salaries - Part Time. Court Overtime $7,800 It is impossible to accurately budget this very variable item. This should cover the expense. Civil Defense $4,000 This item has been consistent for the past several years. I do not expect any change. In order to receive this money, certain training requirements must be met. Training $4,000 After an increase in 1990, the state legislature has been taking away this money for other purposes, including to help the general fund. Exact amounts to be received are unknown. Sale of Vehicles $10,000 This category reflects the sale of two vehicles. Accident Reports $600 This is an average of the past several years. It is recommended that the City Council accept these quotes and authorize the purchase of the merchandise and services contained therein. It is necessary to address this area at this time as the financial system will not be year 2000 compliant. The current system utilized in the Finance Department has been in place since 1990. The proposed acquisitions include upgrading our financial software from our current applications to a more flexible, Windows - compatible product offered by our current software company, Computer Management Services. Governmental finance software is a very specialized application and we feel that CMS offers the best solution for our purposes. CMS has been a vendor in this market a long time and has a proven track record. Our experience with CMS has shown them to be a very customer oriented, support-based company. They are very competitive in the government software market. CMS is also a prominent vendor in this area, with new installations in Chanhassen, Chaska, Lino Lakes, Cottage Grove and other cities, as well as servicing Shorewood and other existing customers in the metro area and greater Minnesota area. CMS is also the largest vendor of governmental finance software in Iowa, and serves municipal customers in Wisconsin, North and South Dakota, Illinois and several other states. The hardware acquisitions include the replacement of our current PC server with a new Dell Windows/NT server. The new server will be the file server for financial applications as well as planning, engineering and general office applications. The current server will be utilized as a workstation in the Finance Department along with the purchase of a second Dell PC workstation. In addition, a 23 page- per - minute Hewlett - Packard Laser Printer will be utilized for printing utility billings and preparing payroll and vendor payments. Message on the Shoreline Left on 7/29/98: Hi, I am a Shorewood resident, and I was wondering if it is possible for you to incorporate something in the next Citizen Informer regarding people using the trail and cars coming off Eureka Road. Within the last month of July, I have almost gotten hit close to six times either riding my bike or walking my dog. When I am coming on the trail toward Smithtown and there is a car or some vehicle coming off of Eureka Road, very seldom they don't stop nor do they look to see if there are trail walkers or bikers coming. And even if you do stop and they stop, they tend not to give the walker or biker the right -of -way. They tend to think we're bigger so we will just go ahead. On several occasions I have almost gotten hit where people have had to slam on their breaks when people weren't paying attention or they chose not to look. They just look to see who is coming up and down Smithtown. So I think to alleviate some future accidents it might be nice to comment a little bit for motorists to keep an eye out for people using the trail so that nobody gets hurt in the future. Thanks.
