The regular meeting of the Shorewood Planning Commission was held on Thurs-
day, February 13, 1974, at the Minnewashta Elementary School at 7:30 p.m.
The minutes of the December 19, 1974 meeting were approved as submitted.
1. PUBLIC HEARING - A public hearing was held on the preliminary plat
of Westwood Addition (Lot 19, Aud. Sub. 133, at Smithtown Road and Star
Lane). Bernard Eisenreich presented the preliminary plat and requested
that the planning commission recommend acceptance of it to the Council.
Vern Watten read a letter:lfrom Bernie Mittelsteadt, Village Engineer,
recommending five items regarding the cul de sacs, drainage of the in-
dividual lots, and a storm sewer problem at the inteF.section of Smithtown
Road and S~ar Lane. (See attached engineer's report). Discussion followed.
A motion to close the public hearing was made and seconded. The motion
carried unanimously.
Vern Watten moved to accept the Westwood Addition, preliminary plat based
on compliance with the five items included in the ~ngineer's report dated
February 13, 1975, and that an additional paper showing the solution to
item #5 be submitted by Mr. Eisenreich with the final plat. Motion second-
ed by Jerry Miller. The motion carried unanimously.
2. DISCUSSION An informal discussion was held by members of the plan-
ning commission relative to Resolution N~ 11-75 adopted by the Shorewood
Council on January 27, 1975, regarding the development of a Recreational
Zoning Ordinance for Shorewood. (The COuncil has requested that a rec-
ommendation be submitted to them within sixty days.) Bob Naegele, Jr,
was present to further,"l elaborate on the ideas behind the council' sre-
quest. He stated that the council wishes the planning commmissionto use
its experience in joining with the newly formedcPark Committee to form-
ulate a recreational land use plan for Shorewood. A map entitled ~Pro-
posed Land Use Plan - 1990", developed in past years, was=looked over and
the role of the village planner in this project was dts'C.ussed. It was
suggested that the planner be contacted and asked to give a projection of
his time and costs, as well as a tentative scheduling of procedure for
the project.
A special meeting of the planning commission with Dick Fredlund, Village
Planner, was proposed for Thursday, February 2~, 1975 at 7:30 p.m. at the
Minnewashta School. Frank Reese will contact Mr. Fredlund to request that
he prepare a preliminary dra.ft (rough study) for a "Recreational Zoning
Ordinance - City of Shorewood".
Jack Huttner was present and recommended that the planning commission con-
duct a two-part study; one on roadways and collector streets, one on the
recreational land use and zoning; and then tie the two into a working co-
ordinate.

on Thursday, April 17. The Shorewood Planning Oommission will hold
a meeting Thursday, April 24 at 16innewashta Elementary School at
7:30 P. M. On the agenda is continued discussion of the Recreational-
Residential District Zoning Amendment. All interested Council members
are encouraged to attend.
The meeting adjourned at 10:35 P. M.

Dear Frank:
Please accept my resignation as a member of the Shorewood
Planning Commission. Your letter of March 22 reminded me of how
poor my attendance has been. To be fair to you and to the successful
operation of the Planning Commission, the council should appoint
someone who can regularly attend the meetings.
One parting suggestion, if I may. In order to have a
better feel of whether you are actually going to have a quorum
or not, someone should call each member of the CommissiQn.
Requesting by letter that the member notify you if he cannot
attend is not a fool-proof method. On several occasions I have
returned from out of town trips after YOUI: meeting, to read your
letter requesting us to call if we could not attend. It is not
safe to assume that not calling us means the person is coming t,o
the meeting. A phone call is better. It will increase the work
load a bit but not too badly, as there are not that many members
nor meetings.
I have enjoyed the experience and hope I have made a
contribution during those meetings I did attend.

At the close of the discussion, five of the planning commission members
went out and inspected the proposed building site.
Generally the members felt that another building would have little or no
effect on the drainage of the area. However, no vote was taken.
The matter will be considered again at the regularly soheduled meeting on
May 8, 1975 provided that the requested information is presented by Mr.
Smith.
Also soheduled for the next meeting is further study of Residential-
ReoreationalZone ( R.R. Zone).

The regular meeting of the Shorewood planning Commission was held on Thursday,
June 12, 1975, at the Minnewashta Elementary School. The meeting was called to
order at 7:45 P.M.
The meeting went immediately into the current business of the public hearing
pursuant to the notic~ published to consider the request of Horace G. Murfin to
rezone the North 200 feet of Tract C, Registered Land Survey #160 (19425 Highway #7)
Mr. Murfin described the proposed plan of the Burger King to be built by Lambin
Construction on the property which now houses Vee Gee's Restaurant, with the ad-
ditional 200 feet of the property to be used for parking. Mr. Murfin discussed
archi tectual plans and also changing of the drainage system to drain to the front
rather than to the back, which, in his opinion would improve the now existing drain-
age problems.
Approximately 35 residents of the Shady Hills area were present and stated
their objections to the rezoning for the purpose of erecting a creation of Burger King~
Namely: creation of greater traffic problems, more drainage problems, late hour
noise and traffic congestion, car lights, food odors, etc.

Mr. Lambin gave a brief account of the proposed plan and how the drainage
problem would be revised so as to improve the existing problems. It was pointed
out by Mr. Reese that the area in question to be rezoned was for the parking accom-
modations and not the restaurant. A motion was made by Frank Reese to close the
hearing and that was seconded and carried unanimously.
Mr. Reese questioned if the Floral Shop located near the rezoning area would
have ample'parking space and the general consensus was that it would. After further
discussion by the Planning Commission pro and con on the proposal and how it would
best serve the Village, Mr. Watten ma~e a motion that no action be taken until
further input is provided by the Engineer, Planners, Attorney and also if possible
a current count on the volume of traffic on #7 in this area; and further that Mr.
Lambin be requested to redesign the parking expansion, if possible. Motion carried
unanimously.
DIVISION OF TRACT A-RLS 435

Mr. Earl Dorn and Earl J~hnson were present requestion permit to divide off
40,000 sq. ft. of Tract A, said Parcel to be divided to contain the existing house.
After further discussion, it was moved by ~ Abramson to recommend approval of
the division provided that the remaining portion of Tract A, approximately It acres,
be added to and developed with the remainder of Parcel G. of RLS #8. Motion was
seconded by Tore Gram and carried unanimously.

July 10, 1975, at Minnewashta Elementary School. The meeting was called to
order at 8:10 P. M.
The minutes of the June 2~, 1975 meeting were amended as follows:

Dr. Stephen Larson was present.
The P?nagraph containing the vote on the rezoning should be struck from the
record and amended by the following paragraph:

This was followed by individual opinions voiced by Planning Commission
members. Ed Abramson made a motion that the rezoning condition be made only
for a 100 feet of Tract C. This was seconded by Jerry Miller. The motion
was turned down by a vote of 4 to 2. Those voting aye were Ed Abramson and
Jerry Miller. Those votingnaye were Jane Cole, Tore Gram, Frank Reese and
Dr. Larson. Steve Larson moved to disapprove request for rezoning of R1 to
C3. F. Reese read resolution. (copy enclosed) Jane Cole seconded Dr. Larson's
motion. The motion in favor of not accepting resolution was passed by a vote
of 4 to 2. Those voting aye were Jane Cole, Tore Gram, Frank Reese and Dr...'r~arson.
Those voting naye were Ed Abramson and Jerry Miller.
Jane Cole made the motion to accept the minutes as amended and Jerry
Miller seconded the motion. Motion carried unanimously.

A motion recommending denial of the rezoning of

The reasons for denial were as follows:

4) The answer to just why the existing C-3 area wasn't
adequate for development was not convincing.
5) It was conceded that present use is not working well
and doesn't make sense, but a C-3 use on the northerly
part was a too different use next to a R-l area, maybe
a less intensive use would be proper.
A good deal of concern was expressed as to how this intended
use or the people involved in the eventual ownership seemed
to be involved in this hearing. These concerns are not ger-
mane to the rezoning, but could be if it were a planned unit
development or a conditional use. -

SUBJECT: MY REASONS FOR VOTING "YES" TO THE REZONING OF THE NORTHERLY 100 FEET
OF TRACT C, RLS 160 HENNEPIN COUNTY, MINNESOTA, FROM AN R-l ZONING TO
A C- 3 ZONING.
1. Tract C = Lot is not located properly for good access to be used as Residential
Property.
2. Tract A is an ideal location for a Fast Serve Food Business
A. Tract A which is a C-3 Zone would allow only a small parking area which
would create a greater traffic problem on the frontage road.
B. A larger C-3 Lot will attract a First Class Operation, like a "Burger
King".
Note: If we discourage good builders and businesses, we will lose future
growth in the right direction.
C. Rezoned Area will be used for parking which abuts one corner of Lot 14
and the back end of Lot 9.
A. The House on Lot 14 is over 300 feet away from edge of Rezoned Lot
Line.
B. Lot 9 has no home on it, but if one would be built, it would be
close to Nancy Lane. This means a hill would separate the house
from the parking area.
C. The other edge of the Rezoned Lot line abuts the balance of Tract C
which is l~l and over 200 feet to meet Lot 13. The balance of
Tract C, which is R-l, has many trees and the type of terrain that
makes it an ideal buffer zone.
3. The Land lIse Plan that was adopted was an excellent Plan, but it must be used
as a guide line for future growth. Some areas will change as our Village
grows, and if we say "No" to all proposals now, we will be forced into changes
in the future that are not desireable. Every City needs businesses as well as
planned residential areas, for the following reasons:
1.
A better Tax Base.
2.
Service to our Residents.
3.
A better Community atmosphere.
Many Suburban Cities in the past said no to any change until they got
into financial trouble, and then they allowed an unplanned expansion
to Commercial and Industrial growth.

The regular meeting of the Shorewood Planning Commission was held August 7, 1975,
7:30 p.m. at Minnewashta School. Present were: Steve Larson, Jerome Miller,
Frank Reese (chairman) and Vern Watten. Absent were: Jane Cole, Tore Gram.
Frank Reese called the meeting to order. Watten moved, Larson seconded that the
reading of the minutes of July 10, 1975 be waived. Approved. The minutes of July
10, 1975 were approved as printed. Reese moved and Larson seconded that the
amendment to the minutes of the June 26, 1975 meeting be approved. Motion carried.
Having distributed copies of "Application for Consideration of Planning Request",
from the village of Maple Grove, Minnesota, Frank Reese began the discussion of
a check list form to be formulated by this Planning Commission for the use of
petitioners who make official requests of the Planning Commission.
Discussion followed as to whether these administrative forms should be a formal
Ordinance or merely a "Procedure". Opinion would be requested from Frank Kelly.
Also mentioned in a general discussion that agendas be sent to members of commission
seven (7) days prior to meeting. And to include Frank Kelly, Bob Naegele Jr., and
Steve frazier on the list of people to receive the agenda.
A suggestion was made by V. Watten that the City Council consider the feasibility of
hiring a Parks and Recreation Director since there is a growing area of involvement
here and hiS/her recommendations might be a part of the approval process in future
planning requests.

Request was made by F. Reese that there be a liaison member from the Parks and
Recreation Commission as well as from the City Council to and from the Planning
Commission.
Reque~t that Ordinance ~ and ~ be indexed, tabbed, and pages numbered for
ease 2n reference.
Case numbers would be assigned to each "parcel" of land in order that a "history"
of the property might be maintained at the City Offices.
Check lists might well be color-coded.
Petitioners to the Planning Commission might be requested to bring one (1) full size
drawing and a stated number of reduced sized drawings to commission meetings for
ease in explaining area of proposed development or change. The large copy would be
on file at the City Office and smaller copies would go to the various City Officers
who would need them for investigation.

COMMENTS:
I realize if the 100 feet were rezoned C-3, anything could be built there.
But since we do not have a planned Commercial District, we must put some
trust into honest people that they will build like they propose to do when
they come and ask for a Rezoning.
As our City grows, our Zoning Ordnance must change to protect the City from
fast talking people that might not keep their promises.
I must admit, I did not like the first proposal of 200 feet, but the second
proposal of 100 feet did not effect the R-1 Area.

WHEREAS, the Planning Commission of the City of Shorewood
has heretofore recommended to the Shorewood City Council the inclu-
sion of land described as the northerly 200 feet of Tract C, RLS 160,
Hennepin County, Minnesota, wi thin the C- 3 General Commercial Zone
of the Shorewood Zoning Ordinance, and
WHEREAS, the applicant has indicated the land would be used'
for automobile parking in conjunction with the construction and
operation of a restaurant to be located on property described as
Tract A, RLS 160, Hennepin County, Minnesota, and as part of the
restaurant operation the applicant indicated a desire to request a
condi~use under the terms of the Zoning Ordinance for the opera-
tion of a drive-up restaurant;

Notice is hereby given that the Planning Commission for the City of
Shorewood will hold a public hearing under and pursuant to the Sbuawwood
Zoning Ordinance on the request of Horace G. Murfin, to change the zoning
classification of the parcels of property hereinafter described , from
their present zoning, to a zoning classification of C-3 (commercial).

The special meeting of the Shormvood Planning Commission was held on
Thursday, June 26, 1975, at Minnmo1ashta Elementary School. The meeting was
called to order at 7:50 P. M.
The minutles of the June 12, 1975 meeting were corrected to read that
motion to tabl!erequest to rezone the N. 200 feet of Tract C, Registered
Land Survey 1/160 .'las not carri~d unanimously by the Planning Commission
members and that P. Heese had voted negatively.
F. Heese made the comment that there was controversy as to whether or
not the public hearing on rezoning was closed at the meeting of 6-12-75 and
Mr. ~eese conf~rmed that it was.
After this correction and .comment, motion "JaS made and seconded and
carried to close minutes of 6/12/75.

if~. Reese asked the petitioner, Mr. Lambin to speak on any changes in redesign-
ing of the parking expansion. Mr. Lambin il1ustrated that now with the revised
plant of elimip.ation of the old bldg. and bringing up proposed Burger King closer
to the road, that approximately 100 feet ,vould suffice to park additional
twenty cars. Burger King could not give estimate of increased traffic flow
except to the point that according to their research, they would expect traffic
of 1000 cars per day-consisting of people living withinH a 6 mile radius and
already travel~ng that way out of necessity, but stopping for convenience.
lflI'. Lambin stated that the last traffic count by the state was made in 1973 and
it ,vas volunteE(red that no ne"J information had been obtained from the state since
the last Plann~ng Commission meeting.
F. Reese Fead from a letter received from qi ty Engineer that developer \-JOuld
assume any additional cost on diversion of storm sewer.
Mr. Lambil} added in regard to odors that developer had cyclalo1atch hood in
building cutti4g down 50% exhaust fumes.
One neighbor asked how balance of property l,"ould be zoned, if only part was
rezoned. Mr. Lambin answered that it would remain 11.1. Mr. Lamb in also described
architectual plan.
This was followed by individual opllllons voiced by Planning Commission
members. F'. }(~ese read general resolution entailing the rezoning. Steve Larson
moved to disap~rove request fDr rezoning offi R1 to C3. J. Cole seconded motion.
Motion vote was: split - 2 votes in favor of rezoning and 4 against.

MINUTES
The Shorewood Planning Commission met on Thursday, August 28, 191'), at Minnewashta
School. The meeting convened at 8:00 p.m. with Tore Gram, Steve i.Jarson, Jerome
Miller, Frank Reese (chairman) and Vern:Watten present, Jane cOlel' absent.

Upon motion,the reading of the minutes was waived and they were approved as printed.

Frank Reese reviewed the requirement that Planning Commission mempers submit written
record of their findings and expressed concern that members might I be liable for
their decisions. He passed around a copy of guidelines for Plann~ng commission
members for decisions on recommendation used in Bloomington. Ver.tl Watten requested
an opinion from Frank Kelly regarding this possibility. Members requested copies be
made and distributed to commission members for their study as wel~.
Frank Reese informed members that the possibility exists that fUthre land use develop-
ments may create pressure to do away with areas zoned "R-l" -- pr~ssures arising from
developers wanting higher density allowed in residentially zoned rreas. He introduced
a "Proposed Land Use Map - 1990" which has been formulated for Shprewood, dated 1969.
In a discussion with Dick Fredland, City Planner, Frank Reese inq~ired if this plan
would answer the requirement of the Metro Council for a local 1ana use plan. Mr. Fred-
land indicated that the major need is for a philosophical statemert that includes an
expression of social and justice goals (allowance for "housing foir all"). Mr. Reese
suggests this as an area for fUture consideration. I
The chairman then referred to the matter of proposed administrative planning forms,
using the samples from Maple Grove as a basis for cons ideration. He informed the
members that the forms would be called a "procedure" and would not need to become an
ordinance.

Shorewood Planning Commission
Meeting - Saturday, October 4, 1975
The Shorewood City Council and Planning Commission met in joint session on
Saturday, October 4, 1975, at, 9:00 a.m. at the Lake Fellowship Unitarian Church
on Glen Road for the purpose of studying the zoning ordinances.
Present were: Mayor Frazier, Council Members Haugen, Keeler, Naegele ;and
Planning Commission members Cole, Larson, Miller and Reese; and Clerk Wiltsey.
Because there may remain items in prior building ordinances (Nos. 8, 15, 22, 43,
50; and 69) that have not been included in the new zoning ordinances 77 and 79,
it was suggested that a committee be assigned to examine them in order to consoli-
date provisions into Ordinances 77 and 19.
Questions that were raised in discussion that require research and/or action:
What can some R-l land be properly labeled? Urban Farm? Other?
Derini tion of "lot line" must be redone because of the complications
caused by town houses, etc.
"Town house privately owned lot" - is this possible?
"Site line" vs. "sight line" - ask Frank Kelly for clarification
In addition to "Townhouse lot", add "services" and "public facilities" to
definition list.
There exists a,need to formulate a P. U. D. - commercial, industrial or
insti tutional- :zoning ordinance. The present ordinance has nothingt~over
such proposed developments.

SHOREWOOD PLAmlING COMMISSION
(Residential-Recreational Zone)
October 23, 1975
A Public Hearing on the Residential-Recreational Zoning Amendment to Ordinance #77
was held on Thursday, October 23, 1975, at 7:30 p.m., in the auditorium of Minne-
washta Elementary School. Present were: Frank Reese, Cha.irman, and Planning
Commission Members Jane Cole, Tore Gram, Stephen Larson and Vern Watten and about
100 interested citizens. Notice of Public Hearing was printed in the Maverick.
Frank Reese opened the meeting at 7:38 p.m. He explained the histor,y of the
development of the Residential-Recreational District and the philosophy that guides
it. He gave an overview of the provisions of the ordinance and the addendum or
specific properties listed in the public notice.
Vern Watten moved we defer discussion upon the properties listed in the addendum
until such time as we can present to the Council those concerns that are voiced
here this evening and that the discussion deal solely with the specific provi-
sions of the ordinance as a whole. Tore Gram seconded. No vote was taken.
The following citizens addressed the Planning Commission: Curran Nielsen,
Irving Turner, Beverly P1athe, Cathy Sa;krison, Mike Arvidsen, John Gilbertson,
Jim Heiland, Don Erickson, Jerry Titrud, Ted Korzenowski, Ed Abramson, Gordon Hall
Duane Bagdons, Peter Wattson, Resident of one month-unnamed, Dick Hassel (lawyer
for A. T. Ridinger), Joanne Carroll (council member of Tonka Bay), Malcom Reid
(mayor of Tonka Bay), Jerry Johnson (council member of Excelsior) and Brad Van
Nest (planning commission member from Orono).
~ Comments from these citizens are summarized as follows:

1. This R and R was tailor-made by the Council with John Cross' advice to fit
John Cross' property. There is selfish conflict of interest on the part of the
Shorewood council. How many drafts were there? Who worked on them? How many
of the drafts did each planning commission member work on?
2. This R and R poses a definite infringement on the property rights of neigh-
bors of John Cross. Feeling exists that Mr. Cross is already renting boats
and running a marina there
3. Have Planning Commission members visited the area? Have they looked at
the area on Gideons Bay from the standpoint of the residents, not just from
John Cross' viewpoint.
4. Boat density statement from !.MCD indicates Gideon's Bay is close t 0 critical.
Have Planning Commission members read the statement?
5. Citizens of Shorewood don't need this ordinance.
6. If this R and R is for Shorewood residents, thirty slips seems really in-
adequate to serve this need.
7. There really is no difference between this Residential-Recreational Zone and
Commercial zone. This is really spot zoning.
8. Propose that private marinas be stricken from the R and R and leave the
provisions for strictly public.
9. In Gideons Bay, Tonka Bay has 70% of the shoreline, Excelsior has the
next largest area and Shorewood has only about 5% of the shoreline. You can't
make a decision in favor, when you do not represent the att.itudes of a majority
of citizens living there.

MINUTES
The regular meeting of the Planning Commission was held on Thursday,
1975, 7:30 p.m., at the Minnewashta Elementary School. Frank Reese,
called the meeting to order at 7:39 p.m. All members were present:

It was moved by Jane Cole, seconded by Vern Watten, that the minutes of the
October 23rd Public Hearing on the Residential-Recreational Zone and the Planning
Commission meeting immediately following be approved as distributed. Motion carried
unanimously.
Frank Reese announced that the Public Hearing scheduled for 7:45 p.m. on the variance
request of J. D. Buergal, 27680 Island View Road, was cancelled at the request of
the applicant.
Chainnan Reese opened the discussion on the R-R Zone by introducing Frank Mixa of
the Lake Minnetonka Conservation District, who explained their Boat Density study
and policy with regard to Lake Minnetonka and Gideons Bay, in particular. He res-
ponded to questions from the audience.
Five factors considered in an assessment of boat density in particular areas are:

1. Relationship of boats stored to acres of water available.
2. Relationship of boats stored to miles of shoreline.
3. Relationship of boats in use to acres of water.
4. Existence of one or more multiple use docks, mooring areas or launching
areas in a particular region of the lake.
5. Crowding Potential: ratio between miles of shoreline and acres of water.
Ability of any area of the lake to absorb dense uses, ashore or afloat.
Frank Reese noted receipt of letters from numerous citizens and resolutions from
municipalities and the Gideons Bay Homeowners Association and directed that they
be filed with the Planning Commission records.
Vern Watten moved, Jane Cole seconded, to delete the addendum to the proposed Section 28
addition to Ordinance #77 as being inappropriate to the consideration of Section 28
known as the Residential-Recreational District. Motion carried unanimously.
Vern Watten read a statement of his analysis of the concerns expressed at the Public
Hearing of October 23, 1975.

A personal and immediate concern for property predominated.
Reference was made to the LMCD and its control and conservation efforts
toward Lake Minnetonka and the participants concern for the welfare of the
whole lake, but especially Gideons Bay.
There is concern over what one community on the South Shore can do to
another community. Suspicious and lack of trust between municipalities
was evidenced and there needs to be greater communication between them.
Lake Minnetonka is a common denominator to us all. We have a concern
for the quality of life and the legacy we can pass on to succeeding
generations.
Each community wishes to retain its identity and autonomy, but we need
to work together in lake related recreational facilities. There seems
to be a limited amount of lakeshore available in Shorewood, but

more facilities are available in other municipalities. Can we devise a
means for reciprocal services between communities?
6. The presently proposed R-R is undesirable because it serves only one
community - Shorewood.
Proposal: A Land Use Plan can satisfy our recreational needs with zoning
decisions based on and within the framework of that comprehensive plan. I
suggest a cooperative collaboration of South Shore communities in developing
a South Shore Coordinated Land Use Plan. Through this plan major parks,
open spaces, marinas, etc., can be developed to the advantage of all communi-
ties involved. I will recommend that the adoption of the R and R be delayed
until a Comprehensive Land Use Plan has been adopted. It is unwanted, un-
necessary, inappropriate, and premature and should not be considered as part
of the present zoning system and should be deferred until a land use plan
has been adopted.

Jane Cole questioned Frank Kelly as to the purpose and intent for developing an
R and R zone.

Mr. Kelly commented that there has been no rezoning on Lake Minnetonka for 20-30
years. There is increasing pressure by people to have the use of the lake. It
is an extremely fine recreational facility - a water park - and should be made avail-
able as much as possible to those who live in the area. It should not just be avail-
able to those who own property on the lakeshore, but to all members of the community.
In that regard, it was thought there would be advantages to have some land on the
lakeshore that would penni t use of that land to provide some kind of a. harbor with
opportunities for people to use the lake. Commerch8t items have crept into this
final draft of the R=R ordinance. The R and R was7 concei ved of in that way. It
was to be a means of launching boats - not a dispenser of commercial services.
Shorewood has needs. This is the problem. Is there a solution to the problem?
Jane Cole next questioned Mr. Kelly as to the possibility of considering requests for
marinas, stables, etc. under a conditional use pennit within R-l, R-2, etc. areas.
Mr. Kelly responded that that possibility does exist. It is always necessary to
try to establish standards and attempts should be made to keep standards high. The
R-R was viewed as a means to accomplishing that. This draft of the ordinance does
not keep the standards hi~.
Frank Reese reviewed the history of the desire of members of the council to provide
for adult recreational needs of Shorewood citizens.
Vern Watten moved that the Planning Commission recommend to the City Council of the
City of Shorewood that the proposed Residential-Recreational Zone, Section 28, Ordi-
nance #77 is unwanted, unnecessary, inappropriate,. and premature and should not be
considered a part of the present ordinance system, but development should be deferred
until such time as a Comprehensive Land Use Plan is established.

As an added element, I recommend that the City Council proceed to implement a plan
to provide a South Shore Land Use Plan, with communities to be selected. An ex-
planation of the proposal request would be forthcoming from the PLanning Commission.
Steve Larson seconded the motion.

Upon discussion, it was decided to take this motion in two parts. The motion was
withdrawn by Mr. Watten and Dr. Larson.
Jane Cole read a statement of her reasons for recommending the rejection of this
draft of the proposed R and R.
1. The wording and content of the draft need further refinement;
2. The attachment of the addendum to the R-R Zoning draft changed the
nature of the draft and, thereby, made a public hearing on the content
of the Residential-Recreational Zoning Ordinance ineffective;
3. It is possible that a Residential-Recreational Zone may not be in the
best legal interest of Shorewood; perhaps developing a conditional use
with restrictive standards under the existing zone -- developed in accor-
dance with a comprehensive land use plan - may work better legally.
(I do still feel that there is a need to provide compatible areas to satisfy
adult recreational needs in Shorewood.)
Discussion followed regarding the need for the Planning Commission to present
reasons why they make the recommendation that they make.
Vem Watten moved and Stephen Larson seconded, that the Planning Commission recommend
to the City Council of the City of Shorewood that the proposed Residential-Recreational
Zone, Section 28, Ordinance #11 should be deferred until such time as a Comprehensive
Land Use Plan is established. Motion carried unanimously.

Vem Watten moved, Stephen Larson seconded, to recommend that the Shorewood City
Council proceed to implement a plan to provide a South Shore Land Use Plan with
communities selected, accompanied by an explanation of the proposed request (from
the Planning Commission). Messrs. Watten, Gram and Larson voted aye; Mrs. Cole and
Messrs. Reese and Miller voted nay. It was a tie vote.
Jerome Miller proposes that any time a municipality proposes an action that will
affect another, that they be made aware of how it will affect one and all. He would
encourage full communication between municipalities.
Jerome Miller moved, Frank ~econded, that the Planning Commission give an explanation
in detail of reasons for recommending not passing the R-R Zone into law.
Jane Cole moved an amendment which would include that the reasons accompany the
recommendation for the tum-down of the R and R Zone. Amendment died for lack of a
motion.
Jerome Miller withdrew his motion and Frank Reese his second.
Jerome Miller moved, Stephen Larson seconded, that the Planning Commission prepare
their findings and request that the City Council withhold their decision until
December 15th, pending receipt and review of the Planning Commissionxs deliberations.
Motion unanimously carried.

Mr. L. Haug, former mayor of Tonka Bay, expressed appreciation for the decisions of
the evening and confirmed the need for communications between the municipalities.
He indicated that this had been the habit of Mayors a number of years back and felt
that it would be worthwhile resuming such meetings.
Jerome Miller moved, Jane Cole seconded a motion to adjoum until December 4th,
which will be a work session.

PLANNING COMMISSION MEETING
December 4, 1975
MINUTES
A special meeting of the Shorewood Planning Commission met on Thursday, Decem-
ber 6, 1975, at 7:45 p.m. at MinnewashtaElementary School. Members present
were Frank Reese, Vern Watten, Jerry Miller and Steve Larson, and, Jane Cole.
Tore Gram was absent.
Frank Reese moved and Jerry Miller seconded, the acceptance of the minutes of the
last meeting as printed. Motion carried unanimously.
The Planning Commission would like to recommend to the Council that greater com-
munication be developed between the Planning Commission and the Council via the
following proposed arrangements:
1. The liaison council member (or the alternate) be in attendance at all
planning commission meetings and public hearings;
2. Joint work sessions should be held as frequently as possible, and
especially prior to any public hearings held by the planning commission.
There followed discussion of reasons for not recommending that the Residential-
Recreational Zone be passed into law. Questions that need to be answered are:
What is the amount of need for adult recreational facilities in Shorewood?
What did the poll sent out in the Fall '75 Shorewood Newsletter show in
terms of this need?
Recommendation: that a committee composed of representatives from the
South Shore communities develop a statement about lake-
shore usage needs encompassing the following:
1. Define the needs, such as are they only for the
citizens of this area or of a wider metropolitan
area?
2. What is the nature of the needs? 1. e., how much
need for sailboats, powerboats, canoes, etc., as
well as on-land uses that would be unique to the
shoreline.
3. A zoning map is an "obituary" in that it tells
what has taken place. A comprehensive land use
plan will layout future use - and should be
"planning by objective."
4. The Planning Commission recommends that the Council
begin development of a comprehensive land use plan
for the City of Shorewood, but in a cooperative
spirit with neighboring communities; and that,
after completion of the Land Use Plan, that the
Council resume a study into the development of a
legal "vehicle" to accommodate the adult recreational
needs. We suggest the development of a Conditional
Use under existing R-l (R-2, R-3, etc.) zoning, with
restrictive standards (permitted uses) clearly set
forth.
5. In retrospect, it was felt that the R and R wasn't
restrictive enough.

Several questions are hereby directed to the Council from the Planning Commission.
I. What amount of money is budgeted for planning in 1976?
2. Will the services of a planner be available to the planning commission
in the future?
3. Why are yacht clubs allowed as conditional uses in the Zoning Ordinance,
but not marinas?
4. Ordinance #29, Section 3, defines as commercial the storing and operation
of any more than three boats at a site. Does this provision not contlict
with the fact that marinas are not included in possible conditional
uses in the Zoning ordinance or with the provision for yacht clubs in
the Rand R?
Frank Reese moved and Jerome Miller seconded that the meeting be adjourned at
10:15 p.m. Motion carried unanimously.

Goal Statement: The residential-recreati onal character of Shorewood should be maintained
in lieu of intensive development activities.
Implementation policies:
A. The unique environmental qualities now available to 011 Shorewood
residents will be protected through careful administrative evaluation
of intensive use land development requests.
B. An optimum population range for the Village is determined to be in the
12,000-14,000 range. (This range should be periodically reviewed and
revised if necessary in the light of constantly changing life styles,
economic conditions and land utilization demands,,)
C. Codes Qnd ordinances relating to construction and rpaintenance of housing
shall be adopted andperiodically reviewed in an effort to provide
current standards for sound, whol esome hous i ng types.
Goal Statement: A choice of quality residential environments should be encouraged and
deve loped within the Vi II age.
Implementation Policies:
A. A complete mix of housing types, sizes and price ranges is not necessary
within each neighborhood, but is possible and desirable at the
community level.
B. low and moderate cost housing for families should not be located in
concentrations, but should be widely scattered.
C. Residential density guidelines (dwelling units per acre) will be established
and implemented through appro.priate zoning classifications.
D. All public services and on-site improvements shall be completed at the
time of residential development.
E. Residential areas should be protected from commercial encroachment as
much as possible. It is recognized, however, that it may not be possible
in some cases to totally protect isolated single family developments from
encroachment of other land uses.
F. All site development plans requiring Planning Commission approval shall
include a detailed plan for landscaping, including but not limited to,
location, type, planting size and ultimate size of plant material, etc.

G. In changing from one density, type of dwelling or price range to another,
the burden of a satisfactory transition is the responsibi Iity of the developer
seeking the change.

H. Business of very limited nature may be permitted in single family detached
dwellings provided such activities are conducted in a manner which assures
that such occupation is not evident at the property line. Such business
shall be termed "home occupationll.
I. Multiple dwellings may be considered acceptable for development in areas
so designated on the comprehensive guide plan subject to the following
considerations:
I. Apartments should not be allowed to isolate small single
fami Iy developments unless it can be shown that the apart-
ments will serve as a transitional use between the single
family neighborhood and a use which in the opinion of the
Village would be incompatible with the single family
ne i ghborhood.
2. Spot development of apartments, being interpreted as a
structure completely surrounded by single family houses,
should be discouraged, in favor of large scale planned unit
developments which are more capable of creating their own
environment and providing desirable amenities.

3. Apartments should be located near principle traffic systems
and not allowed to create unreasonable congestion on local
residential streets.
4. Apartment developments may be uti lized as an effective tran-
sitional use between other uses, but not necessarily in every
instance.
5. It is desirable to locate apartments near large permanent open
spaces in order to compensate for the higher density.
6. While it is the intent of the Village to be as cooperative as
possible with all developers, it is not intended that Vi II age
staff do the developers work in formulating an acceptable
site plan.
7. Site plans shall be prepared by a qualified architect, land-
scape architect or urban planner.
8. Site plans and building design should be sensitive to the
natural land features, the architectural treatment of adja-
cent structures, placement of structures (to avoid monotony),

relationship of major features to each other (safety, convenience,
securi ty).

9. The Village shall impose conditions to insure quality development.
It is the intent of the Village to impose conditions that are reason-
able and economical. It shall be the responsibi lity of the developer
to clearly demonstrate that any such conditions are not economically
fj9asible--which is interpreted to mean the elimination of a reason-
able profit and not merely the reduction of potential profit.
J. Natural ponding areas shall be retained as much as possible.
Goal Statement: Equitable Administrative Procedures and Standards should be publicly approved
and conscientiously practiced.
Implementation policies:
A. Assure fair and impartial hearings and application of ordinances.
I. All ordinances must be developed in the public interest and
enforced in the publ i c i nte rest.
2. Ordinances must not be allowed to become obsolete or ineffective.

3. Village ordinances shall be enforced by the Village staff and
equally applied to all individuals.
4. Exceptions to Village ordinances, codes, regulations, etc., can
be made in special cases, but only after study and after appro-
priate hearings have been held.
5. Guarantee adequate publ i c heari ngs pri or to the adoption of
ordi nances.
B. Provide for conservation and improvement of the natural living environments,
quality and safety .
I. Provide adequate zoning to discourage the development of any
industrial or commercial operations which will through its
operation create a hazard to the residential or natural
environment.
2. Require all future developers to retain as much as possible the
natural environment such as preserving desirable trees, shrubs,
land forms, swamp and ponding areas.
3. Prohibit the erection of any structure in a flood plain or ponding
area.

4. Areas of non-conforming and mixed land uses should be eliminated
and the grouping of similar land uses encouraged.
5. Develop and maintain a suitable park and open space system and
encourage the development of privately owned recreational
faci lities.
6. Require that any sanitary landfill meet all Pollution Control
Agency and Hennepin County requirements and be located in
an area which will not jeopardize future development of"'1e

7. Encourage the development in an orderly fashion of buried
telephone and electric distribution systems.
8. Prohibit open yard storage unless adequately screened from
neighbors and roadways. (This would include winter storage
of boats, trucks, trailers, campers, etc.)
