Motion to Authorize the Mayor and City Administrator to Enter into a Right of Entry

Item 7 of the City Council agenda outlines the proposed conveyance ofa portion of City owned property
to the Minnesota Department of Transportation for permanent right of way purposes for the proposed
reconstruction of Christmas Lake Road and State Trunk Highway 7.
After further review of Item 7 "Consideration of a Motion to Adopt a Resolution Accepting MNIDOT's
Proposal for Right of Way Acquisition-Christmas Lake Road and TH 7, "the City Attorney has advised
that a public hearing be conducted since this is a conveyance of City owned property.
In discussing the matter withMNIDOT, they have requested that the City of Shorewood execute a "right
of entry agreement for the parcel of land, such that the project can stay on track: A public hearing and
follow up report would be prepared and presented the City Council once proper notice has been issued to
conduct the public hearing.
At this time, staff is recommending that Mayor and City Administrator be authorized to enter into a right
of entry agreement in favor ofMNIDOT, for the purposes of constructing, operating and maintaining a
Trunk Highway within a portion of the property described in "Attachment I."

TEMPORARY PERMIT TO CONSTRUCT
The State of Minnesota has by its Commissioner of Transportation established and designated the route
of Trunk Highway No. 7 in Hennepin County,
Minnesota.
It is necessary that the State of Minnesota use for highway purposes real property situated in
Hennepin County, Minnesota, described as follows:
That part of Lot 145, Auditor's Subdivision No. 120 as indicated in red On attached Exhibit A.
The undersigned, having an interest in the above described real property, understand that they are not
required to surrender possession of real property until the purchase price has been made available and are
not required to surrender lawfully occupied real property without at least 90 days notice. By this instrument.
the undersigned waive these rights and give the State of Minnesota right of entry and permit to construct,
maintain and operate the trunk highway.
The State of Minnesota agrees to proceed as soon as possible to acquire the necessary right of way for said
highway as provided by law.
It is necessary that the actual construction of said highway be commenced and completed without
interruption.
For a valuable consideration, the undersigned hereby grant to the State of Minnesota, the right to go upon
said real property after February 27. 1997 and construct said highway and to continue to work the same until
fully completed, and to travel the same when completed. The undersigned waive i!1l right of final payment
prior to the State of Minnesota taking possession of the land as required by U.S. Publie Law 91-646, Title
III, Section 301 (4) with the knowledge that such act in no way jeopardizes or compromises the damages
to which the undersigned may be entitled pursuant to the eminent domain action or direct purchase.

Watten Ponds - Final Plan

You have previously received the final plat, proposed development agreement, proposed
protective covenants and plans for the above-referenced project. In addition we have
received the proposed conservation easement agreement for the wetland buffers and steep
slopes on Lot 7. This easement agreement is considered to be well written and is
recommended as a model for future use. Any approval of the final plans for the Watten
Ponds project should include the following conditions:
Final Plat
1 . Drainage and utility easements must be 10 feet wide on each side of side and rear lot
lines.
2. The street name should be changed. The developer has now proposed Maple View
Court.
3 . The developer must provide deeds for the outlot, conveying the wetlands to the
City.
Development Agreement
4. Building height should reference "as defined by the Shorewood Zoning Code".
5. A condition should be added limiting accessory space to 1200 square feet. A
conditional use permit would be required to exceed that, with a limit of 2000 square
feet.
6. A condition should be added limiting the first floor area of dwellings to 3500 square
feet. (Mayor's suggestion)

7. The development agreement imposes a condition that only non-phosphorous
fertilizer may be used within the plat. No fertilizer is to be used within the
conservation easement areas.
8 . Project landscaping, as shown on the Landscape Plan, must be completed by 1
October 1997.
9. The development agreement requires escrows for maintenance of erosion control
barriers and tree preservation fencing.
Protective Covenants
10. Add same condition as 5. above.
11. Add same condition as 6. above.
12. The covenants include a deed restriction precluding resubdivision of Lot 7, Block
3.
13. The covenants include provisions precluding detached accessory structures and
tennis courts.
Conservation Easements
15. The developer must submit legal d~scriptions of the areas to be protected by
conservation easements.
16. The developer must submit a copy of the plat with the conservation easements
overlaid.
Prior to release of the plat the developer must pay the park dedication fees and the local
sanitary sewer access charges. Also, the letters of credit for the improvement must be
provided and the petition for assessing the water trunk charges and assessments must be
received.

The Eureka Neighborhood Association has found a number of disturbing inconsistencies
regarding the City of Shorewood's approval of the Watten Ponds PUD. We will be
mounting a legal challenge to that Oct. 14 approval based on new information which
counters Attorney Keane's claim that zoning is merely an implementation device and
subservient to the Comprehensive Plan. The Council's decision to approve this subdivision
pivoted on Keane's apparently erroneous fmding.
Our investigation has revealed that State Statute, and testimony by Shorewood Planning
Department staff, contradicts Keane's statement as reported on Page 7 of the City Council
minutes trom October 14, 1996.
State Code 462.357 Subd. 2, reads, "If the comprehensive municipal plan is in conflict
with the zoning ordinance. the zoning ordinance supersedes the plan". This sharply
conflicts with the City's position that zoning is subordinate to the Compo Plan and its
associated PUD. This State Statute clearly expresses that zoning takes precedent over a
Comprehensive Plan if a conflict arises between the two. Simply speaking, this then
eliminates the legal foundation used to justifY the small lots of theW atten Ponds project.
To add even more weight to our position, on Oct. 21 during the Johnson case hearing, Mr.
Nielson apparently testified under oath that zoning does indeed supersede the
Comprehensive Plan.
The record indicates that both the Planning Commission and City Council used the
Comprehensive Plan and its recommendation for a PUD (LU-28 #6) as justification for the
Planned Unit Development at Watten Ponds and to rationalize the associated small lots.
Specifically, it is our legal contention, that the small lot sizes associated with this project
undermines city zoning statutes thereby creating a direct conflict with the Comprehensive
Plan. Because the Watten Ponds PUD was specifically recommended in the
Comprehensive Plan and was the logical basis for the small lots it too is superseded by the
zoning regulations. Clearly, zoning in this case takes precedent over both the
Comprehensive Plan and its associated PUD. The logical conclusion is that lot sizes below
the zoned minimum of 40,000 square feet are illegal for this subdivision.
We believe that this new information demands that tonights consideration of the
development agreement be delayed until this matter can be sorted through. Moreover, by
tabling this project you will eliminate unnecessary legal expense for the City, its taxpayers,
and the Neighborhood Association.

A RESOLUTION DECLARING THE ADEQUACY OF THE PETITION
FOR IMPROVEMENTS AND ORDERING THE
PRELIMINARY FEASmILITY REPORT IN THE MA TIER OF
THE WATER'S EDGE DEVELOPMENT
WHEREAS, the City of Shorewood has received a petition (the Petition) requesting that the
City improve certain property by constructing street, sanitary sewer, storm sewer, and watermain
improvements (the improvement); and
WHEREAS, the City of Shorewood has reviewed the. Petition and identified that the single
owner of real property affected by said improvements who are abutting the public right of way named in
the Petition is the applicant;
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Shore wood
Minnesota:
1. The Petition is hereby declared to have been signed by all of the affected owners of 100%
of the frontage of the real property abutting the public right of way named in the Petition as the location
of the improvement. This declaration is made in conformity to Minnesota State Statutes, Section
429.035.
2. This Petition is hereby referred to the City Engineer who is instructed to provide to the
City Council a report advising, in a preliminary way, whether the Improvement is feasible and whether the
Improvement should thus be made as proposed or in conjunction with other improvements and the
estimated cost of the improvement as recommended.

WHEREAS, the City of Shorewood is fee title owner of real property identified by Property
Identification Number 35-117-23-13-145; and
WHEREAS, the City of Shorewood obtained said property from Hennepin County for right of
way purposes; and
WHEREAS, the Minnesota Department of Transportation has completed a study of the right of
way needs for the reconstruction of the intersection of TH 7 and Christmas Lake Road and has identified
impacts to said property;
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Shore wood
Minnesota:
1. The Mayor and City Administrator are authorized to accept the proposal for the amount
of one hundred dollars ($100.00) as appropriate damages for controlled access to State Trunk: Highway 7
for property identified as Parcel 216 as identified in "Exhibit A."
2. The Mayor and City Administrator are authorized to accept the proposal for the total
amount of $62,600.00 as appropriate damages for controlled access to State Trunk Highway 7, including
11,312 square feet of permanent right of way acquisition and 3,072 square feet of temporary easement
for property known as Parcel 216B as identified in "Exhibit A"

Executive Summary
Shorewood City Council Meeting
Wednesday, December 4, 1996
The Truth in Taxation Public Hearing scheduled for 7:45 p.m. is technically a
separate meeting so the Council should recess the regular meeting at 7 :45 p.m. to
to the hearing. Once the hearing is completed, reconvene the regular meeting. It
should be noticed at the beginning of the 7:30 p.m. meeting that following the
regular meeting the Council will convene in Executive Session to discuss pending
litigation. Minutes for the most recent City Council meeting are not completed
for this packet and therefore will be placed on the December 16 meeting agenda.
Agenda Item 2A: One of the goals for 1996 was to update job descriptions. Those needing
updates are enclosed in the packet for your review and approval.
Agenda Item 2B: The Council made the policy decision to refund a trunk charge for a parcel that
soon became property of an adjacent neighbor on Eureka Road. This resolution clearly lays out
what funds will be refunded for water, sewer and park fees and to whom. The resolution once
executed will be sent to the property owners and inserted in the property files. This should be
considered a cleanup resolution.
Agenda Item 2C: This is acceptance of the fianl improvments of Waterford Fourth Addition. The
developer has completed all of the improvements and is ready for final acceptance.
Agenda Item 4A: Abingdon Dahlstrom LLP has submitted final plans for the Watten Ponds
P.D.D. Any approval must be contingent upon the developer entering into a development
agreement with the City. The agreement will be patterened after the Marsh Pointe development
agreement which was approved at the 25 November Council meeting. Since we are adding
language regarding additional tree protection, custom grading of lots and building permit
performance escrows, the development agreement will not be distributed until Monday. . If you
have any questions relative to this item you can contact the Planning Director at home on Friday.
Agenda Item 4B: Carl Zinn has requested a 90 day extension for f1ling the McCary Addition final
plat. If this is approved they will not have to start the platting process over. Any approval should
stipulate that an up-dated title opinion will be required prior to release of the plat and that the plat
will be subject to whatever fees (i.e. park dedication, local sanitary sewer charges, etc.) are in
effect at the time they request release of the plat. They may also have to change the mylars
reflecting the change in Mayors. The applicant's letter will be distributed on Monday.

Al:enda Item 5: Mr. Blegen, developer for Water's Edge PUD has submitted a petition requesting
the City to prepare a feasibility report and to complete the project as a Public Works Improvement
Project.
Al:enda Item 6: This is consideration to update the Glen Road - County Road 19 drainage
improvements. This involves the construction of three stormwater detention basins on the
southwest quadrant of Glen Road and County Road 19. This item also requests authorization to
enter into a contract with OSM for $5,000 to aid in the update of the feasibility report and prepare
graphics for a public informational meeting.
Al:enda Item 7: The Minnesota Department of Transportation has tendered an offer of $63,600
for right Qf way acquisition for a portion of City owned land at the southwest quadrant of TH 7
and Christmas Lake Road. Staff is recommending approval of the offer tendered.
Agenda Item 8: At the last meeting the City Council asked staff to prepare an ordinance which
amends the Park Commission ordinance clarifying removal for cause rather than simply missing
three meetings. That ordinance is enclosed for your consideration.

Objective and Scope:

Plan and direct all city operations to ensure efficient municipal services and development in
line with objectives and general guidelines established by the City Council.
Includes overall responsibility for City financial, personnel and administrative functions, all
investment activities to achieve maximum safe returns, all public works operations, sewer
and water utilities, and coordination of planning, legal, building and engineering activities.
Also responsible for advising the Council regarding the impact of policy decisions, and
representing the interest of the City in Metropolitan, County and State activities as delegated
by the Council.
This position also functions as the City Clerk and is responsible for. administrative duties
related to maintenance of official records, processing of contracts, elections, and
miscellaneous duties as cited under M.S. 412.151.
Relationship:
Reports to: City Council
Supervises: All employees of the City
Supervises - means coordination of overall work activities and not direct
supervision over day-to-day work activities. The Department Heads are
responsible for the day-to-day work activities of subordinate employees, but
must report to the City Administrator.

WHEREAS, a new lot, known as PIN 33-117-23-23-0059, was created by the
subdivision of PIN 33-117-23-23-0001, as requested by the owner of such parcel, John
Paulson; and,
WHEREAS Mr. Paulson paid Local Sewer Availability Charges (LSAC), Park
Dedication Fees, and petitioned for the levy of Water Trunk Charges on the newly created
lot, as required by City Code; and,
WHEREAS, the new lot was purchased by the owners of the parcel located
directly south of the new lot, Mike and Lori Herman; and,
WHEREAS, Mr. and Mrs. Herman have petitioned for the abatement and refund
of such fees and charges pending the combination of the new lot with their existing lot.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood that:

combination is presented to the City ClerK, all remaining levies for Water Trunk
Charges will be abated, and all installments Qaid to date on such Water Trunk
Charges shall be refunded to Mr. and Mrs. Herman.

Water's Edge PUD
The developer for the Water's EdgePUD has petitioned the City to prepare a feasibility report for street,
sanitary sewer, storm sewer and watermain improvements for the subject development (refer to
attachment 1).
Usually, the City can tack small improvements such as this on to other projects for financing purposes.
The City has slated several improvements for the 1997 Capital Improvement Program, however, it is
difficult to insure that these projects will proceed in the 1997 period.

Under these circumstances, the City can proceed with the preparation of the feasibility study at the sole
risk of the developer. If the City does not complete the improvements scheduled for 1997 the developer
will be stuck in continuing with preparation of construction plans on his own.
I will deliver a resolution at the meeting for your consideration.

Stormwater Improvements for Glen Road - County Road 19 Intersection
Consideration to Update the Feasibility Report
In 1988, the engineers for the Minnehaha Creek Watershed District prepared a hydrological report forthe
to examine frequent flooding problems which occurred on County Road 19 at Glen Road and at
Brentwood Avenue within the Cities of Shorewood and Tonka Bay respectively (refer to attachment 1).
Frequent flooding problems occurred in these areas over the 1977 to 1987 time period. Although the
City has not received recent drainage complaints specific to this area, the potential for future flooding of
this area should be addressed.
.
On February I, 1990, the City of Shore wood entered into an agreement with the Minnehaha Creek
Watershed District to complete additional hydrologic analysis for the southwest quadrant of Glen Road
and County Road 19. This report analyzed the hydraulics for the Glen Road area and concurred with the
Watershed District's recommendations that three stormwater ponds should be constructed within the
southeast quadrant of County Road 19 and Glen Road to increase rate control and minimiz.e flooding
impacts downstream.
In August of 1990, OSM Associates, Inc. prepared a formal feasibility study which included the
recommendations from the Watershed District in addition to identifying a special taxing districts for the
improvements. Since the preparation of that report there have been three major items that have changed
which necessitate the updating of the feasibility report.
The first item is that some of the hydrologic characteristics for the area have changed, or are still in the
process of changing. Specifically, recent construction of the Gideons Woods Subd.ivi$ioninvolved the
construction of a stormwater retention basin in the northwest quadrant of the Glen Road-County Road 19
intersection. The original approval for this subdivision included the construction of a 12 inch storm
sewer from this stormwater basin to the ditch for the Light Rail Transit (LRT) trail. This pipe would be
located into the westerly ditch of County Road 19, and would extend north to the south ditch of the LRT
trai l.

After the plans and specifications for Gideons Woods Subdivision had been approved, it was determined
that the installation of the storm sewer line along CR 19 would have severe impacts to trees. Therefore,
the engineer of record for the project suggested a storm sewer outlet be constructed from the stormwater
basin, across Glen Road, to a newly constructed storm sewer located in the southwest quadrant of the
Glen Road - County Road 19 intersection.
Although this looked good on paper, survey information conducted by the City of Shorewood indicated
that the existing storm sewer is too high to be of use to the Gideons Woods development. The
developer's engineer is in the process of designing a stormwater lift station which would be owned and
maintained by the homeowner's association for Gideons Woods for the outlet to their pond.
As part of the updating of this report, alternatives which investigate a design which would eliminate the.
need for the stormwater lift station should be considered.
The second item which has changed is the design criteria for the ponds. As the City Council is aware, the
Minnehaha Creek Watershed District has adopted the National Urban Runoff Program (NURP) criteria
which typically involves up-scaling of the ponds from what has been investigated before.
The third item which has changed are the City's funding options for these regional ponds. The
Minnehaha Creek Watershed District has adopted what is known as "Rule B" into their management
documents (refer to attachment 2). Rule B requires the construction of a stormwater detention facility
meeting NURP criteria anytime there is a major redevelopment for an area or a roadway. Therefore, if
the City of Shorewood proposed to reconstruct a roadway, a NURP basin will have to be included as part
of the plans to mitigate stormwater runoff.
Minnehaha Creek Watershed District has also implemented another plan which allows Cities to utilize a .
concept analogous to the "wetland banking" programs for stormwater management. This program would
allow the City of Shorewood to continue with roadway reconstruction projects, as long as there is an
agreement between the City of Shorewood and the Watershed District to construct certain targeted
regional stormwater management basins. The construction of these stormwater basins could be credited
against these ponds to offset the impacts of a roadway reconstruction project, such as the Strawberry
Lane Reconstruction Project.
The Watershed District has been very eager to get the Glen Road Stormwater project into motion as
these ponds help reduce impacts downstream. In addition, the District has stated that they have funds
available to help contribute in the planning and construction of such facilities. Since this is a new
program with the District, the amount of funding available is not cast in stone. Representatives of the
District have been very eager to begin discussions regarding potential design parameters and funding
participation from the District. Specifics for each municipality entering into such an agreement will vary
from city to city.

Those Council Members who previously participated in the last update to this report may recall that a
special stormwater taxing district or fee area over the tributary area to the ponds was proposed as part of
the project (refer to attachment 3). As originally proposed, 70 percent of the project costs would be paid
for by the City of Shore wood, with 30 percent being paid by the taxing district. As part of the update to
the feasibility report, staff would seek out the amount of participation that would be available by the
Minnehaha Creek Watershed District. This revenue would be applied to reduce the amount to be
collected by the taxing district. It is also recommended that the taxing district be modified to include the
Gideons Woods Subdivision if the proposed ponds can be designed to eliminate the. need for a
stormwater lift station.
F or this update of the feasibility report, staff is requesting authorization for the Mayor and City
Administrator to enter into an agreement with Orr Schelen and Mayeron, Associates, Inc. to aid in the
hydraulic analysis, update portions of the report, and prepare graphics for a public information meeting.
This contract would be based on a time and material basis not to exceed $5,000. A resolution is attached
for your consideration. .

flowages, the ordinary high water level is the operating elevation of the normal
summer pool.
"Person" means any natural person, partnership, unincorporated association,
corporation, municipal corporation or political subdivision of the State of
Minnesota.
"PID" means Property Tax Identification Number and is an abbreviated method to
substitute for the legal description for a parcel of property (ex. 03-117-24 33
0004 is Section 3 of Township 117; Range 24; Quarter Quarter 33 and Parcel 4).
"Publicwaters" means all waters identified as public waters under Minn. Stat. I03G.005,
Subd. 15.
. "Public waters wetlands" means all wetlands identified as public waters wetlands under
Minn. Stat. 103G.005, Subd. 18.
"Redevelopment" means altering more than one half of the improved area of the site.
"Regional flood" means a flood which is representative of large floods known to
have occurred generally in Minnesota and reasonably characteristic of what
can be expected to occur on an average frequency in the magnitude of the 100-
year recurrence interval.
"Subwatershed" means one of the fifteen major subwatershed planning units within
the Minnehaha Creek Watershed District.

"Waterbasin" means an enclosed natural depression with definable banks capable
of containing water which may be partly filled with waters.
"Waterbody" means all waterbasins, watercourses and wetlands as defined in these
rules.
"Watercourse" means any channel having definable beds and banks capable of
conducting generally confined runoff from adjacent lands. During floods wai.er
may leave the confining beds and banks but under low and normal flows water is
confined within the channel. A watercourse may be perennial or intermittent.
"Wetland buffer zone" means an area of native, unmaintained, vegetated groundcover
abutting or surrounding a wetland. Buffer width is dependent on wetland size (see
Rule D, subsection 2.c.).
"Wetlands" means all wetlands identified as wetlands under Minnesota Stat. 103G.005,
Subd 19.

STORMW A TER MANAGEMENT & EROSION CONTROL PLANS
FORINDnnDUALPROJECTS
1. POLICY. It is the policy of the Board of Managers to:
(a) Require stormwater facilities to be constructed on individual sites where practicable and
effective.
(b) Manage stormwater and snowmelt runoff on a regional or subwatershed basis and
promote natural infiltration of runoff throughout the District to:
1) provide effective water quality treatment and where possible provide such
treatment prior to discharge to surface waterbodies and wetlands; and
.
2) so that future peak rates of runoff into major surface water bodies are less than or
equal to existing rates;
(c) Require preparation and implementation of erosion control plans for construction and
land development activities.
2. REGULATION. Except as provided in paragraph 5, prior to commencing construction, a
developer of land for residential, commercial, industrial, institutional, or public roadway uses shall
submit a stormwater management plan and an erosion control plan to the District in conformity with
the requirements of this rule and secure a permit from the District approving the stormwater
management plan and the erosion control plan. A stormwater management plan and an erosion
control plan are required for new development, redevelopment or additions to an existing site. The .
managers will review a stormwater management plan and the erosion control plan only after the
applicant demonstrates that the project has received preliminary approval from the municipality
indicating compliance with existing municipal plans.
3. DECISION CRITERIA FOR STORMW ATER MANAGEMENT PLANS.
Stormwater management plans shall comply with the following criteria:
( a) The rate of stormwater runoff from the site shall not increase as a result of the proposed
development. Developed peak rates of runoff shall be controlled such that the existing peak
rates are not exceeded. This criteria shall be analyzed and met for runoff producing events
of critical duration with return frequencies of 1, 10 and 100 years in the subwatershed in
which the site is located.
(b) Natural existing low areas will be used for detention of runoff to comply with rate
control criteria. Reservoir routing procedures and critical duration runoff events shall be
used for design of detention areas and outlets.

(c) Wet detention basins shall be required on-site and designed in accordance with the
Minnesota Pollution Control Agency (MPCA) design recommendations published in
sections 4.1-4 through 4.1-5 ("Protecting Water Quality in Urban Areas 1991"), and its
future revisions. These design criteria were developed based upon the results of the
Nationwide Urban Runoff Program (NURP)(USEPA, 1983). Total site area and any
contributing off-site drainage area shall be used to calculate permanent pool volume.
Structural outlets shall remove floatables from ponded runoff for a 1 year event.
(d) If a development or redevelopment site is less than 40 acres and the Board of Managers
determines that the wet detention and/or stormwater storage requirements would be better
addressed on a regional basis, the applicant may instead contribute to a dedicated District
water quality/storm water storage fund in lieu of providing the necessary facilities on-site.
The fund will be used in planning, constructing, and maintaining regional detention
basins/wetlands. Contribution to the above fund will only be allowed if an agreement for a
regional facility is in place with the affected municipalities, if there is an existing or planned
District regional stormwater facility within the same subwatershed, or if the Board of
Managers determines that another facility in a different subwatershed is of a higher water
quality priority and would better serve the public health and welfare and the purpose of the
watershed law. The District will utilize funds collected within the same subwatershed,
provided that the Board of Managers may allocate contributions to the dedicated fund for a
different subwatershed if the Board determines that a regional stormwater facility within the
same subwatershed is not feasible, or that a facility in a different subwatershed is of a higher
water quality priority and would better serve the public health and welfare and the purpose
of the watershed law. The contribution will be equal to the cost of the land, basin
construction and basin maintenance. Land value will be based on the tax assessed value and
basin costs of$20,000 per acre foot of required pond volume. At the discretion of the
District, the stormwater wet detention and storage requirements for a given site may be split
between on-site facilities and contributions to the District water quality/stormwater storage
fund. Site specific Best Management Practices (BMP's) will be required on all sites,
regardless of contribution to the water quality/stormwaterstorage fund. Contributions to the
District water quality/stormwater storage fund for additions to existing sites are based on the
area of the new addition and not the total site area. Contributions to the above fund for new
development or redevelopment are based on the total site area. If a site drains to an existing
or planned District regional stormwater facility, the applicant is required to contribute to the
water quality/stormwater storage fund as stated above.
(e) Waterborne sediments shall be prevented from entering existing drainageways to prevent
sediment transport off the site during and after construction.
(f) The proposed project shall not adversely affect water levels off the site during or after
construction.
(g) Runoff draining onto the site must be accommodated in the analyses and design of new
stormwater management facilities.

(h) The volume of site runoff may not increase due to the project when the receiving area of
said runoff is landlocked, and not capable of handling the increased volume of runoff. In
addition, the applicant shall either own or have proper rights over the landlocked property to
handle water from the development.
(i) All stormwater rate control facilities shall be located above the projected 1 DO-year flood
elevation for the site and within drainage, utility and/or flowage easements to provide access
and to prevent future alteration or encroachment.
G) Stormwater Management Plans under this Rule shall be in conformance with approved
Municipal Stormwater Management Plans.
(k) The outfall structures within wetlands and public waters and wetlands shall incorporate
a stilling-basin, surge-basin, energy dissipater, placement of ungrouted natural rock rip rap .
or other devices to minimize disturbance and erosion of natural shoreline and bed resulting
from peak discharges.
(1) All new residential, commercial, industrial and institutional structures shall be
constructed such that all door and window openings are a minimum of two feet above the
100 year high water elevation of nearby surface waterbodies, wetlands and stormwater
basins.
4. DECISION CRITERIA FOR EROSION CONTROL PLANS. Erosion Control Plans shall
comply with the following criteria:
(a) An Erosion Control Plan prepared by a qualified individual, shall show proposed
methods of retaining waterborne sediments on-site during the period of construction and
shall show how the site will be restored, covered, or revegetated after construction. .
(b) The erosion control plan shall be consistent with specifications of the MPCA manual
"Protecting Water Quality in Urban Areas" (revised July 1991) and its future revisions.
(c) Silt fences shall be removed after all disturbed areas have been fully stabilized.
(d) Sites with high erosion potential characterized by steep slopes or erodible soils may
require a cash deposit to ensure performance and any necessary remedial action. A
performance bond or other surety in a form satisfactory to the District is required for all
construction activity, including clearing, grading, and excavation, that results in the
disturbance of ten or more acres of land.

5. REQUIRED EXHIBITS. The following exhibits shall accompany the permit application.
One set - full size; one set - reduced to maximum size of 11" x 17".
(a) Stormwater Management Plan. A Stormwater Management Plan, certified by a
professional engineer registered in the State of Minnesota, shall include the following:
(1) Property lines and delineation of lands under ownership of the applicant.
(2) Delineation of the subwatershed contributing runoff from off-site, and proposed
and existing subwatersheds on-site.
(3) Proposed and existing stormwater facilities location, alignment and elevation.
(4) Delineation of existing on-site wetland, marshes, shoreland and/or floodplain
areas.
(5) Existing and proposed normal, and 100 year water elevations on-site.
(6) Existing and proposed site contour elevations at two foot intervals, related to
NGVD, 1929 datum.
(7) Construction plans and specifications of all proposed stormwater management
facilities.
(8) Stormwater runoff volume and rate analyses for the 1, 10 and 100 year critical
events, existing and proposed conditions.
(9) All hydrologic, water quality and hydraulic computations completed to design
the proposed stormwater management facilities.
(10) Documentation indicating conformance with an existing municipal stormwater
management plan. When a municipal plan does not exist, documentation that the
municipality haS reviewed the project.
(11) Delineation of any flowage easements or other property interests dedicated to
stormwater management purposes, including, but not limited to, county or judicial
ditches.
(12) Documentation that the project has received a National Pollutant Discharge
Elimination System (NPDES) Stormwater Permit from the Minnesota Pollution
Control Agency (MPCA) if required by the MPCA.
(b) Erosion Control Plan.

(c) A maintenance agreement shall be submitted for: stormwater treatment ponds, outlet
structures for such ponds, culverts, outfall structures, and all other stormwater facilities.
This maintenance agreement shall specify the methods, schedule and responsible parties for
maintenance and must include at a minimwn, the elements contained in the District's
Maintenance Agreement Form. A Maintenance Agreement Form will be provided to the
applicant for use by the applicant as a maintenance agreement or as guidance if the applicant
desires to draft a separate maintenance agreement. The maintenance agreement must be
recorded with the county within 10 days of the issuance date of the permit.
(d) Soil boring results if available.
6. EXCEPTIONS.
(a) If the District has approved a municipal stormwater management plan for a municipality,
or for a sub watershed within a municipality, the requirements in paragraph 3 of this rule .
which are not met by the municipal plan shall be deemed satisfied upon showing of
compliance by an individual developer with the municipal plan.
(b) The requirement of paragraph 3(a) above shall not apply to a project where the total site
area is less than one-half acre.
( c) Residential developments where the total site area is less than two acres and contains
four or fewer living units, and where the total off-site area contributing runoff to the site
improvements in less than one acre, do not require a permit under this rule. Approved.

WETLAND PROTECTION
1. POLICY. It is the policy of the Board of Managers to:
(a) achieve no net loss in the quantity, quality, and biological diversity of
Minnesota's existing wetlands;
(b) increase the quantity, quality, and biological diversity of Minnesota's wetlands
by restoring or enhancing diminished or drained wetlands;
.
( c) avoid direct or indirect impacts from activities that destroy or diminish the
quantity, quality and biological diversity of wetlands;
(d) minimize direct or indirect impacts from activities that destroy or diminish the
quantity, quality and biological diversity of wetlands;
(e) rectify the impact of any such activity by repairing, rehabilitating, or restoring
the affected wetland environment;
(f) reduce or eliminate the impact of such activity over time by preservation and
maintenance operation during the life of the activity;
(g) compensate for the impact on the wetlands by restoring a wetland;
.
(h) compensate for the impact on the wetlands by replacing or providing substitute
wetland resources or environments.
2. REGULATION.
(a) The Wetland Conservation Act, as amended, and the rules. implementing the
Wetland Conservation Act as set forth in Minnesota Rules chapter 8420, as amended,
are incorporated as a part of this Rule and shall govern draining and filling in
wetlands.
(b) Excavations in wetlands for the purposes of wildlife enhancement must comply
with the criteria described in the DNR publication "Excavated Ponds for Waterfowl"
(1992). Excavation in wetlands for any other purpose is governed by the substantive
and procedural standards, criteria and requirements set forth in the Wetland
Conservation Act, as amended, and the rules implementing the Wetland Conservation
Act as set forth in Minnesota Rules chapter 8420, as amended, with the exception that

replacement must be at the ratio of 1 acre of replaced wetland for each acre of
excavated wetland.
(c) Wetland replacement, where permitted, shall occur in the same subwatershed
as the associated wetland impact.
(d) The project must provide for a buffer zone of the following size:

0- 1 acre 16.5 feet
1 - 2.5 acres 20 feet
2.5 - 5 acres 25 feet
> 5 acres 35 feet
· Buffer zones are required around wetlands, and public water wetlands.
· Buffer zones must also be created around all replacement wetlands.
· Activities including, but not limited to mowing, yard waste disposal and fertilizer
application shall not occur within the buffer zone.

3. REQUIRED EXHIBITS. The following exhibits shall accompany the Combined Joint
Notification (CJN) form. One set - full size; one set - reduced to a maximum size of
II"xI7".
(a) Site plan showing:
(1) Property lines and comers and delineation of lands under ownership of the
applicant;
(2) Existing and proposed elevation contours; including the existing runout
elevation and flow capacity of the wetland outlet;
(3) Area of the wetland portion to be filled.
(b) Complete delineation of the existing wetland(s), including data sheets with
detailed information on field indicators (soils, hydrology and vegetation) and
summary report. Wetland delineation's should be performed during the normal
growing season for this area of the State (May 1 - October 15). Delineations
performed outside of this time frame mayor may not be permitted, depending on
potential wetland impact in relation to the entire development or project. Wetland
boundaries need to be staked in the field.
.
(c) Identification and area of the total watershed area presently contributing
storrnwater runoff to the wetland.
(d) A replacement plan, if required, outlining the steps followed for the sequencing
process and including documentation supporting the proposed mitigation plan. A
description of the nature and amount of the proposed fill material and details of the
annual monitoring plan must also be included.

WHEREAS, a feasibility report for the Glen Road Stormwater Improvements and Appurtenant
Work for Glen Road and County Road 19 was prepared and accepted by the Shorewood City Council on
June 25, 1996; and
WHEREAS, it has been determined previously that these improvements are recommended by
the Minnehaha Creek Watershed District to increase rate control to help reduce impacts of storm water
runoff downstream of the Glen Road and County Road 19 intersection; and
WHEREAS, changes have occurred in property ownership, hydraulic features of the area, and
design criteria which require further analysis of the project to determine the feasibility of said project;

NOW, THEREFORE BE IT RESOLVED, by the City Council of Shore wood Minnesota:
1. The proposed improvements are referred to the City Engineer for further study, and that
he is instructed to report to the City Council with all convenient speed advising Council as to whether the
proposed improvements are feasible, in addition to the estimated costs associated with the project, . and
various revenue alternatives for the project.
2. The City Administrator and Mayor hereby authorized to enter into contract for
professional services with Orr Shelen Mayeron Associates, Inc. not the exceed $5,000.00

State Trunk Highway 7 and Christmas Lake Road Intersection Reconstruction Project
The Minnesota Department of Transpiration (MN/Do T) is in the process of obtaining right of way and
continuing to prepare plans, specifications and construction estimates for the reconstruction of the
intersection of State Trunk Highway 7 and Christmas Lake Road.
.
As part of the right of way acquisition process, MN/DoT has identified two parcels ofland which the City
of Shorewood owns that will be impacted by the project. The City received these parcels of property
from Hennepin County under the stipulation in the deed that the parcels be used for right of way purposes
only. These parcels are located at the southwest quadrant of the intersection of State Trunk Highway 7
and Christmas lake Road. For discussion purposes, the State has denoted the west parcel as parcel 216
and the east parcel 216B (refer to attachment 1).
Characteristics of these parcels are flat low lying areas, much of which is wetland and mature vegetative
growth. Total contour relief for both parcels is approximately 8 feet.

MN/DoT is seeking to gain access control for this parcel The appraiser for M/DoT is suggesting that the
compensation for loss of access to TH 7 would be $100.00. It is very typical that the compensation for
access control is usually very minimal unless this the parcel is developed as a commercial facility that
would be damaged by loss of access. Due to the proximity of Christmas Lake Road intersection, it is
very unlikely that access would be permitted under any circumstances. Therefore the $100.00, minimal
as it is, appears to be appropriate.

Parcel 216B
:MNIDOT is seeking to obtain n,312 square feet of permanent right of way and 3,072 square feet as
temporary easement in addition to obtaining access control as shown in Exhibit 2. The appraiser for
MNlDoT has proposed compensation for the temporary easement and access control in the amount of
$16,600. The proposed construction easement expires December 1, 1998. The amount of compensation
for the permanent right of way is $46,000. This brings the total compensation for this parcel to $62,600.
In review of the proposal with the City Assessor, the price for land acquisition can vary widely. An
average price would be approximately $4.00 per square foot. Based upon the area proposed for
permanent easement, this would equate to $45,248.00. Therefore, the $46,000 offer seems appropriate.

Staff is recommending approval of the proposal offered by :MNlDoT. Signatures from Hennepin County
will also be required before the transfer can occur as the deed for these parcels were obtained for right of
way purposes only. Therefore, the County's signature is also required to insure the property is being
used as intended.

WHEREAS, the City of Shorewood is fee title owner of real property identified by Property
Identification Number 35-117-23-13-145; and
WHEREAS, the City of Shorewood obtained said property from Hennepin County for right of
way purposes; and
WHEREAS, the Minnesota Department of Transportation has completed a study of the right.of
way needs for the reconstruction of the intersection of TH 7 and Christmas Lake Road and has identified
impacts to said property;
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Shore wood
Minnesota:

1. The Mayor and City Administrator are authorized to accept the proposal for the amount
of one hundred dollars ($100.00) as appropriate damages for controlled access to State Trunk Highway 7
for property identified as Parcel 216 as identified in "Exhibit A."
2. The Mayor and City Administrator are authorized to accept the proposal for the total
amount of $62,600.00 as appropriate damages for controlled access to State Trunk Highway 7, including
11,312 square feet of permanent right of way acquisition and 3,072 square feet of temporary easement
for property known as Parcel 216B as identified in "Exhibit A"

AN ORDINANCE AMENDING CHAPTER 202 - PARK COMMISSION
THE CITY COUNCIL OF THE CITY OF SHOREWOOD, MINNESOTA, ORDAINS
AS FOLLOWS:
Section 2. Section 202.02 of the Shorewood Code of Ordinances is hereby amended as follows:
Subd. 1.
Membershiti in the Commission: Membership shall consist of up to seven (7)
residents 0 the City appointed by the City Council. Terms of all members shall be
for three (3) years. The City Council shall designate one of its members as its
liaison to meet with the Park Commission, and It shall direct the Park Commission
to designate one member of its body as a liaison person to meet with the Planning
COmmIssion, and the Planning Commission shall designate one member of its
body as a liaison to meet with the Park Commission.
Removals: The City Council shall have the power to remove any member of the
Park Commission for cause as defmed in the Shorewood Personnel Policy, and
after a public hearing with two weeks published notice, by a two-thirds vote of the
entire City Council.
Subd. 2.
Section 2. Section 202.03, Subd. 3 of the Shorewood Code of Ordinances is hereby amended as
follows:
Subd. 3. Rules of Order and Business: The Park Commission shall adopt rules and
regulations governing the conduct of its meetings. A majority of its membership
