March 26, 1958 The Planning Commission met at the home of chairman E. I. Morse at 7.;0 P.M. with the following members present: D. N. Borgen, R. L. Bliss, J. R. Freyermuth, Mrs. R.J.Goodmat eR. D. Handy and Mr. Morse. Only absentee was W. g. Bean. J. B. Janvrin, village trwstee, attended the meeting to brief us on the council's position regarding the function of the Planning Commission. Mr. Morse called the meeting to order asking for selection of a secretary and Mrs. Goodman was elected unanimously. He then asked for determination of a quorum and a meeting date. Because the total membership of the commission is 7, a mini.lllWD. quorum would have to be 4, but inasmuch as. the village council will want a well-rounded and diversified expression on questions referred to us, we decided that a quorum of 5 would be workable and yet easily assembled. Mr. Freyermuth moved that we adopt a quorum of 5 members, Mr. Bliu seconded and the motion carried unanimously. As for the meeting date, Mrs. Goodman requested that it be set enough in advance of the village council meeting to allow about a week's preparation. and delivery time on the minutes. The village council meets the second Tuesday of each month so Mr. Borgen suggested we meet not later than the last week of the month with the calling of :meetings left at the discretion of our chairman. Mr. Morse turned the meeting over to Mr. Janvrin and he explained that the purpose of our PlanniIlg Commission was to investigate and advise on action with regard to Ordinances 8 and ll~l"Ii;--e:; the use of land and the platting of land; while the advisory commission: will do survey type work to advise the mayor of public opinion on any given issue. Mr. Morse asked that we express ourselves on the 40,000 sq. ft. requirement for individual residences and all present upheld this specification from Ordinance #8. In connection with our discussion regarding the necessity for 40,000 sq. ft. per unit residence, . Mr. Janvrin gave each of us a copy of a bulletin from the Minnesota state Health De- . partL11ent which outlined the health hazard accompanying small plats in the suburbs. Where septic tanks and wells are too close together, villages are forced to put in sewage disposal systems and in the case of Shorewood we wQil.:t,4,~n~~d.. sever.alsepara,te sewage systems because at the peculiar layout of our village. Mr. Janvrin explained that a septic tank inspection and fee is now required. Section 4 of Ordinance #9 states that no sewage disposal system can be installed without first presenting a diagram of the proposed system to the building inspector showing its relation to existing systems. Regarding the 40,000 sq. ft. requirement agai~, large plats tend to regulate population growth and consequently keep school costs down which represent the greatest amount of our tax dollar. It was generally agreed that each platting request would require individual consideration because the 40,000 sq. feet would be useless if it was too misshapen. It was also pointed out that builders don't like to build on too big lots because their expenses soar. Any land already legally platted is exempt from this requirement. Mr. Morse requested that maps be secured for our study of the village land use problems. Mr. Janvrin said he would get 10. copies of the Minnetonka area map available at U.OO per copy from the Hudson Map Co. in the McKnight Bldg. Mrs. Goodman is going to borrow Ray Friede's maps of Shore.ood so we can outline village boundaries on our maps. A request from W. C. Bloomgren for a permit to open a golf drive range on his property and the property adjoining it on either: side was presented. Mr. MOrse asked for comments and it was universally agreed that such a permit would tend toward spot commercialization. . Mrs. Goodman will obtain 18 copies of "Zoning; 20 Qyestions and Answers" from the Minnesota Dept. of Business Development. . -2- At 9.00 Mr. Lambin and Mr. Brancel joined our meeting to introduce us to the new home development they are beginning at Eureka. One-third of the ;4 acres Mr. Lambin owns . is platted and legally approved and Mr. Brancel is going to build 16 homes in that section. The meeting will be held in the librar.y annex room at Minnewashta School to aocommodate the expected turnout. However, Mr. Freyermuth moved that the number of people invited be beld down as much as possible to allow for free discussion. Mr. Bean seconded and the motion passed unanimously. Regarding requests for rezoning we decided that we would not waste time on hearsay. Mr. Bean moved that a written request be submitted to our chairman prior to our meeting which would include specific survey data and a contour sketch of the proposed development of property by the buyer and seller, and ifpossible, a personal presentation of this information at our commission meeting. Mr. Freyer~th seconded and the motion carried unanimously. Mr. Bean read the minutes of our March 26, 1958, meeting and two corrections were made. . Mr. Morse called on Messrs. Schnittker and Uran for details on their proposed development of property north of Eureka, but their request was tabled for revamping and additional information. Messrs. DeVoe, DeVoe and Moline presented a request for rezoning of the 8 acre McDonnell property on Ilghway in and Vine Hill for use as a school bus garage, but this also was tabled for further data. Mr. Morse read a letter from Gary Boyd regarding rezoning of his property at the corner of Highway #7 and Murray Hill Road. T,o date, a permit has been issued for the building of a house. Discussion concluded that the property has not been surveyed and apparently there is not suffioient area to develop; no speoifio request on future use of the land was made; located as it is in a residential area, this would be spot zoning; and to be consistent with the refusal of commercial zoning across the highway this property too should remain residential. L. W. Faetkenheuer, of Vern Gagne and Associates, makes this request on behalf of Harold Steinkamp, builder, and .rill sell this prooert:'r to him, if the request is granted. At present this large lot, 235 feet by 216 feet, is occupied ~r a large old home which is in a terribly dilapidated cond.1 ~:i on. It is an eyesore and a detriment to the value and appearance of the neighborhood. Beoause of the age of the house and its poor cor~ition, there is little likely hood of anyone being willing to spend the money to remodel for single occupancy; therefore, it will remain a detriment to the neighbor- hood and a poor source of t~x revenue. Mr. Steinkamp thinks that if the above req1~st is granted, he can economioally remodel the old house into a duplex and build another good modern house on. the remaining 115 feet of frontage that will be in keep- ing with other houses in the ~rea. Mayor Lester Badger also attended. In the absence of the regular secretary, lvII's. Goodman, Walter Bean ac ted as secretary. The Chairman asked the secretary to read a copy of a letter from Harvey Inghem, Chairman of the Deephaven Planning Commission, setting forth why the Deephaven Planning Commission feels that the so-called McDonnell property in the Village of Shorewood should not be rezoned from residential to commercial for the purpose of building a school bus garage thereon. The Chairman ordered the letter filed as a part of the minutes of the meeting. The Chairman distributed to each of the members of the Planning Commission copies of a legal opinion from the law firm of lI'aegre and Benson stating the fact that "spot zoningll is unlawful. On a .motion made, seconded and unanimously carried it was de- cided that tile Commission accept the invitation of lvlayor Robb of Deephaven to attend a meeting on June 11, 1958 of the Planning Commissions of the Villages of ExcelSior, Greenwood, Shorewood, Ninnetonka and Deephaven for the purpose of studying the main problems and potentialities presented by Highway '7. MINUTES OF THE HEETING SHORE\I!OOD VILLAGE PLANNING COMl1ISSION JULY 15th, 1958 The meeting was called to order by the Chairman, Edward Morse. In the absence of the Secretary, M:rs, Goodman, Mr. Borgen was av'ointed as acting Secretary and read the minutes of the last meeting. A motion was made to accept the minutes as read. Motion was seconded and approved by the group. Mr. Morse outlined 5 proposals to be considered and introduced the first proposal for general discussion: I. A request by Mr. Kenneth Boehmke to r0zone property owned by him and lying between Old High'\yay # 41 and Hi,ghway #7 to commercial for purposes of building a 15 unit motel. It was pointed out by members of the plannigg commission that special-use permit in addition to re-zoning to commercial would be necessary before a motel could be cDnstructed on this property. A motion was made by Walter Bean and seconded by James Freyermuth that this request be denied by the Village Council for the following reasons: (a) Non-approptiate land use (b) Property is already occupied by non-commercial housing. (c) Re-zoning of this property to commercial would constitute "s pot-zoningU . II. A request by Hr. C. O. Norman to re-plat'his property to include five a~ditional lots was discussed. After due consideration it was decided by the Planning Commission to refer the proposal back to Mr. Norman outlining necessary requirements to have this property re-platted differently so that it will be more closely in line with ordinance # 11 calling for lot size of 40,000 square feet. III. A request by Harris Niccum to erect a 16' by 24' frame building to display, store, and sell fresh fruit and vegetables on his. property was discussed. This property has 165' of frontage on Hi.gh'fray # 19, and is ad jacent on it's Eastern extremity to the residential development knmvn as Echo Road. A request for either rezonj_ng or Hr. Niccum's property from res idential to commercial or a special-use permit for the use above outlined was denied by the Planning Commission unanimously follo~Ting a motion made to that effect by Walter Bean and seconded by Donald N. Borgen. Reason for denial is that ~~. Niccum's property, as a commercial venture, would encroach on the residential areas adjacent to it. When the property 80' in width vTest of Hr. Niccum's property vTaS zoned commercial, it was felt by the then-in-officeCouncil that this was as far as commercial zoning or commercial use should be allowed along that strip of land. With these reasons included in a letter to the Village Council, the matter was submitted to the Council for final disposition. IV. The Hinnetonka Game and Fish Club petition to have their land re... zoned to commercial was .-'jJscussed. The Club stated that the land they presently occupied is no longer suitable for them, and that in nurchasing other land, they needed more money from the sale of the present property to use as' down payment on new location~ They felt that if their property were re-zoned commercial it would comman0 a higher price. Hoban were in attendance and entered into the scussion. The result was that no action was taken with respect to the proposed road. Replatting of the two lots was approved because one was in excess of 40,000 square feet and the other was only 50 square feet less than 40,000 square feet. Walter Bean reported that, as previously requested, he met with King.tlorn and Stark of the E;xcelsior Village Planning CornJ.llission on September 30, 1958 to diseuss the problem of controlling boat traffic on Galnin's Lake. Mr. George D. Banker requests the perm.ission to divide his land which lies adjacent to Highway 78 into three lots. Two of these lots would be 33,000 square feet and the other 33,330 square teet In area. Mr. Banker's letter to the Commis.sion and the legali description ot the land which is proposed to be subdivided together with a rough sketch of the subdivision are enclosed. After considerable discusslon the platting of this land was approved by split vote. Com... mission members Bliss and Bean voted in favor and Borgen voted against. Morse and Freyermuth abstained. A letter from Mr. A. E. Woods to Ray Latterner wherein Mr. Woods indicates he would purchase the "Gun Club property" If it were rezoned to permit the establishment of a used car lot was considered by the CommissIon. This request tor rezoning was denied because of the use for which the land was proposed to be put. The Commission wishes again to point out to the Council that although the Commission is sympathetic to the prOblem of the Gun Club, it feels that a rezoning should be permitted only for a desirable use for which there is a need on the part of the residents of the Village. 3. Mr. Morse ha~ invited Mayor Lester Badger, Village Clerk Elsa Wiltsey, and Village Attorney Frank Kelly to join our meeting to hear and question Mr. Guy Kelnhofer of the Minnesota State Department of Business D.evelop. ment who described financing procedures for professional planning assistance. II. Mr. Kelnhofer gave an historical account of the establishment of his offioe and oommented on the proposals made by our group. The ooncensus was that it would not be satisfactory for us to try to join with othe,villages in hiring a planning oonsultant inasmuoh as our situation is foreign to those villages which surround us. Any professional assistanoe given would involve a preliminary investigation whioh sets a pattern' ,to develop future planning. Under present requirements if our village budgets a given amount to hire a professional planner, we would be entitled to an equal amount in federal aid; i. e., with a budgeted $2,500 from village funds, we would receive $2,500 from the federal allocation and with $5,000 we could get a professional planner to work with us in establishing plans for 1) roads and streets 2) land use 5) utilities 4) o~mmunity facilities 5) and a beginning capital budget. Of the $60,000 allooated to Minnesota from federal funds, about $25,000 remained December 1, 1958. The federal government generalizes that a planner's fee should run $.90 per capita in villages of 5,000 - 5,000 and $2.00 - $5.00 per oapita in villages under 5,000 population. . . Mr. Kelnhofer will review a survey questionnaire which we oan submit to him before using in Shorewood and he will make oorrections or additions if needed. We are free to interview planners and select the one we feel best for us, but any paid planner receiving federal funds will be subject to approval and regulation by the Department of Business Development. III. Mr. jVlorse described an incompleted dwelling at 30 Birch Bluff Rd. which neighbors are complaining about, and the whole problem was turned over to Frank Kelly for investigation. IV. A letter from Dan Phillips described an $18,000 single house and a $22,000 double house which he will build on proposed lots 1 and 2 of the surveyor's drawing he submitted. The lots will have about 31,000 sq. ft. apiece. On the negative side, the lots do not meet the 40,000 sq. ft. requirement and there is some question as to the desirability of multiple dwellings. On the positive side, considering the immediate vicinity these buildings will improve the area. Mr. Borgen moved that we aocept Mr. Phillips petition and recommend it to the village council. Mrs. Goodman seconded. '.l;'hevote was split with Borgen, Goodman, Freyermuth and Morse for; Bliss against; and Bean abstaining. V. Mr. Morse has talked with members of the Chanhassen Township planning commission and a joint discussion meeting will be arranged between our commission and theirs. VI. Mr. Kelly reported on his study of the st. John the BaptiS't.road problem and has a three page summary on file at his office. No village action can be taken until the Church and the neighbors involved come to some sort of conclusion. ..VII. For the third consecutive time, Mr. Boneau submitted a platte of his property and failed to provide 50' noadways with 100 I turnarounds and show where the acces s , . \ '- - 2 - roads join Christmas Lane to the west as he has been requested previously by the commission through Mr. Morse. Further, the platte submitted was only a pencil sketch and was not accepta~la for approval or rejection. Therefore, Mr. Morse was instructed to request an authentiaated platte. Mr. ,Kelly joined the disoussion to point out the disadvantages of private roads which Mr. Boneau\ prefers for his subdivision. People moving into the subdivision will expect public services - fire, police and road care and it is far less oomplicated to have the roads dedicated from the outset than to try to impose village speci- fioations at a later date. Mr. Morse quoted the bui1dingin8pec~tor, Mr. Aldritt, who believes that the Boneau property, even with large lots, will be subject to drainage problems. The building inspector will require that each house be staked out for exact looation; before a building permi~,will be issued. Mr. Bliss moved that we return. Mr. Boneauts platte because it was not aooeptable. Mr. Freyermuth seconded and the motion oarried unanimously. VIII. The Minnetonka Game and Fish Olub is still seeking commercial zoning for, their property whioh borders the Excelsior dump, but_ the commission wants to know the type of commercial use before making any changes in zoning. August 12,1958 Shorewood Village Planning Commission Shorewood Village, Minnesota Gentlemen: As you know,we are the owners of a rolling tract of ground of 166.7 acres ~lus approximately 14 acres usable meander land in the southeast corner of Shorewood Village. We have been approached by several reputable builders and real estate companies, who have indicated a desire to purchase our property for development, and we ourselves are seriously consider- ing platting the property for the sale of lots to individuals and build.ers. In connection with these plans, we have consulted a number of individuals '\"iho have planned and developed similar aree.s, and they have all expressed the opinion that the current 40,000 sq. ft. lot size minimum is impractical and unrealistic for this pr~pertyand represents a serious bar to the marketing.... of our property, either in individual lots or a.s an entire tract. They have given as their reasons the following: 40,000 sq.ft. lots are too large for proper maintenance by home owners. Large frontages mean a larger road construction and main- tenance burden per house or tax paying unit. If in the future public utilities are installed, a sub- stantially greater cost per unit would result. From the standpoint of the public, fewer tax.-paying units per acre and consequently smaller tax revenues. From a positive point of view they feel that the ideal middle income type area, with houses selling in the $25,000 to $30,000 and over bra.cket, can be and Should be located on lots averaging 25,000 sO.ft. for the following reasons: Easier maintenance by home owner,means better maintenance. Lower road maintenance, burden to village. Greater tax revenue. Lower future utilities cost ner unit. Appropriate pa,rk and playground areas, more economic to properly develop. A properly contoured plat would be more easily developed. Many older or mature families definitely are looking for properties with smaller areas of yard. In a development of this type, a community water system,which is desirable,would be feas:lble on lots in the 25,000 sq.ft.range, but from the information we have might well not be possible on larger tracts. , -2- We therefore ask that the Planning Commission study the following proposal, considering both the welfare of the community and our rights as property owners and taxpayers, to develop our property or sell it on a reasonable and economic basis. That the Planning Commission agree to recommend acceptance of a proper plat contoured, with the streets of the size and grade currently desired, and provided for a park area to be donated to the public, of 6 acres, calling for lot sizes of a minmmum of 25,000 sq.ft., with 25% of the lots to be at least 28,000 sq.ft.j and with minimum frontages of 100 feet, with 25% of the lots to front at least 125 feet. Wi thout a typographical analysis of the la,nd, there is no feasible way at this ti~e to determine the amount of lots available in the trac t. Morse at 7&}0 P.M. with the following members pre sent & D. N. Borgen, U/t,J/t,ttJJ, W. J. Bean, J. R. ~reyerJJlu:t'.l11 Mrs. R. J. Goodman, R. D. Handy and Mr. Morse. R. L. Bliss was absent;- J. B. Janvrin represented the Village Council. Mr. Janvrin reviewed zoning actions of the Oouncil. Mr. and Mrs. D. A. Dreher presented an aerial map photo of their farm which they intend to sub-divide. They were seeking a tentative OK on the proposed lot sizes before making a plat of the property. The members of the commission did not want to make any commitments of approval until more concrete plans were submitted. Mr. Borgen suggested that the Drehers adhere as closely as possible to the 40,000 sq. ft. requirement with 1501 frontages on the lots, realizing that some variation would be inevitable. Mr. Freyermuth mentioned that if the lot sizes were of sufficient size, no restriction on the square footage of each house would be necessary because the homes would be built in balance with the cost of the lots. Mr. R. D. Boneau presented a plat of his property on Ohristmas Lake. Lot sizes were in accordance with the demands of the topography of the land. Only objection arose on the width of the roads and Mr. Bonea~ wish to have no turn-around. Question was made on the problem of sewage drainage and Mr. Boneau agreed to have someone come in and make recommendations on proper sewage drainage. Goodman, Secretary SHOREWOOD VILLAGE PLANNING OO~~SSION September 29, 1958 . Our meeting was held at the home of chairman E. I. Morse at 7:}0 P.ll. with the following members present& D. N. Borgen, R. L. Bliss, W. J. Bean, J. R. Freyermuth, Mrs. R. J. Goodman, R. D. Handy and Mr. Morse. J. B. Janvrin represented the village council. The minutes of the September 2nd meeting were read and approved. Mr. and Mrs. D. A. Dreher were invited to discuss further plans for the subdivision of their 167 acre farm. At the request of Mr. Morse, Mr. Freyer- muth outlined his thoughts on a possible procedure for the platting of the land. First of all, he had made inquiries on the cost of a three dimensional plat and found that the going rate is $12-$15 per acre 80 that the Drehers will be getting by reasonably at the #8.50 an acre or $2,000 for the platting of their land which they have mentioned previously. Mr. Freyermuth continued that a development of high class homes in an area lIpf this size could be.a definite tax advantage for our village so that any assistance we could give the Drehers in following through with their plans would be in the best interests of the village. He recommended that the Drehers acquire a good aerial photo of their lane and then engage a carto- grapher to make a rough sketch of the proposed plat. 'llliis would cost between $150 and ~400. With a tentative proposal to consider for all the land, the Drehers could then proceed to have a few lots definitely platted and approved. The sale of these first few lots could carry the cost of the remaining platting. Mr. and Mrs. Dreher objected to this recommendation because they want to continue to pay taxes on a farm assessment basis rather than on individual lots. . Messrs. Bean and Borgen pointed out that the whole farm could be platted gradually a section at a time, but that with each sectional pla~ approval would have to be given first by the planning commission and then by the village council. Apparently the Drehers were seeking blank approval for }O,OOOsq. ft. lots throughout their subdivision and left the meeting with no further commitment as to their plans. Mr. Boneau had sent a revised sketch of his property, but the commission through Mr. Morse is requesting that he have a surveyor make a plat of his land with 50' roads, 100' turn-arounds, both uppe~d lower access roads and the location of the road connection to a public road. Messrs. Grathwol and Ploetz wrote us on behalf of st. John the Baptist Ohurch regarding a new road which would give a second access to the Ohurch parking lot. No action was taken. The Excelsior Planning Commission wrote us regarding a system of joint control of motors on Galpins Lake. Mr. Janvrin mentioned that property owners adjoining the lake could form an association and decide to ban motors. Walter Bean was appointed to contact R. S. Kinghorn of the Excelsior Planning Oommission to discuss a possible course of action which could be recommended. . Mr. Bliss had investigated the possibility of a survey of our village through the U. of M. facilities, but found that it would be necessary for us to hire one of their consultants. Norse, on October 28, 1958. All members of the Commission except Mrs. Goodman and Mr. Handy were present. In the absence of the regular secre- tary, l\1rs. Goodman, 1tJ^alter Bean acted as secretary. The Cornmission considered a request by JYIr. George D. Banker to divide the property he owns bordering on County Road 78 into three lots. This property has a frontage on High'..vay 78 of 331.1 feet and is 300 feet deep. A division of the property into Urree lots of as near equal size as possible will result in each lot being approximately 33,000 square feet. After con- sarable cHscussion of the matter, a vote v.Tas taken with Bliss and Bean voting in favor of the proposed replatting and Borgen voting c'cgainst. Morse and l:I'reyermuth abstained. Mr. Banker 1 s property is immediately adjacent to a tract of approximately l7~' acres owned by his brother and although the COIT'.Juission, by the majority vote referred to above, recommends to the Village Council that this subdivision be approved, it is with the dis- tinct understanding that, the fact that these tlrree lots do not meet the 40,000 square foot minimum requirement, the platting of them is in no way to be considered a precedent with respect to any request for approval of a plat in the future with respect to the surrounding area. 'Title request of lVIr. C. G. Norman to subdivide his property on the old Yellowstone Trail (lot //217, Auditors Subdivision 135) was again considered by the Commission and Mr. Horse was instructed to inform lVIr. J\Torman that if he would re-submit his request together with a plat showing three lots approximating as closely as possible 40,000 square feet each, the Commission would give the request favorable consideration. Norse. lvIr .vIooas 1 letter stated in effect that he \vould be interested in purchasing the "Gun Club propertyfl just west of the Village of gxcelsior on Highway 19 if it could be re-zoned for use as a used car lot for the purpose of stocking 20 to 30 cars in what l/Ir .vIooas describes in his letter as being 11* * * in the 2nd car class - probably up to ;it;600 retaillf. After consider- able discussion, the Commission unanimously decided that it be recommended to the Village Council that this request for re-zoning be denied because of the nature of the use to which the land was proposed to be put. . Morse was instructed to so inform the Village Council and to again inform the Council that, although the Com.mission is syn1pathetic toward the probleIYl of the Gun Club, it feels that a re-zoning to commercial should be permitted only for a desirable commercia.l use for 1.vhich there is a need on the part of the residents of the llage.
