07-067CITY OF SHOREWOOD RESOLUTION NO. p7-U67 IN THE MATTER OF UPPER MINNETONKA YACHT CLUB CONDITIONAL USE PERMIT The above-described matter came before the City of Shorewood City Council on September 24, 2007, and October 22, 2007, at the Shorewood City Council Chambers located at 5755 Country Club Road, Shorewood, Minnesota. Based upon the testimony, correspondence, exhibits, and other submissions, the Shorewood City Council snake the following: FINDINGS OF FACT 1. The City of Shorewood (the "City") is a Minnesota municipal corporation duly organized under the laws of the State of Minnesota and a statutory city of the fourth class. 2. In 1968 the Upper Minnetonka Yacht Club (formerly Upper Lake Minnetonka Yacht Club, hereinafter, the "UMYC") purchased the property at 4580 Enchanted Point, legally described in Exhibit A, attached hereto and made a part hereof (the "Property"). 3. The UMYC property contains 50,932 square feet of area (1.17 acres), and is occupied by a small storage building, a gravel parking area and various dock and boat storage devices. 4. The UMYC currently exists as anon-conforming use in the R-1 C/S, single- family residential / shoreland zoning distl•ict. 5. In 1969 the City of Shorewood granted a "special use permit" to the UMYC, a non-profit corporation, for the operation of a private yacht club. 6. The special use permit issued in 1969 limited the use of the facility to the docking or mooring of no more than 30 sailboats. 7. In 1973 the City amended its zoning 1•egulations to allow "yacht clubs" as conditional uses in residential zoning districts. 8. The UMYC applied for a conditional use permit in 1977, which application includes multiple references to UMYC use of the property as a "sailing yacht club" attached as Exhibit B. 4176555.2 9. Based on the 1977 UMYC application for a sailing yacht club, the City granted a conditional use permit for 30 boats, which permit was subsequently renewed in 1978. In a drafting oversight, the conditional use reference was to "boats" and not "sailboats." 10. In August 1977 the City amended its zoning regulations, deleting yacht clubs as a conditional use in residential zoning districts, which made the UMYC property a nonconforming use. 11. In November 1992 as part of an application by the UMYC requesting rezoning of the property to L-R, Lakeshore Recreational, Skip Jewett, the UMYC Commodore at the time, stated in writing that all yachts at the club were sailboats only, with the exception of one power boat used for officiating races attached hereto as Exhibit C. The application for rezoning was subsequently denied by the City. No appeal was taken. 12. At no time was an application made to the City to use motorized watercraft as a permitted activity. 13. In 2005 the City received multiple complaints from nearby residents that the Yacht Club had begun renting boat slips to owners of power boats. These complaints continued through the 2006 and 2007 boating seasons. 14. In response to the multiple complaints of motor boat docking and harborage activity, the City commenced a misdemeanor enforcement action in 2006. The misdemeanor complaint asserted the UMYC wrongfully expanded its non-conforming use with the introduction of new and additional power boats. The complaint was dismissed at the initial appearance without an evidentiary hearing by Hennepin County District Judge Charles Porter because the face of conditional use permit before the court restricted the use to 30 "boat slips" and failed to specify 30 "sailboat slips." 15. The Shorewood City Council and Shorewood Zoning Administrator seek to clarify the historic purpose intent, and effect of the conditional use permit based upon the historic record, applications which demonstrate that the UMYC applied for and was granted a permit for a sailboat yacht club only. 16. Accordingly, the City providing notice of hearing as required by Minnesota Statutes and Shorewood City Code of Ordinances, undertook hearings before the Shorewood Planning Commission on August 7, and September 4, 2007, considering the clarification of the purpose and intent of the UMYC conditional use permit. 17. The UMYC and its representatives did appear and speak to the Shorewood Planning Commission at its meetings of August 7 and September 4, and the City Council meeting of September 24, and did supplement the written record with correspondence and attachments dated September 4, 2007. Thereafter, the Shorewood City Council considered the entire record and proceedings before it, allowing for the introduction of testimony, correspondence, and exhibits at its meetings of September 24, 2007, and October 22, 2007, all in consideration of establishing a record in this proceeding. 4176555.2 2 18. The City Council at its meeting of September 24, 2007, directed the preparation of Findings of Fact, Conclusions and Order to include ali information relevant to the purpose and intent of the conditional use permit for the UMYC. NOW, THEREFORE, based upon the information, testimony, correspondence, exhibits, and findings contained in this record, the City Council of the City of Shorewood issues the following: CONCLUSIONS AND ORDER A. Based upon the historic representations, correspondence, operations and practice of the UMYC, the UMYC did and shall continue to operate only as a sailboat yacht club. B. The conditional use permit adopted by Resolution No. 30-78 governing the use of the UMYC at paragraph 2(a) shall read: That upon and in conjunction with the use of said property may be located lifts, slips, docks, and buoys capable of storing and peeping not more than 30 sailboats during the docking season, and such facilities shall not extend beyond 200 feet of the shoreline.
