Acrenda Item #3A: As of this writing Tim Keane has not supplied us
with the written appraisal report for the watermain project. If
it comes before the packets are finalized, it will be enclosed.
Otherwise it will be handed out Monday evening.
Acrenda Item #3B: The engineering agreement for the watermain
project will be 6% of the contract amount minus the feasibility
report charges. It is important to note that the total "soft
cost" on such a construction project is likely to be 35%. This
agreement is just for the design of the project.
Acrenda Item #3C: This is the annual resolution that is necessary
in order to receive Community Development Block Grant funds
through the County.
Acrenda Item #3D: This motion would approve a sign permit for Tahar
Oriental Rugs for the Waterford Shopping Center. It is consistent
with the overall signage plan previously approved. I
.-Acrenda Item #3E: Project management services are needJd for
several park projects this year including the picnic s~elterat
Freeman and the parking lots at Manor and Cathcart and jthe moving

Acrenda Item #5: This resolution approves the final plat of
the Heritage development which is a 24 lot Planned Unit
Development. It also approves the development agreement.
The enclosed letter to the developer lists the items that
need to be accomplished before the final plat is released to
them. Staff recommends final action Monday night. Agreement
on municipal water assessments and trunk charges are covered
under item #26 in the development agreement.
Acrenda Item #6: In addition to those listed in the
snowmobile task force memorandum in the packet, Ingrid Schaff
has voiced an interest in serving on the task force. She has
said that she would try to get a letter of interest to us
before Monday night's Council meeting.

Acrenda Item #7A: Enclosed is a midyear report on the status
of objectives for the year 1995. If you have any questions
or thoughts, please contact us before the Council meeting in
order to save time at the meeting.
Acrenda Item #7B: Staff concurs with Chief Richard Young's
memorandum which indicates that none of the stop signs placed
in Shorewood Oaks meet warrants. But as the Chief says, "the
proposed change is better than the current location".
Therefore, the proposed change should be approved.
Acrenda Item #8: There are technically two public hearings
being held simultaneously. The first is the improvement
hearing; the second is the special assessment hearing. The
procedure would be for the Engineer and Finance Director to
review the project and the plan for financing the project and
then the hearing would be open for public comment. For the
convenience of the public, we have noticed it such that
Manitou Road would be emphasized at 7:45 p.m., and at 8:30
p.m. Howard's Point Road and Edgewood Road would be
emphasized. However, if anyone wishes to speak on any
portion of the project at any time during the hearing, they
certainly would be allowed to do so. The hearing would be
continued until Tuesday evening at 7:30 p.m. at which time
Smithtown Road would be emphasized. Again, comments on any
portion of the project can be heard during the Tuesday
portion of the public hearing. Following the public hearing,
the City Council would discuss the proposed project. The
decisions that need to be made are laid out in the two
resolutions to be considered Tuesday evening.

A. Final Plat for Zachary Woods. Applicant: Brent Sinn. Location: 6035 Galpin Lake Road.
Nielsen reported this was the resolution and development agreement for the fmal plat of Zachary
Woods. He indicated on page 1 of the resolution, paragraph 2, item C. "Gideon" should be
replaced with "Galpin". He indicated staff has the declaration of covenant but it needs to be
revised. He stated the declaration of covenant is necessary because the lots that are accessed by
Galpin Lane have to become members of the Galpin Lane Homeowners Association and have
rights and responsibility for the maintenance of that road and it also gives notice to the owners that
at such time as city water is available to those lots, they will be subject to an additional trunk
charge. He stated the second declaration pertains to Lot 4 and states the lot cannot be further
subdivided until such time as it has frontage on a public street. He reported the Galpin Lane
Homeowners Association is currently working on an easement agreement between themselves and
the Developer and that the Developer must record the deed conveying Outlot A to the property
owner of 22690 Murray Street. He indicated on the development agreement, page 3, paragraph
12, the following should be added "to determine that the work has been done in accordance with
City standards". Also on page 4, paragraph 23, Nielsen reported the City Attorney is drafting a
paragraph regarding municipal water charges. In this case the developer is asking the water
assessment fees be assessed against the lots and the future lot owners be subject to a trunk charge
at such time as city water is available. .
Malam moved, Stover seconded to approve the final plat and development
agreement for Zachary Woods, for Brent Sinn, 6035 Galpin Lake Road, subject to
staff recommendations and additional items required by Staff be received prior to
the plat becoming final record. Motion passed 5/0.
6. CONSIDERATION REGARDING WATERMAIN PROJECT
A. Amendment to Ordinance #300 - Watermain Special Assessment
B. Amendment to Ordinance #301 - Fee Schedule
Hurm outlined the changes to the ordinances which had previously been passed.
Dresel explained the main reason for the change was so the City was not forcing commercial
development. Hurm indicated changes were made to Ordinance #300 to allow the City Council to .
have flexibility with the ordinance to maintain consistency.
Benson moved, McCarty seconded to approve Ordinance #302 amending Chapter
903 of the Shorewood City Code regarding assessment policy for the provision 0 f
municipal water. Motion passed 5/0.
McCarty moved, Benson seconded to approve Ordinance #303 amending
Municipal Chapter 1301.02 of the Shorewood City Code Setting Fees. Motion
passed 5/0.
7. LMCD. REPORT BY REPRESENTATIVE BOB RASCOP ON 1996
BUDGET
There was no report as Mr. Rascop was not present at the meeting. There was Council direction to
schedule Mr. Rascop's report for the August 14, 1995 City Council meeting.

Hurm explained the proposed budget would result in an approximate 3% increase for Shorewood.
Councilmember Malam complimented Chief Young on the budget narrative and thanked him for
the effort.
B. Review First Draft of Excelsior Fire Department 1996 Budget
Hurm explained the City Administrator met with the Fire Chief and City Manager of Excelsior to
discuss the 1996 Excelsior Fire Department Budget. He reported an overall increase of 8% with an
increase to the City of Shorewood of 10%.
Hurm reported vandalism in Badger Park. He indicated the local satellite had been set on fire by
vandals.
Dresel reported he met with members of the Shady Island Homeowners Association on Saturday to
determine what type of bridge to include in the upcoming feasibility report for bridge replacement.
Councilmember Benson requested an update at the next City Council meeting regarding the
Highway 7 project and how it relates to the Excelsior Bridge project.
Keane reported the Supreme Court had ruled on two technical procedural issues with regards to the
Metropolitan Waste Control Commission. They determined that the issue of timeliness was not
established and sided with the City regarding timeliness and the jurisdiction of appeal would be the
Court of Appeals.
Hurm reported he was a member of the Technical Advisory Committee which had been established
by the Metropolitan Council to study rates, Sewer Access Charges (SAC), and inflow and
infiltration. He indicated he was on the sub-group addressing inflow and infiltration. He invited
Councilmembers to attend the next meeting.
9. MAYOR AND CITY COUNCIL REPORTS
A. Report on Citizen Interest in Appointment to the Snowmobile Task Force
There was Council consensus to make a final decision on the Snowmobile Task Force at the July
24, 1995 City Council meeting.
Mayor Bean reported he had received a letter from the City of Excelsior indicating the July 4th
fireworks had been rescheduled for July 22, 1995 at 10:00 p.m. He indicated the food vendors
and music originally scheduled for July 4th will be included and the fly over by the Planes of Fame
is scheduled for 8:00 p.m.
B. Discussion on Shorewood Oaks Stop Sign Enforcement
Hurm indicated he had included a map in the Councilmembers packets which was being dispersed
to the Department Heads and would be discussed at the July 24, 1995 City Council meeting.
Mayor Bean reported Hennepin County has directed staff to retain bond counsel to issue the bonds
to fmance Excelsior's and Shorewood's contribution to the Senior Community Center under the
provision that the funding of the bond repayments will come from annual appropriations from the
two cities. This will save the two cities bond issuances costs, administrative costs and provide
lower interest rates. The next meeting of the cities in scheduled for July 20, 1995 at 4:00 p.m.

PURPOSB AIfQ DAD 0,. THE STUDY
The City of Shorewood is currently contemplating a water
system improvement project that is the first phase in the City's
recently updated Comprehensive Plan. It involves extending a water
main along Smithto~1 Howard's Point, and Edgewood Roads, and along
the west side of Hennepin County Road 19, and the construction of
a water tower. This project will affect approximately eo single
family lots, of which most have been built, three proposed
subdivisions, and several commercial properties.
The total cost of the project is estimated at $1,700,000, of
which $1,100,000 would be assesaed to the benefiting property
owners and the new aubdivisions as computed under the City'S Water
Assessment Ordinance. The balance of the costs would be recovered
through future assessments, trunk charges and utility fees.
The purpose of this study is to assist the City of Shorewood
in determining if the market value of the affected properties will
increase in an amount greater than the amount of the assessment.
The date of study is July 1, 1995. The study is directed at the
value of the land, and the effect of the proposed improvements on
its value. In the case of improved properties, it is the value of
the underlying land only that is considered, consequently an
inspection of the improvements was not done.
The age of the properties varies considerably from early
1900's to the present. Properties ~long smithtown Road are
generally older. Properties on Howard's Point are newer and of
greater value due to the lakeshore. Edgewood Road also has the
benefit of lakeshore.

CITY DESCRIPTIO.
The city of Shorewood is located at the western edge of
Hennepin county, on Truck Highway 7, about 18 miles west of the
Central Business District of Minneapolis. The City is located along
the southern shore of Lake Minnetonka.
The main road link to the Twin Cities from Shorewood is
Highway 7 which connects with I-494, allowing access to the road
system serving the Twin City area.
Hennepin County is considered part of the seven county
metropolitan area, and has experienced continued growth as the Twip
cities expands west. Population levels and forecasts are:

This represents growth of 27.3% over the last ten year period
with projected growth of 21.7% and 13.2% for the next two ten year
periods. Hennepin County grew 9.7% over the past ten year period
with projected growth of 7.4% and 5.6% for the next two ten year
periods.
The City is primarily residential with a mixture of older
housing stock, some newer houses, and ~eighborhood businesses.

Senefits of Project
There is better buyer acceptance of properties with city
water due to several factors.
. The quality of the municipal supply is more
controllable than a private well.
. Fire protection is greater with the availability of
municipal water, resulting in lower fire insurance
premiums.
. Greater convenience of an uninterruptable supply.
. No unforeseen costs of well repair or replacement.
.
. Consistent high water pressure.
These are factors that are considered by prospective property
purchasers and reflected by faster selling times and higher prices.

The proposed assessment of $5,000 per residential property is
low compared to two water projects in the City of Minnetonka. The
trunk lines were already in place, so the assessment was for
laterals. The Crowne Hill development had a cost of $4,644.18 per
property and the Lone Lake R.idge development had a cost of
$9,331.86 per property.

Analysis of Shorewood Property
In order to measure the increase in value of the properties
due to the water project, information on the sale of similar
properties, some with utilities and some without, was analyzed. A
"paired sale- comparison was done whereby property that was
unserviced was compared with serviced property in the same general
area with similar market influences. Adjustments were made for date
of sale, size of the lot, and amenities.

Five properties in Shorewood with sewer and water were
analyzed and compared to five properties with sewer, but not water.
Adjustments were made to remove differences except the availability
of city water.
The five with sewer and water had an average adjusted selling
price of $48,976. The five with sewer, but not water had an average
adjusted selling price of $43,863. This is a difference of $5,113.
After adjustments, properties with all utilities sold for more
than properties with all utilities except water.
COIJCLUSIOR
It is our opinion that the benefit to the subject properties
to be assessed is greater than the cost of the assessment.
The proposed assessment of $5,000 per residential unit for the
extension of city water will be more than offset by an increase in
the value of the property.

A RESOLUTION ORDERING Il\'IPROVEMENT AND
PREPARATION OF PLANS
WHEREAS, a resolution of the City Council adopted the 26th day of
June, 1995 fixed a date for a Council hearing on the proposed water system improvements
for parcels abutting portions of Smithtown Road. Howard's Point Road, Edgewood Road,
and Manitou Road.
WHEREAS, ten days' mailed notice and two weeks' published notice of
the hearing was given, and the hearing was held thereon on the 24th day of July, 1995, and
continued on the 25th day of July, 1995, at which time all persons desiring to be heard
were given an opportunity to be heard thereon.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the
City of Shorewood, Minnesota:
1. Such improvement is hereby ordered as proposed in the Council resolution
adopted 26th day of June, 1995.
2. OSM is hereby designated as the engineer for this improvement. They shall
prepare plans and specifications for the making of such improvement. -
ADOPTED by the Shorewood City Council this 25th day of July, 1995.

RESOLUTION NO. 95-_
A RESOLUTION ADOPTING ASSESSMENT IN THE MA TIER OF
BOULDER BRIDGE AND BADGER FIELD WATER SYSTEM
IMPROVEMENTS
WHEREAS, pursuant to proper notice duly given as required by law, the Council
has met and heard and passed upon all objections to the proposed assessment for the
improvement of Boulder Bridge and Badger field Water System Improvements,
NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of
Shorewood, Minnesota:
1 . Such proposed assessment, a copy of which is attached hereto and made a
part hereof, is hereby accepted and shall constitute the special assessment against the lands
named therein, and each tract of land therein included in hereby found to be benefited by
the proposed improvement in the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending
over a period of years, the tirst of the installments to be payable on or before the first
Monday in January 19_, and shall bear interest at the rate of _ percent per annum from
the date of the adoption of this assessment resolution, To the first installment shall be
added interest on the entire assessment from the date of this resolution until December 31,
19_, To each subsequent installment when due shall be added interest for one year on all
unpaid installments.
3 . The owner of any property so assessed may, at any time prior to
certification of the assessment to the county auditor, pay the whole of the assessment on
such property, with interest accrued to the date of payment, to the City Treasurer, except
that no interest shall be charged if the entire assessment is paid within 30 days from the
adoption of this resolution; and he/she may, at any time thereafter, pay to the City Treasurer
the entire amount of the assessment remaining unpaid, with interest accrued to December
31 of the year in which such payment is made. Such payment must be made before
November 15 or interest will be charged through December 3 1 of the next succeeding year.
4. The Oerk shall forthwith transmit a certified duplicate of this assessment to the
county auditor to be extended on the property tax lists of the county. Such assessments
shall be collected and paid over in the same manner as other municipal taxes.

WHEREAS, a contract will be let for the Boulder Bridge and Badger Field Water
System Improvements for parcels abutting portions of Smithtown Road, Howard's Point
Road, Edgewood Road, and Manitou Road. The cost for such improvements is estimated
to be $1,700,000.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the
City of Shorewood, Minnesota:
1. The portion of the cost of such improvement to be paid by the City is hereby
declared to be about $430,000 and the portion of the cost to be assessed against
benefited property owners is declared to be $ (total of assessment
roll).
2. Assessment shall be payable in equal annual installments extending over a
period of fifteen (15) years, the first of the installments to be payable on or
before the first Monday in January, 1997 and shall bear interest at the rate of
seven (7%) percent per annum from the date of the adoption of the assessment
resolution.
3. The City Clerk, with the assistance of the City Engineer, shall forthwith
calculate the proper amount to be specially assessed for such improvement
against every assessable lot, piece or parcel of land within the City affected,
without regard to cash valuation, as proposed by law, and shall fIle a copy of
such proposed assessment in the City Hall office for public inspection.
4. The Clerk shall upon the completion of such proposed assessment, notify the
Council thereof.

Wayzata We have received the Notice of Assessment Hearing for the Watermain Improvements, a copy of
Minnesota 55391 which is attached hereto. We understand that this assessment hearing will be held on July 24,
1995 and on July 25, 1995.

In the past we have stated the reasons why we believe that the City's proposed policy relating to
the levying of the assessments was not fair or legally correct as to our property within the City
and as shown on your assessment rolls. We understand the City has adopted an assessment
policy that did not take into account the objections that we have made and that that special
assessment policy is the one that is being implemented as part of the proposed assessment for the
watermain improvements.
We appreciate that special assessment formulas generally and the special assessments in this
particular instance are difficult to develop. Apparently your opinion as to what is fair and
reasonable and legally correct is different from our opinion. We do need to note to you our
continuing objection to the assessment policy and specifically to the proposed assessment roll to
be considered at the assessment hearings as outlined in the attached Notice of Assessment
Hearing.
A brief summary of some of the objections that we have provided before and we make again in
this letter, include the following:
1. We believe that a higher percentage of the total cost of this project should be paid from the
general fund of the City instead of being assessed.
2. We believe the amount of the proposed assessment for our property is in excess of the
benefit conferred to the property.
3.' We believe that other properties that are similarly situated are not being assessed as much as
they should be.
4. We believe that other properties with existing wells are not being assessed to the extent that
they should be assessed, given the nature of the older existing wells.

5. The special assessments for other properties which will receive both lateral and trunk benefit
should be a higher rate than proposed. Our property is not receiving the same lateral benefit.
6. These assessments are far in excess of those typically found in other cities.
We ask that these written objections be filed with the administrator/clerk prior to the hearing and
presented to the presiding officer at the hearing so that we will have complied with Minnesota
Statutes in regard to those steps that are necessary under the statute to protect our legal rights in the
event that a decision is made by us to file an appeal as to whatever special assessments may be
finally adopted pursuant to Minnesota Statutes 429.081.
If you have any questions or would like us to prepare any additional information prior to the Special
Assessment Hearings, please contact the undersigned.
Finally, we appreciate our working relationship with the City Staff, Planning Commission and
Council and we hope to develop a high quality project in the City in the near future. However, as to
the special assessments, as you know, we have the concerns noted above.

This serves as our notice of objection per the appeal section on page 2 of out Notice of
Assessment Hearing.
Howards Point Marina does not need the water service proposed nor do we want it. The
corporation will not be maintaining the Brown home on the north side of our property for very
long. The house on our south side of our property is served by our deep well adjacent to our
marina store. The marina store well is very adequate for all our needs.
In addition, the loss of the large oaks along the road more than outweigh any benefit water will
provide. We therefore further request that the water system stop before it reaches our
property.

Timing for the Adoption of Special Assessment Roll for Water
rmprovements on . Howards Point/Edgewood Road, Smithtown Road and
Manitou Road
The City Council has indicated that they may want to consider the option to delay the
beginning of installments of special assessments for above referenced water
improvements. I have conferred with the Hennepin County Special Assessments
Department and with City Attorney Tim Keane on this matter and, in light of these
discussions, would like to present the options available to you in adopting and colleding
the special assessments.
Minnesota State Statute 429.061 is quite specific relative to the adoption and collection of
special assessments on real property. The statute states that the first installment of an
assessment must be collected in the year following the adoption of the assessment roll. For
example, if the assessment roll is adopted on July 25, 1995, the first installment must be
collected with real estate taxes payable in 1996.
The Council may, however, delay the collection of the first installment until 1997 by
adopting the assessment roll after November 30 of this year. To do this, the statutory
procedure is for the Council to adjourn the public hearing on July 25 to a specific date
when the assessment roll will be adopted. The Council would then re-open the hearing on
that date and approve the resolution adopting the assessment roll. Once adopted, interest
at the specified rate would begin to accrue on the assessed amount from the adoption date.
Property owners have 30 days following the adoption of the assessment roll to appeal the
amount of their assessment. Property owners must file a written objection at or before the
public hearing to preserve their right of appeal. Delaying the adoption of the assessments
would also delay the appeal period for those filing such an objection.
This should clarify the options of the Council and the necessary procedures to carry them
out. Tim Keane will be prepared to address this matter on Mondayffuesday night. Should
you have any questions prior to that time, please call me or Tim.

PREP ARA TION OF PLANS
WHEREAS, a resolution of the City Council adopted the 26th day of
June, 1995 fixed a date for a Council hearing on the proposed water system improvements
for parcels abutting portions of Smithtown Road, Howard's Point Road, Edgewood Road,
and Manitou Road.
WHEREAS, ten days' mailed notice and two weeks' published notice of
the hearing was given, and the hearing was held thereon on the 24th day of July, 1995, and
continued on the 25th day of July, 1995, at which time all persons desiring to be heard
were given an opportunity to be heard thereon.
NOW, THEREFORE BE IT RESOLVED, by the City Council of the
City of Shorewood, Minnesota:
1. Such improvement is hereby ordered as proposed in the Council resolution
adopted 26th day of June, 1995.
2. OSM is hereby designated as the engineer for this improvement. They shall
prepare plans and specifications for the making of such improvement.

WHEREAS, a contract will be let for the Boulder Bridge and Badger Field Water
System Improvements for parcels abutting portions of Smithtown Road, Howard's Point

RESOLUTION NO. 95-
A RESOLUTION APPROVING AN AGREEMENT FOR ENGINEERING
SERVICES FOR WATER SYSTEM IMPROVEMENTS
Whereas, the City Council has directed Orr-Schelen-Mayeron and Associates, Inc.,
consulting engineers, to complete the plans and specifications for water system
improvements on the Boulder Bridge and Badger Field Water Systems, including elevated
storage; and
WHEREAS, such work is to be completed on a percent of construction basis in
accordance with the attached design agreement.
NOW, THEREFORE BE IT RESOLVED that the design agreement for said
services is hereby approved and authorized to be executed by the City Administrator.
ADOPTED BY THE CITY COUNCIL of the City of Shorewood, Minnesota this 24th
day of July, 1995.

Dear Mr. Hurm:
We propose to do the design work necessary for the water system improvements outlined in .
our Feasibility Report of June, 1995 on a percent of construction basis based on the attached
"fee curve." This curve is standard to the industry in the area, and the services included in
the design fee are outlined in the "Guide for Engagement of Engineering Services" published
by the Minnesota Society of Professional Engineers.
Based on the construction costs outlined in the Feasibility Report, the fee would be about 6%
of the construction cost. We would also propose a credit for the preparation of the Feasibility
Report.

MAYOR AND CITY ADMINISTRATOR TO
EXECUTE SUBRECIPIENT AGREEMENT WITH HENNEPIN COUNTY
FOR 1995 (YEAR XXI) URBAN HENNEPIN COUNTY COMMUNITY
DEVELOPMENT BLOCK GRANT PROGRAM
WHEREAS, the City of Shorewood has executed a Joint Cooperation .
Agreement with Hennepin County for the purpose of participating in the 1995 (Year XXI)
Urban Hennepin County Community Development Block Grant Program; and
WHEREAS, Hennepin County is the recipient of an annual grant from the
U.S. Department of Housing and Urban Development for purposes of the program, and
the city is a subrecipient under the program and receives a share of the grant; and
WHEREAS, program regulations require that the City and County execute
a Subrecipient Agreement and appropriate Third Party Agreement, which sets forth the
specific implementation processes for activities to be undertaken with program funds.
NOW, THEREFORE, BE IT RESOLVED that the Shorewood City
Council hereby authorizes and directs the Mayor and the City Council to execute the
Subrecipient Agreement and any required Third Party Agreement on behalf of the City.
ADOPTED by the Shorewood City Council this 24th day of July, 1995.

The attached proposal for signage for Taher Oriental Rugs in the new Waterford Shopping Center
is consistent with the overall signage plan which has been previously approved. It should be noted
that window signage will not be allowed within the center, but a messageboard has been
incorporated into the freestanding sign for the center, giving tenants the opportunity to advertise
special sales, etc.

INDEPENDENT CONTRACTOR AGREEMENT
THIS INDEPENDENT CONTRACTOR AGREEMENT, made this day of
19__, by and between THE CITY OF SHOREWOOD, a Minnesota
municipal City, (the City) and Phil Tipka (the Contractor) .
INTRODUCTION:
WHEREAS, the City is a Minnesota-municipal City engaged in the
business of providing municipal services; and
WHEREAS, the City desires to retain the Contractor to provide Park
Project Management Services and both parties desire to enter into an
agreement for such services upon the terms and conditions contained
herein; and
WHEREAS, the Contractor will, pursuant to this agreement, render
services in the course of an independent occupation representing the
will of the City only as to the result of his/her work and not as to the
means by which it is accomplished.
NOW, THEREFORE, in consideration of the mutual promises contained
herein,
IT IS HEREBY AGREED:
1.) Enqaqement - Throughout the term of this Agreement, the City
will periodically contact the Contractor to perform Park Project
Management work.
2.) Term - The term of this Agreement shall commence on the date
hereof and shall Continue for a period of twelve (12) months unless
terminated earlier as provided herein by Section 7. If not terminated
within twelve (12) months the parties may extend the term for an
additional twelve (12) month period by written agreement.
3.) Extent of Services The Contractor is free to devote time,
attention and energy to other businesses in which the Contractor may
be engaged. The Contractor is not in any way granted an exclusive
right to undertake project management for the City.

(a) The Contractor will be paid $28.00 per hour. The
Contractor will be responsible for billing the City every two
weeks.
(b) The Contractor will be available for on an on-call
basis when available.
(c) The Contractor will coordinate work with the City
Administrator.
(d) The Contractor will perform all project management
duties.
(e) The Contractor is responsible for all costs associated
with providing this service other than those specifically
provided for in this Agreement.

(f) The Contractor will wear an identification badge
provided by the City at all times while working.
4.) Remuneration - Subject to the provisions of Section 7, said
City agrees to pay the Contractor $28.00 per hour in accordance with
the City's general payment practice for consulting work.
5.) Tools and TransDortation - The Contractor is responsible for,
and will provide, all necessary tools and transportation in .
connection with the performance of any work for the City. The City
will reimburse Contractor for mileage related to authorized park
projects in accordance with City policy.
6 ) Performance - The Contractor agrees to perform all work in a
professional manner and in accordance with industry standards. The
Contractor shall guarantee his/her work for a period of one (1) year
from the date of completion.
7.) Termination - In addition to expiration of the term specified
~n Section 2, either the Contractor or the City may unilaterally
terminate this Agreement for any reason. Such termination shall be
effective upon receipt of written notice by the non-terminating
party.

8.) Contractor's Obliqations UDon Termination - Upon termination
of this Agreement for any reason, the Contractor shall immediately
return to the City all property and records of the City in his/her
possession and discontinue further representation of himself/herself
as an independent contractor of the City
9.) Nature of RelationshiD -The Contractor shall conduct his/her
business as an independent contractor, and not as an employee of the
City, for all purposes including, but not limited to, federal tax and
unemploYment insurance purposes, Neither the City nor the Contractor
shall be responsible by any agreement, representation, or warranty
made by the other, nor shall the City be obligated for damages to any
person or organization for personal injuries or property damage
. arising directly or indirectly out of the conduct of the Contractor's
business or caused by the Contractor's actions, failure to act,
conduct, or negligence. The Contractor agrees to indemnity and hold
the City harmless for any such act, failure to act, conduct, or
negligence pursuant to Section 11 of this Agreement. As an dependent
contractor, the Contractor shall be responsible for the paYment of
all income or other taxes incurred as a result of remuneration paid
to the Contractor. The Contractor shall also be solely responsible
for providing workers compensation insurance. Finally, as an
independent contractor, the Contractor shall not receive any of the
fringe benefits or participate in any of the plans, arrangements or
.. distributions that the City provides to its employees.
10.) Worker's Compensation Insurance - The Contractor agrees to
maintain, at his/her own expense, worker's compensation insurance to
fully protect both the Contractor and the City from any and all
claims for injury or death arising from the performance of this
Agreement. The Contractor agrees to waive, and does hereby waive, any
responsibility of the City to provide Worker's Compensation Insurance
to the Contractor,
11.) Indemnitv - The Contractor agrees to indemnify and hold the
City harmless from and against any and all claims by or on behalf of
any person arising from.the Contractor's actions, failure to act,

or proceeding brought thereon, including attorneys' fees and
expenses. Upon notice by the City, the Contractor shall defend the
City in any such action or proceeding.
12.) Entire Aqreement - This Agreement contains the entire
agreement between the parties and no amendment hereto shall be valid
unless made in writing and signed by the parties. There is merged
herewith all prior and collateral representations, promises, and
conditions concerning the Contractor and the City. This Agreement
supersedes and nullifies any preexisting agreements between the
parties relating to the subject matter of this Agreement.
13.) Severable - In the event any portion of this Agreement shall .
be held to be invalid, the same shall not affect in any respect
whatsoever the validity of the remainder of this Agreement.
14.) Bindinq Effect - This Agreement shall be binding upon and
inure to the benefit of all the parties hereto, their heirs,
executors, administrators, permitted assigns and successors in
interest.
15.) Notices - Any notice required or permitted to be given under
this Agreement shall be sufficient if in writing and sent by
registered or certified mail to the Contractor's residence or to the
principal office of the City, whichever shall be applicable.

WHEREAS, the City has received a petition (the Petition) requesting that the
City improve certain property by constructing sanitary sewer, storm sewer, and
watermain (the improvements); and
WHEREAS, the City has reviewed the Petition and identified the owners of the
real property abutting the streets named in the Petition and determined that the Petition has
been duly executed by the owners of 100% of the frontage of the real property abutting
on the streets named in the Petition as the location of the improvement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Shorewood, Minnesota:
1. The Petition is hereby declared to have been signed by the owners of 100% of
the frontage of the real property abutting on the streets named in the petition as the location
of the improvements. This declaration is made in conformity to Minnesota Statutes, Section
429.035.

WHEREAS, the fmal plat of Heritage has been submitted in the manner required for the
platting of land under the Shorewood City Code and under Chapter 462 of Minnesota Statutes, and
all proceedings have been duly had thereunder; and
WHEREAS, said plat is consistent with the Shore wood Comprehensive Plan and the
regulations and requirements of the laws of the State of Minnesota and the City Code of the City of
Shorewood.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood
as follows:

1 . That the plat of Heritage is hereby approved.
') That the approval is specifically conditioned upon the terms and conditions
contained in the Development Agreement for Heritage Planned Unit Development, attached hereto
and made a part hereof.

DEVELOPMENT AGREEMENT
HERITAGE
PLANNED UNIT DEVELOPMENT
THIS AGREEMENT, made this day of ,1995, by and
between the CITY OF SHOREWOOD, a Minnesota municipal corporation, hereinafter referred to
as the "City", and ABINGDON DEVELOPMENT CORPORATION, a Minnesota corporation,
hereinafter referred to as the "Developer".
.
WHEREAS, the Developer has an interest in certain lands legally described in Exhibit A,
attached hereto and made a part hereof, which lands are hereinafter referred to as the "Subject
Property"; and
WHEREAS, Developer proposes to develop the Subject Property by means of a Planned
Unit Development ("P.U.D.") consisting of 24 lots and 3 outlots; and
WHEREAS, the Developer has made application for a Conditional Use Permit for a
P.U.D. with the Zoning Administrator and submitted a Concept Plan and Development Stage Plan
for the property, which matters were considered by the City Planning Commission at a Public
Hearing held on , and at a meeting of the City Council on
; and
WHEREAS upon recommendation of the City Planning Commission, the City Council did
consider and grant Concept Plan and Development Stage Plan approval as set forth in Resolution
No. ; and
WHEREAS, the Developer has filed with the City the Final Plat for "Heritage", a copy of
which plat is attached hereto and made a part hereof as Exhibit B-1 and B-s; and
NOW, THEREFORE, in consideration of the mutual covenants and guarantees contained
herein, the parties hereto agree as follows:

1) Conditions of Approval - The Developer shall comply with the conditions of
approval as adopted by the City Council and set forth in Resolution No. , incorporated
herein as Exhibit C-1 through C- . In addition, development of the P.U.D. is subject to the
requirements of the R-1A,Single-Family Residential zoning district.

(b) Outlot B shall be common open space for the use of residents of the P. U.D.
Plans for any common recreational facilities to be located on Outlot B shall be
approved by the City Council. Buildings shall not be allowed on Outlot B.
(c) Outlot C shall be used as a landscaped entry tot he P.U.D. and shall be
owned and maintained by the homeowner's association.
(04) The Developer shall comply with the requirements of Shorewood's wetland code
(Chapter 1102) and the Wetlands Conservation Act of 1991 [Minn. Stat. 103 G.221 et.
seq. (hereinafter referred to as the WCA)]. It is the intent of this agreement that areas
adjacent to wetlands be maintained in their natural state.
(a) A minimum 35-foot buffer strip shall be maintained adjacent to all wetlands.
(b) Natural vegetation shall be maintained in wetland buffer strips. Where
disturbed by site development, wetland buffer strips shall be restored with natural
vegetation.
(c) Wetland buffer strips shall be identified within each lot by permanent
monumentation approved by the City.
(d) A monument is required at each lot line where it crosses a wetland buffer
strip and as necessary to establish required setbacks from the wetland buffer strip.
Monuments shall be placed within 60 days of completion of site grading or prior to
issuance of a building permit, whichever occurs first.
(e) The Developer shall record with the Hennepin County Recorder or Registrar
of Titles, a notice of the wetland buffer requirement against the title of each lot with
a required wetland buffer strip.
(f) No structures, including, but not limited to, decks, patios, and play
equipment may be located in the wetland buffer strip or the required wetland
setback area, except that fences shall be allowed within the wetland setback area.
I.) Improvements Installed by Developer - Developer agrees at its expense to construct,
install and perform all work and furnish all materials and equipment in connection with the
installation of the following improvements:
(01) Street grading, stabilizing and bituminous surfacing;
(02) Surmountable concrete curb and gutter;
(03) Sanitary sewer;
(04) Storm sewer and surface water drainage facilities;
(05) Watermains and service connections;
(06) Street name signs and traffic control signs;
(07) Required landscaping and reforestation;
consistent with the plans and specification prepared by Sathre-Bergquist, Inc. dated
1995, and received and approved by the City Engineer on
,1995.
It is understood that the above improvements do not include any of the "Public Improvements" to
be constructed by the City in extending City water to the property. It is further understood that
underground utility lines, including gas, electric, telephone, and television cable shall be installed
by the respective private utility companies pursuant to separate agreements with the Developer.

.3.) ~inal Plat. Grading. Dr~inage and Utility Plan. Building Plan - The Developer has

SaId plat IS attached hereto and made a part hereof as Exhibit B-1 and B-2. Said fmal plat, together
with the grading, drainage, and utility plans, referenced in paragraph 2 above and this
Development Agreement, is herewith adopted and approved by the City as the Developer's final
plan for development of the property.
4.) Pre-construction Meeting - Prior to the commencement of construction, Developer
or its engineer shall arrange for a pre-construction meeting to be held at Shorewood City Hall.
Such meeting shall be coordinated with the City Engineer and shall include all appropriate parties
specified by the City Engineer.
5.) Standards of Construction - Developer agrees that all of the improvements set forth
in paragraph 2 above, shall equal or exceed City standards, shall be constructed and installed in
accordance with engineering plans and specifications approved by the City Engineer and the
requirements of applicable City ordinances and standards, and that all of said work shall be subject
to final inspection and approval by the City Engineer.
6.) Materials and Labor - All of the materials to be employed in the making of said
improvements and all of the work performed in connection therewith shall be of uniformly good
and workmanlike quality, shall equal or exceed City standards and specifications, and shall be
subject to inspection and approval of the City. In case any materials or labor supplied shall be
rejected by the City as defective or unsuitable, then such rejected materials shall be removed and
replaced with approved materials, and rejected labor shall be done anew to the satisfaction and
approval of the City at the cost and expense of Developer.
7.) Schedule of Work - The Developer shall submit a written schedule in the form of a
bar chart indicating the proposed progress schedule and order of completion of work covered by
this Agreement. It is understood and agreed that the work set forth in paragraph 2 shall be
performed to be completed by , 1996. Upon receipt of written notice from the
Developer of the existence of causes over which the Developer has no control, which will delay the
completion of the work, the City, at its discretion, may extend the dates specified for completion.
8.) As-Built Plan - Within sixty (60) days after the completion of construction of the
Improvements, Developer shall cause its engineer to prepare and file with the City a full set of "as-
built" plans, including a mylar original and two (2) black line prints, showing the installation of the
Improvements within the plat. Failure to file said "as-built" plans within said sixty (60) day period
shall suspend the issuance of building permits and certificates of occupancy for any further
construction within the plat.
9.) Easements - Developer, at its expense, shall acquire all easements from abutting
property owners necessary to the installation of the sanitary sewer, storm sewer, surface water
drainage facilities and watermains within the plat, and thereafter promptly assign said easements to
the City.
10.) Pre-existing Drain Tile - All pre-existing drain tile disturbed by Developer during
construction shall be restored by Developer.
11.) Staking. Surveying and Inspection - It is agreed that the Developer, through its
engineer, shall provide for all staking and surveying for the above-described improvements and
delineation of the wetland buffer areas. In order to ensure that the completed improvements
conform to the approved plans and specifications, the City will provide for resident inspection as
determined necessary by the City Engineer.

12.) Grading. Drainage. and Erosion Control- Developer, at its expense, shall provide
grading, drainage and erosion control plans to be reviewed and approved by the City Engineer.
Said plans shall provide for temporary dams, earthwork or such other devices and practices,
including seeding of graded areas, as necessary, to prevent the washing, flooding, sedimentation
and erosion of lands and streets within and outside the plat during all phases of construction.
Developer shall keep all streets within, and adjacent to, the plat free of all dirt and debris resulting
from construction therein by the Developer, its agents or assignees.
13.) Street Signs - Developer, at its expense, shall provide standard city street
identification signs and traffic control signs in accordance with the Minnesota Manual on Uniform
Traffic Control Devices, as directed by the City Engineer.
14.) Access to Residences - Developer shall provide reasonable access, including
temporary grading and graveling, to all residences affected by construction until the streets are
accepted by the City.
15.) Occupancy Permits - The City shall not issue a certificate of occupancy until all
Improvements set forth in paragraph 2 are completed and approved by the City Engineer.
16.) Final Inspection - At the written request of the Developer, and upon completion of
the Improvements set forth in paragraph 2 above, the City Engineer, the contractor, and the
Developer's engineer will make a final inspection of the work. When the City Engineer is satisfied
that all work is completed in accordance with the approved plans and specifications, and the
Developer's engineer has submitted a written statement attesting to same, the City Engineer shall
recommend that the improvements be accepted by the City.
17.) Conveyance of Improvements - Upon completion of the installation by Developer
and approval by the City Engineer of the improvements set forth in paragraph 2 above, the
Developer shall convey said improvements to the City free of all liens and encumbrances and with
warranty of title, which shall include copies of all lien waivers. Should the Developer fail to so
convey said improvements, the same shall become the property of the City without further notice
or action on the part of either party hereto, other than acceptance by the City.
18.) Replacement - All work and materials performed and furnished hereunder by the
Developer, its agents and subcontractors, found by the City to be defective within one year after
acceptance by the City, shall be replaced by Developer at Developer's sole expense. Within a
period of thirty (30) days prior to the expiration of the said one-year period, Developer shall
perform a televised inspection of all sanitary sewer lines within the plat and provide the City with a
VHS videotape thereof.
19.) Restoration of Streets. Public Facilities and Private Properties - The Developer shall
restore all City streets and other public facilities and any private properties disturbed or damaged as
a result of Developer's construction activities, including sod with necessary black dirt, bituminous
replacement, curb replacement, and all other items disturbed during construction.
20.) Reimbursement of Costs - The Developer shall reimburse the City for all costs,
including reasonable engineering, legal, planning and administrative expenses incurred by the City
in connection with all matters relating to the administration and enforcement of the within
Agreement and the performance thereof by the Developer. Such reimbursement of costs shall be
made within thirty (30) days of the date of mailing of the City's notice of costs to the address set
forth in paragraph 28 below.

21.) Claims for Work - The Developer or its contractor shall do no work or furnish no
materials not covered by the plans and specifications and special conditions of this Agreement, for
which reimbursement is expected from the City, unless such work is first ordered in writing by the
City Engineer as provided in the specifications. Any such work or materials which may be done or
furnished by the contractor without such written order first being obtained shall be at its own risk,
cost and expense.
22.) Surety for Improvements - Deposit or Letter of Credit - For the purpose of assuring
and guaranteeing to the City that the improvements to be constructed, installed and furnished by the
Developer as set forth in paragraph 2 above, shall be constructed, installed and furnished according
to the terms of this Agreement, and to ensure that the Developer submit to the City as-built plans as
required in paragraph 8 and that the Developer pay all claims for work done and materials and
supplies furnished for the performance of this Agreement, the Developer agrees to furnish to the
City either a cash deposit or an irrevocable letter of credit approved by the City in an amount equal
to 150% of the total cost of said Improvements estimated by the Developer's engineer and
approved by the City Engineer. Said deposit or letter of credit shall remain in effect for a period of
one year following the completion of the required improvements. The deposit or letter of credit
may be reduced in amount at the discretion of the City upon approval by the City of the partially
completed Improvements, but in no event shall the deposit or letter of credit be reduced to an
amount less than 100% of the cost of the Improvements. At such time as all of the Improvements
have been approved by the City, such deposit or letter of credit may be replaced by a maintenance
bond.
23.) Insurance - The Developer shall take out and maintain during the life of this
agreement public liability and property damage insurance covering personal injury, including
death, and claims for property damage which may arise out of the Developer's work or the work of
their subcontractors, or by one directly or indirectly employed by any of them. This insurance
policy shall be a single limit public liability insurance policy in the amount of $1,000,000.00. The
City shall be named as additional insured on said policy and the Developer shall file a copy of the
insurance coverage with the City.
Prior to commencement of construction of the Improvements described in paragraph 2
above, the Developer shall file with the City a certificate of such insurance as will protect the
Developer, his contractors and subcontractors from claims arising under the workers'
compensation laws of the State of Minnesota.
24.) Laws. Ordinances. Regulations and Permits - Developer shall comply with all laws,
ordinances, and regulations of all regulatory bodies having jurisdiction of the Subject Property and
shall secure all permits that may be required by the City of Shorewood, the State of Minnesota, the
Minnehaha Creek Watershed Districts, and the Metropolitan Waste Control Commission before
commencing development of the plat.
25.) Local Sanitary Sewer Access Charges (LSSAC) - Developer shall, prior to release
of the final plat by the City, make a cash payment to the City in the sum of $21,000 ($1000 each
for the following lots: Lots 1-8, Block 1; Lots 2-11, Block 2; and Lots 1-3, Block 3) as local
sanitary sewer access charges. Credit has been allowed for Lots 9 and 10, Block 1 and Lot 2,
Block 2 with the existing homes on them.
26.) Municipal Water Charges - Developer agrees that a special assessment will be levied
against the following lots in the amount of five thousand dollars ($5000) per lot for City water:

Developer further agrees to pay trunk charges in the amount of five thousand dollars ($5000) per
lot to be levied against said lots. Developer has requested, and the City agrees, that these charges
and the special assessments will be paid as an assessment against each lot and will be paid over a
period of not to exceed fifteen (15) years at an interest rate not to exceed seven percent (7%).
27.) Park Fund Payment - Developer shall, prior to release of the fmal plat by the City,
make a cash payment to the City in the sum of $15,750 (21 x $750) for the Park Fund. Credit has
been allowed for the three lots with existing homes on them.
28.) Notices - All notices, certificates and other communications hereunder shall be
sufficiently given and shall be deemed given when mailed by certified mail, return receipt
requested, postage prepaid, with proper address as indicated below. The City and the Developer
by written notice given by one to the other, may designate any address or addresses to which
notices, certificates or other communications to them shall be sent when required as contemplated
by this Agreement. Unless otherwise provided by the respective parties, all notices, certificates and
communications to each of them shall be addressed as follows:

29.) Proof of Title - Developer shall furnish a title opinion or title insurance commitment
addressed to the City guaranteeing that Developer is the fee owner or has a legal right to become
fee owner of the Subject Property upon exercise of certain rights and to enter upon the same for the
purpose of developing the property. Developer agrees that in the event Developer's ownership in
the property should change in any fashion, except for the normal process of marketing lots, prior
to the completion of the project and the fulfillment of the requirements of this Agreement,
Developer shall forthwith notify the City of such change in ownership. Developer further agrees
that all dedicated streets and utility easements provided to City shall be free and clear of all liens
and encumbrances.

30.) Indemnification - The Developer shall hold the City harmless from and indemnify
the City against any and all liability , damage, loss, and expenses, including but not limited to
reasonable attorneys' fees, arising from or out of the Developer's performance and observance of
any obligations, agreements, or covenants under this Agreement. It is further understood and
agreed that the City, the City Council, and the agents and employees of the City shall not be
personally liable or responsible in any manner to the Developer, the Developer's contractors or
subcontractors, materialmen, laborers, or any other person, firm or corporation whomsoc::v~r, for
any debt, claim, demand, damages, actions or causes of action of any kind or char~cter ansmg out
of or by reason of the execution of this Agreement or the performance and completIon of the work
and Improvements hereunder.

3 1.) Declaration of Covenants. Conditions and Restrictions - Developer shall provide a
copy of the Declaration of Covenants, Conditions and Restrictions, which Declaration shall include
the City as a signatory thereto, for review and approval by the City prior to recording.
32.) Remedies Upon Default-
(01) Assessments. In the event the Developer shall default in the performance of any of
the covenants and agreements herein contained and such default shall not have been cured
within thirty (30) days after receipt by the Developer of written notice thereof, the City may
cause any of the improvements described in paragraph 2 above to be constructed and
installed or may take action to cure such other default and may cause the entire cost thereof,
including all reasonable engineering, legal and administrative expense incurred by the City
to be recovered as a special assessment under Minnesota Statutes Chapter 429, in which
case the Developer agrees to pay the entire amount of such assessment within thirty (30)
days after its adoption. Developer further agrees that in the event of its failure to pay in full
any such special assessment within the time prescribed herein, the City shall have a specific
lien on all of Developer's real property within the Subject Property for any amount so
unpaid, and the City shall have the right to foreclose said lien in the manner prescribed for
the foreclosure of mechanic's liens under the laws of the State of Minnesota. In the event
of an emergency, as determined by the City Engineer, the notice requirements to the
Developer prescribed by Minnesota Statutes Chapter 429 shall be and hereby are waived in
their entirety, and the Developer shall reimburse the City for any expense incurred by the
City in remedying the conditions creating the emergency.
(02) Performance Guaranty. In addition to the foregoing, the City may also institute
legal action against the Developer or utilize any cash deposit made or letter of credit
delivered hereunder, to collect, pay, or reimburse the City for:
(a) The cost of completing the construction of the improvements described in
paragraph 2 above.
(b) The cost of curing any other default by the Developer in the performance of
any of the covenants and agreements contained herein.

The cost of reasonable engineering, legal and administrative expenses
incurred by the City in enforcing and administering this Agreement.
(03) Legal Proceedings. In addition to the foregoing, the City may institute any proper
action or proceeding at law or at equity to abate violations of this Agreement, or to prevent
use or occupancy of the proposed dwellings.
(c)
33.) Headings - Headings at the beginning of paragraphs hereof are for convenience of
reference, shall not be considered a part of the text of this Agreement, and shall not influence its
construction.
34.) Severability - In the event any provisions of this Agreement shall be held invalid,
illegal, or unenforceable by any court of competent jurisdiction, such holding shall not invalidate or
render unenforceable any other provision hereof, and the remaining provisions shall not in any
way be affected or impaired thereby.
35.) Execution of Counterparts - This Agreement may be simultaneously executed in
several counterparts, each of which shall be an original, and all of which shall constitute but one
and the same instrument.

36.) Construction - This Agreement shall be construed in accordance with the laws of
the State of Minnesota.
37.) Successors and Assigns - It is agreed by and between the parties hereto that the
Agreement herein contained shall be binding upon and inure to the benefit of their respective legal
representatives, successors, and assigns.

RESOLUTION NO. 95-49
A RESOLUTION APPROVING CONCEPT AND DEVELOPl\IlENT STAGE PLANS
FOR HERITAGE P.U.D.
WHEREAS, Abingdon Development Corporation (Applicant) is the owner of real
property located in the City of Shorewood, County of Hennepin, legally described in
Exhibit A, attached hereto and made a part hereof; and
WHEREAS, the Applicant has applied to the City for approval of a Concept Plan
and Development Stage Plans for the construction of a residential planned unit development
known as Heritage P.U.D., containing twenty-four (24) single-family lots on
approximately 34.9 acres of land; and
WHEREAS, the Applicant's request was reviewed by the City Planner, and his
recommendations were duly set forth in a memorandum to the Planning Commission dated
4 April 1995, and in a memorandum to the Mayor and City Council dated 18 May 1995;
and
WHEREAS, the Planning Commission at its regular meeting of 2 May 1995
recommended approval of a Concept Plan and Development Stage Plans for the Heritage
P.U.D., subject to conditions; and
WHEREAS, the Park Commission at its regular meeting of 28 June 1994,
recommended that the City require cash in lieu of land as a park dedication requirement; and
WHEREAS, the Applicant's request was considered by the City Council at its
regular meeting of 22 May 1995, at which time the City Planner's memoranda and the
minutes of the Planning Commission were reviewed, and comments were heard by the City
Council from the Applicant and City staff.
NOW, THEREFORE. BE IT RESOLVED by the City Council of the City of
Shorewood as follows:
FINDINGS OF FACT
1. That the existing zoning of the property is R-lAlS, Single-Family
Residential/Shoreland.
2. That the total area of the property is approximately 34.9 acres, consisting of
five parcels, three of which are occupied by existing single-family dwellings, and of which
approximately 11.35 acres exists as City-designated wetlands.
3. That the Applicant proposes to divide the property into 24 single-family
residential lots, including three with existing homes on them. plus two outlots.

owners of lots within the plat.
CONCLUSIONS
A. That the density of the proposed P.U.D. is within the guidelines of the
Shorewood Comprehensive Plan and Zoning Code.
B. That the Applicant's request for Concept and Development Stage P.U.D.
approval for 24 single-family residential lots (including three existing homes) is hereby
approved. subject to the following conditions and restrictions:
I. Deed restrictions shall be recorded against Lot 9, Block 1 and Lot 1,
Block 2 stating that they will not be further divided.
2. The proposed pedestrian access to the commonly owned island shall
be developed with the site improvements and clearly identified as being owned and
maintained by the homeowner's association.
3. Protective covenants for the P.U.D. shall clearly set forth provisions
for protecting the wetlands (i.e. no dumping of yard waste, no fencing, no site
alteration. etc.).
4. A 35-foot natural buffer will be maintained adjoining all City
designated and Wetland Conservation Act wetlands
5. A I5-foot structure setback shall be maintained from the buffer areas
referenced in (d) above.
6. The Applicant shall dedicate wetland conservation easements over
the City designated and Wetland Conservation Act wetlands and the buffer area
required in (d) above.
7. Upon completion of fmal grading, the Applicant shall place survey
monuments locating the wetland buffer area on each lot.

cul-de-sac on the west side of the street so as to accommodate a 50-foot rear yard

shall be subject to the assessment and connection policies in effect at the time the
final plan is approved.
11. The Applicant shall submit a tree inventory and reforestation plan as

I think my opinion is well known, I do not believe either of the current
stop sign locations meet the warrants of the Uniform Traffic Control
Device tlanual. However, the proposal does make a lot of sense and comes
much closer, if not actually meeting, the warrants. tly only concern
would be that people do not later decide they want all three stop sign
locations, or even add a forth location at the other intersection of
Shorewood Oaks Drive and Oak Leaf Trail If it is a trade-off and WE
have to have the stop 'signs somewhere, it is a good one,

Review of Shorewood Oaks Stop Signs
Currently stop signs are located on Shorewood Oaks Drive at Burlwood Court and Maple
Leaf Circle. Councilperson McCarty has been approached by some Shorewood Oaks
residents suggesting that the Maple Leaf Circle stop signs be moved westerly to the west
intersection of Oak Leaf Trail and Shorewood Oaks Drive. The feeling is that this
intersection would serve a greater purpose for stop signs than Maple Leaf Circle because
Maple Leaf Circle is a short cul-de-sac where Oak Leaf Trail is a thru street. This proposal
is just now being sent on to Department Heads for comment, therefore we would request
that no action be taken until a later Council meeting when Department Head input can be
considered.
