SHOREWOOD, MINNESOTA 55331-8927 · (612) 474-3236 Executive Summary Shorewood City Council Meting Monday, August 26, 1996 Agenda Item 3A: This is a typical Subordination Agreement submitted by the Hennepin County Community Development Block Grant Program. This relates to a refmancing of the home of John and Robert Lebering. The motion is to authorize the Mayor and City Administrator to execute the Subordination Agreement. Agenda Item 3B: This is a request to block Noble Road for a block party for the hours of 5:00 p.m. to 10:00 p.m. on August 28, 1996. Although the City normally does not close a through street for such a long period of time, the street improvements have not yet been officially accepted by the City. The public works department can drop off barricades to be used which can easily be removed in case of an emergency. Agenda Item 3C: Due to a fairly significant remodeling project Roxanne Martin has been unable to complete the landscape berm for which she recieved a c.u.p. for in 1995. She requests, and the Planning Director recommends, an additional six-month extension to use the c.u.p. Agenda Item 3D: TQis is a motion to authorize the purchase a used sewer jetter from Flexible Pipe Tool Company for the amount of $ 14,377.50. The equipment replacement schedule calls for the '76 FNC Jetter to be replaced in 1996. The amount set aside is $22,803. This is within budget and the motion would be to authorize the purchase. Agenda Item 5A: Bill Blegen has submitted development stage plans and a preliminary plat for a four-lot p.u.d~ (Waters Edge) on the southeast side of Manor Road. The plans reflect the requirements imposed at the concept stage review. The Planning Director has recommended approval and the Planning Commission has agreed. Agenda Item 5B: JMS,the developer of the Waterford commercial area, proposes to complete the commercial element of the Waterford P.U.D. by building their home office on the last remaining site on Highway 7. The plans comply with the past approvals for Waterford. The Planning Director recommends approval subject to conditions and the Planning Commission recommended unanimously to approve the plans. Council approval requires a simple majority vote. A Residential Community on Lake Minnetonka's South Shore Agenda Item 5C: Cheryl and Martin O'Brien propose to rearrange the property line between their lot and their neighbor's (Jan Haugen) lot at 4780 and 4790 Lakeway Terrace. This is a very simple division and combination. The Planning Commission recommended unanimously to approve. Council approval requires a simple majority vote. Note: The proposed resolution referenced on the agenda will be distributed at the meeting on Monday night. Agenda Item 6: Jim Daniels and Jeff Foust will discuss the Cable Commission 1997 budget and upcoming telecommunications issues with the Council. Agenda Item 7: The original contract alternate for plantings and landscaping at the Southshore Senior Community Center was for $18,000. A bid tab is enclosed in the packet indicating three local landscape fIrms bid on the project. Staff is recommending to remain with the original bid. Agenda Item 8: Enclosed in the packet is a memorandum explaining the request of Linda Stem regarding abatement of charges levied as a result of non-compliance with the Sump Pump Inspection Program. Agenda Item 9: Each year delinquent utility accounts are assessed and levied for . collection with the next years property taxes. A notice of this assessment was mailed to all affected property owners. A public hearing is not required for these assessments but, as always, the City Council may hear public comments on the assessments at its discretion. The action required by the City Council is to review the delinquent rolls and to pass a resolution assessing the delinquent utility accounts. Agenda Item 10: This resolution establishes project budgets for the three 1996 watermain projects. It indicates the amount of funds needed from a 1996 borrowing. Agenda Item 11: Council asked that the policy regarding establishing a water availability charge in lieu of hooking up to the City water main be placed on this agenda for discussion. Tim Keane has concluded legal research and will be prepared to discuss it with the Council. Following discussion, Council should give direction to staff for preparation of an ordinance to be considered at a later date. Agenda Item 12A: Council asked the Administrator to check with the City of Tonka Bay regarding allowing dogs at Crescent Beach. Because we have not found a history of problems perhaps no action is necessary. Agenda Item 12B: The City has been asked to respond to a questionnaire regarding the level of response we expect on carbon monoxide alarm calls. The Cities of Excelsior, Tonka Bay and Greenwood all have indicated a level three response, which I recommend as well. At this level the police is to contact the complainant either in person or by phone and advise the complainant on the course of action. Any indication of illness results in a level one response. Please review the questionnaire in the packet. .' Bob Rascop appeared and expressed concern with respect to the quality of the water he is receiving. Mr. Rascop noted the water has changed color from white to brown. City Engineer Brown explained there is a difference between the Shorewood and the Tonka Bay systems and explained a milky color to the water is created by air trapped in the water line. In addition, when there are high demands, such as sprinkling, there tends to be a higher iron content in the water. Brown further explained when the new water tower is on line, there will be a more steady pressure which will assist in resolving this problem. Ingrid Schaff, 25605 Smithtown Road, appeared and addressed the Council on behalf of the residents who use the trail for nonmotorized activities. Ms. Schaff asked the Council, when considering the Task Force recommendations, to consider the approximately $20,000 which has been committed to this issue, the unknown additional moneys which will need to be spent to comply with the Task Force recommendations and the public opinion survey. Ms. Schaff asked the Council to read the verbatim comments from the citizens as well as those from the police . officers' interviews. She also asked that the Council look at the escalation of complaints by . residents on all parts of the trail and city. Ms. Schaff stated she supports a complete ban of snowmobiles. She expressed her belief the City needs to devote park and recreation resources to things which benefit more citizens, families and children in Shorewood. 5. PARKS - Report by Representative A. Report on July 23, 1996 Meeting Commissioner Puzak reviewed the matters considered at the July 23, 1996 meeting of the Parks Commission (as detailed in the minutes of that meeting). B. Report on Underground Wiring at Badger Park Commissioner Puzak explained the Park Commission is recommending to the City Council that the remaining money which was to be used for moving the hockey rink be redirected to pay for installing underground wiring for the football lights and to relocate one tree to another area in Badger Park. ., . . REGULAR CITY COUNCIL MINUTES AUGUST 12, 1996 - PAGE 3 Shaw moved, McCarty seconded approving the allocation of funds for relocation of the football field, burial of the electrical power service and the relocation 0 f one tree. Motion passed 5/0. C. Recommendation to Not Allow Dogs at Crescent Beach During Swimming Season Commissioner Puzak noted a recommendation had been made to request City Council to change the ordinance to not allow dogs at Crescent Beach during the swimming season. Stover inquired if there had been a problem with this at the beach. Councilmember Shaw suggested directing staff to discuss this issue with Tonka Bay to ascertain if this is an issue. Councilmember Benson felt the Shorewood ordinance should be consistent with that of Tonka Bay. 6. PLANNING - Report by Representative Commissioner Turgeon reviewed the matters considered and the actions taken by the Planning Commission at their meeting on August 6, 1996 (as detailed in the minutes of that meeting). With respect to the ball fields for Minnetonka School District 276, Commissioner Turgeon noted two wetland basins had been identified on the property and the school has requested the Minnehaha Creek Watershed District exempt an old sewage treatment lagoon in the northwest quadrant site and an easterly lobe of the southerly wetland area. Woody Love appeared noting he is a member of the Minnehaha Creek Watershed District. He explained the engineers from the Watershed District had spent time with members of the school in an attempt to resolve this issue, however, upon a vote of 5-2, the Watershed Board voted to deny the request of the school and chose to remain consistent with their policy to allow only wet retention ponds. Mayor Bean asked if the Watershed District would be allowing the old sewage pond to be modified. Mr. Love stated the Board had responded only to the issue of the wet retention pond. He explained the other ponds are being reviewed by a technical panel and the Watershed Board will consider them at their next meeting. Hurm noted the School District is concerned with having a standing wet pond. He asked if there would be any way to work with the School District to allow for additional soccer and baseball fields which are needed. Mr. Love stated in congested areas, the population puts additional demands on the environment. He stated the environment still has an important role and that these resources must be preserved. 7 . DISCUSSION WITH COMMISSIONER FOUST REGARDING TELECOMMUNICA TION ISSUES Commissioner Foust was unable to attend the meeting due to the birth of his daughter. City Administrator Hurm stated Commissioner Foust had related to him that Triax Cable Vision is interested in an early renewal of their contract. They would like to complete this prior to February. Commissioner Foust will plan to address the Council at their next meeting. 8. CONSIDERATION OF A MOTION TO ADOPT A RESOLUTION AUTHORIZING CHANGES IN TRAFFIC CONTROL FOR SHADY HILLS NEIGHBORHOOD 'c, REGULAR CITY COUNCIL MINUTES AUGUST 12, 1996 - PAGE 4 City Engineer Brown addressed this issue and reviewed it in detail. Mayor Bean asked for the estimated cost of this channelization plan and Brown noted a cost estimate had not been compiled, but he estimated the cost to be approximately $2,800 to $3,500. Brown explained the proposed signs would be put in place and monitored for one year. If complaints are still being received at the end of one year, then an origin destination study would be completed. Councilmember Shaw felt a two or four hour restriction of turning movements would be more appropriate than a 24-hour restriction. Brown indicated the residents had requested a very defInite time period. McCarty moved, Stover seconded, adopting RESOLUTION NO. 96-73, adopting traffic control changes at the intersection of Brohm's Boulevard and Shady Hills Road as noted in Alternative No. 1. Motion passed 5/0. 9. CONSIDERATION OF A MOTION TO APPROVE REQUEST BY SPRINT SPECTRUM TO APPL Y FOR A CONDITIONAL USE PERMIT TO LOCATE ANTENNAS ON SOUTHEAST AREA WATER TOWER . City Administrator Hurm addressed this issue and explained it in detail. Stover moved, McCarty seconded approving a request by Sprint Spectrum to apply for a Conditional Use Permit to locate antennas on the southeast area water tower. Motion passed 5/0. 10. CONSIDERATION OF A MOTION TO ADOPT A RESOLUTION SETTING A PUBLIC HEARING AND SUBSEQUENT HEARING ON THE PROPOSED 1996 MUNICIPAL BUDGET Stover moved, Benson seconded to set the Board of Canvass Meeting for Wednesday, November 6, 1996 at 5:30 p.m., and Regular City Council Meeting dates for Tuesday, November 12, 1996, Monday, November 25, 1996, Wednesday, December 4, 1996, Thursday, December 12, 1996 (if needed), and December 16, 1996. Motion passed 5/0. 12. CONSIDERATION OF A MOTION TO ADOPT A RESOLUTION ACCEPTING THE BIDS AND AWARDING CONTRACT FOR SCADA EQUIPMENT FOR MINNEWASHTA WATER TOWER, BOULDER BRIDGE & BADGER FIELD WELLS AND METERING STATION CITY PROJECT 96-2 City Engineer Brown reviewed this matter in detail noting the low bid was made by Automatic Systems Company in the amount of $46,789. Motion passed 4/1; Stover was the dissenting vote. 13. CONSIDERATION OF MOTIONS REGARDING IMPROVEMENT PROJECTS 1997 CAPITAL A. A Motion to Adopt a Resolution for Expenditure of Funds for Preliminary Survey Work by OSM & Associates . City Engineer Brown reviewed this matter noting OSM & Associates has presented a proposal of $29,300 for this survey work. Councilmember Shaw felt $29,300 was an excessive amount to be expended on this work. Brown stated this work could be put out as a competitive bid and brought back for the Council's consideration at the next regular meeting. It was the consensus of the Council to seek competitive bids. Shaw moved, Stover seconded, directing staff to obtain competitive bids from two competent engineering firms to be selected by the City Engineer and the City Administrator in addition to the bid which has been received from OSM & Associates for the preliminary survey work for the 1997 CIP projects. Motion passed 5/0. B . A Motion to Adopt a Resolution Authorizing the City to Enter into an Agreement with OSM & Associates for Professional Services Benson moved, McCarty seconded to table this matter. Motion passed 5/0. 14. ADMINISTRATOR & STAFF REPORTS . A. Review of Spring Clean-up Charge Policy City Administrator Hurm noted a letter had been received from Chester Yanik, 4245 Enchanted Lane, with respect to the spring cleanup fee. Councilmember McCarty inquired how many residents utilize curbside pickup and if it would be possible to designate drop off sites as opposed to curbside pick up. Councilmember Benson noted a number of residents utilize the curbside pick up. Councilmember McCarty commented she could understand the concerns of the residents who do not utilize this service. Councilmember Benson feels' that everyone benefits from the service in that trash is disposed of. It was noted the $6.50 charge covers a pick up in the spring and in the fall, although the fall program is smaller than the spring program. It was the consensus of the Council that no action would be taken on the issue of the spring cleanup fee. B. Review South Lake Minnetonka Public Safety Department 1997 Proposed Budget City Administrator Hurm reviewed this matter noting the per capita costs to Shorewood are quite low. Mayor Bean noted the amount of time which was spent in Shorewood has risen from 39.8 percent to 47.1 percent. Councilmember Stover expressed her feeling that all of the cities involved are receiving a good service. REGULAR CITY COUNCIL MINUTES AUGUST 12, 1996 - PAGE 6 Stover moved, McCarty seconded approving the South Lake Minnetonka Public Safety Department 1997 Proposed Budget. Motion passed 5/0. C. Review Excelsior Fire Department 1997 Proposed Budget City Administrator Hurm reviewed this matter noting the budget is approximately $2,000 less than had been projected four years ago. He further noted the budget is based on the number of calls and tax capacity. Shorewood's share is increasing approximately 8 percent due to an increase in calls. Councilmember Stover noted Excelsior and Shorewood appear to have the same number of calls even though the populations are not consistent. Hurm noted this would include medical calls in addition to fIre calls. D. Engineer's Report on the Status of the Water Tower City Engineer Brown commented on the fatality at the water tower on July 28, 1996. He noted the work crew is back on the site this week and proceeding with work. It is anticipated sandblasting and painting will begin on August 13th. Brown stated a number of calls have been received with respect to a disease common to people exposed to sandblasting operations and explained that Star Blast, a product manufactured by DuPont which is not a silica based product, will be used in this sandblasting process. In addition, wind conditions will be monitored by a construction observer. It is anticipated the outside of the tower will be completed by September 2nd with the inside to be completed by September 20th. Paint will be applied by roller and lead based paints will not be used. E. Discussion by City Attorney Regarding Smithtown Road City Attorney Coyle stated he met with City Staff and discussed concerns raised by residents adjacent to the right-of-way on Smithtown Road. Questions were raised as to the concise defInition of right-of-way. The City Attorney has advised staff the project, as approved, complies with the ordinance as well as state statute. The feasibility report and construction plans as approved are consistent with that feasibility report and staff should proceed as directed by Council. The City Attorney has advised staff if a situation arises where residents or adjacent property owners have increased concerns to the point where they choose to use physical measures to attempt to prevent completion of the project on the schedule which has been planned, the City Attorney would recommend the City initiate whatever legal action is required to ensure the project not endanger anyone, that the schedule be maintained, and that the City's scarce resources are efficiently used to complete the project as directed by the Council based on the approval of the feasibility report. In addition, the City Attorney would recommend that City Staff be directed to clearly demarcate where the City's right-of-way boundary is either through the use of construction boundary tape or other appropriate signage and markings and to inform the property owners through the placement of the markings where the City's right-of-way boundary is and that specifIc concerns should be brought to the staff. Staff should monitor compliance with that safety boundary to ensure there is no encroachment into the boundary and that the work of the contractor is not impeded. Mayor Bean explained this came about as a result of rumors people may stand in the way of construction or park vehicles in the way of the construction area. He noted the main concern is someone will be hurt in the process. " . . .' , REGULAR CITY COUNCIL MINUTES AUGUST 12, 1996 - PAGE 7 Councilmember Shaw inquired how the right-of-way could be delineated when it has not been determined. City Attorney Coyle explained the basis for the City's claim for the right-of-way exists by statute as well as by the granting of the right-of-way by the State of Minnesota to the City of Shorewood. The City's obligation is to use the right-of-way consistent with statute and court precedent for transportation and other valid purposes related to utilities that are consistent with the use of that right-of-way. City Administrator Hurm indicated where a property owner questions the City's actual ownership of the land, the City has indicated they will stay within the street area. Mayor Bean noted that would be the case unless an easement had been granted to the City, which a number of property owners have done, or there is a platted statutory right-of-way. Councilmember McCarty inquired in cases where the City has the 66-foot right-of-way and the resident is impeding progress what type of action would be taken. City Attorney Coyle noted after Council authorization, a Court Order would be sought. Attorney Coyle requested authorization to proceed with obtaining a Court Order should that become necessary and secondly, to direct staff to mark the boundaries as they understand them based upon the direction given staff by the City Attorney. Attorney Coyle also asked that staff work with properties owners who have a bona fide basis to say the right-of-way line is not 66 feet. Mayor Bean stated it is imperative it be made clear public safety is apriority. . Mayor Bean recessed the meeting at 9:33 p.m. and reconvened at 9:35 p.m. Councilmember Shaw felt the use of construction tape would prompt a dispute with some property owners. Mayor Bean noted the tape would be used to simply identify a construction zone, however, if a problem arises, the police officers will have instructions which define what the limits are. Councilmember Benson felt this should be discretionary between City staff, the City Engineer and the contractor. He also felt the tape would be difficult to maintain and some property owners will be offended by it. Benson moved, McCarty seconded directing staff that City Engineer Brown and the Engineering Staff will have authority to establish the construction limits on an as needed basis and will include the City Attorney in pursuing whatever relief is necessary to preserve the public safety. MAYOR & CITY COUNCIL REPORTS Councilmember Benson stated in reviewing the prior Work Session Minutes he felt the Council should address the issue of abandoning the mandatory hook up. He requested this issue be added to the agenda for the next meeting. City Administrator Hurm noted it is scheduled for consideration in September. Councilmember Stover added she would like the policy on the comer lots addressed at the same time. Mayor Bean noted Mr. Svoboda's issue needs to be addressed prior to September. City Administrator Hurm noted the two issues to be considered are the location of the hook up and when the watermain first goes by is it at that point assessable. Mayor Bean stated with respect to Mr. Svoboda's concern, in terms of where the valve is positioned, City staff should be directed to place it where it makes sense to Mr. Svoboda and the Engineering staff. 16. CONVENE WORK SESSION MEETING DR FT Mayor Bean called the meeting to order at 10:03 p.m. A. Roll Call Present: Mayor Bean; Councilmembers Stover, McCarty, Benson and Shaw; Administrator Hurm; Intern Jason Hendrickson; and Snowmobile Task Force Co-Chair Virginia Kolstad. B. Review Agenda There were no changes to the agenda as noticed. 2. DISCUSSION REGARDING IMPLEMENTATION TASK FORCE RECOMMENDATIONS OF SNOWMOBILE City Administrator Hurm provided a Memorandum from City Intern Jason Hendrickson with respect to the Snowmobile Task Force Recommendations. Hurm made the recommendation if the City is interested in establishing this program, the City Administrator should be held responsible for it. He stated one of the recommendations of the Task Force was there be a body to ensure the program and people involved are held accountable. Hurm noted he would suggest establishing a committee of people committed to having the program and making it work. Hurm suggested this committee meet monthly and include the City Intern to ensure proper implementation. He further stated the City Council would need to make the determination as to whether the program is working successfully or not. Mayor Bean inquired if the advisory committee would be long term. Hurm stated from an accountability standpoint it would need to be long term. However, it could be an administrative committee in charge of keeping up with changing priorities. Councilmember Stover pointed out this would be assuming changes would be made which require constant surveillance and if the position were to be taken snowmobiles were not to be allowed on the trail, a great number of the recommendations would not need to be utilized. Hurm stated his assumption was the Task Force recommendations would be accepted. Administrator Hurm noted with respect to safety, a major recommendation of the Task Force was if snowmobiles are allowed on the trail, that it is important cross country skiers and walkers feel they can get off of the trail. Councilmember McCarty stated she would not be in favor of a side trail. Hurm stated the recommendation does not ban anyone from the trail, however, a side trail would be an alternative if a walker were not comfortable on the trial. Councilmember McCarty felt walkers would be giving up concessions and giving all of the power to snowmobilers. #;lB ... City Intern Hendrickson noted there would not be sufficient space to provide for snowmobiles. Councilmember Stover noted the trail is identified as a nonmotorized trail during the summer and this somehow changes in the winter time. Councilmember McCarty concurred with this statement. Councilmember McCarty pointed out the Council would need to decide whether or not to accept the recommendations of the Task Force and that nothing should be assumed in this process. Mayor Bean asked if snowmobiling should be allowed in Shorewood. Councilmember McCarty agreed there was not an overwhelming majority of citizens asking that snowmobiles be banned from Shorewood. Councilmember Stover stated she was not suggesting snowmobiles be banned from Shorewood. Mayor Bean inquired where snowmobiles should be allowed to operate with respect to the trail, streets and parks. Councilmember Stover pointed out the Park Commission has said no to snowmobiling in the parks. Councilmember Benson concurred with this. Mayor Bean asked if snowmobiles should be allowed on the streets and Councilmembers Stover . and McCarty felt they should be. Mayor Bean further inquired if snowmobiles should be allowed on every street and Councilmember McCarty stated her agreement. Mayor Bean suggested if snowmobiles were allowed on the streets, certain trail streets could be designated. Councilmember Benson stated his agreement with allowing snowmobiles on the street. Councilmember Stover stated streets are intended for motorized vehicles. Mayor Bean asked, with respect to snowmobiles utilizing city streets, if they should be allowed to travel on the paved surface or on the right-of-way or only on paved surfaces. Councilmember McCarty pointed out the right-of-way changes. Councilmember Stover stated the Task Force recommended snowmobiles travel on the street side of the snow plow strip. Mayor Bean noted the Council would attempt to draft an ordinance allowing snowmobiles on City streets within the plowed street surface. Mayor Bean asked for comments on allowing snowmobiles on the regional trail. Councilmembers McCarty and Stover were opposed to this. Councilmember Benson stated if snowmobiles were banned from the trail, it would be difficult to enforce this. There would also be a matter of . expense. Councilmember Benson also noted the trail would need to be plowed if it were maintained for walkers and this would result in another level of expense and the way the trail is presently maintained, it is not at an expense to the City. Mayor Bean felt the City could choose not to maintain the trail. Councilmember Stover stated her opinion that it would be inappropriate to mix the two uses unless it were possible to separate the two trails 100 percent with a wall. She further noted the side trail comes and goes and is not continuous. Councilmember Stover felt it was impractical and too expensive to build a side trail. Councilmember Stover stated her concern is purely safety. Kolstad noted the issue of the side trail was to use it for a year and if it were successful, it would be worthwhile to spend the money to make the trail go all the way through. Mayor Bean asked if it would be possible to run a complete second trail. Kolstad noted it would be difficult due to the proximity of trees and wetlands in some locations. Councilmember Benson felt even if snowmobiles are banned, enforcement would be an issue. The second issue is the expense with grooming the trail for nonmotorized use. He did not feel that banning snowmobiles from the trail would be an improvement CITY COUNCIL WORK SESSION MINUTES AUGUST 12, 1996 . PAGE 3 Councilmember Shaw stated he did not feel banning snowmobiles would be the answer, however, he would be in favor of splitting the trails. Mayor Bean noted he was inclined to agree that snowmobiles should be allowed in the City and he would like to see as much separation as possible on the trail. He stated he did not feel it would be appropriate to ban them on the trail at this time. Councilmember McCarty inquired why snowmobiles were considered compatible with trail use when it has been determined they are not compatible with park use. She noted this to be strictly a public safety issue. She stated this is a passive use trail and motorized vehicles should not be allowed. Councilmember Stover asked who is responsible for enforcement on the trail. Mayor Bean stated Hennepin Park Rangers were responsible to some degree. Kolstad stated the DNR is out on the trail somewhat, generally looking for registration violations. She noted Shorewood will need to look at enforcement on the trail. . Councilmember Stover stated she would not be in favor of spending a lot of money on enforcement. She noted if the Shorewood officer had the time and the necessary equipment to use, that would be a possibility. Councilmember Stover stated the ordinance change recommendations in the Task Force report are good, yet enforcement will continue to be difficult. Councilmember Stover further inquired if the Hennepin County Sheriff or Hennepin Parks could participate in enforcement. Hurm stated that would be the intent. Mayor Bean commented the police department would need to have clear directives from the City with respect to enforcement. Mayor Bean felt the enforcement authority would need to have a snowmobile. Additional signage would be necessary as well. Councilmember McCarty expressed her opinion that there be an inordinate number of signs on the trail to keep the snowmobilers informed of the various rules associated with use of the trail. . Councilmember McCarty felt if there were consistent enforcement over the first two years that the usage of the people violating the law would decrease over time. If that were the case, perhaps the City could lease a snowmobile as opposed to purchasing one. Councilmember Benson felt a snowmobile would be needed to monitor enforcement. Mayor Bean felt more than one snowmobile may be necessary in light of medical emergencies which may arise. As an added value, the snowmobile would also be available to South Lake Emergency Response and would provide a benefit to the entire community. Councilmember Stover suggested if a decision is made to allow snowmobilers on the trail with strict restrictions and good enforcement, she would like to consider a time period of one year only and if those measures do not stop the problem, then snowmobiles would be banned from the trail in future years. Mayor Bean suggested this be communicated to all of the associations. Councilmember Benson noted a special study session may be necessary given the various upcoming meetings. Public Works uses this machine to open up clogged sanitary sewer and storm sewer lines. Design standards for sanitary sewer recommend spacing of manholes for access at a distance of 400 feet. Problems occur with our current jetter when clearing an obstructed sewer line where the obstruction is greater than 300 feet beyond the manhole, due to lack of power of the pump. This forces the operator to jet the pipeline from the upstream end of the pipe. This is undesirable since the water used to jet the line has no where to drain. .. . Staff obtained estimates for a larger machine to address this problem. Estimates received were all close to the $25,700.00 range as shown in attachment 1. This is well above what we had budgeted for replacement. During our research, staff discovered that Flexible Pipe Tool Company has a used 1987 jetterofthe size and type we desire. This machine has been.traded in and has been re-manufactured by the supplier. After inspection of the machine by myself and our mechanic, we believe that this machine will address our needs. The dealer has quoted a price of$14,377.50 including sales tax and trade in of our current machine (refer to attachment 2). MINNEWASHTA ELEMENTARY SCHOOL Applicant: Minnetonka School District 276 represented by S.E.H., Inc. 26350 Smithtown Road Location: . Planning Director Nielsen reviewed the procedures for a public hearing. Vice Chair Pisula announced the case and Nielsen reviewed the matter in detail. City Engineer Brown addressed engineering concerns relative to this project. Scott Herrick of Short, Elliot, Hendrickson, Inc., addressed the Commission noting he is in agreement with the recommendations of City staff. With regard to the need for additional parking at some future time, it may not be feasible to provide hard surface parking. He suggested it may be more feasible to look at alternatives such as semi-hard surface parking. Gene George, Supervisor of Buildings and Grounds, Minnetonka Schools, also addressed the Commission with respect to overflow parking which would be available during events which would be held. Vice Chair Pisula opened the public hearing at 7:25 p.m. Diane Anderson, 3441 Lowell Street, Wayzata, appeared and related her support for a soccer field on behalf of Tonka United Soccer Association. Ms. Anderson explained the difficulty the Association has encountered in obtaining fields for use and noted three of the available fields represents a danger with respect to fly balls. She further stated soccer would not create a parking problem since soccer is a summertime sport and although it would extend into the fall, games are held only on weekends. -41-5 .' "J PLANNING COMMISSION MEETING AUGUST 6,1996 - PAGE 2 Kevin Sheppard, 26410 Smithtown Road, explained he is the resident adjacent to the site and stated he did not have any problem with the project and noted his concerns with respect to potential parking situations had been answered by Planning Director Nielsen. Mr. Sheppard also expressed concern with respect to Smithtown Road and the hazard it presents with respect to the width of the road and the 30 mph speed limit which needs to be enforced. Mr. Gene George expressed his appreciation to City staff for their cooperation and assistance on this project. Molly Rothstein, 26705 Noble Road, inquired how much of the site would be visible to residents in the area and how many trees would be affected by this project. She further inquired if there is any plan to screen the field. Mr. Herrick addressed this issue and explained the landscaping which is expected on this site. Vice Chair Pisula closed the public hearing at 7:36 p.m. Commissioner Lizee expressed concern with respect to parking and the heavy use it could . potentially generate. She further stated her approval of the addition of the soccer field and inquired if there would be future plans for the addition of another soccer field in the future. Mr. George stated that with the use of cones, soccer play could be created on the grass fields which are currently available. Commissioner Kolstad inquired as to potential plans for lighting. Engineer Brown stated that was not a part of the application and Mr. George confirmed there would not be future plans for the addition of lighting. Commissioner Rosenberger made suggestions with respect to potential landscaping. Mr. George was in agreement with the suggestions and noted he had plans along those lines as well. Commissioner Rosenberger suggested Mr. Sheppard, as an adjacent neighbor, may want to consider landscaping prior to the addition of any future parking spaces. Commissioner Rosenberger noted the Planning Commission recognizes the issue with respect to pedestrians and motorized vehicles on Smithtown Road and pointed out when the Commission attempted to address this issue, the Smithtown Road neighborhood had been opposed to any . changes in that area. Commissioner Foust suggested perhaps the Commission should review this issue. Commissioner Rosenberger stated he would be willing to once again address this issue, however, he felt this should be initiated by the neighborhood. Commissioner Turgeon asked what plans had been made with respect to restoration of wetland vegetation. Nielsen stated a landscape professional would handle this issue. Commissioner Turgeon asked for clarification of the statement which indicated fencing would be as high as practical. Mr. George stated it is contemplated the fence would be approximately 12 feet tall. Vice Chair Pisula inquired how many vehicles could be accommodated if the hard surface play area behind the school were to be used for additional parking. Mr. George felt approximately 100 cars could be accommodated. Commissioner Lizee noted her support for this project and suggested residents be encouraged to car pool in an effort to reduce any parking difficulties. Turgeon moved, Lizee seconded to amend the C.D.P. for grading ball fields at the Minnewashta Elementary School, for Minnetonka School District 276, 26350 e. \. PLANNING COMMISSION MEETING AUGUST 6,1996 - PAGE 3 Smithtown Road, subject to Watershed District approval, staff recommendations and school events and recreational events not being scheduled on the same evenings. Motion passed 6/0. . Vice Chair Pisula noted this request will come before the City Council for their consideration on Monday, August 26, 1996. 2. DEVELOPMENT STAGE PLANS/PRELIMINARY PLAT EDGE P.U.D. WATER'S Applicant: Bill Blegen 20295 Manor Road Location: Vice Chair Pisula announced the case and asked Planning Director Nielsen to reVIew the applicant's request. . Kevin Norby, a registered, licensed architect, appeared on behalf of the applicant and addressed the Commission explaining he had been working with Mr. Blegen relative to the development of the subject property. He stated the adjacent neighbors had been consulted and noted positive comments had been received from the City Council as well. Rosenberger moved, Turgeon seconded approving the development stage plans/preliminary plat - Water's Edge P.U.D., for Bill Blegen, 20295 Manor Road, subject to staff recommendations. Motion passed 5/0. (Commissioner Foust was not present for consideration of this request.) Vice Chair Pisula noted this request will come before the City Council for their consideration on August 26, 1996. 3. SITE PLAN REVIEW - JMS OFFICE BUILDING Applicant: Waterford Partners, LLC . Locatiun: 19685 State Highway 7 Vice Chair Pisula announced the case and asked for an analysis of the matter from Planning Director Nielsen who reviewed the request in detail. Dave Siebold, JMS Companies, Inc., was present and addressed the Commission. He noted this is the final site of the Waterford property to be developed. He further noted he is in full agreement with the recommendations of City staff. Commissioner Foust inquired if this would be a multi-tenant building. Mr. Siebold stated it is intended to be multi-tenant and although leases have not been signed at this point, he is currently in negotiations with a potential tenant who would use approximately half of the building. Commissioner Foust expressed concern with the level of traffic which would be generated by multi tenants. Nielsen noted office buildings would typically not produce excessive traffic. Commissioner Foust asked if a lighting plan had been included in the request. Mr. Siebold stated the Waterford P.U.D. contains restrictions with respect to lighting, however, lighting plans could be submitted for approval. ; PLANNING COMMISSION MEETING AUGUST 6,1996 - PAGE 4 Commissioner Foust asked Mr. Siebold to address the issue of signage. Mr. Siebold stated in the case of multi tenants, individual signage would be considered, however if a single user tenant were to be obtained, a larger, illuminated sign would possibly be more desirable. Planning Director Nielsen stated some signage had been anticipated, however multiple signage for each individual tenant would require a separate Conditional Use Permit. Nielsen noted this had not been anticipated for the Waterford P.U.D. Commissioner Lizee inquired if employee space such as picnic tables would be anticipated in the area behind the building. Mr. Siebold stated some thought had been given to that possibility. Nielsen also pointed out with respect to trash facilities, if an outside dumpster were to be considered, it would need to be an enclosed, masonry screened facility. Turgeon moved, Lizee seconded approving the site plan review of the JMS Office Building for Waterford Partners, LLC, 19685 State Highway 7, subject to staff recommendations, and changes to staff recommendations, changing No. 2(b) to read, "Plant low growing evergreen shrubs and two ash trees at berm to soften view." Mr. and Mrs. O'Brien were present along with Jan Haugen who addressed the Planning Commission. Ms. Haugen expressed her appreciation to the Commission for the action taken on the previous request with respect to the Waterford property. Ms. Haugen also noted her appreciation to the . Planning Commissioners for their time and service on the Planning Commission. Ms. Haugen stated she is having discussions with Ms. O'Brien and is optimistic an agreement will be reached. REPORTS Planning Director Nielsen asked for Planning Commission input with respect to the Shorewood Shopping Center site. He noted a potential developer is interested in buying and upgrading the shopping center in conjunction with the Driskill property which includes the Baker parcel and the vacant office building site as well. Nielsen presented sketches of the proposed development for comment by the Commission. Potentially a Super Valu store would be considered. If the developer were to develop the adjacent property in addition to the shopping center site, tax increment financing would possibly be considered. Nielsen noted it would be preferable to have an overall development of the property as opposed to just the shopping center property. It was the consensus of the Planning Commission the area is in need of renovation and they would prefer to see an overall site improvement. Commissioner Foust noted Triax Cable Communications has petitioned the Cable Commission for early franchise renewal. Their current franchise would not expire until 1999. Commissioner Foust explained the potential benefits to the City of Shorewood with respect to an early renewal. 7. TO: FROM: DATE: RE: FILE NO.: Planning Commission, Mayor and City Council Brad Nielsen 1 August 1996 Water's Edge P.D.D. - Development Stage Plans I Preliminary Plat 405 (95.38) In January of this year Bill Blegen received concept stage approval for a four-lot subdivision named Water's Edge P.D.D. The applicant has now submitted development stage plans and a preliminary plat for the project. Following is how the plans conform to the conditions of the concept stage approval which were set forth in City Council Resolution No. 96-12: 1. The northerly 20 feet of the property is shown as right-of-way for Vine Street. 2. Building sites have been identified for all four lots (see Exhibit A). The building sites have been located minimizing tree removal, maximizing wetland protection and avoiding steep slopes at the south end of the site. e Approximately one-half acre at the rear of Lot 2 is proposed to be protected by a conservation easement. The conservation easement adjacent to Outlot A is as much as 20 feet larger than required by Shorewood's Wetland Code. 4. Proposed access has been shown for each lot. The driveway for Lot 1 is located on Vine Street. Lots 2 and 3 will share a driveway along their common boundary. Access to Lot 4 is shown from the cul-de-sac. The City has agreed to consider direct access to Manor Road upon review of a future detailed site plan. 3. 5 . The tree preservation and landscaping plan shown on Exhibit B includes 10 replacement trees. Additional replacement trees will be required for those removed as part of future home construction on Lots 3 and 4. 6. City water is proposed to be extended from the Amesbury system located on the north side of Manor Road. 7. The large wetland (Footprint Lake) is set aside as an outlot to be dedicated to the City. MINNESOTA 55331-8927 · (612) 474-3236 MEMORANDUM TO: Planning Commission, Mayor and City Council p FROM: Larry Brown e DATE: August 5, 1996 RE: Minnewashta Elementary School - Modifications to CUP Background The Minnetonka School District has submitted plans for re-grading the Minnewashta Element~lry .~:chooi property for construction of additional ball-fields on the west portion of the property. (refer to attachment A). Grading and Drainage The grading plan proposes average cuts and fills of approximately 4 feet. There are areas of the site that will have cuts of 8 feet along the easterly portion of the proposed soccer field. However, large cut and fills are limited in area and should not impact the site. e. The plan also proposes construction of a sedimentation pond at the north end of the site. This pond is unique in that the engineers have proposed using a percolation pond that utilizes a rock filter and drain tile system to filter out sediments prior to discharge. This was a compromise to a wet detention basin by the Minnehaha Creek Watershed District due to the concentration of young children which will utilize this facility. During heavy rainfall events the storm sewer system will serve as the outlet to the pond. Once the level of the water has subsided below the storm sewer outlet, the remaining 4 feet of water will gradually percolate out through the proposed rock and field tile drain system. Since the outlet to the pond is immediately adjacent the existing sedimentation area, the drainage pattern has remained unchanged. The high water level for the pond during the 100 year event is 957.6 which is well within the confines of the pond which has been designed. The applicant's engineer has submitted storm sewer calculations which demonstrate that the predeveloped runoff rate has been maintained for the 10 year frequency event. This is in accordance to the City code. . A Residential Community on Lake Minnetonka's South Shore Minnewashta Elementary School Proposed Ball Fields August 5, 1996 Page 2 of2 The outfall structure has been designed as a drop manhole structure to decrease outlet velocities and to minimize the potential for erosion. It is recommended that the outlet pipe be revised such that the outlet velocity is 3.5 feet per second or less for the 10 year frequency event. Erosion Control The plan indicates that erosion control fencing is to be placed between the grading operations and any downstream areas. . Existing Utilities The existing 12 inch diameter corrugated metal pipe which serves as the outfall for the existing ponding area is scheduled to be abandoned by plugging both ends of the pipe. The plan needs to be revised to include blowing the pipe full of sand prior to the bulkheads being placed to insure that a settlement does not occur in the future. In addition, the bulkheads shall be constructed utilizing concrete. Recommendations It is recommended that the proposed amendments to the CUP as proposed on the grading and drainage plan dated July 11, 1996 be approved contingent upon the fOllowiI'!g conditions: . 1. The outfall pipe for the ponding area be revised such that the outlet velocity be 3.5 feet per second or less during the 10 year 24 hour frequency event. 2. DATE: August 19, 1996 RE: Consideration of Excepting Quotes for Landscaping for the South Shore Senior Community Center On June 24, 1996 the City Council awarded the bid for the construction of the South Shore Senior Center to GEH Construction contingent upon the contractor holding his bid for the landscape portion of the project for 60 days. This was to allow TSP/EOS to re-bid the landscape portion of the project to try to attain a better price. Attachment one shows the results of the quotes. The low bidder for the landscaping is Johnson Lawn for the amount of$16,668.00. The Council may recall that the bid alternative submitted by GEH was for $18,000.00. . After review of the results, both TSP/EOS and myself firmly believe that it is better to reject the quotes that were received and accept the quote given by GEH Construction. Although the low quote received is $1,332.00 less than GEH, the City has more of a financial surety in hand with the Senior Center due to the magnitude of the project to insure that the project is coordinated and completed in a proper manner. If the City Council feels that the difference is significant enough, the low bid would be awarded to Johnson Lawn for the amount of$16,668.00. Otherwise, the quotes should be rejected and the award would remain with GEH Construction. A copy of the inspection report was left with the owner, Mr. Deveme Hentges, and a follow up letter was sent the next day explaining what needed to be done to correct the situation. The City did not hear back from Mr. Hentges, and subsequently the $100 per month surcharge was added to his utility bill. The utility bills were not paid and were levied against the property following the standard notices to the property owner and a public hearing. Recently Mr. Hentges' daughter, Linda Stem, came to City Hall to inquire about the charges. She explained her father has been ill and she has taken over his affairs and requested in writing that the City Council abate and/or waive charges levied against the property with regard to the sump pump surcharge. First of all I got the name of my fathers doctor & the clinic name where he was given the anti-depressants and was diagnosed with diabetes. The doctors name is Dr. Geiphart at the Creekside clinic in St Loius Park.My father isn't going there anymore due to the fact they can't pay any more medical bills. They also have no insurance. The anti-depressants are called Zoloft. I've also enclosed a copy of a letter from my fathers attorney in regards to his injurys that occured from falling down on wet floors at Festival Foods in Chanhassen. I was the one who prompted him to seek counsel after seeing the pain he was in. I would also like the council to be aware of the history of depression in my fathers family. His sister committed suicide about 8 years ago. 1m telling them this only to help them understand that my father doesn't seem to be able to handle normal everyday pressures. He seems to have given up about 2-4 years ago. This is why I have take responsibility for their finances ect. I will make sure that their duplex is kept up to Shorewoods expectations in the future. In reading the letter sent to my father in 1994 I see that the city of Shorewood offered to remove or creidt any surcharge added to taxes after the sump pump was taken care of I hope this offer still stands. 1m also sending copies of his current tax problems to let you know how deep his financial problems go. I have been trying to get all of this resolved. But it takes time and money. My father has just gotten a janitorial position which will help with his dept, but as you can see his dept is high. I am not asking the city of Shorewood to remove charges for any material things. Just fines. I fear for my fathers mental & pysical health. This is overwhelming to him and has been for a very long time. As for my mother taking responsibility. My father makes it too difficult for my mother to try and handle these affairs for him. He doesn't seem to mind that his daughter is. I've mailed $1,300.00 to Hennipen County to try to catch up with the property taxes. I've mailed $400.00 to the city of Shorewood also to try and catch up. The problem goes much deeper than this. My father hurt his back almost two years ago, at a local grocery store.. He's currently unemployed & has been off & on since his back injury. He's also on anti -depressant's, and just recently was diagnosed as a dibetic. He's not well and I'm afraid for his physical and mental well being.. I know this is not the city of Shorewood's concern but I'm pleading with Shorewood to remove the fines from his city & county taxes. If this were done 1m sure we could get them current in a very short time. Last winter your police and fire agencies saw a sharp increase in call demand for carbon monoxide alarms. You may already be aware of this issue as a result of increased calls for fire service, and the increase in costs associated with those calls. As a result of this increased demand, the Communications Division has brought this issue before your representatives on the Sheriff's Users Advisory Board in order to seek input on how to best serve your needs. As a result of those discussions it has been determined that many cities wish a continued fire response on all CO Alarm calls. Some cities have implemented an on-call "duty officer" status for the fire service, and have requested that the CO Alarm calls be handled at that level. Finally, a few cities have requested that, absent any indication of illness, there be no response to CO Alarm calls other than to have a police officer call the complainant and advise the caller to contact their furnace service company for evaluation and possible repair. . As your Public Safety Answering Point (pSAP), we need to know your wishes on this subject as it relates to your city, and more specifically, how you wish your police and fire services to respond to CO Alarms in your service area. Enclosed you "will find a response form for your city. Please discuss this issue with your police and fire chiefs, select a Level I, Level II, or Level ill response (described on the form), and return the completed form, in the enclosed envelope, no later than September 6, 1996. RESOLUTION APPROVING SUBDIVISION AND COMBINATION OF REAL PROPERTY WHEREAS, Martin and Cheryl O'Brien (Applicants) are the owners of certain real property in the City of Shorewood, County of Hennepin, State of Minnesota, legally described as: "Lot 13, Block 1 Tonkawood Estates, Hennepin County, Minnesota" (Parcel A); and WHEREAS, Jan Haugen (Applicant) is the owner of certain real property in the City of Shorewood, County of Hennepin, State of Minnesota, legally described as: "Lot 12, Block 1 Tonkawood Estates, Hennepin County, Minnesota" (Parcel B); and WHEREAS, the Applicants propose to rearrange the property line between Parcel A and Parcel B, creating two parcels as legally described in Exhibit A, attached hereto and made a part hereof; and -- WHEREAS, the subdivision and combination requested by the Applicants complies in all respects with the Shorewood City Code; and WHEREAS, the application was reviewed by the City Planner, and his recommendations were duly set forth in a memorandum to the Planning Commission, dated 2 August 1996, which memorandum is on me at City Hall; and WHEREAS, the application and the Planner's recommendations were reviewed by the Planning Commission at a regular meeting held on 6 August 1996, the minutes of which meeting are on file at City Hall; and WHEREAS, the application was considered by the City Council at a regular meeting of the Council held on 26 August 1996, at which time the Planner's Memorandum and the recommendations of the Planning Commission were reviewed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood as follows: 1 . That the parcels of property legally described as Parcels A and B, above be subdivided and recombined to form the two parcels legally described in ExhIlJit A, attached hereto and made a part hereof. 2. That the City Clerk furnish Applicants with a certified copy of this resolution for recording purposes. 4. That Applicants shall cause this Resolution to be recorded with the Hennepin County Recorder or Registrar of Titles within thirty (30) days of the date of certification. Exhibit A CITY OF SHOREWOOD RESOLUTION NO. 96-77 A RESOLUTION REJECTING THE REVISED BIDS AND AWARDING CONTRACT FOR LANDSCAPING FOR THE SOUTHSHORE SENIOR COMMUNITY CENTER WHEREAS, pursuant to Resolution 96-59 adopted on June 24, 1996, which awarded the contract for the construction of the Southshore Senior Community Center, City Project No. 95-20 contingent upon GEH Construction holding the bid for the landscape portion of the Contract for a period of 60 days; and WHEREAS, the City Council directed staff to re-bid the landscape portion of the project; and WHEREAS, TSP/EOS received quotes on August 22, 1996 and have been tabulated said quotes as shown in Exhibit A; and WHEREAS, the bids received were not of significant difference of the original bid. NOW THEREFORE BE IT RESOL YED by the City Council of Shorewood as follows: That the Mayor and City Administrator/Clerk are hereby authorized and directed to amend the original award of contract with GEH Construction as originally bid as part of the Southshore Senior Community Center according to the plans and specifications therefore approved by the City Council on file in the office of the City Administrator/Clerk. Reg. ~ 1.150-2 providing that proceeds of tax-exempt bonds used to reimburse prior expenditures will not be deemed spent unless certain requirements are met; and, WHEREAS, the City expects to incur certain expenditures which may be fmanced temporarily from sources other than bonds, and reimbursed from the proceeds of a bond. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood as follows: 1. The City reasonably intends to make expenditures for the project described in Exhibit A (the "Project"), and reasonably intends to reimburse itself for such expenditures from the proceeds of debt to be issued by the City in the maximum principal amount described in Exhibit A. 2. The City Administrator is authorized to designate appropriate additions to Exhibit A in circumstances where time is of the essence, and any such designation shall be reported to the Council at the earliest practicable date and shall be fIled with the official books and records of the City as provided in Section 3. 3. This resolution is intended to constitute a declaration of official intent for purposes of Treas. Reg. ~ 1.150-2 and any successor law, regulations or ruling.
