. AGENDA ITEM #lD: A representative from the Excelsior Chamber of Commerce
will present the Council with a plaque in appreciation for the City's
participation in the Fourth of July celebration.
AGENDA ITEM #3A: This motion would extend the minute taking service
agreement. It includes an increase of about 1.6% over the last
agreement-.
AGENDA ITEM #3B: This resolution is suggested by the Minnesota League
of Cities. It establishes the week of September 25 through October 2 as
"Cities Week".
AGENDA ITEM #3C:This resolution adjusts salaries for election judges.
They are fair and comparable with other cities.

AGENDA ITEM #3D: 'The owner of 23622 Smithtown Road has had several
vehicles for sale on residential property. He requests that no further
a~tion be taken until 10 September. If the violations remain as a
Monday nights' meeting, it is recommended that the owner be given until
9:00 a.m. on 14 September to completely correct the violations or have
the matter referred to the City Attorney for legal action.
AGENDA ITEM #3E: This motion would be to adopt the resolution setting
next year's budget and preliminary general fund tax levy, which is set
at the same dollar amount as last year. This amount cannot be raised
after this resolution is passed and sent on to the County.
AGENDA ITEM #3F: The City Council has to establish two public hearing
dates which are required by law for our budget. The enclosed
communication from the County lists the many dates already taken by
other jurisdictions. Municipalities are the last to chose dates. We
are suggesting, and the proposed resolution establishes, Tuesday,
November 29 (the regular City Council meeting scheduled for the night
before could be changed to that date), and the final hearing date as
Monday, December 19 (the Council could consolidate their regular City
Council meetings which would normally be December 12 and December 26 to
this meeting date). A final decision needs to be made at this meeting.

AGENDA ITEM #3G: This resolution is adopted annually and suggests
setting the date for the public hearing for assessment of delinquent
utility charges for 7:15 p.m. at the regular Council meeting of October
10.
AGENDA ITEM #3H: Enclosed in the packet is a memorandum with full
information on Kathleen Hebert who is the candidate we are recommending
for hire as the Senior Accounting Clerk. A motion would authorize the
hiring.
AGENDA ITEM #3I: The City needs to establish a date for a public
hearing of September 26 at 7:15 p.m. to reallocate three year old
Community Block Grant Funds. This needs to be set for the next meeting .
so that the funds can be utilized this year.
AGENDA ITEM #3J: This resolution makes the final appointment to the
Shorewood Parks Foundation. Bill Keeler is recommended as the Senior
representative.
AGENDA ITEM #3K: This motion simply authorizes the City of Shorewood to
jointly rebid our recycling contract with the cities of Mound, Spring
Park, Wayzata, Exce13ior and Minnetonka Beach.
AGENDA ITEM #3L: Because there are small items that the contractor
still has to accomplish before final close out, this item on the
Silverwood Improvement Project is postponed.
AGENDA ITEM #3M: As discussed previously, Judge Ann Montgomery did
order the City of Shorewood to commence condemnation proceedings to .
acquire that portion of the Ronald R. and D.L. Johnson property to the
914' elevation. The resolution establishes the finding of public
purpose necessary to initiate the eminent domain proceedings as required
by order of the court.
AGENDA ITEM #4Al: The Park Commission recommends that the speed limit
within Shorewood parks be reduced from 20 MPH to 15 MPH. The proposed
ordinance is in the packet.
AGENDA ITEM #4A2: This motion approves the plans and authorizes
advertisements for bids for the project to be paid for with Community
Development Block Grant funds making our various parks and playground
areas handicap accessible. A memorandum detailing the total project
from Park Planner Bruce Chamberlain is enclosed in the packet. Also
included in the packet is a letter of agreement for services for Mr.
Chamberlain, not to exceed $3,000. This amount is fully reimbursable
from the CDBG program. A separate motion approving this letter of
agreement should be considered.
AGENDA ITEM #4A3: Enclosed in the packet is a memorandum from Bruce
Chamberlain explaining that the City received one base quote for
landscaping in Silverwood Park. The amount is close to what has been
budgeted and the Park Commission recommends that the City Council accept
the low quote from Wilson Nursery of $12,021.50 for the Silverwood Park
Landscaping Project. The Tree Trust has indicated to us that they will
not be able to do the plantings this year as we had hoped. Our Public
Works Department will do the planting and landscaping work. Part of. it
will be done this fall and the remainder of the plants, which should be
planted in the spring time, will be done in the spring of 1995 by the
Public Works Department. However, if the Tree Trust indicates that they
will be able to finish the planting in the spring, we certainly can take
advantage of their services at that time.

AGENDA ITEM #5A: Mr. Daniel Lundgren, 5520 Sylvan Lane, asks that the
City amend its zoning ordinance to require pools that were constructed
prior to the adoption of current fencing requirements to be fenced. If
the Council agrees with Mr. "Lundgren, staff recommends that the issue be
referred to the Planning Commission for review and comment.
AGENDA ITEM #5B: Residents of Lawtonka request that a street light be
authorized for the intersection of Lawtonka Drive and Timber Lane. The
light is consistent with Shorewood's street light location policies.
The Planning Director recommends approval.
AGENDA ITEM #5C: We had indicated that the City Attorney would bring
back to the City Council a draft of the moratorium ordinance which is
set for public hearing before the Planning Commission on September 20.
There are two optional ordinances to be considered. The first is a
simple moratorium. Option B exempts senior housing projects as had been
requested. This could be considered and a recommendation be given by
the Planning Commission. No action needs to be taken until after the
public hearing and at the next regularly scheduled City Council meeting
of September 26.

AGENDA ITEM #6: Bob Gagne will be present to give a report on
activities related to the senior community center since our last
meeting.
AGENDA ITEM #7: The City of Deephaven has responded to the City of
Excelsior that they are not interested in a one year extension of the
fire contract and would be happy to see the equipment schedule as
originally proposed. If Shorewood does the same and accepts the
proposed budget as presented in the August 24 memorandum (which was sent
to you under separate cover earlier), our contribution would be
increased by $1,901. I recommend that Shorewood take the same action as
the City of Deephaven and approve the budget of Shorewood contribution
of $117,070. Excelsior would like to know by September 16.
AGENDA ITEM #8: The budget for the contribution to the City of Mound's
fire department is established by formula. The formula dictates that
Shorewood's contribution for 1995 increases from $5,122 to $6,443. This
increase is largely due to the fact that our percentage of the market
value of the fire department area has increased by over 9% and our
fire/rescue call hours have increased since 1991. In addition, they are
setting aside additional funds for equipment. This amount is
incorporated into our proposed budget for 1995. A motion would be to
approve the 1995 fire contract budget with the City of Mound.
AGENDA ITEM #9: The Mayor has asked that we postpone consideration of
setting meeting dates for November and December. However, the public
hearing dates have to be chosen at this meeting.
AGENDA ITEM #10: This action would be a motion approving the proposed
Lake Minnetonka Cable Commission's 1995 operating budget. Jim Daniels
has indicated he would like to be present to answer any questions, but .
cannot attend until approximately 9:00 p.m.

4. PARK COM.MISSION - Report by representative

A Motion to Adopt an Ordinance Amending Section 902.04 Providing for Speed
Restrictions in City Parks
Hurm referred to the draft ordinance, prepared for a first reading, which would lower the speed
limit in the City's parks from 20 to 15 mph. The proposed ordinance reflects the Park
Commission's concern regarding safety in the parks particularly where asphalt has been applied.
The Commission will be discussing safety and parking issues further at its next meeting. Lewis
stated that some parks are located in close proximity to streets and suggested that the Commission
also consider extending its safety concerns to traffic on those streets. Additional research will be
conducted' to determine acceptable methods to slow or caution traffic in the vicinity of parks. The
Council acknowledged the first reading of the proposed ordinance amending Chapter 902.04 of the
Shorewood City Code providing for speed restrictions in City parks.
B. A Motion to Accept the Bids for the Old Market Road Trail Project and A ward the Contract
Dresel reported that, as directed by the Council, the trail project was re-bid for a more favorable
price. He recommended that the Council accept Landmark Concrete's bid of $50,417.24 which is .
$5,500 less than the lowest received during the frrst bid process. Dresel stated that while the bid is
higher than the MSA estimate of $43,781, any further re-bidding is not likely to produce a lower
bid unless the project is delayed to next year. Based on the bid received, MSA funds will cover
approximately $42,400 of the construction cost with City's trail fund covering the remaining
$8,000. The 6' wide concrete trail will extend from Silverwood Park to an existing sidewalk at the
intersection of Old Market Road and Highway 7. Dresel explained that MSA does not participate
in funding for bituminous trails and concrete is aesthetically favored.
Daugherty moved, Benson seconded to accept the bid for the Old Market Road
Trail Project and to award the contract to Landmark Concrete, Ham Lake, MN, in
the amount of $50,417.24. Motion passed 5/0. .
C. A Motion to Approve Fence Work at Freeman and Cathcart Parks
Hurm reported the Little League organization will pay $679 for the extension of field lines at Field
1 and Park funds will cover $1,799 for the remaining fence work at Freeman Park requested by the
CIP and Park Commission.

Daugherty moved, Stover seconded to award a contract for fence work in Freeman
Park to Sterling Fence Company, in the amount of $2,478.00. Motion passed
5/0.
D. A Motion to Approve Low Quote for Cathcart Park Parking LorJBallfield Project
Dresel stated that bids for construction of a new parking area at Cathcart Park are coming in 30-
35% higher than anticipated. Because of the high bids, he cannot recommend accepting a bid at
this time. He suggested combining the projects (parking lot and ballfield work) for re-bidding
during the winter for completion of the work in the spring. The Council concurred with Dresel's
recommendation and therefore took no action on this motion. Hurm explained that preliminary
work to make room for the new parking area at Cathcart will not be completed this year because of
the delay in construction of the parking lot.
E. A Motion to Authorize the Demolition of the Cathcart Warming House and Rental of
Warming House Trailer
Hurm reiterated that since the work at Cathcart Park has been delayed as reported by Dresel and
accepted by the Council, demolition of the warming house and rental of a warming house trailer for
the Park will not be necessary at this time. Therefore the Council took no action on this motion.
Park Commission Chair McCarty reported that a Minnetonka sports group has requested
consideration of improvements at Badger Park, at the sports group's expense, including
construction of goal posts and installation of additional lighting.
Daugherty moved, Benson seconded to request the Park Commission to negotiate
the proposed improvements at Badger Park with the lVIinnetonka sports group.
Motion passed 5/0.
5. PLANNING - Report by Representative
A. Report on August 15 Joint Work Session
Commissioner Pisula reported .on the August 15 joint meeting and summarized the Commission's
objective in recommending an interim development moratorium.
B. Consideration to Direct Staff to Prepare Interim Ordinance Regarding Development
Moratorium and Set Public Hearing Date
The Councilmembers discussed the Planning Commission's recommendation to declare an interim
development moratorium in the City of Shorewood.
Brancel stated she initially opposed the moratorium. After hearing the concerns expressed by the
Planning Commission, Brancel generally agreed that the issues identified by the Commission need
to be reviewed and updated in the Comprehensive Plan. However, Brancel expressed opposition
to the 12-month length of the moratorium and preferred a substantially shorter time - on the order
of 3 months - in consideration of fairness to the developers who have applications before the City
and to avoid interference with the 1995 construction season.
Commissioner Pisula explained that the Planning Commission is willing to work with the Council
to set a mutually agreeable time frame to accomplish the work necessary to update the

Comprehensive pian. Completion of the Comp Plan update correlates to the length of an interim
moratorium.
Daugherty acknowledged the work before the Planning Commission to accomplish the necessary
updates to the Comprehensive Plan. He generally agreed with Brancel's opinion that the
Commission should complete the process on a fast-track basis so that a moratorium on
development would be short. He suggested a mid-November/early December deadline in order
that the Council may consider and take timely action on current projects before the City.
Lewis stated the primary concern is to avoid delays for developers for the 1995 construction
season. He acknowledged it is unfair to the developers to continue tabling action on their
applications. Nonetheless, Lewis pointed out that resolution of Comp Plan issues outweigh the
temporary difficulties placed upon the developers. Lewis indicated it is difficult to set a deadline
for completion of the Comp Plan update process since ample time should be allowed to develop an
acceptable result.
Benson generally agreed with Lewis' opinions and indicated that while the update process may be
shortened, a January-Febl1,lary 1995 time line could be realistic.
Stover agreed with the justification for a moratorium but expressed concern regarding the length of
time. She questioned whether 3-4 months is reasonable and whether the Commission would be
able to accelerate the update process. Stover stated that she would have no objection to considering
a Comp Plan with limited or no changes from the current Plan providing that adequate study and
research has been.conducted to support the conclusions. Lewis pointed out that certain issues such
as those related to City services, the Joint Powers agreement, and senior housing require a
consensus for inclusion in the Comp Plan.
The Councilmembers considered possible deadlines for completion of the Comp Plan and the
length of a moratorium. It was suggested that the Commission begin public information meetings
as soon as possible and continue its work to update the Comp Plan simultaneously. It was agreed
that the moratorium would continue to November 14, 1994, at which time the Council may
consider its extension. Stover stated preference for the Planning Commission's recommendation
that the moratorium be in effect for 12 months or until the Comp Plan update is completed,
whichever comes first. Daugherty explained that the shoner limit provides for close monitoring of
the Comp Plan update process. He stated he would be willing to extend the moratorium if
justified.
Daugherty moved, Lewis seconded to set a Planning Commission public hearing
on September 20, 1994, and to direct the staff to prepare, for the Council's
September 12, 1994 consideration, an interim ordinance declaring a development
moratorium for the City of Shorewood until November 14, 1994, at which time
the Council will review the progress of issues related to the moratorium, with the
further understanding that the moratorium will go no further on a date line that
would potentially delay construction in the 1995 spring construction season.
Motion passed 5/0.
Daugherty reiterated the importance of allowing sufficient time for review of development
applications so as to avoid 1995 construction season delays resulting in potential liability on the
part of the City. .

Stover moved, Benson seconded to table consideration of the proposed Excelsior
Fire Department 1995 operating budget. Motion passed 5/0.
7. CONSIDERATION OF THE PROPOSED SOUTH LAKE MINNETONKA
PUBLIC SAFETY DEPARTMENT 1995 OPERATING BUDGET
Police Chief Rick Young referred the Councilmembers to his August 15, 1994 memorandum
regarding the status of the Department's 1995 budget following his meeting with the Excelsior City
Council. Excelsior's decision to limit its contribution to the budget results in a$1O,746.85 overall
reduction in the proposed budget. Under the Joint Powers Agreement any city may set its annual
share for police services and that amount is used in the formula calculation of each city's share.
During discussion, Chief Young explained his administration of the budget, which is in large part
driven by salaries, and responded to questions from the Councilmembers.
Brancel reviewed the other cities' negative reaction to Shorewood's hiring of a part-time officer as
it affects the Joint Powers agreement. She expressed concern that while Shorewood's need for
services is increasing, continued reductions in the budget preclude service. Brancel supported
cooperation among the Joint Powers cities, but considered some actions by individual cities
detrimental to the Agreement. She supported an amendment to the Agreement that would provide
for review of any cities' action that may affect the Joint Powers Agreement.
The Councilmembers supported Chief Young's proposed budget. The Council generally supported
the Joint Powers concept, but expressed dismay over continuing reductions in required services for
Shorewood resulting from the Joint Powers Agreement and agreed that the issue should be
thoroughly considered when the Public Safety contract expires in 1997.

8. CONSIDERATION OF A SENIOR CENTER TASK FORCE
RECOMMENDATION
Mr. Robert Gagne, Chair of the Senior Center Task Force, reported that the survey proposals will
be presented to the mayors on August 24. The Task Force also intends to ask the other cities
whether they would participate in funding construction of a scaled down senior/community center.
Responses will be requested by September 15. .

Hurm stated that Hennepin County has notified the City of.a cut-ba~k in recY7ling funds. ~e
suggested that to partially offset the reduced funds, the CouncIl may WIsh to conSIder a change m

the program that awards $25 to the resident whose name is drawn if their recyclables are curbside
by 7 a.m., and accumulates an additional $25 each week that it is not awarded. The change
proposed would dispense with the practice of accumulating the award and would set $25 as the
maximum award. '
The Councilmembers discussed the merits of the award program. While the majority of the
Council agreed that the program has served its purpose as an incentive to recycle and should be
abolished, Stover and Benson stated that some residents faithfully place their recyclable curbside
by 7 a.m. for the opportunity to win the award.
Benson moved, Stover seconded to set the recycling award in an amount not to
exceed $25. Motion failed 2/3. Brancel, Lewis and Daugherty voted nay.
Lewis moved, Daugherty seconded to abolish the recycling award program
effective immediately. Motion passed 3/2. Benson and Stover voted nay.
Dresel reported that MnDot intends to turn back to the City certain portions of properties along the
frontage road on the north side of Hwy 7 from Old Market Road to the Greenwood city limits. He .
explained the condition of the area and road. Keane stated that negotiations for MnDot
improvement of the road will be undertaken.
12. MAYOR AND CITY COUNCIL REPORTS
Lewis. joined by Daugherty, expressed concern regarding the safety of pedestrians, bikers,
children. etc. on Old Market Road because of a significant increase in traffic and speed violations
on lhat street. It was acknowledged that the ,reconstruction of Vine Hill Road may be re-routing
traffic to that street. It was agreed that staff should review the situation and develop
recommendations to alleviate the hazardous conditions. Daugherty encouraged residents to report
similar situations that may exist in other parts of Shorewood.
Brancel suggested that in view of residents' poor rating of animal control in the City, staff research
other sources for the service.
13. ADJOURN TO WORK SESSION SUBJECT TO APPROVAL OF CLAIMS

Stover moved, Daugherty seconded to adjourn the Council meeting at 9:00 p.m.,
subject to the approval of claims, to a Work Session. Motion passed SlOe

The meeting was called to order by Mayor Brancel at 9:10 p.m.

REVIEW PROPOSED 1995 OPERATING BUDGET
Referring to the proposed 1995 General Fund Budget distnbuted with an August 18, 1994
memorandum, Hurm highlighted issues for the Council's consideration including: the police
budget (discussed at the August 22 Council meeting), hiring of a City Engineer mid-year
1995, decreased recycling funding from Hennepin County (discussed at the August 22
Council meeting), and senior housing and the senior center. A preliminary tax levy will be
set at the Council's September 12 meeting. The budget presented includes no increase in
tax levy dollars for 1995.
The Councilmembers discussed the issues brought to its attention and Hurm and Rolek
responded to questions. Brancel inquired about the need for part-time employees. Staffwill
provide information to support the occasional need for such employees.
. Following discussion, the Council generally accepted the budget as presented and requested
that a resolution setting the preliminary 1995 tax levy be prepared for consideration at its
September 12, 1994 meeting.
The Council complimented the staff on the format and content of the budget and noted that
the proposed budget is available for public review at City Hall.

Agreement for your review. One copy highlights the changes from the 1994 Agreement.
As you probably know, our rates with Shorewood have not increased since the start of our
contract in May of 1992. The 1995 Agreement reflects the same hourly rate with a one hour
minimum and a per page increase of twenty-five cents. It appears that Shorewood averages
26 pages of minutes per month so the increase will result in approximately $6.50 per month
or 1.5% to 1.6% of your total billing.

RECORDING SECRETARY SERVICE AGREEMENT
THIS AGREEMENT is made between CARLA WIRTH, d/b/a as TIMESAVER
OFF SITE SECRETARIAL ("TOSS") and the CITY OF SHOREWOOD, MINNESOTA,
5755 Country Club Road, Shorewood, Minnesota ("Shorewood").
Shorewood wishes to employ TOSS to act as recording secretary of all Shorewood
City Council and Planning Commission meetings during the term of this Agreement, and
such special meetings and special meetings of its Commissions as Shorewood s~all request
of TOSS from time to time.
IT IS THEREFORE AGREED AS FOLLOWS:

1. Recording Secretary. TOSS is hereby; retained and appointed to provide a
competent, experienced and professional recording secretary to appear at and
attend, record, and transcnbe, and submit minutes of all regular Shorewood
City Council and Planning Commission meetings and, as requested of TOSS
by Shorewood from time to time, special meetings for the Shorewood City
Council and meetings of its Commissions. Minutes of each meeting on hard
copy and diskette shall be prepared and submitted with the tape recording of
each meeting within seven (7) days after each meeting to the Deputy City
Clerk of Shorewood, or to other such officer as the City Clerk or Shorewood
City Council may designate from time to time. TOSS shall attempt to provide
minutes of the first monthly Planning Commission meeting within three (3)
days of the meeting date.
2.
Equipment. Shorewood shall provide for each meeting at the meeting site all
tape recording equipment required to record the minutes of the meeting.
TOSS shall provide all equipment and materials necessary to transcnbe and
prepare the minutes and to take shorthand minutes at a meeting.

3. TOSS Charges. TOSS shall be paid for its services as recording secretary for
each meeting as follows:
a. Twenty-one ($21.00) dollars per hour for time attending meetings (one
hour minimum), and fifteen (15) minutes prior to Call to Order and
fifteen (15) minutes following adjournment; and
b. Eight and 50/100 ($8.50) dollars for each page of minutes prepared
from shorthand notes of the recording secretary as draft minutes, if
requested, for submission to and the review and comment of
Shorewood before preparation of final minutes.
4. Billipg. When TOSS submits the final minutes of each meeting TOSS shall
bill Shorewood on TOSS' standard invoice form which itemizes time in
attendance at each meeting and the number of pages of draft minutes
prepared by TOSS of each meeting. Shorewood agrees that it will submit
each TOSS invoice with the next bill list or other applicable expense
authorization list to be considered by the Shorewood City Council or the
authorizing official of the Council. .
5. Term. This Agreement shall become effective on January 1, 1995, and shall
continue in force until December 31, 1995. Either party may cancel this
Service Agreement on sixty (60) days written notice; otherwise the contract
shall remain in force.
6. Delegation. TOSS may, from time to time, appoint one or more persons and
delegate its duties as recording secretary hereunder to its employees or
contractors with Shorewood's express prior consent.

7.
Shorewood agrees that during the term of this Agreement and any extension
to it, and for a period of six (6) months thereafter, it will not employ, hire,
subcontract with, or otherwise engage as a recording secretary a person or an
entity formed by a person who has acted as a recording secretary of TOSS for
Shorewood under this Agreement.
8. At the end of the term of this Agreement or any extension of it, the parties
may make a new Agreement or extend or modify the terms of this Agreement.

A RESOLUTION SETTING A PUBLIC HEARING ON PROPOSED
ASSESSMENT OF DELINQUENT SEWER, WATER AND STORMWATER UTILITY
CHARGES, CITY CLEAN-UP CHARGES AND PROPERTY CLEAN-UP CHARGES
WHEREAS, Shorewood City Code provides for the City to place
delinquent sewer, water and stormwater utility charges, City clean-
up charges and property clean-up charges on the succeeding year tax
rolls for the specified properties; and,
WHEREAS, the City Administrator/Clerk has notified the Council
that such proposed assessment rolls have been completed and filed
in his office for public inspection.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Shorewood as follows:
1. That a public hearing shall be held on October 10, 1994 at
7:15 p.m., in the Council Chambers of the City Hall to pass upon
such proposed assessments, and at such time and place all persons
owning property affected by such assessments will be gi ven an
opportunity to be heard.
2. That the City Administrator/Clerk is hereby directed to
cause a notice of the hearing on the proposed assessments to be
published in the official newspaper at least two weeks prior to the
hearing, and shall cause mailed notice to be given to the owner of
each parcel described in the assessment roll not less than two
weeks prior to the hearing.

Item 3H - Hiring of a Senior Accounting Clerk
Our present Senior Accounting Clerk, Wendy Davis, has submitted her
resignation from that position effective September 30. Upon
receiving her resignation, an advertisement was placed in the
August 17th edition of the Sun-Sailor and in the August 14th
edition of the Sunday Minneapolis Tribune to fill the position. A
deadline for receiving applications was set for August 25.
The ad called for minimum requirements for the position of at least
two years post-secondary education in accounting and one year of
accounting experience, with governmental experience preferred. We
received 22 applications for the position. Three additional
applications were received after the due date and were rejected.
A selection and. interview team. consisting of ... Teri Nabb and myself
was established. We screened the applications using the minimum
criteria and the applicants I experience in each phase of accounting
and computer skills . Five applicants were selected for the
interview process, which included an oral interview and a test
which evaluated math aptitude, written communication skills and
computer skills.
After completing the interview process, Teri and I evaluated the
candidates based upon their oral interviews and test results.
Following this evaluation, the consensus was to offer the position
to Kathleen Hebert. Kathleen has a two-year degree in accounting
from Rasmussen Business College and has over a year of experience<
in the accounting field. She was employed by the ci ty of Eden
prairie as a records technician in the Police Department fo~ five
years. .
We contacted references and received high recommendations on Kathy.
A background check was performed by the SLMPSD, which turned up no
criminal record.

Kathleen certainly fulfills all the criteria for the position. We
feel that she will be a great replacement for Wendy and will fit in
well with the staff. Therefore, it is recommended that the City
Council approve the hiring of Kathleen Hebert for the Senior
Accounting Clerk position starting at $11.48 per hour, subject to
a six-month probationary period. Kathleen would start on Monday,
September 19, which allows a two-week crossover training period
with Wendy and me before Wendy leaves.

A RESOLUTION RELATING TO A FINDING OF PUBLIC PURPOSE
FOR THE ACQUISITION OF EASEMENT FOR PUBLIC WATER STORAGE
WHEREAS, the City did authorize the construction of certain
stormwater improvements, including those to Outlpt A, Block 2
Waterford Addition; and
WHEREAS, property owners Ronald R. and Dee L. Johnson argued to
the District Court that in conjunction with creating the sto~ater
pond the City constructed a control structure to maintain a minimum
level of water resulting in inundation two to three times per year
to the 914' elevation; and
WHEREAS, Hennepin County District Court Judge Ann D. Montgomery.._...._....
did, on August 17, 1993, enter a judgment finding that there has
been a physical taking of the Johnson's property to an elevation of
914' since December 31, 1984: and
WHEREAS, Judge Montgomery further found that al though the pond
control structure is "removable" it was constructed as a permanent
fixture and constitutes an irreversible taking which requires
compensation; and
WHEREAS, Judge Montgomery further ordered that the Johnsons
have successfully brought an action compelling the initiation of
inverse condemnation proceedings and are, therefore, entitled to an
award of compensation pursuant to Minnesota Statutes 117 ~ ~;

Section 1: Section 902.04 of the Shorewood City Code is amended as
follows:

I am pleased to submit this proposal for design and project administration services for
handicapped access paths and resilient surfacing in Freeman, Manor and Cathcart Parks. The
project will be funded with CDBG funds with every intention of completing it this fall.

Hoisington Koegler Group Inc. will specifically perform the following professional services
related to the project:
1. Conduct field investigation of the parks to determine quantities and locations.
2. Prepare layout plans and construction details for the improvements.
3. Prepare specifications including CDBG required wage standards.
4. Solicit bids from contractors and recommend contract approval to the City.

The City has allocated a portion of its Community Development Block Grant (CDBG)
funds for construction of handicapped access paths and playground surfacing in City
parks. Since CDBG has specific standards for construction projects, a number of CDBG
eligible projects have been combined into one bid package. The projects are as follows:
Freeman Park
· 142 sq. ft. of 13/a" play top surfacing at the north play area.
· 125 sq. ft. of 5/a" play top surfacing at the north play area.
· 1,560 sq. ft. of bituminous path connecting the Little League parking
lot to the south play area and new trail.
Manor Park

54 sq. ft. of 11A" play top surfacing at the play area.
1,200 sq. ft. of bituminous path connecting the future parking lot to
the play area.

· 1,620 sq. ft. of bituminous path connecting the future parking lot to
the play area.
The Landscape Architect's estimate for this work including $3,000 for administration is
$14,200. Due to the size of the project, an advertised bidding process is not needed.

submit bids based on project plans and specifications.
The action requested of the City Council at this time is to approve the project and direct

Re: Silverwood Park Landscaping.
Bids were requested from five landscape contractors for Silverwood Park landscaping.
The Base Bid includes plants and materials delivered to the site. Add Alternate No. 1
includes installation as a lump sum price. The Landscape Architect's Estimate for the
Base Bid is $11,684 and $13,585 for Add Alt. No.1.
Only one bid was recieved by the deadline date of August 26, 1994. The bid is from
Wilson's Nursery Inc. in Chanhassen with a Base Bid amount of $12,021.50 and an Add
Alt. bid of $8,123.00.
The Park Commission reviewed the bid at their August 23 meeting and recommended
acceptance of the base bid but since no money was budgeted for installation, it was
agreed upon that the Shorewood Public Works Department will install the material. .
I agree with the Park Commission's recommendation and add that even though only one
bid was recieved, the Base Bid amount is very reasonable. Therefore I recommend that
the City Council accept the Base Bid and award the contract to Wilson's Nursery, Inc.
in the amount of $12,021.50. I further recommend that the City Council direct Staff to
coordinate delivery and installation of the material this fall and next spring (some of the
plants specified are better suited to spring planting).

Lundgren, Daniel - Consider Zoning Code Amendment Relative to Preexisting
Swimming Pools Without Fences

Section 1201.03 Subd. 2.f. of the Shorewood Zoning Code requires swimming pools to be
enclosed by a minimum four-foot high, nonclimbable fence with self-closing gate. There are at
least three residential pools of which staff is aware that existed prior to the adoption of the fencing
requirement and do not comply with the requirement. One of those is currently being required to
comply as part of an extensive remodeling pennit.
Mr~ Daniel Lundgren, 5520 Sylvan Lane, contacted our office to inquire about the City's
enforcement policy relative to swimming pool fences. He was informed that such fences are
"grandfathered in" when the pool existed prior to adoption of the current fencing requirements. As
such they are treated the same as other nonconforming uses, with one exception. Based upon legal
advice from the City Attorney, staff sends a letter (see Exhibit A, attached) to owners of
nonconforming pools, advising them of the current fence requirement, and that their property does
not comply. This simply puts the owner on notice that the pool doesn't comply - it does not
require the owner to comply.
In his letter to the Council (Exhibit B), dated 2 August 1994, Mr. Lundgren urges a more
aggressive policy toward nonconforming swimming pools. It should be noted that the-current
Code is. being strictly enforced. What Mr. Lundgren asks is that the Code be amended to eliminate
the "grandfather rights" for swimming pool fencing.
Upon discussion with the City Attorney, he advises that the Code can be amended to retroactively
require pool fencing. This requires an amendment to the Zoning Code, a public hearing and
review by the Planning Commission, and four-fifths approval by the City Council.
If the Council concurs with Mr. Lundgren, it is recommended that the issue be referred to the
Planning Commission for review and recofil!I1endation.

eXtending from a navigable lake. channel or stream to the near side of the
average building construction line, shall noe exceed four feet (4') in

My wife and I have three daughters ages seven, four, and two. I have recently reviewed the city
code regarding pools with a number of individuals at Shorewood City Hall and I was advised by
a city inspector that two properties adjoining mine are in clear violation of the ordinance relating to
the enclosure of swimming pools. In the case of one of the properties there is no barrier at all.
Another very disturbing fact is that the individuals at this same property reside out of state for a
portion of the year, leaving their pool unattended.
I have spoken with the resident without any fence and their objection to bringing the property up to
code appears to be based solely on aesthetics. Having lived in other parts of the country where
pools not only need to be fenced, but surrounded by 6 foot high masonary walls, I understand the
seriousness of this violation. The fact is, these municipalities understand the clear danger of .
unrestricted swimming pools where drownings can occur quickly and silently.
An un[ enced pool presents a clear danger which is very attractive to very young children. There
must be some way that our progressive community which is obviously concerned about public
safety can enforce this law and avoid the possibility of future tragedy. Let's use common sense,
do the right thing, and make the community safer for our kids.
Please let me know what the next steps are in enforcing ordinance 168.

In 1986, a study by the Consumer Product Safety
CommIssion showed that 630 people drowned In back
yard swimming pools. and 330 of them were under the
age of 5. Three-fourths of the ellildren under 5 were 3
or under.
A ellild's risk of drowning Is much greater than most
people realize. In a survey of American grade-school
children conducted in the mid-197Gs, 15 percent said
they had had a near miss In the water at least ones
during the previous year.
Smaller kids are most at risk
Children under the age of 5 are 14 times as likely to die
in a pool as in a motor vehicle. Of those who survive
near-drownlngs, many are permanently brain
danlaged.
Unfortuna1ely, for too many parents. grandparents and
others who have residential pools, the only safety
measures are warnings to children about not going
near the pool alone.
The commission's study revealed telDng clrcumstaness
surrounding the poo/-relat8d deaths of young children.
Two-thIrds occurred In the family pool and one-third In
pools owned by frlends or relatlves.
Nearly half the ellildren were last seen in the house
and nearly a quarter were last seen In the yard or on
the porch or patio: no one knew the youngsters had
gone near the pool. Only about one-third of the ellil-
dren were In or around the pool just before drowning.
The lessons to be learned from these statistics Include
the facts that drowning accidents happen very qulcldy,
in familiar surroundings and during very short lapses in
supat'Vfsion. .
Vigilance of is caretaker is essential
There are no cries for help to alert caretakers that a
small child Is in trouble In the water. The only ,effective
protection Is to ensure that cllildren cannot get near a
pool without being accompanied by a responsible and
trained caretaker whose attention IS not distracted by
phone calls, door bells, reading matter or the care of
other children who are not In the pool.
While many communities have safety regulations gov-
ernIng residential pools, It is the pool owner's respon-
sibtllty to adopt these mInimal safety standards: .
. Fence it In. A fanes or COmparable barrier completet;
surrounding the pool is the best preventive, reducing
the rlsIc of pool drownlngs by about 70 percent. an
Australian study showed. It Is just as Important to
fenes in an above-ground pool as an In-ground pool.

The gate of the pool fence should close automatically,
open away from the pool and be secured by a self-
latching mechanism that is out of the reach of small
children.
Some safety tips from the experts
. Cover It. Some physicians, like Or. Glen C. Griffin, a
pool owner in Minneapolis, favor motorized pool cov-
ers in addition to fences to keep unsupervised young-
sters out of pools. He worrles about the many children
who manage to gain access to pools even when they
are fenced in. "Anytime an adult Is not in our pool, or
an adult who can swim is not by Its side carefully
watching young swimmers, we close our pool cover,"
he said. '
Pool covers can be installed over most In-ground
pools. 8e sure to remove the protective cover (and any
solar pool cover used to heat the water) completely
when the pool is in use and remove water that may
collect when the pool is covered.
. RemaIn vigilant. Children in or near pools must be '
watelled constantly by a responsible and wel/-informed
caretaker. A momenfs lapse can spell dfsaster. Never
assume that a child who has taken swimming lessons
or is using a flotation devica can sately be left unat-

horseplay in the water. Children should not be allowed
to dunk each another. push each other into the water
or yell in jest for help. Mark the pool's deep end and.
preferably use a floating pool rope to denote where
the water ~oUld be above the children's chIns. Never
permit diving at the shallow end or from the sides of
the pool or Into an above-ground pool.

Section 1. Definitions. The following terms whenever used In this
Ordinance shall be interpreted to mean:

survey, or metes and bounds description of an area, parcel, or
tract of land into three or more parcels, tracts or lots for
transfer of ownership or for residential, commercial, or other
use or combination thereof. For purposes of this Ordinance, the
term subdivision shall not include the separation or division of
a parcel, tract, or lot for the purpose of attachment to
contiguous parcels, tracts, or lots, provided that no residual
parcel, tract or lot is left unattached.

Section 2. Intent. It is the intent of this interim ordinance,
pursuant to Minnesota Statutes 462.355, subd. 4, to allow the City of
Shorewood sufficient time to complete the update of its
comprehensive plan. This interim ordinance is adopted for the
purpose of protecting the planning process, the health, safety and
welfare of the citizens and property of the City of Shorewood.
Section 3. Temporary Prohibition. Pending the completion of
the update of the comprehensive plan, no application shall be
accepted, processed, or approved for a subdivision within the
City of Shorewood.
Section 4. Effective Date. This ordinance shall take effect from
and after its passage and publication and shall remain in effect
until November 14, 1994, unless extended by adoption of
resolution on or before that date.

Dear Carl,
The Deephaven City Council has reviewed your letter dated August 24,
1994. The city does not agree to the change of the 1995 Fire
Department Budget by lowering the Vehicle Equipment Fund $5,000.
A five year budget was accepted and approved by all five contract
cities. Deephaven feels if we accept a change this year and add an
additional year to the contract the same condition may happen to
another city next year. This is defeating the purpose of the five
year contract. Deephaven'wants to keep the five year contract and not
extend for an additional year.

The Excelsior City Council has also reviewed James Hurm's letter of July 29, 1994
regarding Shorewood's request for a reduction of $8,000 to the 1995 Excelsior Fire
Department Budget.
The Excelsior City Council has some deep concerns with Shorewood's proposal in
the fact that:
1) Cutting future funding for replacement of equipment does not ensure that
the Department has efficient and effective equipment to maintain their
current high quality of service;

A five year budget (1994 - 1998) was accepted and approved by all five
contract cities in 1994. The proposed 1995 Fire Department Budget is
within the agreed dollar amount from the five year budget for 1995.
Shorewood is now asking for a reduction to the proposed budget which was
previously agreed upon due to a high increase in contributions for 1995.
Shorewood's contribution increase for 1995 is due in fact to a higher
demand in calls and tax capacity. Shorewood's actual calls for the last
three year period jumped from 425 to 509.

3) The 12.5% increase that Shorewood is experiencing in 1995 is not
exorbitant when compared to Excelsior's 68.79% increase in 1994 with the
formula change.
The Excelsior City Council understands the need for holding costs down; however,
to keep a well equipped fire department to deliver the high quality of service the
contract cities have become accustom to, there are costs involved that can not be
compromised. The Council has reluctantly agreed to reduce the 1995 Excelsior Fire
Department Budget by lowering the Vehicle Equipment Fund $5,000 with the
understanding that since this reduction would add an additional year onto the vehicle
equipment replacement fund the Council would require that each of the contract cities
agree to extend the current five year Fire Contract an additional year, through 1999.

the $5,000 reduction.

SUBJECT: 1995 FIRE CONTRACT BUDGET PROPOSAL
Enclosed is the 1995 Fire Contract Budget Proposal. It follows the same format
and approach as used since 1982, with the exception that we are now using market
value instead of assessed value.
Capital Outlay includes the following:
1 . Weather Station and office equipment and furnishings.
2. New Pumper and new Tanker
.
A weather station will assist the department in keeping track of weather
conditions which could have an impact on the number and types of emergency calls
that usually occur under severe weather situations. Office equipment and furnishings
represents some basic items, Le., storage racks for tables and chairs, audio/visual
cart, answering and fax machines and a glass display case to hold awards or other
forms of recognition that the department receives.
last year we discussed the need to replace the Mack Engine #12 and the old
tanker that the department has had for many years. We have estimated their cost at
$250,000. We have been setting aside monies in the fire truck repair account since
1991 for this purpose. It was thought that a pumper and tanker in one unit was the
best way to proGeed.
When Steve Erickson became the Fire Chief on January 1, 1994, he instructed
the truck committee to continue to look at options regarding the replacement of the
pumper and tanker. The committee determined that a new pumper and a new tanker
could be purchased for about $250,000. Thus, the committee and the Fire Chief have
now recommended pursuing this option.

Therefore, in 1995, the Fire Department is proposing to purchase a pumper and
a tanker for an estimated amount of $250,000. Financing approaches are still open
for discussion. The City of Mound could advance the cash needed to be paid back
over five years at a specified rate of interest or could borrow the funds necessary at
the time of purchase and charge each city accordingly. Please note the projected fund
balance of the Area Fire Service Fund on 12/31/94 is estimated at $152,533 and
$182,533 by 12/31/95. These fund balances indicate that we would need to raise
an additional $70,000 - $100,000 in order to purchase the two vehicles.
We have again reviewed the annual increase for the Fire Relief Association.
From 1982 until 1990, we have been collecting a 10% annual increase for this
purpose. In the 1991 budget, we reduced the annual increase to 4%. In the 1992 .
budget, we again included a 4% increase. For 1993, a 7% increase for the fire
pension contribution was approved. For 1994, a 4% increase in the contribution was
approved. For 1995, we are proposing a 4% increase in the contribution. Currently,
the pension benefit is at $425 per month.
We have indicated to the Fire Pension Board that we want to be able to provide
a fair and equitable pension benefit to our firefighters and to maintain an incentive to
attract new candidates to the fire department. However, we also emphasize that all
of the cities in the fire service area are striving to hold the costs of government down
and that we must be realistic with each other as we prepare our budgets.
The Fire Department is very proud of the quality of their equipment and the
service they provide. The City of Mound is proud of having such a dedicated group
of individuals who volunteer their time for the safety of all of our citizens in the fire .
service area.

Dear Mayor Brancel and Council Members:
On August 16, 1994, the Lake Minnetonka Communications
Commission (LMCC) passed its budget for 1995. As has been our
experience in the past, the LMCC has once again directed staff
to speak with you at a city council meeting and briefly explain
the expenses that are projected for 1995. Jim Daniels, our
Administrator, will be contacting Jim Hurm, to set up a timed
item on one of your upcoming city council meetings to answer any
questions that may arise and ask for a city council motion that
supports your LMCC. Since Mr. Daniels may have three or four
city councils in one evening, I hope that once he has arrived
you will address the 1995 Budget item as soon as your agenda
will allow it to be heard.
It has been a very busy 1994, with the LMCC accomplishing its
main objective of lowering subscriber rates this year, as well
as dealing with some very important proposed legislation in
Congress and the reality of technological changes that will
create the potential of several providers of service to the
residents of our cities.
Last year all fourteen cities unanimously approved the efforts
and budget of the LMCC, which told us we must be doing something
right. Enclosed you will find our 1995 Budget figures, that are
almost identical to the 1994 total expenses that were
unanimously approved by your city council. I would simply
remind you that these are NOT tax dollars and are provided by
the cable company through the provisions of our franchise
agreement.
Finally, in case you missed the press coverage, Jim Daniels is
our representative on the League of Cities Policy Committee.
This will prove to be very positive in helping us work toward
some effective legislation for 1995 and keep Congress up-to-date
on the communication needs of our residents.
