05-101 CITY OF SHOREWOOD RESOLUTION NO. 0')-101 A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO PLACE FILL IN EXCESS OF 100 CUBIC YARDS FOR MARK GUIDINGER WHEREAS, Mark Guidinger (Applicant) is the owner ofreal property located at 19735 Muirfield Circle, in the City of Shorewood, County of Hennepin, legally described as: "Lot 12, Block 6, Waterford 2nd Addition"; and WHEREAS, the Applicant has applied to the City for a Conditional Use Permit to place up to 400 cubic yards of fill to level off an area for a swimming pool on the above- referenced property; and WHEREAS, the Shorewood City Code requires a Conditional Use Permit to place fill in excess of 100 cubic yards; and WHEREAS, the Applicant's request was reviewed by the Planning Director, and his recommendations were duly set forth in a memorandum to the Planning Commission, Mayor and City Council dated 26 October 2005; and WHEREAS, the Applicant's request was reviewed by the City's Engineering Consultant, and his recommendations were duly set forth in a memorandum to the Planning Director, dated 26 October 2005 and a letter to the Planning Director, dated 21 November 2005, which memorandum and letter are on file at City Hall; and WHEREAS, after required notice, a public hearing was held and the application was reviewed by the Planning Commission at their regular meeting on 1 November 2005, the minutes of which meeting are on file at City Hall; and WHEREAS, the Applicant's request was considered by the City Council at their regular meeting on 28 November 2005, at which time the Planner's memorandum, the Consulting Engineer's memorandum and letter, and the minutes of the Plmming Commission were reviewed and comments were heard by the Council from the City staff. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Shorewood as follows: FINDINGS OF FACT 1. The subject property is located in the P.U.D., Planned Unit Development zoning district and contains approximately 26,361 square feet of area. 2. The proposed fill will be contained by a terraced boulder retaining wall and will be used to level offthe rear yard of the Applicant's property to accommodate a swimming pool. 3. The area of fill shall be limited to that which is shown on Exhibit A, attached hereto and made a part hereof. 4. The design of the proposed retaining walls has been addressed by Paul D. Schimnowski, KBH Consulting, Inc., a registered professional engineer, whose recommendations are set forth in a letter to the applicant's contractor, dated 5 October 2005, a copy of which is attached hereto as Exhibit B. CONCLUSION a. The application of Mark Guidinger for a Conditional Use Permit as set forth hereinabove be and hereby is granted. b. The pool and retaining wall shall be constructed in accordance with the recommendations ofKBH Consulting, Inc., contained in Exhibit B, and the recommendations of the City's consulting engineer, contained in Exhibit C, both attached hereto and made a part hereof. c. Any discharge of water :from the pool shall be directed to the City storm sewer system when the pond located in Outlot A, Block 2, Waterford is at or below an elevation of 910 feet. At such times as the elevation of the pond is over 910 feet elevation, any discharge of pool water shall be directed to the City sanitary sewer system. d. Final grading shall be subject to approval by the City Engineer. e. Erosion control measures must be in place prior to filling. f. That the City Administrator/Clerk is hereby authorized and directed to provide a certified copy of this Resolution for filing with the Helmepin County Recorder or Registrar of Titles. I understand that tile proposed boulder retaining "tVaUs on this project are located scmtheast of the existing house in the bacl..--yard, A two-tiered wall system wiU be used to retain a section of the backyard in which an in -ground swimming pool is proposed. The lower wall will be 6' exposed in height; will be approximately 150' long; and will have a maximum 4:1 slope in front of the wal1. The upper wall will be 6' behind the lower wall (face.to-face distance); will be 6' high exposed; will be approximately 100' long; and will have level slopes at the front and back of the wall. No ex1:ernal surcharge or groundwater loads were d.esigned for these retaining walls, It is assumed that no load. is being imposed on the retaining walls from the swimming pool. Therefore, the pool should be back from the npper walt a minimum of 10 feet. In addition, a letter outlining the design parameters for a boulder retaining wall, dated October 7, 2005 and prepared by KBH Consulting, Inc, was reviewed. Based on this review, we have the following comments: Boulder Retaining Wall 1. In addition to the design parameters outlined in the design memo, it is recommended that the following items be incorporated into the plan: a. Place a six inch (minimum) compacted base under walls b. Provide 12 inches of free draining aggregate behind wall system for drainage 2, The construction requirements must be shown on a construction plan signed by a Registered Engineer, registered in the State of Minnesota, 3. It is recommended that, as a condition ofthe building permit, the Engineer submit an as-built drawing certifying that the wall was constructed according to the construction plan, Site Drainage 1. The Minnesota Pollution Control Agency recommends that, when draining swimming pools, the water pumped :from the swimming pool be discharged to the sanitary Exhibit C C:\Docllments (/nd Seftillgs\wsb. Should the homeowner discharge to pervious areas in the back of their own residential lot, the runoff will flow approximately 500 feet to the pond located on Outlot A, which outlets to the south, The anticipated flow path is shown on the attached contour map of the area, 3. Because the rate of flow would be relatively minor, it is anticipated that the runoff will most likely infiltrate into the ground before it reaches the pond, 4. Surface water runoff also would be improved slightly by this project. Under existing conditions, the runoff :from the hill will be conveyed directly off-site, eventually flowing to the pond on Outlot A.
