There is a lot on this agenda so therefore it seems unlikely that we will be able to have a Budget Work Session. We will attempt to keep the agenda for the October 26th meeting to a minimum so as much time as possible can be given to a Budget Work Session. AGENDA ITEM 3A - This resolution proclaims the month of November 1992 as Epilepsy Month in the City of Shorewood. AGENDA ITEM 3B - Because NSP failed to deliver the agreed upon stipulation for easement delays have resulted in this request to extend the deadline to receive the deed regarding the Doherty property at 20375 Manor Road. This resolution extends the deadline to October 22, 1992~ ~ 1 i AGENDA ITEM 3C - This resolution approves a CUP for accessory space and setback variances at 26305 Edgewood Road. The Council directed this resolution be prepared at the September 14th meeting. AGENDA ITEM 3 D - This resolution accepts the Shady Hills storm Sewer Improvement project. .. t t J jJ. ~ 't '. AGENDA ITEM 4B - $5,000 has been budgeted for the surveying of Freeman Park. The Park Commission has worked with staff and Mark Koegler, Park Planner, in determining the most cost effective way of accomplishing this task. This design agreement with OSM is our recommendation. AGENDA ITEM 4C - The Park Commission has recommended the Council approve this letter of agreement with Mark Koegler for up to $500 for preparation of a bike trail grant application. One of the areas which could be included in this application is a pedestrian way along Old Market Road and covington Road. Included in the packet is a memorandum from the city Attorney indicating that Old Market Road can continue as a bike way even if the side walk is in place. This means that 25 mph designation could remain. AGENDA ITEM 6 - At this point we have heard unofficially that representatives from MWCC will be at the Council meeting at 7:30 pm. Staff is preparing a short presentation to give to them and the City Council which puts in perspective what has been happening over the last several years. At that point we might ask the MWCC representatives to respond to our letter and this presentation. AGENDA ITEM 7 - This is a request for the City Council to reconsider a Shorewood Oaks Drive area request for two additional stop signs at Maple Leaf Court. A complete history of this request is enclosed in the packet. AGENDA ITEM 8 - This is a petition from residents on covington Road requesting measures to reduce speed. Staff memorandums raising policy questions are enclosed in the packet. AGENDA ITEM 9 - The same petitioners are requesting additional street lights on Covington Road. Two additional street lights would be warranted. Should the Council wish to authorize it staff will designate the best locations and coordinate the installation. AGENDA ITEM 10 - This item remains from the last City Council agenda. We hope to have a final report on water testing from Munitech by the Monday evening council meeting. AGENDA ITEM 11 - This item to increase the fees for engineering services for the S.E. area water treatment plant was held over from the last meeting because Mr. Vogen was unable to attend at that time. . . AGENDA ITEM 12 - This is a redraft of an ordinance presented at the last meeting considering delinquent water bills. The additional language suggested by the City Council, at the last meeting, is underlined as subd.3(d) in this proposed ordinance. AGENDA ITEM 13 - The CUP and variance request for the Vine Hill market was previously tabled and therefore needs to be raised again at this meeting. AGENDA ITEM 14 - This is a request of Tony Studer, 5685 Minnetonka Drive to spread his $4,000 water hook-up fee out over three years. Should the Council wish to do this we would recommend $1,000 down and $1,000 a year over a three year period at an 8% interest spread as a special assessment rather than monthly paYments. AGENDA ITEM 15 - The low quote for landscaping for the Public Works facility was presented by Lan-De-Con Inc. in the amount of $17,715. Even this low quote is about $5,000 above the original budget. We recommend awarding the work to the low quote, Lan-De-Con, with the understanding that they work with the Planning Director Nielsen to lower the total landscaping cost nearer to the original budget of $12,500. AGENDA ITEM 17B - In preparation for the Church Road special assessment hear ing at 7: 15 pm on Monday, October 26, the City Engineer has prepared a memorandum discussing the issues to be considered in relation to that project. The Council should have an opportunity to discuss these issues before the public hearing. . Stover reported that at its September 22 meeting following discussion regarding proposed re-zoning and variances requested by the Upper Lake Minnetonka Yacht Club, the Planning Commission voted to recommend that a public hearing be held to consider amending the City Code to change the slip to land ratio and discussed and recommended approval of proposed amendments to the Shoreland Management Regulations. 6. REVIEW AND CONSIDER A RESOLUTION APPROVING TIlE DESIGN AND PlANS FOR TIlE IMPROVEMENTS TO LIlAC lANE Dresel reported that he met with Shorewood resident Simcox and has reviewed the final plans and specifications for reconstruction of Lilac Lane with the City of Chanhassen. Items in the design plans incorporating concerns of Shorewood residents include: 1) existing lilac hedge along the north side of Lilac Lane to be saved; 2) barrier consisting of wooden bollards to be constructed off the north side of Lilac Lane in line with Teton Lane; 3) existing slope of Lilac Lane to be matched at an approximate rate of 8.26%; and 4) proposed retaining wall shall be modular concrete block in lieu of timber. Dresel recommends approval of the plans prepared by the City of Chanhassen's engineer. 2 REGUlAR CITY COUNCIL MINUTES SEYIEMBER 28, 1992 - PAGE 3 Gagne moved, Daugherty seconded to approve RESOLUIlON NO. 90-22, "A Resolution Approving the Design and Plans for the Improvements to lilac Lane." AN ORDINANCE CHANGING THE ZONING-SHADY ISIAND FROM R-1B TO R-1C Gagne moved, Stover seconded to approve Ordinance No. 258, "Amending Section 1201.09 of the Sborewood City Code" to re-zone Shady Island from R-lB to R-1C. Motion passed 5/0. . 8. A MOTION TO ADOPT A RESOLUIlON APPROVING FINAL PAYMENT FOR THE S.B. AREA WATER TREATMENT PIANT - A & K CONSTRUcnON Lewis moved, Gagne seconded to approve a Resolution Accepting Project No. 91458, Water Treatment Plant for the Southeast Area, Well No.7. Daugherty questioned the validity of test results, expressed concern as to whether the problem has been solved and suggested that final payment be withheld until further testing is conducted. Lewis indicated he has not heard anything from his neighbors. Dresel stated that testing has been done randomly two or three times trying to work out operational problems. Lewis withdrew the motion for approval to accept the project, Gagne withdrew his second . Stover moved, Daugherty seconded to table action to adopt a Resolution approving final payment for the S.E. Area Water Treatment Plant - A & K Construction pending results of additional water testing by an independent laboratory and receipt of comments, if any, from residents in the southeast area. Motion passed 5/0. 9. REMOVED. 10. CONSIDER A MEMORANDUM OFUNDERST ANDING BETWEEN THE CITY OF SHOREWOOD AND FIRMS ENTERING CONSULTING AGREEMENTS WITH THE CITY Hurm stated that having had professional consulting firms approach the City for additional funds "after the fact", he has prepared a "Memorandum of Understanding" to be signed by a consultant when entering into an agreement with the City. He pointed out that the agreement provides that if the scope of services requested significantly expands, a consultant 3 . . REGUlAR CITY COUNCll.. This would allow for prior Council consideration and approval of additional compensation for the service. Lewis moved, Gagne seconded to approve the Memorandum of Understanding Between the Oty of Shorewood and Firms Entering Consulting Agreements with the Oty. Motion passed 5/0. 11. A MOTION TO ADOPT VOUCHER PAYMENT POLICY FOR CITY CONTRACTING PROJECTS Hurm reviewed the suggestion presented at the September 14 meeting to streamline the approval process for construction contract pay vouchers by eliminating the time and expense involved in preparing vouchers for Council approval. He stated that the new policy would provide that construction project payments be approved through the regular voucher payment process by the Project Manager, Finance Director, and Administrator. The new policy includes the following: 1) Council must have taken action to award the project and its proposed budget; 2) only intermediate monthly pay requests within the established budget will be exempt from Council review; 3) change orders or supplementary agreements require Council approval; 4) final pay request subject to Council approval; and 5) pay vouchers processed and approved by Project Manager, Finance Director and Administrator and listed on Council's check approval list before payment. Gagne stated that the current policy should be retained to keep Council members informed. They are accountable for taxpayers' money. Stover stated that at the present time, Council consideration and action on such items does not take much time, questioned whether the change results in saving money or time and felt the existing procedure allows Council members to keep up with current projects. Lewis noted that projects and budgets are pre- approved, Council approval is a formality and updates of construction projects are provided to the Council. Lewis moved, Brancel seconded to adopt the new Voucher Payment Policy for Oty Contracting Projects. Motion passed 3/2. Stover and Gagne voted nay. 12. CONSIDER AN ORDINANCE - CHAPTER 901.01 OF THE SHOREWOOD CITY CODE RELATIVE TO STREET EXCAVATION Hurm stated that this ordinance requires a permit for excavating within 10 feet of a public street right-of-way and increases the excavator's deposit from $1,000 to $2,000 which provides for restoration of the street. Based on past experience with both matters, staff recommends approval of these amendments to the Code. 4 REGUlAR CITY COUNCIL MINUTES SEPfEMBER 28, 1992 - PAGE 5 Gagne moved, Stover seconded to approve Ordinance No. 259 Amending Chapter 901 of the Shorewood City Code Relating to the Excavation of Streets and Public Right-of-Way. Motion passed 5/0. 13. A MOTION TO AMEND CHAPTER 903 OF TIlE SHOREWOOD CITY CODE REIATIVE TO DELINOUENCIES Rolek reviewed the recommended amendment regarding the water turn off policy previously discussed by the Council. It shortens the amount of time for sending shu-off notices for delinquent charges from 90 to 45 days and removes language allowing for special arrangements. He noted that the current policy allows for a two-quarter delinquency whereas the proposed policy will keep a delinquency in the current quarter, increase . efficiency and improve the City's cash flow. Stover asked whether the new policy would include both commercial and residential. Rolek stated this will cover all property. Stover questioned the dollar amount of quarterly delinquencies, expressed concern about the severity of turning off residents' water and asked for information about the appeal process. Lewis stated assistance programs are available for persons with problems paying utility bills and that it may be necessary to implement a new policy in order to encourage timely payments of obligations to the City for this service. Rolek noted that delinquent water bills disputed can be appealed to the Council and water service would continue pending a determination, and that unpaid utility costs are assessed to residents through the tax system. . The Council members directed the staff to modify the proposed amendment for the Council's review at its next meeting to provide for an appeal process for an individual with a delinquent water bill before the water is turned off. 14. A MOTION APPROVING DESIGN AGREEMENT FOR TIlE PREPARATION OF RIGHT-OF-WAY PLANS FOR LAKE LINDEN DRIVE Hurm stated that MNDot has completed its speed limit study on Lake Linden Drive leaving the speed limit at 30 mph. MnDOT recommends posting an S-curve warning sign on Lake Linden Drive, with a 25 mile per hour speed recommendation. In addition, the City's engineering firm has developed a preliminary design agreement for reconstruction of Lake Linden Drive. Stover asked whether there will be neighorhood involvement or a public hearing in connection with the proposed re-construction and how the project will be financed. Dresel indicated that the road will be designed with a 30 mile an hour speed limit and informal 5 REGULAR CITY COUNCIL MINUTES SEP1EMBER 28, 1992 - PAGE 6 meetings and contact with the residents during the design stage is appropriate. It was noted that a preliminary re-constructionengineering design will be developed consistent with MSA requiremenrs in order to assure MSA funding. Dresel indicated that some additional right-of-way will be required to meet the road width requirements. Gagne questioned whether there is an option for the City to finance the project and avoid designing the road to meet the criteria for MSA funding. Stover asked whether additional right-of-way acquisition is necessary. Lewis stated that the Council should retain options in the design of the road based on input from the residents on the stated-mandated requirements. Daugherty suggested that action on the right-of-way acquisition be delayed until further information on the proposed design is available. Brancel noted that she has received a number of communications from residents on Lake linden Drive requesting that improvements be made to address the safety concerns. . Staff indicated that additional information will be available after the design plans are drawn up for review by the Council. Gagne moved, Stover seconded to approve the Preliminary Arlmini~trative Expenditure Budget and Design Agreement with Orr Schelen Mayeron and Associates, Inc. for Lake linden Drive Reconstruction (MSA Project) to include: A topographic survey, B. proposed aligninent for the new road and C. proposed grading plan for the new alignment; and that informal contacts be made with the affected residents. Motion passed 5/0. Lewis moved, Stover seconded to direct the staff to erect an S curve and 20 mile-an-hour warning sign at the appropriate position on Lake linden Drive as soon as possible. . Motion passed 5/0. 15. CONSIDER A RESOLUTION ESTABLISHING STOP SIGN PLACEMENT CRITERIA Hurm noted that the staff had been asked to review the City's stop sign placement policy. He indicated that the Resolution being considered contains applicable language from the MNDot's uniform manual. Lewis moved, Stover seconded to adopt RESOLUTION NO. 91-92, "A Resolution Adopting Stop Sign Placement Criteria, amended by adding the following: A RESOLVE paragraph along the lines of: "the City Council has the responsibility of making the final determination in the placement of all stop signs within the City of Shorewood." A MOTION TO ADOPT A RESOLUTION SETTING A PUBliC HEARING FOR SPECIAL ASSESSMENT OF COST OF CHURCH ROAD IMPROVEMENTS - PROJECT NO. 91-2 Daugherty moved, Gagne seconded to adopt RESOLUTION NO. 92-92, "A Resolution Setting a Public Hearing on Proposed Assessments for Project No. 91-2, Street and Water Main Improvements, Church Road." Motion passed 5/0. 17. CONSIDERATION OF lAKE MINNETONKA CABLE COMMUNICATION COMMISSION (LMCC) BUDGET - 1992 . Mr. Jim Daniels, Administrator of the Lake Minnetonka Cable Communications Commission, presented the 1993 Proposed Budget for Administration and Local Cable Programming which totals $142,450. He also presented an update on Congressional legislation regarding cable matters. He noted that, to date, 10 of 12 city councils have approved the budget. The budget for 1993 is generally comparable to the 1992 budget except for funding for cable casting City Council meetings is now included in their budget. Gagne moved, Stover seconded to approve the 1993 Proposed Budget for Administration and Local Cable Programming, as presented by the Lake Minnetonka Cable Communications Commission. Motion passed 5/0. . Brancel noted that the Cable Commission office has been re-Iocated to the U.S. West building in Excelsior. Constituents may call the cable office at 474-5539. 18. MATTERS FROM TIlE FLOOR Mr. Bob Rascop, LMCD director, 4560 Enchanted Point, briefly commented on the cable commission's budget and on the reconstruction plans for Lake Linden Drive. He asked if OSM had done some design work on Lake Linden Drive previously. 19. STAFF REPORTS A Attorney's Report - None. B. Engineer's Report - 1992 Project Update Dresel commented on the closure of Radisson Road Entrance, the completion of the Public Works facility and the status of Church Road. 7 REGUlAR CITY COUNCIL MINUTES SEPTEMBER 28, 1992 - PAGE 8 C. Planner's Report Report on Delinquent Clean-Up Charges - Greg Fox Nielsen brought the Council's attention to his September 24 memorandum providing background information regarding the assessment of clean-up charges for property located at 25565 Smith town Road including a chronology of the complaint and how it was processed as requested by the Council at its September 14 meeting. The Council members agreed procedures were complied with by staff and re-affirmed assessment of the appropriate charges. Nielsen provided information resulting from his meeting with the developer of Gideon Woods noting that a public hearing on the P.U.D. will be scheduled in November. . D. Administrator's Report Drop-off Box Hurm informed the Council that the cost of providing an after-hours drop off box as requested by the Council will be $90 for materials and $160 for labor. Gagne moved, Stover seconded to approve payment of the costs associated with installation of an after-hours drop off box at City Hall. Motion passed 5/0. Schedule of Meeting Dates for the Remainder of 1992 . Hurm reviewed the tentative schedule of meeting dates for the remainder of 1992. Stover moved, Gagne seconded to re-schedule the November 23 Council meeting to Monday, November 30, and to cancel the December 28 Council meeting. Motion passed 5/0. The remaining 1992 Council meeting dates are: Mondays: October 14 and October 28; November 9 and November 30; December 14. A Budget Work Session is scheduled for November 16 if needed. Fall Yardwaste Collection Hurm informed the Council that the Fall Yardwaste Collection date is Saturday, October 24, 1992, from 9 a.m. to 4 p.m. in the City Hall parking lot. 8 REGUlAR CITY COUNCIL MINUTES SEPTEMBER 28, 1992 - PAGE 9 Portable Phone for Sewer Safety Hurm informed the Council that upon the request of the Public Works Director, it is recommended that the City purchase a portable phone at a cost of $350 to assure safety for workers and for emergency purposes. Gagne moved, Stover seconded to approve the expenditure of $350 for purchase of a portable phone as requested by the Public Works Director. Motion passed 5/0. Metropolitan Waste Control Commissi9n . Hurm reported that a meeting with the other affected cities regarding the Metropolitan Waste Control Commission's increased sewer service charges was held on September 25. Dresel reviewed the discussions at the meeting noting that, in general, each City has a unique situation regarding sewer service and the calculation of charges. Council members discussed the subject and agreed that the Chair of the Commission be invited to the Council's next meeting on October 12 to answer questions and provide information on the rationale for the increase in Shorewood's sewer service charges and further, the Council agreed to pursue appropriate legal action against the Commission regarding the increase for sewer service charges if necessary. Hurm informed the Council that photographs will be taken at 6:45 p.m., prior to the October 12 meeting. 20. COUNCIL REPORTS . A. Mayor Brancel - None. B. Councilmembers Lewis suggested that if not already done, a follow-up traffic study be conducted since the opening of the Old Market Road intersection and asked about the status of MNDot's agreement to complete the Radisson Road cul-de-sac. Shorewood trails also seem to reasonably fit the qualifying criteria used in making the funding awards. Based on the application submittal requirements, I would estimate that the total fee for the preparation of the grant application will range from $400.00 to $500.00. In any case, I do not see the fee exceeding $500.00. The proposed $122,500 increase in charges in one year reflects an increase of over $52 a year per household. Because of the MWCC's high estimates of flow for Shorewood and the resulting 40% increase in charges, we simply can no longer afford to fund projects to address any city III problems. The dramatic increase in charges with no credit or consideration for Shorewood's I/I reduction efforts seems counfer productive to our common goal of reducing I/I. We ask that MWCC follow the recommendations in its Systemwide Infiltration/Inflow Evaluation Report (April, 1992). The report recommends "...that the technical assistance, public information, and III reduction goals programs be implemented immediately and that I/I levels be reviewed periodically." The Commission prepared the 1992 estimated flow for the city in March of 1990 following three years of dry weather conditions. Since then the rainfall conditions have changed, 1991 had a near record rainfall and thus far in 1992, the rainfall is above normal. The Commission tries to estimate flows based on normal rainfall conditions. Historically, the city's flows have generally been higher when rainfall is above normal and lower when rainfall is below normal. Another factor contributing to a flow increase may be an underestimation of growth within the community. Based on measured flows through July, it is anticipated tpat your total year end flow for 1992 will exceed the estimated flow by approximately 42 percent. This assumes that the rainfall conditions through the end of the year will continue at a normal level. This would result in an underpayment of approximately 42 percent for 1992. The underpayment would be carried forward and added to the 1994 cost allocation. This petition represents great concern and desire for change on the part of these homeowners in regard to the speeding and dangerous driving taking place on the streets in our neighborhood. Shorewood Oaks Drive has become a popular cut-through for many non-residents within the past year. We are finding that meny of these drivers are coming through Shorewood Oaks at speeds of 35 to 40 plus miles per hour. The current 30 m.p.h. speed limit and the lack of any stop signs is promoting people to speed in excess of 30 m.p.h. thus creating dangerous situations for the many children who live and play here every day, Homeowners have taken to standing in the street to block these cars, and phoning in tag numbers to . the police. We feel that the time for change has come as this neighborhood is more that 50% complete. Currently there are 75 homeowners and 49 school aged children in Shorewood Oaks. We were informed that this petition would be on your agenda for your June 10, 1991 meeting. No such reduction may be made without approval of the State of ~nnesota. They will require a speed study and great documentation for any change in speed limit. I would not expect them to grant any change in the speed limit from the statutory residential speed limit of 30 MPH, certainly not to 15 MPH. I am not aware of any local speed limits that are set that low. Shorewood Oaks is a new street system with wider streets and curbs than in a large proportion of Shorewood. Speed l:imits are normally set at the 85th percentile of normal traffic. Speed limits are, therefore, set with the knowledge that the 15th percentile of all. .traff:icwHwi+l normally be_. violating-.!:_~f:!___ ___ speed l:im:it. Studies have shown that a lower speed limit will not usually reduce the speed of traffic, but rather make more persons law violators. (See attached). Another issue is the level at which traffic citations are issued. As you may know, the police department can not issue citations for only a few MPH over the limit. The court system will not accept them. We are forced to write citations based upon the level of acceptance of the legal system. This is very well defined in Hennepin County. (In my opinion this "tolerance" is increasing.) Most of the speeds referred to in the cover letter to the petitions would fall within that "tolerance". Should the State of M:innesota allow a different speed limit than the statutory speed l:imit for residential areas~ I certainly would encourage the adequate posting of that speed limit. The request for "Slow ~ Ch:ildren at Play" signs is also an issue in wh:ich the State of M:innesota has taken a very definite stand. They do not recognize such signs. They are not legal. During recent studies, in our area, of traffic control signs and devices, the State of Minnesota recommended all such signs be removed. One reason I heard for this was the ineffectiveness of the signs. Serving South Lake Minnetonka Communities of Excelsior, Greenwood, Shomvood and Tonka Bay Apparently studies have shown that most drivers do not see the signs and for those that do, there is no effect on their driving behavior. The request for stop signs should be considered in relation to the Minnesota Manual on Uniform Traffic Control Devices. The State of Minnesota has adopted this nationwide manual. I have included a copy of the portion relating to stop signs and their placement. There are four warrants -.jor the placement of stop signs. In reviewing the petition for requested locations, the warrants can be applied to only some of them. I think everyone would agree that Shorewood Oaks Drive is the main thoroughfare. Therefore, the following requests could be considered under warrants numbers one and/or two: Oak Leaf Trail at Shorewood Oaks Drive - Both Locations Maple Leaf Circle at Shorewood Oaks Drive Burlwood Court at Shorewood Oaks Drive There already is a stop sign on Shorewood Oaks Drive at Strawberry ~ Lane. - The other requested locations, Shorewood Oaks Drive at Maple Leaf Circle and Burlwood Court do not appear to meet any of the warrants. They appear to be more of a speed control device. This is specifically mentioned in the manual as an improper use of a stop sign. The City of Shorewood has denied other requests for like stop signs. The City of Shorewood has also recently removed stop signs which were felt to be used for speed control only. The police department takes no position on the petition, with the- exception of the stop signs which meet the warrants. I feel those signs should be erected. The other requests are subject to the State of Minnesota, City of Shorewood or the manual as published. My comments are meant merely to inform the City Council of factors I am aware of which might impact their decision making process. Dear Mr. Hurm: A speed zoning study has been completed for Shorewood Oaks Drive and Oak Leaf Trail as requested by the Shorewood City Council in Resolution 63-91. Based on the study results and as discussed with you previously, we recommend continued reliance on Minnesota's statutory 30 mph urban district speed limit. (This limit may be posted or not posted at the city's discretion.) Our recommendation has been forwarded to Mn/DOTs traffic engineering office in St. Paul for their review. Assuming they concur, no speed limit authorization will be issued. You will be notified of their action. Also, as discussed with you, there is one curve on each road where 30 mph speed cannot be . safely maintained. We suggest installation of turn signs with appropriate advisory speed plates for these curves, especially since the speed limit is posted. During discussion of our recommendation, you expressed interest in general comments concerning speed limits and SLOW CHILDREN signs. You might therefore find the attached letter and the following general comments of interest. While many people believe that posted speed limit determines the speed of traffic, studies in Minnesota and elsewhere have demonstrated that speed patterns are actually determined by driver reaction to the road environment and by driver attitude (purpose of trip, etc.). Very little change in speed patterns can be expected with a change in the posted speed limit. Why then do we bother to post a speed limit? Hurm August 22, 1991 Page Two - Inform those not faITilliar with a road, what speed is considered to be reasonable and safe under ideal conditions. - Inform those living along the road of the prevailing speed of traffic. - Serve as a basis of enforcement against those who drive at unreasonable or unsafe speed. - Contribute to smooth traffic flow on roads with high traffic volume. . To fulfill these functions, however, the numerical value of the speed limit must be consistent with prev3iling operating speeds. Also, considering the functions of a speed limit, it is apparent that a posted speed limit will be of the greatest value on arterial or collector streets where non-local traffic can be expected and where enforcement activity is likely. Most municipalities elect to rely on unposted statutory speed limits for strictly residential streets - for three reasons: 1) Speed limits have little value on streets where almost all traffic consists of local residents who drive the road daily and where enforcement activity is unlikely. 2) Few cities can afford speed limit signs for all of their streets. 3) If each street were to be speed zoned on its own merit, the resulting array of speed limits would be confusing and difficult to enforce. . It has come to our attention that some municipalities and townships within Minnesota are still using black on yellow rectangular shaped signs wi th messages such as: "SLOW CHILDREN" and "T..TATCH OUT FOR CHILDREN," etc. Please be advised that these are not standard signs as listed in the Minnesota Manual on. Uniform Traffic Control Devices and we tnerefore recommend that you remove them from your road system as soon as possible. Alternative signs of the correct diamond shape do exist in the Minne- sota Manual. (Two examples are: sign Wll-X5 "WATCH FOR CHILDREN" and sign Wll-X6 "WATCH FOR PEDS"). To remain effective, however, these signs must only be used in unusual situations. One example might be an area of restricted sight distance where the presence of children is probable and drivers are likely to be unaware of this fact. We do not recommend use of the signs where sight distance is good or in residential areas where drivers should be expecting the presence of children merely because of the type of adjacent development. While we do not presume to suggest that Mn/DOT has any jurisdiction in this matter, we do feel it is appropriate to inform you of the non-conforming use. Droege presented the petition of the Shorewood Oaks residents for the placement of stop signs on Shorewood Oaks Drive, Maple Leaf CirclE Burlwood court and Oak Leaf Trail and the reduction of the speed limit to 15 MFH. The petition also requests SLOW CHILDR&~ AT PLAY signs. Droege said there are many small children in the area and cars speed alons Shorewood Oaks Drive. It is used as a cut through street to Hwy. 7 because a right turn lane is provided on Hwy 7. She said if a right tu~ lane was put in ~ Church Road, the traffic might be reduced. .., Brancel said Public Works Director Zdrazil recommended stop signs only at each end of Shorewood Oaks Drive and each end of Oak Leaf Trail. Also, aT the intersection of Burlwood Court and Maple Leaf and Shorewood Oak Drive. She said a 15 MFH speed limit will need the approval of the State of Minnesota. He said without these houses the assessment of the Pine Bend_project will rise 20% for the remaining homes. He said the City could pay the additional $8000 out of the water fund. to be replaced when the two homes are hooked up. Stover said this would constitute a change in the City's policy and if the project hinges on a change in the water policy it will not get done. She asked if a new public hearing will be necessary because of the change in price. Dresel said yes. RECOMMENDATION: Increase police presence through part time officer enforcement as outlined below. DISCUSSION OF OPTIONS: Speed bumps are not safe and are not effective. As you know, they can also present a great potential for liability for the city. I strongly recommend that speed bumps not be installed. As you also know, a recent City Council action reduced the State of Minnesota approved 30 MPH zone to 25 MPH citing a statute which allows this for bike paths. The street was posted at 25 MPH. However, no bike path exists. Further, we have been advised by the Hennepin County District Court bench, not to write citations alleging violation of the 25 MPH zone based upon a non-existent bike path. . The distance between Vine Hill Road and the stop sign controlled intersection at Sweetwater Curve/Vine Ridge Road is so short that most vehicles would not reach a maximum speed that is ticketable before they have to start slowing down for the upcoming stop sign. We can not write a ticket for a violation that is only slightly over the legal speed limit. Before the courts will accept a ticket , it has to be substantially in excess of the legal limit. The only answer is more frequent police presence. However, we do not have enough officers to have them in the area as frequently as would be necessary to make a noticeable difference in the perceived problem. I will be proposing a resolution to the Coordinating Committee allowing individual cities to hire, at their own expense, additional part time officers to address specific problems such as this~ I do not know what their decision will be. Even if they pass the resolution, an ~ndividual city would still have to have the resources and desire to implement the program in their city. FISCAL AND STAFF IMPACT: Current fiscal and staff resources do not permit addressing this perceived problem as recommended. The inability of posted speed limit signs to curb the intentional violat~r, leads to frequent demands for installation of "speed bumps" in public streets and alleys. However, actual tests of various experimental designs have demonstrated the physical inability of a speed bump to control all types of light weight and heavy-weight vehicles successfully. In fact, a softsprung sedan is encouraged to increase speed far a better ride, while same vehicles may lase control. Speed zoning studies have been placed on our agenda for the following roads as requested in your October'31 letter: Old Market Road - from T.H. 7 to covington Road Covington Road - from Old Market Road to Vine Hill Road Good ~eather and road conditions are required as are normal traffic conditions to determine the optimal speed limit for a road. It is therefore unlikely we can make a definite speed limit determination until the road opens to traffic and weather conditions improve. It might be possible to provide the initial reaction you requested . prior to the November 12 city council meeting. Such an assessment would be based on examination of the construction plans and would, of course, not necessarily be the same as the final spee~ limit determination. We will try to obtain a copy of the plans from our district state aid office, but since there is little time before the November 12 meeting, it might be beneficial if Shorewood would provide us with a copy as insurance. JCH.al Attachment q A Residential Community on Lake Minnetonka's South Shore PETITION SEPTEMBER 10.1992 We, the undersigned, petition the City of Shorewood for street lights to be placed at jointly selected- locations on Covington Road between Vine Hill Road and Sweetwater CurveNine Ridge Road. We believe it is necessary for reasons of safety. Covington Road is very busy at this location and speeding is a major problem. In addition, vandalism to property has taken place. Most other neighborhoods in this area are served by street lights. No doubt our area was not served due to the fact that for a number of years there was a private street light at 5795 Covington Road. The plant has been in operation since January 14, 1992 and producing good quality effluent. The raw water has an iron content of 2.1 parts per million (PPM). Finished water iron is approximately .03 PPM, well below the guarantee of .25 PPM specified. The plant was constructed for $343,336.23 including changes. This cost is approximately 55% of your city engineer's estimate which was based on a plant that they designed several years ago. Associated Consultants Engineers, Inc. (ACEI) was to be compensated on a fixed fee basis of $40,000. This fee was based on a scope of work which was exceeded by the following items: 1. Landscaping Additional landscaping was added to the project prior to the bid letting. This required issuing an Addendum, meeting with the Park Board and meeting with the Park Board consultant. Engineer Drafter Clerical Mileage 37.0 hours 1.0 hours 3.0 hours 20 miles 2. Underground Piping The existing underground piping was not located in accordance with the as- built pumphouse drawings supplied to ACEI by the City of Shorewood. This required three trips to the site, negotiations with the Contractor and additional design work. Engineer 37.5 hours Drafter 5.0 Hours Mileage 60 miles 3. Control System The control system as-built drawings supplied by the City of Shorewood did not correctly describe the system. Several changes were required at different times as these system differences were discovered. These required seven site visits, additional design work and negotiation with the Contractor and the vendor of the original system. . Engineer Mileage 43.5 hours 140 miles 4. Studies and Testing to Optimize Performance The Specifications called for a guarantee of a maximum iron level of .25 PPM in the finished water. This was to be achieved through a combination of aeration and chlorine injection. The cost of the chlorine was estimated to be approximately $2000 annually. This required twelve trips to the site. The testing duration was limited by the tower capacity since for most of the work, the well was required to run. . The effort resulted in a water quality of .03 PPM and very long intervals between backwashes. Chapter 903 of the Shorewood city Code is hereby amended by adding the following: . 903.09 Subd. 3(b) - Delinquencies: After the last day of the month in which payment is due, a penalty of ten percent (10%) of the unpaid account balance will be assessed and added to the amount due on the account. Prior to water being turned back on again, the property owner or user shall be required to pay all delinquent charges, plus penalties and shut-off fees, and the prescribed turn-on fee. 903.09 Subd. 3(d)- Appeals to Discontinuance of Service: The propertv owner or user mav appeal the notice to the ci tv Council durinq the fifteen dav geriod set forth in subd. 3(b). Water service shall continue to the appelinq propertv owner or user pendinq the decision of the Council on the appeal. Because some of the issues regarding this project are somewhat complicated, we thought it advisable to discuss some of them prior to the October 26 assessment hearing. The original Feasibility Report was prepared in November, 1990 and identified construction costs of $10~160.00, indirect (soft) costs of $35,770, and right-of-way costs of $39,270 for ~ total of $177,200. Currently, the construction costs are estimated at $105,500, soft costs associated with construction are at about $35,000, and right-oi-way costs and contingencies are estimated at $87,500 for a total of $228,000. Obviously, the total project cost is significantly higher than originally proposed - primarily because of the high cost of obtaining right-of-way. Originally, the stated intent of the residents was for each to donate the required rlght-of-waYJ leaving only the acquisition of the parcel for the cul-de-sac and legal costs to be assessed. This was the premise upon which the Council voted to proceed. U nfortunatelYJ it appears that at least one of the residents involved intends to resist the easement taking, and a quick and easy resolution to the situation does not appear likely. This, we believe, will lead to the increased easement taking costs noted above. The potential increase in assessments is estimated at $3,500 (from $12,800 to $16,300) for each assessable unit. The proposed cost split include two (2) deferred assessments on the cul-de-sac parcel as originally delineated in the Feasibility Report. Keeping in mind that the proposed assessment has to have a direct bearing on the financial benefit to the parcel involved. staff believes the Council should have some alternatives available. One of these alternatives would be to have the City keep the $24,000 purchase price of the cul-de-sac lot, to be recouped upon future development. With the City assuming a 1/3 portion of the street costs (about 550,000), the proposed assessments would be about $12,700 - very close to the original assessment of 512,800. The Council should also be aware that some or all of the affected residents will be receiving Some of the assessment money back in the form of easement payments. Currently, the estimates for easement payments range from $1,000 to $6,400. While . these payments wm have the result of reducing the net assessment, they must be considered separately from the actual assessment roles according to the City Attorney. HENNEPIN COUNTY RESIDENTIAL RECYCLING FUNDING POLICY I. BACKGROUND Hennepin County has adopted a policy to provide funding support to municipalities for curbside collection of residential recyclables. This policy is the product of input received from municipalities through the Recycling Task Force which reviewed County programs and recommended direction for future program development. . II. POLICY DESCRIPTION The Residential Recycling Funding Policy covers the period from January 1, 1993, to December 31, 1997, and provides for the following: A. Entitlement Grant Municipalities shall receive $1.75 per eligible residential housing unit per month for recycling program expenses including capital and operating costs. Eligible residential housing units are defined as single family through eight- plex residential units, or other residential units with separate entry and where the individual residential unit sets out its own refuse and recycling container, such as a townhome. . B. Incentive Grant A waste reduction and recycling incentive grant fund will be established and will be equal to 5 cents per month per eligible residential housing unit. This incentive fund will be established each year using the total number of households as submitted by each municipality. Any portion of the incentive grant fund not awarded will remain in the Solid Waste Enterprise Fund. This fund will be used to provide grants for the capital and operating costs of new or innovative methods which contribute to the efficiency and effectiveness of residential waste reduction and recycling programs. Also eligible are municipally sponsored programs for multi-housing and dormitories at higher education institutions. 1 The municipal recycling coordinators, as a group, will determine a process to select five municipal representatives to the incentive grant committee. Two County staff will also be on the committee. The committee will develop criteria for incentive grants each year, and will evaluate and select proposals based on these criteria. III. RESPONSIBILITIES OF MUNICIPALITIES A. Aoolication for Funding 1. Entitlement a. Applications for the entitlement must be received by November 1, 1992 and by October 1 for each year thereafter in order to receive entitlement funding for the following year. The application must be accompanied by a city council resolution authorizing submittal of the . application. b. Each municipality applying for entitlement funds must sign an agreement to receive entitlement and incentive payments. 2. Incentive Grants a. Applications for incentive grants are due by March 1, 1993 for the 1993 grant period. Applications must be accompanied by a resolution authorizing submittal of the application. For each year thereafter, applications for incentive grants must be submitted by October 1 in order to qualify for grants for the following year. b. For those cities awarded an incentive grant, an amendment to those cities' entitlement agreements will be prepared in order to ensure that grant funds can be paid to those cities. B. Minimum Program Reauirements . 1. Recvcling Performance Municipalities must recycle 18% of their residential waste stream or the percentage achieved in 1992, whichever is greater. Hennepin County will determine the residential generation upon which this percentage is calculated, unless a municipality is able to measure its residential generation amount. Failure to achieve this percentage goal will result in the requirement that a plan to increase abatement be submitted for Hennepin County approval within 90 days of the submittal of the municipal year-end report.. 2 2. Materials to be Collected At a minimum, the following materials must be collected at curbside: a. Newspaper and advertising supplements; b. Corrugated ca.....dboard; c. Clear, brown and green glass food and beverage containers; d. Metal food and beverage cans; and , e. All plastic bottles with a neck except bottles that previouslycmlCia:i hazardous materials or motor oil. This list may be modified from time to time, with input from municipalities and approval of Hennepin County. . C. Reoorting Reauirements 1. A Semi-Annual and a Final Report must be submitted to the County by July 31 of the grant year and February 15 of the following year, respectively, on forms provided by the County. 2. Incentive grant activities and expenditures must be reported based on requirements developed through the incentive grant process. D. Use of Funds 1. All entitlement funds accepted from the County must be used for waste reduction and recycling capital and operating expenses in the year granted; any unused fund must be returned to the County by April 1 of the following year. . 2. A municipality or township may not charge its residents through property tax, utility fees or any other method for that portion of the costs of its recycling program funded by County entitlement. 3. The municipality or township must establish a separate accounting mechanism such as a project number, activity number, cost center or fund that will separate recycling revenues and expenditures from all other municipal activities including solid waste and yard waste activities. 4. All recycling and waste reduction activities, revenues and expenditures are subject to audit. 5. Municipalities that do not contract for curbside recycl"ing services will receive the entitlement specified in II.A provided these funds are credited back to those residents whose participation in curbside recycling programs can be verified. 3 IV. RESPONSIBILITIES OF HENNEPIN COUNTY A. Entitlement grant payments will be made to a municipality or township. The first entitlement grant payment, amounting to one third of the grant application amount, will be made following the County Board approval of the grant application and execution of the grant agreement. The second and third payments will be made upon receipt of the Semi-Annual and Final Reports. B. The County will convene an incentive grants committee (see II.B) to establish criteria for incentive grant applications. Criteria for the 1993 funding year will be established by January 1, 1993, and by August 1 of the year preceding the funding year, for following periods. C. Hennepin County will continue this funding policy thrQugh December 3.1, 1997, or as long as State and County funds are available to fund this program. The County reserves the right to change any provision of this policy by Board resolution, with 90 days notice. . V. MULTI-HOUSING PROGRAM Hennepin County will continue to support multi-housing recycling through the following: A. The five cent incentive program (II. B) may be used to cover multi-housing and dormitory recycling projects. B. Technical assistance will be provided to support multi-housing recycling programs. . C. I would expect to find more tags on Vine Hill Road because experience has shown there tend to be more violations on that road. There also has been the concern over the 25 MPH limit without the official bike path on portions of Covington. The court has expressed their concern that we do not write tags for the 25 MPH violation until such time as a bike path really exists in those locations. Finally, I repeat that I was not expecting to give a report so I have not been accumulating the data.
