AGENDA ITEM 3A - This is a resolution proclaiming the month of
March as Chronic Fatigue Syndrome Awareness month as requested by
the CFS Association of Minnesota.

AGENDA ITEM 3D - The motion to be voted on here is to approve an
extension until September 9, 1992 for submitting final plat for the
three lot division at 25985 smithtown Road (Jim and Barb Neitge).
This is recommended and consistent with past practice.
AGENDA ITEM 3E - The previous City Hall cleaner recently resigned
due to other committments. Staff recommends the City Council
approve by motion an agreement with Jeffrey Reinhart to begin
cleaning City Hall at a rate of $59 per week. This is $5 per week
higher than the previous agreement but includes trash removal and
all cleaning supplies. This is more efficient than requiring
personnel from Public Works to collect and remove trash.

AGENDA ITEM 4B - The Park Commission is looking at the early part
of 1993 for a Park referendum. They have determined that with or
without a referendum grading and pond excavation of Silverwood Park
should be done in 1992. The Park fund has a balance of $30,000 and
we are anticipating an additional $25,000 during 1992. The Council
might then consider approving a $55,000 budget: $5,000 for
engineering and project management; and $50,000 for grading and
excavation and miscellaneous.
AGENDA ITEM 4C - The City Council is asked to review and approve
the general concept plan for Silverwood Park and approve the Letter
of Agreement with VanDoren Hazard & stallings for engineering and
project management for this project. This is a Park Commission
recommendation.
AGENDA ITEM 4D - citizens will be asked for comment on the proposed
trail plan. Staff and Park Commission members will be available to
present the plan Tuesday, 3/24; 2:00 - 4:00 pm & 7:00 - 9:00 pm.
AGENDA ITEM 4E - The Park Commission would like the Administrator
to discuss very informally with the City of Chanhassen questions
concerning Cathcart Park (ie. program scheduling, special
assessment policies, and capital improvements).
AGENDA ITEM 4F - The results of the Park Commissions telephone
survey are enclosed in the packet. 140 Shorewood residents were
telephoned. A one page executive summary is page one of the
report. The report is quite readable and I encourage you to spend
10 - 15 minutes reviewing it so that you can draw your own
conclusions.
AGENDA ITEM SB This proposed

hold the required public hearing on the potential vacation of a

however not take any action at this meeting but rather wait until
further Planning Commission input is received for the April 13
meeting.

AGENDA ITEM 7 - 7:30 P.M. - PUBLIC HEARING - This is the required
public hearing for the community Development Block Grant Program
(CDBG) . When the hearing notice was prepared the City of
Shorewood's allocation was $22,779 since then we have been notified
that our allocation has been reduced to $22,358. That is a
reduction of $421. I have asked the CDBG Program office to prepare
a memorandum for us explaining the effects of taking the funds that
had been set aside for the housing rehabilitation program and using
those funds for renovations required by the American Disability
Act. That communication has not arrived at this point. Further,
the Southshore Senior Center asked the -City to consider an
additional $2,000 to $3,000 of funding. That request is attached
in the packet. It should be noted that the request for funding
does not have to be returned to Hennepin County until April 15. So
if the Council wishes to hold off on the decision until their next
full meeting on April 13 there would be time to do so.
AGENDA ITEM 8 -Representatives from EOS Architecture will make a
presentation on the plans and specifications for the Public Works
facili ty. They will also review the updated budget. The
resolution authorizing advertisement for bids is enclosed.

AGENDA ITEM 9 - It is my hope that the City Council was pleased
with the way last years Spring Cleanup went. We are proposing the
same effort for 1992. The Council should approve the Letter of
Agreement with BFI.
AGENDA ITEM 12-4A- If the City Council agrees with the proposed
City Values which was discussed at the last Council work session,
a motion approving the proposed value would be in order.
AGENDA ITEM 4B - The City Council should be aware that the
Ordinance bringing all the various fees and charges together in one
location in the City Code will cost up to $1,500 in order to bring
our Code up to date. This will be a one time major expense.

Administrator Hurm presented the City Council Work Calendar and a
partial list of the City of Shorewood Accomplishments for 1991. He
asked the Council if they had any additions.
The Council had no additions.
Hurm reviewed the Shorewood Statement of Purpose and Statement of City
Values.
Brancel asked if the Council wished to review the Board Member Manual.
The Council decided not to review the Manual.
Daugherty said he felt the City Newsletter did not reach the people. He
said the newsletter should be more visible.
Finance Director Rolek suggested the newsletter could be redesigned and
mailed out quarterly and professionally typeset.

Hurm said Beverly Von Feldt will be attending a desktop publishing class
and can ask how the newsletter can be updated.
Hurm presented the Staff Concensus Sheet of Issues Facing the City in
1992. The staff prioritized the issues according to the following
system:
1A High Council Control; High Impact
1B High Council Control; Low Impact
2A Low Council Control; High Impact
2B Low Couoncil Control; Low Impact
The staff also estimated the amount of staff time required for each
issue according to a scale of 1 to 10 with one requiring the least
amount of time.
Hurm then asked the Council to prioritze the issues. They used a 1 to 5
rating system with 5 being urgent and most important, down to one being
not urgent and not important. He asked them to attempt to have equal
numbers of fives, fours, threes, twos and ones.

Gagne asked how much staff time was devoted to the list. Hurm said
several hours.
A summary of the Council priority consensus is attached to and made a
part of these minutes.
Daugherty said he thought the rating procedure was creative and
positive~
Hurm said the staff will develop a report based on the priorities list
and draft an action plan.
Gagne asked Hurm if the City had requested RFP's from banks. He thought
this item was requested by the Council in January. Lewis and Daugherty
concurred.

Hurm said it was his understanding the RFP's were to be requested
somtime during the coming year.
The Council indicated requesting the RFP's from Banks IS an immediate
priority.
Hurm agreed to do this.
Public Works Director Zdrazil said the Little League Field at Freeman
Park has not yet been satisfactorily completed. He said work remains to
be done in the spring.
Daugherty asked Rolek what procedure is used to review where City funds
are invested.

Rolek stated there are State guidelines for investing the City's money.
He said he reviews the idle funds and analyzes the cash flow and bonded
debt service paYment schedules. Rolek informed Daugherty he uses five
different investment firms and banks to acquire the best instrument and
yield for the City's investments. He said the City's funds are invested
in short and long term investments, depending upon the liquidity needs
of the City. .
Daugherty asked the average dollar amount invested. Rolek said about
4.5 million. Daugherty asked Rolek if an investment advisor is used.
Rolek said investment advisors are not commonly used by cities.
Daugherty asked the rest of the Council if they thought an advisor
should be used.
Lewis said he thought one might be helpful.

Rolek said the investment of City funds is part of the day to day
operation of the City and about 15% of his time is allocated to it. He
said it would still require his time even if an advisor was used. Rolek
also stated the liquidity of funds is important to consider.
However, he said it is possible the City may receive a better return if
the money was actively managed.
Hurm said the advisor would also take a fee and therefore the return
would have to be greater.
Rolek ~aid the City's return has been good but there are no figures
available to compare the return with other cities.
Gagne asked if the guidelines for the City are different than tor an
individual. Hurm and Rolek said they are.
Gagne said the staff should find out how many other cities use a
financial consultant. Hurm said this may be available from the State
Finance Office or the League of Minnesota Cities.
Daugherty asked that a Financial Consultant be added to the Issues List
as number 43 with a 4 priority. Lewis agreed. The Council did not
object.

A RESOLUTION PROCLAIMING THE MONTH OF MARCH AS
AWARENESS OF CHRONIC FATIGUE SYNDROME (CFS) MONTH
WHEREAS, Chronic Fatigue Syndrome (CFS) is a serious illness
marked by debilitating fatigue and weakness, accompanied by flu-
like sYmptoms and cognitive impairment; and
WHEREAS, victims often experience sYmptoms of sufficient
severity to interfere with their participation in the activities of
daily life for many months or years, and the loss to society of
productive people in their prime earnings years is great; and
WHEREAS, Because some physicians are unfamiliar with CFS,
routine diagnostic tests fail to suggest a specific disease, and
insurance and disability compensators may delay or deny CFS-related
claims, the burdens for CFS sufferers are even greater; and
WHEREAS, There is an alarming lack of understanding and concern
about how CFS impacts individuals, diminishing their ability to
enjoy life, disrupting education and employment, and creating
tremendous medical expenses; and
NOW THEREFORE BE IT RESOLVED that the Chronic Fatigue Syndrome
Association of Minnesota continue to provide reliable information
to the afflicted and their families, the health care providers and
the public to stimulate interest in finding effective treatments
and a cure for CFS.
FINALLY, we urge all residents to become aware of this disorder
and support efforts to find a cure.

RE: REQUEST FOR PROCLAMATION TO DESIGNATE MARCH AS CHRONIC
FATIGUE SYNDROlVIE AWARENESS MONTH
Dear Mayor,
I am writing to urge your favorable consideration of the enclosed letter from one of
your constituents, which requests that you issue an official proclamation which
designates March, 1992 as Chronic Fatigue Syndrome Awareness Month in your
community. CFS is a life-altering illness which has been recognized and studied by
the U.S. Centers for Disease Control. It differs from the typical feelings of fatigue by
degree and duration and includes an array of other debilitating symptoms. Please see
the enclosed literature for more information about CFS.
.
Volunteers for the CFS Association of Minnesota are working in conjunction with the
National Chronic Fatigue Syndrome Association, which is sponsoring a nationwide
effort to encourage government officials to proclaim for the first time an entire month
for CFS awareness. We work closely with this organization because of our mutual
goal to promote medically accurate information about CFS.
We have enclosed a sample CFS proclamation, similar to the one used in past years by
Governor Carlson, for your consideration. Additionally, we request that you present
the proclamation to representatives of our organization, possibly at a city council
meeting, around the end of February or early in March.
We would also be honored to have your participation in our awareness celebration
which will be held from 1-4 p.m., Sunday, March 15, at Abbott Northwestern
Hospital in Minneapolis.

Thank you for your assistance in the recognition of CFS as a serious health concern in
Minnesota.

WHEREAS, The boundaries of Legislative Districts 43A and
43B have changed; and
WHEREAS, this boundary change results in Precinct I being
moved from Legislative District 43A to Legislative District 43B;
and
WHEREAS, the new boundary line separating Legislati ve
District 43A from Legislative District 43B results in a change in
the precinct boundary line between Precinct I and Precinct III;
and

WHEREAS, the City Administrator/Clerk has submitted for
approval a list of election judges to officiate at the 1992
Presidential Primary election; and
WHEREAS, said list appears to be correct and complete in
all respects.
NOW, THEREFORE, BE IT RESOLVED by the City Council of ~he

Thank you for the opportunity to prepare plans and specifications and act as project
managers for grading and pond excavation at Silverwood Park. We are prepared to proceed
immediately with the work necessary to complete the project in a timely manner. This letter
contains information regarding scope of services, project schedule and proposed fee.
Scope of Services

As discussed at the February 25, 1992 Shorewood Park Commission meeting, there is
$55,200 budgeted in the 1992 Shorewood CIP for grading and pond excavation in Silverwood
Park. In preparing for construction we propose the following services be provided by
Van Doren - Hazard - Stallings, Inc.:

. Survey City land and easement to Silver Lake.
. Detail grading plans for a completed park, including pond excavation, with an erosion
control element.
. Cost estimates.
. Project budget and schedule.
. Administering bid process - specs.
. General project management, including acquiring permits (ie. U.S. Corp of Engineers,
Watershed District) and approve pay vouchers.
. Staking.
. Work with the Public Works Director at least weekly on inspection of the project.
Project Sebedule
The timely pTogress and completion of this project is important to the endeavors of the City.

Proposed Fee
Based upon the scope of this project, we propose a fee on an hourly basis not to exceed
$5,000 plus necessary reimbursable expenses associated with the project.
We propose to bill for these services in accordance with the attached hourly rate schedule.
Reimbursable expenses for printing, copying, shipping, mileage and facsimile will be invoiced
at the rates indicated. If needed, additional services will be billed for at the same hourly

I. EXECUTIVE SUMMARY
The Shorewood Park Commission determined that the first step in planning for a park
referendum would be a telephone opinion survey. with the aid of City staff and Judy
Marshik of Quik Research Inc. the Commission designed a ten question survey instrument
to acquire opinion data (see Appendix A). It was determined that 140 Shorewood residents
would be surveyed in late January and early February. This was just before the Minnetonka
School District referendum was held.
Following a training meeting the Commissioners began making their calls from a randomly
selected list of Shorewood telephone numbers. Those interviewed were screened. Only
property tax paying Shorewood registered voters were surveyed. This report is the results .
of the survey.
The second section of the report (II Neighborhood Sample) illustrates the locations of the
completed surveys. A map of the City identifying neighborhoods by number is Appendix
B. Section III is the result of the ten questions asked. Section IV is a series of "crosstabs",
that is, six questions were cross tabbed with question 7 with answers broken down for those
who would vote for or against the park improvement referendum. There is a lot of data in
this report. Because the results are computerized more cross-tabulations could be done if
requested. However, at this point, a few specific observations can be made:

And a few general conclusions can be drawn:
. There is good support for a park referendum
. There are ways that the "positives" could be reinforced and enhanced: tie in trail
expansion, and encourage park usage because park users are generally more positive.
It is our hope that those reading this report will find it very easy to understand and
interpret. The reader should then be able to make meaningful observations and additional
conclusions.

. 6. Shorewood has five parks and a multi-use trail. Four of the parks are neighborhood
parks; Badger Park, in the central part of the City; Cathcart Park, in the southwest
portion of the City; Manor Park, to the northeast of the City; and Silverwood Park,
to the southeast. Freeman Park is the City-wide park and is located near Highway
7 and Eureka Road. Proposed improvements to these Shorewood City parks include:
open skating areas, improved children's play areas, picnic areas, tennis courts,
additional parking areas, playing fields, nature trails and other improvements.

, In 1985 the 'City established a. 75...fooUakeshoresetback -reG.uirCfiJ.ent for Lake Minnetonka, in
order to be consistent with the Minnehaha Creek Watershed District. The MCWD later
revised its requirement to 50 feet, consistent with State shoreland management regulations,
'.v hen it realized that Shorewood was entirely served by city sewer. Subsequently, in 1986,
the City revised its requirement back to the 50-foot requirement which had existed for years.
.
A recent inquiry by the Upper Lake Minnetonka Yacht Club brought to the attention of this
office that the lake shore setback for the L-R, Lakeshore Recreational District was never
shanged from 75 feet to 50 feet when the setback was changed for other zoning districts.
While this has an adverse effect on the Yacht Club's ability to conform to the Code, the staff
believes it was an oversight that should be corrected by the City. Consequently it is __
suggested that the Code be. amended at the City's own initiative.
Following are the three sites which are potentially affect~d by the L-R District requirements
and their current zoning status:
1) Upper Lake Minnetonka Yacht Club: R~lC, Sing1e:-Family Residential
2) Howard's Point Marina: R-1A, Single-Family Residential
3) Shorcwood Yacht Club: R-1A, Single-Family Residential
It should be noted that none of these facilities has applied for L-R District zoning.

ANALYSIS/RECOMMENDATION
The City spent a considerable amount of time in the 1970's trying to develop an ordinance
which provides for access to Lake. Minnetonka, while at the same time protects residential
properties adjoining the access sites. This effort culminated in the provisions of the
Lakeshore Recreational District found in Section 1201.24 of the City Code. Although.not
specifically stated, the Code limits lakeshore recreational use to the three sites- which
currently exist. Additional sites are precluded by the requirement that no site can be located
within 5000 feet of an existing multiple dock facility.
.
Bringing these sites into conformity with the L-R District requirements can benifit both the
City as well as the facilities themselves. As conforming uses under the L-R District the
facilities could make changes which are not currently allowed for nonconforming uses in
residential districts. As an example, Howard's Point Marina could update and even enlarge
its' underground fuel tanks and provide pump-out service for its' customers. The City'
benefits by the licensing and annual review of licenses, parking requirement compliance,
landscaping and screening requirements, etc.
The L-R District already requires a 50-foot side yard setback adjoining residential uses, 30
feet more than other uses must provide. Requiring an additional 25 feet more of lakeshore
setback than other uses must provide makes it less and less practical for owners of the
existing sites to apply for L-R zoning. It should be remembered that the 75-foot setback is
associated with on-site septic systems. Also, requiring buildings to be located 75 feet from
the lake invariably forces parking on the lake side of the site (parking is allowed to be 50
feet from the lake). This seems contrary to Shorewood's past practice of protecting the lake.

Had the City not intended for these facilities to continue in existence, it could have left them
as nonconforming uses in their respective residential zoning districts. In view of the purpose
of the L-R District, it is recommended that the City amend the Code to require a 50-foot
setback in the L- R District.

BACKGROUND

Mr. Thomas Doherty owns the property located at 20375 Manor Road (see Site Location
map - Exhibit A, attached), which abuts the east side of Gardendale Road, a platted, but
undeveloped street right-of-way. Gardendale Road separates his homestead parcel from a
triangular shaped parcel on the west side of the r.o. w. , -upon which his driveway is located.
Mr. Doherty requests that the City of Shorewood vacate a portion of Gardendale Road
adjoining his home.

Gardendale Road serves as the only access to an approximately three acre site south of
Doherty's. The owner, JamesBeal, was granted a permit almost two years ago to clear an
access path to his property. That approval specified that construction of a driveway would ~
require an additional r.o.w. permit at such time as someone applies for a building permit for
the Beal property. Review of that request revealed that the right-of-way comes extremely
close to Mr. Doherty's house. In fact a recent survey by Mr. Doherty (see Exhibit B,
attached) indicates that his house actually encroaches onto the right-of-way.
Mr. Doherty's survey shows the portion of the road he would like vacated. At staff's
direction he has also shown a portion of his westerly parcel which he proposes to trade back
to the City so that the Beal property will still have access.

ANALYSIS/RECOMMENDATION
While the proposed r .0. w. trade obviously benefits the applicant, it also improves the
intersection of Gardendale Road with Manor Road by making its angle closer to ninety
degrees. This is particularly important given the proximity of the intersection to
Knightsbridge Road just west of Gardendale.
There is some question as to how much r.o.w. should be vacated. Although the parcel the
. applicant proposes to convey to the City is the same width as that being vacated, the
resulting r.o.w. tapers down to approximately 19 feet in front of his garage. It is
recommended that the line be moved closer to the applicant's garage so that the r.o.w. is not
reduced to less than 25 feet in width. /

It is recommended that the City approve the subdivision/combination and partial street
.vacation subject to the following:
1. The applicant must submit a revised legal description of the r.o.w. to be vacated,
showing the r.o.w. no less than 25 feet in width.
2. The applicant must provide an up-to-date (within 30 days)' title opinion for the
property to be conveyed to the City.
3.
The vacation and division/combination must be recorded within 60 days of the
Council's approval of the request. (Note: The Subdivision Ordirtance requires that
division be recorded within 30 days. However, we are aware that there are title
questions on the triangular parcel which may take additional time to clear.)

4. Prior to release of the resolution approving the applicant's request, the applicant must
submit an executed application for a right-of-way permit (see Exhibit C, attached).

RESOLUTION APPROVING PROJECTED USE OF FUNDS FOR YEAR XVIII
OF THE URBAN HENNEPIN COUNTY COMMUNITY DEVELOPMENT
BLOCK GRANT PROGRAM
WHEREAS, the City of Shorewood, through execution of a Joint
Coorperation Agreement with Hennepin County, is cooperating in the
Urban Hennepin County Community Development Block Grant Program;
and

WHEREAS, the City of Shorewood has developed a proposal for
the use of Urban Hennepin County CDBG funds made available to it,
and held a public hearing on March 9th, 1992 to obtain the views of
citizens on local and Urban Hennepin County housing and community
development needs and the City's proposed use of $22,779.00 from
the Year XVIII Urban Hennepin county Community Development Block
Grant.
BE IT RESOLVED, that the City Council of the City of Shorewood
approves the following projects for funding from the Year XVIII
Urban Hennepin County Community Development Block Grant program
related and applicable program income and authorizes submittal of
the proposal to Hennepin County for review and inclusion in the

COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM
NOTICE IS HEREBY GIVEN that the city of Shorewood in cooperation with Hennepin County,
pursuant to nUe I of the Housing and Community Development Ad of 1974, as amended. is holding
a public hearing on March 9,1992. at 7:30 p,m. in the Council Chambers of Shorewood City Hall.
The public hearing is on housing and community development needs of the city and UrbaIi Hen- -
nepin County, the Urban Hennepin County Community Development Block Grant Program State-:
ment of Objectives and the propa;ed use of the Year XVIII Urban Hennepin County Community
Development Block Grant Program planning allocation of $22,779 by the city. -
During the July 1. 1992 to JW1e 30, 1993 program year it is estimated that no additional program. .
income from locally funded CDBG activities will be available to the city. .
The Statement of Objectives basically consists of the following seven program areas: (l) AD-
MINISTRATION, to maximize program benefiland effectively administer program funds; (2)
_ HOUSING, to rehabilitate and assist in the development of housing which is affordable to low.
and moderate-income households; (3) NEIGHBORHOOD REV1TAUZATION, to maintain and
preserve viable neighborhoods through concentrated community development activities; (4)
PUBUC FACIUTIES. to improve existing and assist in the development of new public facilities
_ which benefit low-and moderate-income persons; (5) ECONOMIC DEVELOPMENT, to provide
fmancia1 assistance to businesses which will provide or retain employment to the benefit of low-
and moderate-income persons; (6) PUBUC SERVICES, to expand and improve the quantity and
quality of public services available to low- and moderate-income persons; and (7) REMOVAL OF
ARCHITEcroRAL BARRIERS. to alleviate cooditioos which restrict the mobility and accessibility
of elderly or handicapped persons.

Dear Mayor Brancel:
This letter is meant as a follow-up to our conversation about
the possible increase in support by the City of Shorewood for the
Southshore Senior Center. The City of Chanhassen has
embarked on the development of a new Senior Center located in
the lower level of its Municipal building. As a regular funder of
the Southshore Senior Center in the past, Chanhassen has
recently indicated that we should anticipate a significant
decrease in Southshore Center support in the next Community
Development Block Grant (CDBG Year XVIII) fiscal year.
In a letter dated February 11th, I wrote to you requesting $ 6,482
for the 1992-93 fiscal year from the City of Shorewood to support
the Southshore Senior Center. I would like you to consider
increasing that level by $2-3,000. This would significantly lesson
the impact of the expected cut and should go a long way towards
maintaining the Center's viability.
Underlying all programs operated by Senior Community
Services is the desire to help people maintain their
independence. The South shore Senior Center, with its dining
and transportation services, educational programs, and as a place
to meet with friends, plays a direct role in assisting the Center's
participants to maintain their independence remaining in their
respective communities for as long as possible.

Senior Community Services is requesting $ 6,482 for the
1992-93 fiscal year from the City of Shorewood to support the
Southshore Senior Center. This amount reflects a 4% cost-of-
living-increase. The City provided $ 6,233 for the past year
through its share of County-wide Community Development
Block Grant (CDBG Year XVII) funds.
Shorewood, along with the other cities that support the
Southshore Senior Center, provides a very valuable service to
its elderly residents. Dining, transportation and the meeting
with friends, helps maintain the independence of the Center's
participants in their respective communities for as long as
possible.

REVISED 1992 CDBG PLANNING ALLOCATIONS
HUD has reduced the 1992 (Year XIII) CDBG allocation to Urban Hennepin County
by $52,000. The accompanying schedule represents this reduction and the
resulting planning allocation for each community. Please use these amounts
in finalizing your 1992 request for funding.
HUD explained the reduction as a result of the 1990 Census showing no
population in the Hennepin County portion of Chanhassen, therefore, eliminat-
ing Chanhassen's statistics from HUD's allocation formula. HUD's decision is
being questioned, although HUD has assured us the allocation for 1992 will
not be changed.

A RESOLUTION APPROVING PLANS AND SPECIFICATIONS
AND ORDERING ADVERTISEMENT FOR BIDS FOR
THE PUBLIC WORKS FACILITY
WHEREAS, on December 9, 1991, the city council authorized EOS
Architecture to prepare plans and specifications for the Public
Works facility.
NOW, THEREFORE, BE IT RESOLVED by the City council of the City
of Shorewood as follows:
1. That such plans and specifications, dated March 13, 1992
are hereby approved.
.
2. That the ci ty Clerk shall prepare and cause to be
inserted in the official newspaper and in "Construction Bulletin"
an advertisement for bids upon the making of such improvement under
such approved plans and specifications. The advertisement shall
specify the work to be done, shall state that bids will be received
by the Clerk until 11:00 a.m., on April 8, 1992, at which time they
will be publicly opened in the Council Chambers of the City Hall by
the City Clerk, will then be tabulated, and will be considered by
the Council at 7: 00 p. m. on April 13, 1992, in the Council
Chambers, and that no bids will be considered unless sealed and
filed with the Clerk and accompanied by a cash deposit, cashier's
check, bid bond or certified check payable to the Clerk for five
per cent (5%) of the amount of such bid.

will be handled similarly to last years.

Both the curbside pickup and the drop-off site are for Shorewood
residents only. Those using the drop-off site will be required to
show proof that they are Shorewood residents.
Larqe Volumes of Brush and Yard Waste, and Trees
Since the curbside pickup is limited to bagged yard waste and
manageable bundles of .brush, it may not be practical for some
residents with large volumes of brush, logs, etc. to utilize the
cudrbside service. Those residents have three apparent options:
1. Contact a private company, listed in the Yellow Pages
under Tree Service, which chips trees and brush. (Bagged
woodchips can be accepted in the curbside cleanup).
2.
Take large loads (no compost materials) to the Hennepin
County Tree Disposal Site in Maple Grove, operated by
Ceres Tree Co. The site is open weekdays 8: 00 am to 4: 00
pm and Saturdays 10:00 am to 2:00 pm. Call 420-7045 for
fees and directions to the site.
3. Make arrangements with a private company to have a
dumpster brough to your property. Yard waste collected
in the Spring Clean up will go to R & W Roll-Off Service
Inc. (448-7833), who can also provide dumpsters.

RE: Spring Cleanup - Shorewood
Dear Mr. Hurm:

Thank you for the opportunity to do the Spring Cleanup collection for the City
of Shorewood. We appreciated doing the service for you last year. We anticipate
that there may be more yardwaste than last year because of the early snow storm
( on Halloween ) and an earlier cleanup date this year than last ( May 9th instead
of June 1st ).
Our charge would be $60.00 per hour again this year for each truck we use. All
disposal costs ( tipping fees ) will be charged back to the city of Shorewood.
Tipping fees have not been increased since last year but we plan to not spend
the extra time "debagging" the grass and leaves at the curb this year. It is
considerably faster to throw the bags directly into the truck and have the compost
site do the debagging process. The tipping fee for bagged yardwaste is $7.50 per
yard, however, compared to $4.00 when it was debagged and mixed with the brush.
We expect the savings in time will offset the increase in disposal.
A special extra charge of $15.00 will be charged at the disposal site for hide- .
abeds. Also, rolls of carpet that exceed six (6) feet in length and 12 inches in
diameter will cost an extra $15.00, so you might want to advise residents about
how to prepare their rolls of carpet before they bring them to the drop-off center.
They also should not tie the rolls of carpet with wire.
Last year we did not haul away the tires, batteries and large appliances that
were taken to the drop-off site but we certainly can do it for you if you want.
We can see how many of these items are brought in and take care of it on Monday
if necessary.
We plan to start our curbside collection of trash and yardwaste at 8:00 A.M. on
Saturday, May 9th. We understand the curbside collection to be limited to the
following items:
1.) Household rubbish to include small furniture items.
2.) Grass and leaves in bags.
3.) Brush cut in four (4) foot lengths and bundled so one man can easily handle it.
Hazardous waste and construction debris will not be collected.

Our annual half-marathon between Wayzata and Excelsior is scheduled

The amendment was prepared in response to the 1988 Metropolitan
Systems Information Statement, and contains updated population,

As you may know, the City of Chanhassen will not be
funding the Southshore Senior Center as they have in the
past due to their embarking on the development of a new
center to be located in the lower level of the Municipal
Building.
Due to this decrease, we are anticipating a cut of $3,876
in Southshore funding.
We have divided the projected shortfall among the
South shore cities proportionately based on the number of
residents aged 60+. We hope the City of Shorewood will
provide $1,221 in addition to our original request of
$6,482 making the total request $7,703.

The city of Shorewood has participated in tho Urban Hennepi.n County COIlllDunl-.
ty Development Block Grant Program since its establishment in 1975. During
the first 17 years of the program the city has reeei~ed $566;746, of which
$237,7l~ (41.9~) ~s b$en ucod for the doferred payment hOU5ing rehabilita-
tion loans. Approximately 30 low- and modera.t$~income Shorewood homeowners
have received assistance through the program to date. The homeowners
r~cQiving the rehabilit4tion ~GGiotance arc only required to repay the
"loan" if the property is sold within a ten-year period.
Currently, two Sho~ewood re~identa have submitted .applications for housing
reha~ilitation assistance and are on the p~ogram's waiting list. As waiting
list clients, their eligibility for the program based upon household income
h~o not yet been verified.
Should the City elect not to fund housing rehabilitation, the households on
the waiting list will be given the opportuni~ to make application !v~ ~le
Minnesota Housing Finance Agency Housing Rehabilitation Deferred Payment
Loan Program. MHFA / S program is similar to the CUBe. program except that the
household i~come limits are approximAt~ly 45 percent of Lh~ ~uL.euL cnSG

SHOREWOOD CITY CODE RELATING TO ZONING REGULATIONS
THE CITY COUNCIL OF THE CITY OF SHOREWOOD, MINNESOTA, ORDAINS:
Section 1: Section 1201.24, Subd. 3.d.(2) of the Shorewood City Code is hereby amended
to read as follows: .
"(2) Rear yard

Section 2: This Ordinance shall be in full force and effect from and after its passage and

Schultz moved, Leslie seconded to approve the Planning Commission Minutes of 4 February
1992 as written. Motion carried - 5-0.
7:00 P.M. PUBLIC HEARING - ZONING ORDINANCE AMENDMENT - REDUCE
THE REAR YARD SETBACK IN THE LAKESHORE-RECREATIONAL (L-R) DISTRICT
Planning Director Nielsen reviewed his report stating that in 1985 the City established a 75-
foot lakeshore setback requirement for Lake Minnetonka, consistent with the Minnehaha
Creek Watershed District. The MCWD later revised its requirement to 50 feet, consistent
with State shoreland management regulations, when it realized that Shorewood was entirely
served by city sewer. Subsequently, in 1986, the City revised its requirement back to the
50-foot requirement. A recent inquiry by the Upper Lake Minnetonka Yacht Club brought to
the attention of the City that the lakeshore setback for the L-R, Lakeshore-Recreational
District was never changed from 75 to 50 feet when the setback was changed for other
zoning districts. It is suggested that the Code be amended at the City's own initiative.
Public portion of the public hearing opened at 7:05 P.M.
Skip Jewett of the Upper Lake Minnetonka Yacht Club, was present to listen and made no
comments.
Robert Rascop, Enchanted Point, said he is in favor of the 50-foot setback, but does have
concerns about the Upper Lake Minnetonka Yacht Club itself.
Chair Benson said the issues discussed need to remain strictly on the L-R District setback,
and not stray to private development matters, such as the Yacht Club's individually.

Hansen moved, seconded by Leslie to recommend to Council approval of reduction of the
lakeshore setback in the L-R, Lakeshore-Recreational District to 50 feet.
Schultz said he is concerned about the intensity of use by commercial facilities and does not
want to see it increase by reducing the setback.
Nielsen explained that parking can be located 50 feet from the lake, regardless of the
building setbacks, and if buildings are forced back to the 75-foot setback, parking tends to
end up on the lakeshore side of the site. Allowing buildings at the 50-foot setback may
reverse this effect.
Gagne remarked that he believes the Howard's Point Marina has not taken steps to rezone
and comply with zoning regulations because they don't want to spend money on required
improvements.
Benson said he feels lake access is desirable, and he doesn't object to the 50-foot setback.
Rosenberger said he agrees with Schultz and does not feel the current 75-foot setback is a
problem.
Hansen feels the 75-foot setback is relative to on-site sewer systems, and that the City should
address the existing uses.
Motion carried - 3-2 (Rosenberger, Schultz - nay~)
This item will appear on the Council agenda of 9 March 1992.
INTRODUCTION OF PARK COMMISSION LIAISON - STEVEN DZURAK
Steve Dzurak appeared to introduce himself as Park Commission liaison to the Planning
Commission. He said he intends to review Planning Commission agendas and minutes and
attend Planning Commission meetings on an as-needed basis. .
Benson. and Schultz suggested that Mr. Dzurak remind the Park Commission that the
Planning Commission has strongly recommended in favor of a permanent structure at Manor
Park for warming house purposes, and that they should budget for saine.
INFORMAL DISCUSSION - COMPREHENSIVE PLAN ISSUES
Nielsen reviewed a list of issues prepared by the Planning Department in a memorandum
dated 18 February 1992. The Commission suggested the following additional issues be
studied:

Hanson suggested that the City review its policies regarding clearing trees on public
property .
Rosenberg suggests that senior housing is a significant issue to be addressed. The
Commission agreed that a more active approach by the City may be necessary.
Rosenberg feels that the City should consider increased control on garbage haulers as a
means to protecting streets.
The Commission agreed that efforts should continue to share more services with surrounding
communities.
