EXECUTIVE SUMMARY SHOREWOOD CITY COUNCIL AGENDA MONDAY, OCTOBER 14, 1991 AGENDA ITEM 3A - This item simply directs staff to prepare the findings of fact regarding a conditional use permit application for accessory space in excess of 1200 square feet at 5235 Howards Point Road. AGENDA ITEM 3B - This is a very similar request for accessory space over 1200 square feet. The action is to direct the staff to prepare findings of fact for the next meeting. The address is 6085 Riviera Lane. AGENDA ITEM 3C - The motion is to extend a deadline for the removal of a unlicensed Jeep from the premises at 23985 Smithtown Road. The appellant requests an extension to the end of October because his parents return home October 28th and at that time he can get the title from his parents safe deposit box so it can be properly licensed. AGENDA ITEM 3D - Jan Bredeson, 5960 Christmas Lake Road, requests that parking be allowed on one side of the road on October 25, 1991 from 7:00 pm for the remainder of the night. This request is for a wedding party. The Police Department concurs with the request but asks the following: 1) the legal parking area must clearly be marked by the Bredeson's and they must provide someone to assist the guests in parking in the authorized area; 2) parking would be allowed on one side of the street in such a manner as to allow the other residents and emergency vehicles the use of the roadway; 3) they should notify the Police Department of the final arrangements. The motion is for the approval of the request. first pay request for The amount of the Hardrives, Inc. The AGENDA ITEM 4 - 7:00 pm Public hearing on Shady Hills storm sewer improvement. Staff will make a presentation including a history of the project and explain the proposed levy. Following the public hearing no further action by the Council is required. .__O--:>.T"'_~_.'''''_~'--'--'--''-''''_______._~;'''_______.'''_.' . . EXECUTIVE SUMMARY - OCTOBER 14, 1991 PAGE TWO AGENDA ITEM 5 - 7:15 pm Public hearing on assessments on the Water Treatment Plant for the southeast area. Staff will make a presentation on the history of events and explain the assessment process and what special assessments are to be levied. It should be noted here that the City Council has discussed the possibility of abating some of the later assessment installments if the current municipal water system is expanded to incorporate a greater user base. The action is a resolution approving the special assessments for the project. AGENDA ITEMS 6 & 7 - Monique Droege, 26060 Shorewood Oaks Drive, requested that this be placed back on the agenda. The City Council has taken the actions that deems it appropriate. It seems that the request still stands for more stop signs in the Shorewood Oaks area. The speed study by the Police Department shows that there does not seem to be a speed problem in that area. It is worth noting on the second page, on October 6th, an Officer received a complaint from a Strawberry Lane resident that all summer long the Shorewood Oaks residents stand in the street with their children talking and playing. The Covington Road/Vine Ridge request did not relate to speed so the Police Department study centered on stop signs. Again the State strongly discourages the use of "slow children" signs and professional traffic safety engineers discourage their use because they can give a false sense of security, and cause a proliferation signs for drivers to read. AGENDA ITEM 8 - PLEASE BRING TO THE MEETING YOUR COpy OF THE LAKE MINNETONKA MANAGEMENT PLAN - Gene Strommen, from LMCD, will be present to review the Plan for the Council. Brad Nielsen will comment on the Plan from the technical stand point. The Council was asked to review and comment on the Plan as well as approval if they see fit. AGENDA ITEM 9 - Susan Scribner from the Riley-Purgatory Bluff Creek Watershed District, has contacted the City regarding potential of levying money for specific stream maintenance activities. The whole issue should be referred to staff for analysis and comment. AGENDA ITEM 10 - At this point the City has received nothing from the developer of Gideon's Cove in relation to dock rights and use of the peninsula. If anything comes in the Council can receive it, refer to staff and place it on the next Council meeting agenda. . . EXECUTIVE SUMMARY - OCTOBER 14, 1991 PAGE THREE AGENDA ITEM 13 A - We received a letter from Sgt. Bryan Li tsey regarding a proposed ordinance on the consumption of alcohol under the age 21. I have referred the proposal to Attorney D. Sellergren for his review and comment. D-1 - Nick Reuhl of EOS Architect has been invited to the Council meeting to make a report on progress and design on the Public Works facili ty . The discussions will include an update on the budget for the project. D-3- Please review the letter from Mr. William F. Kelly regarding his objections to paying for the copying of agendas and minutes. It is my intention to request Attorney Dave Sellergren to communicate with Mr. Kelly on this matter. D-4 - Because of public notice requirements and scheduling concerns the public hearing for the watermain and street project on pine Bend and Howards Point Road will need to be rescheduled for 6:30 pm, Monday, November 4th, at city Hall. Immediately following that hearing at 7:30 pm the Council has a public information meeting on the municipal water system at the Minnewashta Elementary School. This resolution resets the date of the public hearing. AGENDA ITEM 14A - The background investigation of the Prosecuting Attorney Selection Committees recommendation, Kenneth Potts has been completed. The Committee's recommendation stands. His resume is enclosed for your information. A motion directing the Administrator to negotiate an agreement with Mr. Potts in coordination with the other municipalities would be in order. 10/10/91 JCH.al !- CITY OF SHOREWOOD ~ REGULAR CITY COUNCIL MEETING MONDAY. City Engineer Dresel informed the Council that not all the residents of Church Road have granted easements for the construction project. He said the bid was awarded to Widmer construction during the summer and there is not enough time left to start the project before winter. 2 REGULAR CITY COUNCIL LES SEPTEMBER 23, 1991 - PAGE 3 . Gagne asked how many residents want the project. Dresel said he has held meetings with the neighbors and there are eleven who want the project and one that does not. Daugherty asked if the time has expired on the bid from Widmer. Dresel said the bid has already expired. He said the project can be bid again in the winter. Dresel told the Council they may have to condemn the land for the easements. Councilmember Stover asked how long the condemnation process takes and how much will it cost. Dresel said the process takes 90 days and the costs are negotiated with the resident. Stover said this additional cost will be added to the cost of the project. Gagne said, because of the delay, the street will flood again in the spring. ORDINANCE NO. 244 4. ORDINANCE ESTABLISHING A SENIOR HOUSING COMMITTEE Brancel read the purpose of the Senior Housing Task Force. Administrator Hurm added minor changes to the Ordinance. A. Subd. 2 Meetings: The Task Force shall meet monthly or at the call of the chair, and all meetings shall be open to the public. B. Gagne said the positions should be open to everyone in Shorewood who qualifies. The Council agreed. 5. REVIEW LANDSCAPE PLANS - EXCELSIOR COVENANT CHURCH Applicant: Jack Streed Location: 19955 Excelsior Blvd. - ..::. REGULAR CITY COUNCIL ~ES SEPTEMBER 23. 1991 - PAGE 4 . Planner Nielsen explained that the Excelsior Covenant Church was granted a C.U.P. to build an addition to the Church. However, the C.U.P. was contingent upon their submitting a landscape plan for approval by the City Council. Nielsen said his staff report recommended landscaping on the north and west sides of the site. He said he talked with Jim Vol ling, Chairman of the Excelsior Covenant Church Building Committee and they propose to transplant arborvitae from the front of the church to the north and west sides. Nielsen said this would be consistent with the landscape plan. Jim Vol ling - addressed the Council and told them he disagrees with Nielsen's report. He said the west side of the church is adjacent to a heavily wooded lot and this screens the west side. Nielsen said the lot has deciduous trees and there will be no cover in the winter. Brancel said she thought someone had tried to develop the lot next to the church. Nielsen said yes, there was a proposal to develop the lot at one time and it is zoned two family, residential. He said there is a gap between the woods and the church and tranplanting arborvitae will fill the gap and not as many will be needed. Daugherty said he drove by the church and thought the northwest side of the church needed more screening than the west side. Councilmember Lewis asked Nielsen if he had come to an agreement with Volling. Nielsen said Vol ling will transplant the trees to the west side if he has to. Lewis asked how many trees will be needed for the buffer. Nielsen suggested six. Brancel said the Council cannot make decisions based on financial hardship. Lewis said it should be possible to satisfy the C.U.P. with existing material and not have to have an added expense. He suggested planting half the existing trees to the west and half to the north of the church. . Lewis moved. Daugherty seconded to approve the landscape plan of Excelsior Covenant Church and transplant 4 existing trees from the front of the church to the west side and 4 existing trees to the northwest side. . Motion carried - 3/2 (Gagne. Brancel) 6. COMMISSION REPORTS: A. Planning Commission Stover said there was no Planning Commission meeting. 4 REGULAR CITY COUNCIL4ItNUTES SEPTEMBER 23. 1991 - PAGE 5 . B. Park Commission Steve Dzurak reported to the Council from the Park Commission. 1. He said the Snowmobile Ordinance was not discussed at the last Park Commission meeting. The Commission is awaiting language from Police Chief Young to incorporate into the Ordinance. They expect to finalize the Ordinance by the Oct. 8 meeting. Dzurak said enforcement of an Ordinance is important and the Commission would like to see a volunteer patrol established under the administration of the Chief of Police and City Administrator. 2. The fee schedule for the use of Park facilities will be finalized at the Oct. 8th meeting. 3. The Park Commission will hold a meeting with area businesses to discuss volunteer opportunities in the Shorewood Park System. 7. MATTERS FROM THE FLOOR. CHARLES THOMPSON - 5260 ST. ALBANS BAY RD. asked the Council for a 30 day extension of time to file the final plat of his subdivision. He said the signing of some paperwork is being delayed. City Attorney Sellergren said the Council can grant a 30 day extension. Gagne moved. Stover seconded to grant a 30 day extension for the filing of a final plat to Charles Thompson. Motion carried - 5/0 LEROY KRAMER - asked about his 30 day extension. Brancel said it was granted. Kramer asked if he could get a 60 day extension to remove an old car. Brancel said they usually grant only 30 days for an extension. 8. STAFF REPORTS: A. ATTORNEY'S REPORT He had no report. B. ENGINEER'S REPORT He had no report. C. Hurm said the Excelsior Fire Department is gathering information about the formula used to determine cost basis for each City and will make a presentation to the Council. 2. Resident Letter Requesting Signage in the Covington/Vine Ridge Area. Hurm said "Slow - Children at Play" signs were requested in Shorewood Oaks and have been requested by the Covington/Vine Ridge Homeowners Association. He said Mn/Dot does not approve of these signs because they give a false sense of security and are ineffective. Hurm suggested the Council request more Police patrol in these two areas. He said a sign has been placed at Covington Road directing traffic away from Covington Court. 3. Update on Speed Study - Shorewood Oaks Drive/Oak Leaf Trail. Hurm said Mn/Dot has completed it's speed study of Shorewood Oaks Drive and does not recommend lowering the speed limit. However. they recommend the installation of two "turn ahead" arrow signs. He said speed limit signs have been installed as directed by the Counci 1 . He said the residents of Shorewood Oaks want to talk to the Council at the next meeting. Gagne said there are a lot of children in the Shorewood Oaks neighborhood. Daugherty said additional patrol in the Covington and Shorewood Oaks neighborhoods should be added. Steve Dzurak said he lives on Vine Ridge and that most of the speeding problems are from non-residents. He said more police patrol would help the problem. Stover moved. Gagne seconded to request increased Police patrol in the Shorewood Oaks and Covington/Vine Ridge and send a report to the City Counci 1 . Motion carried 5/0 4. Policy on Cost Reimbursement for Citizen Request for Minutes. Agendas and Documents. Hurm said a lot of time and money is spent copying and mailing agendas and minutes of City Council meetings. 6 REGULAR CITY COUNCIL ~ES SEPTEMBER 23, 1991 - PAGE 7 . He suggested the following policy regarding distribution of agendas and minutes. 1. Agendas: $35.00 per year or 25 cents per page. 2. Finance Director Rolek informed the Council that he asked Springsted, Inc. if the bond issue should be lowered because the Church Road project is delayed. Springsted advised against this. They said the cost of issuing a separate bond for the Church Road project will be higher. In addition, the interest rates are currently at a low point. Gagne asked what will happen if the Church Road project is not done. Hurm and Rolek said the money could be used for other projects. Sellergren said the City may not be able to use the money, it depends on how the bond is structured. COUNCIL REPORTS. A. MAYOR BRANCEL 1. Report on Prosecuting Attorney Selection Committee. Brancel said the Committee will interview the following attorneys on October 2, 1991: A. Kenneth Potts B. William Henney C. Greg Keller D. George Hoff Stover asked if a decision will be made on Oct. 2. Daugherty asked Hurm how much money the City will save on prosecutions. Hurm said the City may pay under $20,000 per year. The formula will be divided among the four cities, similar to the Police Department formula. Shorewood will pay a lump sum only for it's own prosecutions. 7 REGULAR CITY COUNCIL4ItNUTES SEPTEMBER 23, 1991 - PAGE 8 . 2. Request for City Flag Brancel said the North American Vexillological Association is holding a convention in Minneapolis Oct. 11.12.13 and Mayor Don Fraser has asked for Shorewood's flag. Gagne moved, Lewis seconded to send the City flag to the Vexillological Society convention in Minneapolis. Motion carried - 4/1 (Stover) 3. Parade of Homes Resident Sign Request - Christmas Lake Road. Brancel presented pictures of the parking along Christmas Lake Road during the Parade of Homes. She said there have been numerous complaints. She said the Council should consider the parking problem for next year's Parade of Homes and restrict the parking on substandard streets. Brancel and Hurm said the motion to allow parking for the Parade of Homes did not specify parking on only one side of the street. They sent a clarifying letter to the developer. B. COUNCI LMEMBER GAGNE He had no report. C . COUNC I LMEMBER STOVER Stover asked Hurm if the staff routinely sends follow up letters to individuals who have applied for positions within the City. Hurm said yes. She also asked if the Finance Board had received letters. Hurm said yes. Stover also asked if meetings can be held on Nov. 5, Election Day. PUBLIC HEARING - GIDEON'S COVE P.U.D. - DISCUSSION OF DOCK RIGHTS MAYOR BRANCEL OPENED THE PUBLIC HEARING AT 7:05 P.M. Planner Nielsen explained that the Gideon's Cove P.U.D. concept plan was approved at the Sept. 9. 1991 City Council Meeting. However. the issue of dock rights on the peninsula was not approved and that is what will be discussed tonight. Councilmember Gagne asked Nielsen to describe the history of this issue. LB 1 . CITY COUNCIL MINUTES I SEPTEMBER 30. 1991 - GE 2 . Nielsen stated that the City allows dockage on Lake Minnetonka where the principal dwelling is located. There are exceptions to this rule that have been grandfathered. One exception is Boulder Bridge which has 40 docks for 46 lots and was approved in the late 1970's. He said most other requests for docks on noncontiguous property are not granted. Nielsen said the LMCD allows multiple dockage on the Lake but the City can be more restrictive. Nielsen said the peninsula in Gideon's Cove is currently deeded to the first two lots in the development. Gagne asked what dockage is grandfathered. Nielsen said two docks are grandfathered. Gagne asked how many boats can be moored at each dock. Nielsen said the LMCD specifies 3 boats per dock. if they are owned by the resident. This requirement pertains to watercraft over 16 ft. and motors over 10 horsepower. Nielsen said the Boyer's plan to distribute the six boat slips among 6 residents of the development on a first come first served basis. Bob'Boyer and John Boyer agreed with Nielsen's explanation of their plan. BRANCEL OPENED THE PUBLIC PORTION OF THE HEARING AT 7:18 P.M.' JIM SCHULTZ - 5465 TIMBER LANE Schultz stated that this discussion should be presented to the Planning Commission. He said there are errors in the drawings of the peninsula. He said there is only one dock at the present time. One previous dock has not been maintained for quite some time. Schultz said the area has considerable boat traffic from Minnetonka Dredging. Shorewood Marina and "Sullivan's Marina" which has seven boats moored at different times. He said Sullivan's is noncontiguous dockage which has not been enforced. He said if the City allows more noncontiguous dockage at Gideon's Cove. they will set a precedent and open the door to more requests. . He said 6 boats owned by 6 individuals will generate more boat traffic than two docks owned by two individuals. Schultz also said the City should consider the impact of shore storage facilities and the use of canoes and other small watercraft. He said the City will have to be involved in controlling this. Schultz said he strongly opposes the distribution of the dockage as proposed by Boyer. BOB BOYER said the peninsula is currently deeded to the first two lots in the development and in this sense it is contiguous property. He said they plan to have an as~ociation monitor the usage of the peninsula. JOHN BOYER also indicated that the Planning Commission had approved this concept plan. 2 . CITY COUNCIL MINUTES . SEPTEMBER 30, 1991 - E 3 . Councilmember Stover said two members of the Planning Commission suggested the Council have this meeting to discuss the docks. They said that six different owners has a different impact on the development. PETE EOYER - 19865 EXCELSIOR ELVD. said other residents of the area have kept boats on the peninsula. He said Boyer Construction has the right to develop the peninsula. He said some lots in Boulder Bridge are separated by a road and are not considered noncontiguous. Stover said the Boulder Bridge P.U.D was one parcel when it was approved. MARY EAGDINS - 5585 TIMBER LANE asked what use will be made of the peninsula. Will other watercraft be stored on the shoreline. Nielsen said the City can control the use of the peninsula in any way they want through the P.U.D. Gagne asked Boyer how the peninsula will be used. Bob Boyer said they plan to leave the peninsula as is so all the residents of the development can use it. The association will control the use. Gagne said he would like to see this use of the peninsula written into the P.U.D. agreement. JOHN EOYER asked what rights Boyer has currently. Gagne said the Council approved the use of the peninsula but no dockage. The LMCD will allow small watercraft to be pulled UP onto the peninsula. Brancel said the City can restrict this. JIM SCHULTZ said "Sullivan's Marina" has barbecue grills, showers, benches and electricity and the City has done nothing to control this. He said if twelve houses have access to the peninsula how will this same type of usage be controlled. Nielsen said the "Sullivan Marina" has three grandfathered docks which were owned. at one time. by noncontiguous properties in the area. However, these properties may have changed hands. Brancel directed Nielsen to look into the ownership of these docks. PAUL EOYER said the Sullivan property is being used to the maximum. He said Boyer does not plan to do this. They are only asking for the right to use the property. THE PUELIC HEARING WAS CLOSED AT 7:50 P.M. Stover asked Boyer where the residents of Gideon's Cove will park when using the peninsula. She said Timber Lane is a substandard road. - .;;. CITY COUNCIL MINUTES. SEPTEMBER 3D, 1991 - GE 4 . Boyer said there should be no need for parking, it is a short walk from the development. Stover then asked where residents will store boating equipment. Boyer said there are currently sheds on the site and these can be used. TIM KANE - ATTORNEY said the Boyer's are entitled to two docks tied to the first two lots in the development. He said an amendment to this designation is within the discretion of the Council, with a 4/5 vote. Stover said she is concerned about supplemental needs, such as dock lights and water. She said all twelve units could have some kind of craft on the peninsula. JOHN BOYER said they will do what the residents of the development want. He said Boyer will establish an association to control the uses of the peninsula, therefore the City will have to exert less contro I . Gagne said the main point of discussion is whether the City will allow two docks with two units or two docks for six units. Councilmember Daugherty said the City should impose restrictions on the use of the peninsula whether it approves 6 boat slips or two. Councilmember Lewis said the amount of watercraft in the area is a legitimate concern. He said the City already has a difficult time controlling the use of shoreline property. Stover said there will be additional use of a very crowded area. Gagne asked Bob Boyer what kind of facilities will be provided to all the residents. Boyer said they will have access to the peninsula and the six residents with boat slips will pay extra for the slips. Nielsen explained that only a concept stage plan has been approved and a development stage plan will provide more details for the Council. Daugherty asked Nielsen if the other residents of Gideon's Cove could have small craft. Nielsen said they could at this time, however, the Council can restrict this within the P.U.D. agreement. Stover asked the Attorney's opinion whether certain parcels of land are retained for common use. Kane read the P.U.D. concept stage plan that the Council approved and said the Council approved the density of the development and reserved the right to dis~uss Outlots A, Band C. 4 . CITY COUNCIL MINUTES I SEPTEMBER 30. 1991 - GE 5 . Gagne moved. Daugherty seconded to approve six boat slips divided among six living units and registered to these units. subject to the approval of the development stage plan. Motion failed - 3/2 (Stover nay. Lewis abstained) Lewis said the Council is allowing an increase in boat density from one boat per dock to three per dock. Stover said two dock owners may not each have three boats. Gagne said the Gideon's Cove association will control the use of the peninsula and this change allows more access to the Lake. - Daugherty said there are many issues to clarify such as. the funding of the association and how to restrict boat use of the peninsula. He favors increased boat slips but with restrictions. Brancel asked Nielsen about the sheds currently on the peninsula and if they will be used to store boats. Nielsen said the Boyer's should address the common use of the sheds. Lewis moved. Stover seconded to table the discussion of dock rights on the peninsula at Gideon's Cove. Daugherty seconded to approve six boat slips divided among six living units and registered to these units. subject to the approval of the development stage plan. Motion failed - 3/2 (Lewis and Stover. nay). Daugherty asked Lewis and Stover if they want an amendment stating there will be no more than six boat slips. Stover and Lewis said they do not want to guarantee SlX slips. They felt this was a change in the grandfathering. Nielsen said Boyer has six months to submit a development stage plan to the Planning Commission. Daugherty said Boyer should return to the City and address the issues discussed tonight. BOB BOYER said they are proposing the most restrictive use of the shoreline as stated in the LMCD Shoreline Management Plan. They propose 50 ft. of shoreline for each boat. Gagne asked Kane if the parcel will be all one piece when the P.U.D. is completed. Kane said yes, it would. Daugherty said more neighbors should have been present if they are concerned about the issue. 5 CITY COUNCIL MINUTES. SEPTEMBER 30, 1991 - PAGE 6 . SHOREWOOD, MINNESOTA 55331 -(612) 474-3236 MEMORANDUM TO: Planning Commission, Mayor and City Council FROM: Brad Nielsen DATE: 30 September 1991 RE: Baker, Richard - C.U.P. for Accessory Space in Excess of 1200 Sq. Ft. FILE NO.: 405 (91.17) BACKGROUND Mr. Richard Baker proposes to build an attached garage onto his existing home, located at 5235 Howard's Point Road (see Site Location map - Exhibit A, attached). The area of the new garage, when combined with an existing detached garage on the property exceeds 1200 square feet. Consequently, Mr. Baker has applied for a conditional use permit, pursuant to Section 1201.03 Subd. 2.d.(4) of the City Code. The property in question is zoned R-1A, Single-Family Residential. The existing garage on the property (see Exhibit B) measures 30' x 36' and contains 1080 square feet of area. The proposed garage contains approximately 1013 square feet of area. The house contains 3080 square feet on the main level with almost the same area on the lower walkout level. Exhibit C illustrates how the proposed garage relates to the existing home. ANALYSIS/RECOMMENDATION The Zoning Code contains four specific criteria for allowing accessory space in excess of 1200 square feet. Following is how Mr. Baker's request complies: a. The total area of accessory space (2093 square feet) does not exceed the total area of stories above grade (the main level alone is 3080 square feet). A Residential Community on Lake Minnetonka's South Shore JA . . Re: Baker, Richard C.U.P. for Accessory Space 30 September 1991 b. The total area of accessory space does not exceed 10 percent of the minimum lot size for the zoning district in which the property is located (.10 x 40,000 - 4000 square feet). c. The addition exceeds the minimum setback requirements for the R-1A district (also shoreland requirements). d. The proposed addition is being built as an integral part of the existing dwelling. It is worth noting that in order to expedite construction the applicant has submitted plans for a family room addition where the proposed garage will be built. Upon approval of a c.u.p. he will convert the addition to the proposed garage space. Based upon the preceding, it is recommended that the c.u.p. be granted as proposed. (612) 474-3236 MEMORANDUM TO: Planning Commission, Mayor and City Council FROM: Brad Nielsen DATE: 26 September 1991 RE: Bardine, Paul - C.U.P. for Accessory Space in Excess of 1200 Square Feet FILE NO.: 405 (91.06) BACKGROUND In 1989, Mr. Paul Bardine received a conditional use permit to build accessory space in excess of 1000 square feet on his property located at 6085 Riviera Lane. He now proposes to add a utility shed in his rear yard which puts his total accessory space over 1200 square feet in area. He has requested approval to modify his C.U.P. to allow the additional space. Background for his request is contained in the staff report for his previous request (see Attachment 1 - Planner's Memorandum, dated 15 March 1989, copied in yellow). The new building is 12' x 14' and contains 168 square feet of area. Mr. Bardine proposes to use the same siding and shingles as the existing house. Also, the utility shed will have a hip roof, similar to the house. ANALYSIS/RECOMMENDATION Shorewood's Zoning Ordinance has changed since Mr. Bardine's original C.U.P. was approved. The City now allows up to 1200 square feet of area before a C.U.P. is required. It also allows all stories above grade to be counted in the formula for determining how much accessory space may be allowed. Previously only the "footprint" area of the dwelling was counted. The proposed building brings the total accessory space to 1548 square feet. Following is how the applicant's request complies with Section 1201.03 Subd. 2.d.(4) of the Code: A Residential Community on Lake Minnetonka's South Shore 313 . . Re: Bardine, Paul C.D.P. for Accessory Space 26 September 1991 a. The total area of accessory space (1548 square feet) does not exceed the floor area above grade of the house (1556 square feet). b. FOR ACCESSORY SPACE IN EXCESS OF 1000 SQUARE FEET FILE NO.: 405 (89.06) BACKGROUND Mr. Paul Bardine has requested a conditional use permit. pursuant to Section 1201.03 Subd. 2d. (4) of the City Code. to construct accessory space in excess of 1000 square feet on his property at 6085 Riviera Lane (see Site Location map - Exhibit A. attached). The house. currently under construction. contains a triple garage facing Riviera Lane (see Building Elevations - Exhibits B and C). An additional tuck-under garage will be located beneath the main garage. Access to the lower level will be from the south (see Property Survey - Exhibit D). The property is located in the R-1A. Single-Family Residential District. The proposed house contains 1556 square feet of area on the main level and 1451 square feet on the lower level. The upper level garage will contain 660 square feet and the lower level garage will contain 720 square feet. ANALYSIS/RECOMMENDATION Following is how the applicant's request complies with Section 1201.03 Subd. 2d. (4) of the City Code: a. The total area of accessory space (1380 square feet) does not exceed the "footprint" of the principal structure (1556 square feet). b. The additional garage space is designed as an integral part of the house. If not for the 8' x 7' overhead door it would be considered to be part of the basement. As part of new construction, overall site grading and drainage have been designed to fit the lot. d. As mentioned above the only thing which differentiates between the proposed lower level garage and a basement is the small overhead door on the south side of the house. It is worth noting that by facing the garages in different directions, the overhead doors can not be seen from anyone direction. This agreement will have to be executed by the City prior to MnDOT releasing any funds for the signal work currently being performed. Based on our discussions with MnDOT and our understanding of the agreement, the State is paying 2/3 of the cost of the signal with the City picking up 1/3. As is typically the case, the City will be responsible for the operational costs of the light. As this amounts to a $56,536 participation by the State, we recommend approval of this resolution and contract. Sincerely, ORR-SCHELEN-MAYERON & ASSOCIATES, INC. ~ Joel A. Dresel, P.E., L.S. Council of the City of Shorewood 5755 Country Club Road Shorewood 1 MN 55331 Ladies and Gentlemen 1 Re : Assesment district for water treatment plant improvement. During the hearings about the desirabllity of this water treatment plant improvement it was stated by the city engineer 1 that one of the reasons for the yellow/brown water, that we are being served regularly 1 is the fact that the present system is too big for the number of customers served. As a result the water is being stored relatively long in the water tower and the iron particles are given ample opportunity to turn into rust particles 1 with the well known results. Under these circumstances it does not seem to make sense to me to include in the assesment district only the properties presently being served by this water treatment plant. May I suggest that 1 apart from these properties, also all properties that are slated to be served by the plant in the future are included in the district. I understand that it has always been the intention to hook the Shady Hi lls area up to the present water system as soon as the main came close, which would happen when Waterford III would be bui lt . That event is imminent, I understand. Therefore it seems reasonable to hook Shady Hills up and include it in the assesment district. Furthermore 1 I understand that you are on the verge of taking the decision to install City Water throughout Shorewood . Such a decision would no doubt lead to an even more expanded customer base for the present water system and proposed treatment plant. In summary 1 I agree that it has to be done but let's have everybody who benefits 1 now or in the near future 1 contribute equally to the cost. Hurm, City Administrator City of Shorewood - 5755 Country Dub Road Shorewood, MN 55331 Re: Speed Zoning - City of Shorewood Shorewood Oaks Drive/Oak Leaf Trail Dear Mr. Hurm: A speed zoning study has been completed for Shorewood Oaks Drive and Oak Leaf Trail as requested by the Shorewood City Council in Resolution 63-91. Based on the study results and as discussed with you previously, we recommend continued reliance on Minnesota's statutory 30 mph urban district speed limit. (This limit may be posted or not posted at the city's discretion.) Our recommendation has been forwarded to Mn/DOTs traffic engineering office in St. Paul for their review. Assuming they concur, no speed limit authorization will be issued. You will be notified of their action. Also, as discussed with you, there is one curve on each road where 30 mph speed cannot be safely maintained. We suggest installation of turn signs with appropriate advisory speed plates for these curves, especially since the speed limit is posted. During discussion of our recommendation, you expressed interest in general comments concerning speed limits and SLOW CHILDREN signs. You might therefore find the attached letter and the. following general comments of interest. While many people believe that posted speed limit determines the speed of traffic, studies in Minnesota and elsewhere have demonstrated that speed patterns are actually determined by driver reaction to the road environment and by driver attitude (purpose of trip, etc.). Very little change in speed patterns can be expected with a change in the posted speed limit. Why then do we bother to post a speed limit? A speed limit can perform the following functions: ~~ MINNESOTA 1990 An Equal Opportunity Employer . . James C. Hurm August 22, 1991 Page Two - Inform those not familiar with a road, what speed is considered to be reasonable and safe under ideal conditions. - Inform those living along the road of the prevailing speed of traffic. - Serve as a basis of enforcement against those who drive at unreasonable or unsafe speed. - Contribute to smooth traffic flow on roads with high traffic volume. To fulfill these functions, however, the numerical value of the speed limit must be consistent with prevailing operating speeds. Also, considering the functions of a speed limit, it is apparent that a posted speed limit will be of the greatest value on arterial or collector streets where non-local traffic can be expected and where enforcement activity is likely. Most municipalities elect to rely on unposted statutory speed limits for strictly residential streets for three reasons: 1) Speed limits have little value on streets where almost all traffic consists of local residents who drive the road daily and where enforcement activity is unlikely. 2) Few cities can afford speed limit signs for all of their streets. 3) If each street were to be speed zoned on its own merit, the resulting array of speed limits would be confusing and difficult to enforce. Alternative signs of the correct diamond shape do exist in the Minne- sota Manual. (Two examples are: sign Wll-X5 "WATCH FOR CHILDREN" and sign Wll-X6 "WATCH FOR PEDS"). To remain effective, however, these signs must only be used in unusual situations. One example might be an area of restricted sight distance where the presence of children is probable and drivers are likely to be unaware of this fact. We do not recommend use of the signs where sight distance is good or in residential areas where drivers should be expecting the presence of children merely because of the type of adjacent development. While we do not presume to suggest that Mn/DOT has any jurisdiction in this matter, we do feel it is appropriate to inform you of the non-conforming use. We have observed a great number of these instal- lations throughout our district. Please call me or Larry McKenzie at this office if you have questions. Sinz:' ~. Kat P.E. Michael .ramer 5425 Timber Lane Shorewood, MN 55331 OCT I 4 1991 Dear Barb: It has come to my attention that the developer of the Lawtonka properties has formed an association and wishes to enhance the salability of his property by requesting the Shorewood City COlJ1CiI to allow a large nunber of boats to be docked at the peninsula on Timber Lane. As an eleven year resident of Timber Lane, and a 36 year resident of Shorewood, I see his plans to be inappropriate for the neighborhood and inconsistent with city plans, long range Lake Minnetonkawater surface plans, and general citizen wishes to keep Shorewood an open, semi-rural area. His plans, if implemented, will contribute significantly to boat traffic congestion on a bay that has 1) some of the least navigable waters per open water area ( i. e. too shallow in most years: approximately 1/3 of the bay is less than 2 feet deep) , 2) the most boats per shoreline foot of any enclosed bay in Lower Lake Minnetonka, 3) a major sailboat marina with almost yearly requests for expansion, and 4) already five high-density/multiple boat marinas in opera- tion.(Shorewood Yacht Club, Arvidson property, Manitou Junction Cove, Tonka Bay Municipal Marina, and the "Gideon Pointe" (the old Round Point or Winston Estate) development. I wish to remind you that there has been at least a ten year unsuccessful effort to bring a marina of questionable legality and questionable owner- ship (the Arvidson property, immediately to the east of the proposed association marina) into compliance with Shorewood and LMCD rules. (0 --.'-~"".~.~'''''''--'-'~-1'''~~---~'''''~ " . . Several years ago; the owner of the LaW'tonka property individually as- sured all of the Timber Lane residents that he planned to construct only six single fami Iy homes on the property at the time he was requesting the Shorewood cOll1CiI for the slbdivision. I attended at least one COlJ'lCiI meeting where the question of multiple property use of the peninsula \Vas addressed. The cOll1CiI was firm in stating the rules that were "one property, one owner, one dock., An exception to the Shorewood shoreline footage restrictions was allowed in the case of the two pieces of property that comprised the peninsula}' since remnants of a dock on each were discovered. The owner of the LaW'tonka property was warned... however that if he chose to combine the two pieces of property, he would be allowed only one dock, not two, as in that case the grandfathering provisions would no longer apply, and the present shoreline footage restrictions would only allow one. He was told by the counci I that whether he wished to form an association or not, he could attach the peninsula properties to only one parcel each of the six properties he wished to develop. I wish to note that some of the provisions of the long range plans for the water surface use of Lake Minnetonka specifically discQl!rage and will if approved, outlaw the use of associations to increase boat density per shore I ine foot in the manner the developer of the property intends. If his wishes are on the other hand, marginally altruistic, that is to allow greater access to Lake Mimetonka}' I wish to point out to him several articles in the Minneapol is newspaper noting the laments of marif:la owners on Lake Minnetonka as to all the empty Slips this year. It appears that the developer took the chance in purchasing the property in question with the intention of continuing to presSlJ"e the Shorewood Counci I in the hopes that he could attach a boat sl ip to each piece of property. I lI1derstand that he now wishes to construct, instead of the six single family homes; six "upper bracket double condominilBTlS". I wish to note; that he did not come around to each Timber Lane resident to announce his change in plans, ~ About twenty five yeaego a representative of a comp. With the same name purchased a large tract of land including a beautiful English COlB1try house on southeast Lake Mimewashta, from the estate of the Boutell family. A representative of this company assured my parents, who were living nearby, that the land would be kept as is and never split up for development. In this case, UneverU was about two years. If six upper bracket doubles are built and occupied (presumably each half owned by single families) , I estimate that dLring the winter, this will add approximately 30 % to traffic on Timber lane, and of ccxrse, inter- section traffic an an already tricky inters~ion at County 19. If the marina association is allowed" this will, in my estimation, add 60 % to summertime weekend traffic. In what I will call a worst case scenario, if lower bracket doubles are built... similar those dotting the landscape in Shorewood (Wood Duck Lane, Timber Lane north... and behind Carmichael's) or T onka Bay (between the city hall and T onka Bay Road), the following potential exists. The lower bracket doubles wi II be very I ikely be rented rather than owned, and many of them wi II probably be occupied by single people sharing fa- cilities. The occupants will probably have one automobile each. This could be as much as four automobiles per half of a double, or adding a total of 48 automobiles or 63 % to the Timber Lane traffic load. This could be the scenario during the winter only. On Sl.DTIT1er weekends, I think one can imagine Timber Lane and Gideon Bay looking like Excelsior dLring the Fouih of July fireworks. Thank you very much for your time and attention. I realize that members of the counci I often hear from members of the community only when un- popular things are being considered, and I want you to know that I appreCiate your stewardship of the city also during less controversial times. This proposal was drafted at my request by Attorney Paul Ahern and received judicial approval from Judge Gary Larson. The proposed ordinance would help strengthen our efforts in combatting illegal alcohol/drug use in the South Lake area. First, it would eliminate the concern over venue in cases where underage drinkers have been consuming elsewhere but are detected in the South Lake area. Second, it would hold the party host accountable for allowing illegal alcohol/drug use on their premise. I would ask that you present this proposed ordinance to the Shorewood City Council for their review. We would charge this copying fee to anyone who stopped at City Hall to have them copied to take with them. Further, I explained that this is the general interpretation of the law throughout local government. al A Residential Community on Lake Minnetonka's South Shore !~D-5 ,-"'-"'-' -.,-'-, .~..- -' -.., '--'._-.. ,-.' Hurm City Administrator City of Shorewood 5755 Country Club Road Shorewood, Minnesota 55331 Dear Mr. Hurm: I have your letter of September 25, 1991, informing me, as a resident of the City of Shorewood, that if I was to continue to receive by mail, the council minutes of the City of Shorewood, I must pay $75.00. I have never requested that agendas be mailed. You indicated that all minutes are maintained in a minute book which is available for reading during office hours. Minnesota Statute (M.S. 5412.191, subd 3) requires that official council meeting minutes be published at least in a condensed version. In the alternative to publication, the city "may mail at city expense a copy of the proceedings to any resident upon request". I reside at 25000 Yellowstone Trail, Shorewood, Minnesota 55330. I do request the mailing to me "at city expense" a copy of the official version of the council minutes as required by M.S. 5412.191, Subd 3.1 am enclosing a copy of the statute making such mailing at city expense mandatory in view of the non publication of the council proceedings. I shall expect to continue to receive such minutes without the necessity of paying $75.00 for the privilege of knowing what is occurring in my city. WFK/dh Enclosure . SNOWMOBILE ORDINANCE The following motions were made without further discussion. SNOW PATROL ;:::::;:::;:::::::::::: .. .. SHOREWOOD PARK COMMISSION MINUTES TUESDAY, OCTOBER 8, 1991 - paqe two 19IiiJgli!i:i!5~.jBi::!~::l\R.j.HI.~!~1ii!m~~i!:ffii!~i!illx!iiil PUBLIC INFORMATION COMMITTEE FOR PARK IMPROVEMENTS This item is postponed until Administrator Hurm has the opportunity to talk to Jennifer McCarty to see if she is interested in heading a committee. USER/RESERVATION FEES The Commission discussed tennis courts. Lindstrom and Wilson, who were at a meeting with Jim Jones, Mark Koegler, and Jim Hurm, said tennis courts were discussed. Jones mentioned that if they were allowed to be reserved, tennis pros could tie them up all the time to give lessons, thats why a first come-first served basis was decided upon. Jones said that, in order to enforce reservations, someone (similar to a rink attendant) would have to be there all the time, and the income generated would not cover the wages of the attendant. . The Commission decided that if someone wanted it on a one-time basis for a family party, or other similar reason, they could come before the Park Commission or the Council and make a one-time request. The Commission discussed putting a sign on the courts stating that the courts cannot be reserved, but are on a "first come - first served" basis. ; SHOREWOOD PARK COMMISSION MINUTES TUESDAY, OCTOBER 8, 1991 - Page three HATTERS FROM THE FLOOR Badaer Park GoalDosts Christensen said he contacted Dennis Tone of the Minnetonka Youth Football Association today but he was not available. They said they could use more lighting in the end zones, and there were some bad spots on the field. Hurro said Public Works Director Zdrazil said the field was torn up in some places because they had played in the rain. The Commission discussed this and decided some type of policy had to be set between Zdrazil and the Football Association. Zdrazil would be in control of stating when they could not play because of wet condi tions. The coaches could contact him. The City will set up a meeting between Zdrazil and the Football Association. "To Do List" Items Christensen asked if the items mentioned by him at a previous meeting couldould be put on the "to Do List".
