EXECUTIVE SUMMARY SHOREWOOD CITY COUNCIL AGENDA MONDAY, SEPTEMBER 23, 1991 AGENDA ITEM 3A - This requires a motion approving the Application of Waconia Sanitation for a Refuse Collector's License in Shorewood. AGENDA ITEM 3B - Al though LeRoy Kramer's request for a time extension to remove a non-licensed vehicle is until spring the recommendation and motion would be to give him a 30 day extension of time to remove the vehicle. AGENDA ITEM 3C - The recommendation and motion would be to reject the application of Scott Gysland, 4812 Ferncroft Drive, for additional time to license a blue Ford pick-up truck and to direct Public Works to cleanup the site at their earliest convenience. AGENDA ITEM 3D This resolution formally accepts from the developer, Fullerton Properties Inc., public improvements in the plat of Fox Run West. The start of the one year warranty period would begin at this time. AGENDA ITEM 3E - The motion would accept the audit proposal of Abdo, Abdo & Eick to do the 1991 City audit. The estimated cost is $7,995 and additional $1,500 would be necessary to assist with the forms and reports for the Government Finance Officers Association Certificate of Performance. AGENDA ITEM 3F - This resolution establishes a public hearing for 7:15 pm, October 28, 1991 for the pine Bend watermain and street construction project. AGENDA ITEM 3G - This resolution establishes a public hearing for 7:30 pm, October 28, 1991 for the Church Road improvements. AGENDA ITEM 3H - This resolution approves the final plat for the Neitge addition. Preliminary plat approval had been approved at the last City Council meeting.REMOVE FROM AGENDA AT MRS. NEITGE'S REQUEST AND RESCHEDULE FOR LATE OCTOBER MEETING. AGENDA ITEM 3I - This is a resolution that lays out the conditions of approval as set out in the Planning Staff Report dated June 27, 1991 for the Gideon's Cove P.U.D. Specifically the resolution states that the revised concept plan is not intended to approve use of the docks currently located on a pennisula. The public hearing on this issue is set for 7:00 pm on September 30, 1991. AGENDA ITEM 4 - The proposed ordinance establishes a Senior Housing and Services Task Force. Council should review the two page ordinance carefully. It outlines the specific duties of the Task Force and establishes a sunset clause. ,. . . . EXECUTIVE SUMMARY - SEPTEMBER 9, 1991 CITY COUNCIL AGENDA AGENDA ITEM 5 - A memorandum from the Planning Director explains that the landscaping plan submitted by the Excelsior Covenant Church is not consistent with what was discussed when the conditional use permit was approved for the Church in April, 1990. The recommendation is that the Certificate of Occupancy permit be withheld until the Church has submitted a plan which is consistent with what had been discussed at the time the C.U.P. was approved. AGENDA ITEM 8D-1- Members of the Council might want to talk to me indi vidually concerning the Deephaven Mayor' s letter concerning the Excelsior Fire Department funding formula. The Fire Department is currently undertaking a study of the various area Fire Department formulas and will be getting in touch with the South Lake Area communities to discuss the formula and contract in October. AGENDA ITEM 8D-2 - When considering the letter requesting signage in the Covington/Vine Ridge area, please refer to the Department of Transportation letter which has been referred to in discussing the Shorewood Oaks petition for signage. The State Traffic Safety Engineers strongly discourage the use of "Slow Children" playing signs. The SLMPSD should be requested to patrol this area more frequently on an intermittent basis. The new informational sign for Covington Court will be install immediately upon its arrival. It has not yet been delivered to the City. AGENDA ITEM 8D-4 As part of our review of revenues and expenditures during the budget process we are recommending that the Council review our policy on who should receive copies of agendas and minutes at no cost. Please review the memorandums from Finance Director Al Rolek and Deputy Clerk Anne Latter and consider a policy reducing the number of indi viduals to whom agendas and minutes are mailed to. For all others Council minutes and agendas will be sent or given out for the cost of copying (.25/per side). If they wish to be added to the regular mailing list an annual fee would be charged ($25.00/agendas and $75.00/approved minutes). 9/20/91 al . SEWER AND CLEAN-UP CHARGES AND WATER HOOK-UP FEES Brancel opened the Public Hearing at 7:30 P.M. and asked if the audience had any comments. There were no comments and the Public Hearing was closed at 7:31 P.M. Finance Director Rolek indicated that the clean-up charge is new . this year and the water hook-up charge is an assessment requested by a resident. Lewis moved. Daugherty seconded to adopt RESOLUTION NO. 95-91 itA Resolution Approving Special Assessments for Municipal Water Service Connection Charge. It Motion carried - 5/0 Gagne moved. GIDEON'S COVE P.U.D. - CONCEPT STAGE APPROVAL - DIRECT FINDINGS OF FACT Applicant: Location: Boyer Building Corp, Lawtonka Drive Nielsen informed the Council that Boyer Building had submitted their . concept plan to the Planning Commission three times. A Public Hearing was held in July and there was neighborhood objection. The Planning Commission denied the Boyer plan that included 14 units. '? ..:.. REGULAR CITY COUNCIL MINUTES SEPTEMBER 9. 1991 - PAGE 3 . Nielsen said Boyer has addressed a number of the concerns aired during the Public Hearing, including the density. Nielsen said he should mention that two members of the Planning Commission were concerned that sufficient notice was not sent to the neighbors. They felt the neighbors should have been notified of the change in the use of the peninsula. The two Commissioners tboughta special hearing should be held to inform the neighbors of the change. Gagne said there are two distinct discussions. One discussion involving the approval of the P.U.D. and another regarding the dockage. He said there has been a history of problems with the docks on this peninsula and he wants the issue discussed independently from the P.U.D. approval. Councilmember Stover said the two docks in question have been grandfathered and have room for three boats each. If the City approves the Boyer plan, six people will have use of these docks. She said, at the current time, the docks are legally tied to the first two lots in the Lawtonka Development. She thinks there will be a great deal more density if there is a change in this dockage. . Boyer said he would like to consider the dock issue at the same time as the P.U.D. Nielsen said the Council can table the issue if they want to hold a Public Hearing on the dock issue. Boyer asked why a public hearing is necessary. Gagne said people have been turned down for docks at this location because the docks were not located on contiguous property. He said it is a very volatile issue. Stover agreed with Gagne and said she would turn down the plan as presented. Nielsen said the Council can hold a public hearing on the dock issue, provided they give two weeks notice. This can be done at the Oct 1st Planning Commission meeting. He also advised the Council that they can approve the P.U.D. separately. Boyer asked the Council to approve the P.U.D. without the dock. The Council agreed to approve the P.U.D. separately and to hold the Public Hearing at a City Council meeting. Councilmember Lewis asked how many residents attended the Public Hearing at the Planning Commission meeting. Stover said there have been a number of meetings. At the last meeting the developer did not consult with the neighbors concerning the change in the plan for dockage on the peninsula. Lewis asked if the Planning Commission approved the dock plan as presented this evening. Stover said yes. . Boyer explained the concept stage process which Boyer Building presented to the Planning Commission. He said the original concept plan was denied because the density was too high at 3.8 units per acre, the driveways were too short 3 REGULAR CITY COUNCIL MINUTES SEPTEMBER 9. 1991 - PAGE 4 and there was concern about the use of the peninsula. He said traffic was a concern but it was thought that could be managed. . The second plan incorporated 3.3 units per acre and the driveways were lengthened. The area neighbors objected to this plan because of the visual impact and the traffic problem. At that time the plan called for the peninsula to be owned by two of the units. The current plan has 12 units and brings the density to 2.8 units per acre. The buildings are spread out with 30 ft. between _the homes. Boyer said this should decrease the traffic. The peninsula will be owned by an association and maintained by them. There will be room for 6 boats on the peninsula. This will not increase the current dockage. Boyer said the original plat was to have 6 single family homes. He said the sale of this type of home is very sluggish at this time. Boyer Building will build twinhomes or villa types homes to appeal to 55 and older buyer. He also informed the Council that the surrounding area is zoned R-2. Stover said the area was originally zoned R-1A and was then rezoned R-1C for the Boyers to build single family homes. She said the neighbors have slowly seen an increase in the density of the area. She said it should be noted in the plans that the walking path is really a Railroad . Right of Way owned by Hennepin County. Stover said the project has been marketed to the elderly, 55 or older. However, the builder has no control of the age of the purchaser. Boyer said they are not marketing this project as an elderly project even though 55 and older can be considered elderly. He said they cannot discriminate but their marketing approach will be toward the 55 and older market. He said covenants can be written so that the homes will not be attractive to young families. Stover said Boyer is making too many assumptions about the elderly, that they have no children, less traffic, etc. She also said the housing will not be affordable according to the Elderly Housing Task Force. Stover said if each house made eight trips a day and there are twelve houses, the traffic will increase greatly on Timber Lane which is a substandard road. Lewis asked if the density calculation included the R.O.W. Nielsen said the previous plan included outlot C which bordered Timber Lane. However, the current plan does not count R.O.W. area but does include the peninsula in the density calculation. Lewis asked if the plan fit in the Comprehensive Plan. Nielsen said it did. He asked if the setback from the road is adequate. Boyer said the. houses are 30 ft. Lewis asked about water hookup. Nielsen said City water is on the south side of HwY. 19. 4 REGULAR CITY COUNCIL MINUTES SEPTEMBER 9, 1991 - PAGE 5 4It Boyer said they will run water to the project. Gagne said he is liaison to the Senior Housing Task Force and this project is a type of housing they considered. He asked the price of these townhomes. Boyer said the mid $200,000 range, it could be higher. Stover said each townhome wi 11 have one bedroom and an unfin.ished lower level. If the lower level is finished, the homes will be higher priced. Lewis asked Boyer's plan for lot 6. Boyer said the lot is owned by Mr. Shafer. Mr. Shafer said he has no plans to sell the lot. Nielsen said the lot should be rezoned to R-2A, if Gideon's Cove is approved. Gagne moved, Lewis seconded to accept the Concept Stage Plan and approve the preparation of Findings of Fact, excluding the plan for the docks on the peninsula, subject to the recommendations of the Planner in his June 27, 1991 report. 4It Motion carried - 4/1 (Stover) DAN PUZAK - 23830 SMITHTOWN ROAD said the neighbors attended the first Public Hearing on this plan. They did not attend the last Planning Commission meeting because they thought all the problems had been discussed. He said they would have come if they had known there was a change in the usage of the peninsula docks. He said the neighbors have seen the lot size decrease from 40,000 sq. ft. to 20,000 sq. ft. He said the plan is unpopular and he would like the Council to deny the P.U.D. until all the issues are resolved. Brancel said the Council has approved a Concept Stage Plan, not a final plat and the dock issue will have a separate Public Hearing. Puzak said it will be difficult to change the density once it has been approved. He objects to the inclusion of the peninsula in the density calculation. STEVE HASKINS - 5455 TIMBER LANE said he represents five neighbors. He said they were at the Public Hearing and objected to the density of the project. He has no objection to single family housing. He said Timber Lane cannot handle the increased traffic with this project. JOHN BLUMENTRITT -BOYER BUILDING said he lives on Timber Lane and has not experienced a traffic problem and does not think that additional traffic from the Gideon's Cove project will create a traffic problem. He said Mr. Puzak does not want this project to proceed, however, this area is in District No.7 and is approved for multiple housing. 4It Stover said the peninsula should not be part of the square footage if no dockage is approved. r.:- .::J REGULAR CITY COUNCIL MINUTES SEPTEMBER 9. 1991 - PAGE 6 Blumentritt said the peninsula is legally tied to lots one and two of . the Gideon's Cove project. Brancel asked who will get the docks at the present time. Nielsen said the first two units will get the docks. City Attorney Sellergren said the City Code requires submittal of a preliminary plat and this should show who retains the docks. He said the docks can stay in the project and can be distributed any way the City chooses. Stover asked if the peninsula can be used in other ways. such as a park. Nielsen said the docks are grandfathered but the use of the peninsula would be limited by the P.U.D. approval. Brancel directed the staff to notify residents of a Public Hearing on the docks on the peninsula in the proposed Gideon's Cove development. The hearing will be held September 30. 1991 at 7:00 P.M. 6. RESOLUTION APPROVING PRELIMINARY PLAT RESOLUTION NO. 97-91 NEITGE ADDITION Applicant: Location: Jim and Barb Neitge 25985 Smithtown Rd. Stover moved. Gagne seconded to adopt RESOLUTION NO. 97-91 "A Resolution. Granting Preliminary Plat Approval for the Neitge Addition." Motion carried - 5/0 7. ZONING ORDINANCE AMENDMENT - ELDERLY HOUSING ORDINANCE NO. 243 Nielsen said the Planning Commission approved the Amendment as written. He said the City Attorney added additional language to the amendment as follows: (2) Occupancy of each dwelling unit shall be limited to no more than two (2) adults. sixty-two (62) years of age or older. Occupancy of dwellings which qualify as "housing for older persons" under the Federal Fair Housing Act shall be limited to two (2) adults. fifty-five (55) years of age or older. The occupancy limitations shall be memorialized in restrictive covenants approved by the City and filed with the Hennepin County Recorder. There will also be statutory reference when the Federal Fair Housing Act is mentioned. Gagne said this amendment allows Elderly Housing throughout the City. by C.U.P. Councilmember Daugherty asked Nielsen to clarify the difference . between the 55 and 62 year restrictions. 6 REGULAR CITY COUNCIL MINUTES SEPTEMBER 9. 1991 - PAGE 7 . Nielsen said. if certain services are provided. housing can be restricted to ages 55 and older otherwise the age limit is 62 years. Stover moved. Gagne seconded to adopt ORDINANCE NO. 243 "An Ordinance Amending 1201 of the Shorewood City Code Relating to Zoning Regulations. II Motion carried - 5/0 8. REPORT AND RESOLUTION ON BIOS FOR PINE BEND WATERMAIN EXTENSION CITY PROJECT 91-11 Ed De La Forest of OSM explained to the Council the difference between the feasibility study and the final bid on the Pine Bend Watermain project. The final bid was $36.000 higher than the Feasibility Study and the cost to the City to reconstruct the street will be $75,000. De La Forest said the assessment per parcel will increase by $1000. He said Joel Dresel did discuss the difference in the cost with the neighbors. . BILL KEELER - 27420 PINE BEND said he talked to neighbors and the same number of people are still interested in the project. He said he talked to Dresel and Dresel did not think the cost of this project would decrease in the spring. JERRY BRECKE - 27450 PINE BEND said he also Brecke said he is in favor of the project. Zdrazil. Superintendent of Public Works and the new road will be superior to the old. represents Mark Graham. He talked to Don Zdrazil confirmed that PHIL BORTSCHELLER - 27410 PINE BEND said he does not need the City water hook-up but he does approve of the project. He said Dresel told him the construction can start in two weeks. He asked De La Forest if there will be enough time to complete the project before winter. De La Forest said it can be done. Bortscheller asked the Council if there has been a change in the City water hook-up assessment policy. He asked if a resident has to hook-up to the water within a certain time. Brancel and City Administrator Hurm said there has been no change in policy, a resident is not required to hook-up and there is no time limit. . Gagne asked the total number of residents to be assessed. De La Forest said 11 residents will be assessed. Gagne asked Rolek if there is $8000 in the water fund. Rolek said there is money in the water fund. However, the $67,600 will come from the General Fund. Lewis asked if the "soft costs" in the project will increase with the final bid price. 7 REGULAR CITY COUNCIL MINUTES SEPTEMBER 9. 1991 - PAGE 8 De La Forest said the design costs are a percentage of the total construction cost. However. the are some reimbursable costs written into the contract. . Daugherty asked why the street costs have increased. Rolek said the costs of reconstruction of the street has increased. Hurm said there is money in the General Fund for repair of streets. Daugherty said he wanted to be sure money will not be taken from other projects. Gagne moved. Daugherty seconded to adopt RESOLUTION NO. 98-91 itA Resolution Accepting Bid and Awarding Contract for Pine Bend Watermain Extension City Project 91-11." Motion carried - 5/0. BREAK - 9:00 - 9:05 9. RESOLUTION SETTING SALE FOR $950.000 G.O. IMPROVEMENT BONDS. SERIES 1991A. ROBERT PLAISTED - SPRINGSTED. INC. informed the Council that his company will be receiving bids on the sale of $950.000 GO. Improve ment bonds at 7:00 P.M. on October 15. 1991. . He said there are two parts to the bond issue. 1. $635.835 will fund three City projects. A. The S.E. Area Water Treatment project. B. The Church Road project. C. The Pine Bend project. 2. The remainder of the issue will refinance an earlier bond issue. The City will payoff $400.000 and refinance $265.000. Plaisted said the interest rate on this issue should be about 6.18%. Plaisted said the underwriter's project is $11.00 per bond. However. this can be adjusted on October 15th when the final bid is received. Gagne moved. Stover seconded to adopt RESOLUTION NO. 99-91 "A Resolution Providing for the Issuance and Sale of $950.000 General Obligation Improvement Bonds. Series 1991A." Motion carried - 5/0 on a roll call vote. 10. ADDENDUM TO RECYCLING CONTRACT WITH KNUTSON SERVICES INC. REGARDING MAGAZINE AND CATALOG COLLECTION AND EXTENDING CONTRACT . ONE YEAR 8 . . . REGULAR CITY COUNCIL MINUTES SEPTEMBER 9. 1991 - PAGE 9 Hurm said Knutson Services Inc. will collect magazines and catalogs from residents. However. they want a one year extension of their contract. Lewis moved. Stover seconded to approve an extension of the recycling contract with Knutson Services Inc. for one year. Motion carried - 5/0 Gagne said he would like to see Knutson send out a calendar of holiday pick-ups to each resident. 11. COMMISSION REPORTS: A. Planning Commission 1. Planning Commission Vacancies. Stover said one Planning Commission member. Dave Pitney has moved and one member. Dick Spellman will be moving. This leaves two vacancies on the Planning Commission. These positions should be filled from the S. E. Area and from the islands. She said the City will advertise in the newspaper. Nielsen said an inquiry has been made from the islands. 2. Recommendation on Establishment Senior Housing Committee - Refer to Planning Commission Minutes under separate cover. Stover said the Planning Commission has recommended the Council approve the implementation of a Senior Housing Committee to follow UP on the Senior Housing Study. Gagne said it is a good idea to have this committee. Hurm is the staff should draft an Ordinance before the City asks for participants in the committee. Brancel asked the staff to prepare an Ordinance establishing a Senior Housing Task Force. B. Park Commission Steve Dzurak presented the Park Commission report. He said the Park Commission revised the snowmobile Ordinance at it's August 27th meeting and will forward recommendations in Sept. to the Council. They will be asking the snowmobile club to help enforce the Ordinance. He said the Commission has established a schedule of user fees for the parks. He said most City haulers were not interested in collecting and some already collect for their clients. R & W Roll-Off will provide roll-off containers at a drop off site. Hurm said this will only be done on one or two Saturdays. The Council discussed whether they wanted to provide another drop-off site for waste. Daugherty and Gagne said this can get out of control. . City Administrator Hurm, City Engineer Dresel, City Finance Director Rolek, City Planner Nielsen and Public Works Superintendent Zdrazil. Absent: Mayor Brancel 2. DRAINAGE ISSUES City Engineer Dresel said a storm drainage map was developed in the 1970's identifying the drainage areas in Shorewood. He said there are two major problems to be addressed. 1. 2. The City has no Capital Drainage Project funds. The City needs money for small drainage projects. Dresel said the City is proposing to charge each household $15.00 per year utility charge to be used for drainage projects. He said the City will be divided into 16 Watershed Districts within a Shorewood/Lake Minnetonka Drainage District. Councilmember Stover said the current policy requires the approval of more than 50% of the residents before a project can be assessed. She asked if this policy will remain in affect. Dresel said the Council will have to decide if they want to make a policy change. He said the legislature approved the establishment of drainage districts to assess everyone in an area for a drainage project. Dresel said residents on high ground do not want to pay for drainage problems. Dresel said three projects have already been identified as needing immediate attention. 1. Grant Lorenz 2. Glen Road 3. Public Works pond Councilmember Lewis said. with the current policy. a small minority can hold up a project. STREETS Dresel explained that funds are available for designated MSA (Municipal State Aid) roads. At the present time Shorewood has about $500.000 i,n the MSA fund. Dresel said he has worked with Public Works Superintendent Zdrazil to prepare a street pavement schedule. however. they are not proposing to do this with a computer program. - They agreed that Strawberry Lane will be the first road to be reconstructed: it is scheduled to be done next year. EQUIPMENT REPLACEMENT SCHEDULE Hurm said a schedule for equipment replacement has been put together. He said equipment certificates can be used to purchase equipment during times of peak replacement. Gagne said the City has been saving ahead to purchase equipment and this would reverse that policy. Finance Director Rolek said the City can do both. He said there is . $105.000 in the Equipment Fund. The City can finance equipment in many ways but there should be a plan. Hurm and Rolek said the City can issue Equipment Certificates or Springsted can do this. They said banks are very eager to purchase these certificates. Hurm said the City should look at all options. make a decision and stick with it. Public Works Superintendent Zdrazil said the replacement schedule has remained the same. however. a $50.000 per year budget will not be enough. PUBLIC FACILITY Dresel said the public works site is being graded and there is a lot of excess fill. It is on schedule. SANITARY SEWER Dresel is recommending discontinuation of the I & I project. Stover asked about the Metro. Sewer contract. Dresel said the MWCC is examining overall III rates. . Gagne asked why an average of the S. E. Area water usage can't be used to calculate sewer rates. Dresel said the area has a lot of groundwater and storm runoff and this complicates the calculations. .., ..:.. . . . CITY COUNCIL WORKSHOP SEPTEMBER 16. 1991 - PAGE 3 WATER Hurm referred to the revised spreadsheet for a fully developed water system. Hurm said the City recalculated the number of units to be assessed for water and determined there are about 1800 units. The assessment per unit would then be $7300. Hurm said each resident would be assessed $800 for construction of a new tower and trunck main and $4000 for the lateral line. He said any new units that are added-after the water is installed would pay a $2500 connection fee in addition to the $4000 for the lateral line. He said all residents would have to connect within five years. This revenue would be needed to make the project work. Water rates will increase 3% annually beginning in 1996. Hurm said a second water treatment plant may be needed in the western section of the City. Gagne said they should include a second water treatment plant. Hurm said the City could start the 3% rate increase a year earlier to obtain funds for this plant. Hurm said it might be advisable to obtain an appraisal of the potential increase in value of the properties with water installed. This may be costly but could save money in any potential lawsuits. Hurm said residents should be told the proposal would require them to connect to the water system within five years. Stover said she will not support any plan that requires connection. She said this will require a policy change and many older residents will object. Gagne asked how long the project will take. Hurm said it will take three years. Gagne said he cannot support assessing a residents before the water is installed. Hurm said all would be assessed $800 spread over 15 years beginning in December of 1992. Water would be available, depending on location, in the fall of 1992, 1993 and 1996. It would be at that point that the $4000 would be assessed over 15 years. Gagne said he thinks residents will approve a water system. "FUDGE FACTORS" Hurm presented a number of factors that could adjust the costs of the project. He said he hopes the 35% standard soft costs could be reduced to 25% due to economies of scale. Gagne asked what kind of negotiations can be done on a large contract. Dresel said there would not be much negotiation if they wanted the project done in one year because only about two contractors can handle - ..::. POLICY QUESTIONS Hurm reviewed a series of policy questions and possible changes. Stover objected to requiring connection to the system. Gagne, Lewis and Daugherty said requiring connection is necessary to make the system work. Daugherty said the City should obtain input from residents in the form of flyers to their homes. Gagne said the City should have the two information meetings and make a decision. Nielsen said all residents should receive notification of the proposed system because their rates will 'be affected. Daugherty said a telephone survey can be done. Lewis agreed with this. Hurm said the City can mail flyers and information packets. then do a telephone survey and finally have the two information meetings. He asked the Council if they agreed with the Policy statements presented. Lewis, Daugherty and Gagne agreed. They wanted the addition of a treatment plant in the Western section of Shorewood. Stover did not. . WATER PROGRAM INFORMATION PACKET Hurm reviewed an outline of the proposed information packet. The Council said the packet should not ,be presented as Pros and Cons. The packet should simply list the facts of the project and considerations involved. Gagne asked if the rest of the Council agreed with the policy not to encourage development by not assessing property until it is developed. The Council did agree with this. The Council discussed the costs of abandoning a well and the costs ranged between $300 and $1000. The Council will have to make a decision regarding this. They decided to delete this from the packet. as any abandoned well. with or without a City system. would need to be capped. At this point the City would not require abandonment. Well water could still be used outside. The Council decided to have an independent group do a telephone survey. . Nielsen recommended Judith Marshik who did the Senior Housing Study. 4 .' . . . At the conclusion of our audit, we will also request certain written representations from you about the financial statements and related matters. An audit includes examining, on a test basis, evidence supporting the amounts and disclosures in the financial statements; therefore, our audit will involve judgment about the number of transactions to be examined and the areas to be tested. Also, we will plan and perform the audit to obtain reasonable assurance about whether the financial statements are free of material misstatement. However, because of the concept of reasonable assurance and because we will not perform a detailed examination of all transactions, there is a risk that material errors, irregularities, or illegal acts, including fraud or defalcations, may exist and not be detected by us. WHEREAS, Boyer Building Corporat~on (Applicant) is the owner of real property located in the City of Shorewood, County of Hennepin, legally described as: Lots 1, 2, 3, 4, 5, and 7, . AN ORDINANCE AMENDING-TITLE 200 OF THE SHOREWOOD CITY CODE ESTABLISHING A SENIOR HOUSING AND SERVICES TASK FORCE THE CITY COUNCIL OF THE ClTYOF SHOREWOOD, :MINNEsOTA, ORDAINS: Section 1: Title 200 of the Shorewood City Code is hereby amended by adding the following Chapter: SECTION: 205.01: 205.02: 205.03: 205.04: 205.05: 205.01: 205.02: "CHAPTER 205 SENIOR HOUSING AND SERVICES TASK FORCE Purpose Task Force Created, Membership, Term of Office Organization Objectives and Duties Sunset Clause PURPOSE: The Task Force is created to research and make recommendations to the Planning Commission and City Council concerning issues which affect senior citizens within the City of Shorewood. TASK FORCE CREATED, MEMBERSHIP, TERM OF OFFICE: A Shorewood Senior Housing and Services Task Force is hereby created which will serve as an advisory body to the Planning Commission and City Council. Membership in the Task Force shall consist of seven (7) residents of the City appointed by the City Council. Residents must be fifty-five (55) years of age or older to be eligible for appointment to the Task Force. Terms of all members shall commence 1 January 1992 and shall be for two (2) years. The City Council shall designate one of its members as its liaison to meet with the Task Force, and it shall direct the Task Force to designate one member of its body as a liaison person to meet with the Planning Commission, and the Planning Commission shall designate one member of its body as a liaison to meet with the Task Force. 205.03: ORGANIZATION: + , Subd. 1. Officers: The chair of the Task Force shall be selected by the City Council, and that person shall serve in that position a period of one year. The Task Force may appoint a secretary who mayor may not be a member of the Task Force. . Subd. 2. Meetings: The Task Force shall meet at least monthly, and all meetings shall be open to the public. Subd. 3. Rules of Order and Business: The Task Force shall adopt rules and regulations governing the conduct of its meetings. A majority of its 'membership shall be required to conduct official business. 205.04:- OBJECTIVES AND DUTIES: The Task Force is hereby designated the following responsibilities: Subd. 1. Prepare and submit to the Planning Commission a Senior Housing section to the Shorewood Comprehensive Plan, incorporating policy statements as recommended in the "Study of Senior Housing Needs", dated May 1991. Subd. 2. Review and make recommendations to the Planning Commission on amendments to the Senior Housing section of the Comprehensive Plan. Subd. 3. In April of 1990 the Excelsior Covenant Church was granted a conditional use permit to build an addition on the west side of their building. The c.u.p. was specifically contingent upon their submitting a landscape plan for approval by the City Council (see Exhibit A, Excerpt from Resolution No.34-90). The staff report for their c.u.p., dated 27 March 1990, recommended that their landscape plan concentrate on the. north side of the site where the old driveway was removed, and on the west side of the site, to retain the type of screening which had existed prior to construction (see Exhibit B). A landscape plan submitted by Mr. Jack Streed is too large to copy for this report and will be presented at the meeting on Monday night. His recommedations to the church are stated in a letter attached as Exhibit C. The plan which ha~ been submitted is considered to be primarily decorative foundation planting which requites no approval by the City. The plan does not address the screening which was recommended in the staff report. Having viewed the site when the leaves were down, the construction of the church addition has left a gap in the existing vegetation on the west side of the site. While the property to the west is currently undeveloped, it is zoned for residential use. Consequently, it has been recommended to representatives of the church that evergreen trees be planted on the west side of the parking lot to screen the parking. Six-foot trees planted now would provide a visual buffer by the time the property to the west is developed. It is recommended that evergreen shrubbery of some sort be planted in the area where the old driveway w~ removed. The plan as submitted is not consistent with what was discussed when the c.u.p. was approved. This is one case where a very little is quite adequate. Your site presently has all the trees and shrubs that you need, and I recommend just three improvements. On the overlay/they are marked A, B, and C. A. You might consider putting four or five small trees in this area. River birch, aspen, and amelanchier and examples of small, hardy trees that would serve quite nicely. Not only would such a planting add interest and a focal point to the southwest quadrant of your property, but it would also serve as a guide for traffic when the Minnesota snows are blowing around, .obscuring curb and pavement. B. These planting pockets present a fine opportunity for effective, minimum maintenance landscaping. Planted either with a ground cover such as Baltic Ivy, or even Ground Ivy and/or a strong perennial such as, say, Hemerocallis or Rudbeckia, they will provide a good accent on the west side of the building. C. The AC equipment can be screened 'any number of ways. The simplest would probably be with a wooden fence or trellis which can be enlarged to accommodate more equipment. 2. I see no need for anything more than the above. The area shaded light green should be seeded or sodded in some places, but that is all. The rest of the property, that property outside the parking area could well be left unmowed entirely. Free growing grasses are attractive and provide numerous environmental advantages. During this time you have received many compliments from us for the fast and efficient response to our needs. We have no complaints about the actual per- formance of your fire department. I regret to advise you however, that we do have a serious complaint about the manner in which you see fit to- allocate your costs, not only to us but also to adjacent cities who are also purchasing service from you. I have voiced my' complaint, to you before, but apparently you have chosen to ignore what I consider improper and unfair distibution of expense among participating cities. . According t6 your letter, you have chosen "tax capacity" as a basis for cost allocation, despite the fact that this has no relationship to the fire risk involved, to the true value of property that must be protected nor to the potential work load that Excelsior must assume to protect Deephaven property. As you know "tax capacity" is an arbitrary number designed by the state legislature to set highly progressive taxes against property carrying high assessed value, while leaving low assessment properties with low taxes. One home assessed at say $680,000 is judged to have 27 times as much tax capacity as one home assessed at $68,000 despite the fact that it is only ten times more valuable than the lower priced residence. Applying this sort of formula to set fire protection charges is ridiculous. Surely the fire risk and the service need of one $680,000 home is not 27 times greater than what is needed to cover one home of one-tenth the value yet under your formula, that is exactly what you propose to charge us. With our considerable Lake Minnetonka shoreline, and with ever rising values being placed upon shoreline property, we have many homes falling in the highest of the steeply progressive tax structure mandated by the state. The fact that land prices have increased so sharply, has nothing to do with increased fire risk. Fire does not destroy land. . It is our opinion that fire protection costs should be allocated on the basis of the number of locations where such an event might occur, plus a factor that covers the monetary ?J 0-../ value of what might be destroyed. I repeat, tax capacity bears no relationship to this. Under your misguided formula we believe Deephaven is being asked to cover an unfair portion of the total expense and if you persist in sticking to tax capacity, we intend to seek elsewhere for service that will cover our needs. Our service from Excelsior, as I said in the beginning, has been excellent. Your decision that arbitrarily places an unfair cost burden on high valued property, is not acceptable however. While not a part of this discussion, I must point out to you the fallacy of the state laws on residential property taxes. Progressive taxation is widely accepted when based with ability to pay.The assessed value of a property has nothing to do with the ability of the occupants capacity to pay. In our city we have many long term residents who have seen their homes grow in value at a rate far greater than their income. Imposing progressive taxation upon these people is not proper. We will be happy to meet with you and the other cities concerned, in order to try to develop a proper and equitable formula. Working together, I am sure that this is possible. We will appreciate your thoughts on this. I trust that I have made our position abundantly clear. A speed zoning study has been completed for Shorewood Oaks Drive and Oak Leaf Trail as requested by the Shorewood City Council in Resolution 63-91. Based on the study results and as discussed with you previously, we recommend continued reliance on Minnesota's statutory 30 mph urban district speed limit. (This limit may be posted or not posted at the city's discretion.) Our recommendation has been forwarded to Mn/DOTs traffic engineering office in St. Paul for their review. Assuming they concur, no speed limit authorization will be issued. You will be notified of their action. Also, as discussed with you, there is one curve on each road where 30 mph speed cannot be safely maintained. We suggest installation of turn signs with appropriate advisory speed plates for these curves, especially since the speed limit is posted. During discussion of our recommendation, you expressed interest in general comments concerning speed limits and SLOW CHILDREN signs. You might therefore find the attached letter and the following general comments of interest. While many people believe that posted speed limit determines the speed of traffic, studies in Minnesota and elsewhere have demonstrated that speed patterns are actually determined by driver reaction to the road environment and by driver attitude (purpose of trip, etc.). Very little change in speed patterns can be expected with a change in the posted speed limit. Why then do we bother to post a speed limit? Hurm August 22, 1991 Page Two . - Inform those not familiar with a road, what speed is considered to be reasonable and safe under ideal conditions. - Inform. those living along the road of the prevailing speed of traffic. - Serve as a basis of enforcement against those who drive at unreasonable or unsafe speed. - Contribute to smooth traffic flow on roads with high traffic volume. To fulfill these functions, however, the numerical value of the speed limit must be consistent with prevailing operating speeds. Also, considering the functions of a speed limit, it is apparent that a posted speed limit will be of the greatest value on arterial or collector streets where non-local traffic can be expected and where enforcement activity is likely. Most municipalities elect to rely on unposted statutory speed limits for strictly residential streets for three reasons: 1) Speed limits have little value on streets where almost all traffic consists of local residents who drive the road daily and where enforcement activity is unlikely. 2) Few cities can afford speed limit signs for all of their streets. 3) If each street were to be speed zoned on its own merit, the resulting array of speed limits would be confusing and difficult to enforce. . The copying and postage expenses of maintaining such a list can be quite costly. It was suggested that. a fee be established to defray the cost of such mailings. . Because of possible legal implications of such a fee, the ci tl Attorney was consulted regarding the City's obligation to provi~~ this service. In his.opinon,according to. state statute, a fee may be charged for mailing of council agendas for regular council meetings; agendas for special council meetings must be mailed to .residents upon request, at city expense, .if the agendas for such meetings are not published in the official newspaper. Likew~s8, minutes must be mailed upon request, at city expense for postaga. However, it was the attorney's opinion that the cost of copying could be charged back. Upon researching the matter further, we found several other communities which are presently charging for the mailing of agendas and minutes. . Our average Council agenda is four pages and our average set of Council minutes is 11 pages . When applying a $.25 per page copying charge, mailing materials, and the first class .postage rate to these figures, and multiplying by the number of meetings each year, the annual cost of mailing agendas is $35.00; the ann\Ialcost of mailing minutes, for copying and materials only, is $75.00. Inasmuch as the city posts all meeting agendas in designated public places for public inspection and maintains a minute book at the City Hall which is available for public inspection, I recommend that a fee be established to defray the cost of these types of mailings. I recommend an annual fee of $35.00 for mailed agendas and $75.00 for mailed minutes. The City council meetings generates an enormous amount of copying and time spent with the preparation and distribution for residents requesting minutes and agendas (list attached). The minimum total for copying agendas is 78 copies for each City Council meeting. This may in"crease depending on the number of issues on the agenda. For example, anyone listed on the agenda automatically is mailed a copy. Then there is another list for minutes (agenda included) that is sent to the Commission members, and others for a total of 21 (decreased by 5, 9/9/91 meeting) plus copies for the front counter. I recommend that we consider the suggestions in the Finance Director's memorandum (suggesting fees) and further set a policy that the City Council minutes, as requested by residents, be copied only after it has been approved by the Council. That the current list be reviewed to decrease further the limit on the mailing. Two options to be considered - . option one: would be the entire 14 members of the 2 Shorewood Commissions, mail only to the chairperson, and eliminate the duplication tQ the 2 newspapers (they get complete packets), and review the list of others. option two: handout minutes/agendas at the commission meetings and not send to the duplicates to the newspapers.
