Roll Call All members of the City Council were present and at 7:45pm Councilman Daugherty left the meeting the remainder of the interviews were video taped with the permission of the applicants. The following firms were interviewed: Froberg and Ahern Larkin Hoffman Daly & Lindgren - Rider Bennett Holmes & Graven Chartered Following the interviews there was a consensus among the Councilmembers present that the video tape would not leave the City Hall and that the Council would meet again to make a decision on July 31, 1991 with a backup date of July 30. Planning Commission Gagne said he attended the Planning Commission meeting and agenda items 7 and 15 were discussed at the meeting. B. Park Commission 1. Park Capital Improvement Program Administrator Hurm said the Council will receive a report on the Park Capital Improvement program at the next City Council meeting. . 5. REVIEW OF RESOLUTION NO. 42-91 APPROVING PRELIMINARY PLAT JOHNSON'S FIRST ADDITION Attorney Froberg referred to paragraph 8 of Resolution 42-91, approving the preliminary plat for Johnson's First Addition. He said there is no statutory authority that allows the City to delegate it's authority to a third party to grant approval when acting as an architectural review board. Froberg and City Planner Nielsen met with the Waterford neighbors and they were under the impression that the Johnson lots were included in the Waterford covenants and that there is an agreement between Mr. Johnson and Trivesco to that effect. Froberg said the City has seen no agreement between Johnson and Trivesco, and if there is one, it would be a private matter between Johnson and Trivesco. Planner Nielsen said one of the 'neighbors asked if the discussion could be tabled until the residents can locate the agreement between Johnson and Trivesco. Lewis' moved, Daugherty seconded, to table reconsideration of the resolution to the meeting of Aug. 26 to allow the residents of Waterford Circle to obtain necessary documents to support their claims that the Johnson lots are part of Waterford. Motion carried - 5/0 RESOLUTION NO. 68-91 6. PROPOSED RESOLUTION DENYING SUBDIVISION/LOT WIDTH VARIANCE Applicant: Location: A. J. Daugherty seconded. to direct the attorney to prepare findings of fact approving a front yard setback variance for a sidewalk at 5885 Christmas Lake Road. Motion carried - 5/0 8. SIGN PERMI1 Applicant: Location: BeverlY Janson 19285 State Highway 7 GLEN JANSON spoke on behalf of his wife Beverly Janson. He said he rebuilt the sign in the same location it has been for many years and was given verbal approval by a person at City Hall. Janson said many other local businesses have signs in the R.O.W. Councilmember Daugherty asked him if he would have a problem relocating the sign. Janson said he would have to destroy the sign to relocate it because it is set in concrete. He asked if the sign could remain in place until the new road construction begins. Councilmember Stover said the Planner's report indicated that Mn/Dot does not allow signs within it's R.O.W. ' Brancel and Gagne indicated they will not override Mn/Dot. Gagne'moved. Stover seconded. to issue a sign permit to Beverly Janson subject to relocation of the sign from the Mn/Dot right-of-way to her property at 19285 State Hwv. 7. Motion carried - 5/0 9. ORDINANCE AMENDING CHAPTER 1201 OF THE SHOREWOOD CITY CODE (DEFINING STREETS) - FIRST READING Froberg presented a proposed Ordinance amendment to the Council for a first reading. He stated the Ordinance has been modified to include public and private R.O.W. in the definition of streets. He said the final copy of the Ordinance will be presented to the Council for action at the next City Council meeting. - ~ ~ : REGULAR CITY COUNCIL MIaS JULY 22, 1991 - PAGE 4 . ORDINANCE NO. 240 10. AN ORDINANCE ESTABLISHING A FEE FOR SPECIAL PERMIT TO INSTALL UNDERGROUND SPRINKLER IN RIGHT-OF-WAY. Stover moved, Lewis seconded to adopt ORDINANCE NO. 240 "An Ordinance Establishing a Fee for Special Permit to Install Underground Sprinkler in Right-of-Way." Motion carried - 5/0 Administrator Hurm said this ordinance will apply to all private properties and some common areas in the City. RESOLUTION NO. 72-91 - 11. PROPOSED RESOLUTION ACCEPTING BIDS AND AWARDING CONTRACT CHURCH ROAD IMPROVEMENTS - Engineer Dresel recommended awarding the bid to Widmer Construction because they were the low bidder at $103.500. Gagne moved, Daugherty seconded to adopt RESOLUTION NO. 72-91 "A Resolution Accepting Bid and Awarding Contract for Church Road Improvements to Widmer Construction." Motion carried - 5/0 RESOLUTION NO. 73-91 12. PROPOSED RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS FOR PINE BEND WATERMAIN EXTENSION. Dresel presented the schedule for the Pine Bend project. Bid advertisement - Aug. 19 Award Bid - Aug. 26 Council Meeting -Construction - Sept. to Oct. Gagne moved. Stover seconded to adopt RESOLUTION NO. 73-91 "A Resolution Approving Plans and Specifications and Ordering Advertisement for Bids for Pine Bend Watermain Extension." Motion carried - 5/0 RESOLUTION NO. 74-91 13. RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS FOR SALT/SAND STORAGE BUILDING 4 REGULAR CITY COUNCIL MI~S JULY 22, 1991 - PAGE 5 . Dresel explained that the salt/sand shed will be a three sided lean-to. It will have wood siding and asphalt flooring and measure 44 I x 44 I . Nielsen said the building meets all zoning requirements. Daugherty asked Dresel if the shed meets EPA standards. Dresel said the shed will meet the EPA requirements to prevent runoff. The bids will be received until 11:00 A. M.Aug. 23, 1991 and a the contract will be awarded at the Aug. 26, 1991 City Council meeting. Gagne moved, Stover seconded to adopt RESOLUTION NO. 74-91 "A Resolution Approving Plans and Specifications arid Ordering Advertisement for Bids for a Salt/Sand Storage Building." Motion carried - 5/0 RESOLUTION NO. 75-91 14. RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS FOR SITE GRADING OF SMITHTOWN ROAD PUBLIC WORKS SITE. Bids will be received until 10:30 A. M. Aug. 19, 1991 and will be awarding at the Aug. 26, 1991 City Council meeting. Gagne moved, Stover seconded, to adopt RESOLUTION NO. 75-91 "A Resolution Approving Plans and Specifications and Ordering Advertisement for Bids for Site Grading of Smithtown Road Public Works Site." Motion carried - 5/0 15. P.U.D. CONCEPT STAGE APPROVAL - GIDEON'S COVE Applicant: Location: John Blumentritt Lawtonka Drive .'WITHDRAWN Gagne informed the Council that the Planning Commission recommended denial of this concept plan because the density is too high. He said part of the property has a peninsula and the City has had problems in the past with residents wanting to install docks on it. He said one dock is grandfathered but no more will be allowed. Stover said the previous plat approval for this parcel stipulated that the peninsula be attached to one lot. RESOLUTION MAKING APPOINTMENTS TO CERTAIN OFFICES AND POSITIONS WITHIN THE CITY OF SHOREWOOD The following appointments are proposed within the staff: 1. Stover seconded. to adopt RESOLUTION NO. 77-91 "A Resolution Making Appointments to Certain Offices and Positions Within the City of Shorewood." Motion carried - 5/0 18. LMCD 1992 BUDGET Gagn~ move. Stover seconded to table the discussion of the 1992 LMCD budget until LMCD Representative Rascop is present. Motion carried - 5/0 19. 1992 ASSESSMENT CONTRACT - ROLF ERICKSON Councilmembers Lewis and Daugherty said the City should advertise for bids for this position. Stover said several years ago the City had a difficult time finding someone to assess a City this size and Erickson has done a good job. Hurm said Hennepin County would charge the City $42,600 for assessment. Erickson did lower his fee somewhat in response ~o budget restraints. Stover moved. Gagne seconded to approve the 1992 assessment contract with Rolf Erickson. Motion carried - 5/0 20. 1992 POLICE DEPARTMENT BUDGET REQUEST Stover said the formula used for the calculations is now based mostly on demand for police service. Froberg said the present Police Contract will expire on Dec. 31. 1-992. Daugherty asked how this contract compares with other cities. Daugherty said an analysis should be done of the costs compared to other cities. Finance Director Rolek said the contract amounts are below average costs for police protection. Gagne moved. Stover seconded to approve the 1992 Police Department Budget. Motion carried - 5/0 21. STAFF REPORTS: A. ATTORNEY'S REP0RT 1. Report on Declaration of Covenants - Sweetwater at Near Mountain concerning the underground sprinkler systems in right-of-way. '~roberg said easements were given by residents to Lundgren Brothers for the installation of underground sprinkler systems. However. these easements did not involve public R.O.W. He said Sweetwater residents will be required to pay a fee for a permit if they install sprinkler systems in the public R.O.W. Gagne asked Froberg to inform the residents. Froberg said he will. B. ENGINEER'S REPORT 1. Report on State Highway 7 right turn lane into Freeman Park. Dresel said MnlDot plans to begin two right turn lanes on HwY. 7. One at Eureka Rd.. and HwY 7. and one a t Church Road and HwY. 7. 7 REGULAR CITY COUNCIL MI~S JULY 22. 1991 - PAGE 8 . He said he would write Mn/Dot to expedite the project. C. PLANNING DIRECTOR'S REPORT 1. Report on private encroachments on trail property from Silverwood Park to Highway 7. Nielsen said he are encroaching them at night. and wi 11 follow has not been ~ble to contact the residents who on the park trail. He said he will try to contact He will direct them to remove the trees and shrubs this with a letter. D. ADMINISTRATOR'S REPORT 1. Christmas Lake 1991 Eurasian Water Milfoil Inspection Hurm said the report from Lake Restoration. Inc.-indicates there is no Eurasian Milfoil in Christmas Lake. 2. Report on Stop Signs at Rustic Way/Idlewild Path and West Lane/Garden Lane Hurm said these stop signs would not be placed at these locations today. He does not recommend taking them down. He said the request does show that the placement of stop signs should be taken seriously and perhaps some guidelines should be established. Stover said the residents who requested these signs have moved. The new residents want them removed. Councilmember Lewis said the safety of neighborhoods should be considered not just the flow of traffic when making these decisions. Stover moved. Gagne seconded. to remove the Stop Sign at Idlewild Path and Rustic Way. Motiop carried - 5/0 3. Report on evacuation of City underground fuel tank Hurm said the diesel tank was removed. They found a small hole in the tank. The MPCA has been contacted to look a any potential environmental damage. He said there could be an expense involved in this but it is reimbursable through a State Fund. 4. Meeting Hurm said the July 29 study session on Capital Improvements is cancelled and he suggested Wednesday. Sept. 4, 1991 at 7:00 P.M. as an alternate date. 8 REGULAR CITY COUNCIL MI~ES JULY 22, 1991 PAGE 9 . 22. MATIERS FROM TIlE FLOOR. Daugherty said he had been contacted by Dennis Huber of 5885 Howards Point Road. Huber has to replace his well at a cost of $2500 - $3500. He said it will cost him $5100 to hookup to City water which is not far from his property. He would like the City to provide a mechanism for financing this amount. He is not claiming he has a hardship. Daugherty said there has been a lot of discussion about the City's water policy and this type of financing could be part of the po Ii cy. . Hurm said this would be a policy change. Froberg said the state statutes provide for assessment of connection charges but there is no provision in the City Code. Lewis moved, Gagne seconded to prepare an amendment to the Ordinance to revise the City Code to allow assessment of water hookup charges for a period of 10 years. Motion - withdrawn Lewis moved, Gagne seconded, to add the water connection charge for Dennis Huber to the Notice for Hearing on 1991 assessment for delinquent utility charges. Motion carried - 5/0 23. COUNCIL REPORTS. A. MAYOR BRANCEL 1. Report on discussions on purchasing land for the Public Works facility. Brancel said the negotiations with Mr. Bishop have been dropped. /2. Report on July 10, 1991 SLMPSD Coordinating Committee Meeting. Brancel said Greenwood has offered to pay part of the police expense for the July 4 fireworks. She will obtain the final cost figures for the fireworks and the Council will resume the discussion. B. COUNC I LMEMBER GAGNE Gagne asked Dresel if there will be a new intersection at Christmas Lake Rd. and HwY. 7. Dresel said MnlDot has dropped the project because of objections by Greenwood. D. COUNC I LMEMBER DAUGHERTY No report. E. COUNCILMEMBER LEWIS Lewis asked if all-the Trivesco partners had signed the Declaration of Covenants, Conditions and Restrictions. Brancel said they had.. Lewis also asked about the status of the Old Market Road intersection. Dresel said they expect final a~proval by the 1st or 2nd week of August and there will be more Special funds available than anticipated. Brancel said the interview tapes of engineering firms is available. Hurm also said he will have a memo, regarding the candidates, available on 7/23/91 for the Council members. 24. CITY OF SHOREWOOD SPECIAL CITY COUNCIL MEETING WEDNESDAY, JULY. 31, 1991 COUNCIL CHAMBERS 5755 COUNTRY CLUB ROAD 7:00 P.M. MINUTES Mayor Brancel called the special city council meeting to order at 7:05 pm. 1. Roll Call Present: Mayor Brancel, Councilmembers Daugherty, Lewis, stover and Gagne and City Administrator James C. Hurm. 2 . Review and Consider Appointment to the posi tion of Ci ty Enqineer. Administrator Hurm reviewed for'the city Council the process undertaken in making a recommendation to the Council for the position of city Engineer. A special committee was established to review all of the fourteen applications, establish criteria, narrow the field of firms to be interviewed to three, conduct the interviews and make a recommendation based on a point rated system in accordance with the criteria selected early in the process. Members of the committee were Administrator Hurm, Planning Director Brad Nielsen, Public Works Director Don Zdrazil, Director of Operations and Maintenance Lloyd Pauley (City of Minnetonka), and City Administrator/Engineer Alan Orsen (City of Wayzata). The committee recommendated Joel Dresel of Orr Schelen Mayeron & Associates, Inc. (OSM) to be the City's Engineer. Following discussion Gagne moved, to authorize the Administrator to negotiate an agreement with OSM with the financial considerations outlined during this selection process with a cap on project fees and with a thirty day notice to end the agreement, seconded by Stover. The motion passed unanimously. , There was some discussion on the eventual need of an in-house engineer. OSM would need to be made aware that in some point the City is likely to consider an in-house engineer. 3. Review and Consider Appointment to the position of city Attornev. There was discussion among the members of the Council on the four firms that had been interviewed by the council for the position of City Attorney. It was noted that the personal attention for the City by our current Attorney Glenn Froberg has been very valuable. -1- 3C ".. . . city council Work Session Minutes - July 31, 1991 Page Two Daugherty moved, to re-interview the firm of Larkin, Hoffman, Daly & Lindgren, Ltd. to clarify several points specifically: meeting attendance, billing procedures, and the possibility of the City going with a separate outside prosecutor; seconded by Gagne. The motion passed 4-0 with Stover abstaining. The Council asked that a special meeting be set up for 7:00pm on August 12, 1991, to meet with representatives with that firm. The Capital Improvement Program work session will start immediately thereafter at 7:30pm. 4. Adjournment There being no further business the meeting was adjourned at 8:50 pm. SHOREWOOD, MINNESOTA 55331 · (612) 474-3236 -MEMORANDUM TO: Mayor and City Council FROM: Brad Nielsen DATE: 8 August 1991 RE: Shorewood Finamart - Temporary Sign Permit and Charitble Event FILE NO. 405 (Sign Permits) The management of the Finamart store located at 24365 Smithtown Road has requested approval to hold a charitable event on their property on Saturday, 24 August from 10:00 a.m. to 4:00 p.m. They propose a "car smash" to raise money for the Muscular Dystrophy Association. Their proposal is described in a request letter, dated 5 August. There are two issues which should be addressed by the Council: 1) the event itself; and 2) a temporary sign permit to advertise the event. The Finamart facility exists under a fairly specific conditional use permit, the conditions of which are listed on Exhibit A, attached. One of the main premises on which their c.u.p. was granted was that outdoor activities on the site would be significantly restricted. Although the "car smash" will occur outdoors, it is not considered to violate the intent of the c. u. p. for several reasons: 1. The proposed event benefits a charitable organization. 2. It is a one-time event scheduled for six hours on a Saturday. 3. It is not expected that large crowds will be drawn to the event at anyone time. Consequently, it is not anticipated to create a parking problem. It is worth remembering that the parking lot for the Dairy Queen building which has not been built to-date is currently underused. 4. Temporary signage for the event is within the allowable limits of the Zoning Ordinance. A Residential Community on Lake Minnetonka's South Shore 4A-2- ,., . . Shorewood Finamart Temporary Sign Permit 8 August 1991 The only issue which may be viewed as potentially negative is noise - from the car being hit or from occasional cheering from spectators (particularly if the vehicle is a Volkswagen!). This problem may be mitigated somewhat by the proposed limited hours. The Zoning Ordinance allows two temporary sign permits per year, per property, for seven -days at a time. The subject site has not had a temporary sign permit since 22 January 1990. The applicant proposes to erect a 4'x 8' portable billboard on the site, approximately one week prior to the event. The sign will announce only the event and will not be used for commercial purposes. Approval is recommended subject to the conditions that the sign not be animated in any way or include any type of flashing lights, and that it be located so as not to interfere with sight lines from the driveways to the property. Since the proposed signage is for a charitable cause, the City may wish to consider not counting it against the property's two allowable sign permits. Type of Contract If the cities agree on a proposal, a contract for City Prosecuting Attorney Services will be signed between the individual selected and the individual cities participating in the joint search program. In the individuals absence another attorney can be assigned, with the consent of the City Council. It is contemplated the contract term will be for two years. Qualifications The cities are extremely interested in the ~alifications of the proposer. Proposals should state the qualifications of the individual, and if applicable, the qualifications of the firm which may support the individual (keep the two separate). The proposal should summarize the experience in prosecutions, particularly in Hennepin County, the length of various experiences, and the individuals educational background. We are also concerned with potential conflicts of interest. Please state what other government subdivisions you or your firm represents. Are there other possible conflicts which may arise? If you are selected as prosecuting attorney and a conflict does arise, will you represent the City as your first priority? - Also of interest is the office and support staff of the proposer. Where is, or will your office be located? What. size is it? Is there a complete library? Is there computer assisted research capability? How is research accomplished and by whom? Absent: Commissioner Rosenberger Commissioner Pitney arrived at 7:43 P.M. APPROVAL OF MINUTES A. Planninq Commission Minutes - July 2. 1991 Leslie moved, Bongaards seconded, to approve the Planning Commission minutes of July 2, 1991. Motion carried - 5/0 1. STUDY SESSION - ELDERLY HOUSING Planner Nielsen presented his memo of July 2, 1991 regarding the Elderly Housing - Comprehensive Plan and Zoning Ordinance Amendments. The following issues were discussed: 1. Comprehensi ve PI an 2. Sr. Housing issues. 3. Goal or goals of elderly housing 4. Pol icy recommendat ions. 5. Zoning Ordinance amendments. 6. Senior Housing Commission. ISSUES Nielsen said the Senior Task Force Study ~ad identified the fact that there is limited housing available for the elderlY in Shorewood. There is only one 18 unit C1.partment building and no smaller or "step-down" housing, as recommended by the Study. He said the Study indicated that the elderly want to stay in the area and want affordable housing. 1 PLANNING COMMISSION MINUTES JULY 30, 1991 - PAGE 2 The Shorewood Zoning Codes already provide for a variety of housing needs. Nielsen said projects could be developed that will fit into the ~urrounding neighborhoods. GOALS E:dstinq Compo Plan: "Provide a full range of equal opportunity~ choice and accessibility to services for each individual in Shorewood." Proposed re: Elderly: "Provide housing opportunities and services to ensure that senior citizens can remain a part of the community." Nielsen said the Planning Commission or Elderly Housing Commission can redefine these goals. POLICIES Nielsen reviewed the policies stated in the July 2 memo. ZONING ORDINANCE AMENDMENTS The Housing Needs Study identified three types of housing +or the elderly: 1. Smaller units on smaller lots, either attached or detached. type of housing was most popular in the survey. Senior apartments. Care facilities. This ~ .L. ~ '-' . Nielsen said the R-3B district is currently the only district in Shorewood that can" accommodate elderly housing and there is no land zoned R-3B or proposed to be zoned R-3B. The current definition of elderly housing was changed by the Commission members: , "A public agency owned or controlled multiple-dwelling building with open occupancy Ii mi ted to persons over si :-:ty years of age." The Commission deleted" multiple-dwelling building" and substituted single family attached units. The members said "public agency owned or controlled" should be redefined according to the Federal Fair Housing Act. They also agreed that the occupancy should be limited to persons over sixty two years of age. - The Planning Commission discussed the possibility of allowing one spouse under 62 years of age but decided to leave the age limit at 62. The Federal Fair Housing Act states that persons under 62 must have specific services provided. 2 PLANNING COMMISSION MINUTES JULY 30, 1991 - PAGE 3 R-1A. SINGLE-FAMILY RESIDENTIAL The Planning Commission members agreed that elderly housing shouid be provided within existing zoning districts. They agreed that elderly housing should be: 1. By P.U.D. 2. Limited to 62 years of age ~. The caretaker should also be 62 years and occupancy should be defined according to the existing code. 4. The owner, association or agency must file a resume of occupancy of each building listing the number of tenants by age in each unit. 5. Many of the Commission members stated there should be two parking spaces per unit and possibly provide space for one garage per unit. Nielsen said most elderly housing units have only one parking space to keep the cost affordable. However, he said the City could provide incentives for developers to provide garages. 6. The density of the development in the Rl-A district shall not exceed 4 units per acre and 8 units in the Rl-C. However, the minimum parcel size should be 4 acres. R-3A. MULTIPLE-FAMILY RESIDENTIAL The Commission members agreed to provide for nursing homes in this district under C.U.P. They deleted the mention of group housing. However, group housing is covered under State guidelines. Nielsen asked the Commission if they wanted to recommend rezoning areas of the City to R-3A or R-3b. The Commission said that should wait until a daveloper makes a proposal. Nielsen said he will incorporate the Commission's recommendations into the Comprehensive Plan and Zoning Ordinances and present them at the August 6th Planning Commission meeting. He s~id a Public Hearing will have to be held to finalize these changes. SENIOR HOUSING AND SERVICES COMMISSION Nielsen said the staff suggested that the Senior Housing Committee be established as a separate Commission and include Senior services. Housing recommendations will be reviewed by the Planning Commission first. He presented five purposes of the Commission: 1. Incorporate the Policy Statements of the Senior Housing Needs Study. 2. Recommend amendments to the Senior Housing Section of the Compo Plan. ~ PLANNING COMMISSION MINUTES JULY 30, 1991 - PAGE 4 ~. Repo~t on the affect of va~ious issues and policies on senio~ citizens as ~equested by the City Council. 5. Develop and ~ecommend a p~ocess to the City Council fo~ updating the housing needs of senio~ citizens. Commissione~s Pitney and Schultz said a Commission should not add~ess the needs of one specific g~oup. Council Liaison Stove~ s~id the g~oup should be a Task Fo~ce with specific tasks and goals. The Planning Commission ag~eed the senio~ g~oup should be the Senio~ Housing and Se~vices Task Fo~ce with items 1 th~ough 4 as it's goals. The~e will.be 7 membe~s who a~e ~esidents of Sho~ewood. The Council liaison will be Councilmembe~ Gagne, staff liaison will be Nielsen and the Planning Gommission liaison will be designated as needed. 2.
