For more detail please refer to the individual staff reports contained in the Council information packet. Item 3A. The American Legion has applied for their annual gambling license. Shorewood issues such licenses to charitable organizations, pursuant to Chapter 301 of the City Code. The application must also go to the State and requires a resolution to be approved by the City. bjn Item 3B. Former Mayor Haugen has requested that the City reissue an old Council paycheck which had been misplaced for a number of years. The check had been cancelled and the money deposited to the general fund. The Finance Director recommends reissuing the check. ajr Item 6. Based upon the Council's direction at the last meeting, the City Attorney has prepared findings of fact denying a setback variance and variance to expand a nonconforming use of property requested by Herb Mason. The structure in question had been built without a permit. bjn Item 7. Ron Johnson proposes to plat three lots which will front on Waterford Circle. Staff has stressed the importance of ensuring that homes built on these lots be consistent with the existing homes on the street. While the applicant agrees to conditions similar to the restrictions which exist for homes in Waterford, he objects to being subject to Waterford's architectural review committee. Understandably, residents on Waterford Circle want assurance that their property values will be protected. The Planning Commission recommends that the preliminary plat be approved, subject to a number of conditions, one of which is that the new lots be subject to the same covenants and restrictions that exist for Waterford. bjn Item 8. The original feasibility report for this project was completed in August 1990 and included resident feedback regarding tree removal and dredging as suggested by the MWCD. The updated Feasibility Report presented March 25, 1991 reduces the scope of the project and construction costs from $150,000 to $107,000 with funding proposed through a special taxing district. However, needed easement acquisition could add up to $250,000 to the total project cost. jad # . . Executive Summary - Council Packet 22 April 1991 Page two Item 9. The Feasibility Report presented March 25, 1991 contains several options for the extension of city water into the Pine Bend area. These options range in scope from the lowest initial cost to the most advantageous from an engineering and maintenance standpoint. Total project costs are estimated from $77,000 to $121,000 with funding proposed from both the 1991 street maintenance budget and special assessments. jad Item 10. In addition to the plans and specifications, the City Engineer will have a display prepared to show the layout and features of the Old Market Road Intersection Project. These plans contain many items of interest to the Council, including signage and traffic control, watermain extensions, and funding alternatives. Acceptance of the plan is necessary to bring bids back to the Council prior to the June 1, 1991 deadline. jad Item 11. Based upon issues which arose during the past year, the Park Commission secretary has proposed certain revisions to the contract between various athletic organizations and who wish to use the park facilities and the City. The revisions have been reviewed by the City Attorney. bjn Item 12. Like other cities, Excelsior is experiencing budgetary problems. In an effort to curb expenses, they have suggested that other cities share more of the additional expense for police services associtated with the annual Excelsior 4th of July Celebration. From information provided by Excelsior's Manager, it appears that they are suggesting that Shorewood's share of the cost would be $2617. We have budgeted $1000 for donation to the Excelsior Chamber of Commerce for the fireworks for 1991. bjn Item 14C-2. Upon the Council's direction at the last meeting we have obtained an estimate from the Park Planning Consultant to prepare a landscape plan for the S.E. Area Water Treatment Plant. The check, issued to her in 1980 in the amount of $100.00, was found as she was going though some of her papers. It was found, after researching the records, that the check had been canceled by the City and had never been reissued. Jan is requesting that the check be reissued to her. Inasmuch as the check has never been cashed, and the City has since changed its depository, it is recommended that a replacement check be issued to Jan Haugen in the amount of $100.00. A RESOLUTION DENYING VARIANCES TO HERBERT MASON FOR THE CONSTRUCTION OF A GAZEBO WHEREAS, Herbert Mason (Applicant) has constructed a 12 foot by 12 foot gazebo without a building permit on the west side of his home on his property located at 27010 Edge'Wood Road in the City of Shorewood, County of Hennepin, State of Minnesota; and WHEREAS; said gazebo was constructed in such manner and location that it does not comply with the side-yard setback requirements of the Shorewood Zoning Code, and Applicant therefore requires a setback variance in order to maintain the gazebo in its present location; and WHEREAS, there already exists two single-family dwellings on the property which do not comply with the use requirements of the Shorewood Zoning Code and, therefore, are existing as a non-conforming use of the property; and WHEREAS, Applicant has made application for a variance to permit the expansion of an existing non-conforming use of the property to permit the additional use of the property for a gazebo; and WHEREAS, a pUblic hearing was held and the application reviewed by the Planning Commission, and, after due deliberation and review, the Planning Commission recommended denial of the variances; and WHEREAS, a further review of the application was had before the City Council at their regular meeting held on 8 April 1991, at which time the Planning Commission recommendations were reviewed and reports received from the City Planner and City Attorney; and WHEREAS, atter due deliberation and a review ot the criteria required for the granting of variances, the city Council directed the City A ttorney to prepare a resolution setting forth Findings and Conclusions denying Applicantls application for the requested variances. That the subject property is located in an R-1C, single-fam11y residential zoning district and 1s also subject to the requirements of the S, Shoreland (overlay) district. That the R-1C zoning district requires a side-yard setback of 20 feet whereas Applicant's gazebo is presently constructed within 17 1/2 feet of the Vlesterly side yard lot line. 3. That Shorewood City Code Section 1201.03, Subd. 2.c. (4), specifically limits the use of a residential lot to one principal building. 4. That Applicant's property is presently occupied by two principal buildings and therefore constitutes a non-conforming use of the property. 5. That the use of the property for a gazebo would be an expansion of a non-conforming use of the property. 6. That the Shorewood Zoning Code makes no provision for the expansion of a non-conforming use of residential property, and further provides that is the intent of the Code is that all non-conforming uses shall be eventually brought into conformity. 7. That Applicant neglected to a.pply for a bullding permit for the construction of the gazebo prior to its construction and that said gazebo therefore constitutes an illegal structure on the property. CONCLUSIONS 1. That the the variances requested by the Applicant constitute a substantial deviation from the requirements of the Shorewood Zoning Code. 2. That the property can be put to a reasonable use, and, in fact, already has been put to a reasonable use without the construction of the gazebo on the lot. 3. That the present plight of the Applicant concerning the illegally constructed gazebo is due to circumstances created by the Applicant and is not a result of circumstances unique to the property. 4. That the Applicant has not met the criteria for the grant of a variance under Section 1201.05 of the Shorewood City Code and has not established an undue hardship as defined by Minn. Stat. (612) 474-3236 MEMORANDUM TO: Mayor and City Council FROM: Brad Nielsen DATE: 18 April 1991 RE: Johnson's First Addition FILE NO. 405 (91.07) In reviewing the preliminary plat for Johnson's First Addition, the Planning Commission recommended that this plat should be subject to the same protective covenants which apply to Waterford, including having Trivesco serve as the architectural review committee. In the attached letter, dated 8 April 1991, from John Bonner, the applicant's attorney, he states his concerns with having Trivesco serve in this capacity. His letter also proposes a compromise solution. He suggests having Trivesco review the plans, but if they disapprove an independent architect would serve as an arbitrator. The City Attorney and I met with Mr. Bonner to discuss this proposal. Our concern with the way it is stated in the letter is that one individual would have veto power over three, defeating the purpose of having a committee in the first place. It was finally suggested that the compromise may be acceptable if Trivesco and Johnson both selected independent architects to arbitrate in the event plans were denied. This alternative is elaborated on in a letter from Mr. Bonner, dated 18 April. The mechanics for this type of arrangement can be formalized in the development agreement which is recommended for this plat. Shorewood, MN 55331 RE: Johnson's First Addition Preliminary Plat Dear Brad: After the Tuesday night meeting I had an opportunity to meet with Ron to discuss the possibility of arriving at a compromise position with respect to the issues regarding our participation in the Waterford Homeowners Association and its Architectural Review Committee. I have a proposal which I believe may be acceptable. First, however, I must state my disappointment over the rather inflexible and uncooperative attitudes displayed by our neighbors at the planning commission meeting. As you know, we have indicated a willingness to attempt to accommodate both the residents concerns and our own but, when one member of the planning commission asked whether or not the neighbors would be willing to work with us to arrive at a solution, the residents flatly refused, stating that it was "our problem." This, of course, places us in a difficult position. We would like to arrive at a reasonable solution which addresses my client's fears that Trivesco might, as a competitor, choose to unreaso- nably block development of our lots as well as the possibility that once Waterford is completely built, the Architectural Review Committee would consist only of residents and not professionals. While I have not developed any final language with respect to the pro- posal I have Mr. Johnson's authority to propose a concept which may serve as a basis for a compromise. We propose that the development plans would be submitted initially to the Architectural Review Committee and if the plans were approved no further approvals would be necessary. However, in the event the Architectural Review Committee chose not to approve the plans an independent architect would be selected to conduct a review whose decision would be final and . . This should give the existing residents some comfort and additionally I believe it will assist my client or any future builder in avoiding litigation over matters which deal exclusively with aesthetic concerns. I should mention that so far as I can determine from my review of the Ordinance, the City has no right whatsoever to impose a requirement that we adopt restrictive covenants as a condition of approving the plat. Shorewood, MN 55331 RE: Johnson ~ Property Dear Brad: Since our meeting Monday evening I have not had an opportunity to finalize documentation regarding the proposed covenants and restric- tions to be imposed regarding the above-captioned plat. However, I want the council to have an idea as to the types of restrictions we felt would be acceptable to my client so that they could at least consider these on a conceptual basis preparatory to the meeting scheduled for April 22, 1991. First, we are still prepared to go forward with a proposal that the property be subjected to the Waterford covenants and that the purcha- sers of the property belong to the Waterford group after the plans and specifications for construction of the home are approved. This of course would be subject to the agreement or approval of the Waterford group. I doubt that we could automatically join that group by simply electing to do so. Prior to construction of the home on any site, a buyer or builder would be required to initially submit the plans and specifications to Trivesco for their review. If Trivesco approved of the plans nothing further would be required. However, if Trivesco did not approve the plans or, if Trivesco no longer comprised the Waterford Architectural Control Committee, the plans would be subject to review and approval as follows: A. My client would designate within five days an architect to review the plan. Trivesco or the Architectural Control Committee would select an architect within five days. Those architects would meet and, if the two of them agreed that the plans and specifications called for construction of a dwelling which was architecturally com- patible or . . If however they were not able to agree, they would appoint a single architect whose decision regarding the plans would be final and binding on the parties. While I do not relish the thought of subjecting anyone to these requirements, I feel in view of the concerns expressed they are a reasonable way of accommodating our neighbors. I wish however to reiterate the fact that we do not believe that such restrictions could be legally required as a condition of the platting under the current ordinance. With respect to the balance of the issues addressed by my separate letter to you I believe they can be covered in conjunction with the drafting of language on a proposed development agreement. I simply wish to make certain that Mr. Johnson has adequate protection with respect to the property so that we do not find ourselves confronted with the claim that we had agreed to matters which we did not intend to agree to. This cost includes the actual construction costs, indirect costs such as engineering, administration, financing, etc., and easement acquisition costs. A special taxing district has been established to pay for the improvement. Under this arrangement, all 41 parcels within the district boundaries will share in the cost of the improvement on an ad valorem basis. Those properties having the highest tax capacities will pay more for the improvements than those having lower tax capacities. The cost per $1,000 in tax capacity is $3,298.24. I have estimated the cost per parcel and the annual payment at a 7.5% interest rate, with 5% coverage, over ten and fifteen year periods to give an idea of total costs. A spreadsheet is attached which shows these estimates for all parcels in the district. The per parcel costs range from $570.60 on the low end to $ 71,627.83 on the high end. The cost of one of the options, represented by Cost Estimate A, appears to be prohibitive. The other two options seem to be workable, as well as the more affordable, options. The project cost for each option is proposed to be spread equally against the benefitted properties. The costlier of the two options, represented by Cost Estimate B, includes bringing the road up to an urban section specification and involves a larger contribution of City road funds to build. The City Engineer feels that since this would upgrade the quality of the road, the project could be financed over a 15 year period. Cost Estimate C would restore the existing road and include an overlay of bituminous material. This option is less costly; however, since there is no permanent road improvement, the project would probably be financed over 10 years. Our original contract asked for a liability insurance policy in the amount of $1,000,000. These organizations have trouble handling this amount. I remember last year we had difficulty with this. I asked Attorney Froberg if we had to have this amount. He suggested contacting our insurance agent, and having the agent recommend an amount. I talked to Finance Director Rolek. Rolek said he felt $1,000,000 was very high. He contacted Ken Jarcho. Jarcho recommended at least $500,000. Some of these teams begin playing April 27. I understand that the building plans are now out for bids with an advertised opening date of May 13, 1991. Therefore, the landscaping portion of the project should be handled as an addendum to the building plans and should be out by no later than May 1, 1991. I have not seen copies of the specifications for the building so I am unsure of the total work effort necessary to add the landscaping portion of the project to the contract documents. As a result, I am estimating that the total cost of the landscaping plans and specs will run from $800.00 - $1,000.00. I do not anticipate a problem completing the plans by May 1, 1991. I appreciate the opportunity to provide this estimate for continuing professional services to the City of Shorewood.
