Following are very brief summaries of the items listed on the above-referenced agenda. For
more detail please refer to the individual staff reports contained in the Council information
packet.
Item 3A. Visu-sewer has completed the 1990 sewer televising/cleaning/repair authorized for
City Project 90-1. The City Engineer has reviewed the data submitted, and recommends a
final payment of $1031.44, which represents the final retainage of 5%. This fmal payment
will bring the total to $20,628.72, as compared to the original contract amount of
$25,555.95. The workshop scheduled for 6:30 will include a selected portion of the
videotape from this project. jad
Item 3B. The bid opening for this project is scheduled for Thursday, April 4, 1991. The
bidders list and recommendation will be prepared for the meeting on Monday night. jad
Item 3C. The City has been requested to contribute to the Hennepin County Fair. The
Finance Director informs us that $50 was budgeted for this purpose for 1991. ajr
Item 6. Cellular One has been unable to strictly comply with the requirements of Resolution
17-90 regarding the installation of antennas on the SE Area water storage tank. Specifically,
they have not been able to obtain formal approval from the tank's designer, Chicago Bridge
and Iron (CBI). Based on information from CBI and a review of the project, the Engineer is
willing to accept the antenna construction with other safeguards and recommend an
amendment to the resolution. jad
Item 7. A gazebo was built at 27010 Edgewood Road without a building permit. Upon
investigation it was found that there are currently two dwellings on the subject site,
constituting a nonconforming use. Since the Zoning Ordinance prohibits the expansion of a
nonconforming use, the owner applied for a variance to keep the structure. The Planning
Commission recommended that the variance be denied. When the City Council reviewed the
case they referred it back to the Planning Commission for review of the provisions which
govern nonconforming uses. The Planning Commission reviewed the Code, determined that
it was very important to control nonconforming uses, and recommended that it should not be
changed.
In addition to the recommendations of the Planning Commission and Planning Director, the
City Attorney expresses serious concerns over the precedent which this case may set, and its
effect on a similar case currently in litigation. bjn

Item 8. Ron Johnson proposes to plat three lots which will front on Waterford Circle. Staff
has stressed the importance of ensuring that homes built on these lots be consistent with the
existing homes on the street. While the applicant agrees to conditions similar to the
restrictions which exist for homes in Waterford, he objects to being subject to Waterford's
architectural review committee. Understandably, residents on Waterford Circle want
assurance that their property values will be protected. The Planning Commission
recommends that the preliminary plat be approved, subject to a number of conditions, one of
which is that the new lots be subject to the same covenants and restrictions that exist for
Waterford. bjn
Item 9. Preliminary grading plans have been previously prepared for the future Public
Works Dept. site. These plans were prepared with a larger area involved than is currently
available, and will need to be revised for a final plan. An excess of excavated soil is .
probable with the limited site under consideration. Should the soil from this excavation be
undesirable from an engineering standpoint, the cost of disposal could be high. To determine
the soil type, it is estimated that $2000 will have to be spent for soil borings. jad
Item 10. A public hearing is required to hear citizens' comments on the use of CDBG
funds by the City of Shorewood. The City participates in the CDBG program through
Hennepin County. All CDBG functions are administered through the County, and funds are
distributed as designated by the City. The City has received a request for CDBG funding
from the South shore Senior Center for $6,233, a 5% increase over 1990. The remainder of
the City's $23,362 CDBG allotment, $17,129, is proposed to be designated for rehabilitation
of private property for low- and moderate-income families. It is recommended that the City
Council adopt a resolution, included in the packet, participating in the Hennepin County
CDBG Program and designating its funds for the 1991 allotment as listed in the resolution.

Item 11. Trivesco has requested a six month extension for submitting the final plan for the
third phase of Waterford. Although staff feels the request is warranted, the fmal plan must
be submitted within the next 30 to 60 days in order for the project to proceed. bjn
Item 12. The Excelsior Chamber of Commerce has requested that Shorewood proclaim May
18 - May 25 as International Special Olympics Week. Staff recommends that the Council
adopt the resolution provided in the packet. bjn

Item 14C-1. Having determined that Freeman Park would not be used as a drop-off site for
Shorewood's annual Spring Cleanup, the Council directed the staff to explore the possibility
of a curbside pickup. Not having done this before, there are a number of issues which must
be resolved by the Council (e.g. what items will be collected?, how will the cleanup be
charged?, how long will it take to collect the entire city?, etc.). The Council will also be
asked to consider rescheduling the cleanup to early Fall and using the new Public Works site
for collection, assuming an access road can be graded in time. bjn
Item 14C-2. The consultant to the Senior Housing Study Task Force suggests a joint
meeting of the Council, the Task Force, and the Planning Commission to discuss informally
the preliminary results of their study. Tuesday, 21 May has been suggested as the date for
the meeting. bjn

UPDATED FEASIBILITY REPORT -
GLEN ROAD DRAINAGE PROJECT
RESOLUTION NO. 31-91
Acting City Administrator Nielsen informed the Council that the
Engineer has updated the feasibility report for the Glen Road_drainage
project.__He said the updated report makes better use of the
topography of the site and will result in less site alteration.
Nielsen said the Staff suggests the Council call another public
hearing for all affected property owners.
Stover moved, Lewis seconded to adopt RESOLUTION NO. 31-91 "A
Resolution Accepting the Updated Feasibility Report for the Glen Road
Drainage Project and calling a Public Hearing tor April 22, 1991."

S. E. AREA WATER TREATMENT PLANT
A. Approve Plans and Specifications and Direct Notice to Bidders
(Plans and Specifications Availabl~ for Review at City Hall)
Noel Vogen. Associated Consultants. presented the plans for the S. E.
Area Water Treatment Facility. He said the plant will be a 1000 GPM
pressure filter system. The pipe will be expanded and the iron is
oxidized and is then filtered. The water can be chlorinated at this
point. There is a periodic backwash in the system.
He consulted with the Park Commission and they suggested the building
be redesigned to make it more obscure. The building will be dug into
the hill and be constructed of rock face concrete block. Railings
will be added to the retaining walls for safety.
Lewis asked if there was any attempt to match the existing building.
Vogen said they tried to make the building blend in with the
surroundings.
Lewis said the building is too large to be obscure and when Silverwood
Park is developed the building will be very visible.
Stover suggested they show the plans to the neighbors.
RESIDENT - MRS. VOGEL asked who would pay for the sludge that is
pumped into the sewer from the water treatment plant.
Stover said the City pays.
Brancel said there is no definite charge per gallon of water used.
Nielsen said the sewer flow is estimated because not all residents are
on City water.
Vogel said she would like to see some figures indicating the increase
in flow.
Lewis asked Vogen is he could get the figures. Vogen said he would.

treatment facility until the plans can be shown to the neighborhood
and the construction and other matter discussed.

Nielsen asked if the City should send out notices.
Lewis said the Staff should do that within 10 days and he would
discuss the time and place with Nielsen. Vogen will be present to
present the material.
FEASIBILITY REPORT -
PINE BEND WATERMAIN EXTENSION
RESOLUTION NO. 32-91
Engineer Dresel estimated the cost at $4800 per household and that
includes the use of some street funds.
Stover moved. Daugherty seconded. to adopt RESOLUTION NO. 32-91 "A
Resolution Receiving the Feasibility Report on the Pine Bend Watermain
Extension and calling for a Public Hearing on April 22. 1991.11

SHADY HILLS DRAINAGE PROJECT - PROPOSED LOT LINE ADJUSTMENT
Nielsen said the residents of Shady Hills whose property abuts the
drainage pipe wish to have the City approve a minor lot line
adjustment in exchange for the necessary easements for the drainage
project.
The Staff proposes the City initiate the lot line adjustment and
schedule it for review by the Planning Commission at their April 2nd
meeting.
Stover moved. Lewis seconded. to approve initiating the lot line
adjustment for the Shady Hills Drainage Project and send the matter to
the Planning Commission for review.

FREEMAN PARK PUMP HOUSE
Nielsen the Staff had considered a new design for the roof of the
Freeman Park pump house. The roof will be a standing seam. steel roof
with a slight pitch. It will not look very different from the
previous design but will keep the building within the $2000
established by the Council.

CHURCH ROAD IMPROVEMENT PROJECT - R.O.W. ACQUISITION
Nielsen said he and City Attorney Froberg met with Mr. Dale Johansen
and Mr. Johansen agreed to sell his lot at the end of Church Road for
$23.000 with the provision that the City be responsible for abandoning
the well on the property.
Nielsen said the State of Minnesota will require the well to be
abandoned at a cost of $300 to $600.
City Attorney Froberg said the seller has accepted the City's offer.
He will provide a warranty deed. abstract of title. The seller will
pay real estate taxes for_1991. He will payoff the balance on the
current mortgage and will pay the filing fees.
Daugherty asked how the value of the land was determined and if it was
in line with values in the area.
Froberg said a professional appraisal was obtained.
Nielsen said the feasibility reported valued the lot at $24.000.
Lewis asked if there will be any additional expense for the well
abandonment and what is involved in abandoning the well.
Nielsen said the pipe has to be pulled and the hole filled by a
licensed well driller or supervised by one.
Froberg said the City must obtain a permit from the State if the well
is not sealed before the closing.
Stover moved, Daugherty seconded. to approve the agreement to purchase
the property of Dale Johansen and to set a closing date for the date
the well is capped, providing the cost to the City for capping the
well does not exceed $600.

STREET LIGHT REQUEST - WOOD DRIVE/HIGHWAY 7
Nielsen said NSP has informed the City that there is no power
available to the location for the Street Light on HwY 7 and Wood
Drive. He said the policy is to pay for the monthly electric bill for
the light but not any other costs.
The Council agreed to keep the current policy and to inform the
petitioners that they must pay to have the power provided to the site.

Nielsen said he has decided not to pursue recertification as a
Building Official. He recommends the City appoint Joe Pazandak as
Building Official for the City of Shorewood. He said Pazandak has a
Class II certification.

Froberg said he had no report except what would be discussed in
the Executive Session.
B. ENGINEER'S REPORT
Dresel said he has two tapes the Council might want to view. One
tape was narrated by Mike Fairbourne and concerned pavements.
The other tape was the sewer video.
Brancel suggested the Council view the tapes 1/2 hr. prior to
their next meeting.
C. PLANNING DIRECTOR'S REPORT
'Nielsen said the RFPs for Engineer and Attorney will be due the
week after the new Administrator takes office, about May 1. He
said the new Administrator should be involved in the discussion.
He asked the Council how they felt about this.
Daugherty and Stover agreed with him.
Brancel and Lewis did not think it was necessary to wait.

Lewis reported on the Task Force for the Old Market Road. He
would like to have Benschooft & Associates do a report on the
intersection.
Stover asked if a task force has been appointed. Lewis said
Jim Berdahl has been appointed Chairman.

Lewis said no clear consensus was reached on who should be
appointed. He said there have been volunteers.
Stover said the Council usually appoints the people on a task
force.
Brancel asked for a list of people. Lewis said he does not want
to delay the implementation of the task force.
Brancel does not want to spend money for the task force until
Trivesco actually starts the project.
Daugherty said the project should include a study of the traffic
problem in the entire area.
Lewis said the Task Force goal should be to alleviate concern
that Old Market Road will become a collector street.
Lewis moved, Daugherty seconded, to approve $3000/$4000 budget to hire
Benschooft & Associates to study the traffic conditions at Old Market
Road contingent upon Trivesco purchasing the bonds for the Waterford
III project.
Motion carried - 4/0.
E. COUNC I !.MEMBER DAUGHERTY
Daugherty asked Brancel if there has been an meeting between the
Police Dept. and the snowmobile group. Brancel said the meeting
is set for April 10th.

The Council adjourned to Executive Session at 8:13 P.M. to discuss the
pending Kennelly litigation.

RESOLUTION NO.
A RESOLUTION ACCEPTING SEWER TELEVISING AND REHABILITATION WORK
PROJECT 90-1
WHEREAS, on 22 October 1990, the City accepted the bid of Visu
Service Clean & Seal, Inc. (the Contractor) and entered into an Agreement
for certain sewer televising and rehabilitation designated as Project
90-1, and
WHEREAS, said Agreement provided for' the Contractor to perform
certain sewer televising and rehabilitation work in accordance with the
plans and specifications prepared by the City Engineer; and
WHEREAS, said work has now been completed by the Contractor, as
further described in that certain memorandum of the City Engineer
dated , attached hereto as Exhibit A.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the city of
Shorewood as follows;
1. That the City hereby accepts from the Contractor the sewer
televising and rehabilitation work desiqnated as Project 90-1.
2. That final payment be made to the Contractor upon receipt of
Affidavit, State of Minnesota Form lC-134, and Receipt and waiver of Lien
Rights from Visu Service Clean & Seal, Inc.

WHEREAS, pursuant to an advertisement for bids for local
improvements designated as Modifications to Lift Stations No. 5 and 6,
Project 91-3, bids were received, opened on , and tabulated
according to law, such tabulation is attached hereto and made a part hereof
as Exhibit Ai and
WHEREAS, the City Council has determined that
is the lowest responsible bidder in compliance with the specifications.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Shorewood as follows:
1. That the Mayor and City Clerk are hereby authorized and directed
to enter into a contract with in the name of the City of
Shorewood, Project No. 91-3, according to the plans and specifications
therefor approved by the City Council on file in the office of the City
Clerk.
2. That the City Clerk is hereby authorized and directed to return
forthwith to all bidders the deposits made with their bids, except for the
deposits of the successful bidder and next lowest bidder, which shall be
retained until a contract has been signed.

CONTRIBUTION TO HENNEPIN COUNTY FAIR
Each year for the past several years the Hennepin County Fair Board
has requested a contribution from the City to be used towards
operating costs for the County Fair. City Council has annually
budgeted an amount as a contribution to the Hennepin County Fair.
The Fair Board has once again requested a contribution from the
City for the 1991 fair. The Council budgeted $50 in 1991 for this
purpose.
It is recommended that the City Council approve the contribution of
$50 to the Hennepin county Fair for 1991.

We are planning the Hennepin County "Olde Tyme" Fair
for July 25-28 at the Corcoran Lions Park, located at the
crossroads of Bass Lake Road and Hwy. 101, in Corcoran.
We are hoping for an even bigger and better (and definitely
drier!) fair this year.
The fair will again resemble an old fashioned county fair,
with a rural setting featuring brightly striped tents, demolition
derbies, moto-cross races, live entertainment, exciting midway
rides, open class and 4H exhibits, animals, and much more. A
competition between mayors of cities in Hennepin County is being
planned, reminiscent of early fairs in the County, when mayors of
the municipalities competed in a Jalopy Race.
In order to have a successful fair, we really do need your
support. Financially, last year was a disaster for us, with 12
inches of rain in one night drastically reducing attendance.
We respectfully request a donation from your city to help support
your citizens' County Fair.
In addition, we request your cooperation in informing your
citizens that, yes: Hennepin County does have a county fair!

city's newsletters, newspapers, utility billings, etc.

HENNEPIN COUNTY FAIR PLANNING, SPACE RENTAL, BEGINS
The Hennepin County "Olde Tyme" Fair will be held July 25 - 28

As you are aware, we sent a letter to Mr. Ted Broich of Cellular One Corporation on
February 27, 1991 stating several conditions prior to our issuing a final occupancy permit
for the antennas on the Shorewood water tower. These two conditions were:
1. A final inspection needed to be performed.
2. In accordance with the Resolution and Construction Agreement previously signed
with Cellular One, we requested an approval letter from Chicago Bridge and Iron
(CBI) stating that the proposed antenna changes posed no threat to the water
tower itself.
Since that time, Cellular One has attempted to gain this approval from CBI. However, it
is becoming evident that CBI is unable to give such a letter for legal reasons. In a letter
to Cellular One from CBI dated March 13, 1991, Mr. Steven Meier stated that AEC's
proposed design and details were of good engineering practice, and suitable for the type
of structure proposed. They further went on to state that the proposed modifications
would not be detrimental to the tank or impair its function, assuming the modifications
were properly installed. However, they fell short of giving full acceptance to the proposed
plans. We have enclosed copies of both the February 27th and March 13th letters for
your reference.
Based on the letter from CBI and our review of the project, it is our recommendation that
the City amend their Resolution to allow the acceptance of this project based on AEC's
engineering design, provided that it is signed by an engineer registered in the State of

This letter will serve to summarize the status of the occupancy permit of the referenced
antennas. A temporary occupancy permit was issued on December 26, 1990 with un
expiration date of June 1, 1991. Issuance of the final permit is contingent upon approval
by the City Engineer. To be able to grant our approval in conformance with City
Resolution No. 17-90, several issues need to be addressed.
. First, a final inspection will need to be performed. We suggest a combined inspection by
ABC and city staff followed by a letter of substantial completion by AET. As we are
already aware of a sodding problem from last fall, we recommend that this final inspection
be performed in late spring. We will, however, leave the timing to your discretion.
Secondly, in accordance with the above Resolution and the Construction Agreement, we
have repeatedly requested an approval letter from Chicago Bridge and Iron (CBI) stating
that the proposed antenna change poses no threat to the water tower itself. This
information has been requested of Mr. Glen Gauger during several telephone conversations
dating back to January 9, 1991. Though this is not the responsibility of the City, we
contacted CBI on February 21, 1991 at the request of Mr. Gauger. We were informed by
Mr. Steve Meier of CBI tbat Mr. Robert Wozniak, the previous project manager for the site,
had retired and that it could be some time before CBI could analyze and report on the
antenna installation. Mr. Meier suggested that since Mr. Wozniak was still consulting for
CBI, perhaps Cellular One could contact Mr. Wozniak directly for the requested approval.

This information was relayed to Mr. Gauger by telephone on. February 22, 1991, at which
time we agreed to write thi~ summary letter; The possibility of having AEC provide the
approval letter instead of CBI was also discussed on February 22nd. We can understand
Cellular One's desire to have ABC rather than CBI involved, as it appears it would save

considerable time. However, the city resolution specifically requires "approval from the
tower manufacturer, Chicago Bridge and Iron". We do not deem it necessary to pursue
alternate avenues until Cellular One has expended every effort to gain CBl's approval.

A RESOLUTION APPROVING AN AMENDMENT TO THE
WATER TOWER ANTENNA SITE CONSTRUCTION AGREEMENT
WHEREAS, the City Council of the City of Shorewood ("the City")
by its Resolution No. 17-90 on February 26, 1990, approved a water tower
antenna site construction agreement with A C C /McC A W Cellular of Minneapolis
(the "Contractor") and authorized the Mayor and City Clerk to execute said
Agreement on behalf of the City; and
WHEREAS, such Agreement was duly executed by the Contractor and
the City on March 1, 1990; and
WHEREAS, the parties now wish to amend paragraph 3 of such
Agreement to provide for a different Antenna Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Shorewood as follows:
1. That the Amendment attached hereto amending the Water Tower
Construction Agreement, dated March 1, 1990, is hereby approved, subject
only to approval by the the City Engineer.
2. That the Mayor and City Clerk are hereby authorized to
execute said Amendment on behalf of the City Council.
3. That REsolution No. 66-90, passed by the City Council on 23
July 1990, entitled, "A Resolution Approving An Amendment to the Water
Tower Antenna Site Construction Agreement", is hereby rescinded.
ADOPTED BY THE CITY COUNCIL OF THE CITY OF SHOREWOOD this

In August of 1989 Mr. Herb Mason applied for an after-the-fact variance and building permit
for.a gazebo built illegally on his property, located at 27010 Edgewood Road (see staff report
attached, dated 26 September 1989, copied in yellow). When the City Council reviewed the
request, they considered granting the variance subject to the applicant demolishing a
nonconforming shed also located on the site. Rather than grant the variance, however, the
Council referred the matter back to the Planning Commission for review of the Zoning
Ordinance provisions pertaining to the expansion of nonconforming uses of property .
The Planning Commission reviewed the Code and voted unanimously to leave the provisions
as currently written. They recommend that it is extremely important to maintain control over
the use of land in Shorewood, particularly in residential areas, and particularly with respect
to nonconforming uses of land.
Their position was reiterated at their 2 April meeting, at which they invited the new members
of the Council to meet with the Commission to discuss zoning in general, and variances in
particular .
In addition to the recommendations of this office and the Planning Commission, the City
Attorney has serious concerns regarding the precedent this case may have on a very similar
one currently under litigation. His report will be sent under separate cover.

BACKGROUND
Last month it was discovered that a 12' x 12' gazebo was being built, without
~ puilding permit, on property located at 27010 Edgewood Road (see Site
Location map - Exhibit A, attached). When one of the owners, Mrs. Herbert
Mason, came in to apply for a permit, she was advised that a permit could not
be issued because the Zoning Ordinance prohibits the expansion of a
nonconforming use of property. The use of the property is nonconforming
because there are two single-family dwellings on one lot. Further
complicating matters, the structure in question was built too close to the
side lot line (see Exhibit B). Rather than remove the structure, Mr. Herbert
Mason requests variances on behalf of his wife to allow the structure to
remain. His request is explained in a letter, dated 6 September 1989 (see
Exhibit C).
The subject property is zoned R-1C, Single-Family Residential and is also
subject to the requirements of the S, Shore land (overlay) District. As
mentioned the site is occupied by two homes, plus a small accessory building
located on the south end of the lot. As can be seen on Exhibit B,none of
the buildings conform with the requirements of the R-1C district with regard
to setbacks. The northerly house is eight feet too close to the lake and
more than seven feet too close to the side lot line. The southerly house is
only 5.7 feet from the side lot line and the shed is too close to both the
front of the lot and side of the lot. The lot itself is substandard for the
R-1C/S zoning district. It measures approximately 78' x 225' and contains
17,550 square feet of area.

ANALYSIS/RECOMMENDATION
A. Nonconforming Use vs. Nonconforming Structure.
In reviewing this request it is important to recognize the distinction
between nonconforming structures and a nonconforming use of property.
Nonconforming structures are those which were built prior to existing
size, height or setback requirements, which in one way or another do not
comply with current dimensional requirements. All of the buildings on
the property in question are examples of nonconforming structures in that
they do not conform with current setback requirements.
A nonconforming use is a land use or activity which is not allowed and is
not considered acceptable in the district in which it is located.
Section 1201.03 Subd. 2.c.(4) of the City Code specifically prohibits
having more than one principal building on a lot. The subject site
currently contains two principal buildings.
Section 1201.03 Subd. 1 of the Code distinguishes nonconforming uses from
nonconforming structures.
"a. Purpose. It is the purpose of this Section to regulate
nonconforming structures and uses and to specify those
requirements, circumstances and conditions under which
nonconforming structures and uses will be operated and
maintained. The Zoning Ordinance establishes separate uses which
are permitted in that district. It is necessary and consistent
with the establishment of these districts that nonconforming
structures and uses not be permitted to continue without
restriction. Furthermore, it is the intent of this Section that
all nonconforming uses shall be eventually brought into
conformity.
b. Any structure or use lawfully existing upon the effective date of
this Ordinance shall not be enlarged, extended, or structurally
altered, but may be continued at the size and in the manner of
operation existing upon such date except as hereinafter specified
or, subsequently amended.1I
Although both nonconforming structures and uses are IIgrandfathered inll
(allowed to be continued at the size and in the manner of operation
existing at the time the zoning ordinance was adopted), the Code does
allow nonconforming single-family homes to be expanded, provided the
nonconformity is not increased. This provision does not extend to
nonconforming uses (It... Furthermore, it is the intent of this Section
that all nonconforming ~ shall be eventually brought into
conformity.II).

B. Variances.
While the applicant's letter apologizes tor building without a permit, it
does not explain how they can not make reasonable use of the property
without the variances. In fact, given the existence of two homes on one
lot, it can be stated that their use of the property is more than
reasonable.
Section 1201.05 Subd. 2.b.(4) states:
"(4) Granting the variance requested will not confer on the applicant
any special privilege that is denied by this Ordinance to other
lands, structures, or buildings in the same district."
Allowing the expansion or extension of a nonconforming use in this case
would confer a special privilege on the applicant which has not been
extended to others. There are several nonconforming uses which have been
denied permits to expand in the past. Examples are: 1) enlargement' of
two-family dwellings in single-family zoning districts; 2) expansions of
nonconforming commercial uses (e.g. marinas); and 3) construction on
nonconforming billboard sites. If unwarranted variances are granted, a new
precedent is established which is not only contrary to the stated purpose
of the Code, but could also diminish the City's control over nonconforming
uses.
I~'view of the preceding the variance is not recommended. It is suggested
that the applicant be required to remove the structure no later than 15
November 1989.

Enclosed is an application for a variance for the construction of a
gazabo styled screen porch.
Mrs. Mason~ in preparation for a lawn reception for our daughter and
son-in-Iaws recent marriage, went ahead with the construction of this
porch without the knowledge of the requirement for a building permit.
For this~ we are both sorry. I was unaware of the construction at the
time. We have been separated for many years.
Also enclosed is a plat showing property lines as well as all buildings
on said property.
Building plans are not to fancy but I hope they will be adequate.
The mailing list of all owners for a radius of 500 feet is also enclosed
along with all of their mailing addresses.
Had I been involved with this structure~ I would have known to go
for a permit, however; I would not have interpreted the need for more
than the seventeen and one half feet that we have from our property
line on the west to the structure.
Also enclosed are letters from the six nearest homeowners expressing
their feelings to the style and location of the gazabo. Please consider
these letters in making your decision in this matter.
The building is designed to tie into our deck off of the back door and
is structured of like materials used in the exterior structure of the
house.
It's difficult to give an explanation for a need for a screen porch
but a frequent visitor to Mrs. Mason's home is our son-in-law who
has a severe allergy to bee stings. With her flowers around the property
there are bees.
I would like to request the planning commission and the council to consider
a visit to the property to personally observe the location and elevation
of the porch.

BACKGROUND
In July of 1988, the City approved a rezoning and preliminary plat for 20 acres of land
located on the west side of Vine Hill Road, between Shady Hills and Waterford (see staff
report, dated 27 June 1988, copied in yellow).
The owner, Mr. Ron Johnson, did not seek fmal plat approval at that time for reasons
stated in a letter from his attorney (Exhibit A, attached), dated 19 February 1991. Mr.
Johnson's attorney now proposes alternative solutions to the two requirements with which
they originally took exception, and requests preliminary plat approval.
The proposed plat is the same as what was approved in 1988. The previous staff report
serves as background for this request.
ANALYSIS/RECOMMENDATION
The applicant's attorney is concerned with two of the conditions of the preliminary plat
which was approved in 1988: 1) dedication of wetlands; and 2) imposition of the Waterford
protective covenants on Mr. Johnson's property.
1. Wetland Dedication. Much of Mr. Johnson's property is designated wetland area.
The way the property is proposed to be platted (three lots, with the remainder of the
property as an outlot) the wetland area is part of the outlot. There is precedent for

acquiring the wetland at such time as the outlot is replatted. This was done in the
Near Mountain P.U.D. Wetlands were dedicated with each phase of platting.
It is recommended that the wetland be dedicated at such time as the northwest corner
of the site is platted.
2. Protective Covenants. Apparently the applicant does not object to covenants and
restrictions similar to those which exist for Waterford. He does, however, object to
being part of the Waterford Homeowner's Association and being subject to
Waterford's Architectural Review Committee.
To address the staff s and residents' concerns that homes built on the three lots be
consistent in quality and character to those which exist on Waterford Circle, he has
suggested two possible solutions: .
a. An architectural review committee consisting of three independent
architects, possibly professors of architecture from the University of
Minnesota; or
b. Have Shorewood's Planning Department review predetermined architectural
controls prior to issuance of building permits for the three lots.
Having discussed these alternatives with the City Attorney, it is not recommended that
the City be involved in the architectural review committee. While an independent
committee of design professionals is considered reasonable, the approval of the plat
must establish a mechanism for requiring the future property owners to pay for the
architectural review.
As part of the final plat for this property, the applicant should be required to provide
proposed covenants and restrictions, including criteria for architectural controls.
As a final note, the applicant does not object to being subject to Waterford
architectural control for future additions and improvements.
Based upon the preceding it is recommended that the preliminary plat be approved subject
to the following conditions:
1. Front setbacks for the three lots should be maintained at 35 feet.

2. The resubdivision sketch should be used as a guide for future development of the
property. Any future divisions should be done as formal plats. No development
should be allowed on Outlot A unless it is replatted.
3. At such time as the northwest comer of the property is platted, the applicant must
dedicate the designated wetland area, or a drainage and conservation easement over it,
to the City for protection of the wetland.
4. Drainage and utility easements must be provided 10 feet on each side of each side and
rear lot line.
5. Prior to final plat approval, the developer should provide a detailed grading plan for
the three residential lots. Grading and drainage should be subject to the review and
approval of the City Engineer and Watershed District.
6. The City should require that homes built on Lots 1-3 be engineered to fit the sites.
7. The applicant must pay park dedication fees totaling $2250.
8. The applicant must submit a final plat within six months of preliminary plat approval.
As part of the final plat he must submit proposed covenants and restrictions, similar
to Waterford's, for review and approval by the City.

Dear Members of the City Council and City Planning Commission:
I represent the applicant in conjunction with the above-
referenced subdivision application. Mr. Johnson is a long time
resident of the City of Shorewood.
In 1988 an application for subdivision of this property was sub-
mitted and approved. The subdivision which was proposed is iden-
tical to the subdivision requested today.
The City however, in conjunction with the prior application,
imposed conditions regarding the portion of the wetlands outlot
which I could not advise my client to accept. In addition, the
City sought to impose requirements regarding architectural
controls which I could not recommend. As a result, the plat was
not filed and I have, over the past year or two discussed these
issues with the City Planning Department.
We now believe that we have agreement that the wetlands issue
need not be addressed at this time.
We also have proposed that the newly platted lots be subject to
architectural controls which would permit the City of Shorewood
by its Planning Department to determine whether or not the plans
for a home to be built on a lot are architecturally compatab1e
with existing housing in the Waterford development. However,
after construction of the home we propose that the lot be subject
to the same architectural control requirements which affect other
lots in Waterford with respect to improvements.
It is our hope that this information will be of assistance to you
in considering my client's request.

BACKGROUND
Mr. Ron Johnson has requested approval of a preliminary plat to subdivide
approximately 20 acres of land which he owns on the west side of Vine Hill
Road. between the Shady Hills area and the Waterford development (see Site
Location map - Exhibit A. attached). He proposes to divide off three lots
along the south edge of the site. leaving the remaining portion of the
property as an outlot (see Exhibit B). Since the lots are smaller than the
current R-lAzoning of the property allows. he has requested that the site be
rezoned to R-1C. Single-family residential.
Land use and zoning surrounding the site are as follows:
north - single-family residential. zoned R-1C
west and south - single-family residential. zoned P.U.D.
east - single and multiple-family residential (Minnetonka).

B. Zonin~ Requirements.
1. Lot Area. The three residential lots being proposed as part of this
plat are consistent with the minimum. lot size for the R-1C zoning
district (20,000 square feet). Furthermore the lots are consistent
with the lot sizes in Waterford and Shady Hills (lot sizes start at
20,000 square feet in area).
2. Lot Width and Depth. All lots meet or exceed the 100 foot width and
120 foot depth requirements of the R-1C district.
3. Setbacks. The applicant's plat shows building pads located 30 feet
from the street. The R-1C district requires a 35 foot setback. While
some variance may be justified due to the severe topography and depth
of sanitary sewer, the developer's grading plan, to be submitted as
part of the final plat, should strive to maintain the 35 foot minimum
setback.
C. Subdivision Requirements. There are two significant issues which should
be addressed relative to subdivision requirements, 1) future development,
and 2) designated wetland.
1. Future Development. Since the three lots represent only a small
portion of the total site, the City must be concerned with how the
remainder of the land might be developed in the future. At the
request of this office the developer has prepared a resubdivision
sketch (see Exhibit C) showing how the northwest corner of the
property could be developed into four lots. Two additional lots are
shown in the southeast corner of the site.
While the two southeasterly lots can be served directly by Vine Hill
Road, the four northwesterly lots require access through one or more
vacant lots located in Shady Hills. The plan shown on Exhibit C
requires acquisition of Lots 5, 6 and 7, Block 4, Shady Hills. It
demonstrates the difficulty in developing the northwest corner of the
property.
The sketch also shows that the three lots will not impact future
development of the property.
2. Designated Wetland. More than one half of the subject site is
occupied by a designated wetland (see Exhibit D). This area should be
shown on the preliminary plat and set aside as an outlot. separate
from the buildable areas in the northwest and southeast corners of the
property. Section 1102.06 of the City Code (Wetland Ordinance)
requires that an easement be granted to the City over the designated
wetland.

3. Grad;ng, Drainage and Utilities. Given the severe topography on Lots
1-3, it is recommended that a detailed grading plan be prepared prior
to the final plat. The plan should show the proposed building pads
and access drives and should demonstrate how the grading of "the three
lots will tie into the adjoining lots in Waterford.
Considering that the proposed building pads are 25 feet above the
wetland area, drainage is not anticipated to be an issue.
Nevertheless, drainage, as well as grading, must be subject to review
and approval by the City Engineer and the Purgatory Creek Watershed
District.
Utilities are not anticipated to create a problem. The sewer in
Waterford Place was constructed deep enough to accommodate the future
lots. It appears that four service stubs have been provided for the
property in question from Waterford Circle.
4. Park Dedication. Considering the proximity of the site to Silverwood
Park, it is assumed that the City will require cash dedication in lieu
of land. The total amount of park dedication fees for the three lots
is $1500 ($500 per lot).
D. Outlot C, Waterford. The plat depends upon the developer's acquisition
of Outlot C from Trivesco. You may recall that the development agreement
for Waterford requires Trivesco to convey Outlot C to the owner of the
property to the north (Mr. Johnson) for an amount equal to three street
and sewer assessments. Exhibit E contains an excerpt form the Waterford
development agreement.
While the agreement specifies the amount which can be charged for the
outlot, it does not specify any other conditions which may be imposed.
Since the other lots which have been developed on Waterford Circle .were
subject to protective covenants and restrictions, it is assumed that Lots
1-3 of the Johnson First Addition will be subject to the same covenants.
This should be encouraged by the City to preserve property values of
homes already built on Waterford Circle.
RECOMMENDATION
Based upon the preceding analysis, the developer's proposal is considered to
be consistent with Shorewood's Comprehensive Plan and development
regulations. It is therefore recommended that the rezoning be approved. It
is also recommended that the preliminary plat be approved subject to the
following:
1. Front setbacks for the three lots should be maintained at 35 feet.
2. The resubdivision sketch should be used as a guide for future development
of the property. Any future divisions should be done as formal plats.

that certificates of occupancy shall not be issued until
utilities have been approved and accepted by the City. The
City may, however, issue certificates of occupancy prior to the
final acceptance of the street, providing all other utilities have
been installed and accepted. .
13. The Developer shall provide copies of all covenants,
easements, and restrictions and other documents relating to the
project which shall be reviewed and approved by the City
Attorney prior to the commencement of construction for Phase One.
14. The Developer shall provide copy of Articles of Incorpora-
tion and By-Laws of the Homeowners Association for review and
approval by the City prior to commencement of construction. The
Homeowners Association need not invo+ve the owners of the single
family lots if no common ownership of property is involved,
except Developer shall make provisions for the permanent care and
maintenance of any identifying monuments located at the entrance
to the project.
15. The City, its agents and employees, shall not be personally
liable or responsible in any manner to the Developer, the
Developer's contractors or subcontractors, material men, laborers,
or to any other person, firm, or corporation whomsoever, for any
debt, claim, demand, damages, action, or causes of action or any
kind of character arising out of or by reason of this agreement
of the performance of the work and improvements hereunder; the
Developer shall save the City, its agents, and employees harmless
from any and all claims, damages, demands, actions, or causes
of action arising therefrom and the costs, disbursements and
expenses of defending the same, except for any work performed
by the City.
16. Developers agree to hold Outlot C for the use of the
property to the north to provide access to the property to the
north and agree to sell Outlot C to the owners of the property to
the north in the amount of.$60,OOO (representing three sewer
and street assessments), plus accrued interest from the date of
said sale.

Re: Preliminary Grading Plans for a Salt/Sand Building

Dear Mr. Nielsen:
As requested, we have reviewed the status of the referenced salt/sand storage building
and site. We have previously prepared a preliminary grading plan based on the August
8, 1990 layout by the City Planning Department. This grading plan includes the adjoining
parcel to the east (ultimate development), and needs only slight adjustment to obtain a
balance of earthwork. However, it will need substantial adjustment to proceed with only
the westerly half of the proposed project.
With regards to the proposed building, we have received and reviewed a copy of
MnDOT's "1989 Salt Handling Report". In addition, we have received the plans for a
MnDOT building that they are using for their storage. These buildings are based on either
100 or 340 ton multiples for any ton storage required, with approximately 2,000 tons of
storage required for the City of Shorewood. However, these MnDOT buildings are not
permissible in Shorewood due to existing zoning regulations. Because these MnDOT
buildings will not work, we have laid out a preliminary type and size building that is
consistent with the existing zoning ordinances.
At this time, it is our understanding that the City wishes to complete the grading for the
westerly portion of the site. Modifying the existing plan would be fairly inexpensive, and
construction bids are currently running on the low side. However, without the benefit of
the lower area on the easterly portion of the site, we would probably generate an excess
of soil. If this soil is granular in nature, it may be that the City could sell a portion of it.
However, if it is not granular, it could be very difficult and costly for the City to dispose
of it. To determine the type of material existing in this excavation area, we have obtained
a cost estimate for soil borings in the amount of $2,000. These soil borings would be
located to permit their use during the design of the salt/storage buildings.

PUBLIC HEARING - ALLOCATION OF CDBG FUNDS
The City of Shorewood participates in the Federal Community
Development Block Grant Program through Hennepin County. The
County actually receives the CDBG funds and distributes them as the
City directs. The City must hold a public hearing on the
allocation of these funds and pass a resolution agreeing to
participate in the Urban Hennepin County CDBG Program and
requesting CDBG funding for the programs proposed by the
City.
This year the City's portion of CDBG funds is $23,362.00. The
funds are to be used for public purpose within the community, such
as housing, neighborhood revitalization, public facilities, public
services, etc., which benefit primarily low- and moderate-income
persons and families. The City Council has allocated its CDBG fund
in the past toward operations costs for the Southshore Senior
Center, and for rehabilitation of private properties for low- and
moderate-income families.
Again, this year, the Southshore Senior Center has requested a
contribution from the City's CDBG funds in the amount of $6,233.
This is a five percent increase over last years contribution. The
remainder of the CDBG funds, $17,129.00, would go towards private
property revitalization.
It is recommended that the City Council adopt the resolution
approving participation in the Urban Hennepin County Community
Development Block Grant Program and allocating CDBG funds for the
purposes and amounts listed above. Copies of the resolution,
requests for funding, and the request from Southshore Senior Center
are attached.

The funds allocated for the rehabilitation of 'private homes will
allow for the repairs anda needed energy corrections to enable
some elderly and low inclome families to remain in and upgrade
their older homes for the welfare of their families. Some
structures may become unsuitable for occupancy without these .
needed improvements. The City supports the continuation of added
fundi ng for thi s purpose. In the past years, the City has seen
these funds used to repair and save homes that otherwise would
have become uninhabitable if not for the improvements made possible
throug~ this program.
The City of Shorewood has contracted with Hennepin County for the
implementation of this project on their behalf.

Senior Community Services is requesting $6,233 for
the 1991-92 fiscal year from the City of Shorewood to
support the Southshore Senior Center. This amount
reflects a 5% cost-of-Iiving increase. The City provided
$5,936 for the past year through its share of County-
wide Community Development Block Grant (CDBG Year
XVI) funds. While we are aware that CDBG funds are
tight this year, we hope that the City will be able to
fully fund our request.
In this time of tight budgets, we hope that you will
continue to provide the resources necessary to support
the Southshore Senior Center. If another city, or cities
are not able to provide support at the level requested, an
additional request may be made at a later time.
If you have any questions, or if the City Council would
like to have an informational presentation, please don't
hesitate to let us know. On behalf of the seniors, who
are the real beneficiaries of your funds, many thanks for

WHEREAS, the City of Shorewood, through execution of a Joint
Cooperation Agreement with Hennepin County, is a cooperating unit
in the Urban Hennepin County Communi ty Development Block Grant
Program, and,
WHEREAS, the city of Shorewood has developed a proposal for
the use of Urban Hennepin County CDBG funds made available to it,
following a public hearing on April 8, 1991, to obtain the views of
citizens on local and Urban Hennepin County housing and community

Waterford Third Phase - Final Plan

Trivesco has requested an extension for submitting the final plan for the third phase of
Waterford (see attached letter from Randy Travalia). Trivesco cites the Hare/Snyder lawsuit
and the negotiations over the modifications to the T .I.F. Plan as reasons for not being able to
file a final plan within six months of the development stage approval. In addition, they were
not approved as a substitute developer for Sherman-Boosalis until December 1990. During
this time the City directed the City Engineer to stop work on the plans for the Old Market
Road intersection until negotiations were completed.
Given the circumstances the request for a six month extension is considered reasonable, and
allowable under the Zoning Ordinance. As a practical matter the final plan and P.D.D.
agreement must be completed before 1 June in order for the project to proceed.

Dear Mr. Neilsen:
As you know, Waterford 3rd Addition was granted development stage approval late
last year, when Sherman-Boosalis was to be the developer of this property. Inas-
much as Sherman-Boosalis is no longer a party to this development plan, Trivesco
has stepped in as the substitute developer. On December 27, 1990, the City Council
approved Trivesco as the substitute developer, and voted to nodify the TIF plan
advanced at that time.
A law suit filed by Mr. Hare and Mr. Schneider, alleging a breach of the public
hearing requirement in the TIF statute was filed at that same time. This resulted
in a delay until late February, when the City had another public hearing, wherein
the City approved the TIF modifications and approved Trivesco as the substitute
developer. At that point in time, Trivesco advanced to the City, a good faith
deposit of $99,000 so that the City may proceed with engineering drawings and bid
specifications in order to develop a firm bid price for the proposed improvements.
This bid format is to be accomplished by June 1, 1991. Given the time factors we
have occasioned as a result of these delays, and because of the time needed to
prepare bid plans and the like, Trivesco respectfully requests a six month extension
of the development stage approval granted late last year by the City of Shorewood.

- The last International Summer Special Olympics Games in
South Bend, Indiana, in 1987, are recorded to cost at least
S 7 million.
Why does it cost $16 million today and only $7 million in 1987?
- We will have 40% more participants; experience inflation; and are
holding the venues at multiple world-cIass athletic facilities. This
requires more contracts with the various facilities; more
transportation and security. The athletes will be staying at various
campuses around the community which increases housing and food
services. All of this will mean a more extensive communication
system to 'ensure that everyone is kept informed of game and athlete
information.

The 1991 International Special Olympics Games are Win-
ning Over The World. From July 19th-27th, over 6,000 ath-
letes with mental retardation, from nearly 90 nations will
visit Minneapolis-Saint Paul. Minnesota, USA to participate
in the 1991 International Special Olympics Games. This is
the single largest sporting event in the world in 1991, and the
largest multi-sport event ever held in Minnesota.
Special Olympics Games are a celebration of courage and
conviction in the true spirit of athletic competition. During
the 1991 Games, Special Olympics athletes will par-
ticipate in 15 sports at 20 different venues and be
housed in live villages throughout the Minneapolis-
Saint Paul area. It will be a memorable
time for everyone involved as athletes,
coaches and families from around the
world have the rare opportunity to live
together and share in each other's cul-
tures. Minnesotans will open their
community to this global cele-

In addition to the 500,000 volunteers who assist in the
year-round training and preparation of athletes for local, na-

that coordinate every aspect of the Games, to the thousands

RESOLUTION 'NO.
A RESOLUTION PROCLAIMING MAY 18 - 25
AS INTERNATIONAL SPECIAL OLYMPICS WEEK
WHEREAS, the Eighth International Special Olympics Games for
athletes with mental retardation -- the largest sporting event in the world
held in 1991 and the largest international multi-sport event ever held in
Minnesota - will be held July 19 through 27, 1991; and
WHEREAS, over 6,000 athletes with mental retardation from nearly 90
countries will be competing in various events including swimming and diving,
track and field, basketball, bowling, cycling, equestrian, football (soccer),
gymnastics, powerlifting, rollerskating, softball, table tennis, team
handball, tennis and volleyball; and
WHEREAS, the Shorewood City Council desires to encourage those in
the Shorewood community to support these events through the process of
building a community awareness proqram regarding the Special Olympics and
t-1hat it does for people who have mental 'retardation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Shorewood as follows:
1. That the City of Shorewood endorses the 1991 International
Special Olympics Games to be held in the Minneapolis/St. Paul metro area
July 19 through 27, 1991.
2. That the City Council of the City of Shorewood hereby proclaims
May 18 through May 25, 1991, as SPECIAL OLYMPICS WEEK.
ADOPTED BY THE CITY COUNCIL OF THE CITY OF SHOREWOOD this
8th day of April 1991.

Judy Marshik, the consultant to the Senior Housing Study Task Force, has suggested that the
City Council meet informally with the Task Force to discuss the preliminary draft of their
housing study. Since any future elderly housing project is likely to require modifications to
both the Comprehensive Plan and the Zoning Ordinance, I suggested that the meeting also
include the Planning Commission.
We suggest having the meeting on Tuesday, 21 May at 6:30 p.m. If acceptable to the
Council we also suggest serving sandwiches to those who can make the meeting. This
should be a good opportunity for the groups to meet and discuss elderly housing in
Shorewood.
If you have any questions relative to this matter, please call me.

Mayor Brancel reconvened the Special Council Meeting at 5:55 p.m.
Mayor Brancel announced that Trivesco had agreed to reduce the interest rate on the
proposed bond purchase from ten percent to nine percent.
Stover moved, Gagne seconded to adopt RESOLUTION NO. 23-91 "Resolution Approving
Contract for Tax Increment Finance Development By and Between the City of Shorewood,
Minnesota, and Trivesco, a Minnesota General Partnership".

Stover moved, Gagne seconded to adopt RESOLUTION NO. 24-91 "Resolution Approving

Chairman Andrus called the meeting to order at 7:00 p.m.

NEW POLICY REGARDING PARK COMMISSION MEETINGS
Chairman Andrus said that he would like to see Park meetings take
a little less time and proposed the following in order to
accomplish this:
1. start the meetings on time
2. Hold discussion to the topic of discussion
3 . Limit "Matters from the Floor" discussion to 5 minutes per item
4. If a Commissioner wants to discuss an item, and it will take
more than 5 minutes, call Sue by Wednesday morning before the
meeting, and have the item put on the agenda.

Laberee moved, Vogel seconded, to approve the minutes of Tuesday,
1991, as written. Motion carried - 6/0.

commissioner's Comments:
Laberee thought Silverwood would have more listed. He is in favor
of re-evaluating Freeman tennis courts vs. Silverwood tennis
courts.
wilson had 1. and 2. reversed, he said he has heard more from the
general public about playground equipment than tennis courts. He
said he would rather complete Silverwood all at once, he likes to
tackle one project and get it done before starting another. He
said he supposed the work should be spread throughout the City.
Dzurak mentioned playground equipment in both Freeman and
Silverwood Parks.
Lindstrom listed the Wagner property, Silverwood (pond, tennis
court, and playground equipment), Cathcart, Freeman playground
equipment, and irrigation of Freeman fields, Babe Ruth and old
Little League field.
Andrus said the City is either going to finish the parks, or not,
either way the money is coming out of the taxpayer's pocket, the
only difference being that if it takes 20 years to finish them, it
will probably cost at least 4 times as much.
vogel said we have to be realistic... where is the money coming
from?
Lewis said economic hardships are affecting the city right now, the
City has cut their budget this year, and will probably have to cut
it a lot more next year. The Park Commission cannot expect much of
anything from the General Fund, $20,000 is a realistic figure. The
rest will have to come from Park Dedication Funds.
wilson said Hopkins passed a referendum last year by 100 votes, and
it was because they included a senior building in their referendum.
Dzurak asked Lewis if any of the TIF funding can be used for
Silverwood Park. Lewis said we will have to wait until June 1 to
see what is going to happen, even then, the entire development will
have to be successful in order to create excess funding.

Lewis and Koegler urged the Commission to work with Finance
Director Rolek to set up a budget, and to promote it to the
council, and to the Public.
Lindstrom feels the Council should pursue consolidation with other
cities, that it would cut down on a lot of expenses.

PROMOTION OF PARKS
Laberee said from the limited turnout at Referendum meetings,
residents are ignorant regarding City parks.
The Commission said they will promote Freeman Park first. Sue will
do an article on Freeman Park in the upcoming newsletter.
The Commission wants to feature a different park in every
newsletter. Commissioners will write articles for other parks and
present them to Sue so she will have them ready when they are
needed. The Commission also feels that mentioning a future
referendum in the articles is important.

The Commission asked Park Planner Koegler what are the best ways to
promote the Park?
Koegler mentioned newsletters, park plans, a matrix showing what
sports are available in what parks. He asked why Shorewood does
not have any type of annual celebration like other cities do.
The Commission discussed what type of a promotional event they
could have. They feel they can hold a small event with Bessie

Bingo, balloon rides, and Park Commissioners and Councilmembers
present to sell Tee-shirts, explain ci ty maps, promote a City
Garden Club, guided trail tours, and a suggestion booth asking for
suggestions for an annual city celebration, and asking for
volunteers. This promotional event would be held at the same time
that the softball tournament is held, this way there will also be
food and drink available. This would take place on Saturday, June
21, 1991.
Andrus will check with other cities to see how they handle yearly
celebrations, and successes and problems they've encountered.
Vogel will talk to the Minnetonka Garden C+ub. Lindstrom will
check on a balloon. Laberee will check on "Bessie" and with the
scouts. (Scouts could direct parking and give trail tours).
Ponies and contacting the "Lion's Club" were also discussed.
wilson will talk to people about contributing trees.
WAGNER PROPERTY
Koegler reviewed his report wi th the Commission. He said they
should also consider possibility of eventually purchasing the homes
on each side of the Freeman Park Highway 7 entrance. This would be
a definite benefit to Freeman Park. Niccum will discuss this with
Nielsen, asking him to make a courtesy call to Wagner, and to ask
the Council to direct the Planning Commission to investigate means
of securing the Wagner property for eventual addition to Freeman
Park.
LAND ACOUISITION
The Commission feels that land acquisition is a high priority item.
They feel that there should be a separate fund for land purchase
because you never know when a property will become available for
purchase.
FIRE LANES
The Commission asked Niccum to get a map of the fire lanes.

to attend the meeting instead.
User Fees
Dzurak feels the Commission should discuss "User Fees".
Lindstrom said Todd Strot of the softball league said they
would be willing to pay $10 a game. with two games per
field, 3 fields, playing 3 nights a week, this would be
$180 a week. In return they would like the fields dragged
and chalked before each game. Lindstrom said he had
talked to Zdrazil about this already, and Zdrazil didn't
feel it would be a problem. Laberee said he felt that if
the city did this for the softball league, they would also
have to do it for soccer, football, and any other sport.
He also felt that discussing, and aSking for user fees,
did not mean the City would do more than they are doing
now, that the idea of user fees was to benefit the city.
The Commission asked Niccum to have Nielsen and Zdrazil
discuss this.
Budaet
Dzurak also asked that the Commission start working on a
budget, and that Niccum ask Finance Director Rolek to
attend a working meeting when he feels the Commission
should begin this process.
Dugouts - Freeman Park Little Leaaue Fields
Lindstrom said Jim Latterner, of the Tonka Men's Club, has
volunteered the Men's Club's services to build two dugouts
for the Little League fields at Freeman Park. It was
suggested that he be asked to present drawings to the
building inspector for approval before taking any action.
Trails - Freeman Park
Lindstrom said he and Christensen had marked the rest of
the trail west of the storm sewer line so Zdrazil can have
the crew finish it.
Lindstrom said Christensen had suggested calling the creek
"Cottonwood Creek" after the huge cottonwood tree that
stands on the bank. The Commission felt the trails should
have names and signs for the benefit of walkers.

The Commission again discussed the fact that no trees had
been replaced. They feel this was part of the agreement,

and the jOb should have been done a long time ago. They
are not talking about filling in the area, only curving it
so it doesn't look like the strips where they put in the
power lines up north.
REPORTS
The pumphouse at Freeman Park was approved at a cost of $2000.

are in good shape and working order.
2) Playground Equipment - Identify cost and placement so that
we can act if someone wants to support (pay for) a smaller
item.
3) Signage - in all parks

5) Develop user fees for leagues
~) Prepare Budget - We need to become part of the budget
process so that we can have some control (or at least
input) over it.
7) Participate in the Shorewood committee that is trying
to solve the snowmobile problem.
