M I NUT E S CALL TO ORDER The Shorewood City Council convened at 6:02 P.M. on Thursday, November 8, 1990, to review the local election results from the General Election held November 6, 1990. ROLL CALL Present: Mayor Haugen, Councilmembers Gagne, Brancel and Watten. (Stover absent) Staff: Deputy Clerk Kennelly RESOLUTION #125-90 CANVASS OF ELECTION The Council reviewed a "Resolution Accepting Local Election Results" for the local election held Tuesday, November 6, 1990, as presented by the Election Judges of all four Shorewood precincts. Gagne moved, seconded by Brancel, to adopt Resolution #125-90-"A Resolution Accepting Local Election Results." Motion carried 4 Ayes - 0 nays by Roll Call Vote. REVIEW AGENDA APPROVAL OF MINUTES A. REGULAR CITY COUNCIL MEETING - OCTOBER 22. 1990 Gagne moved, Stover seconded, to approve the Minutes of the October 22, 1990, City Council Meeting, with the following corrections. 1. Pg. 5. Councilmember Brancel wanted to know if the cost to install a masonry curb at the Badger Field Shelter was correct. The Council said it was correct. 2. Pg. 14. Senior Housing Task Force - Councilmember Stover said Councilmember Watten was appointed to the Task Force. Motion carried - 5/0. B. CITY COUNCIL WORKSHOP - OCTOBER 30. 1990 Gagne moved, Brancel seconded, to approve the Minutes of the October 30, 1990, City Council Workshop, with the following corrections: 1. P. 5 - 4th line from the bottom. Brancel said "the Council has told the residents they will look at a municipal system and they would continue to do so." 2. P. 1 - Correct the last line of Recycling RFP 1991. 3. P. 4 - Councilmember Stover asked if her request to have Finance Director Rolek obtain information regarding individual va well iron filtering had been done. Administrator Whittaker will look into this. Motion carried - 5/0. Gagne moved, Brancel seconded, to approve the following Consent Agenda: A. Approve the 1991 Budget for West Hennepin Human Services Motion carried - 5/0. COMMISSION REPORTS: A. Planning Commission Councilmember Stover said no Planning Commission meeting had been held. B. Park Commission Park Liaison Watten reported to the Park Commission the decisions of the City Council regarding the Parks. He also said that he had received samples of flooring for the Park warming houses. The Toughtex product must be glued to the floor and would cost $3200.87. The second type of flooring is from the Pawlings Corp. and is an interlocking, reversible flooring that does not need glue. This product would cost $4500. Watten recommend this product because of its flexibility. The Council would not have to order the first quality tile; the second quality would be just as good and would only have a slightly different color. Gagne said the Park Commission preferred the in~erlocking material. Watten moved, Gagne seconded, to purchase the flexible tile flooring from the Pawlings Corporation at a cost not to exceed $5000. Motion carried - 5/0. Watten said the Park Commission accepted the offer of the Shorewood Snowmobile Club to clean UP the Hiking and Biking Trail. The Council said they would discuss this when the Administrator arrived. APPEAL NOTICE TO REMOVE - WILDA GOGGANS APPLICANT: LOCATION: WILDA GOGGANS 26960 WEST 62ND STREET Councilmember Brancel said she had talked to Planner Nielsen about Mrs. Goggans. The City has removed material from her property once before and now there is more to clean-up. 2 CITY OF SHOREWOOD _ REGULAR CITY COUNCI~EETING TUESDAY. NOVEMBER 13. 1990 C.CILCHAMBERS 5 . COUNTRY CLUB ROAD PAGE 3 Haugen said the Council should give her until the end of November to clean-up the material as recommended by Nielsen. Gagne moved. Brancel seconded. to give Wilda Goggans until November 30. 1990 to remove offensive items and vehicles as listed by the City Planner in his October 19. 1990. letter. Motion carried - 5/0. REVIEW ALTERNATIVES AND COSTS FOR LIFT STATION REPAIRS AND AUTHORIZE THE CITY ENGINEER TO PREPARE PLANS AND SPECIFICATIONS. City Engineer Norton presented his cost estimate for the rehabilitation of lift stations 5 & 6. Norton told the Council these two stations have been identified by Munitech as needing the most immediate repair. They are wet well/dry well types, manufactured by Cant ex and installed in 1972. It will be necessary to completely replace these stations. Norton said there are two alternatives: 1. Replace the existing equipment with the same equipment. 2. Convert the stations to submersible types. Norton recommends the City convert the stations to submersible stations. The cost is higher but there are two reasons for considering the conversion. 1. Only one man will be needed to maintain the station. 2. They are safer because they can be operated from above ground. Stover asked why there was a difference in price between Station 5 and 6. Norton said Station 5 was originally designed to include flow from Enchanted Island, therefore, the pipe is 121-vs-9" for the rest of the City. However, the MWCC decided there should be no line under Lake Minnetonka and Enchanted Island has never been connected to this pipe. Gagne moved. Watten seconded. to authorize the City Engineer to prepare plans and specifications for replacing Lift Stations 5 & 6 with submersible stations. Motion carried - 5/0 Gagne, Haugen and Stover said the City has been budgeting for this replacement in the Sewer Fund. CONSIDER AN ORDINANCE RELATING TO THE ESTABL I SHMENT OF STORM SEWER IMPROVEMENT TAX DISTRICT NO. 2 - SHADY HILLS SUBWATERSHED ORDINANCE NO. 235 Gagne asked how far along the City was on this project. REGULAR CITY COUNCI EETING TUESDAY, NOVEMBER 13, 1990 C.CIL CHAMBERS 5 COUNTRY CLUB ROAD PAGE 4 City Attorney Froberg said the Council held a hearing on the Ordinance establishing the Shady Hills Storm Sewer District on October 8. 1990 and tabled the matter. On October 30, 1990, the Council ordered a Public Hearing on the Feasibility of the Shady Hills Drainage project to be held on Nov. 26. 1990. Froberg said the Ordinance before them sets up the boundaries of the Taxing District. Brancel asked if the Taxing Districts have to be used once they are established. Froberg said they do not have to be used. This Ordinance merely sets up the boundaries of the district. Additional action is necessary by the Council before additional taxes can be levied within the district. Gagne moved, Brancel seconded to adopt ORDINANCE NO. 235 "An Ordinance Establishing Storm Sewer Improvement Tax District No.2, Shady Hills Subwatershed," and waive the second reading. Motion carried - 5/0 on a roll call vote. UPDATE ON THE FEASIBILITY REPORT. AND CONSIDERATION OF AN ORDINANCE RELATING TO THE ESTABLISHMENT OF STORM SEWER IMPROVEMENT TAX DISTRICT NO. 1 - GLEN ROAD ORDINANCE NO. 236 RESOLUTION NO. 125-90 SUBWATERSHED Engineer Norton said he and Mayor Haugen had discussed the Glen Road Project with the Minnehaha Creek Watershed District and they seemed receptive to the City's revised Feasibility Report. However. Jim Mahady of the Watershed District had contacted Norton and said he would be presenting the City's proposals to the District Board on Nov. 15th. Norton said the City will receive an order to proceed 30 days after the approval by the District Board. The Watershed District will also be charging $1500 for their services. Haugen said she had received no information from the Watershed District concerning this matter. Gagne asked if Norton had told the Watershed District they are driving Cities away from them with their delays. Haugen and Stover said the City should proceed without their approval. Norton said the City needs the Watershed District's approval. Stover asked about the payment of $1500. Norton said the money was for the computer analysis of the City's Feasibility Study. Gagne said the City originally asked the Watershed District for assistance because their computer had the necessary figures for the Feasibility Study. This payment will update the study. Gagne moved, Watten seconded, to authorize payment of $1500.00 to the Minnehaha Creek Watershed District for the update of the Glen Road Feasibility Study. Motion carried - 5/0 Councilmember Watten asked Norton the depth of ponds in the project. Norton said pond * 2 will be 4 ft. and pond * 3, 4 to 5 ft. 4 CITY OF SHOREWOOD . Norton said the ponds will have a 4 to 1 slope and should be no more dangerous .than a natural pond. Froberg said the legal description of the District is not attached. However. it is within the area identified in Exhibit A as enclosed in the information for the Public Hearing. The proposed boundaries of the District were identified at that time but not all the properties in that area will be included in the tax district. Stover moved. Gagne seconded. to adopt ORDINANCE NO. 236 "An Ordinance Establishing Storm Sewer Improvement Tax District No.1. Glen Road and County Road 19 Subwatershed." and waive the 2nd reading. Motion carried - 5/0 on a roll call vote. Brancel moved. Gagne seconded. to adopt RESOLUTION NO. 125-90 II A Resolution rescheduling the Public Hearing on the updated Feasibility Report for Glen Road Drainage Improvements to January 28. 1991. at 8:00 P.M. Motion carried - 5/0. RESOLUTION CALLING A PUBLIC HEARING ON A RESOLUTION NO. 126-90 PROPOSED ORDINANCE RELATING TO THE ESTABLISHMENT OF STORM SEWER IMPROVEMENT TAX DISTRICT NO. 3 - GRANT LORENZ SUBWATERSHED - FOR MARCH 11. 1991 AT AT 8:00 P.M. Froberg said the Council should discuss the legal boundaries of the District. Norton said the project has grown considerably from the original concern. The taxing district map includes the areas that contribute to the problem. Watten asked Norton about the contribution of surface water vs ground water to the problem. He said a storm sewer must be considered or ground water will add to the problem. Stover asked if the preliminary map would be updated before the hearing. Haugen asked if there are developments that have completed their own water systems. She said they should not be taxed for another drainage project. Norton said Strawberry Fields does have ponding areas on the development but the overflow does go into Grant Lorenz. He said the City needs to formulate a policy regarding credits to developments that already have drainage systems. Gagne said the developments in this district should be responsible for part of this project because some of their water still drains into the Grant Lorenz area. 5 CITY OF SHOREWOOD .. REGULAR CITY COUNCI~EETING TUESDAY, NOVEMBER 13, 1990 C.CIL CHAMBERS 5 COUNTRY CLUE ROAD PAGE 6 Stover said the developments have not made the drainage problem worse. The residents of the area can let the City know if they want this project. . Gagne said there are people who have a problem and need to have it corrected. The Council needs to make a decision. Erancel wanted to know if the entire City map should be divided into Special Taxing Districts. instead of doing it piecemeal. Norton said there had been discussion at the Staff meeting to look upstream from Noble Road and the pipes that run under Edgewood Road to a lagoon and Lake Minnetonka. The Staff decided to use the areas that contribute to the Grant Lorenz problem. Stover wanted the reasoning to be consistent and fair for all residents. Erancel asked if there was enough area North of Edgewood Rd. to create a separate Taxing District. Norton said there is a sizable area. Watten moved. Gagne seconded. to adopt RESOLUTION NO. 126-90 "A Resolution calling for a Public Hearing on the Proposed Ordinance Relating to the Establishment of Storm Sewer Improvement Tax District No.3 Grant Lorenz Subwatershed, on March 11. 1991." Motion carried - 5/0 on a roll call vote. REVIEW PROPOSED CONTRACT FOR PREPARATION OF PLANS AND SPECIFICATIONS FOR WATER TREATMENT PLANT Froberg said there have been changes to the proposed contract with Associated Consultants Engineers. He said progress payments have been added and are outlined in the new contract. If the project is abandoned by the City. the Engineer is paid proportionally to the work performed. The Engineer's errors and omissions insurance has been reduced from $1 Mill. to $250.000. If the Engineer abandons the project. all fees paid by the City to the Engineer will be refunded to the City. Gagne said he does not want this contract to be any different than other City contracts. Froberg said the City normally has the Engineer prepare the assessment roll but Associated Engineers does not normally provide this service. Noel Vogen - He said he can provide this service but could not accurately determine his fee for this service and it is not included in the fixed fee stated in the proposed contract. Gagne said it has not be determined how this project will be funded. It could be funded with TIF money. in which case there will be no need 6 CITY OF SHOREWOOD ~ REGULAR CITY COUNCI~EETING TUESDAY, NOVEMBER 13, 1990 C.CIL CHAMBERS 5 COUNTRY CLUB ROAD PAGE 7 for assessment roll. Gagne also asked if Associated Consultant's references had been checked. Haugen said the City Administrator will inform him. Haugen asked Froberg if the contract had been shown to Associated Consultants prior to his estimate of a $40,000 fixed fee. Froberg and Vogen said no it had not. Froberg said the provision requiring the Engineer to prepare the assessment roll was left in the contract and the Council can make their decision. Haugen asked the Fill of the Council. Gagne said he is uneasy and has questions he wants to ask Whittaker. Watten asked if he wanted to check the Engineer's qualifications? Gagne said he wanted to inquire about the firm's prior projects. Watten thought the firm was already hired and the qualifications should have been checked a long time ago. Froberg said the plans and spec. were ordered subject to approval of an agreement with the Engineer. City Administrator Whittaker said he has seen reports on the quality of the treatment of one of the plants they designed. However, there have been no calls from other references. Mrs. Vogel - asked how the TIF money will be spent. Haugen said the money can be spent on public improvements within the district. Mrs. Vogel wanted to know lr it was a public improvement to treat the water when the water is already healthy drinking water. Haugen said the water is not clear. Watten said the Council has decided to treat the water. Froberg said water treatment is part of public improvements that may be partially financed with TIF money. Haugen said the money is not yet available. If an assessment is necessary, only the benefitted properties will be taxed. Stover asked Froberg why there is a reduction in the errors and omissions part of the contract from $1 Mill. to $250,000. Froberg said Associated Consultants does not have that much insurance. Haugen said $1 Mill. has always been in the City's contracts and she doesn't want to deviate. Gagne is bothered by this project and would rather wait. He wants to know what is happening with the Waterford Tnird Phase. Whittaker said he met with Sherman-Boosalis and they will close on the purchase of the property from Trivesco on Nov. 30, 1990. Trivesco will provide the letter of credit for the TIF bonds. The City is expending no money on the preparation of plans and specs. for the public improvements because they have not received a deposit or letter of credit from Sherman-Boosalis. He expects to have all signed agreements and money by Dec. 1, 1990. 7 CITY OF SHOREWOOD .. REGULAR CITY COUNCI~EETING TUESDAY. NOVEMBER 13, 1990 C.CIL CHAMBERS 5 COUNTRY CLUB ROAD PAGE 8 Gagne moved. Brancel seconded. to table the authorization for plans and specifications for the S. E. Area Water Treatment Facility until the Dec. 10. 1990 City Council meeting. Motion carried - 4/1 (Watten) Whittaker asked if the Council had addressed all their questions concerning the contract. Gagne wants Associated Consultant's references checked. Brancel and Haugen want the $1 Mill. errors and omissions insurance left in the contract. Froberg said the City has $600,000 tort liability limit insurance by Statute. Gagne said it would set a precedent. Vogen said he cannot afford a $1 Mill. insurance policy on a $40,000 fee. Froberg said the $1 Mill. errors and omissions figure was taken from the insurance provision in the current contract with the City Engineer. Whittaker said TIF will support only about one-half of the cost of the project. Whittaker said a policy on insurance has never been discussed. Haugen said $1 Mill. is on all contracts. Gagne asked Whittaker to review the other City contracts to see if $1 Mill. insurance is used. Stover asked who on the City staff would be assisting the Engineer with the assessment roll? Whittaker said the City Clerk or Finance Director would help. On a per user basis, it would not be hard to calculate the assessment roll. Vogen said it would be hard to figure the cost of the service before a method of payment is determined. Haugen said Vogen can give the City his hourly rate. Stover said there is a difference in the "benchmarks" provision In the contract. Vogen said it is the firm's policy to provide "benchmarks" to the contractors and they follow them rather than the Engineer laying-out the building. Watten asked about the retainage upon completion of the project. Froberg said In this contract there is a schedule of payments. The last payment IS not dispensed until all the work is completed to the satisfaction of the City. Watten said the City was in hurry to hire this firm and now it is checking references. He said this should have been done first. Vogel asked how long it would take to corrode the pipes with the amount of iron in the water. Gagne said the Council agreed to treat this water problem. The City was told the water was healthy but the residents are saying it is not of decent quality. MATTERS FROM THE FLOOR Mayor Haugen asked three times for matters from the floor. There were none. STAFF REPORTS: A. CITY ENGINEER 1. Alternatives for T.H. 7 and Christmas Lake Road Intersection Norton reported that Mn/Dot has sent five new plans to the City for approval. ,All the proposals move Christmas Lake Road West. Alternatives 1-3 move Highway 7 South. Alternatives 4 & 5 move HwY. 7 North. The proposals that move HwY. 7 South will impact Radisson Road; many buildings will have to be taken down. Whittaker asked how these plans differ from the City's plan. Norton said the intersection has been moved West. Gagne said Greenwood doesn't want the boatworks or the Food N Fuel to be taken. He asked if the State has taken Greenwood's position into consideration. He also said the Council needs to decide what is best for Shorewood. Norton said the best solution for Shorewood would be to have the road moved North. He said * 4 would be the best proposal but the City should wait until the public hearing on Nov. 14, 1990. Stover asked if Shorewood can veto the proposals. Haugen said Mn/Dot cannot proceed without the approval of Greenwood and Shorewood. Whittaker said he thought they could proceed without the Cities' approval. Norton said Mn/Dot has told him they can but will not proceed without the approval of the two cities. B. CITY ATTORNEY 1. FINAL REPORT - Sign at Rapid Oil Chanqe Attorney Froberg reported that Naegele had taken down the sign at Rapid Oil Change. 2. Amendments to LMCD Enabling Act Froberg reported that the State Legislature has codified the LMCD Enabling Act of 1967. Excess Liability Options Froberg said the City must consider whether or not to waive the Statutory liability limit for purposes of it's umbrella coverage for excess liability of $1 Million. The State liability limit of $600,000 does not apply to Federal cases. Also, inverse condemnation cases cannot be limited to the $600,000 limit. Therefore, the City needs the umbrella policy. The umbrella coverage can be limited only to those cases in which our statutory liability does not apply. The City can save on the premium by not waiving our statutory liability limit of $600,000. Froberg advised not to waive the statutory limit but keep the umbrella for exclusions. Stover moved. Watten seconded to accept the excess liability coverage of $1 Million from the League of Minnesota Cities Insurance Trust and the City DOES NOT WAIVE the monetary limits on tort liability established by Minnesota Statutes 466.04. Motion carried - 5/0 C. CITY ADMINISTRATOR 1. Offer from Snowmobile Club to Clean Up Trail Whittaker said he has talked with Mr. Arndt concerning his complaints about the Snowmobile Club. He said the City should accept the club's help if it does not require supervision. Watten said the Park Commission recommended the City accept the offer. Haugen said the City had received two letters from residents stating that the Snowmobile Club does not clean-up the trail. Stover said a previous snowmobile club had offered to clean-up the trail and had cut branches along the trail. She does not object to this club cleaning litter but does not want them to do any tree trimming. Mike Ellis - President. Shorewood Snowmobile Club He said the club is newly reformed. Their intention is to clean-up the litter along the trail a couple of times during the year. Their purpose is similar to the Adopt-a-Highway program and they would like a sign at each end of the trail recognizing their help. Haugen said there are too many signs already. Brancel and Gagne did not object to the signs. Watten moved, Gagne seconded to accept the offer of the Shorewood Snowmobile Club to clean-up the Shorewood Hiking and Biking Trail. Haugen) 2 Nay(Brancel & Gagne) Gagne said many of the resident's complaints concern the signs that are nailed to trees. He said these signs should be fixed to posts. Watten said signage should be left to the City. 2. LMC Office Space Whittaker said the League of Minnesota Cities is requesting more office space. He said the City has just finished paying additional dues each year to payoff the bonds on the current building. Whittaker said the League should consider adding on to the building. However. he would like the Council's input on the subject. Haugen said she has been to many meetings at the current building and the League is cramped for space because they have had to add additional staff. She said she would concur with adding on to the current space. Stover moved. Brancel seconded to recommend the League of Minnesota Cities add on to their current office building. Motion carried - 5/0. Haugen suggested the new City Council have a representative to the LMC. The Council needs to be aware of bills at the State Legislature that affect the City. She said she would be glad to help. 3. Podium Chairs The discussion was delayed until January. 4. Proposals for 1991 Recyclinq Contract Whittaker said the proposals have been received and the savings will amount to $.25 per household. He said the contract was worth doing jointly. The final proposal will be ready on Nov. 26th. 5. Metro Waste Control Whittaker said a proposal was received from Gene Franchette to become a watch dog at the MWCC. Gagne said the City is paying a lot for waste control and it might be worth trying this proposal. Property Stakes Haugen said a resident of Shorewood Oaks had complained that a property stake had been taken while the area for the Little League Field was being graded. She asked Norton who was responsible for this. Norton said the contractor is responsible for returning the stake but it should really be installed by a surveyor. We checked each tank, at that time, for quantity in each. The 1000 gallon tank used by Public Works was not empty as we did not know when the tanks would be removed. Public Works purchased two tanks for the back of the pickups. The 4000 gallon tank thought to be empty was found to have over a thousand gallons of water and gas in it. Determan Welding and Tank Service Inc., was called to pump and dispose of contaminated liquid. This was done by afternoon the same day. Westside had called for utility locations and they were completed on the afternoon of the 14th. NSP was asked to disconnect Public Works electric service for the morning of the 15th as the power line was thought to layover the underground tanks. NOVEMBER 15, 1990: Public Works pumped gas into pickup tanks from the 1000 gallon. The 4000 gallons was empty. Wests ide Equipment started by removing the gas pumps and the island. NSP shut off electricity - Tom Green, Consultant with Applied Engineering, was here. Wests ide started removal of tanks. Wests ide began with the 1000 gallon tank. Public Works was unable to get this tank completely empty. Wests ide furnished a pump and emptied the tank into a 55 gallon barrel. Approximately 45 gallons was pumped into the barrel. When the tank was empty C02 was put into the tank. Excavation then started, blacktop chunks were loaded onto westside trucks. contaminated soil was lifted out of the area around the tanks and then moved to a pile near the City mailbox and salt sand pile. Sand was hauled in to fill the hole and was compacted by westside. Public Works put up fencing and flashers around the hole for over night safety. NOVEMBER 16, 1990: Fences and flashers were removed and Wests ide finished filling hole and compacting sand. westside put in crushed rock for blacktop base. Flashers were put back around blacktop edge for safety over the weekend. NOVEMBER 19, 1990: Public Works repaired blacktop surface. NOVEMBER 20, 1990: contaminated soil was relocated on top of new blacktop and covered for storage with plastic by Public Works. These budgets, upon adoption by the City Council, become the guide for the delivery of services to be provided to the residents of the city in the coming year. The budget anticipates the level of funding necessary for the City to provide these services. The preparation of budgets in the last few years has been quite a task. In addition to forecasting the City's needs, the staff has had to anticipate changes in the levy laws and state aids by the State Legislature, adopt Truth in Taxation requirements, and make projections for future capital improvement needs of the City. Last year, the State Legislature's shift of Local Government Aid from cities to school districts brought the City of Shorewood from receiving in excess of $166,000 in aid to zero. Additionally, after the 1990 budget was adopted and in effect, the Legislature further reduced state aids to the City in the amount of $25,710 for 1990, a real reduction in expected revenue which becomes a permanent reduction in city taxing ability. The Truth in Taxation law requires cities to certify a proposed levy by September 1 and does not allow that levy to be increased thereafter, yet the final tax levy and budget cannot be adopted until the middle of November. Many cities, Shorewood included, have submitted their maximum levies as a hedge against uncertainty in the intervening months, with the idea that the levy may be lowered at the time of final adoption. Lastly, the rapid rate of growth the City has experienced during the last few years has yielded the City with many new roads, sewer lines, water lines, etc., which must be maintained, and park land to develop. The proposed 1991 budget shows an increase of 9.6% over 1990. The level of property taxes to be levied for 1991 is 10.2% greater than in 1990. Offsetting this rather large percentage increase is an increase in total property value in the City for 1990 of 12.6%, which represents real growth in the number of single family residences, and adjustments in existing properties. The real effect on property taxes for a single residential lot range from a minimal increase to a small decrease in taxes. This is due to the change in Tax Capacity Rates which increased the range from $100,000 to $110,000 at the 2% level. The major increases in the expenditure area of the budget for this year are salary increases, LMCD and other membership fees, postage, which goes to $.30 in 1991, clerk and planning software, animal patrolling, assessors contract, engineering, recycling, insurance, fire protection, police, materials for street maintenance, street lighting, parks and recreation, and capital improvements. In some cases, shifts have occurred from one department to another, such as salaries and other expenses, to reflect the true cost of operating the department. . . MEMO 1991 Proposed Budget November 21, 1990 Page 3 The single largest increase is in the area of capital improvements, which has a $63,112 increase. This is a factor of the growth of the city. This is also the area which, if the Council chooses, could be cut. If this were to be taken from the budget, the tax rate would be reduced by 1.822%. However, the Council should weigh future capital improvements against this action. Public Works facilities, street improvements, park development, etc., are expensive undertakings and would require several years of capital budgeting to build. The City is also at the whim of the Legislature in its ability to raise revenue. Therefore, such a step should be carefully considered. In approving these budgets, the city council is being responsive to the needs of the residents of the City, both now and into the future. We would, therefore, recommend the adoption of the 1991 General Operating Budget and Property Tax Levy, Water Fund Budget and Sewer Fund Budget. . . (612) 474-3236 UPDATE ON THE PROPOSED STORM SEWER IMPROVEMENTS - SHADY HILLS November 14, 1990 HISTORY: The City Council reviewed all of the concerns expressed at the Public Hearing on the Special Taxing District and: 1. Televised the storm sewer to assess the condition of the pipe - which verified the poor condition of the pipe and the need for replacement; 2. Reviewed the topographic maps for the subwatershed to de- termine more precisely what the boundary of the Special Taxing District should be; 3. Reaffirmed their decision that solutions to drainage problems must be financed through these Disctricts as there are not sufficient revenues in the General Fund to solve all the known drainage problems; 4. Established a policy that any parcel that was at least 50% (percent) in the subwatershed should be included in the Special Taxing District; and, 5. Adopted an Ordinance establishing the special Taxing District on November 13, 1990. PROCESS: The City must now hold a Public Hearing on the Feasibility of the project. The Notice of that hearing is included in this packet. That hearing will be held November 26, 1990, at 9:00 P.M. in the City Hall. Once the City Council is satisfied that the issues raised have been adequately addressed, the Council may order the City Engineer to prepare plans and specifications and take bids for construction of the project. (612) 474-3236 Planning Commission, Mayor and City Council Brad Nielsen 16 November 1990 Barthel Construction - C.U.P. for Fill in Excess of 100 Cubic Yards 405 (90.26) Mr. Duane Barthel has requested a conditional use permit, pursuant to Section 1201.03 Subd.8 of the Shorewood City Code, to place more than 100 cubic yards on the property located at 24155 Wood Drive (see Site Location map - Exhibit A, attached). The applicant's proposed grading plan is shown on Exhibit B. Since this type of request is largely an engineering matter, the City Engineer has addressed the plan in a separate letter, dated 29 October 1990. Briefly, the applicant proposes to fill an existing depression on the site to create a level area for a front yard for a future home on the lot. As can be seen on Exhibit B the lot drops off from the cul-de-sac at the end of Wood Drive, easterly to Riviera Lane. He proposes to add up to 380 cubic yards to the building pad location and the southeast corner of the lot. The City Engineer was asked to review the request, particularly with respect to drainage. Although not mentioned in his letter, a 12-inch culvert has been required where the applicant proposes to build the new driveway. The Engineer advises us that drainage will not be adversely effected by the fill. Surface water will still pond on the site somewhat, although to a lesser degree. Positive drainage is provided to the south along Riviera Lane, ultimately flowing to the existing pond on the north side of Highway 7. With two exceptions, all of the vehicles are properly licensed, as an inspection by your office will attest. In the two other cases, I will need added time to complete the licensing of the units. Explanation in each ca~e follows. 1964 TBird Convertible This car was purchased for my mother-in-law in 1964 by my father-in-law, and has always been in my wife's family. The last vehicle registration for this car was before titles were required for cars, and w~ have to title it in order to license it. The registrar will not take our word for ownership, but wants some documentation that in 1978 we were in title. (Side comment: they have copies of the 1978 registrations somewhere...why isn't it their responsibility?). There apprear to be two options available, find documentation in the estate papers for my wife's family, or get an affadavit signed by the dealer who sold the car originally to Dr. SEifert. Both avenues require more time. I think I have the best chance with the dealer, who is still in the Twin Cities, and was at the time of the sale a close friend of the family. (6/2) 474-0929 1964 TBird Hardtop I have discussed title to this car with the chief of South Shore Department. I do nothave ownership proof for this car. IT was abandoned by the owner at a dealership in St. Paul, and the dealership turned it over to David Voaklander of Dave's (now Four SEasons) Towing. He, knowing of the other Tbird, offered it to me f~r parts. I have never attempted to title it until now, as I considered it just that.......spare parts for the other car. Rick Young stated that there is a particular prucedure thac a dealer goes chrough in situations like this, but no one has ever offered any paperwork to me showing I have title. I don't know that a certificate from Dave would help register the unit, but I am asking that he provide me with at least that much documentation. If he will not, them I will ask him to remove the vehicle that he is storing on my premises, and see how that flies!!!!! That'll take another week to ten days. This is to advise you of the regulations pertaining to such storage in the City of Shorewood. Only those boats, vehicles, equipment, etc. owned by a resident of the property in question may be stored on the property. AGRICULTURAL LAND: Continuous acreage often (10) acres or more, primarily used for farming, dairying, pasturage, agriculture, horticulture, floriculture, viticulture, or animal or poultry husbandry. AP ARTMENT: A room or suite of rooms, located in a building- con- taining three (3) or more similar units, which is designed for, intended for, or occupied as a residence by a single family or an individual, and is equipped with cooking and sanitation facilities. (See Dwelling - Multiple- Family.) AQUIFER RECHARGE AREAS: All land surface areas which by nature of their surface and/or subsurface characteristics are determined to con- tribute to the replenishment of subsurface water supplies. AUTOMOBILE REPAIR - MAJOR: General repair, rebuilding or recon- ditioning of engines, motor vehicles or trailers; collision service, including body, frame or fender straightening or repair; painting; vehicle steam cleaning. AUTOMOBILE REPAIR - MINOR: Minor repairs, upholstering, replace- ment of parts and motor services to passenger automobiles and trucks not exceeding twelve thousand (12,000) pounds gross weight, but not in- cluding any operation specified under "Automobile Repair - Major". AUTOMOBILE WRECKING or JUNK YARD: Any place where two (2) or more vehicles not in running condition or not licensed, or parts of vehicles, are stored in the open and are not being restored to opera- tion or any land, building or structure used for wrecking or storing of such motor vehicles or parts thereof; and including any commercial salvag- ing and scavenging of any other goods, articles or merchandise. AWNING: A temporary hood or cover which projects from the wall of a building, and of a type which can be retracted, folded or collapsed against the face of a supporting building. Subd. 2. (d) Cooling towers, mechanical and air conditioning equipment when screened from view. (e) Cupolas and domes which do not contain useable space. (f) Elevator penthouses. (g) Flagpoles. (h) Monuments. The staff report for that c.u.p., dated 31 August 1989, is attached for your review. The c.u.p. was granted for one year in order to monitor the level of activity at the skating rink to determine if a permanent shelter should be provided. Based upon neighborhood use the Park Commission has recommended that the shelter be brought back this season. Since the previous c.u.p. was for one year only it must be reprocessed before the shelter can be brought in. It should be noted that the Park Commission and City Council have not abandoned the idea of a permanent shelter. Shelters in all of the City parks will be a topic of consideration in a future bond referendum being studied by the Park Commission. In the mean time there is an apparent need to provide a shelter for neighborhood use this year. The 1989 staff report raises a number of issues, none of which has really changed. The recommendation at that time was to allow the use of a temporary shelter for three years, after which a decision should be made relative to a permanent building. This recommendation remains unchanged also, despite recent comments by the Council that the new c.u.p. should be for one additional year. COUNCIL REPORT Mayor's Report Intergovernmental Meeting of the LMCD Haugen reported on the discussion at the LMCD Intergovernmental meeting regarding the appointment of the representatives by the Cities to the LMCD. Some of the Mayors' would like the representatives to be appoint- ed for the same term as that of the Mayor. The mayors would also like to be able to recall a representative if they don't like the manner in which the City is being represented. Rascop felt the three-year term prevented a possible total turn over of all the representatives at one time. Rascop thought a recall would be possible for poor performance. However, Rascop said, Cities should not be able to recall a representa- tive simply for disagreeing with their directives. Representatives should act in the best interests of the Lake, as they see it. Regional breakfast meeting for City officials with the Met Council will be held at 7:30 A.M., Friday, September 22nd; Whittaker will attend. Transportation conference will be held on October 19 and 20, and Regional Transportation conference will be held on the 18th of October. FILE NO.: 405 (89.32) BACKGROUND The Shorewood Park Commission proposes to locate a temporary warming house at Manor Park (see Site Location map - Exhibit A, attached). They propose to rent an 8' x 32' mobile building (see Exhibit B) for three months. Depending on its use, it is our understanding that they may wish to use the building for two years following, three months at a time. This proposal requires a conditional use permit, despite the temporary nature of the building. You may recall that the City considered a conditional use permit for a permanent building in May of 1987 (see staff report, dated 30 April 1987 - Attachment I, copied in yellow). After considerable discussion the Park Commission decided their capital improvements budget could not afford a permanent building designed and built to code. They intend to monitor use of the temporary shelter to determine if a permanent building is warranted for this park. The Park Commission proposes to locate the structure in the same spot as was proposed for the permanent building (see Exhibit C of Attachment I). Hopefully, members of the Park Commission will attend the public hearing on 5 September to answer questions. ANALYSIS/RECOMMENDATION The City Council has directed my departments to evaluate this request from zoning and building code perspectives. A Residential Community on Lake Minnetonka's South Shore Re: Manor Park Conditional Use 31 August 1989 .. Warm1ng House Permit . A. Zoning Requirements. Park buildings are regulated by Section 1201.10 Sub~. 4.a. of the City Code. Following is how the proposed shelter complies with that section. 1. Given the temporary nature of the shelter and the need to wheel it in and out of the park, screening and landscaping is not recommended at this time. At such time as a permanent shelter is built, a landscape plan should be prepared. 2. Consistency with Comprehensive Plan. As mentioned in the 1987 staff report, a shelter building is considered to be a typical element of a park and essential where winter activities are provided. Page 44 of Shorewood's Comprehensive Plan (see Exhibit C) contains policies relative to the construction of governmental buildings and facilities. It may be argued that the mobile shelter may be contrary to policy number 4. 3. Compatibility with Surrounding Uses. In recent years Shorewood has taken particular care to make its public buildings blend into the neighborhoods in which they are located. The best examples of this are the Boulder Bridge and southeast area pump houses. Worse examples are the Public Works garage and Badger pump house which predate Shorewood's Comprehensive Plan. While the proposed structure is not considered to be compatible with housing quality in the Manor Park area, the City may be willing to overlook this requirement if the structure is limited to only three months per year for three years. 4. Affect on Property Values. Several communities have been identified as having used portable shelter buildings. Presumably because they are temporary, the buildings do not detract from property values. It is possible that people view the portable shelters as being better than no shelter at all. 5. Construction Requirements. In addition to requirements of the State Building Code, Shorewood has adopted into the Zoning Ordinance criteria for the construction of buildings. With respect to residential areas, the requirements were adopted to discourage mobile homes and pole barns. As a technicality, governmental buildings are not specifically addressed. A general requirement for all buildings in residential districts is that sheet or corrugated steel or aluminum siding is prohibited for buildings over 120 square feet in floor area. The mobile shelter comes with corrugated aluminum siding. The brochures we have seen suggest that other types of siding may be available. - 2 - Re: Manor Park Conditional Use 31 August 1989 warmi'House Permit . B. Building Code Requirements. The Park Commission has expressed a degree of frustration in the past with building code requirements, particularly with respect to having plans prepared by a registered architect. Several times we have been asked why other cities get by with portable buildings, trailers, etc. for park shelters. The vendor has referred us to a number of cities for whom they have provided temporary park shelters. As of this writing it appears that in most cases the building departments have been side-stepped. Parks departments have wheeled the units in without building department input and building officials have apparently looked the other way. There is a provision in the Building Code which gives the Building Official discretion to issue permits for temporary "miscellaneous" structures. Depending on an evaluation currently being made by the Building Inspector, this approach may be used here. If certain basic life safety requirements can be met, we may be able to issue the permit from this office. If we are not comfortable with the code compliance of the unit, the City Council may have to issue the permit. There is apparently neighborhood demand for some type of shelter facility. The concerns raised herein may be mitigated by the public interest being served. While temporary use of the portable building may be acceptable, it is not recommended as a long term solution for the park. Assuming a reasonable amount of use of the facility during the trial period, it is recommended that the Park Commission reconsider a permanent, low-maintenance building. FILE NO.: 405 (87.13) BACKGROUND The Shorewood Park Commission has prepared plans for a warming house/pavi1lion to be. located in Manor Park (see Site Location map ... Exhibit A, attached). Pursuant to Section 200.01 Subd. 4a. of the Shorewood Zoning Ordinance, a public hearing has been scheduled for the 5 May Planning Commission meeting to consider a conditional use permit for the facility. The proposed building measures 24' x 48' with half of it enclosed as a warming shelter and the other half open as a picnic pavillion. The building is surrounded by a concrete slab which covers a 34' x 58' area. Elevations of the proposed building are shown on Exhibit B, attached. As shown on Exhibit C the building is to be located 50 feet from the right-of-way of Manor Road and 35 feet from the east edge of the pond in the southwest comer of the park. ANALYSIS/RECOMMENDATION The proposed building is very residential in character and should be an amenity to the Manor Park neighborhood. Following is how the shelter complies with the criteria contained in Section 200.01 Subd. 4a. 1. Screening and Landscaping. Given the residential character of the proposed shelter, the need for screening is questionable. The premise was to grant a larger volume contract at a reduced rate. We began with fourteen cities and subsequently reduced to seven cities prior to bid proposal time. The representatives for the cities and county spoke with six potential con- tractors in an attempt to prepare a RFP. After the informational meetings with the contractors and a review of the current city recycling contract costs, we determined that it would not be beneficial for the West Hennepin County group of rural cities to participate in the bid proposals with the other lake area cities. Their current contract rates are very low in comparison to the more suburban cities and by continuing to participate in the bid proposal, their rate could increase. The RFP was then prepared by Hennepin County and sent to potential respondents. The cities included in the requests are Excelsior, Minnetonka Beach, Mound, Shorewood, Spring Park, Tonka Bay and Wayzata. Six bids were received for consideration by Nov 5, 1990. On Nov. 9th, we met to review the bid proposals and select a contractor. The group selected Knutson Services Inc., from Rosemount, Minnesota. Attached is a copy of the bid from Knutson Services. We have received a quotation of $1.70 per household per mouth for a weekly curbside collection, based upon a three year contract. As you will recall our contract currently with Waste Management is &$1.90 per household on a bi-weekly bases. I had received a proposed new contract rate for 1991 at $2.25 per household which would include plastics and cardboard. Our new contract will also include plastics and cardboard collected at curbside as well as at the drop off site. They will also provide office paper collection at City Hall and the drop off site. In addition to the good rate we have written in a provision for revenue sharing on the sale of the recycled materials. The City will receive a reimbursement of one-third of the revenue calulated from the "local spot market" price. I have met extensively with Mark Heieren of Knutson Services to fine tone additional contract details specifically for Shorewood. The basic contract format is being prepared by the staff in Wayzata and will be submitted to us for addition specifications negotiated for Shorewood. M I NUT E S CALL TO ORDER Acting Chairman Andrus called the meeting to order at 7:00 p.m. ROLL CALL Present: Chairman Christensen (late), Commissioners Lindstrom, Vogel, Andrus, Laberee, Wilson and Dzurak (late); Administrative Assistant Niccum; Council Liaison Watten; Public Works Director Zdrazil; and Park Planner Koegler APPROVAL OF MINUTES Lindstrom moved, Laberee seconded, to Tuesday, November 27, 1990, as written. 4 ayes - 1 abstain (Andrus) approve the minutes Motion carried - of BADGER PARK SHELTER REPAIR UPDATE - By Jim Norton Jim Norton, City of Shorewood Engineer, displayed the plans for repairing the Badger warming house. He explained the codes to the Commission. He said the moisture problem has been caused by several things: 1) there are no rain gutters - this causes a splash problem as high as two feet on the outside of the building; 2) the parking lot slopes toward the building; and 3) its possible that in the winter snow has been pushed in the direction of the building. He said the exterior walls are rotting. Norton explained, in detail, exactly what would be done to correct the problem. This includes removal and reinstallation of the interior wood panels, sidewalk replacement, and sill repair. Public Works has experimented with removing the panels, it will be a time-consuming job, and they would rather have the contractor do it if the cost is reasonable. Norton said the project has been discussed with the city Attorney, because the cost is below $15,000, performance and bid bonds are not necessary. Watten asked for an approximate estimate. Norton said approximately $8,500. He said the work has to be completed by December 15, 1990. \ SHOREWOOD PARK COMMISSION MINUTES TUESDAY, NOVEMBER 27, 1990 - Page two Watten questioned why concrete instead of blocks. Norton said the block was hard to work with, there is not any working area. They don't want to jeopardize the trusses or the roof. Also - concrete is cleaner. Public Works Director Zdrazil said Joe Pazandak, the city Building Inspector, had told him the building would have to be heated for 7 days before the concrete could be poured, and this would involve covering the whole building with plastic. He strongly recommended waiting until Spring to do the project. Commissioner's Lindstrom and Wilson agreed with Zdrazil. Norton said there is a 3' overhang on the building, but no gutters. He recommended installing them. He also discussed the sidewalk, saying its possible that it may be blacktopped. Watten recommended installing a wood base around the interior walls. He said this would cover up any imperfections in the rubber flooring, and make it easier to install the flooring. Norton said the bids will be in soon. EXCELSIOR SLO PITCH LEAGUE DONATION Todd Strot, Director of the Excelsior Slo pitch League, presented the Park Commission with a check for $1000. He specified that they want the money used for playground equipment near the ballfields in Freeman Park. He said the City did a great job on Freeman Park. He said their purpose in holding the tournament was to raise money for the parks. They plan to hold a tournament for this purpose every year. He specifically thanked Sue Niccum, Don Zdrazil, and Dan Randall for making the tournament possible. He said they received a lot of compliments from people from other cities. He admired the City's desire to do the job right without cutting corners, and for putting in the irrigation--he said too many cities cut corners, and pay for it later. He also said they will be working with Community Services next year on scheduling. They will also be working with other Leagues, such as Co-Rec and Church Leagues. They have changed the name of the league to "South Shore Softball League", so that both Shorewood and Excelsior will be included. SHOREWOOD PARK COMMISSION MINUTES TUESDAY, NOVEMBER 27, 1990 -Page three POSSIBLE PARKING PROBLEMS - FREEMAN PARK The Commission discussed the fact that if softball and soccer are going on at the same time - parking could be a problem, and more space may be needed. They discussed a volunteer in the parking lot to direct parking, or marking the big lot with posts and chains. Watten said if the map is to scale, the 3 lots will hold 250 cars. MARKING CROSS COUNTRY SKI TRAILS IN FREEMAN PARK Watt en suggested that the trails be marked for cross country skiing. Koegler said there is a small skier symbol that can be used. The Commission agreed to have Koegler locate the trails, and to use laminated signs. CONTINUED REFERENDUM DISCUSSION/MASTER PLANS - By Mark Koeqler The fill permits have been ordered for Silverwood Park, we should have them in 30-60 days. Mark will check the parking in Freeman Park. The Commission mentioned the Highway 7 entrance to Freeman Park, the turn lane is shallow, there are trees blocking the entrance, and the signage is not placed properly -- in general -- it is still difficult to see, and easy to miss turn off. The Commission discussed various locations for parking at Cathcart. Koegler will look into this. . Koegler needs more information regarding Manor Park. The Commission reviewed the current master plans. Koegler will have the changes discussed tonight on the master plans, and the trail plan will be worked on at the January 14 meeting. UPDATE OF CONSTRUCTION PROJECTS IN FREEMAN PARK The new Little League Field is sodded, the outfield is seeded, the irrigation system is installed and blown out for winter, and the holes for the fencing are dug. SHOREWOOD PARK COMMISSION MINUTES TUESDAY, NOVEMBER 27, 1990 - Page four The irrigation on Lindstrom, Kelly, and Keeler fields has been tested and blown out, and the drinking fountain has been tested. The trenching areas will be rolled in the spring. There is a 2 yr. warranty. The other areas that needed repair have been seeded and top-dressed. MINNEWASHTA CHURCH PROPERTY TRAILS Zdrazil said the Commission should consider and decide whether they want blacktop or woodchips on the trails in the parks. He said the City of Minnetonka has gone to all blacktop. Chips have to be replaced every year. Minnetonka has said Shorewood can have all their woodchips. It was estimated that with blacktop approximately $6 a square yard, and 8' trail would cost $6 a lineal foot. Someone mentioned bike trails along the roads. Don said it was like comparing apples and oranges to try to compare the two.
