CALL TO ORDER
The Regular Council meeting of the Shorewood City Council was called
to order at 7:30 PM on Monday, January 8, 1990, in the Council Chambers
by Mayor Haugen.

Mayor Haugen opened the Regular Council meeting with the Pledge of
Allegiance.

Resolution Making Appointments to Certain Offices and Positions within

Brancel moved, Gagne seconded, to approve:
a Si~n Permit for Mr. Harry Niemela for Echo Fields at 19385 State
Hi~hway 7, allowing him to increase the face of an existing free-
standing 5' x 8' sign with another 5' x 8' sign for the clothing
store (Echo Fields),
and, the date for the Local Board of Review as Wednesday, April 18,
1990 at 7:30 PM.

ACCEPTANCE OF STREETS, WATERMAIN, SANITARY RESOLUTION NO. 2-90
SEWER AND STORM SEWER IN THE PLAT OF BRENTRIDGE
Gagne asked City Engineer Norton if the above are all satisfactory, and
ready to accept? Norton said yes.
Gagne moved, Stover secc>nded, to adopt Resolution No. 2-90 - "A Resolution
Accepting Streets, Watermain, Sanitary Sewer and Storm Sewer in tbe Plat
of Brentridge". Motion carried by roll call vote - 5/0.
BRENTRIDGE - RELEASE OF LETTER OF CREDIT

RESOLUTION NO. 3-90
Stover asked if the Developer didn't finish some or all of the stipulated
work, if it would become a City problem? She was told it could happen.
She said this left her. with an uncomfortable feeling. She wondered if
the $2000 deposit would be an adequate amount if any problems arose.
The Council felt that Public Works has enough to do without ending up
finishing a job that is not their responsibility. They also discussed
the easement that the Developer is to obtain.
Watten moved, Brancel seconded, to adopt Resolution No. 3-90 - "A
Resolution Releasing Letter of Credit Furnished by Brentridge" with the
following amendments:
a. That Developer provide a cash deposit or certified check in the sum
of $5,000 to ensure the completion of minor items specified by the
City Engineer, which items shall be completed on or before July 1, 1990.

REQUEST FOR "NO PARKING" SIGNS - RESOLUTION NO. 9-90
SERVICE ROAD NORTH OF HIGHWAY 7
BETWEEN LAKE LINDEN DRIVE AND HIGHWAY 41
Haugen asked about "No overnight Parking" signs, and if they could be
posted in the shopping center parking lot? Planner Nielsen said Ryan
Construction had already posted such signs, and that is when people
started parking out on the service road.
Gagne moved. Brancel seconded. to adopt Resolution No. 9-90 - "A
Resolution to post "No Parking" signs along the north service road of
State Highway 7 between Lake Linden Drive and Highway 41". Motion
carried by roll call vote - 5/0.
A REQUEST FOR AN EXTENSION FROM
METROPOLITAN COUNCIL TO AMEND
THE SHOREWOOD COMPREHENSIVE PLAN
PER THE SYSTEM STATEMENT
RESOLUTION NO. 8-90
Stover moved. Watten seconded. to adopt Resolution No. '8-90 - "A
Resolution Requesting an Extension from Metropolitan Council to Amend
the City of Shorewood Comprehensive Plan per the System Statement".
Motion carried by ro~l call vote - 5/0.
PARK COMMISSION REPORT
Park Commissioner Gordon Linustrom was present. He told the Council
that Manor Park skating rink is really getting a lot of use. The
lighting has been installed and is quite effective. He said if the
Council had any questions he would relay them to the Commission at
the meeting tomorrow night. He also said the Silverwood Park Questionnaire
results will be presented at tomorrow nigh~s meeting. He mentioned
the trails in Freeman Park and said the Southwest Trail Association has
volunteered to groom them for the City. This will be discussed at
greater length at the Park meeting. He said the Commission wanted to
thank Gagne for a job well done in 1989, and welcome Vern Watten as
their new liaison.

C.U.P. TO EXCEED 1000 SQ. FT. OF ACCESSORY SPACE - CONTINUED FROM
DECEMBER 5, 1989

Stover reported that the Planning Commission approved the Conditional
Use Permit to exceed 1000 square feet of accessory space unanicously.
She said only one question arose, one regarding the roof height, and
that was solved.
Brancel moved, Gagne seconded, to instruct the City Attorney to draw
Findings of Fact and a Resolution approving a Conditional Use Permit
to exceed 1000 square feet of accessory space for Harley Feldman at
5635 Christmas lake Point. Motion carried - 5/0.
Planner Nielsen said due to the fact that this request had been postponed,
and that there are no special conditions imposed, he requested the Council
to allow the applicant to proceed at this time by allowing the issuance
of a building permit.
Stover moved, Gagne seconded, to approve the issuance of a Building Permit
to Harley Feldman at 5635 Christmas Lake Point so that work can proceed.
Motion carried - 5/0.
SIMPLE SUBDIVISION/LOT COMBINATION
RESOLUTION NO. 10-90

Stover reported that the Planning Commission unanimously approved the
simple subdivision/lot split. They did, however, add two conditions
to the six conditions recommended by the Planner.
7. The applicant may only build a single family dwelling on the property,
a double will not be allowed.
8. Any future improvements must comply with required setbacks. No
variances are anticipated.
The Council questioned the area designated as wetland. The City
Engineer said he does not see this area as a necessary storage basin.
Haugen asked Attorney Froberg if the area is on the Shorewood wetlands
map, if the Council should only approve the lot split? He said this
issue would have to be examined at the time the building permit is issued.
Gagne moved, Brancel seconded, to adopt Resolution No. 10-90 - "A
Resolution Approving a Simple Subdivision/Lot Combination for Bruce
Prescher for Plumbline Builders at 6060 Lake Linden Drive, contingent
upon the six conditions listed in the Planner's Report of December 28,
1989, and the two conditions listed in the Planning Commission Minutes
of January 2, 1990. Motion carried by roll call vote - 5/0.

SHOREWOOD WETLAND AREAS
The Council discussed the wetlands and felt that this is an issue that
should be studied by,othe Planning Commission in the future.

Stover reported that the Planning Commission recommended approval with
the Planner's recommendations included.
The driveway and access were discussed.
Brancel moved, Watten seconded, to approve Resolution No. 11-90 - "A
Resolution allowing a Simple Subdivision of Real Property at 5220
St. Albans Bay Road" contingent upon the Planner's recommendations(5)
listed in his report of December 29, 1989. Motion carried by roll
call vote - 5/0.
Lot 86 of Auditors Subdivision 141 and Lot 2 of St. Albans Bay Hei~hts
Plowman said if the City was willing to forgive taxes on Lot 86, a
substandard lot with a substandard house on it, he would tear the
house down and combine the above lots.
Stover said the taxes due are not only City taxes, but School District,
etc. Lot 86 is 8,000 sq. ft. and Lot 2 is 35,000 sq. ft.
One house would then be built on the combined property.
Council directed Attorney Froberg to research the tax situation and
prepare a recommendation for the next meeting.
COST ESTIMATES - FEASIBILITY STUDY FOR SOFTENING AND/OR IRON REMOVAL
PLANT S. E. AREA WATER SYSTEM
Planner Nielsen, representing Administrator Whittaker, requested tabling.
Gagne moved, Stover seconded, to table the issue to review proposals
with both firms to explain cost difference. Motion carried - 5/0.
WEST SUBURBAN MEDIATION CENTER
Watten moved, Gagne seconded, to deny the request for a $700 contribution
to the West Suburban Mediation Center. Motion to deny carried - 5/0.

Status of Widmer Lawsuit
Attorney Froberg said the Final Motions will be held on Tuesday,
January 16, 1990, at 9:00 AM and the trial will take place on
Monday, January 22, 1990, at 9:00 AM. These will take place at
the Hennepin County Government Center. Froberg did suggest that
if you plan on attending ---_pleCl!.;g_~heck with hJta first to see
if any time changes have taken place.

Attorney Froberg said Ms. Lovrein is still waiting for necessary
information.
Stover moved, Gagne seconded, to continue the matter until the meeting
of January 22, 1990. Motion carried - 5/0.
ENGINEER'S REPORT
MSA Report
Engineer Norton attended a meeting December 28, 1989. He met with the
District State Aid Engineer. He was given an "Annual Certification
of Mileage" report. He completed and returned the report on January 1,
1990. Mr. Ken Strauss gave Engineer Norton the figures shown for the
City's 1990 allocation.
Population - $ 89,416.
Needs - 58,659.
Total $ 148,075
Norton said this was based on a population of 5,612. He said last
year's allocation was $21,000.
Planner Nielsen explained that the first year they base the amount
on the figures required by a city similar to Shorewood. Next year
Shorewood will receive funding based upon their own needs and population.
Norton said East Bethel was the city used for comparison purposes.
Glen Road DrainaKe
Engineer Norton said he talked to Jim Mahady at Administrator Whittaker'E
request. Action was taken and approval given. Norton received a copy
of the agreement. The original will be sent the Administrator
Whittaker so he can execute the contract.
PLANNER'S REPORT
Cellular One - Mobile Phones
The Council discussed accepting up to three mobile phones from
Cellular One. They also discussed costs, including installation,
air time, basic rates, Federal charges, etc. After further discussion
it was decided that the City should not accept the car phones, but if
the police want them, to include the phones in the lease negotiations.
The Council would like more information on costs.

PLANNER'S REPORT ~ Continued
Mrs. G. F. Latterner - Status of ZoninK Violations and Junk Violation
Planner Nielsen said he had been there today. The boat trailers and
boat cradles have been removed. There is still one fish house on the
property. If this is not removed soon he will send a letter.
Edsell GOKKans - 26960 West 62nd Street - Junk Complaint
Planner Nielsen said the City cleaned this up. The cars are still
there. They will be towed if not removed. Goggans will be billed
if they are towed. If payment is not received, the cost will be
certified to taxes.
ADMINISTRATOR'S REPORT
Hennepin County CompostinK Sites
This will be on the January 22nd agenda because we are still waiting
for information.
Permanent Animal Control Contract
This will be on the January 22nd agenda because the City of Chanhassen
votes at their meeting tonight.
Second Fire Proof File from 1989 Microfilm BudKet
Gagne moved, Brancel seconded, to approve purchase of a second fire
proof file, using extra funds from microfilm budget. Motion carried-
5/0.
Extend Hours for Ginny Smith
Decision postponed until January 22 meeting.
Animal Contract with Clinic
Stover asked if the contract with the Clinic could be signed right
away. Attorney Froberg said there is a paragraph in the contract that
he wants to check with the insurance company before signing the contract
MAYOR'S REPORT
LMCD InterKovernmental MeetinK
Thursday, January 18, 1990 - 7:00 PM - Tonka Bay City Hall
Haugen said they would discuss funding for LMCD. They are also
discussing letting others join the board (i.e. DNR, Watershed).
Haugen also said the LMCD has decided that if a City's Represnetative
to LMCD is not attending meetings, or doing a good job, the City can
ask for their resignation.

Chapter 105 - Code of Ethics
Haugen asked that the forms be sent to the Council and all Commissions
in the next packet, or individually.
AMM MeetinK - Saturday, January 27, 1990 - Hopkins House - 9:00-10:30 AM
Haugen would like to see as many as possible attend this meeting. She
encouraged Administrator Whittaker and Planner Nielsen to attend. This
gives us the opportunity to meet the Legislators. Future City concerns
will be discussed (i.e. taxes, legislation, solid waste, property taxes,
land use). The City will pay the $5 cost. Staff is requested to
contact Knickerbocker, Gen Olson, and Jim Ramstead, and invite them to
the meeting.
Clarence Clofer Post 1259 - $5,000 Donation
American Legion Post #259 has donated $5,000 for the reconstruction
of the Cathcart Hockey Rink.
COUNCIL REPORTS
Stover - Fence Ordinance
The Planning Commission will study the Fence Ordinance the 1st week
in February.
RecyclinK Bins - Shorewood ShoppinK Center
Gagne feels bins should be removed - its a mess! Watten agrees.
Brancel and Stover feel it should be moved th City Hall parking lot
on a trial basis. A relocation sign would have to be placed at the
Shorewood Shopping Center. Staff is requested to negotiate with the
League of Woment Voters. A time limit is requested for the trial.
Council feels recycling has to be promoted. The people have to
be educated. Haugen suggested picking a resident at random on
recycling day; and if they are recycling, pay them a stipulated
amount of money.
The availibility of extra bins was also discussed.

Feasibility Study, Iron Removal/treatment for S.E. Area water system
I think a simple effort to "test" our engineering fees ( by getting
competitive bids for this study) has become a very complicated pro-
cess of assessing our approach to the problem.
Associated consultants has responded to our RFP is the simplest terms.
They propose to determine the cost of an iron removal and/or softening
plant for the S.E. Area water system...for $3,000. They will also es-
timate the costs of an alternate site(s), if necessary...for $500.
OSM proposes to conduct a "feasibility study". This goes well beyond
estimating a cost to "bounce-off" the affected residents. Under their
proposal, "feasibility" includes answering all of the questions for a
Chapter 429 Feasibility Hearing (Is this the best/only site? Can this
be accomodated on the Silverwood Park site given park plans, neighbor-
hood expectations, aesthetics? Is something other than a standard iron
filtration system desireable? Can we minimize the impact of the plant
by employing higher filter loading rates - not yet approved by the
Minnesota Department of Health? Do we need to evaluate and implement
the radio control system with the treatment plant? Do we need or would
it be cost-effective to put in an alternative energy system? What will
it cost to disinfect the system should the State require that? How
could we finance these improvements? How does this compare to "treatment"
costs we have now - polyphos, hydrant flushing, etc.)
I think we would want to - or need to - answer all of these questions
if the "approximate" cost of a basic iron removal/treatment plant is
tenable. But, I think a cost estimate that could be presented to the
affected residents at an informational meeting is a more practical
first step.
Yes, this might result in a greater margin of error and, possibly, some
duplimtion of effort if we go into a full-blown 429 feasibility hear-
ing; but, it's a much smaller investment and will probably provide
enough information for the residents to react to and the Council to get
adequate direction from.
The basic costs - without looking at alternative sites, filters, and
treatment standards - will be illuminating enough to take the next

steps.
If the cost of a basic system on the current well site is unacceptable
to the residents and the Council - or you agree that residents would
rather solve the problem individually - or, for the most part, already
have solved it individually - further study won't be necessary.
If there is a positive response to the initial cost estimate - and we
will be conservative in making this estimate, we could then proceed
to fill in the blanks.
While I think both firms are capable and competent to do the study,
OSM has a stronger set of qualifications. The City Engineer has been
personally involved in several of these studies for other cities and,
from the proposals, it seems OSM is on the cutting edge of technology.
However, I don't think we need this much study YET and we can address
"all the possibilities" once we have a better assessment of "demand"
for this project.
I recommend we ask OSM if they can provide the basic information at
the cost proposed by Associated Consultants - simply because their
knowledge of the system and the community will be very valuable should
we proceed with the project.
If OSM does not believe it can comfortably do this, I think we should
hire Associated Consultants at $3,500 for the initial cost estimate.
I simply cannot justify the additional expense of $8,500 before we
give the Council and residents a chance to react to this.
I have to make this comment, also, as it may be on your minds too. I
think you can "over-engineer" a project. And, while I appreciate the
prompt, thorough service we have had from OSM... and the competence
and experience they bring to this project, we need to examine the level
of engineering required and the cost for it more closely than we have.
"?erfect" engineering would be nice; but, practical solutions are possible
without it. Like the ballfield fences, you tend to eliminate risk and
error as the amount of study and the fee go up. But, a whole lot of
people get over 100,000 miles on a car and never own a Mercedes. And,
finally, even that Mercedes can be a problem sometimes.

The Minnesota Department of Transportation has submitted a 4th
Alternative layout for our review on Christmas Lake Road and S.T.H
No.7. As stated in their December 5, 1989 letter to the City they
say "We feel this is the best alternative for this intersection.
It minimizes the impacts and solves the safety problems." They are
asking for preliminary concept approval on this proposed layout.
Some of the major items that MnDOT proposes on this alternative are
listed as follows:
1. The new intersection will be moved approximately 150' west of
its present location.
2. This option widens T.H. 7 to the south. As a result:
A. One residential relocation at 21285 Radisson Road is
proposed.
B. Two garages would have to be moved.
1. 21265 Radisson Road
2. 21235 Radisson Road
3. Several access points to T.H. 7 would be closed.
A. Radisson Road
B. Radisson Entrance - cul-de-sac proposed.
C. Greenwood Side
4. Northland Yachts would have to be relocated. (Greenwood)
5. A retaining wall would be constructed along Radisson Road.
6. The M.W.C.C. Lift station would have to be relocated.

The staff has reviewed this alternative, along with the others.
Taking all the items into consideration, we feel Alternative No.
4 is the preferred layout and recommend the Council approve it as
the preferred conceptual alternative.
Representatives from MnDOT will be at the Council Meeting, Monday
night, January 22, 1990 to answer any questions you may have.

We received the latest proposed intersection layout (Alternative
No.3) for Vine Hill Road and S. T. H. 7 from the Minnesota
Department of Transportation in their January 10, 1990 letter to
us. They are asking for concept approval from the city Council on
this alternative.
The staff has reviewed this proposed geometrical layout and how it
impacts the city. Some of the major impacts of this alternative
are as follows:
1. Three existing business will be removed.
A. Burger King
B. Shorewood Liquor
C. Arnolds
2. The new intersection is proposed to be located approximately
100' east from its current location.
3. It encroaches on the north edge of Lot 8, Block 1 in the Shady
Hills Addition.
4. Two residences in Deephaven must be removed.
Representatives from MnDOT will be at the Monday night Council
Meeting, January 22, 1990 to address these issues. Along with
these issues staff has discussed with them the frontage road issue
and access to commercial property as a result of this proposed
work.
While this layout significantly impacts the City of Shorewood,it
represents a long history of alternatives that have been reviewed

RE: SOUTHEAST AREA TRAFFIC IMPROVEMENTS

At the 13 November Council meeting the City Council directed staff to explore
ways to discourage nonlocal traffic from using the Old Market Road/Covington
Road/Vine Hill Road collector alignment as a shortcut between State Highway 7
and the future West 62nd Crosstown.
After several meetings with the City of Minnetonka staff and Hennepin County
highway engineers, the Shorewood staff recommends the following:
A. Speed Limit. While the range of speed limits for a collector street is
30-40 m.p.h., it has never been suggested that the speed limit for the
road in question be any higher than 30 m.p.h. This is the same as the
speed limit specified for local streets.
B. stop Signs. Based upon past experience the City recognizes that
unjustified stop signs do not serve to deter speed. stop signs in
inappropriate locations can actually create more problems than they
solve. There are, however, certain locations in the proposed collector
alignment that can be justified; 1) a four-way stop at the intersection of
Old Market Road and the Highway 7 service road; 2) a four-way stop at the
intersection of Covington Road and Sweetwater Curve; and 3) a three-way
stop at Covington Road and Vine HIll Road.
C. Pedestrian Improvements. At such time as plans are prepared for upgrading
Covington Road between Old Market Road and Vine Hill Road, the City should
give serious consideration to the construction of sidewalks along at least
the east side of Old Market Road and the north side of Covington Road.
Adequate right-of-way has been acquired for this purpose.

It is also recommended that pedestrian crosswalks be located at the
Sweetwater Curve/Covington Road intersection and at Silverwood Park where
the trail easement to Silver Lake is located.
Finally, the City has acquired land and trail easements which provide for
a trail system extending from the north side of Silverwood Park to the
south service road of Highway 7. This future trail system will allow all
of the residents of Covington Vine Ridge and Shady Hills and many
residents of waterford to access the park without having to use the
collector street. Priority for improving the trail system should be
assigned in conjunction with plans to upgrade Covington Road and
Silverwood Park.
D. Intersection of Covington Road and Vine Hill Road. The street plan for
the southeast area (see Exhibit A, attached) shows Covington Road sweeping
south into Vine Hill Road and Vine Hill Road teeing into the new curve
from the north.
This improvement involves participation by the City of Minnetonka. They
are not in a position to make this decision until a determination on the
future of the Crosstown has been made (see item E for more on this).
It is therefore recommended that this improvement be delayed until more is
known about the future of the Crosstown. If the intersection is revised
per the current plan, it could be made into a three-way stop.

Minnetonka has serious concerns about the proposed design for Crosstown,
specifically how Hennepin County proposes to cross wetland areas adjoining
Purgatory Creek. As a consequence they are not in a position to make a
decision on the Townline Road/Highway 101 intersection until more is
resolved on the Crosstown issue - something which may take quite some
time.
Staff will continue to work with Minnetonka as they study the Crosstown
issue.
Based upon the preceding items A and B can be implemented immediately. Item C
should be coordinated with plans for upgrading Covington Road and Silverwood
Park and items D and E coordinated with Minnetonka's review of the Crosstown
plans.

The manager of the above referenced business, located at 24365 Smithtown Road,
has requested a temporary sign permit. He proposes to erect a 4'x8' temporary
sign permit to announce a car wash special.
Section 1201.03 Subd. llc.(4) of the City Code provides for the use of
temporary signs twice within any 12 month period, seven days at a time and no
larger than 32 square feet in area. Our records indicate that their last
permit was issued through 16 January 1989
The commerical zoning of the site allows the sign to be lit, but it shall not
flash or blink. The sign must be located at least five feet from any property
line and can't obstruct visibility for automobiles entering or exiting the
site.
Ordinarily this would be a consent agenda item, however, it is anticipated that
the Council will want to discuss the soil ventilation system with the owner of
the site. The applicant has been advised of this.

The City must decide if any public purpose exists for four tax forfeited
properties. Only one of the parcels has presented some interest for public use
_ the one at approximately 26620 Smithtown Road. possible uses which have been
discussed are a public works department site on a site for an elderly housing
project.
~he site contains 10.4 acres of mostly buildable ground, accessed by a 50 foot
strip of property on Smithtown Road. with the exception of its size the site
fails to meet most of the criteria for a good public works site which has been
developed by the Public Works Director and me. Proximity to low density
single-family residential is a major drawback.
Similarly, the site is not conducive to an elderly housing project, because of
its proximity to single-family residential property.
It is recommended that the parcel on Smithtown Road, as well as the remaining
three sites, be released for public sale.

The second draft of the proposed rental housing code will be forwarded under
separate cover in time for Monday night's meeting. At the meeting the Council
should decide if they want to review it further (that night or at a study
session) or schedule a public hearing after which it would be studied in the
context of public comment. The Council should also decide whether you or the
Planning Commission should conduct the hearing.
The second draft will contain revisions based on all comments received to-date
from the Planning Commission and Council members. If you have any questions,

A RESOLUTION GRANTING A CONDITIONAL USE PERl,IIT
FOR ADDITIONAL ACCESSORY SPACE
TO HARLEY FELDHAN
HHEREAS, Harley Feldman (Applicant) is the owner of certain real
pr~erty located at 5635 Christmas Lake Point in the City of S horewood,
c,mty of Hennepin, State of l,finnesota, legally described in Exhibit A,
~ached hereto and made a part hereof; and
(
WHEREAS, Applicant has applied to the City for a Conditional Use
Permit (C UP) for the construction of a new home which includes a 24' x 49'
attached garage, having a total accessory space area of 1,181 square feet;
and
WHEREAS, the Shorewood City Code requires a Conditional Use
Permit for the construction of accessory space containing a total square
footage in excess of 1,000 square feet; and
WHEREAS, the application was revieHed by the Shorewood Planning
Commission at a public hearing held on 5 December 1989, continued to 2
January 1990, and approval was recommended by the Commission.
WHEREAS, the Applicant's application was considered by the City
Council at their regular meeting held on January 8, 1990, at which time
the Planner's memorandum was reviewed, the minutes of the Planning
Commission ",,,ere revievled, comments Here heard from City Council members
and staff, and the City Attorney was directed to prepare a resolution
setting forth findings and conclusions approving the application.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood as follows:
FINDINGS OF FACT
1. T hat the total proposed accessory space (1,181 square feet)
does not exceed the "footprint" area of the principal structure (2, 724
square feet).
2. T hat the total area of the accessory space does not exceed
ten per cent (10%) of the minimum lot area for the R-1C zoning district in
which it is located (2,000 square feet).
3. T hat the house and garage comply with all setback
requirements of the R-1C and shoreland districts.

ORDINANCE NO. 216
AN ORDINANCE AMENDING CHAPTER 501 OF THE SHOREWOOD CITY CODE
RELATING TO GENERAL HEALTH AND SAFETY PROVISIONS
THE CITY COUNCIL OF THE CITY OF SHOREWOOD, MINNESOTA, ORDAINS:
Section 1. City Code Section 501.01, Subd. 3, is hereby amended to read
as follows:
"Subd. 3. Failure to Remove: If, at the end of said ten (10)
days following service of such notice, the offensive matter has not been
removed, the City shall cause removal and disposition. A motor vehicle
removed under this section shall be disposed of as an "abandoned vehicle"
pursuant to Chapter 503 of this code."
Section 2. City Code Chapter 501 is further amended by adding a neVi
section to read as follows:
"501.04: VIOLATION: Any person violating the provisions of this
Chapter shall be guilty of a misdemeanor"

ADMINISTRATOR'S REPORT, Jan. 22 Council meeting
RECYCLING:
Shorewood Center - I postponed moving the recycling bins from the
Center to City Hall as the bins at the Center still generate over half
the materials we use to justify our reimbursement grants. (See attached
report. ) Even though we spend about $200 per month cleaning up the
site, we qualify for about $500 more in reimbursement because of the
volume generated at the site. We do not think we will get that volume
at City Hall.
I suggest two alternatives:
1. Include the site elena-up costs in our recycling budget - for
80% reimbursement; and,
2. We wait another month or two to see if the recycling bins we
distriouted result in higher participation - and higher volume -
at curbside.
We might also put bins at the City Hall to see if the volume is any
where near what we get at the Center. This would only cost $35/month.
Extra Bins - Residents have already asked for additional bins and,
soon, I'm sure a resident will lose a bin and want replacement. While
the first 2300 bins were 80% reimbursed by the County, replacements will
be at our expense (about $7.00 each). I think we should reserve our
"extra" bins for new homes - as we proposed to the County when we were
reimbursed; AND, I think we should set a fee of $7.00 each for additional
or replacement bins.
Rewards - We do not have a computerized system to make random "re-
ward" drawings; but, if you think a reward will greatly enhance the parti-
cipation, we can devise some system to do it.
I think a more valuabl~ long-term incentive might be a credit on
utility bills. This, however, requires house by house reports from
the hauler - and most cities have employed a bar code reader to keep
track of this. Waste Management does not have such a system at this
time.
2. COMPOSTING: I will be attending the County t~sk force meeting to
morrow and the Cities' meeting on the 24th - ana wlll know more then.

Sites - a more critical issue at this time, however, is securing
a future transfer site.
The two sites we identified as potential public works/compost trans-
fer sites are "on the market". The site behind Minnetonka Center is
for sale and, I understand, there are interested parties. And, the site
near Freeman Park is already being considered by the Westonka Men.s Club
for a Little League Field.
In short, I think we need to act on the public works site or we
may not have a site. Staff need authority to contact and negotiate
with the owners of these sites so that we can get back to the Council
in February.
3. Animal Control
1. The City of Chanhassen has agreed to offer us a three-year
contract at $22.00 per hour. I recommend we accept that offer
and authorize the Mayor and Administrator to execute a contract
for the service. It will be far cheaper than establishing the service
through SLMPSD.
2. Our Animal Control officer advises me that they can intensify
patrol in a specific area within the contr~c~~dtime. However, if you
want to pay for it, both Tonka Bay and Excelsior would be happy to give
up some patrol time for additional vigilance in Shorewood. I would
prefer to try to solve the problem without the expense - and, then,
consider extra patrol.
3. The insurance questions have been resolved and we have executed
the contract withthe Waconia/Chanhassen Veterinary Clinic for pound
services.
4. Codification
1. Sterling Codifiers has given us a quote of $1840.00 to update
115 pages of the 1987 City Code and make fifty (50) copies of the
Code Supplement. Glen and I agreed that this is a very reasonable
price and recommend approval.
2. Subscriber service provides for automatic updates to the Code
for those who have books and want to keep them up to date. Most of
our Code books belong to City employees and volunteers. I don't think
we can charge them. However, if there are private firms, we should
charge reproduction costs - as we now do for copies of the Zoning and
Subdivision Ordinances. I recommend 35i per page.
5. Legislative Conference - Please let me know Monday night if you
plan to attend.

AD FOR BIDS - COMPUTER HARDWARE AND SOF'IWARE
As you know, the city staff, with the aid of a consultant, has been in the
process of identifYing the City's computer hardware and software needs.
With this process completed, we are now ready to proceed with the search
for the equipment and programs that will fulfill those needs. It is,
therefore, recanmended that the City Council authorize the advertisement
for bids for computer hardware and software.
Jim Ste rn, our computer consult an t, has supplied us with a sample Request
for Proposal (RFP) and has recommended that we adapt our computer needs to
this sample and enter into the bidding process. He feels that this
process will be the most efficient way to obtain competative bids on
computer equipm:lnt and programs that most closely match our needs. The
RFP will be structured so that the City may accept all or any part of any
particular bid, or reject all bids completely.
It is then recommended that the City Council authorize the Ad for Bids
with a bid opening date of March 5, 1990. The bids will be tabulated and
the most compatable products will be investigated. A recommendation to
purchase will be presented for your approval upon completion of this
process.

please call me at any time. Your input is encouraged and your suggestions
are more than welcome.
