MINUTES
CALL TO ORDER
The Regular Council meeting of the Shorewood City Council was
called to order at 7:30 P.M., Monday, November 14, 1988, by
Mayor Rascop.
PLEDGE OF ALLEGIANCE AND PRAYER
Mayor Rascop opened the meeting with the Pledge of Allegiance and
a prayer.
ROLL CALL

APPROVAL OF MINUTES
Brancel moved, Gagne seconded, to approve the Regular minutes of
October 24, 1988. Motion carried - 5 ayes.
Brancel moved, Gagne seconded, to approve the Special meeting
minutes as written. Motion carried - 5 ayes.
MATTERS FROM THE FLOOR
Beaver Complaint - Water ford Pond
Mr. Jack Ocenasak of 5505 Waterford Circle appeared. He pre-
sented pictures, explained damage, and asked for a solution.
Administrator Vogt stated he had attempted to get a live trapper
and was told live trapping will not work due to the area where.
traps would have to be set, and the beavers would drown. He
also said relocation won't work because beavers are too plen-
tiful.
Haugen said she talked to several residents and discovered the
beavers have plugged the storm sewer, a situation that could
cause serious problems.
Haugen moved to amend the Ordinance to provide leeway for the
Council to act in emergency situations. Gagne seconded for
discussion purposes. Motion was amended to direct City Attorney

Beaver Complaint - Waterford Pond - Continued
Froberg to draft an amendment to the trapping Ordinance, being
very specific regarding instances of use and procedures, for
the November 28th meeting. Motion carried - 5 ayes.
Upper Lake Minnetonka Yacht Club
Resolution No.138-88
Mr. John Dennis, of the Upper Lake Minnetonka Yacht Club, appear-
ed to state the Club is moving to Spring Park, and asked for
approval of the move.
Mayor Rascop moved, Haugen seconded, to support a Resolution
commending the Upper Lake Minnetonka Yacht Club for moving from
R-l residential to commercial zoning in Spring Park thus elimi-
nating a Conditional Use Permit. Motion carried by Roll Call
Vote - 5 ayes.
PLANNING COMMISSION REPORT
Stover said there were six public hearings. She will report on them
as they appear on this agenda.
LIGHTING-CITY HALL PARKING LOT
There have been complaints about darkness from people entering City
Hall at night.
Haugen moved, Gagne seconded, to direct the City Engineer to draw up
a parking lot lighting plan and cost estimate. Motion carried - 5 ayes.
PARK COMMISSION
Freeman Park-Payment Delay Request
Brancel moved, Gagne seconded, to remove item B-3, Payment
Voucher for watermain, parking lot, and ballfields-Freeman park-
Project No.88-2, and item C, Home Energy Check-up Program, from
the Consent Agenda. Motion carried-'5 ayes.
Administrator Vogt has spoken to the Freeman Park contractor,
T & S Excavating and they will solve the rock problem on the
outfields. The City Engineer will varify all grades. If there
is a grading problem Widmer will be brought back as they have a
one year maintenance bond. Administrator Vogt will send a letter
to T & S Excavating explaining why payment is being delayed.

PARK COMMISSION - Continue
Manor Park Warminq House/Pavilion
Planner Nielsen stated the Conditional Use Permit, (Passed for
Lepo~ky's signed architectual plan) has expired. Administrator
Vogt recommends RFP's from architectural firms for the building.
Brancel moved, Gagne seconded, to direct Administrator Vogt to
get RFP's for the warming house/pavilion, fitting the Park
Commission's request, either designing their own plan or using
Lepowsky's signed plan as a base, in the $15,000.00-$20,000.00
range. Motion carried - 5 ayes.
BMX Track
Brancel moved, Gagne seconded, to remove the portion of BMX
track that is on a neighbors property. Motion carried - 5 ayes.

Candy/Pop Sale - Cathcart Park
Park Commission requested that only Martey Jakel be allowed to
sell pop and candy only at Cathcart only on the Sundays they
have musical skating, with proceeds to go to the Park Fund.
Brancel moved, Gagne seconded, to table this issue until research
is done to see if this is allowed by Ordinance. Motion carried -
5 ayes.
Snowmobile Trails - Request to Southwest Trail Association
The Park Commission requests contacting the above association
to see if they will mark trails in order to prevent problems,
mainly around Cathcart skating rink.
Mayor Rascop moved, Gagne seconded, to direct Administrator Vogt
to draft a letter to Southwest Trails Association requesting
marking of trails and to express the fact that complaints have
been received regarding speed, late hours, etc. and ask about
better policing. Motion carried - 5 ayes.

Resolution No.147-88
The election results from the November 8, 1988 General Election
were presented for approval.
Payment Voucher-Seal Coatinq and Overlay-Project No.88-1
Engineer Norton recommended approval of the third and final
payment voucher for Seal Coating and overlay-Project No.88-1
in the amount of $11,504.00 to H.L. Johnson Company.
Payment Voucher - S.E. Area Water Tank - Project No.86-1D
Engineer Norton recommended approval of the eighth payment
voucher for S.E. Area Water Tank - Project No.86-1D in the

Engineer Norton recommends taking over the ownership and main-
tenance of the street (Christopher Road) and utilities, subject
to receipt of a one year maintenance bond.
TEMPORARY SIGN PERMIT - SHOREWOOD SHOPPING CENTER
Planning Department states sign meets City Ordinance, sign will
be 4' X 8' with no lights or moving parts and will advertise the
Craft Fair during week of November 14th.
Haugen moved, Stover seconded, approval of the Consent Agenda
with the removal of items B-3 and C. Motion carried and Reso-

HOME ENERGY CHECK-UP PROGRAM
Council wants to have the liability of the City clarified by the
Attorney before they act upon this issue.
AMESBURY RIGHT-OF-WAY MAINTENANCE
Mr. Dean Thomas of the Amesbury West Association was present. On
behalf of the Association he made the statement that in the future
the Association would no longer perform maintenance of the right-
of-way of Bayswater Road on the side of the street opposite to the
Development. Mr. Thomas also submitted applications from the four
property owners who own the mailboxes located on the opposite side
of the street from the Development for permits to keep the mailboxes
in the right-of-way pursuant to the Shorewood City Code Section 901.
Based upon the statement made by the Association and the permits
submitted by the mailbox owners, the City Attorney recommended that
the complaint brought by the City against the Association for
illegally maintaining the right-of-way and keeping the mailboxes
in the right-of-way without a permit be continued one year for dis-
missal.
Gagne moved, Brancel seconded, to approve the permits, permitting the
mailboxes to continue in the right-of-way until such time as the
City sees fit to revoke the permits. Motion carried - 4 ayes - 1
abstention - Stover.
The Council asked Administrator Vogt to write a letter to Mr.
Peterson explaining the decision made.

Randi and Lisa Gibbs - 5365 St. Albans Bay Road
Planner Nielsen reviewed the Gibbs request for a C.U.P. to put a
second garage on the lower level, thus creating a two story garage.
The Planning Commission and Planner both recommended approval.
Stover moved, Haugen seconded, to approve the Conditional Use Permit
and the Variance. Motion carried by Roll Call Vote - 5 ayes.
Stover mentioned that the Planning Commission questioned why the
Ordinance counts gross floor area of accessory space but only the
footprint of the principal structure, and discussed comparing foot-
prints to footprints or area to area.
SIMPLE SUBDIVISION AND LOT AREA VARIANCE

Mr. Jeff Schoenwetter, Alice Goethke's representative, was present to
request dividing the property into two lots, the lot with the exist-
ing home with 24,393 square feet and a new lot approximately 16,874
in size, resulting in a variance of 3,126 square feet.

Mark Senn of Marcus Development/Y.E.S. was present. Planner Nielsen
reviewed his report.
Haugen moved, Stover seconded, to approve the Conditional Use Permit
for Multiple Commercial Signage contingent upon the following recom-
mendations from the Planner's Report dated October 26, 1988:
1. That the "Car Wash" wall sign consisting of 11.5 square
feet be removed, bringing the total signage down from 350
square feet to 339.5 square feet, thus meeting the 341 square
feet allowance.
2. That two signs, no more than three square feet in area, be
placed in a position so that they identify the entrance and
exit of the car wash.
3. That the applicant be advised of Shorewood's regulations
relative to advertising and temporary signs.
Motion carried by Roll Call Vote - 5 ayes.
Mark Senn, when questioned, brought the Council up-to-date regarding
the disposal plans for the contaminated dirt, and his dealings with
the PCA. Administrator Vogt will also continue discussions with the
PCA regarding the dirt.
DEVELOPMENT STAGE APPROVAL-BAYWOOD
SHOPS P.U.D.-DICK DREHER, DREHER AND
ASSOCIATES, INC.-5620 and 5660 MANITOU
ROAD
RESOLUTION NO.144-88
Planner Nielsen reviewed his report, stating Dreher and Associates
have already revised their site plan to meet parking lot setbacks
and reduce driveways from three to two~
Dick Dreher was present. He expressed frustration over the drainage
issue, saying the Watershed District has tabled the issue until they
have City approval of an overall stormwater management plan for the

decided against mini-storage and are now proposing large storage
sections, possibly three of them. He also said there will be
lighting on the rear side of the building. Mr. Dreher stated that
they have adequate parking and will probably never use the back two
acres of the property. The middle two acres may be used for park-
land and trails.
Engineer Osmundson discussed the drainage pattern, saying that the
pipe running north and discharging water at the adjacent property
line should direct water to the west.
Engineer Norton had suggested that the pipe to handle storm water
end at the rear of the parking lot and a swale or energy dissipator
carryon from that point.
Gagne moved, Stover seconded, to approve the development stage of the
Baywood Shops P.U.D. contingent upon the Planner's recommendations
in his Report of October 25, 1988. Motion passed by Roll Call
Vote - 5 ayes.
C.U.P./P.U.D. RESIDENTIAL ESTATE-TOM KORDONOWY-6100 APPLE ROAD
Stover reported that the Planning Commission had unanimously
approved.
Mr. Kordonowy has agreed to keep the 4.5 acre site intact, he has
no plans for future division.
There will be a public hearing held on November 28 before the City
Council to consider this proposal. No action was taken at this
time.
FINAL PLAT-BOULDER BRIDGE 3rd
ADDITION - MIKE JORGENSEN-28070 AND
28080 BOULDER BRIDGE DRIVE
RESOLUTION NO.145-89
Haugen moved, Gagne seconded, to approve the final plat of Boulder
Bridge 3rd Addition, and that an extension be granted to file the
final plat until December 31, 1988. Motion carried by Roll Call
Vote - 5 ayes.

RESOLUTION NO.146-88
Mr. Bill Ecoff was present to request permission to build on Lots 4,
5, 6, 7 and 8 of his development. He asked that the stormwater
management plan for the Glen Road/County Road 19 be accepted by the
City. Residents questioned easement locations.
The Council decided to break to have staff answer the concerns.

RESOLUTION NO.146-88
Mr. Chuck Farrell, who has a two acre parcel at 24695 Glen Road,
Mr. David Littlefield of 24775 Glen Road and Mr. John Dennis,
owner of the Shorewood Place Apartments, expressed concerns re-
garding: flucuating water levels and total capacity of pond three,
how easements through their property may affect them, who will
pay, how will funding be done and total cost. In general - how
will they be affected by the drainage? Staff gave further explana-
tion of the proposed project.
Gagne moved, Haugen seconded, to adopt the Resolution accepting the
hydrologic report and approving a stormwater management plan for
the Glen Road/County Road 19 subwatershed, thus authorizing Mr.
Bill Ecoff to go ahead with Phase two, consisting of construction
on Lots 4, 5, 6, 7 and 8, in the Towne Addition providing that he
cover the cost of constructing a pond by either a 150% Letter of
Credit or a cash deposit of $3,000.00 said amount is not in lieu
of further special assessments. Motion carried by Roll Call Vote -
5 ayes.
PETITION FOR NO PARKING SIGNS
MUIRFIELD CIRCLE (WATERFORD)
RESOLUTION NO.148-88
Ann Christian and Dick Wagner were present to discuss the parking
problem on Muirfield Circle due to construction. Ms. Christian
had a petition with seven signatures. The school bus will not
come down the street unless something is done. Various ways of
solving the problem were discussed.
Haugen moved, Brancel seconded, to have no parking signs put up on
the outside of the circle stating "No Parking - Monday through
Friday - 7:00 AM - 5:00 PM." Motion carried by Roll Call Vote -
5 ayes.
STAFF REPORT
Attorney's Report
Status Report - Plehal-Crowley vs. Lake Minnetonka Homes
(Ridge Point Development)
The City received a draft on the $42,000.00 Letter of Credit
put up by Minnetonka Homes, Inc. in the amount of $37,400.88.
Subcontractors Clover Hill and Plehal-Crowley were paid pur-
suant to court proceedings.
Administrator Vogt read a letter from Gary and Carol Dorale, of
5905 Country Club Road, referring to conditions set forth in an
easement agreement asking for replacement of shrubs, trees,
sodding correction where bare patches were left between rolls of

Status Report - Plehal-Crowley vs. Lake Minnetonka Homes
(Ridge Point Development)
sod, and recementing of mailbox. Upon researching the issue,
Administrator Vogt discovered that although the City has two
easement copies, one between the City and the Dorales, and one
between Fullerton Financial Corporation, the Dorales have two
additional easement agreements, one between Lake Minnetonka
Homes, Inc. and one between the Dorales and the Andersons.
The requested repairs were not included in plans and specifi-
cations for the development and are not subject to reimburse-
ment from the Letter of Credit. The Dorale's will have to
approach the Anderson's as the above items were mentioned in
their easement. Because the City was not even aware that the
above easements existed, it has been suggested that there be a
clause in the development agreements that any written agreements
with neighbors be included with the development agreement in
order to offer better protection to Shorewood citizens.
Loverien/Henney et al vs. City of Shorewood-Appeal
The Plaintiffs have appealed the decision of the trial court.
We've contacted the League of Minnesota Cities relative to our
insurance coverage and the possibility of their submitting an
amicus brief.
Engineer's Report
Status Report-Shady Island Bridge Repair
Engineer Osmundson said that Park Construction Company has sent
letters to all residents that will be affected by the bridge
repair telling them the construction schedule and that there
will be power outages from time to time. The Police, Water
Patrol, and Fire Department have also been informed of the re-
pair and temporary power outages. It will take approximately
one-half hour to do each pile. Work will take approximately
one week.
Cost Estimate for Water - Covington Road
The City received a request for a cost estimate for a watermain
extension on Covington Road. The total cost estimate for a
twelve inch line approximately 800 feet in length is $35,000.00-
$40,000. Council asked Administrator Vogt to inform interested
parties that their cost would be around $10,000.00 and to see
if they are still interested before proceeding with a cost esti-
mate.

Union Negotiations
Administrator Vogt informed the Council that the first meeting
on union negotiations will take place November 22.
New Finance Director
Al Rolek, the new Finance Director, started work with the City
on November 14.
Comparable Worth
Jim Schultz and Karen Olson will meet with Administrator Vogt to
discuss comparable worth on December 1, 1988.
MAYOR'S REPORT
Council Vacancy
Mayor Rascop asked the newspapers if they would advertise the fact
that anyone interested in the unexpired two year Council term
should write a letter to the Council expressing their interest. The
deadline for receipt of letters is December 1, 1988. A couple of
letters have already been received.
LMCD Advisory Committee - Subcommittee Addressing Shore land
Management
A person will be appointed from each 14 Cities to attend two or
three meetings to study the Shoreland Management issues.
Haugen moved, Stover seconded, to appoint Planner Nielsen to the
Shore land Management study committee. Motion carried - 5 ayes.
Mayor Rascop will also attend the meetings.
Policy on Compensatory Time for Exempt Employees/Grievance Policy -
Open Door Policy
Mayor Rascop stated he would like to see policies on the above set
before he leaves office. He said he didn't feel they had been
handled too well in the past.
A meeting was set for 7:30 P.M. on Monday, November 21,1988.

Private Well - Amesbury Pond
Haugen said the Amesbury Association wants to drill a private well
to be used for filling the pond.

Upgrading City Property
Stover inquired about the update on City Hall parking area. Planner
Nielsen has the plan on his drawing board. Funds are budgeted for
construction to take place in 1989.
Auditor Proposals
Councilmember Stover suggested that Auditor's proposals be requested
before the first of the year. Mayor-elect Haugen indicated that
this is a topic of discussion with each Councilmember and RFP's
will be ordered soon.
Snowmobile Ordinance
Council asked why the Ordinance had not been reviewed. Staff said
they had only received one complaint. Councilmembers said they have
received many complaints on speed, late hours, not living up to the
agreement, some people don't want snowmobiles at all. They want it
on the Park Commissions next agenda for review.

The City has received a petition (Exhibit A. attached) from Shorewood and
Minnetonka residents requesting stop signs at the intersection of Vine Hill
Road and Hanus Road. Since Vine Hill Road lies on the common municipal
boundary of Shorewood and Minnetonka. the City of Minnetonka has also been
presented with a petition.
Upon receipt of the petition Shorewood staff contacted the Minnetonka
Engineering Department. It was decided that Minnetonka was in a better
position than Shorewood (i.e. staffing and equipment) to conduct a detailed
study relative to the volume and speed of traffic along Vine Hill Road.
When the speed study was completed. the two staffs met to discuss the matter.
The report prepared by the Minnetonka Engineering Department (Exhibit B.
attached) reflects the recommendation of both staffs. Essentially the report
states that not only are stop signs an inappropriate way to reduce speed or
volume of traffic. but stop signs in that location may present more of a hazard
than already exists.
Although the stop signs are not recommended. excessive speed along Vine Hill
Road is recognized as a problem. The speed study prepared by Minnetonka has
been referred to both the SLMPSD and Minnetonka Police Department for
consideration of increased patrol.
As a final note. the Shorewood staff feels strongly that both traffic speed and
volume north of Covington Road will be reduced at such time as the collector
alignment for the area is changed over to Old Market Road. As you recall
Shorewood's plan is to encourage traffic to use the new alignment by curving
Vine Hill Road from the south into Covington Road/Old Market Road. Vine Hill
Road from the north is intended to "T" into the new collector street. A stop
sign would be placed at that location at that time.

As with the request for a multi-way stop sign at Highland
Road and Highwood Drive, the data for this intersection does
not reasonably approach the limits established by warrants
for a multi-way stop installation. There are, however, a
couple of characteristics which are interesting.
petitioners have requested that north/south traffic on
Hill Road be stopped at its intersection with H~us
Presently, Vine Hill Road is uncontrolled, and Hanus
regulated by a stop sign. The average daily traffic
are shown on the attached graphic, and the Police
reveal no reported accidents during the 1986-87-88
The first characteristic is vehicular speed. While the
posted speed limit is 30 m.p.h., approximately 76 percent of
the vehicles are traveling in excess of that rate.
Additionally, approximately 23 percent of the vehicles
recorded were traveling in excess of 40 m.p.h.
The second noteworthy characteristic is that of sight
distance. Stopping sight distance to the south of Hanus
Road is approximately 270 feet. Vegetation is a nominal
factor, and some trimming is warranted. However, the
definitive constraint is a fairly flat crest vertical
curve. Some jUdiCious trimming would assure that the full
270 feet of sight distance is available, which would be
adequate for vehicles traveling at 40 m.p.h.
To the north of Hanus Road, sight distance is also somewhat
impaired by vegetation encroaching into the right-of-way.
The Operations and Maintenance Department should consider
some trimming to ensure maximum sight distance is provided.
Additionally, a speed limit sign with a weight limit sign
posted beneath it is located along the east side of,Vine
Hill Road north of Hanus Road. It is too close to the
intersection and does block out a relatively significant
portion of Vine Hill Road within which southbound traffic
could be obscured. Because the statutory speed limit is 30
m.p.h., the speed limit sign is technically not necessary
and could be removed entirely. At a minimum, the sign
installation should be relocated to a point between 50 and
100 feet further north of its present location.
The petitioners' concern with speeding traffic is valid,
given that approximately three-fourths of the vehicles on
Vine Hill Road are traveling in excess of the posted speed
limit. The installation of stop signs, however, is not an
appropriate means for controlling vehicular speeds. Because
of the sight distance constraints with respect to northbound
traffic, and because of the relatively steep downgrade for
southbound traffic approaching the intersection, the
installation of stop signs on Vine Hill Road would be likely
to create a very significant hazard with respect to the
potential for rear end collisions. .

introduced by the placement of stop signs, it is staff's
recommendation that the placement of stop signs regulating
traffic on Vine Hill Road not be ordered.
Because the westerly half of Vine Hill Road is under the
jurisdiction of the City of Shorewood,. they were also
petitioned for installation of stop signs at this location.
After officials of both municipalities had an opportunity to'
review the data, we met to discuss the issue and jointly
reached the same conclusion. The Shorewood Council will
also be considering a similar negative recommendation at
their November 28, 1988 meeting.
Based on the preceding findings, our recommendation is that
the stop signs not be installed as petitioned. Our further
recommendation is that the Operations and Maintenance
Department be directed to provide trimming of the vegetation
as is necessary to maintain adequate sight distance, and to
also remove or relocate the signs north of Hanus Road that
obstruct sight distance to the north. A copy of this report
has been forwarded to the Chief of Police for his review and
possible consideration of additional enforcement activity
along Vine Hill Road.

Mr. Jack Hendrickson has submitted a final plat for Hendrickson Acres (see
Exhibit A. attached). The preliminary plat was approved in July of this year
with a number of conditions.
The plat complies with the requirements of the R-1A zoning district and the
conditions imposed in the preliminary plat approval. approval is therefore
recommended subject to the following:
1. The applicant must submit an up-to-date (within 30 days) title opinion for
review by the City Attorney.
2. The resolution approving the final plat should stipulate that any future
division of Lot 4 must be done as a formal plat.
3. The applicant must pay park dedication fees in the amount of $1500.
4. The applicant must advise the City Clerk as to how he wants sewer
equalization charges spread against the property.
5. Items 1.. 3. and 4. above must be completed within 30 days of the Council's
approval of the final plat. Once the applicant has received the Council
resolution approving the plat. he must record it within 30 days.

Ms. Janet Poulson has requested an occupancy permit to use the Vine Hill
Furniture Store as a retail children's clothing store. The property is located
at 19385 State Highway 7 (see Site Location map - Exhibit A~ attached).
Section 1201.07 Subd. 1 requires a certificate of occupancy whenever a change
in occupancy occurs on an existing building. Shorewood policy requires Council
approval of commercial permits. The intent of these requirements is to review
site and building plans for conformance with current zoning requirements.
The attached floor plan and site plan (Exhibits B and C~ respectfully) are
considered quite sketchy at best. However~ since the proposed business
constitutes primarily a change in occupancy (retail to retail) rather than a
change in land use~ the plans may be adequate for review.
The existing building is nonconforming in terms of building and parking
setbacks. Since no physical improvements are proposed for the site at this
time~ it would be impractical to expect that the conformity of the building or
site be upgraded as part of this request.
Parking for the site is grossly substandard~ both in terms of setbacks and
number of spaces. As can be seen on the site plan there are 20 existing
spaces~ seventeen of which extend into the public right-of-way. Based upon the
gross floor area of the building (7172 square feet~ including the liquor store)
the site should have 32 spaces. Following is how the parking space calculation
is derived:
gross floor area (7172 sq. ft.) - 10% (717.2 sq. ft.) = 6454.8 sq. ft.

Despite the nonconformity~ there is ample room east of the building to
accommodate considerably more parking. It is not recommended~ however~ that
parking be brought into conformity at this time. This is based on the idea
that the use (retail) is not changing. More importantly~ it is not known at
this time what effect the MNDOT plans for the Vine Hill Road intersection will
have on this site. Until such time as their plans havp been completed and/or
until a change in the use of the building is proposed~ it is suggested that the
existing parking be considered adequate.
An. issue which the City has attempted to resolve in the past is the
nonconforming roof sign currently located on top of the building. Although
most of the previous sign has been painted over~ the sign board still remains
and several letters from the previous message are still visible. While it
would be desirable to Qave the sign structure removed~ the City Attorney has
advised us that once the letters can not be read~ the structure.is technically
no longer a sign. It is therefore recommended that the occupancy permit be
issued subject to the remaining portion of, the sign being painted over.

When the 1989 departmental budgets were submitted it was suggested that
computer software for the Building Inspection Department be handled as a 1988
budget amendment. Our original"figures amounted to approximately $7800. Since
the Finance Department will be switching over entirely to the System 36. we
will be able to use the hardware of which they are no longer in need. What
this does is reduce the proposed budget amendment to $5500.
From a financial perspective there should be ample money available from
building permit fees which have greatly exceeded our 1988 revenue estimates.
We originally projected $130.000 in revenue for 1988. Through the end of
October we have taken in $253.013.171
It is the feeling of this department that the proposed software will greatly
improve the efficiency of day to day permit issuance. monthly and annual
reporting and inspection tracking.

Attached is a copy of the proposed Ordinance Amending Section 703.04 of
the Shorewood City Code providing for the trapping of muskrats and beavers.
This provision would permit the Council to review each trapping request on
a case by case basis. After hearing the applicant's request and determining
that a permit should issue, the Council would then set the conditions of the
permit which would include:
1. name of the trapper and DNR license number,
2. location where the trapping would occur,
3. approval of the party on whose property the trapping would occur,
4. the period for which the permit would be valid,
5. the type of animal to be trapped.
The conditions could also include such things as the design of the trap, the
frequency with which the trap line would have to be checked by the trapper
and any other conditions or restrictions which might be applied to a particular
situation.
It should be emphasized that this amendment to the Code would not automatically
permit the use of traps in the City, but would give the Council the discretion
to issue a permit for" trapping in those special instances where it appeared
proper.

AN ORDINANCE AMENDING SECTION 703.04 OF THE
SHOREWOOD CITY CODE PROVIDING FOR
THE TRAPPING OF MUSKRATS AND BEAVERS
THE CITY COUNCIL OF THE CITY OF SHOREWOOD, MINNESOTA, ORDAINS:
Section 1. Section 703.04 of the Shorewood City Code is hereby amended by
adding a new subdivision to read as follows:
"Subd. 3. The sale or use of other traps for the trapping of
muskrats or beavers by State licensed trappers, providing such
trapping is specifieally authorized by the City Council. Such
authorization shall be by special permit. This permit shall
contain such conditions and provisions as the Council may deem
appropriate. Permits shall be issued for a period not exceeding
six (6) months, and may be renewed by Council action."
Section 2. This Ordinance shall be in full force and effect from and
after its passage and publication.
ADOPTED BY THE CITY COUNCIL of the City of Shorewood, Minnesota, this

On 14 March, after considerable discussion, the City approved
conditional use permits for the Crepeau Dock property which
allowed the Garden Patch store to remain open and even expand
their operation. The approvals were subject to a number of
conditions, one of which was that the parking lot be brought
into compliance with current ordinance standards. Although
the parking lot was required to be paved, curbed and striped,
there was no deadline imposed for compliance.
We have now gone through an entire construction season and the
improvements have not been made. It is recommended that the
City Council adopt a resolution requiring that all site improv-
'!lents, particularly the parking lot; be completed per the /
approved plans bylJune 1989. Failure to comply should result
in revocation of the conditional use permit and the expiration
of the permit which allowed the Garden Patch to exist in that
location.

CALL TO ORDER
Chairman Vogel called the meeting to order at 7:00 PM.
ROLL CALL.
Present: Chairman Vogel, Commissioners Laberee, Jakel, Lindstrom, Andrus, Weatherly,
and Christensen; Engineer Norton; and Deputy Clerk Niccum

Engineer
Engineer Norton was present to review the major concerns expressed by the Commission,
and what's been done about them. He said that, according to the discussion at the
last meeting, he felt the three main concerns were 1) rocks, 2) particle size and
undulations, and 3) overall grading.
Engineer Norton reviewed the contracts for the two projects. Project 87-5 with
Widmer, cost $49,355, was to take the site material and spread it according to the
grading plan. The seeding that originally went with this project was dropped from
Widmer's contract. Project 88-2 with T. & S. Construction, cost $75,777.70, was
water, parking lots, ball field surfacing, and seeding.
Engineer Norton said Phil Tipka was at Freeman Park most of the time when Widmer
was doing the grading. He also said he gave a copy of the grading plan to the
surveyor and had the surveyor put red lathes topped by blue ribbon at each grid
point. The surveyor shot the existing grade as it is today. Norton said there
is not a significant difference. He pointed out one spot (grid point H-8) where
there is a difference of 2.4' and explained that this was the original berm area,
it does not affect either the softball or football fields. He said the spots where
the grade is off are areas where extra dirt was originally stockpiled. He said
a +1' to a-I' variance in slope is allowable, and the field is pretty well graded
as planned. The base lines are also marked with natural colored lathes topped with
red ribbon. He suggested the Commission get out to the park as soon as possible to
look at it before the lathes are removed by someone. The grid is a 100' grid which
means the grids are 100' apart.
Most of the problems appear to be in the Northeastern corner field. When Engineer
Norton talked to Phil Tipka, Tipka said at the time of grading he did not see the
swale. Now he does and said it needs fill. He also said the ag lime has to be
taken off the top, off the perimeter and smoothed out, then regraded. Tipka said
he didn't remember seeing that many rocks. Norton said T. & S. Construction had
people picking rock for two to three days. He said after that they followed
directions to disc and mulch and the discing apparently turned up more rocks. He
also reminded the Commission to remember the condition of the fill, referring to
Shorewood Oaks, Smithtown Road, Grant Lorenz Road, and the City Hall material.
Commission asked who gave him permission to dump all that material in the park?
Norton said it was a staff decision.
The Commission told Engineer Norton that they are extremely disappointed in the
work done. They said that they were under the impression that once this work was
done, the fields would be completed and ready to play upon and instead felt as
though they have spent $100,000 on another alfalfa field, the only difference being
that the dirt on the original field was better! They felt the Council also thought
they would end up with a finished product.

Engineer Norton said that apparently there was a misunderstanding between himself
and the Park Commission, he said he did what he was directed to do, and was aware
all the time that the field would need fine grading, topdressing, etc. He said he
was under the impression that the Commission wanted a well graded, well drained
plan with the understanding that more work would be needed later on, and that it
would be finished later when curb, gutter, etc. were done. He feels that he and
the Commission had different expectations. He said Banshee Enterprises, a
subconstractor for T. & S., will come back out and remove rocks. He suggested
paying T. & S. the $13,107.l4 denied at the last meeting, but continuing to
withhold the $3665.65 until the work is finished. He also suggested talking to
Widmer in the Spring when they come to fill in the swale about purchasing black
dirt and having them spread it, fine grading it. He also mentioned additional
seeaing. He said the money withheld from T. & S. should pay for the dirt.
Commissioner Lindstrom, Engineer Norton, and Phil Tipka visited Freeman Park
this afternoon and all agree that more work needs to be done.
The Commission asked that the Council Minutes be checked to see what had been
ordered done.
Engineer Norton left the meeting.
The Commission definately feels that their requests are not being honored but
wish to have a joint meeting with the Council as soon as possible to try to
discover where the problem exists, and why the fields are not finished.
Christensen moved, Jakel seconded, to adopt the Engineer's suggestion and to
recommend to Council that they pay T&S the amount of $13,107.14, and withhold
$3665.65 until the rock is collected. Motion carried - 7 ayes.
Lindstrom moved, Jakel seconded, to withhold the Engineer's payment until the
details are worked out and resolved in Freeman Park.
There was a lot of discussion on this issue. Some Commissioners felt that all
payment whould be withheld. The Commission is aware of the fact that the
Engineer has probably already been paid.
Motion carried - 4 ayes - 3 nayes (Weatherly, Andrus, & Lindstrom)
Laberee moved, Jakel seconded, to recommend to Council that a joint meeting
between the Council and Park Commission be set as soon as possib1e.to resolve
some communication problems i.e. ba11fie1ds. Motion carried - 7 ayes.
Fence Field Area to Prevent Vandalism
Commissioner Laberee expressed his concern over the possibility of 3 and 4-wheel
vehicle damage to the fields.
Christensen moved, Laberee seconded, to recommend to Council that Public Works
erect snow fencing around the field, Laberee and Lindstrom to be present to
show where they want the fencing. Motion carried - 7 ayes.
Highway 7 Entrance
Commissioner Laberee will see if a student working for him can talk a teacher into
using an entrance design as a project.

The Commission discussed the location of the signs in Freeman Park.
Documentation
The Commission asked for Council Minutes, Specifications, Bid Documents, etc.
relating to the ballfields.
SNOWMOBILE ORDINANCE
Staff reported that the Council definately wants the Commission to review the Snowmobile
Ordinance. Various Councilmembers state they have received numerous complaints.
Chairman Vogel said the review will be on the agenda for December 5th as several of
the Commissioners have not been with the City long enough to be familiar with the
history.
Bill Kullberg of Southwest Trail Association was present to state signs directing
snowmobile traffic will be reposted next weekend. He also presented a letter to
the Council and Commission with an invitation to ride the trails so they know what
they are dealing with, where trails start, lake accesses, etc.
JOINT COUNCIL-PARK COMMISSION MEETING
The Joint Council/Park meeting will be held Monday, December 5, at 7:00 PM.

As per your reques~ ~or a comple~ion date for ~he parking lo~ in
~he fron~ o~ our buildings, we plan to have the parking lo~ installed
in ~he middle o~ Augus~, 1989. We think a date be~ween 8/15/89 and
9/1/89 would be better than the 6/1/89 date that you proposed for the
~ollowing reasoDS.
Crepeau Dock and The Garden Patch are both seasonal businesses with
the peak period of their business in April, May, and June. We both
do approxima~ely 70 per cent of our business in that period. It. would
be very difficult. to install the driveway in those months; and without
parking, people would have to park all along Highway 19 which is Tery
dangerous. Therefore, August 15 or Sept. 1 would be more appropriate
as we could get the curbing installed first and then pave half ot the
driveway at a time and allow parking for each side, k.eeping the people
off the highway.
A dela.y has occurred in installing the driveway in 1988 because of the
drought. We had thought we had the correct grading done in the spring
to improve the drainage, which had always been a big problem as much
ot the water trom the driveway area had tlowed toward The Garden Patch
and had not been diverted. We had the grading done, and we thought it
was correct; but it never rained enough to really know that there still
was a problem. In the fall, the rains started to come slowly and we
could then tell that the water flow had not been changed enough. We
then had the grading redone. Unfortunately, it was completed too late
in the fall for the contractors to complete the curbing and blacktopping.
Not realizing that you wanted a date for completion, we delayed the pro-
ject until we could. complete it all at once.
We have contracted both Schmidt Curb Co., Ine. and Dawson Blacktopping
f or the work.
